1.—Leasaítear leis seo Acht na nOispidéal Puiblí, 1933, tríd an alt seo a leanas a chur in ionad alt 12, arna leasú le hAcht na nOispidéal Puiblí (Leasú), 1940:

“12.—(1) Íocfar le Bord Iontaobhais na nOspidéal an t-iarmhéid a bheidh fágtha den airgead a gheofar as ticéid a dhíol i scuabgheall arna sheoladh faoin Acht seo tar éis na duaiseanna a dáileadh sa scuabgheall sin, na costais a tabhaíodh ag seoladh an scuabghill sin, agus aon dleacht nó cáin is inmhuirearaithe i leith an iarmhéid sin a íoc nó soláthar a dhéanamh dóibh.

(2) Beidh feidhm ag na teorainneacha seo a leanas maidir le húsáid an airgid a gheofar as ticéid a dhíol i scuabgheall arna sheoladh faoin Acht seo:

(a) ní mó ná daichead faoin gcéad den airgead sin, nó cibé céatadán faoina bhun sin den airgead sin a chinnfidh an tAire Dlí agus Cirt ar an scéim don scuabgheall sin a cheadú, an méid a úsáidfear as an airgead sin chun na costais a íoc a tabhaíodh ag seoladh an scuabghill sin (seachas ticéid, coimisiún, duaiseanna nó luach saothair eile a tugadh i ndáil le díol ticéad);

(b) i gcás ina dtabharfar íocaíocht do dhuine as an scuabgheall sin a chur chun cinn, measfar chun críocha an Achta seo gur cuid de na costais a bhaineann le seoladh an scuabghill sin an íocaíocht sin;

(c) ní lú ná tríocha faoin gcéad den airgead sin a gheofar as ticéid a dhíol in aon scuabgheall an méid a íocfar de bhun an ailt seo le Bord Iontaobhais na nOspidéal i leith an scuabghill sin, i dteannta méid aon dleachta nó cánach is inmhuirearaithe i leith an airgid nó aon chuid den airgead a fuarthas as ticéid a dhíol sa scuabgheall sin.”.

2.—(1) Féadfar Acht na nOspidéal Poiblí (Leasú), 1976, a ghairm den Acht seo.

(3) Féadfar Achtanna na nOspidéal Poiblí, 1933 go 1976, a ghairm d'Achtanna na nOispidéal Puiblí, 1933 go 1940, agus den Acht seo le chéile.

PUBLIC HOSPITALS (AMENDMENT) ACT, 1976

Amendment of Public Hospitals Act, 1933.

1.—The Public Hospitals Act, 1933, is hereby amended by the substitution of the following section for section 12, as amended by the Public Hospitals Act, 1940:

“12.—(1) The balance of the moneys received from the sale of tickets in a sweepstake held under this Act remaining after paying or providing for the prizes distributed in such sweepstake, the expenses incurred in holding such sweepstake, and any duty or tax chargeable in respect of such balance shall be paid to the Hospitals Trust Board.

(2) The following limitations shall apply in respect of the application of the moneys received from the sale of tickets in a sweepstake held under this Act:

(a) the amount applied out of such moneys for paying the expenses incurred in holding such sweepstake (other than tickets, commission, prizes or other remuneration given in relation to the sale of tickets) shall not exceed forty per cent. of such moneys or such lesser percentage of such moneys as the Minister for Justice may, when sanctioning the scheme for such sweepstake, determine;

(b) where a payment is made to a person for promoting such sweepstake, such payment shall be deemed for the purposes of this Act to be part of the expenses of holding such sweepstake;

(c) the amount paid in pursuance of this section to the Hospitals Trust Board in respect of any sweepstake, together with the amount of any duty or tax chargeable in respect of the moneys or any part of the moneys received from the sale of tickets in such sweepstake, shall not be less than thirty per cent. of the said moneys received from the sale of tickets in such sweepstake.”.

Short title and collective citation.

2.—(1) This Act may be cited as the Public Hospitals (Amendment) Act, 1976.

(2) The Public Hospitals Acts, 1933 to 1940, and this Act may be cited together as the Public Hospitals Acts, 1933 to 1976.
