2.—(1) Féadfaidh údarás áitiúil, tar éis comhairle a ghlacadh le Coimisinéir an Gharda Síochána, socruithe a dhéanamh chun go ndéanfaidh daoine a bheidh fostaithe ag an údarás na feidhmeanna a shonraítear i bhfo-alt (2) den alt seo a fheidhmiú i limistéar feidhmiúcháin an údaráis.

(2) Is iad na feidhmeanna dá dtagraítear i bhfo-alt (1) den alt seo—

(a) feidhmeanna i leith cionta faoi na hAchtanna um Thrácht ar Bhóithre, 1961 go 1973, a bhaineann le toirmeasc nó srian ar fheithiclí inneallghluaiste a stad nó a locadh,

(b) feidhmeanna a bhaineann le cion faoi rialacháin faoin Roads Act, 1920, arb é an cion é gan ceadúnas i leith feithicle a eisíodh faoin Acht sin a ghreamú agus a bheith ar iompar ar an bhfeithicil mar a fhorordaítear leis na rialacháin sin.

Forálacha a bhaineann le cionta áirithe i leith feithiclí.

3.—(1) Baineann an t-alt seo le cibé cionta díobh seo a leanas a ndearbhóidh an tAire le rialacháin a dhéanfar tar éis comhairle a ghlacadh leis an Aire Dlí agus Cirt gur cionta iad lena mbaineann an t-alt seo, eadhon, aon chion faoi na hAchtanna um Thrácht ar Bhóithre, 1961 go 1973, a bhaineann le toirmeasc nó srian ar fheithiclí inneallghluaiste a stad nó a locadh agus cion faoi rialacháin faoin Roads Act, 1920, arb é an cion é gan ceadúnas feithicle a eisíodh faoin Acht sin a ghreamú agus a bheith ar iompar ar an bhfeithicil mar a fhorordaítear leis na rialacháin sin.

(2) I gcás cúis réasúnach a bheith ag maor tráchta a chreidiúint go bhfuil cion lena mbaineann an t-alt seo á dhéanamh nó déanta ag duine, féadfaidh sé fógra san fhoirm fhorordaithe a sheachadadh don duine á rá—

(a) go líomhnaítear go ndearna an duine an cion,

[EN]

(b) go bhféadfaidh an duine, i rith na tréimhse 21 lá dar tosach dáta an fhógra, suim fhorordaithe, a mbeidh an fógra ina teannta, a íoc leis an údarás áitiúil a bheidh sonraithe san fhógra,

(c) nach dtionscnófar ionchúiseamh i leith an chiona líomhnaithe i rith na tréimhse a bheidh sonraithe san fhógra agus, má dhéantar an íocaíocht a bheidh sonraithe san fhógra i rith na tréimhse sin, nach dtionscnófar aon ionchúiseamh i leith an chiona líomhnaithe.

(3) I gcás cúis réasúnach a bheith ag maor tráchta a chreidiúint go bhfuil cion lena mbaineann an t-alt seo, agus úsáid feithicle inneallghluaiste i gceist ina dhéanamh, á dhéanamh nó déanta, féadfaidh sé fógra san fhoirm fhorordaithe a ghreamú den fheithicil á rá—

(a) go líomhnaítear go ndearnadh an cion,

(b) go bhféadfaidh duine a dhlífear a ionchúiseamh i leith an chiona, i rith na tréimhse 21 lá dar tosach dáta an fhógra, suim fhorordaithe, a mbeidh an fógra ina teannta, a íoc leis an údarás áitiúil a bheidh sonraithe san fhógra,

(c) nach dtionscnófar ionchúiseamh i leith an chiona líomhnaithe i rith na tréimhse a bheidh sonraithe san fhógra agus, má dhéantar an íocaíocht a bheidh sonraithe san fhógra i rith na tréimhse sin, nach dtionscnófar aon ionchúiseamh i leith an chiona líomhnaithe.

(4) I gcás ina ndéanfar fógra a sheachadadh faoi fho-alt (2) nó a ghreamú faoi fho-alt (3) den alt seo—

(a) féadfaidh duine lena mbainfidh an fógra, i rith na tréimhse a bheidh sonraithe san fhógra, an íocaíocht a bheidh sonraithe san fhógra, agus a mbeidh an fógra ina teannta, a íoc leis an údarás áitiúil a bheidh sonraithe san fhógra,

(b) féadfaidh an t-údarás áitiúil sin an íocaíocht a ghlacadh, admháil uirthi a thabhairt agus an t-airgead a íocadh amhlaidh a choinneáil lena dhiúscairt de réir an Achta seo, agus ní bheidh aon íocaíocht a ghlacfar amhlaidh inghnóthaithe in aon chúinse ag an duine a d'íoc í,

(c) ní thionscnófar ionchúiseamh i leith an chiona líomhnaithe i rith na tréimhse a bheidh sonraithe san fhógra, agus, má dhéantar an íocaíocht a bheidh sonraithe san fhógra i rith na tréimhse sin, ní thionscnófar aon ionchúiseamh i leith an chiona líomhnaithe.

(5) (a) Ní dhéanfaidh aon duine, ach duine lena mbainfidh an fógra, fógra a bheidh greamaithe d'fheithicil faoi fho-alt (3) den alt seo a bhaint anuas ná ní bhainfidh le fógra den sórt sin.

(b) Aon duine a sháróidh an fo-alt seo beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £20 a chur air.

(6) Féadfar suimeanna éagsúla a fhorordú chun críocha fho-alt (2) (b) agus fho-alt (3) (b) den alt seo i leith cionta éagsúla, aicmí éagsúla feithiclí agus cionta a líomhnaítear a rinneadh in áiteanna poiblí áirithe nó i limistéir éagsúla.

(7) In aon ionchúiseamh i leith cion lena mbaineann an t-alt seo is ar an gcosantóir a bheidh an fhreagracht a shuíomh go ndearnadh íocaíocht de bhun fógra faoin alt seo.

(8) Déanfar airgead a fhaibhreoidh chuig údarás áitiúil faoin alt seo a dhiúscairt de réir rialacháin a dhéanfaidh an tAire.

Forálacha a bhaineann le maoir thráchta.

4.—(1) Aon duine a bhacfaidh maor tráchta a bheidh ag gníomhú i mbun dualgais beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £20 a chur air.

(2) I gcás cúis réasúnach a bheith ag maor tráchta a chreidiúint go bhfuil cion lena mbaineann alt 3 den Acht seo, cion faoi alt 3 (5) den Acht seo nó cion faoin alt seo á dhéanamh nó déanta ag duine, féadfaidh sé ainm agus seoladh an duine a iarraidh nó a éileamh air.

(3) I gcás ina n-iarrfar nó ina n-éileofar a ainm agus a sheoladh ar dhuine faoin alt seo agus go ndiúltóidh nó go mainneoidh sé a ainm nó a sheoladh a thabhairt nó go dtabharfaidh sé ainm nó seoladh atá bréagach nó míthreorach, beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £20 a chur air.

(4) I gcás ina n-iarrfaidh nó ina n-éileoidh maor tráchta faisnéis ar dhuine faoin alt seo, ní bheidh de cheangal ar an duine géilleadh don iarratas nó don éileamh mura dtarbharfaidh an maor ar aird, má iarrann an duine air é, aitheantas oifigiúil air féin.

Ionchúiseamh gcionta.

5.—Féadfaidh údarás áitiúil ionchúiseamh a thionscnamh i leith cion lena mbaineann alt 3 den Acht seo, i leith cion faoi alt 3 (5) den Acht seo nó i leith cion faoi alt 4 den Acht seo.

Forálachá ginearálta maidir le rialacháin.

6.—(1) Féadfaidh an tAire rialacháin a dhéanamh ag forordú aon ábhar nó ní dá dtagraítear san Acht seo mar ábhar nó ní atá forordaithe nó le forordú.

(2) Gach rialachán a dhéanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.

Údarás áitiúil d'fheidhmiú cumhachta faoin Acht seo d'údarás áitiúil eile.

7.—Féadfaidh údarás áitiúil comhaontú a dhéanamh le húdarás áitiúil eile go mbeidh aon chumhacht a thugtar don údarás chéadluaite leis an Acht seo infheidhmithe thar a cheann ag an dara húdarás a luaitear agus ón uair a dhéanfar an comhaontú sin amhlaidh tiocfaidh an chumhacht sin chun bheith infheidhmithe ag an dara húdarás a luaitear.

8.—Féadfaidh an tAire, le toiliú an Aire Airgeadais, deontais a thabhairt i leith caiteachas údaráis áitiúil faoin Acht seo.

9.—Déanfar na caiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais é, as airgead a sholáthróidh an tOireachtas.

LOCAL AUTHORITIES (TRAFFIC WARDENS) ACT, 1975


AN ACT TO ENABLE LOCAL AUTHORITIES TO MAKE ARRANGEMENTS FOR THE CARRYING OUT OF CERTAIN FUNCTIONS IN RELATION TO ROAD TRAFFIC, TO ENABLE THE MINISTER FOR LOCAL GOVERNMENT TO MAKE GRANTS TOWARDS EXPENSES INCURRED BY LOCAL AUTHORITIES UNDER THIS ACT, AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. [12th July, 1975] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS: [GA]

Definitions.

1.—In this Act—

[GA]

Act of 1961” means the Road Traffic Act, 1961;

[GA]

local authority” means the council of a county, the corporation of a county or other borough, the council of an urban district or the commissioners of a town;

[GA]

mechanically propelled vehicle” has the meaning assigned to it by section 3 (1) of the Act of 1961;

[GA]

the Minister” means the Minister for Local Government;

[GA]

prescribed” means prescribed by regulations made by the Minister under this Act.

[GA]

Employment of traffic wardens by local authorities.

2.—(1) A local authority may, after consultation with the Commissioner of the Garda Síochána, make arrangements for the carrying out of the functions specified in subsection (2) of this section in the functional area of the authority by persons employed by the authority.

(2) The functions referred to in subsection (1) of this section are—

[GA]

(a) functions in respect of offences under the Road Traffic Acts, 1961 to 1973, which relate to the prohibition or restriction of the stopping or parking of mechanically propelled vehicles,

[GA]

(b) functions relating to the offence under regulations made under the Roads Act, 1920, of not attaching to and carrying on a vehicle in the manner prescribed by those regulations a licence in respect of the vehicle issued under that Act.

[GA]

(3) Persons referred to in subsection (1) of this section shall be known, and are in this Act referred to, as traffic wardens.

[GA]

(4) For the purposes of this section, the functional area of a local authority includes the area of any local authority with which an agreement under section 7 of this Act has been entered into.

Provisions applying to certain offences relating to vehicles.

3.—(1) This section applies to such of the following offences as may be declared by the Minister by regulations made after consultation with the Minister for Justice, to be offences to which this section applies, namely, any offence under the Road Traffic Acts, 1961 to 1973, which relates to the prohibition or restriction of the stopping or parking of mechanically propelled vehicles and the offence under regulations made under the Roads Act, 1920, of not attaching to and carrying on a vehicle in the manner prescribed by those regulations a licence in respect of the vehicle issued under that Act.

(2) Where a traffic warden has reasonable grounds for believing that a person is committing or has committed an offence to which this section applies, he may deliver to the person a notice in the prescribed form stating—

(a) that the person is alleged to have committed the offence,

[GA]

(b) that the person may, during the period of 21 days beginning on the date of the notice, make to the local authority specified in the notice a payment of a prescribed amount, accompanied by the notice,

[GA]

(c) that a prosecution in respect of the alleged offence will not be instituted during the period specified in the notice and, if the payment specified in the notice is made during that period, no prosecution in respect of the alleged offence will be instituted.

[GA]

(3) Where a traffic warden has reasonable grounds for believing that an offence to which this section applies, involving the use of a mechanically propelled vehicle, is being or has been committed, he may affix to the vehicle a notice in the prescribed form stating—

[GA]

(a) that the offence is alleged to have been committed,

[GA]

(b) that a person liable to be prosecuted for the offence may, during the period of 21 days beginning on the date of the notice, make to the local authority specified in the notice a payment of a prescribed amount, accompanied by the notice,

[GA]

(c) that a prosecution in respect of the alleged offence will not be instituted during the period specified in the notice and, if the payment specified in the notice is made during that period, that no prosecution in respect of the alleged offence will be instituted.

[GA]

(4) Where a notice is delivered under subsection (2) or affixed under subsection (3) of this section—

[GA]

(a) a person to whom the notice applies may, during the period specified in the notice, make to the local authority specified in the notice the payment specified in the notice, accompanied by the notice,

[GA]

(b) that local authority may receive the payment, issue a receipt for it and retain the money so paid for disposal in accordance with this Act, and no payment so received shall in any circumstances be recoverable by the person who made it,

[GA]

(c) a prosecution in respect of the alleged offence shall not be instituted during the period specified in the notice, and, if the payment specified in the notice is made during that period, no prosecution in respect of the alleged offence shall be instituted.

(5) (a) A notice affixed to a vehicle under subsection (3) of this section shall not be removed or interfered with except by a person to whom the notice applies.

(b) A person who contravenes this subsection shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £20.

[GA]

(6) Different amounts may be prescribed for the purposes of subsection (2) (b) and subsection (3) (b) of this section in respect of different offences, different classes of vehicles and offences alleged to have been committed in particular public places or different areas.

(7) In a prosecution for an offence to which this section applies the onus of showing that a payment pursuant to a notice under this section has been made shall be on the defendant.

(8) Moneys accruing to a local authority under this section shall be disposed of in accordance with regulations made by the Minister.

Provisions relating to traffic wardens.

4.—(1) A person who obstructs a traffic warden acting in the course of his duty shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £20.

[GA]

(2) Where a traffic warden has reasonable grounds for believing that a person is committing or has committed an offence to which section 3 of this Act applies, an offence under section 3 (5) of this Act or an offence under this section, he may request or demand of the person his name and address.

(3) Where a person whose name and address is requested or demanded of him under this section refuses or fails to give his name or address or gives a name or address which is false or misleading, he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £20.

(4) Where a traffic warden requests or demands information of a person under this section, the person shall not be bound to comply with the request or demand unless the warden produces, if requested by the person, official identification of his identity.

Prosecution of offences.

5.—A prosecution for an offence to which section 3 of this Act applies, an offence under section 3 (5) of this Act or an offence under section 4 of this Act may be brought by a local authority.

General provisions relating to regulations.

6.—(1) The Minister may make regulations prescribing any matter or thing referred to in this Act as prescribed or to be prescribed.

(2) Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.

Exercise of power under this Act by one local authority for another.

7.—A local authority may enter into an agreement with another local authority that any power conferred on the first-mentioned authority by this Act may be exercised on its behalf by the second-mentioned authority and the power shall from such entry become exercisable by the second-mentioned authority.

Expenses of local authorities.

8.—The Minister may, with the consent of the Minister for Finance, make grants towards the expenses under this Act of a local authority.

Expenses of Minister.

9.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title.

10.—This Act may be cited as the Local Authorities (Traffic Wardens) Act, 1975.
