1.—Leanfaidh an tAcht seo i ngníomh go dtí an 31ú lá de Nollaig, 1958.

2.—San Acht seo—

ciallaíonn “an Bord” an comhlucht a bunaítear faoi alt 4;

[EN]

folaíonn “gnóthas tionscail” gnóthas atá ar marthain ar dháta an Achta seo a rith;

folaíonn “talamh” measáistí, tionontáin agus oidhreachtáin, tithe agus foirgintí d'aon tsórt tionachta;

ciallaíonn “údarás áitiúil” comhlucht a sonraítear i bhfo-alt (2) d'alt 2 den Acht Rialtais Áitiúil, 1941 (Uimh. 23 de 1941);

ciallaíonn “an tAire” an tAire Tionscail agus Tráchtála;

ciallaíonn “límistéir neamhfhorbartha” límistéir lena mbainean n an tAcht seo, do réir ailt 3.

Límistéirí neamhfhorbartha.

3.—(1) Baineann an tAcht seo leis na límistéirí seo a leanas:

(a) na límistéirí cúnga,

[EN]

(b) aon límistéir eile a ndearbhófar, le hordú ón Aire, an tAcht do bhaint leis de thuras na huaire,

[EN]

(2) Is iad seo a leanas na límistéirí cúnga:—

(a) Contaethe Dhún na nGall, Shligigh, Liatroma, Roscomáin, Mhuigheo, na Gaillimhe agus Chiarraighe,

[EN]

(b) sean-tuathcheantair Bhaile Uí Bheacháin, Inis Díomáin, Chill Rois, na Scairbhe, Thulach na nAspal agus Chill an Dísirt, i gContae an Chláir, agus

[EN]

(c) sean-tuathcheantair Bheanntraighe, Bhaile an Chaisleáin, Scumhaill agus an Sciobairín, i gContae Chorcaighe.

4.—(1) Beidh comhlucht ann ar a dtabharfar An Foras Tionscal (dá ngairmtear an Bord san Acht seo) chun na feidhmeanna a chomhlíonadh a bheirtear dóibh leis an Acht seo.

(2) Beidh feidhm ag forála an Chéad Sceidil maidir leis an mBord.

[EN]

Cumhachta ginearálta an Bhoird.

5.—(1) D'fhonn láithreáin nó áitribh a sholáthar, nó cabhrú lena soláthar, le haghaidh gnóthas tionscail a bhunú, d'fhorbairt nó a chothabháil i límistéir neamhfhorbartha, ar deimhin leis an mBord ina thaobh—

(a) gur dhóigh dhó fostaíocht a chur ar fáil nó a choimeád ar fáil sa límistéir sin, agus

[EN]

(b) gur gá cúnamh airgid chun a áirithiú go ndéanfar é a bhunú, a chothabháil nó d'fhorbairt, agus

[EN]

(c) gur gnóthas é a bhfuil buanadas réasúnach ann agus go seolfar go héifeachtúil é,

[EN]

féadfaidh an Bord, ar pé téarmaí is cuí leo—

[EN]

(i) aon talamh a thógaint go buan nó go sealadach agus trí chomhaontú nó go héigeantach;

[EN]

(ii) aon éasúint, cead slí, ceart uisce nó ceart eile ar bith ar aon talamh nó uisce, nó ina leith, a thógaint (go buan nó go sealadach agus trí chomhaontú go héigeantach);

[EN]

(iii) forceannadh, srianadh, nó cur isteach eile a dhéanamh (go buan nó go sealadach agus trí chomhaontú nó go héigeantach) ar aon éasúint, cead slí, ceart uisce nó ceart eile ar bith ar aon talamh nó uisce nó ina leith;

(iv) foirgintí agus oibreacha eile a dhéanamh, d'oiriúnú agus a chothabháil;

(I) talamh a thógaint,

[EN]

(II) foirgintí agus oibreacha eile a dhéanamh, d'oiriúnú agus a chothabháil, agus

(III) seirbhísí agus saoráidí a sholáthar i ndáil le talamh;

[EN]

(viii) aon ghníomh nó rud a dhéanamh is gá chun aon ní a dhéanamh, nó a ghabhas le déanamh aon ní, a húdaraítear leis na míreanna sin roimhe seo don Bhord a dhéanamh.

(2) Beidh feidhm ag forála an Dara Sceidil maidir le feidhmiú a gcumhacht faoin alt seo ag an mBord.

(3) Ní bheidh aon dleacht stampa iníochtha ar aon ionstraim faoina dtógfaidh an Bord aon talamh, éasúint, cead slí, ceart uisce nó ceart eile ar bith ar aon talamh nó uisce nó ina leith.

(4) Ní forléireofar aon ní i bhfo-alt (1) den alt seo mar ní a dhéanas difir d'oibriú ailt 130 den Acht Iompair, 1944 (Uimh. 21 de 1944).

Deontais le haghaidh inneallra agus trealaimh.

6.—(1) Féadfaidh an Bord deontais a thabhairt, ar pé téarmaí is cuí leo, mar chabhair chun inneallra agus trealamh a sholáthar le haghaidh gnóthais tionscail i límistéir neamhfhorbartha, más deimhin leis an mBord—

(a) gur dhóigh don ghnóthas fostaíocht a chur ar fáil nó a choimeád ar fáil sa límistéir sin, agus

[EN]

(b) gur gá cúnamh airgid chun a áirithiú go ndéanfar é a bhunú, a chothabháil nó d'fhorbairt, agus

[EN]

(c) go bhfuil buanadas réasúnach ann agus go seolfar go héifeachtúil é.

(2) Ní bheidh an méid iomlán a deonfar amhlaidh níos mó in aon chás ná leath costais an inneallra nó an trealaimh a soláthófar.

Deontais chun oibrithe a thréineáil.

7.—(1) Féadfaidh an Bord deontais a thabhairt, ar pé téarmaí is cuí leo, chun tréineáil a thabhairt d'oibrithe, sa Stát nó in áit eile, ar phróiseanna ar gá oilteacht chucu i ngnóthas tionscail i límistéir neamhfhorbartha, más deimhin leis an mBord—

(a) gur dhóigh don ghnóthas fostaíocht a chur ar fáil nó a choimeád ar fáil sa límistéir sin, agus

[EN]

(b) gur gá cúnamh airgid chun a áirithiú go ndéanfar é a bhunú, a chothabháil nó d'fhorbairt, agus

[EN]

(c) go bhfuil buanadas réasúnach ann agus go seolfar go héifeachtúil é.

[EN]

(2) Ní bheidh an méid iomlán a deonfar amhlaidh níos mó ná méid na páighe a íocfas an gnóthas iarbhír leis na hoibrithe i gcaitheamh a dtréimhse tréineála, maraon le méid a gcostas taistil agus cothuithe i gcás oibrithe a tréineálfar lasmuigh den Stát.

(3) Nuair a beifear ag meas páigh oibrí chun na críche seo, ní háireofar aon mhéid a híocfar de bhreis ar na gnáth-rátaí ceardchumainn i gcás foghlaimeora i bhfostaíocht den tsórt céanna sa límistéir céanna nó i límistéir cosúil leis.

8.—(1) Féadfaidh an Bord, chun cabhrú le gnóthas tionscail ar dóigh dhó fostaíocht a chur ar fáil nó a choimeád ar fáil i límistéir neamhfhorbartha, deontais a thabhairt, ar pé téarmaí is cuí leo—

(a) chun bóithre, droichid, oibreacha cuain, agus línte agus saoráidí iarnróid a dhéanamh agus a dheisiú, agus

[EN]

(b) chun tithe agus cóiríocht chónaithe eile agus ceaintíní agus ionaid eile séarais nó siamsa a sholáthar do dhaoine a bheas ar fostú sa ghnóthas.

(2) Sara dtugaid deontas faoin alt seo i leith bóthair nó droichid phoiblí, raghaidh an Bord i gcomhairle leis an Aire Rialtais Áitiúil.

[EN]

Rátaí a mhaitheamh.

9.—(1) Baineann an t-alt seo le háitreabh a dheimhneos an Bord a bheith arna sholáthar, do ghnóthas tionscail i límistéir neamhfhorbartha, ag an mBord nó trí dheontas ón mBord.

(2) Féadfaidh údarás áitiúil, más oiriúnach leo, dhá dtrían ráta is intobhaigh acu i leith áitribh lena mbaineann an t-alt seo a mhaitheamh.

(3) Faoi réir fo-ailt (4), beidh éifeacht ag an maitheamh i leith na bliana airgeadais áitiúla díreach i ndiaidh na bliana airgeadais áitiúla ina gcinntear an maitheamh a dheonadh agus i leith gach ceann de na naoi mbliana airgeadais áitiúla ina dhiaidh sin.

(4) Má dheimhníonn an Bord, in aon bhliain airgeadais áitiúil, nár chomhlíon an gnóthas na téarmaí ar ar soláthraíodh an t-áitreabh, ní bheidh éifeacht ag an maitheamh i leith na bliana airgeadais áitiúla sin.

(5) Ní deonfar maitheamh níos mó ná uair amháin i leith aon áitribh áirithe.

[EN]

(6) I gcás gan luacháil ar leithligh, faoi na hAchta Luachála, a bheith déanta ar áitreabh, féadfaidh an Coimisinéir Luachála, ar iarratas ón mBord, an méid is cuí leis de luacháil inrátuithe na maoine ar cuid di an t-áitreabh a chionroinnt ar an áitreabh.

(7) Is feidhmeanna forcoimeádta chun críocha na nAcht um Bainistí Chontae, 1940 agus 1942, na cumhachta a bheirtear d'údarás áitiúil leis an alt seo.

Leictreachas ar rátaí ísle.

10.—Déanfaidh Bord Soláthair an Leictreachais, má ceangaltar sin orthu le hordú ón Aire arna dhéanamh ar mholadh ón mBord a bunaítear faoin Acht seo, leictreachas a sholáthar chun aon chríche do ghnóthas tionscail i límistéir neamhfhorbartha ar ráta nach mó ná an ráta is ísle ar a soláthraítear leictreachas chun na críche sin in aon chuid den Stát.

Feidhm ailt 16 den Acht um Bailte agus Líomatáistí a Shíneadh Amach, 1934.

11.—Beidh an Bord ina bhord reachtúil chun críocha ailt 16 den Acht um Bailte agus Líomatáistí a Shíneadh Amach, 1934 (Uimh. 22 de 1934), alt a bhaineas le comhar le húdaráis phleanála d'fhonn a áirithiú go ndéanfar do réir scéimeanna pleanála.

Deontais don Bhord.

12.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, deontais a thabhairt, as airgead a sholáthrós an tOireachtas, don Bhord chun a chumasú dhóibh a bhfeidhmeanna a chomhlíonadh.

(2) Ní bheidh méid iomlán na ndeontas faoin alt seo níos mó ná dhá mhilliún punt.

Caiteachais an Aire.

13.—Na caiteachais faoína raghaidh an tAire ag forghníomhú an Achta seo, déanfar, a mhéid a cheadós an tAire Airgeadais, iad d'íoc as airgead a sholáthrós an tOireachtas.

14.—Féadfar an tAcht um Límistéirí Neamhfhorbartha, 1952, a ghairm den Acht seo.

AN CHEAD SCEIDEAL

An Foras Tionscal.

Alt 4.

Corprú.

1. Beidh an Bord ina gcomhlucht corpraithe le comharbas suthain agus gnáthshéala agus cumhacht agartha agus chun bheith inagartha faoina n-ainm chorpraithe agus cumacht chun talamh a thógaint agus a shealbhú.

Ceapadh agus coinníollacha seirbhíse.

2. (1) Beidh an Bord comhdhéanta de thriúr comhaltaí a mbeidh duine acu ina chathaoirleach.

(2) Is é an tAire, le toiliú an Aire Airgeadais, a cheapfas an Cathaoirleach agus na comhaltaí eile.

(3) Is mar chinnfeas an tAire, le toiliú an Aire Airgeadais, tráth a cheaptha ina chomhalta, a bheas téarma oifige (nach mbeidh níos sia ná cúig bliana) agus coinníollacha seirbhíse comhalta.

(4) Íocfar le gach comhalta, as cistí a bheas faoina réir ag an mBord, pé luach saothair a chinnfeas an tAire le toiliú an Aire Airgeadais.

(5) Féadfar comhalta a bheas ag dul as oifig d'athcheapadh.

(6) Ní bhainfidh Achta Rialuithe na Stát-Sheirbhíse, 1924 agus 1926, le hoifig chomhalta.

Nós imeachta.

3. (1) Féadfaidh an Bord gníomhú trí aon bheirt dá líon agus d'ainneoin folúntais ina gcomhaltas.

(2) Féadfaidh an Bord a nós imeachta féin a rialáil.

Cur as oifig, éirí as oifig agus dícháiliú.

4. (1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, comhalta a chur as oifig.

(2) Féadfaidh comhalta éirí as a oifig.

(3) Má thagann comhalta den Bhord chun bheith ina chomhalta de cheachtar Tigh den Oireachtas, ansin, ar é a theacht, faoi Bhuan-Orduithe an Tí sin, i dteideal suí sa Tigh sin, scoirfidh sé de bheith ina chomhalta den Bhord.

(4) Duine a bheas de thuras na huaire i dteideal, faoi Bhuan-Orduithe cheachtar Tí den Oireachtas, chun suí sa Tigh sin, beidh sé dícháilithe chun bheith ina chomhalta den Bhord.

(5) Beidh comhalta dícháilithe chun bheith, agus scoirfidh de bheith, i seilbh oifige má breithnítear ina fhéimhí é, nó má dhéanannséimshocraíocht nó comhshocraíocht lena chreidiúnaithe, nó má dhaorann cúirt dlínse inniúla é chun príosúnachta nó pian-tseirbhíse.

(6) Ní bheidh comhalta den Bhord ina chomhalta d'údarás áitiúil.

Gan eolas a nochtadh.

5. Ní nochtfaidh comhalta aon eolas a gheobhas sé i gcomhlíonadh a fheidhmeanna i dtaobh cúrsaí príobháideacha aon duine nó gnótha ach amháin i gcúrsa tuarascála chun an Aire.

Leas airgeadais a nochtadh.

6. Má bhíonn aon leas airgeadais, díreach nó neamhdhíreach, ag comhalta in aon ghnóthas tionscail, cuirfidh sé in iúl don Aire, sara gcomhlíonfaidh sé aon fheidhmeanna mar chomhalta den Bhord, cad é an leas é agus déanfaidh do réir pé ordachán a bhéarfas an tAire dhó ina thaobh.

Gnáthshéala.

7. (1) Déanfar gnáthshéala an Bhoird, nuair a cuirfear ar dhoiciméad é, d'fhianú le síniú bheirt chomhaltaí.

(2) Bhéarfaidh gach cúirt bhreithiúnais aird bhreithiúnach ar ghnáthshéala an Bhoird agus glacfar i bhfianaise gach doiciméad a airbheartós a bheith ina ionstraim arna déanamh ag an mBord agus a bheith séalaithe le gnáthshéala an Bhoird agus a bheith fianaithe do réir na míre seo, agus measfar, gan a thuilleadh cruthúnais, gurb í an ionstraim sin í, mura gcruthaítear a mhalairt.

Conartha agus ionstraimí gan séala.

8. Aon chonradh nó ionstraim nár ghá a bheith faoi shéala dá mba phearsa a dhéanfadh nó d'fhorghníomhódh é, féadfaidh aon duine a bheas údaraithe go ginearálta nó go speisialta ag an mBord chuige sin é a dhéanamh nó d'fhorghníomhú thar ceann an Bhoird.

Oifigigh agus seirbhísígh.

9. (1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, pé oifigigh agus seirbhísigh a cheapadh is dóigh leis is gá chun cabhrú leis an mBord i gcomhlíonadh a bhfeidhmeanna.

(2) Beidh na hoifigigh agus na seirbhísigh a ceapfar amhlaidh i seilbh oifige ar pé téarmaí, agus gheobhaid pé luach saothair. a chinnfeas an tAire Airgeadais.

(3) Féadfaidh an tAire, ar an mBord dá iarraidh sin agus le toiliú an Aire Airgeadais, comhairleoirí teicniúla don Bhord a cheapadh agus féadfar pé táillí nó luach saothair eile a chinnfeas an tAire, le toiliú an Aire Airgeadais, d'íoc leis na comhairleoirí sin as airgead a sholáthrós an tOireachtas.

(4) Ní dhéanfaidh aon chomhairleoir teicniúil aon eolas a gheobhas sé i gcomhlíonadh a dhualgas mar chomhairleoir den tsórt sin a nochtadh ach amháin i gcúrsa tuarascála uaidh chun an Bhoird. Aon duine a shárós an fhoráil seo beidh sé ciontach i gcion i gcoinne an Achta seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná caoga punt a chur air.

Cuntais agus iniúchadh.

10. (1) Coimeádfaidh an Bord, i pé foirm a cheadós an tAire, le toiliú an Aire Airgeadais, na cuntais go léir is gnáth agus is cuí ar airgead a gheobhaid agus a chaithfid, agus coimeádfaid go háirithe na ountais speisialta sin go léir a ordós an tAire ó am go ham.

(2) Cuirfidh an Bord na cuntais faoi bhráid an Ard-Reachtaire Cuntas agus Ciste go bliantúil lena n-iniúchadh, pé tráth a ordós an tAire, le toiliú an Aire Airgeadais, agus déanfar na cuntais sin ar iad a bheith iniúchta amhlaidh, maraon le tuarascáil an Ard-Reachtaire Cuntas agus Ciste orthu, a thíolacadh don Aire agus bhéarfaidh seisean go leagfar cóipeanna dhíobh faoi bhráid gach Tí den Oireachtas.

Tuarascáil bhliantúil.

11. Bhéarfaidh an Bord tuarascáil bhliantúil ar a ngníomhachta i pé foirm a ordós an tAire, agus bhéarfaidh an tAire go leagfar cóipeanna den tuarascáil faoi bhráid gach Tí den Oireachtas.

Tuairisceáin.

12. Bhéarfaidh an Bord don Aire pé eolas i dtaobh a ngníomhachta a iarrfas sé ó am go ham.

Caiteachais chomhaltaí.

13. Íocfaidh an Bord le gach duine dá gcomhaltaí pé caiteachais taistil agus chothuithe agus pé caitheachais teagmhasacha faoina raghaidh sé agus a cheadós an tAire, le toiliú an Aire Airgeadais.

AN DARA SCEIDEAL.

Forala Maidir le Feidhmiu Cumhacht an Bhoird.

Talamh a Thógaint.

Alt 5.

Dul isteach ar thalamh, etc., roimh an tíolacadh.

1. (1) Aon uair roimh an tíolacadh nó fionnadh an phraghais nó an chúitimh a dhéanamh, féadfaidh an Bord, faoi réir na míre seo agus chun aon cheann dá bhfeidhmeanna a chomhlíonadh:

(a) dul isteach agus seilbh a ghlacadh ar aon talamh;

(b) aon cheart d'fheidhmiú a húdaraítear leis an Acht seo don Bhord a thógaint;

(c) forceannadh, srianadh nó cur isteach eile a dhéanamh ar aon éasúint nó aon mhaoin nó ceart eile a n-údaraítear don Bhord leis an Acht seo forceannadh, srianadh nó cur isteach eile a dhéanamh air.

(2) Aon uair a fheidhmeos an Bord aon chumhacht faoi fhomhír (1) dlífid ús d'íoc, le háititheoir na talún nó le húnaer na héasúna, an chirt nó na maoine eile a ndeachthas isteach air nó ar cuireadh isteach air, ar mhéid an phraghais nó an chúitimh is iníoctha faoin Acht seo leis an áititheoir nó leis an únaer, do réir trí faoin gcéad sa bhliain ó dháta an dula isteach nó an churtha isteach go dtí dáta íoctha an phraghais nó an chúitimh.

(3) Ní dhéanfaidh an Bord—

(a) dul isteach ná seilbh a ghlacadh ar aon talamh faoin mír seo gan fógra mí ar a laghad nó, i gcás tí chónaithe áitithe, fógra trí mhí ar a laghad, a thabhairt i scríbhinn roimh ré don áititheoir go bhfuilid ar intinn sin a dhéanamh, ná

(b) aon éasúint ná ceart eile d'fheidhmiú ná cur isteach ar aon cheart ná maoin faoin mír seo gan fógra mí ar a laghad a thabhairt i scríbhínn roimb ré don únaer go bhfuilid ar intinn sin a dhéanamh.

(4) Féadfar fógra faoin mír seo a sheirbheáil ar dhuine ar bith trína chur leis an bpost cláraithe i gclúdach arna dhíriú chun an duine sin ag an seoladh is gnáth, nó is déanaí is eol, a bheith aige.

(5) Mura féidir, ar aon chúis, an clúdach a dhíriú amhlaidh, féadfar é a dhíriú chun an duine dá mbeidh sé beartaithe i gceachtar slí nó sa dá dhlí acu seo a leanas:—

(a) faoin tuairisc “an t-únaer” nó “an t-áititheoir” (pé acu é) gan a ainm a lua,

(b) ag an talamh nó ag suíomh na maoine lena mbaineann an fógra.

Léarscála, pleananna, etc., a thaisceadh.

2. (1) Bhéarfaidh an Bord, tráth nach déanaí ná mí roimh iad do dhul isteach ar aon talamh nó roimh iad do chur isteach ar aon mhaoin nó ceart, go dtaiscfear do réir na míre seo léarscála, pleananna agus leabhair eolais maidir leis an gcéanna.

(2) Beidh na léarscála agus na pleananna líonmhar a ndóthain agus de shaghas is leor chun go dtaispeánfaid ar leor-scálaí an mhaoin, corprach nó neamhchorprach, a beartaítear a thógaint agus gach cur isteach (a mhéid is féidir sin a thaispeáint ar líníocht) a beartaítear a dhéanamh ar aon mhaoin, corprach nó neamhchorprach.

(3) Beidh sna leabhair eolais ainmneacha na ndaoine is únaerí nó únaerí toimhdean, léasaithe nó léasaithe toimhdean, agus áititheoirí ar an talamh go léir a mbeartaítear í a thógaint nó baint léi ar shlí eile faoin Acht seo agus ar an maoin go léir, corprach nó neamhchorprach, a mbeartaítear cur isteach uirthi in aon tslí faoin Acht seo.

(4) Taiscfear na léarscála, na pleananna agus na leabhair eolais i bpríomh-oifig an Bhoird agus i pé áiteanna eile a ordós an tAire agus coimeádfar ar taisceadh amhlaidh iad go ceann pé tréimhse a hordófar agus, faid a bheid ar taisceadh amhlaidh, beid ar fáil chun a n-iniúchta ag duine ar bith, in aisce, idir a deich a chlog ar maidin agus a ceathair a chlog tráthnóna gach lá ach amháin an Satharn, an Domhnach, agus laethanta saoire bainc.

(5) A luaithe is féidir tar éis aon léarscála, pleananna, nó leabhair eolais a thaisceadh, bhéarfaidh an Bord fógra poiblí i dtaobh an taiscthe sin trí fhóghrán d'fhoilsiú faoi dhó i ngach ceann de dhá nuachtán laethúla nó níos mó agus i pé nuachtáin eile (más ann) a ordós an tAire.

(6) Déarfar sa bhfógra poiblí go bhfuil na léarscála, na pleananna nó na leabhair eolais lena mbaineann sé ar fáil chun a n-iniúchta ag an bpobal do réir na míre seo agus luafar ann na trátha agus na háiteanna a bhféadfar iad d'iniúchadh.

Praghas nó cúiteamh a mheasúnú.

3. (1) An praghas nó an cúiteamh a bheas le n-íoc ag an mBord, as aon talamh a tógadh (go buan nó go sealadach) faoin Acht seo, leis na daoine ar leithligh a bhfuil teideal acu chuioi, nó eastáit nó leasa acu inti, nó as aon éasúint, cead slí, ceart uisce, nó ceart eile, nó i leith aon cheann acu sin, a tógadh amhlaidh (go buan nó go sealadach), leis an únaer nó leis na daoine ar leithligh a bhfuil teideal acu chun na talún nó eastáit nó leasa acu sa talamh, ar uirthi nó ina leith a tógadh an ceart sin amhlaidh, déanfar, cheal comhaontuithe, a mhéid a cheapadh faoi réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919.

(2) An cúiteamh a bheas le n-íoc ag an mBord, as forceannadh nó srianadh nó cur isteach eile (buan nó sealadach) a dhéanamh faoin Acht seo ar aon éasúint, cead slí, ceart uisce nó ceart eile ar aon talamh nó uisce nó ina leith, déanfar, cheal comhaontuithe, a mhéid a cheapadh faoi réim agus do réir an Aquisition of Land (Assessment of Compensation) Act, 1919, amhail is dá mba é a bheadh sa chúiteamh sin an praghas ar thalamh a tógfaí go héigeantach.

(3) Nuair a bheas aon phraghas nó cúiteamh á mheasúnú i leith aon mhaoine, corprach nó neamhchorprach, atá á háitiú nó á húsáid nó á teachtadh i dteannta aon mhaoine eile nó is cuid d'aon mhaoin eile, bhéarfar aird ar aon tsochar i bhfoirm siltin nó i bhfoirm feabhsú ar sholáthar uisce a mbeadh sé réasúnach súil a bheith lena theacht don mhaoin eile sin de bhíthin aon oibreacha a bheas déanta nó á ndéanamh nó ar tí a ndéanta faoin Acht seo.

(4) Beidh feidhm ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845 (arna oiriúnú nó arna leasú le haon Acht iardain nó faoi) maidir le haon phraghas nó cúiteamh is iníoctha faoin mír seo agus maidir le maoin, corprach nó neamhchorprach, a bheas tógtha faoin Acht seo, a thíolacadh don Bhord, agus chun críche na feidhme sin measfar gurb iad an Bord bunaitheoirí an ghnóthais.

(5) Ní bheidh aon ábhar caingin, dlí ná cothromais, i gcoinne an Bhoird ná aon chonraitheora ná aon oifigigh ná seirbhísigh don Bhord ná d'aon chonraitheoir i dtaobh ná i leith aon ghnímh, ní ná ruda a mbeidh cúiteamh iníoctha ina leith de bhuaidh na míre seo.

4. Gach éileamh ar an bpraghas le haghaidh, nó an cúiteamh i leith, aon talún, éasúna, cirt nó maoine eile (corprach nó neamhchorprach) a tógadh nó ar cuireadh isteach air faoin Acht seo, déanfar é laistigh de bhliain tar éis an dáta a chuathas isteach, nó a rinneadh feidhmiú nó cur isteach den chéad uair, faoin Acht seo, ar an talamh, an éasúint, an ceart, nó an mhaoin.

5. (1) Má bhíonn teideal, iarbhír nó go hionchasach, ag duine chun cúitimh i leith aon ní a rinneadh nó a beartaítear a dhéanamh go dleathach faoin Acht seo, féadfaidh an Bord pé oibreacha a dhéanamh chun tairbhe dhó, mar shásamh nó mar shásamh páirteach ina éileamh ar chúiteamh, is cuí leis an mBord agus a aontós an duine sin a ghlacadh.

(2) Féadfaidh an Bord pé téarmaí (lena n-áirítear téarmaí i dtaobh únaerachta, seilbhe, agus stiúrtha na n-oibreacha), ar a gcomhaontóidh an Bord agus an duine ar chun tairbhe dhó a déanfar na hoibreacha amhlaidh, a chur le déanamh aon oibreacha faoin mír seo.

6. Aon uair is dóigh leis an mBord go mbeadh sé neamheacnamúil nó go mbeadh sé neamhfhóirstineach ar aon chúis eile cúiteamh d'íoc as cur isteach ar aon talamh, féadfaid an talamh a thógaint go buan faoin Acht seo, trí chomhaontú nó go héigeantach.

7. (1) Sa mhír seo, ciallaíonn “údarás poiblí” Coimisiún Talún na hÉireann nó Coimisinéirí na nOibreacha Poiblí in Éirinn.

(3) Déanfaidh Coimisiún Talún na hÉireann an talamh a thíolacadh don Bhord nó a dhílsiú iontu.

(4) Soláthróidh agus íocfaidh an Bord an praghas a bheas le n-íoc.

(5) Íocfaidh an Bord costais agus caiteachais uile an Bhoird agus Choimisiún Talún na hÉireann i dtaobh nó i leith an cheannaigh sin.

(6) Sna forála roimhe seo den mhír seo, folaíonn “talamh” aon éasúint, profit-á-pendre, nó ceart eile ar aon talamh nó ina leith, agus folóidh an chumhacht cheannaigh a bheirtear leis an mír seo cumhacht chun aon cheart den tsórt sin a cheannach pé acu i dteannta nó d'éagmais talamh a cheannach é.

10. (1) Beidh an Bord agus a n-oifigigh agus a seirbhísigh, agus daoine eile a bheas údaraithe chuige sin ag an mBord, i dteideal dul isteach ar aon talamh chun gach ní nó aon ní a dhéanamh ar an talamh sin, nó ar aon talamh eile, a húdaraítear don Bhord a dhéanamh leis an Acht seo nó chun aon fhiosrú, imscrúdú nó scrúdú a dhéanamh roimh ré.

(2) Duine ar bith a dhéanfas cosc nó toirmeasc nó cur isteach ar fheidhmiú aon chumhachta ag an mBord nó ag aon oifigeach nó seirbhíseach don Bhord nó ag aon duine a bheas údaraithe ag an mBord, is cumhacht a bheirtear dóibh nó dó leis an mír seo, beidh sé ciontach i gcion i gcoinne an Achta seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná deich bpuint a chur air.

11. Aon uair a theastós eolas as leabhar rátaí nó as doiciméad eile dá shamhail ón mBord chun a bhfeidhmeanna a chomhlíonadh, déanfaidh an t-údarás áitiúil a mbeidh an leabhar nó an doiciméad sin ina gcoiméad, ar an mBord dá iarraidh sin orthu—

12. UNDEVELOPED AREAS ACT, 1952.


AN ACT TO AID INDUSTRIAL DEVELOPMENT IN UNDEVELOPED AREAS. [22nd January, 1952.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Duration.

1.—This Act shall continue in operation until the 31st day of December, 1958.

Definitions.

2.—In this Act—

[GA]

the Board” means the body constituted under section 4;

[GA]

industrial undertaking” includes an undertaking in existence at the passing of this Act;

[GA]

land” includes messages, tenements and hereditaments, houses and buildings of any tenure;

[GA]

local authority” means a body specified in subsection (2) of section 2 of the Local Government Act, 1941 (No. 23 of 1941);

[GA]

the Minister” means the Minister for Industry and Commerce;

[GA]

undeveloped area” means an area to which, in accordance with section 3, this Act applies.

[GA]

Undeveloped areas.

3.—(1) This Act applies to each of the following areas:

[GA]

(a) the congested areas,

[GA]

(b) any other area to which, by order of the Minister, the Act is for the time being declared to apply.

[GA]

(2) The congested areas are—

[GA]

(a) the counties of Donegal, Sligo, Leitrim, Roscommon, Mayo, Galway and Kerry,

[GA]

(b) the former rural districts of Ballyvaughan, Ennistymon, Kilrush, Scariff, Tulla and Killadysert, in the county of Clare, and

[GA]

(c) the former rural districts of Bantry, Castletown, Schull and Skibbereen, in the county of Cork.

[GA]

(3) An area to which this Act applies is referred to as an undeveloped area.

[GA]

4.—(1) There shall be a body to be known as An Foras Tionscal (in this Act referred to as the Board) to perform the functions given to them by this Act.

(2) The provisions of the First Schedule shall apply to the Board.

[GA]

General powers of Board.

5.—(1) For the purpose of providing or facilitating the provision of sites or premises for the establishment, development or maintenance in an undeveloped area of an industrial undertaking in respect of which the Board are satisfied that—

[GA]

(a) it would be likely to provide or maintain employment in such area, and.

[GA]

(b) financial assistance is necessary to ensure its establishment, maintenance or development, and

[GA]

(c) it is of a reasonably permanent nature and will be carried on efficiently,

[GA]

the Board may, on such terms as they think proper—

[GA]

(i) acquire any land either permanently or temporarily and either by agreement or compulsorily;

[GA]

(ii) acquire (either permanently or temporarily and either by agreement or compulsorily) any easement, way-leave, water right or other right whatsoever over or in respect of any land or water;

[GA]

(iii) terminate, restrict or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any easement, way-leave, water right or other right whatsoever over or in respect of any land or water;

[GA]

(iv) construct, adapt and maintain buildings and other works;

[GA]

(v) provide services and facilities in connection with land;

[GA]

(vi) sell, lease or otherwise dispose of land vested in them;

[GA]

(vii) make grants to aid persons to—

[GA]

(I) acquire land,

[GA]

(II) construct, adapt and maintain buildings and other works, and

[GA]

(III) provide services and facilities in connection with land;

[GA]

(viii) do any act or thing which may be necessary for or incidental to the doing of anything which the Board are by the preceding paragraphs authorised to do.

[GA]

(2) The provisions of the Second Schedule shall apply to the exercise by the Board of their powers under this section.

[GA]

(3) No stamp duty shall be payable on any instrument under which any land, easement, way-leave, water right or other right whatsoever over or in respect of land or water is acquired by the Board.

[GA]

(4) Nothing in subsection (1) of this section shall be construed as affecting the operation of section 130 of the Transport Act, 1944 (No. 21 of 1944).

Grants for machinery and equipment.

6.—(1) The Board may make grants, on such terms as they think proper, towards the provision of machinery and equipment for an industrial undertaking in an undeveloped area if the Board are satisfied that—

[GA]

(a) the undertaking would be likely to provide or maintain employment in such area, and

[GA]

(b) financial assistance is necessary to ensure its establishment, maintenance or development, and

[GA]

(c) it is of a reasonably permanent nature and will be carried on efficiently.

[GA]

(2) The total amount so granted shall not in any case exceed one-half of the cost of the machinery or equipment provided.

Grants for training of workers.

7.—(1) The Board may make grants, on such terms as they think proper, for the training, either in the State or elsewhere, of workers in skilled processes of an industrial undertaking in an undeveloped area if the Board are satisfied that—

(a) the undertaking would be likely to provide or maintain employment in such area, and

[GA]

(b) financial assistance is necessary to ensure its establishment, maintenance or development, and

[GA]

(c) it is of a reasonably permanent nature and will be carried on efficiently.

[GA]

(2) The total amount so granted shall not exceed the actual amount of the wages paid by the undertaking to the workers during their period of training together with, in the case of workers trained outside the State, the amount of their expenses of travel and subsistence.

[GA]

(3) In estimating the amount of wages of a worker for this purpose any amount paid in excess of the normal trade union rates applicable to a learner in similar employment in the same or a comparable area shall be disregarded.

Grants for roads, bridges, harbour works, railway lines and facilities housing and, canteens.

8.—(1) The Board may, in aid of an industrial undertaking likely to provide or maintain employment in an undeveloped area, make grants, on such terms as they think proper, for—

[GA]

(a) the construction and repair of roads, bridges, harbour works and railway lines and facilities, and

[GA]

(b) the provision of houses and other dwelling accommodation and canteens and other places of refreshment or recreation for persons employed in the undertaking.

[GA]

(2) Before making a grant under this section in respect of a public road or bridge, the Board shall consult with the Minister for Local Government.

[GA]

Remission of rates.

9.—(1) This section applies to premises certified by the Board to have been provided for an industrial undertaking in an undeveloped area either by the Board or by means of a grant made by them.

[GA]

(2) A local authority may, if they think fit, remit two-thirds of a rate leviable by them in respect of premises to which this section applies.

[GA]

(3) The remission shall, subject to subsection (4), have effect in respect of the local financial year next following that in which the decision to grant the remission is made and in respect of each of the next nine local financial years.

[GA]

(4) If, in any local financial year, the Board certify that the undertaking has failed to observe the terms upon which the premises were provided, the remission shall not have effect in respect of that local financial year.

[GA]

(5) A remission shall not be granted more than once in respect of the same premises.

[GA]

(6) Where premises are not separately valued under the Valuation Acts, the Commissioner of Valuation may, on the application of the Board, apportion to the premises such part as he thinks proper of the rateable valuation of the property in which the premises are comprised.

(7) The powers conferred on a local authority by this section shall be reserved functions for the purposes of the County Management Acts, 1940 and 1942.

Electric current at low rates.

10.—The Electricity Supply Board shall, if so required by order of the Minister, made on the recommendation of the Board constituted under this Act, supply to an industrial undertaking in an undeveloped area electric current for any purpose at a rate not exceeding the lowest rate at which current is provided for that purpose in any part of the State.

Application of section 16 of Town and Regional Planning Act, 1934.

11.—The Board shall be a statutory board for the purposes of section 16 of the Town and Regional Planning Act, 1934 (No. 22 of 1934), which relates to co-operation with planning authorities with a view to ensuring conformity with planning schemes.

Grants to Board.

12.—(1) The Minister, with the consent of the Minister for Finance, may, out of moneys provided by the Oireachtas, make grants to the Board to enable them to perform their functions.

[GA]

(2) The aggregate amount of grants under this section shall not exceed two million pounds.

[GA]

Expenses of Minister.

13.—The expenses incurred by the Minister in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title.

14.—This Act may be cited as the Undeveloped Areas Act, 1952.

FIRST SCHEDULE.

Section 4.

Incorporation.

1. The Board shall be a body corporate with perpetual succession and a common seal and power to sue and be sued in their corporate name and to acquire and hold land.

Appointment and conditions of service.

2. (1) The Board shall consist of three members of whom one shall be Chairman.

(2) The Chairman and the other members shall be appointed by the Minister with the consent of the Minister for Finance.

(3) The term of office (which shall not exceed five years) and conditions of service of a member shall be such as the Minister, with the consent of the Minister for Finance, determines at the time of his appointment.

(4) Each member shall be paid out of funds at the disposal of the Board such remuneration as the Minister, with the consent of the Minister for Finance, determines.

(5) An outgoing member may be re-appointed.

(6) The Civil Service Regulation Acts, 1924 and 1926, shall not apply to the office of member.

Procedure.

3. (1) The Board may act by any two of their number and notwithstanding a vacancy in their membership.

(2) The Board may regulate their own procedure.

Removal, resignation and disqualification.

4. (1) The Minister, with the consent of the Minister for Finance, may remove a member from office.

(2) A member may resign his office.

(3) Where a member of the Board becomes a member of either House of the Oireachtas, he shall, upon his becoming entitled under the Standing Orders of that House to sit therein, cease to be member of the Board.

(4) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein shall be disqualified from being a member.

(5) A member shall be disqualified for holding and shall cease to hold office if he is adjudged bankrupt, or makes a composition or arrangement with his creditors, or is sentenced by a court of competent jurisdiction to suffer imprisonment or penal servitude.

(6) A member of the Board shall not be a member of a local authority.

Non-disclosure of information.

5. A member shall not disclose any information obtained by him in the performance of his functions as to the private affairs of any person or business except in the course of a report to the Minister.

Disclosure of financial interest.

6. Where a member has any financial interest directly or indirectly in any industrial undertaking, he shall before performing any functions as a member of the Board declare the nature of his interest to the Minister and shall comply with such directions as the Minister may give him in regard to it.

Common seal.

7. (1) The common seal of the Board shall, when applied to a document, be attested by the signature of two members.

(2) All courts of justice shall take judicial notice of the common seal of the Board and every document purporting to be an instrument made by the Board and to be sealed with the common seal and to be attested in accordance with this paragraph shall, unless the contrary is shown, be received in evidence and be deemed to be such instrument without further proof.

Contracts and instruments not under seal.

8. Any contract or instrument which, if entered into or executed by an individual, would not require to be under seal may be entered into or executed on behalf of the Board by any person generally or specially authorised by the Board for that purpose.

Officers and servants.

9. (1) The Minister, with the consent of the Minister for Finance, may appoint such officers and servants as he thinks necessary to assist the Board in the performance of their functions.

(2) The officers and servants so appointed shall hold office on such terms and receive such remuneration as the Minister for Finance determines.

(3) The Minister, at the request of the Board and with the consent of the Minister for Finance, may appoint technical advisers to the Board and such advisers may be paid out of moneys provided by the Oireachtas such fees or other remuneration as the Minister, with the consent of the Minister for Finance, determines.

(4) A technical adviser shall not disclose any information obtained by him in performing his duties as such adviser except in the course of a report made by him to the Board. A person who contravenes this provision shall be guilty of an offence against this Act and shall be liable on summary conviction to a fine not exceeding fifty pounds.

Accounts and audit.

10. (1) The Board shall keep in such form as may be approved of by the Minister, with the consent of the Minister for Finance, all proper and usual accounts of moneys received and expended by them, and in particular shall keep all such special accounts as the Minister may from time to time direct.

(2) The accounts shall be submitted annually by the Board to the Comptroller and Auditor General for audit at such time as the Minister, with the consent of the Minister for Finance, shall direct and the said accounts, when so audited, shall, together with the report of the Comptroller and Auditor General thereon, be presented to the Minister who shall cause copies thereof to be laid before each House of the Oireachtas.

Annual Report.

11. The Board shall submit in such form as the Minister may direct an annual report of their activities and the Minister shall cause copies of the report to be laid before each House of the Oireachtas.

Returns.

12. The Board shall submit to the Minister such information regarding their activities as he may from time to time require.

Expenses of members.

13. The Board shall pay to each of their members such travelling, maintenance and incidental expenses incurred by him as the Minister, with the consent of the Minister for Finance, may sanction.

SECOND SCHEDULE.

Provisions relating to exercise of powers of Board.

Section 5.

Acquisition of Land.

Entry on land, etc., before conveyance.

1. (1) At any time before conveyance or ascertainment of price or compensation, the Board may, subject to this paragraph and for the purpose of performing any of their functions:

(a) enter on and take possession of any land;

(b) exercise any right which the Board are authorised by this Act to acquire;

(c) terminate, restrict, or otherwise interfere with any easement or other property or right which the Board are authorised by this Act to terminate, restrict or otherwise interfere with.

(2) Whenever the Board exercise any power under sub-paragraph (1), they shall be liable to pay to the occupier of the land or the owner of the easement, right or other property entered upon or interfered with, interest on the amount of the price or compensation payable under this Act to the occupier or owner at the rate of three per cent, per annum from the date of entry or interference until payment of the price or compensation.

(3) The Board shall not—

(a) enter on or take possession of any land under this paragraph without giving to the occupier at least one month's or, in the case of an occupied dwelling-house, three months' previous notice in writing of their intention so to do, or

(b) exercise any easement or other right or interfere with any right or property under this paragraph without giving to the owner at least one month's previous notice in writing of their intention so to do.

(4) A notice under this paragraph may be served on any person by sending it by registered post in an envelope addressed to him at his usual or last known address.

(5) Where, for any reason, the envelope cannot be so addressed it may be addressed to the person for whom it is intended in either or both of the following ways:

(a) by the description “the owner” or “the occupier” (as the case may be) without stating his name,

(b) at the land or the situation of the property to which the notice relates.

Deposit of maps, plans, etc.

2. (1) Not later than one month before the Board enter on any land or interfere with any property or right, they shall cause maps, plans, and books of reference in relation thereto to be deposited in accordance with this paragraph.

(2) The maps and plans shall be sufficient in quantity and character to show on adequate scales the property, corporeal or incorporeal proposed to be acquired and every interference (so far as it can be shown on a drawing) proposed to be made with any property, corporeal or incorporeal.

(3) The books of reference shall contain the names of the owners or reputed owners, lessees or reputed lessees, and occupiers of all land proposed to be acquired or otherwise affected under this Act and of all property, corporeal or incorporeal, proposed to be in any way interfered with under this Act.

(4) The maps, plans, and books of reference shall be deposited at the head office of the Board and at such other places as the Minister may prescribe and shall remain so deposited for such period as may be prescribed and shall, while so deposited, be open to inspection by any person, free of charge, between the hours of ten o'clock in the morning and four o'clock in the afternoon on every day except Saturdays, Sundays, and bank holidays.

(5) As soon as may be after the deposit of any maps, plans, or books of reference, the Board shall give public notice of such deposit by advertisement published twice in each of two or more daily newspapers and in such (if any) other newspapers as the Minister may prescribe.

(6) The public notice shall state that the maps, plans, or books of reference to which it relates are open to public inspection in accordance with this paragraph and shall state the times and places at which they may be inspected.

Assessment of price or of compensation.

3. (1) The amount of the price or compensation to be paid by the Board for any land acquired (whether permanently or temporarily) under this Act to the several persons entitled thereto or having estates or interests therein, or for or in respect of any easement, way-leave, water-right, or other right so acquired (whether permanently or temporarily) to the owner thereof or to the several persons entitled to or having estates or interests in the land over or in respect of which such right is so acquired shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919.

(2) The amount of the compensation to be paid by the Board on account of the termination, restriction or other interference (whether permanent or temporary) under this Act of or with any easement, way-leave, water-right, or other right over or in respect of any land or water shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, in like manner as if the compensation were the price of land compulsorily acquired.

(3) Where any price or compensation is being assessed in respect of any property, corporeal or incorporeal, which is occupied, used or enjoyed with or forms part of any other property, regard shall be had to any benefit in the nature of drainage or improvement of water supply which may reasonably be expected to accrue to such other property by reason of any works executed or in the course of execution or about to be executed under this Act.

(4) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845 (as adapted or amended by or under any subsequent Act) shall apply to any price or compensation payable under this paragraph and to the conveyance to the Board of property, corporeal or incorporeal, acquired under this Act, and for the purpose of the application the Board shall be deemed to be the promoters of the undertaking.

(5) No action shall lie at law or in equity against the Board or any contractor or any officer or servant of the Board or of any contractor for or on account of any act, matter or thing in respect of which compensation is payable by virtue of this paragraph.

Time for claims for price or compensation.

4. All claims for the price of or compensation in respect of any land, easement, right or other property (whether corporeal or incorporeal) acquired or interfered with under this Act shall be made within one year after the land, easement, right or property is first entered on, exercised or interfered with under this Act.

Execution of works in lieu of compensation.

5. (1) Where a person is entitled, actually or prospectively, to compensation in respect of anything lawfully done or intended to be done under this Act, the Board may execute for his benefit such works, in satisfaction or partial satisfaction of his claim for compensation, as the Board think proper and he agrees to accept.

(2) The Board may attach to the execution of any works under this paragraph such terms (including terms as to the ownership, possession and control of the works) as are agreed upon by the Board and the person for whose benefit the works are so executed.

Acquisition of land in lieu of payment of compensation.

6. Whenever the Board are of opinion that the payment of compensation for interference with any land would be uneconomic or for any other reason inexpedient, they may acquire the land permanently under this Act either by agreement or compulsorily.

Powers and duties where acquired land is subject to a land purchase annuity, etc.

7. (1) In this paragraph, “public authority” means the Irish Land Commission or the Commissioners of Public Works in Ireland.

(2) Whenever the Board acquire permanently any land which is subject, either alone or in conjunction with other land, to a land purchase annuity, payment in lieu of rent or other annual sum (not being merely rent under a contract of tenancy) payable to a public authority, they shall, as from the date on which they enter on and take possession of the land so acquired—

(a) become and be liable for the payment to the public authority of such annual sum, or such portion thereof as shall be apportioned by the public authority on such land, as if the land had been transferred to the Board by the owner thereof on that date, and

(b) be entitled, if the Board so think fit, to redeem the annual sum or such portion thereof as aforesaid, and

(c) be obliged, if required by the public authority to do so, to redeem such annual sum or such portion thereof as aforesaid.

Power of Board to purchase land from the Irish Land Commission.

8. (1) The Board may purchase from the Irish Land Commission any land, vested in the Irish Land Commission, which is required by the Board for the performance of any of their functions.

(2) The land shall be so purchased at such price and upon such other terms as are agreed upon by the Board and the Irish Land Commission, subject to the restriction that in assessing the price no regard shall be had to, nor any enhancement of price allowed for, any improvements executed on the land with moneys paid or advanced out of the Central Fund or out of moneys provided by the Oireachtas.

(3) The land shall be conveyed to or vested in the Board by the Irish Land Commission.

(4) The price to be paid shall be provided and paid by the Board.

(5) The Board shall defray all the costs and expenses of the Board and the Irish Land Commission of or incidental to the purchase.

(6) In the preceding provisions of this paragraph, “land” includes any easement, profit-a-prendre, or other right over or in relation to any land, and the power of purchase conferred by this paragraph shall extend to the purchase of any such right whether in conjunction with or apart from the purchase of land.

Miscellaneous.

Employment of contractors.

9. (1) The Board may contract with any person for the doing by him of any work which they are authorised by this Act to do.

(2) The Board may delegate to that person by agreement the right to do the work and thereupon he shall have, concurrently with them, the right to exercise such of the powers conferred by this Act on the Board as are necessary for doing the work and are specified in the agreement.

(3) References in this Act to the doing of any work or thing by the Board shall be construed as including the doing of it by a contractor authorised under this paragraph.

General power of entry on land by the Board.

10. (1) The Board and their officers and servants and other persons authorised by the Board in this behalf shall be entitled to enter on any land for the purpose of doing thereon or on any other land all or any of the things which the Board are authorised by this Act to do or making any preliminary inquiry, investigation or examination.

(2) Any person who obstructs, prevents or interferes with the exercise by the Board or any officer or servant of the Board or any person authorised by the Board of any power conferred on them or him by this paragraph shall be guilty of an offence against this Act and shall be liable on summary conviction to a fine not exceeding ten pounds.

Right of the Board to information from rate books.

11. Whenever the Board, for the purpose of the performance of their functions, require information from a rate book or other similar document, the local authority having custody of such book or document shall, at the request of the board—

(a) permit any officer of the Board authorised in that behalf by the Board to inspect free of charge a copy of the whole or any part of the book or document, and

(b) furnish to the Board, upon payment by the Board of such fee as shall be agreed upon by the Board and the local, authority or, in default of agreement, shall be fixed by the Minister for Local Government, a copy of the book or document or of any particular part specified by the Board.

Protection of postal and telegraphic services.

12. Neither the Board nor any contractor executing any works under this Act shall by virtue of this Act acquire, enter on, remove or otherwise interfere with any land, works, plant, materials or other property of the Minister for Posts and Telegraphs or erect any works or do any other matter or thing which, in the opinion of the Minister for Posts and Telegraphs, would obstruct, delay, hinder or otherwise injuriously affect the due execution of the public services of the Department of Posts and Telegraphs.

Disposal of surplus land.

13. The Board may sell or lease any land vested in them which is no longer required for the purpose of their functions.

Disposal of moneys of Board.

14. Any moneys received by the Board in respect of the disposal of land, whether by sale, lease or otherwise, shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance may direct.
