calluíonn an abairt “Ceanntar na Forghasa” an ceanntar siltin do bunuíodh leis an Moladh Deiridh dar dáta an 30adh lá de Dheireadh Fómhair, 1860, agus ar ar thug an moladh san Ceanntar na Forghasa;
cialluíonn an abairt “an Moladh Deiridh dar dáta an 30adh lá de Dheireadh Fómhair, 1860,” an Moladh Deiridh do rinne na Coimisinéirí ar an dáta san maidir le Ceanntar na Forghasa.
Comhairle an Chláir do thógaint tailimh.
2.—(1) Is dleathach do Chomhairle an Chláir na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so do thógaint i mbith-dhílse, do réir cláis (A) de mhír 1 den Toiliú Sceidealta agus tré chó-aontú no go héigeanta, agus iad saor agus glan o gach cíos, blianacht, muirear, agus eire ar bith ar phraghas sé púint déag an t-acra reachtúil.
(2) Is dleathach do na Comhairlí gach duine fé leith de dhílseánaigh na dtailte luaidhtear sa Dara Sceideal a ghabhann leis an Acht so do shaoradh o na rátaí siltin uile bheidh dlite no ag teacht chun bheith dlite do na Comhairlí ón dílseánach san, maidir lena chuid-sean de na tailte sin, ar dháta aistrithe an chéanna chun Comhairle an Chláir.
(3) Is dleathach do Chomhairle an Chláir gach duine fé leith de shealbhairí na dtailte tuairiscítear sa Dara Sceideal a ghabhann leis seo do shaoradh ón ráta dealbhais uile bheidh dlite no ag teacht chun bheith dlite don Comhairle sin ón sealbhaire sin, maidir lena chuid-sean de na tailte sin, ar dháta aistrithe an chéanna chun na Comhairle sin, agus chun na críche sin is dleathach don Chomhairle sin gach cion-roinnt riachtanach do dhéanamh ar an ráta dealbhais i gcás aon ghabháltais rátuithe áirithe ná beidh ach cuid de isna tailte sin.
(4) Nuair a bheidh na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so aistrithe chun Comhairle an Chláir, beid ina gcuid d'oibreacha siltin Cheanntar na Forghasa agus féadfaidh na Comhairlí iad d'úsáid mar thaisc-iomar tuile no chun aon chríche eile bhainfidh le hoibriú no cothabháil na n-oibreacha siltin sin.
(5) Beidh feidhm ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845, arna leasú no arna oiriúnú le hachtacháin iaraimseardha no fútha, maidir le Comhairle an Chláir do thógaint go héigeanta oiread de na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so ná tógfar tré chó-aontú agus, chun críche na feidhme sin, is tuigthe gurb iad Comhairle an Chláir bunathóir an ghnóthais.
Rann-íoo ón Aire i leith praghas na dtailte tógfar.
3.—(1) Má dhéanann Comhairle an Chláir na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so do thógaint fén Acht so féadfaidh an tAire pé suim, nach mó ná dhá mhíle agus cúig céad punt agus a mheasfaidh is ceart, d'íoc leis an gComhairle sin as airgead a sholáthróidh an tOireachtas.
(2) An t-airgead uile íocfaidh an tAire le Comhairle an Chláir fén alt so úsáidfidh an Chomhairle sin é mar rann-íoc i leith an phraghais íocfaidh an Chomhairle sin as na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so ar iad do thógaint fén Acht so.
(3) An t-airgead íocfaidh an tAire fén alt so le Comhairle an Chláir is tuigthe é íoc i nglanadh agus i gcólíonadh na hoblagáide forchuirtear, le Clás (A) de mhír 2 den Toiliú Sceidealta, ar na Coimisinéirí chun suim de dhá mhíle agus cúig céad punt do ranníoc, agus léireofar gach tagairt atá sa Toiliú Sceidealta don tsuim de dhá mhíle agus cúig céad punt a sholáthróidh na Coimisinéirí mar thagairt don airgead íocfaidh an tAire le Comhairle an Chláir fén alt so.
Na Comhairlí do sholáthar £6,000.
4.—(1) Féadfaidh na Comhairlí, de bhun cláis (C) de mhír 1 den Toiliú Sceidealta, suim ná raghaidh thar sé mhíle punt do sholáthar as a gcistí contae fé seach chun na gcrícheanna luaidhtear sa Chlás san (C).
(2) Airgead a sholáthróidh na Comhairlí fén alt so soláthrófar é amhlaidh sna cionúireachtaí so leanas, sé sin le rá, soláthróidh Comhairle an Chláir ·98841 den airgead san agus soláthróidh Comhairle na Gaillimhe ·01159 de.
(3) Déanfar an t-airgead a shóláthróidh na Comhairlí fen alt so d'úsáid chun na gcrícheanna uile agus fé seach a luaidhtear i gclás (C) de mhír 1 den Toiliú Sceidealta.
(4) Déanfaidh Comhairle na Gaillimhe pé cuid (más ann) de na costais a luaidhtear fén mír-cheann “Sixthly” i gclás (C) de mhír 1 den Toiliú Sceidealta ná beidh glanta as an airgead a sholáthróidh na Comhairlí fén alt so do chruinniú agus d'íoc tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán.
(5) Chun an t-airgead do sholáthar a húdaruítear dóibh a sholáthar fén alt so is cead go dtógfadh Comhairle an Chláir agus go dtabharfadh an tAire ar iasacht as an gCiste Iasachtaí Áitiúla suim nach mó ná méid an airgid a húdaruítear a sholáthar amhlaidh, fé is dá mba chríoch a luaidhtear in Airteagal 22 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, soláthar an airgid sin.
(6) Féadfaidh Comhairle na Gaillimhe an t-airgead a húdaruítear dóibh a sholáthar fén alt so do chruinniú tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán no is cead, chun an t-airgead san do sholáthar, go dtógfadh an Chomhairle sin agus go dtabharfadh an tAire ar iasacht as an gCiste Iasachtaí Áitiúla suim nach mó ná méid an airgid sin fé is dá mba chríoch a luaidhtear in Airteagal 22 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, soláthar an airgid sin.
(7) Airgead a thógfaidh ceachtar de na Comhairlí ar iasacht fén alt so ní háirmheofar é mar chuid d'fhiacha na Comhairle sin chun crícheanna Airteagail 22 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898.
Na Coimisinéirí do dhéanamh oibreacha.
5.—(1) Is dleathach do na Coimisinéirí dul isteach ar na tailte i gCeanntar na Forghasa agus na hoibreacha luaidhtear i gclásanna (D) agus (F), fé seach, de mhír 2 den Toiliú Sceidealta do dhéanamh agus do chríochnú ann agus, chun na críche sin, beidh ag na Coimisinéirí agus is cead go n-oibreoidís, gach ceann no aon cheann no cinn de na comhachta do bheirtear dóibh leis na hAchtanna chun Dréineáil do Choinneáil Suas, 1886 agus 1924, maidir le hoibreacha siltin do dhéanamh no do dheisiú.
(2) Deimhniú fé láimh innealltóra arna cheapadh chuige sin ag na Coimisinéirí á dheimhniú gur scrúduigh sé na hoibreacha do rinne na Coimisinéirí fén alt so agus go bhfuil ar na hoibreacha san na hoibreacha uile luaidhtear i gclásanna (D) agus (F) fé seach de mhír 2 den Toiliú Sceidealta agus go bhfuilid críochnuithe chun a shástachta, beidh sé ina fhianaise dho-chlaoite chun gach críche ar na hoibreacha san a luaidhtear sna clásanna san fé seach do bheith críochnuithe go cuibhe ag na Coimisinéirí do réir an Toilithe Sceidealta.
Na hoibreacha nua d'ionchorprú in oibreacha siltin na Forghasa.
6.—(1) Ar bheith críochnuithe do na hoibreacha (dá ngairmtear na hoibreacha nua san alt so) a luaidhtear i gclásanna (D) agus (F) fé seach de mhír 2 den Toiliú Sceidealta, ansan, na hoibreacha san agus na hoibreacha siltin (dá ngairmtear na seanoibreacha san alt so) a luaidhtear i Sceideal B a ghabhann leis an Moladh Deiridh dar dáta an 30adh lá de Dheireadh Fómhair, 1860, isiad san in éineacht, chun gach críche, oibreacha siltin Cheanntar na Forghasa feasta ach san, i dtaca leis na seanoibreacha dhe, sa mhéid amháin go mbeidh na hoibreacha san riachtanach chun crícheanna an Cheanntair sin.
(2) Chun éifeacht a thabhairt don fho-alt san roimhe seo den alt so déanfaidh na Coimisinéirí, le hordú dhéanfaid nuair a bheidh na hoibreacha nua críochnuithe, Sceideal B a ghabhann leis an Moladh Deiridh dar dáta an 30adh lá de Dheireadh Fómhair, 1860, do leasú i slí go mbeidh na hoibreacha siltin a tuairiscítear sa Sceideal san B arna leasú leis an ordú san có dhéanta de na sean-oibreacha (sa mhéid go mbeidh na hoibreacha san riachtanach chun crícheanna Cheanntar na Forghasa) agus de na hoibreacha nua.
Na Coimisinéirí do dhéanamh orduithe mhuirir.
7.—(1) Chó luath agus is féidir é tar éis dáta an Achta so do rith déanfaidh na Coimisinéirí ordú (dá ngairmtear san alt so agus in áiteanna eile san Acht so an t-ordú muirir fén Acht so) lena muirearófar do réir an ailt seo na suimeana so leanas (dá ngairmtear san alt so na suimeanna muirearuithe) maraon le hús ortha o dháta an orduithe do réir an ráta ghenerálta bhaineann le hiasachtaí siltin a thug na Coimisinéirí na tráthanna do rinneadar na réimhíocanna dá bhfuil an tsuim chaipitiúil a luaidhtear i mír (a) den fho-alt so códhéanta, sé sin le rá:—
(a) an tsuim chaipitiúil d'aon mhíle dhéag, céad agus dhá phunt sheachtód, aon scilling déag, agus trí pingne luaidhtear i gclás (B) de mhír 2 den Toiliú Sceidealta, agus
(b) an tsuim de dhá chéad agus dhá phunt ochtód, deich scillinge, agus cheithre pingne atá dlite do na Coimisinéirí ar scór an réimhíoca do thugadar d'iontaobhaithe Cheanntar na Forghasa sa bhliain 1918, agus
(c) suim is có-ionann le cúig seachtód fén gcéad de mhéid iomlán na gcostas agus an chaiteachais (arna meas ag na Coimisinéirí) a bhainfidh no a ghabhfaidh leis an ordú d'ullmhú agus do chríochnú.
(2) Beidh feidhm agus éifeacht ag na forálacha so leanas maidir leis an ordú muirir fén Acht so, sé sin le rá:—
(a) déarfaidh agus déanfaidh an t-ordú san na plásáin no na paistí tailimh uile agus fé seach atá sna tailte luaidhtear i Sceideal A a ghabhann leis an Moladh Deiridh dar dáta an 30adh lá de Dheireadh Fómhair, 1860 (ach amháin na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so) do chur fé mhuirear íoctha na suimeanna muirearuithe agus an úis ortha le comhairle na contae ina bhfuil an plásán no an paiste tré dhachad íocaíochta leath-bhliantúla codroma ar na laetheanta ceapfar leis an ordú, agus an chéad lá aca san do bheith, chó comhgarach agus is caothúil, sé mhí tar éis dáta an orduithe sin;
(b) leagfaidh na Coimisinéirí amach san ordú san na plásáin agus na paistí tailimh uile agus fé seach a bheidh á muirearú leis de bhun na míre sin roimhe seo den fho-alt so agus, fós, na cionúireachta deachúla ina mbeidh na plásáin no na paistí sin le muirearú amhlaidh;
(c) áirmheofar agus ceapfar na cionúireachta deachúla san ag na Coimisinéirí agus, gan aon ordú eile, isiad san na cionúireachta ina mbeidh ar na plásáin agus na paistí uile agus fé seach san rann-íoc do dhéanamh i leith íoctha na suimeanna muirearuithe agus an úis ortha agus i leith an ráta chothabhála siltin i gCeanntar na Forghasa agus ní bheidh ar aon phlásán ná paiste den tsórt san cionúireacht is mó ná san de na suimeanna muirearuithe no den ús no den ráta san do rann-íoc;
(d) nuair a bheidh na cionúireachta deachúla san á n-áireamh ag na Coimisinéirí bhéarfaid áird chuibhe ar na tailte tuairiscítear sa Dara Sceideal a ghabhann leis an Acht so do bheith dúnta amach o na tailte bheidh á muirearú leis an ordú san, agús féadfaidh na Coimisinéirí áird a thabhairt ar na cóipeanna bheidh ar seilbh aca de na mapaí agus na leabhair luachálaithe agus na scríbhinní eile do hullmhuíodh maidir le bunú Cheanntar na Forghasa;
(e) déanfaidh agus déarfaidh an t-ordú san freisin a chur mar mhuirear ar chistí contae fe seach Chomhairle an Chláir agus Chomhairle na Gaillimhe na suimeanna muirearuithe agus an t-ús ortha d'íoc, na tráthanna agus sa tslí luadhfar san ordú san, leis na Coimisinéirí, go rátúil sna cionúireachta (a luadhfar san ordú san) ina mbeidh méideanna na suimeanna muirearuithe agus an úis ortha á muirearú leis an ordú san ar thailte i gcontae an Chláir agus ar thailte i gcontae na Gaillimhe.
(3) Maithtear leis seo an t-ús uile bheidh dlite don Chiste Iasachtaí Áitiúla ar dháta an orduithe mhuirir fén Acht so o cheachtar de na Comhairlí maidir leis an suim chaipitiúil d'aon mhíle dhéag, céad agus dhá phunt sheachtód, aon scilling déag agus trí pingne is cuid de na suimeanna muirearuithe, agus dá réir sin ní bheidh an t-ús san iníoctha ná ionbhainte amach.
(4) Dearbhuítear leis seo gurb í an tsuim de dhá chéad agus dhá phunt ochtód, deich scillinge agus cheithre pingne, is cuid de na suimeanna muirearuithe, an méid iomlán (d'ainneoin aon úis pheannaidigh no puntáiste bheidh fásta) atá dlite ar dháta an Achta so do rith do na Coimisinéirí ar scór an réimhíoca do thugadar d'iontaobhaithe Cheanntar na Forghasa sa bhliain 1918.
(5) An tsuim a cuirfear sna suimeanna muirearuithe maidir leis na costais agus an caiteachas a bhainfidh no a ghabhfaidh leis an ordú muirir fén Acht so d'ullmhú agus do chríochnú, réimhíocfar as an gCiste Iasachtaí Áitiúla í agus beidh sí ionaisíoctha agus ionbhainte amach sa tslí foráltar leis an Acht so.
(6) An cion de na suimeanna muirearuithe agus an t-ús ortha a muirearófar ar chiste contae cheachtar de na Comhairli leis an ordú muirir fén Acht so, íocfaidh an Chomhairle sin é leis na Coimisinéirí na tráthanna agus sa tslí luadhfar san ordú san agus íocfaidh an Chomhairle sin amhlaidh é as airgead a bhaileoidh an Chomhairle sin o dhílseánaigh no sealbhairí na bplásán no na bpaistí tailimh uile agus fé seach, i gcontae na Comhairle sin, ar a mbeidh na suimeanna muirearuithe agus an t-ús ortha á muirearú leis an ordú san agus, maran leor agus sa mhéid nach leor an t-airgead a baileofar amhlaidh, déanfaidh an Chomhairle sin an t-easnamh d'íoc amhlaidh as an gciste contae agus cruinneofar é tríd an ráta dealbhais mar mhuirear ar an gcontae iomlán.
(7) Mar bhreis agus gan docharú ar aon tslí eile chun é bhaint amach fé aon Acht eile, féadfaidh na Coimisinéirí airgead is iníoctha leis na Coimisinéirí ag ceachtar de na Comhairlí fén bhfo-alt deiridh sin roimhe seo den alt so do bhaint den Chomhairle sin trí aicsean dlí.
Comhachta agus dualgais na gComhairlí maidir le hairgead is iníoctha leo fén Acht so.
8.—(1) Gach ceann riamh de na cearta agus na comhachta agus na leighseanna do bheirtear do na Coimisinéirí leis an Drainage Maintenance Act, 1886, chun suimeanna arna muirearú le hordú muirir fén Acht san do bhaint amach, beid ag Comhairle an Chláir agus ag Comhairle na Gaillimhe ar leithligh agus féadfaid iad d'fheidhmiú chun na suimeanna muirearófar leis an ordú muirir fén Acht so ar thalamh atá ina gcontae do bhaint amach.
(2) Gach suim a muirearófar ar phlásán no paiste tailimh leis an ordú muirir fén Acht so beidh sí inghearrtha ar dhílseánach no (marab é an dílseánach san an sealbhaire freisin) ar shealbhaire an phlásáin no an phaiste sin agus iníoctha aige agus ionbhainte dhe, agus déanfaidh na Coimisinéirí pé cionroinnt is gá chun éifeacht do thabhairt don fho-alt so, ach beidh freagarthacht shealbhaire fén alt so gan dochar d'aon cheart chun aon tsuim den tsórt san íocfa sé do bhaint as an gcíos is iníoctha aige.
(3) Beidh de dhualgas ar gach ceann fé leith de na Comhairlí go mbaileoidís o dhílseánach no (marab é an dílseánach an sealbhaire freisin) o shealbhaire gach plásáin no paiste tailimh a muirearófar leis an ordú muirir fén Acht so agus a bheidh ina gcontae na suimeanna uile is iníoctha ag an dílseánach san leis an gComhairle sin fén ordú san, agus déanfar agus féadfar gach suim den tsórt san do bhailiú agus do bhaint amach sa tslí ina ndéantar agus inar féidir an ráta dealbhais do bhailiú agus do bhaint amach.
(4) Bainfidh alt 54 den Drainage and Improvement of Lands Act (Ireland), 1863, leis an airgead uile a leagfar agus a cuirfear mar ráta agus mar cháin ar dhílseánaigh aon phlásáin no paiste tailimh de bhun an mhuirir a cuirfear ar an bplásán no ar an bpaiste sin leis an ordú muirir fén Acht so.
Ordú áirithe agus comhachta, etc., áirithe do bhuan-choimeád.
9.—(1) Ní dhéanfaidh éinní atá san Acht so dochar ná deifir do bhailíocht ná d'oibriú an Orduithe dar dáta an 17adh lá de Mhí na Samhna, 1931, do rinne an tAire Riaghaltais Aiteamhail agus Sláinte Poiblidhe fé alt 20 den Local Government Act, 1898, arna leasú le halt 3 den Acht chun Dréineáil do Choinneáil Suas, 1924 (Uimh. 46 de 1924), agus lena ndearnadh gnó iontaobhaithe Cheanntar na Forghasa d'aistriú chun na gComhairlí.
(2) Ní déanfar comhachta, dualgais ná freagarthachta na gComhairlí maidir le Ceanntar na Forghasa agus le hoibreacha siltin an chéanna d'fhionnraighe ná d'fhoirceannadh, ná ní déanfar deifir dóibh, trí na Coimisinéirí d'fheidhmiú aon cheann de na comhachta do bheirtear dóibh leis an Acht so, ach ar dháta an orduithe mhuirir fén Acht so agus dá éis bainfidh comhachta, dualgais agus freagarthachta na gComhairlí, maidir le hoibreacha siltin do chothabháil sa Cheanntar san, leis na hoibreacha siltin a luaidhtear i Sceideal B a ghabhann leis an Moladh Deiridh dar dáta an 30adh lá de Dheireadh Fómhair, 1860, arna leasú ag na Coimisinéirí fén Acht so, agus ní bhainfid ach leis na hoibreacha san.

10.—D'ainneoin éinní atá sna hAchtanna chun Dréineáil do Choinneáil Suas, 1866 agus 1924, ní dhéanfaidh na Coimisinéirí aon ordú muirir fé na hAchtanna san maidir le hoibreacha do rinneadar roimhe seo i gCeanntar na Forghasa fén Acht chun Dréineáil do Choinneáil Suas, 1924 (Uimh. 46 de 1924).

11.—Ní luighfidh aon aicsean ná imeacht eile ná ní bheidh aon airgead damáiste ionbhainte amach i gCúirt ar bith i gcoinnibh na gComhairlí, in éineacht no ar leith, ná i gcoinnibh na gCoimisinéirí ná i gcoinnibh iontaobhaithe Cheanntar na Forghasa i dtaobh éinní do rinneadh no do fágadh gan déanamh aca no ag aon taobh aca maidir le Ceanntar na Forghasa tráth ar bith (pé aca roimh dháta an Achta so do rith no dá éis sin é) roimh dháta an orduithe mhuirir fén Acht so.

12.—Lasmuich de chás dá bhforáltar a mhalairt leis an Acht so is as airgead a sholáthróidh an tOireachtas, sa mhéid go gceadóidh an tAire é, a híocfar costais féna raghaidh na Coimisinéirí chun an tAcht so do chur i bhfeidhm (ar a n-áirmhítear costais déanta agus críochnuithe na n-oibreacha luaidhtear i gclásanna (D) agus (F), fé seach, de mhír 2 den Toiliú Sceidealta).

1. IT IS HEREBY CONSENTED AND AGREED by and between the County Councils of the Counties of Clare and Galway and the above-named Plaintiffs as testified by the respective Common Seals of the County Councils of the Counties of Clare and Galway hereunto affixed and by the signatures of their respective solicitors and by the respective signatures of the Plaintiffs and their solicitors as follows:—
(A) That subject to the necessary legislation enabling them in this behalf being enacted the County Council of the County of Clare shall acquire the lands shown coloured green on the map annexed hereto containing 272 acres, or thereabouts, statute measure. The said lands shall be acquired by the County Council of the County of Clare at the price of £16 0s. 0d. per statute acre and shall be conveyed to the said Council in fee simple freed and discharged from all rents, annuities, charges and encumbrances whatsoever. The said price of £16 0s. 0d. per statute acre shall be paid and accepted in full satisfaction of all claims in respect of or in anywise arising out of such acquisition. The said lands when so acquired by the County Council of the County of Clare shall form part of the drainage works but shall not otherwise be included in the Charging Order hereinafter mentioned.
(B) That subject to the necessary legislation enabling them in this behalf being enacted the County Council of the County of Clare shall relieve the owners of the said lands to be so acquired from all liability for all arrears of rates due in respect of the said lands to be so acquired and shall take all necessary steps to relieve the Plaintiffs from such liability.
(C) That subject to the necessary legislation enabling them in this behalf being enacted the County Councils of the Counties of Clare and Galway shall provide a sum not exceeding £6,000 0s. 0d. in the proportions hereinafter mentioned to defray the payment of the following sums:—
Firstly—in payment of the balance of the purchase money of the said lands to be so acquired after allowing for the sum of £2,500 0s. 0d. hereinafter mentioned which is to be provided by the Commissioners of Public Works in Ireland towards the cost of acquisition of the said lands;
Secondly—in payment to the Plaintiffs of their costs of deducing title to the said lands to be acquired when taxed and ascertained;
Thirdly—in payment of the costs of the County Council of the County of Clare of acquiring the said lands and taking Conveyances thereof as taxed between solicitor and client;
Fourthly—in payment of the Plaintiffs' costs of this action as taxed between party and party, subject to the right of the County Council of the County of Clare and the County Council of the County of Galway to set off pro tanto against the Plaintiffs' said taxed costs and to retain thereout the respective amounts of the taxed costs of the County Council of the County of Clare and the County Council of the County of Galway ordered to be paid by the Plaintiffs under the Order of the High Court dated the 14th day of November, 1938;
Fifthly—in payment of the costs of the County Council of the County of Clare of this action as taxed between solicitor and client and of the expenses incurred by the County Council of the County of Clare in connection with this action;
Sixthly—in payment of the costs of the County Council of the County of Galway of this action as taxed between solicitor and client provided that if the sum of £6,000 0s. 0d. after making the payments hereinbefore mentioned shall be insufficient to discharge in full the said costs of the County Council of the County of Galway then the County Council of the County of Galway shall raise such sum of money by means of the Poor Rate as a County-at-large Charge on the County of Galway as may be required to meet the deficiency.
(D) That subject to the necessary legislation enabling them in this behalf being enacted the County Council of the County of Clare and the County Council of the County of Galway respectively shall raise by way of loan as hereinafter provided the aforesaid sum not exceeding £6,000 0s. 0d. the repayment whereof shall be secured by the respective County Funds of the said Councils and by means of the Poor Rate as a County-at-large Charge on each of the said Counties in the proportion of ·01159 for the County of Galway and ·98841 for the County of Clare, or the County Council of the County of Galway may, if it so desires, pay its proportion of the said sum not exceeding £6,000 0s. 0d. out of revenue instead of raising such proportion by way of loan.
2. AND IT IS HEREBY CONSENTED AND AGREED by and between the Plaintiffs, the Commissioners of Public Works in Ireland and the Minister for Finance and the County Councils of the Counties of Clare and Galway as testified by their respective Common Seals hereunto affixed and by the signatures of their respective solicitors as follows:—
(A) That subject to the necessary legislation enabling them in this behalf being enacted the Commissioners of Public Works in Ireland shall out of moneys to be provided by the Oireachtas contribute the sum of £2,500 0s. 0d. towards the cost of acquisition of the lands coloured green on the map annexed hereto.
(B) That the capital sum of £11,172 11s. 3d. expended in the Fergus Drainage District under the Drainage Maintenance Act, 1924, with the addition of a sum equal to 75 per cent. of the total amount of the costs and expenses of and incidental to the preparation and completion of the Charging Order hereinafter mentioned, shall be a charge on the lands included in the Fergus Drainage District, other than the said lands hereinbefore referred to which are to be acquired by the County Council of the County of Clare, and be repaid by the Proprietors of such lands in such proportions as shall be determined by a Charging Order to be made by the Commissioners of Public Works in Ireland, the proportion of the said sums of £11,172 11s. 3d. and the costs and expenses aforesaid for which the County Councils of Clare and Galway shall respectively be liable for the repayment of under such Charging Order when made to be a Charge on the County Fund of each of the said Councils and repayable to the Commissioners of Public Works in Ireland by the respective Councils by half-yearly payments over a period of twenty years.
(C) That subject to the necessary legislation enabling them in this behalf being enacted the Commissioners of Public Works in Ireland shall waive their claim to interest accrued to the date of the Charging Order mentioned in the last preceding paragraph hereof on the capital sum of £11,172 11s. 3d. expended by them in the Fergus Drainage District pursuant to the provisions of the Drainage Maintenance Act, 1924.
(D) That subject to the necessary legislation enabling them to do so being enacted the Commissioners of Public Works in Ireland shall out of moneys to be provided by the Oireachtas execute and carry out under the supervision of an Engineer appointed by them such works as they may deem necessary to give effect to the recommendations contained in paragraphs 1, 2 and 4 of the Report made by Messrs. P. H. McCarthy, F. Dowling, George Lee, J. P. Candy and Alfred D. Delap on the 25th day of May, 1939, a copy whereof is annexed hereto AND ALSO to provide an automatic tidal sluice or sluices at Clarecastle Bridge in order to shut out the tide from the embanked section as recommended in paragraph 3 of said Report all of which said works are estimated to cost £21,500 0s. 0d. PROVIDED ALWAYS that such sluice or sluices can be procured and PROVIDED FURTHER ALWAYS that in the opinion of such Engineer the provision of such sluice or sluices will not cause danger to persons or property in the neighbourhood of the river AND IT IS FURTHER AGREED that in the event of the nonerection of the said sluice or sluices the said Commissioners will consult with the County Councils of the Counties of Clare and Galway with a view to the provision within a limit of cost of £12,000 0s. 0d. (being part of the said sum of £21,500 0s 0d.) of a suitable alternative safeguard for the embanked section aforesaid and will, if possible, provide such suitable alternative safeguard AND IT IS HEREBY AGREED AND DECLARED that a Certificate under his hand given by the Engineer for the time being employed by the Commissioners of Public Works in Ireland that the works aforesaid have been completed shall be conclusive, final and binding evidence that such works have been completed and carried out in every respect.
(E) That the Minister for Finance and the Commissioners of Public Works in Ireland shall bear their own costs of this action.
(F) That the Commissioners of Public Works in Ireland shall out of moneys to be provided by the Oireachtas expend a sum not exceeding £10,000 0s. 0d. in carrying out such works of restoration and minor improvements in the upper reaches of the River Fergus as the Engineer for the time being employed by the said Commissioners may deem necessary.
(G) That subject to the necessary legislation enabling them in this behalf being duly enacted the Commissioners of Public Works in Ireland shall out of the Local Loans Fund and at such interest as the Minister for Finance shall direct advance on loan to the County Council of the County of Clare and the County Council of the County of Galway such moneys as the said Councils shall respectively require to meet their respective obligations hereunder and that the sums so advanced with interest as aforesaid shall be repaid to the said Commissioners by the said County Councils respectively by half-yearly instalments over a period of twenty years from the date of such advance, or the County Council of the County of Galway may, if it so desires, pay out of revenue the amount which it is bound to contribute hereunder.
3. AND the Minister for Finance hereby AGREES testified as aforesaid with the Commissioners of Public Works in Ireland and the County Councils of the Counties of Clare and Galway that he will submit to the Oireachtas such Bill or Bills as may be necessary to enable the Commissioners of Public Works in Ireland and the County Councils of the Counties of Clare and Galway to give effect to this Agreement.
4. AND IT IS HEREBY CONSENTED AND AGREED by and between the above-named Plaintiffs and the above-named Defendants the County Councils of the Counties of Clare and Galway, the Commissioners of Public Works in Ireland and the Minister for Finance testified as aforesaid that this action shall be settled and all claims by the Plaintiffs be waived and surrendered on and in consideration of the terms mentioned above and that this Consent shall be received by the Court and this action be stayed until further Order with liberty to all parties to apply as the case may require.
IN WITNESS WHEREOF the Plaintiffs have hereunto signed their names and the County Council of the County of Clare, and the County Council of the County of Galway, the Commissioners of Public Works in Ireland and the Minister for Finance have caused their respective Common Seals to be affixed hereto and the respective solicitors for the said parties have hereunto signed their names.

FERGUS DRAINAGE DISTRICT.
Glynn and Others versus Clare County Council and Others.
Following upon the recommendation made by Mr. Justice Gavan Duffy at the adjournment of the above case on the 24th January, 1939, we, the engineers representing all parties in this case, met in conference at the Office of Public Works on 25th May, 1939, to consider various proposals prepared by the Chief Engineer, Office of Public Works, for dealing with the embankments problem in the Ennis-Clarecastle section of the Fergus Drainage District.
Due to the peculiar natural conditions obtaining in this section of the Drainage District the hydraulic problem presented is one of great complexity. These conditions render the stability of the embankments precarious. We are of opinion that to afford reasonable protection to the lands behind the embankments it is essential that the water level within the embanked area be controlled.
We are agreed that the most suitable means of effecting this solution is as follows:—
1. To abandon the area north of the Ennis-Quinn Road on the east bank, approx. 272 acres (coloured green on map), thereby providing a reservoir for the flood waters.
2. To construct protective works along the Ennis-Quinn Road from Doora Bridge to Crows Bridge (marked A-B on map) in order to exclude flood waters from entering the area south of the Ennis-Quinn Road (east bank) coloured yellow on map. The present opening at Crows Bridge to be closed and the flow through this bridge to be diverted northward to the Gaurus River.
3. To provide automatic tidal sluices at Clarecastle Bridge in order to shut out the tide from the embanked section.
4. To make good the remaining embankments in the section, viz., the portion from C to D on the west bank and the portion A to E on the east bank and recondition drains and sluices.

Messrs. McCarthy and Dowling and Lee were of opinion that having regard to the peculiar conditions obtaining in the Ennis-Clarecastle section of the Fergus Drainage District the County Councils should be relieved of their maintenance obligation for the drainage works in this portion of the district for the future.
