Atúrnaethe i seirbhís an Stáit do shaoradh o dheimhnithe do thógaint amach.
1.—(1) Dearbhuítear agus achtuítear leis seo ná fuil agus ná raibh riamh d'oblagáid ar atúrnae ar fostú (pé aca roimh dháta an Achta so do rith no dá éis sin é no go leathrannach roimh an dáta san agus go leathrannach dá éis) i seirbhís an Stáit mar atúrnae deimhniú den tsórt a luaidhtear in alt 38 den Solicitors (Ireland) Act, 1898, do thógaint amach ná do bheith aige le linn é bheith ar fostú amhlaidh, agus dá bharr san—
(a) ná fuil agus ná raibh riamh cosc ar atúrnae ar fostú i seirbhís an Stáit mar adubhradh bheith cáilithe go cuibhe chun gníomhú mar atúrnae do réir bhrí ailt 6 den Acht san de dhruim amháin gan é do thógaint deimhnithe den tsórt san amach no gan a leithéid do bheith aige le linn é bheith ar fostú amhlaidh, agus
(b) ná fuil agus ná raibh riamh feidhm ná éifeacht ag alt 48 den Acht san maidir le haon ghníomh no imeacht arna dhéanamh no arna bhunú ag atúrnae le linn é bheith ar fostú amhlaidh i seirbhís an Stáit.
(2) Ní tuigthe atúrnae do bheith ar fostú i seirbhís an Stáit do réir bhrí no chun crícheanna an fho-ailt sin roimhe den alt so ach amháin má bhíonn no má bhí air agus faid a bheidh no bhí air a chuid ama go léir do thabhairt don fhostaíocht san agus gur as airgead arna sholáthar ag an Oireachtas a bheidh no bhí a luach saothair go léir as an bhfostaíocht san á fháil aige.

SOLICITORS ACT, 1943.
Exemption of solicitors in the service of the State from taking out annual certificates.
1.—(1) It is hereby declared and enacted that it is not and never was obligatory for a solicitor employed (whether before or after or partly before and partly after the passing of this Act) in the service of the State as a solicitor to take out or hold, while so employed, such certificate as is mentioned in section 38 of the Solicitors (Ireland) Act, 1898, and consequently that—
(a) a solicitor employed in the service of the State as aforesaid is not and never was prevented from being duly qualified to act as a solicitor within the meaning of section 6 of the said Act by reason only of his not taking out or holding such certificate while so employed, and
(b) section 48 of the said Act does not and never did apply or have effect in relation to any act or proceeding done or taken by a solicitor while so employed in the service of the State.
(2) A solicitor shall only be regarded as employed in the service of the State within the meaning or for the purposes of the foregoing sub-section of this section if and while he is or was required to devote the whole of his time to that employment and is or was remunerated in respect of such employment wholly out of moneys provided by the Oireachtas.
Short title.
2.—This Act may be cited as the Solicitors Act, 1943.
