ACHT NA nÓISPIDÉAL PUIBLÍ, 1933.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” (ach amháin nuair is mar abairt as Acht eile a húsáidtear í) an tAire Rialtais Áitiúla agus Sláinte Puiblí;
cialluíonn an focal “scuab-gheall” duaiseanna do tharrac no do thabhairt amach tré chrannchur no tré chor na cinniúna, pe'ca bheidh baint ag an ngnó san le toradh ní nea-chinnte san am le teacht no ná beidh, no sreath de ghnóthaí den tsórt san;
cialluíonn an abairt “crannchur duaiseanna” ticéadaí do tharrac no obair eile den tsórt san agus san ag brath ar fad ar chor na cinniúna agus tré n-a ndéanfar tabhairt-amach na nduaiseanna i scuab-gheall do chinneadh go díreach no do réir tortha ní nea chinnte san an le teacht no cuid de do chinneadh go díreach agus cuid de do chinneadh do réir an tortha san;

cialluíonn an abairt “cumann banaltrais” fundúireacht no cóghléasadh i Saorstát Éireann gurb é a aon-chuspóir no a phríomhchuspóír cóir bhanaltrais do chur ar dhaoine bochta go ngalair, loit, no éalaingí cuirp ortha no ar mhná bochta i luighe seola agus banaltraí do chur ar fáil do sna daoine sin;
cialluíonn an abairt “cólucht rialúcháin” an chomhairle, an bord, an coiste no an cólucht eile ag á bhfuil stiúradh agus bainistí an óispidéil no an chumainn bhanaltrais gur ina thaobh a húsáidtear an abairt agus (lasmuich de chás ná ceadódh an có-théacs san) foluíonn údarás áitiúil ag á bhfuil stiúradh an óispidéil no an chumainn sin.
An t-airgead do fuarthas as ticéadaí do dhíol d'áireamh.
2.—Nuair a beifear, chun crícheanna an Achta so, ag áireamh méid an airgid do fuarthas as ticéadaí do dhíol i scuab-gheall ní cuirfear san áireamh luach na dticéad do tugadh amach in aisce mar luach saothair do dhíoltóir ticéad, agus bainfear as ainmphraghas díola gach ticéid eile gach coimisiún, duais, agus luach saothair eile do tugadh amach maidir leis na ticéadaí sin do dhíol.
Costaisí.
3.—Lasmuich de chás dá bhforáltar a mhalairt leis an Acht so, is amach as airgead a sholáthróidh an tOireachtas a híocfar, sa mhéid go gceadóidh an tAire Airgid é, gach costas fé n-a raghaidh Aire ar bith agus é ag feidhmiú an Achta so.
Athghairm, agus forálacha diombuana.
4.—(1) Athghairmtear leis seo na hAchtanna um Oispidéil Phuiblí Dhéirciúla, 1930 go 1932, ach is fé réir na bhforálacha ina dhiaidh seo den alt so agus gan dochar dóibh a bheidh éifeacht ag an athghairm sin.
(2) Leanfaidh na hAchtanna um Oispidéil Phuiblí Dhéirciúla, 1930 go 1932, de bhaint do bheith acu le gach scuab-gheall dar ceaduíodh scéim fé sna hAchtanna san roimh an Acht so do rith ach san go sna hatharuithe seo leanas agus fé n-a réir, sé sin le rá:—
(a) déanfar an barrachas ionfhálta, do réir bhrí alt 5 agus 6 den Acht um Oispidéil Phuiblí Dhéirciúla (Leasú), 1931 (Uimh. 24 de 1931), i ngach scuab-gheall den tsórt san ina mbeidh crannchur duaiseanna ar siúl tar éis an Achta so do rith, déanfar (fé réir aon diúité no cáin is inéilithe ina thaobh d'íoc) é d'íoc le hIontaobhaithe Náisiúnta na nOispidéal agus do chur de láimh do réir an Achta so;
(b) déanfar pé méid den bharrachas ionfhálta do réir an bhrí roimhráite, in aon scuab-gheall den tsórt san ina raibh an crannchur duaiseanna no na crannchurtha uile duaiseanna ar siúl roimh an Acht so do rith, nár chuir coiste an scuab-ghill dá láimh go dleathach roimh an Acht so do rith, déanfar (fé réir íoctha do dhéanamh i pé méid d'aon diúité no cáin is inéilithe ina thaobh agus atá gan íoc le linn an Achta so do rith) é d'íoc le hIontaobhaithe Náisiúnta na nOispidéal agus do chur de láimh do réir an Achta so;
(c) íocfaidh an tAire le hIontaobhaithe Náisiúnta na nOispidéal, chun a churtha de láimh do réir an Achta so, pé méid (más ann do) d'aon bharrachas ionfhálta, do réir an bhrí roimhráite, do híocadh leis fé sna hAchtanna san roimh an Acht so do rith agus ná teastuíonn uaidh chun crícheanna a húdaruítear leis na hAchtanna san agus go ndearnadh socrú ina dtaobh roimh an Acht so do rith;
(d) ní bheidh feidhm agus tuigfear ná raibh feidhm riamh ag alt 3 den Acht um Oispidéil Phuiblí Dhéirciúla (Leasú), 1931, maidir le scuab-gheall ar bith nár ceapadh coiste réitigh ina chóir fén alt san roimh an Acht so do rith.
Coiste scuab-ghill do cheapadh.
5.—(1) Pé uair is mian le cólucht rialúcháin óispidéil (nách óispidéal fé stiúradh údaráis ná otharlann chontae ná óispidéal fiabhrais contae) no le cóluchtaí rialúcháin dhá óispidéal no níos mó den tsórt san scuab-ghill do chur ar siúl fén Acht so chun airgid do chruinniú chun crícheanna Ciste Iontaobhais na nOispidéal, féadfaidh an cólucht no na cóluchtaí rialúcháin sin (dá ngairmtear na bunathóirí san Acht so) coiste (dá ngairmtear coiste scuab-ghill san Acht so), ar a mbeidh pé líon agus pé daoine is dóich leis na bunathóirí is ceart, do cheapadh chun críche na scuab-gheall san, coiste chun na scuabgheall san do bhainistí agus do stiúradh.
(2) Má thárlann aon fholúntaisí, tré bhas no eirghe as, i mballraíocht choiste scuab-ghill féadfaidh na bunathóirí do cheap an coiste sin iad do líonadh.
(3) Féadfaidh coiste scuab-ghill gníomhú d'ainneoin folúntais no folúntaisí do bheith ina bhallraíocht.
(4) Ní bhfuighidh ball ar bith de choiste scuab-ghill aon luach saothair mar gheall ar ghníomhú mar bhall den choiste sin ná mar gheall ar é do thabhairt aon tseirbhísí uaidh ná é do dhéanamh aon oibre maidir leis na scuab-ghill gur ina gcóir do ceapadh an coiste sin.
(5) Má dheineann an tAire Dlí agus Cirt le hordú i scríbhinn ar n-a sheachadadh ag seoladh coiste scuab-ghill no ar n-a chur tríd an bpost chun an tseolta san a ordú amhlaidh, no má dheineann na bunathóirí do cheap coiste scuab-ghill le hordú i scríbhinn ar n-a sheachadadh ag an seoladh san no ar n-a chur tríd an bpost chuige a ordú amhlaidh, no má dheineann coiste scuab-ghill tré rún do rith a chinneadh amhlaidh, ní dhéanfaidh an coiste scuab-ghill sin, tar éis an dáta ar a bhfuighid an t-ordú san ón Aire sin no o sna bunathóirí sin no ar a rithfid an rún san, scéim ar bith i dtaobh scuab-ghill ar bith do leagadh fé bhráid an Aire Dlí agus Cirt fén Acht so, agus ní leanfaid de bheith ina gcoiste scuab-ghill ach amháin chun crícheanna scuabghill ar bith go ndearna an coiste scuab-ghill sin scéim do leagadh fé bhráid an Aire Dlí agus Cirt ina thaobh fén Acht so roimh an dáta san, agus chun gach críche eile beidh an coiste scuab-ghill sin ar scur ón dáta san.
(6) Ní ceapfar aon choiste scuab-ghill fén alt so faid a bheidh aon choiste scuab-ghill eile ann mara mbeidh an coiste scuab-ghill eile sin tar éis ordú d'fháil, fén bhfo-alt san roimhe seo, ón Aire Dlí agus Cirt no o sna bunathóirí do cheap an coiste scuab-ghill sin, no tar éis rún do rith fén bhfo-alt san.
Coiste scuab-ghill do chur scéime isteach.
6.—Pé uair a bheidh bunathóirí do cheap coiste scuab-ghill ar aigne scuab-gheall áirithe do chur ar siúl ullamhóidh an coiste scuab-ghill sin agus leagfaid fé bhráid an Aire Dlí agus Cirt scéim ina luadhfar, maidir leis an scuab-gheall san, na nithe seo leanas, sé sin le rá:—
(a) ainm no ainmneacha an óispidéil no na n-óispidéal dar cólucht no cóluchtaí rialúcháin na bunathóirí;
(b) ainmneacha ball an choiste sin;
(c) mion-innste ar na duaiseanna atáthar ar intinn do thabhairt amach sa scuab-gheall san, maraon leis an méid airgid is fiú aon duais nach suim airgid;
(d) an méid crannchur duaiseanna atáthar ar intinn do dhéanamh sa scuab-gheall san agus an lá, an áit agus an modh atá beartuithe chun an chrannchuir sin no chun gach ceann de sna crannchurtha san (má bhíonn níos mó ná crannchur amháin ann) do dhéanamh;
(e) an praghas atáthar ar intinn d'éileamh ar thicéadaí sa scuab-gheall san;
(f) an méid no an méid maximum atáthar ar aigne do lomháil no do chaitheamh mar choimisiún, mar dhuais, no mar luach saothair eile maidir le ticéadaí sa scuab-gheall san do dhíol agus an cion de thicéadaí atáthar ar aigne do thabhairt amach in aisce mar luach saothair don té dhíolfaidh aon líon áirithe ticéadaí sa scuab-gheall san;
(g) ainmneacha triúr iontaobhaithe ar a laighead (dá ngairmtear na hiontaobhaithe scuab-ghill san Acht so) a bheidh tar éis a thoiliú i scríbhinn gníomhú mar iontaobhaithe den tsórt san agus gur ina n-ainmneacha atáthar ar intinn an taisce no na taiscí do lóisteáil is gá do réir an Achta so;
(h) ainm an bhainc phuiblí i Saorstát Éireann ina lóisteálfar an taisce no na taiscí is gá do réir an Achta so;
(i) má táthar ar intinn, maidir leis an taisce no na taiscí is gá do réir an Achta so, an céanna do lóisteáil i bpáirt no go hiomlán tré urrúis do lóisteáil, tuairisc ghenerálta ar na hurrúis sin;
(j) an dáta ar a dtosnófar ar thicéadaí sa scuab-gheall san do dhíol; agus
(k) an cuntasóir fé chairt no an t-iniúchóir no an cuntasóir cáilithe eile atáthar ar intinn d'fhostú do réir an Achta so chun cuntaisí an scuab-ghill sin d'iniúchadh.
An tAire Dlí agus Cirt do cheadú na scéime agus an scuabgheall do bheith dleathach dá bhíthin sin.
7.—(1) Nuair a dhéanfaidh coiste scuab-ghill scéim do leagadh fé bhráid an Aire Dlí agus Cirt fén Acht so, féadfaidh an tAire sin, más ceart san dar leis agus más deimhin leis gurb iad do cheap an coiste sin ná bunathóirí bhí i dteideal an coiste sin do cheapadh fén Acht so, an scéim sin do cheadú gan atharú, no tar éis pé atharú is oiriúnach leis, do dhéanamh uirthi.
(2) Nuair a leagfar scéim fé bhráid an Aire Dlí agus Cirt fén Acht so féadfaidh an tAire sin, chun a dheimhniú dho féin gurb iad do cheap an coiste scuab-ghill do chuir an scéim sin fé n-a bhráid ná bunathóirí bhí i dteideal fén Acht so an coiste sin do cheapadh, a éileamh go gcruthófaí san le pé fianaise, tré dhearbhú reachtúil no ar aon tslí eile, is oiriúnach leis.
(3) Nuair a dhéanfaidh an tAire Dlí agus Cirt scéim a leagadh fé n-a bhráid fén Acht so do cheadú (go n-atharú no gan atharú), ansan, d'ainneoin éinní contrárdha dho san atá in Acht ar bith eile, beidh sé dleathach do sna bunathóirí do cheap an coiste scuabghill do leag an scéim sin fé bhráid an Aire sin an scuab-gheall le n-a mbaineann an scéim sin do chur ar siúl, fé réir agus do réir na gcoinníoll so leanas, sé sin le rá:—
(a) déanfaidh an coiste scuab-ghill sin do ceapadh fén Acht so chun críche an scuab-ghill sin an scuab-gheall san do stiúradh agus do bhainistí, agus
(b) déanfar an scuab-gheall san do chur ar siúl, do stiúradh agus do bhainistí ar gach slí do réir na scéime sin mar do cheaduigh an tAire Dlí agus Cirt í, agus
(c) cólíonfar maidir leis an scuab-gheall san an fhoráil den Acht so le n-a n-éilítear go ndéanfaí rud ar bith áirithe no le n-a dtoirmisctear rud ar bith áirithe do dhéanamh maidir le scuab-gheall a cuirfear ar siúl fén Acht so, agus
(d) ní déanfar aon ticéadaí do thabhairt amach in aisce sa scuab-gheall san ach amháin ticéadaí do bhéarfar amach do dhíoltóirí ticéad mar luach saothair ar son ticéadaí do dhíol.
Taisce chun a chur in áirithe go n-íocfar na duaiseanna.
8.—(1) Pé uair a cuirfear scuab-gheall ar siúl fén Acht so, déanfaidh an coiste scuab-ghill a bheidh ag bainistí an scuabghill sin no cuirfid fé ndeár go ndéanfar, maidir leis an gcrannchur duaiseanna no le gach ceann de sna crannchurtha duaiseanna (do réir mar bheidh) sa scuab-gheall san, taisce (dá ngairmtear an taisce san Acht so) do lóisteáil do réir na bhforálacha so leanas, sé sin le rá:—
(a) isé slí ina ndéanfar an taisce sin do lóisteáil ná tré pé airgead no urrúis a luaidhtear anso ina dhiaidh seo do lóisteáil sa bhanc a bheidh ainmnithe chuige sin sa scéim a bhaineann leis an scuab-gheall san agus san in ainmneacha na n-iontaobhaithe scuab-ghill a bheidh ainmnithe sa scéim sin;
(b) más de mhéid chinnte no maran suim airgid gach duais a bheidh le cur ar crannaibh sa chrannchur gur maidir leis a déanfar an taisce do lóisteáil, beidh an taisce chó mór no chó luachmhar le méid no luach iomlán na nduaiseanna san agus déanfar é do lóisteáil sara ndíoltar aon ticéadaí sa scuab-gheall san;
(c) má bhíonn méid no luach gach duaise no aon duaise dá mbeidh le cur ar crannaibh sa chrannchur gur maidir leis a déanfar an taisce do lóisteáil ag brath, ar fad no go leathrannach, ar mhéid an airgid do gheobhfar as ticéadaí sa scuab-gheall san do dhíol no ma bhíonn sé le háireamh dá réir sin, déanfar an taisce do lóisteáil pé am agus beidh inti pé méid agus déanfar í do mhéadú o am go ham oiread san is gá chun ná beidh méid na taisce aon uair níos lugha ná an tsuim do bheadh mar mhéid no luach iomlán na nduais a bheidh le cur ar crannaibh sa chrannchur san dá ndeintí an méid no an luach san d'áireamh do réir méid an airgid a bheidh faighte cheana féin an uair sin as ticéadaí sa scuabgheall san do dhíol;
(d) más rud é, i gcás le n-a mbaineann an mhír dheiridh sin roimhe seo, go ndéanfar méid no luach minimum do luadh i dtaobh na nduais a bheidh le cur ar crannaibh sa chrannchur gur maidir leis a déanfar an taisce do lóisteáil déanfar pé cuid den taisce sin is có-ionann leis an méid no an luach minimum san do lóisteáil sara ndíolfar aon ticéadaí don chrannchur gur mar gheall air a bheidh an minimum san luaidhte, agus cuirfear leis an gcuid sin fé mar is gá (más gá san) o am go ham do réir na míre deiridh sin roimhe seo;
(e) féadfar an taisce do lóisteáil i gceachtar slí no sa dá shlí acu so leanas, sé sin le rá, tré airgead do lóisteáil no tré stuic, scaireanna, no urrúis dea-urruithe ionmhargaidh do lóisteáil de shaghas a bheidh luaidhte chuige sin sa scéim a bhaineann leis an scuab-gheall san;
(f) tuigfear gurb é is luach chun crícheanna an ailt seo d'aon stuic, scaireanna, no urrúis is cuid den taisce ná an praghas do gheobhfaí ortha an lá déanfar iad do lóisteáil.
(2) Ní bheidh an t-ús, na dividenda, agus an t-ioncum eile fhásfaidh le linn ré na taisce ar airgead no ar stuic, scaireanna, no urrúis is cuid den taisce, ní bheid ina gcuid den taisce sin ach beid dá chuid féin ag an duine agus beid iníoctha leis an duine do rinne an t-airgead, na stuic, na scaireanna, no na hurrúis sin do chur ar fáil.
An taisce d'úsáid.
9.—(1) Más rud é ná déanfaidh an coiste scuab-ghill a bheidh ag bainistí scuab-ghill aon duais áirithe a tarraingeofar go cuibhe sa scuab-gheall san d'íoc go cuibhe leis an duine no do thabhairt go cuibhe don duine bheidh ina teideal fé théarmaí an scuabghill sin, íocfaidh na hiontaobhaithe scuab-ghill leis an duine sin, as an taisce do lóisteáladh maidir leis an gcrannchur in ar tarraingeadh an duais sin, méid no luach na duaise sin no pé cuid nár íoc an coiste sin leis den mhéid no den luach san, agus chun an íoctha san do dhéanamh beidh lán-chomhacht ag na hiontaobhaithe sin chun gach ceann no aon cheann de sna stuic, na scaireanna no na hurrúis a bheidh sa taisce sin do dhíol más rogha leo féin é.
(2) Ar na duaiseanna go léir a tarraingeadh sa chrannchur gur maidir leis a bheidh taisce lóisteálta do bheith íoctha no tugtha amach in iomlán, pe'ca gan tarrac ar an taisce sin é no ar fad no go leathrannach amach as an taisce sin, déanfaidh na hiontaobhaithe scuab-ghill gur ina n-ainmneacha bheidh an taisce sin iomlán an airgid no na n-urrús a bheidh sa taisce sin, no pé méid den chéanna ná beifear tar éis a úsáid ar shlí eile fén alt so (do réir mar is gá sa chás), do thabhairt thar n-ais don té do rinne an t-airgead no na hurrúis sin do chur ar fáil.
(3) Más rud é, le toiliú an Aire Dlí agus Cirt, go bhfágfar gan déanamh an crannchur duaiseanna gur maidir leis a déanfar taisce do lóisteáil déanfaidh na hiontaobhaithe scuab-ghill gur ina n-ainmneacha bheidh an taisce sin aon airgead, stuic, scaireanna agus urrúis a bheidh sa taisce sin do thabhairt thar n-ais don té do chuir an céanna ar fáil.
Fuirm na dticéadaí agus srian le fógraíocht, etc.
10.—(1) Beidh clóbhuailte go soiléir ar gach leabhar de thicéadaí i scuab-gheall a bheidh ar siúl fén Acht so ráiteas gur fén Acht so agus chun tairbhe d'óispidéil agus d'fhundúireachtaí dá samhail i Saorstát Éireann atáthar ag cur an scuab-ghill sin ar siúl.
(2) Beidh clóbhuailte go soiléir ar gach ticéad i scuab-gheall a bheidh ar siúl fén Acht so ráiteas á iarraidh ar cheannuitheoir an ticéid sin, i gcás é do theip ar choiste bhainistí an scuab-ghill sin a admháil go bhfuaradar praghas an ticéid sin, fógra do chur go díreach chun an choiste sin á rá gur theip ortha amhlaidh, agus beidh clóbhuailte go soiléir ar an ticéad san freisin leor-eolas ar an ainm agus an seoladh chun ar cheart an fógra san do chur.
(3) Ní bheidh in aon fhógra, memorandum, cearcalán, leabhar ticéadaí, ticéad, ná scríbhinn eile, do bhéarfaidh coiste scuab-ghill amach maidir leis an scuab-gheall le n-a mbaineann an coiste sin, aon fhocail á thaisbeáint no dob fhéidir go réasúnta do léiriú mar fhocail a thaisbeánann go bhfuil an scuab-gheall san á chur ar siúl fé choimirce no fé thearmann Rialtais Shaorstáit Éireann no aon Aire is ceann ar Roinn Stáit.
(4) I gcás aon fhógra, memorandum, leabhar ticéadaí, ticéad, no scríbhinn eile, do bhéarfaidh coiste scuab-ghill amach maidir leis an scuab-gheall le n-a mbaineann an coiste sin, do shárú aon fhorála den alt so, beidh gach ball den choiste sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air.
Saothar agus abhair de chuid Shaorstáit Éireann d'úsáid.
11.—Chó fada agus is féidir é, is i Saorstát Éireann a déanfar an chlódóireacht go léir do scuab-gheall no maidir le scuab-gheall a cuirfear ar siúl fén Acht so agus an páipéar agus na habhair eile go léir a húsáidfear chun críche aon scuab-ghill den tsórt san beid de dhéantús Shaorstáit Éireann.
Toradh scuab-gheall do chur chun críche.
12.—(1) Déanfar an farasbár, den airgead do gheobhfar as ticéadaí do dhíol i scuab-gheall a cuirfear ar siúl fén Acht so, a bheidh fágtha tar éis íoctha na nduaiseanna do bhéarfar amach sa scuab-gheall san agus na gcostaisí fé n-a raghfar ag cur an scuab-ghill sin ar siúl agus aon diúité no cánach is inéilithe alos an fharasbáir sin no tar éis díol íoca an chéanna do chur ar fáil, déanfar san d'íoc le hIontaobhaithe Náisiúnta na nOispidéal.
(2) Beidh feidhm ag na teoranta so leanas maidir leis an airgead, do gheobhfar as ticéadaí do dhíol i scuab-gheall a cuirfear ar siúl fén Acht so, do chur chun críche, sé sin le rá:—
(a) an méid den airgead san a cuirfear chun íoctha na gcostaisí fé n-a raghfar ag cur an scuab-ghill sin ar siúl (lasmuich de thicéadaí, coimisiún, duaiseanna no luach saothair eile do bhéarfar i dtaobh ticéadaí do dhíol) ní raghaidh thar triocha per cent. den airgead san;
(b) i gcás íocaíochta do thabhairt do dhuine mar gheall ar an scuab-gheall san do chur chun cinn tuigfear chun crícheanna an Achta so an íocaíocht san do bheith ina cuid de sna costaisí bhaineann leis an scuab-gheall san do chur ar siúl agus ní ragha sí thar seacht per cent. den airgead san do gheobhfar as ticéadaí do dhíol sa scuab-gheall san;
(c) an méid a híocfar do réir an ailt seo le hIontaobhaithe Náisiúnta na nOispidéal alos aon scuab-ghill, maraon le méid aon diúité no cánach is inéilithe alos an airgid no aon choda den airgead do gheobhfar as ticéadaí do dhíol sa scuab-gheall san, ní bheidh sé níos lugha ná fiche per cent. den airgead san do gheobhfar as ticéadaí do dhíol sa scuab-gheall san.
Cuntaisi scuab-gheall d'iniúchadh.
13.—(1) Laistigh de thrí mhí tar éis an chrannchuir dhuaiseanna no, i gcás níos mó ná crannchur amháin do bheith ann, tar éis an chrannchuir dheiridh dhuaiseanna i scuab-gheall a cuirfear ar siúl fén Acht so cuirfidh an coiste scuab-ghill a bheidh ag bainistí an scuab-ghill sin fé ndeár go ndéanfaidh an té a hainmnítear chuige sin sa scéim a bhaineann leis an scuab-gheall san no, mara mbeidh an duine sin ar fáil, duine éigin eile go sna cáilíochta céanna agus a bheidh ceaduithe roimh ré ag an Aire Dlí agus Cirt iniúchadh ar chuntaisí an airgid uile do fuarthas agus an airgid uile do híocadh maidir leis an scuab-gheall san.
(2) Bhéarfaidh gach coiste scuab-ghill don Aire Dlí agus Cirt agus do gach ball den Oireachtas, laistigh de dhá mhí tar éis an iniúchta déanfar do réir an ailt seo, cóip de sna cuntaisí bhaineann leis an scuab-gheall dar ceapadh an coiste sin fé mar a bheidh na cuntaisí sin iniúchta fén alt so, maraon le cóip de dheimhniú an iniúchóra agus dá thuarasgabháil ar an iniúchadh san.
Coimisiún na nOispidéal do bhunú.
14.—(1) Chó luath agus a bheidh caoi ann chuige sin tar éis an Achta so do rith bunóidh an tAire, le hordú, coimisiún dá ngairmfear “Coimisiún na nOispidéal” agus ar a mbeidh triúr gnáth-bhall ar a laighead agus is duine acu san a bheidh mar chathaoirleach ar an gCoimisiún.
(2) Déanfaidh an tAire gnáth-bhaill Choimisiúin na nOispidéal do cheapadh agus cathaoirleach an Choimisiúin sin d'ainmniú le hordú, o am go ham, fé mar is gá san.
(3) Pé uair is dóich leis an Aire gur gá san do dhéanamh féadfaidh, le hordú, pé daoine agus pé méid daoine is oiriúnach leis do cheapadh chun bheith ina mbaill bhreise de Choimisiún na nOispidéal go ceann tréimhse áirithe (nách sia ná dhá bhliain) no go dtí go gcuirfear as oifig iad níos túisce ná san fén alt so.
(4) Féadfaidh an tAire aon uair, le hordú, ball ar bith de Choimisiún na nOispidéal do chur as a oifig mar bhall den tsórt san agus fós féadfaidh aon uair, le hordú, cathaoirleach Choimisiúin na nOispidéal do chur as a phost mar chathoirleach den tsórt san.
(5) Marab éag, eirghe as, no cur as oifig roimhe sin do beidh gach gnáth-bhall de Choimisiún na nOispidéal i seilbh oifige mar bhall den tsórt san go ceann dhá bhliain o dháta a cheaptha, ach beidh sé ion-athcheaptha.
(6) Chun a chuid dualgas fén Acht so do chólíonadh féadfaidh gach ball de Choimisiún na nOispidéal cuaird do thabhairt ar gach ceann no ar aon cheann d'áitreabhacha óispidéil no cumainn bhanaltrais ar bith do bhí páirteach i scuab-gheall ar bith ar n-a bhunú fé sna hAchtanna um Oispidéil Phuiblí Dhéirciúla, 1930 go 1932, no fén Acht so, no bheidh tar éis deontais as Ciste Iontaobhais na nOispidéal d'iarraidh fé alt 24 dhe seo, no ar gach ceann no ar aon cheann d'áitreabhacha fundúireachta ar bith atá fé chúram údarásanna áitiúla no do gheibheann congnamh uatha san, agus beidh i dteideal na háitreabhacha san agus a bhfeisteas agus a bhfearas d'iniúchadh agus do scrúdú, agus fós beidh i dteideal eolas iomlán ar bhainistí agus ar staid airgeadais óispidéil no cumainn bhanaltrais ar bith d'iarraidh agus d'fháil agus gach cuntas ar fháltaisí agus ar chaiteachas cóluchta rialúcháin an óispidéil no an chumainn bhanaltrais sin d'fheiscint agus do scrúdú, maraon le gach leabhar agus scríbhinn eile no aon leabhar no scríbhinn eile ina mbeidh aon bhreacachán ar na fáltaisí agus ar an gcaiteachas san.
(7) Íocfar le gach ball de Choimisiún na nOispidéal pé luach saothair (más ann do) ordóidh an tAire o am go ham.
(8) Féadfaidh Coimisiún na nOispidéal gníomhú d'ainneoin folúntais amháin do bheith imeasc a ngnáth-bhall.
Oifigigh agus seirbhísigh Choimisiúin na nOispidéal.
15.—(1) Beidh Coimisiún na nOispidéal i dteideal oifigigh agus seirbhísigh (ar a mbeidh comhairligh ghairmiúla no theicniciúla fé mar is gá agus nuair is gá san) d'fhostú, pé daoine agus pé méid acu, agus ar pé luach saothair agus téarmaí, is dóich leis an gCoimisiún san, le ceadú an Aire, do bheith ceart, agus beid i dteideal oifigeach no seirbhíseach ar bith den tsórt san do bhriseadh le ceadú an Aire.
(2) Beidh Coimisiún na nOispidéal i dteideal pé saoráidí d'fháil ón Aire agus pé congnamh d'fháil o oifigigh an Aire ordóidh an tAire.
(3) Beidh gach ball de Choimisiún na nOispidéal agus gach oifigeach don Choimisiún san i dteideal, ar bheith ag taisteal do chun a chuid dualgas mar bhall no mar oifigeach den tsórt san do chólíonadh, costas taistil agus liúntas cothuithe d'fháil agus d'íoc leis do réir pé ráta cheadóidh an tAire.
Costaisí Choimisiúin na nOispidéal.
16.—(1) Íocfar le Coimisiún na nOispidéal o am go ham, amach as Ciste Iontaobhais na nOispidéal, pé suimeanna cheadóidh an tAire i gcóir costaisí Choimisiúin na nOispidéal agus sa mhéid go gceadóidh an tAire é is amach as na suimeanna san íocfaidh an Coimisiún san costaisí fé n-a raghaid agus iad ag feidhmiú a bhfeidhmeanna fén Acht so agus ortha san beidh an luach saothair, na costaisí taistil agus na liúntaisí cothuithe is iníoctha le baill de Choimisiún na nOispidéal agus le hoifigigh don Choimisiún san.
(2) Íocfar amach as Ciste Iontaobhais na nOispidéal isteach sa Stát-Chiste no chun tairbhe don Stát-Chiste, sna tráthanna agus ar an slí ordóidh an tAire Airgid, an tsuim sin in aghaidh gach bliana airgeadais ar a gcinnfidh an tAire, le ceadú an Aire Airgid, do bheith mar shuim is iníoctha le ceart alos saoráidí do chuir an tAire ar fáil, agus alos conganta do thug oifigigh leis an Aire, do Choimisiún na nOispidéal fén Acht so sa bhliain airgeadais sin.
Feidhmeanna Choimisiúin na nOispidéal.
17.—Beidh sé de dhualgas ar Choimisiún na nOispidéal na nithe seo leanas do dhéanamh, sé sin le rá:—
(a) fiosrú, agus scrúdú, agus breithniú generálta do dhéanamh, uatha féin, mar gheall ar na saoráidí óispidéil agus banaltrais atá i Saorstát Éireann agus eolas do bhailiú agus do chur ar breacadh agus in eagar, uatha féin, i dtaobh na saoráidí sin, i dtaobh an ghá atá ag na daoine leis na saoráidí sin, agus i dtaobh na saoráidí sin do chur in oiriúint don ghá san;
(b) lorgaireacht do dhéanamh agus tuarasgabháil do thabhairt don Aire mar gheall ar gach ní bhaineann le saoráidí óispidéil no banaltrais i Saorstát Éireann agus a chuirfidh an tAire fé n-a mbráid chun lorgaireacht do dhéanamh agus tuarasgabháil do thabhairt uatha mar gheall air;
(c) scéimeanna do cheapadh agus do leagadh fé bhráid an Aire, ar iarratas an Aire, chun feabhas do chur agus có-eagar do dhéanamh ar shaoráidí óispidéil no banaltrais, no ar shaoráidí óispidéil agus banaltrais, i Saorstát Éireann uile no in aon chuid áirithe dhe;
(d) lorgaireacht do dhéanamh agus tuarasgabháil do thabhairt don Aire mar gheall ar gach ní chuirfidh an tAire fé n-a mbráid fé fhoráil ar bith no do réir forála ar bith den Acht so seachas an t-alt so;
(e) comhairle do thabhairt don Aire, uatha féin no ar iarratas an Aire, mar gheall ar ní ar bith a bhaineann le Ciste Iontaobhais na nOispidéal do riaradh.
Cosaint maidir le bunreacht, etc., óispidéal áirithe d'atharú.
18.—Ní dhéanfaidh éinní atá san alt deiridh sin roimhe seo comhacht do thabhairt do Choimisiún na nOispidéal scéim do cheapadh agus do leagadh fé bhráid an Aire gur gá dá druim atharú do dhéanamh ar bhunreacht no cur isteach do dhéanamh ar riaradh óispidéil ná fuair aon tairbhe as scuab-gheall ar bith do bunuíodh fé sna hAchtanna um Oispidéil Phuiblí Dhéirciúla 1930 go 1932, agus ná fuighidh aon tairbhe as scuab-gheall a bunófar fén Acht so agus ná faghann aon deontas o údarás áitiúil.
Cuntaisí Choimisiúin na nOispidéal agus a n-iniúchadh.
19.—(1) Déanfaidh Coimisiún na nOispidéal gach cuntas is ceart agus is gnáth, ar an airgead go léir do gheobhaid no chaithfid, do choimeád i pé fuirm le n-a n-aontóidh an tAire.
(2) Déanfar gach bliain cuntaisí Choimisiúin na nOispidéal d'iniúchadh agus tuarasgabháil ortha do thabhairt don Aire agus isé dhéanfaidh san ná iniúchóir go gcáilíochta cuibhe a cheapfaidh an tAire go bliantúil chuige sin, agus déanfaidh Coimisiún na nOispidéal suim a shocróidh an tAire mar tháille don iniúchóir sin d'íoc leis an Aire mar chuid dá gcostaisí.
Iontaobhaithe Náisiúnta na nOispidéal.
20.—(1) Chó luath agus a bheidh caoi ann chuige sin tar éis an Achta so do rith bunóidh an tAire, le hordú, cólucht de chúigear iontaobhaithe, dá ngairmfear Iontaobhaithe Náisiúnta na nOispidéal, chun na gcomhacht d'fheidhmiú agus chun na ndualgas do chólíonadh a ceaptar dóibh leis an Acht so.
(2) Ceapfaidh an tAire Iontaobhaithe Náisiúnta na nOispidéal le hordú agus beidh gach iontaobhaí acu san, marab éag, eirghe as, no cur as oifig roimhe sin do, i seilbh oifige mar iontaobhaí den tsórt san go ceann cúig mblian o dháta a cheaptha, ach beidh sé ion-athcheaptha.
(3) Féadfaidh an tAire aon uair, le hordú, duine ar bith do cheap sé chun oifige mar dhuine d'Iontaobhaithe Náisiúnta na nOispidéal do chur as an oifig sin.
(4) Féadfar, le hordú ón Aire ag ceapadh duine no daoine d'Iontaobhaithe Náisiúnta na nOispidéal, a dhearbhú, más gá san sa chás, go ndílseoidh an mhaoin uile, réalta no pearsanta, a bheidh no ba cheart do bheith dílsithe an uair sin in Iontaobhaithe Náisiúnta na nOispidéal, go ndílseoidh sí san iontaobhaí no sna hiontaobhaithe ceaptar amhlaidh agus sna hiontaobhaithe leanúnacha (más ann dóibh) i dteanta a chéile, agus déanfaidh gach dearbhú den tsórt san an mhaoin sin uile do dhílsiú sna hiontaobhaithe sin a ceaptar amhlaidh agus sna hiontaobhaithe leanúnacha san mar chó-thionóntaithe, chun an estáit agus an leasa uile inti ba chóir do réir chirt do bheith dílsithe sna hiontaobhaithe sin agus déanfaidh, maidir leis an maoin uile den tsórt san ná fuil do réir dlí ionaistrithe ach amháin i leabhair aon údaráis, bainc, cuideachtan, no duine eile, a bhronnadh mar cheart ar na hiontaobhaithe sin a éileamh go ndéanfaí an mhaoin sin d'aistriú sna leabhair sin agus i gcás gach maoine eile déanfa sé an dílsiú san gan aon leithliú eile ar bith.
(5) Féadfaidh Iontaobhaithe Náisiúnta na nOispidéal gníomhú d'ainneoin folúntais amháin, ach ní d'ainneoin níos mó na san, do bheith ar a líon.
(6) An dlí i dtaobh iontaobhaithe do bheith freagarthach i sárú iontaoibhe agus i laigheadú luacha cistí iontaobhais no ina gcailliúint san agus i dtaobh iontaobhaithe do bheith saor ón bhfreagarthacht san bainfe sé le hIontaobhaithe Náisiúnta na nOispidéal fé mar a bhaineann sé le hiontaobhaithe ceaptar le dintiúir, agus chun críche imeacht chun aon fhreagarthachta den tsórt san do chur i bhfeidhm tuigfear gurb é an tAire an té atá i dteideal chun tairbhe Ciste Iontaobhais na nOispidéal.
(7) Déanfar gach costas fé n-a raghaidh Iontaobhaithe Náisiúnta na nOispidéal, le ceadú an Aire, agus iad ag feidhmiú a bhfeidhmeanna fén Acht so d'íoc amach as Ciste Iontaobhais na nOispidéal.
Oifigigh agus seirbhísigh Iontaobhaithe Náisiúnta na nOispidéal.
21.—(1) Beidh Iontaobhaithe Náisiúnta na nOispidéal i dteideal oifigigh agus seirbhísigh d'fhostú, pé daoine agus pé méid acu, agus ar pé luach saothair agus téarmaí, is dóich le hIontaobhaithe Náisiúnta na nOispidéal, le ceadú an Aire, do bheith ceart, agus beid i dteideal oifigeach no seirbhíseach ar bith den tsórt san do bhriseadh le ceadú an Aire.
(2) Sa mhéid go gceadóidh an tAire é is amach as Ciste Iontaobhais na nOispidéal a híocfar na costaisí uile fé n-a raghaidh Iontaobhaithe Náisiúnta na nOispidéal fén Acht so agus ortha san beidh luach saothair a gcuid oifigeach agus seirbhíseach.
Cuntaisí Iontaobhaithe Náisiúnta na nOispidéal agus a n-iniúchadh.
22.—(1) Déanfaidh Iontaobhaithe Náisiúnta na nOispidéal gach cuntas is ceart agus is gnáth, ar an airgead go léir do gheobhaid no chaithfid, do choimeád i pé fuirm le n-a aontóidh an tAire.
(2) Déanfar gach bliain cuntaisí Iontaobhaithe Náisiúnta na nOispidéal d'iniúchadh agus tuarasgabháil do thabhairt ortha agus isé dhéanfaidh san ná iniúchóir go gcáilíochta cuibhe a cheadóidh an tAire go bliantúil chuige sin agus déanfaidh Iontaobhaithe Náisiúnta na nOispidéal táillí an iniúchóra san agus costaisí generálta na n-iniúchadh san d'íoc amach as Ciste Iontaobhais na nOispidéal.
(3) Déanfaidh Iontaobhaithe Náisiúnta na nOispidéal, díreach tar éis gach iniúchta fén alt so ar chuntaisí Iontaobhaithe Náisiúnta na nOispidéal, cóip den chuntas chothromaíochta, mar a bheidh glactha leis ag na hiniúchóirí, agus cóip de thuarasgabháil an iniúchóra do chur chun an Aire.
Ciste Iontaobhais na nOispidéal.
23.—(1) Déanfar an t-airgead uile a híocfar no bheidh iníoctha le hIontaobhaithe Náisiúnta na nOispidéal fén Acht so no dá réir do chur in aon chiste amháin ar a dtabharfar, agus dá ngairmtear san Acht so, Ciste Iontaobhais na nOispidéal agus beidh an t-airgead san ar seilbh ag na hIontaobhaithe sin ar iontaoibh chun an chéanna do shuncáil, do bhainistí agus do chur chun críche do réir an Achta so.
(2) Déanfaidh Iontaobhaithe Náisiúnta na nOispidéal pé méid de chaipital Chiste Iontaobhais na nOispidéal ná beidh ag teastáil de thurus na huaire chun íocaíochtaí d'íoc do réir an Achta so do shuncáil agus do choimeád suncálta in urrúis a bheidh údaruithe de réir dlí chun cistí iontaobhais do shuncáil ionta no bheidh údaruithe le hordú ar n-a dhéanamh ag an Aire, le haontú an Aire Airgid, chun Ciste Iontaobhais na nOispidéal do shuncáil ionta.
(3) Féadfaidh Iontaobhaithe Náisiúnta na nOispidéal o am go ham suncáil no aon chuid de shuncáil Chiste Iontaobhais na nOispidéal d'atharú.
(4) An t-ús, na dividenda, agus an t-ioncum uile agus gach suim i bhfuirm bonus do gheobhaidh Iontaobhaithe Náisiúnta na nOispidéal as na hurrúis ina mbeidh Ciste Iontaobhais na nOispidéal suncálta, cuirfear le caipital an Chiste sin iad agus beid ina gcuid de, an túisce ina bhfuighidh na hiontaobhaithe sin iad, ach amháin mara n-orduighidh agus sa mhéid go n-ordóidh an tAire a mhalairt.
(5) Ní bheidh sé dleathach d'Iontaobhaithe Náisiúnta na nOispidéal síntiúisí do lorg do Chiste Iontaobhais na nOispidéal, ach féadfaidh na hiontaobhaithe sin, le toiliú an Aire, aon tsíntiús den tsórt san in airgead a tairgfear dóibh gan é lorg amhlaidh do ghlacadh, agus tuigfear chun crícheanna an ailt seo gach airgead a tairgfear agus a glacfar amhlaidh do bheith íootha leis na hiontaobhaithe sin do réir an Achta so.
(6) Íocfaidh Iontaobhaithe Náisiúnta na nOispidéal amach as Ciste Iontaobhais na nOispidéal na deontaisí, na costaisí, agus an t-airgead eile sin uile a horduítear no a húdaruítear leis an Acht so d'íoc amach as an gCiste sin, ach i gcás in ar gá do réir an Achta so aon ordú, údarás, no ceadú d'fháil i gcóir an íoca san ní déanfar é ach ar fháil an orduithe, an údaráis, no an cheaduithe sin.
Iarrataisí ar dheontaisí as Ciste Iontaobhais na nOispidéal.
24.—(1) Féadfaidh cólucht rialúcháin aon óispidéil no cumainn bhanaltrais i Saorstát Éireann, no duine ar bith a bheidh ar tí aon óispidéal no cumann banaltrais den tsórt san do bhunú, deontas as Ciste Iontaobhais na nOispidéal, chun tairbhe don óispidéal no don chumann san, d'iarraidh ar an Aire aon uair.
(2) Déanfar, i ngach iarratas fén alt so ar dheontas as Ciste Iontaobhais na nOispidéal, a luadh, chó mion-chruinn agus is gá sa chás, cad ina chóir go mbeifear ar aigne an deontas san do chaitheamh agus cadé méid a moltar do bheith sa deontas san.
(3) Déanfaidh an tAire gach iarratas a gheobhaidh sé fén alt so, ar dheontas as Ciste Iontaobhais na nOispidéal, do chur fé bhráid Choimisiúin na nOispidéal, chun lorgaireacht do dhéanamh ina thaobh agus tuarasgabháil air do thabhairt uatha, agus ní thabharfaidh breith ar bith ar an iarratas san go dtí go bhfuighidh tuarasgabháil Choimisiúin na nOispidéal air.
(4) Le linn don Aire iarratas fén alt so, ar dheontas as Ciste Iontaobhais na nOispidéal, do bhreithniú féachfaidh do thuarasgabháil Choimisiúin na nOispidéal ar an iarratas san ach ní bheidh fé cheangal ag an tuarasgabháil sin.
Deontaisí do dheonadh as Ciste Iontaobhais na nOispidéal.
25.—(1) Fé réir forálacha an Achta so féadfaidh an tAire aon uair, uaidh féin no de bhíthin san d'iarraidh air fén Acht so, deontas as Ciste Iontaobhais na nOispidéal do dheonadh chun tairbhe d'aon óispidéal no cumann banaltrais a bheidh cheana i Saorstát Éireann no a beifear ar aigne a bhunú ann, deontas de pé méid agus chun pé crícheanna, ar n-a n-údarú leis an alt so, is dóich leis an Aire is ceart.
(2) Déanfar deontas a bheidh á dheonadh as Ciste Iontaobhais na nOispidéal fén alt so do dheonadh do chólucht rialúcháin an óispidéil no an chumainn bhanaltrais a bheidh ann cheana, no do neach bunuithe an óispidéil no an chumainn bhanaltrais a bheidh beartuithe, do réir mar bheidh, agus gur chun tairbhe dho a bheidh an deontas san á dheonadh, agus déanfar an focal “deonaí” san alt so do léiriú mar fhocal a chialluíonn an cólucht rialúcháin sin no an duine sin, do réir mar is gá sa chás.
(3) Féadfar deontas a bheidh á dheonadh as Ciste Iontaobhais na nOispidéal fén alt so do dheonadh, fé mar is dóich leis an Aire i ngach cás fé leith do bheith ceart, i bhfuirm suime bheidh le n'íoc amach as caipital Ciste Iontaobhais na nOispidéal, no i bhfuirm íocaíochtaí bheidh le n-íoc go bliantúil ar feadh pé tréimhse ordóidh an tAire amach as ioncum Ciste Iontaobhais na nOispidéal, agus má orduíonn an tAire amhlaidh d'Iontaobhaithe Náisiúnta na nOispidéal déanfaid cuid de chaipital Chiste Iontaobhais na nOispidéal do chur i leataoibh agus an chuid sin do shuncáil mar urrú ar dheontas ar bith a deonfar i bhfuirm íocaíochtaí bheidh le n'íoc go bliantúil.
(4) Pé uair a chinnfidh an tAire deontas do dheonadh fén alt so as Ciste Iontaobhais na nOispidéal ordóidh d'Iontaobhaithe Náisiúnta na nOispidéal an deontas san d'íoc amach as Ciste Iontaobhais na nOispidéal agus leis sin íocfaidh na hiontaobhaithe sin méid an deontais sin amach as an gCiste sin le pé duine, agus in aon tsuim amháin pé tráth no ina thráthchoda pé tráthanna, ordóidh an tAire.
(5) Pé uair a dheonfaidh an tAire deontas fén alt so as Ciste Iontaobhais na nOispidéal luadhfaidh cad ina chóir a caithfear an deontas san agus féadfaidh fáil an deontais sin do chur fé pé coinníollacha (pe'ca roimh an bhfáil sin no dá héis a bheid le cólíonadh) is dóich leis is ceart chun a chur in áirithe go ndéanfar an deontas san do chaitheamh go cuibhe ar na crícheanna bheidh luaidhte ag an Aire no chun aon chuspóra eile do chur in áirithe no do thabhairt chun críche: Ach ní bheidh fáil aon deontais den tsórt san fé aon choinníollacha bhainfeadh i slí ar bith le ceapadh no le briseadh no le stiúradh fuirinne aon óispidéil no cumainn bhanaltrais.

(7) Féadfar deontas a dheonfaidh an tAire fén alt so chun tairbhe aon óispidéil no cumainn bhanaltrais a bheidh ann cheana no bheidh beartuithe, féadfar é do dheonadh chun gach críche no chun aon chríche acu so leanas, sé sin le rá:—
(a) talamh no foirgintí, ar a n-áirmhítear aon estát no leas uachtarach no nea-ghlanta i dtalamh no i bhfoirgintí, do cheannach;
(b) foirgintí do thógáil;
(c) foirgintí d'athdhéanamh, do leathnú, d'atharú, no d'fheabhsú;
(d) fearas óispidéil, banaltrais agus eile do cheannach;

Deontas leabharlainne óispidéil.
26.—(1) Féadfaidh an tAire aon tráth, ar n-a iarraidh sin air do dhuine ar bith a bheidh i mbun leabharlainne iasachtaí chun leabhra do chur ar fáil chun úsáide othar no iostaithe in óispidéil no bheidh ar tí leabharlainne den tsórt san do bhunú, deontas (ar a dtabharfar, agus dá ngairmtear san alt so, deontas leabharlainne óispidéil) do dheonadh don duine sin as Ciste Iontaobhais na nOispidéal agus pé méid ann is dóich leis an Aire is ceart, chun costaisí uile no aon chuid de chostaisí na leabharlainne iasachtaí sin d'íoc.
(2) Féadfar deontas leabharlainne óispidéil do dheonadh, fé mar is dóich leis an Aire i ngach cás fé leith do bheith ceart, i bhfuirm suime bheidh le n'íoc amach as capital Chiste Iontaobhais na nOispidéal, no i bhfuirm íocaíochtaí bheidh le n'íoc go bliantúil ar feadh pé tréimhse ordóidh an tAire amach as ioncum Chiste Iontaobhais na nOispidéal, agus má orduíonn an tAire amhlaidh d'Iontaobhaithe Náisiúnta na nOispidéal déanfaid cuid de chaipital Chiste Iontaobhais na nOispidéal do chur i leataoibh agus an chuid sin do shuncáil mar urrú ar aon deontas leabharlainne óispidéil a deonfar i bhfuirm íocaíochtaí bheidh le n'íoc go bliantúil.

PUBLIC HOSPITALS ACT, 1933.
Definitions.
1.—In this Act—
the expression “the Minister” (except where used by way of quotation from another Act) means the Minister for Local Government and Public Health;
the word “sweepstake” means a drawing or distribution or a series of drawings or distributions of prizes by lot or chance whether with or without reference to the result of a future uncertain event;
the expression “drawing of prizes” means a drawing of tickets or other similar procedure which is entirely dependent on chance and whereby the distribution of prizes in a sweepstake is determined whether directly or by reference to the result of a future uncertain event or partly directly and partly by such reference;
the word “hospital” means an institution or organisation in Saorstát Eireann which affords medical, surgical, or dental treatment to human beings, and includes any institution or organisation in Saorstát Eireann for the prevention, treatment, or cure of human disease, injury, or deformity and any institution or organisation for affording asylum to blind, deaf, dumb, or mentally defective persons, or to expectant mothers, or mothers with their children of less than five years of age, and also includes infirmaries provided by local authorities (whether as parts of county homes or otherwise) for the care and treatment of aged and infirm persons and infirmaries not so provided but to which such persons are sent by any local authority, and also includes institutions or organisations for carrying on medical research, but does not include any institution or organisation conducted by persons for their private profit;
the expression “nursing organisation” means an institution or organisation in Saorstát Eireann which has for its sole or principal object the nursing of, and providing of nurses for, poor persons suffering from physical diseases, injuries, or deformities or poor women in childbirth;
the expression “governing body” means the council, board, committee or other body having the control and management of the hospital or nursing organisation in relation to which the expression is used and (save where precluded by the context) includes a local authority having the control of such hospital or organisation.
Calculation of moneys received from sale of tickets.
2.—When calculating for the purposes of this Act the amount of the moneys received from the sale of tickets in a sweepstake, the value of tickets issued free of charge by way of reward to a seller of tickets shall be excluded from the calculation, and there shall be deducted from the nominal selling price of all other tickets all commissions, prizes, and other remuneration given in relation to the selling of such tickets.
Expenses.
3.—Save as is otherwise provided by this Act, all expenses incurred by any Minister in the execution of this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals and transitory provisions.
4.—(1) The Public Charitable Hospitals Acts, 1930 to 1932, are hereby repealed, but such repeal shall have effect subject and without prejudice to the subsequent provisions of this section.
(2) The Public Charitable Hospitals Acts, 1930 to 1932, shall continue to apply to every sweepstake for which a scheme was sanctioned under those Acts before the passing of this Act but with and subject to the following modifications, that is to say:—
(a) the available surplus within the meaning of sections 5 and 6 of the Public Charitable Hospitals (Amendment) Act, 1931 (No. 24 of 1931), in every such sweepstake in which a drawing of prizes takes place after the passing of this Act shall (subject to the payment of any duty or tax chargeable in respect thereof) be paid to the National Hospital Trustees and disposed of in accordance with this Act;
(b) so much of the available surplus within the meaning aforesaid in any such sweepstake in which the drawing or all the drawings of prizes has or have taken place before the passing of this Act as has not been lawfully disposed of by the sweepstake committee before such passing shall (subject to the payment of so much of any duty or tax chargeable in respect thereof as remains unpaid at such passing) be paid to the National Hospital Trustees and disposed of in accordance with this Act;
(c) the Minister shall pay to the National Hospital Trustees, to be disposed of in accordance with this Act, so much (if any) of any available surplus within the meaning aforesaid as has been paid to him under the said Acts before the passing of this Act and is not required by him for purposes authorised by those Acts in respect of which arrangements were made before the passing of this Act;
(d) section 3 of the Public Charitable Hospitals (Amendment) Act, 1931, shall not apply and shall be deemed never to have applied in relation to any sweepstake in respect of which a committee of reference was not appointed under that section before the passing of this Act.
Appointment of sweepstake committee.
5.—(1) Whenever the governing body of a hospital (other than a hospital under the control of a local authority or a county infirmary or a county fever hospital) or the governing bodies of two or more such hospitals desires or desire to hold sweepstakes under this Act to raise money for the purposes of the Hospitals Trust Fund, such governing body or bodies (in this Act referred to as the organisers) may appoint for the purpose of such sweepstakes a committee (in this Act referred to as a sweepstake committee), of such number and of such persons at the organisers may think proper, to manage and control such sweepstakes.
(2) Vacancies occurring by death or resignation in the membership of a sweepstake committee may be filled by the organisers by whom such committee was appointed.
(3) A sweepstake committee may act notwithstanding one or more vacancies in its membership.
(4) No member of a sweepstake committee shall receive any remuneration for acting as a member of such committee or for any services rendered or work done by him in relation to the sweepstakes for the purposes of which such committee was appointed.
(5) If the Minister for Justice by direction in writing delivered at the address of a sweepstake committee or posted to such address so directs, or if the organisers by which a sweepstake committee was appointed by direction in writing delivered at or posted to such address so direct, or if a sweepstake committee by passing a resolution so decides such sweepstake committee shall not, after the date of receiving from the said Minister or from such organisers such direction or of passing such resolution, submit to the Minister for Justice under this Act any scheme in respect of any sweepstake, and shall continue to be a sweepstake committee only for the purposes of any sweepstake in respect of which a scheme had been submitted to the Minister for Justice under this Act by such sweepstake committee prior to such date, and such sweepstake committee shall as from such date be dissolved for all other purposes.
(6) No sweepstake committee shall be appointed under this section while any other sweepstake committee is in existence unless such other sweepstake committee has, under the foregoing sub-section, received a direction from the Minister for Justice or from the organisers by whom such sweepstake committee was appointed, or has passed a resolution under that sub-section.
Submission of scheme by sweepstake committee.
6.—Whenever organisers who have appointed a sweepstake committee propose to hold a particular sweepstake such sweepstake committee shall prepare and submit to the Minister for Justice a scheme specifiying in relation to such sweepstake the following matters, that is to say:—
(a) the name or names of the hospital or hospitals of which the organisers are the governing body or governing bodies;
(b) the names of the members of such committee;
(c) particulars of the prizes intended to be distributed in such sweepstake, including the money value of any prize which is not a sum of money;
(d) the number of drawings of prizes intended to be made in such sweepstake and the date on which, the place at which, and the manner in which such drawing or each of such drawings (if more than one) is intended to be made;
(e) the price intended to be charged for tickets in such sweepstake;
(f) the amount or the maximum amount proposed to be allowed or expended by way of commission, prize, or other remuneration in relation to the sale of tickets in such sweepstake, and the proportion of free tickets proposed to be allotted by way of reward to the seller of any particular number of tickets in such sweepstake;
(g) the names of not less than three trustees (in this Act referred to as the sweepstake trustees) who have in writing consented to act as such trustees and in whose names the deposit or deposits required by this Act is or are intended to be made;
(h) the name of the public bank in Saorstát Eireann in which the deposit or deposits required by this Act will be made;
(i) if the deposit or deposits required by this Act is or are intended to be made wholly or partly by the deposit of securities, a general description of such securities;
(j) the date on which the sale of tickets in such sweepstake is to commence; and
(k) the chartered accountant or other qualified auditor or accountant intended to be employed in accordance with this Act to audit the accounts relating to such sweepstake.
Sanction of scheme by Minister for Justice and consequent legality of sweepstake.
7.—(1) When a scheme is submitted to the Minister for Justice by a sweepstake committee under this Act, the said Minister may, if he so thinks proper and if he is satisfied that such committee was appointed by organisers entitled to appoint such committee under this Act, sanction such scheme either without modification or with such modifications as he may think fit to make therein.
(2) When a scheme is submitted to the Minister for Justice under this Act, the said Minister may, for the purpose of satisfying himself that the sweepstake committee submitting such scheme was appointed by organisers entitled under this Act to appoint such committee, require such evidence by statutory declaration or otherwise as he thinks fit.
(3) When a scheme submitted to the Minister for Justice under this Act has been sanctioned (whether with or without modification) by the said Minister it shall, notwithstanding anything to the contrary contained in any other Act, be lawful for the organisers by whom the sweepstake committee which submitted such scheme was appointed to hold the sweepstake to which such scheme relates subject to and in accordance with the following conditions, that is to say:—
(a) such sweepstake shall be conducted and managed by the said sweepstake committee appointed under this Act for the purpose of such sweepstake, and
(b) such sweepstake shall be held, conducted, and managed in all respects in accordance with such scheme as sanctioned by the Minister for Justice, and
(c) the provision of this Act requiring anything to be done or prohibiting the doing of anything in relation to a sweepstake held under this Act shall be observed in relation to such sweepstake, and
(d) no tickets in such sweepstake shall be issued free of charge except tickets issued to sellers of tickets by way of reward for effecting such sale.
Deposit to secure payment of prizes.
8.—(1) Whenever a sweepstake is held under this Act, the sweepstake committee managing such sweepstake shall make or cause to be made, in respect of the drawing or each of the several drawings (as the case may be) of prizes in such sweepstake, a deposit (in this Act referred to as the deposit) in accordance with the following provisions, that is to say:—
(a) such deposit shall be made by depositing in the bank named in that behalf in the scheme relating to such sweepstake and in the names of the sweepstake trustees named in such scheme such moneys or securities as are hereinafter mentioned;
(b) where every prize to be drawn for at the drawing in respect of which the deposit is made is either of a fixed amount or not a sum of money, the deposit shall be equal in amount or value to the total amount or value of such prizes and shall be made before the sale of any tickets in such sweepstake;
(c) where the amount or value of all or any of the prizes to be drawn for at the drawing in respect of which the deposit is made is wholly or partly dependent on or to be calculated by reference to the amount of the moneys received from the sale of tickets in such sweepstake, the deposit shall be made at such time and be of such amount and be so increased from time to time that the amount of the deposit shall not at any time be less than the sum which would be the total amount or value of the prizes to be drawn for at such drawing if such amount or value were calculated by reference to the amount of the moneys at that time already received from the sale of tickets in such sweepstake;
(d) where in a case to which the next foregoing paragraph applies a minimum amount or value is specified in relation to the prizes to be drawn for at the drawing in respect of which the deposit is made, so much of such deposit as is equal to such minimum amount or value shall be made before any tickets are sold for the drawing in respect of which such minimum is specified, and such additions (if any) as the case may require shall be made thereto from time to time in accordance with the said foregoing paragraph;
(e) the deposit may be made in either or both of the following ways, that is to say, by the deposit of money or by the deposit of sound marketable stocks, shares, or securities of a description specified in that behalf in the scheme relating to such sweepstake;
(f) the value for the purposes of this section of any stocks, shares, or securities included in the deposit shall be taken to be the market price thereof on the day on which they are deposited.
(2) The interest, dividends, and other income accruing during the continuance of the deposit on moneys or on stocks, shares, or securities included in the deposit shall not form part of such deposit, but shall belong and be payable to the person by whom such moneys, stocks, shares, or securities were provided.
Application of deposit.
9.—(1) If any prize duly drawn in a sweepstake is not duly paid or handed over by the sweepstake committee managing such sweepstake to the person entitled thereto under the terms of such sweepstake, the sweepstake trustees shall pay to such person out of the deposit made in respect of the drawing at which such prize was drawn the amount or value of such prize or so much of such amount or value as has not been paid to him by such committee, and such trustees shall for the purpose of making such payment have full power at their discretion to realise all or any stocks, shares or securities included in such deposit.
(2) When all prizes drawn at the drawing in relation to which a deposit is made have been fully paid or handed over, whether without resort to such deposit or wholly or partly out of such deposit, the sweepstake trustees in whose names such deposit is standing shall return to the person by whom the moneys or securities included in such deposit were provided the whole or so much as is not otherwise applied under this section (as the case may require) of such moneys and securities.
(3) If the drawing of prizes in relation to which a deposit is made is, with the consent of the Minister for Justice, not made, the sweepstake trustees in whose names such deposit is standing shall return any moneys, stocks, shares and securities comprised in such deposit to the person by whom they were provided.
Form of tickets and restrictions on advertisements, &c.
10.—(1) Every book of tickets in a sweepstake held under this Act shall have clearly printed thereon a statement that such sweepstake is being held under this Act for the benefit of hospitals and kindred institutions in the Irish Free State.
(2) Every ticket in a sweepstake held under this Act shall have clearly printed thereon a statement requesting the purchaser of such ticket, in the event of the committee managing such sweepstake failing to acknowledge the receipt of the price of such ticket, to send direct to such committee a notification of such failure, and such ticket shall also have clearly printed thereon a sufficient indication of the name and address to which such notification should be sent.
(3) No advertisement, memorandum, circular, book of tickets, ticket, or other document issued in relation to a sweepstake by the sweepstake committee for such sweepstake shall contain any words indicating or which could reasonably be construed as indicating that such sweepstake is being held under the auspices or patronage of the Government of Saorstát Eireann or of any Minister head of a Department of State.
(4) If any advertisement, memorandum, book of tickets, ticket, or other document issued in relation to a sweepstake by the sweepstake committee for such sweepstake contravenes any provision of this section, every member of such committee shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
Use of Saorstát Eireann labour and materials.
11.—So far as may be practicable, all printing for or in connection with a sweepstake held under this Act shall be done in Saorstát Eireann and all paper and other materials used for the purpose of any such sweepstake shall be of Saorstát Eireann manufacture.
Application of proceeds of sweepstakes.
12.—(1) The balance of the moneys received from the sale of tickets in a sweepstake held under this Act remaining after paying or providing for the prizes distributed in such sweepstake, the expenses incurred in holding such sweepstake, and any duty or tax chargeable in respect of such balance shall be paid to the National Hospital Trustees.
(2) The following limitations shall apply in respect of the application of the moneys received from the sale of tickets in a sweepstake held under this Act, that is to say:—
(a) the amount applied out of such moneys for paying the expenses incurred in holding such sweepstake (other than tickets, commission, prizes or other remuneration given in relation to the sale of tickets) shall not exceed thirty per cent. of such moneys;
(b) where a payment is made to a person for promoting such sweepstake, such payment shall be deemed for the purposes of this Act to be part of the expenses of holding such sweepstake and shall not exceed seven per cent. of the said moneys received from the sale of tickets in such sweepstake;
(c) the amount paid in pursuance of this section to the National Hospital Trustees in respect of any sweepstake together with the amount of any duty or tax chargeable in respect of the moneys or any part of the moneys received from the sale of tickets in such sweepstake shall not be less than twenty per cent. of the said moneys received from the sale of tickets in such sweepstake.
Audit of accounts of sweepstakes.
13.—(1) Within three months after the drawing of prizes or, where there is more than one drawing, after the last drawing of prizes, in a sweepstake held under this Act the sweepstake committee managing such sweepstake shall cause the accounts of all receipts and disbursements of money in relation to such sweepstake to be audited by the person named in that behalf in the scheme relating to such sweepstake or, if such person is not available, by some other similarly qualified person previously approved of by the Minister for Justice.
(2) Every sweepstake committee shall furnish to the Minister for Justice and to every member of the Oireachtas, within two months after the audit in pursuance of this section, a copy of the accounts relating to the sweepstake for which such committee was appointed as audited under this section, together with a copy of the auditor's certificate and report on such audit.
Establishment of Hospitals Commission.
14.—(1) As soon as conveniently may be after the passing of this Act the Minister shall by order establish a commission which shall be styled “the Hospitals Commission” and shall consist of not less than three ordinary members of whom one shall be the chairman of the Commission.
(2) The ordinary members of the Hospitals Commission shall be appointed and the chairman of that Commission shall be nominated by the Minister by order from time to time as occasion requires.
(3) The Minister, whenever in his opinion circumstances so require, may by order appoint such and so many persons as he may think fit to be additional members of the Hospitals Commission for a specified time (not exceeding two years) or until sooner removed under this section.
(4) The Minister may at any time by order remove any member of the Hospitals Commission from his office as such member, and also may at any time by order remove the chairman of the Hospitals Commission from his position as such chairman.
(5) Every ordinary member of the Hospitals Commission shall, unless he previously dies, resigns, or is removed from office, retain office as such member for two years from the date of his appointment, but shall be eligible for reappointment.
(6) For the purposes of performing his duties under this Act every member of the Hospitals Commission may visit all or any of the premises of any hospital or nursing organisation which shall have participated in any sweepstake promoted under the Public Charitable Hospitals Acts, 1930 to 1932, or under this Act, or which shall have applied for a grant out of the Hospitals Trust Fund under section 24 hereof or of any institution under the control of or assisted by local authorities and shall be entitled to inspect and examine such premises and the fittings and equipment thereof, and shall also be entitled to call for and be furnished with full information in relation to the management and the financial position of any hospital or nursing organisation and to see and examine all accounts of the receipts and expenditure of the governing body of such hospital or nursing organisation and also all or any books and other documents containing any record of such receipts and expenditure.
(7) Each member of the Hospitals Commission shall be paid such (if any) remuneration as the Minister shall from time to time direct.
(8) The Hospitals Commission may act notwithstanding one vacancy among its ordinary members.
Officers and servants of the Hospitals Commission.
15.—(1) The Hospitals Commission shall be entitled to employ such and so many officers and servants (including as and when necessary professional or technical advisers) at such remuneration and on such terms as such Commission shall, with the sanction of the Minister, think proper and, with such sanction, to dismiss any such officer or servant.
(2) The Hospitals Commission shall be entitled to receive from the Minister such facilities and from the officers of the Minister such assistance as the Minister shall direct.
(3) Every member and every officer of the Hospitals Commission, when travelling in performance of his duties as such member or officer, shall be entitled to receive and be paid travelling expenses and maintenance allowance at such rate as shall be sanctioned by the Minister.
Expenses of Hospitals Commission.
16.—(1) There shall be paid to the Hospitals Commission out of the Hospitals Trust Fund from time to time such sums as the Minister may sanction for the expenses of the Hospitals Commission and that Commission shall defray out of such sums expenses, to such extent as shall be sanctioned by the Minister, incurred by them in the execution of their functions under this Act including the remuneration, travelling expenses, and maintenance allowances payable to members and officers of the Hospitals Commission.
(2) There shall be paid out of the Hospitals Trust Fund into or for the benefit of the Exchequer at such times and in such manner as the Minister for Finance shall direct such sum in respect of every financial year as the Minister, with the sanction of the Minister for Finance, shall determine to be the amount properly payable in respect of facilities provided by the Minister and assistance rendered by officers of the Minister for or to the Hospitals Commission under this Act in such financial year.
Functions of the Hospitals Commission.
17.—It shall be the duty of the Hospitals Commission to do the following things, that is to say:—
(a) on their own motion to inquire into, examine, and survey generally the hospital and nursing facilities existing in Saorstát Eireann and to collect, record and digest information in relation to such facilities, the needs of the people for such facilities, and the adjustment of such facilities to such needs;
(b) to investigate and report to the Minister on every matter relating to hospital or nursing facilities in Saorstát Eireann which is referred to them by the Minister for such investigation and report;
(c) at the request of the Minister, to make and submit to the Minister schemes for the improvement and co-ordination of hospital or nursing or both hospital and nursing facilities in the whole or any particular part of Saorstát Eireann;
(d) to investigate and report to the Minister on every matter referred to them by the Minister under or in pursuance of any provision of this Act other than this section;
(e) on their own motion or at the request of the Minister to advise the Minister on any matter relating to the administration of the Hospitals Trust Fund.
Saving as to alteration of constitution, etc., of certain hospitals.
18.—Nothing contained in the last preceding section shall empower the Hospitals Commission to make and submit to the Minister a scheme which shall involve an alteration of the constitution or an interference with the administration of a hospital which did not receive any benefit from any sweepstake promoted under the Public Charitable Hospitals Acts, 1930 to 1932 and does not receive any benefit from a sweepstake promoted under this Act and which does not receive any grant from a local authority.
Accounts and audits of Hospitals Commission.
19.—(1) The Hospitals Commission shall keep in such form as shall be approved by the Minister all proper and usual accounts of all moneys received or expended by them.
(2) The accounts of the Hospitals Commission shall in each year be audited and be the subject of a report to the Minister by a duly qualified auditor appointed annually for the purpose by the Minister, and an amount fixed by the Minister as the fee of such auditor shall be paid by the Hospitals Commission to the Minister as part of their expenses.
The National Hospital Trustees.
20.—(1) As soon as conveniently may be after the passing of this Act, the Minister shall by order establish a body of five trustees, to be styled the National Hospital Trustees, to exercise the powers and perform the duties assigned to them by this Act.
(2) The National Hospital Trustees shall be appointed by the Minister by order and every such trustee shall, unless he sooner dies, resigns, or is removed from office, hold office as such trustee for five years from the date of his appointment, but shall be eligible for reappointment.
(3) The Minister may at any time by order remove any person whom he has appointed to the office of National Hospital Trustee from that office.
(4) An order of the Minister appointing a National Hospital Trustee or Trustees may, if the circumstances so require, declare that all property, real or personal, which then is or ought to be vested in the National Hospital Trustees shall vest in the trustee or trustees so appointed in conjunction with the continuing trustees (if any), and every such declaration shall operate to vest in such appointed and continuing trustees as joint tenants all such property for all the estate and interest therein which should properly be vested in such trustees and shall, in respect of all such property which is by law transferable only in the books of any authority, bank, company, or other person, confer on such trustees the right to call for a transfer of such property in such books and, in the case of all other property, shall effect such vesting without any further or other conveyance.
(5) The National Hospital Trustees may act notwithstanding one, but only one, vacancy in their number.
(6) The law relating to the liability of trustees for breaches of trust and for depreciation or loss of trust funds and to the immunity of trustees from such liability shall apply to the National Hospital Trustees in like manner as it applies to trustees appointed by deed, and for the purpose of proceedings to enforce any such liability the Minister shall be deemed to be the person beneficially entitled to the Hospitals Trust Fund.
(7) All expenses incurred by the National Hospital Trustees, with the sanction of the Minister, in the execution of their functions under this Act shall be defrayed out of the Hospitals Trust Fund.
Officers and servants of National Hospital Trustees.
21.—(1) The National Hospital Trustees shall be entitled to employ such and so many officers and servants at such remuneration and on such terms as the National Hospital Trustees shall, with the sanction of the Minister, think proper, and, with such sanction, to dismiss any such officer or servant.
(2) All expenses incurred by the National Hospital Trustees under this Act, including the remuneration of their officers and servants, shall, to such extent as may be sanctioned by the Minister, be defrayed out of the Hospitals Trust Fund.
Accounts and audits of National Hospital Trustees.
22.—(1) The National Hospital Trustees shall keep in such form as shall be approved by the Minister all proper and usual accounts of all moneys received or expended by them.
(2) The accounts of the National Hospital Trustees shall in each year be audited and be the subject of a report by a duly qualified auditor approved annually for the purpose by the Minister and the fees of such auditor and the expenses generally of such audits shall be paid by the National Hospital Trustees out of the Hospitals Trust Fund.
(3) Immediately after every audit under this section of the accounts of the National Hospital Trustees, the National Hospital Trustees shall send to the Minister a copy of the balance sheet as passed by the auditors and a copy of the auditor's report.
The Hospitals Trust Fund.
23.—(1) All moneys paid or payable to the National Hospital Trustees under or in pursuance of this Act shall form a single fund to be known and in this Act referred to as the Hospitals Trust Fund and shall be held by the said Trustees upon trust to invest, manage, and apply the same in accordance with this Act.
(2) So much of the capital of the Hospitals Trust Fund as is for the time being not required for making disbursements in pursuance of this Act shall be invested and kept invested by the National Hospital Trustees in securities authorised by law for the investment of trust funds or authorised by order made by the Minister, with the concurrence of the Minister for Finance, for the investment of the Hospitals Trust Fund.
(3) The National Hospital Trustees may from time to time vary the investment or any part of the investment of the Hospitals Trust Fund.
(4) All interest, dividends, and income and all sums in the nature of bonus received by the National Hospital Trustees on the securities in which the Hospitals Trust Fund is invested shall, save if and so far as is otherwise directed by the Minister, be added to and form part of the capital of the said Fund as from the receipt thereof by the said trustees.
(5) It shall not be lawful for the National Hospital Trustees to solicit contributions to the Hospitals Trust Fund, but the said trustees, may, with the consent of the Minister, accept any such contribution in money which is offered to them without such solicitation, and all money so offered and accepted shall for the purposes of this section be deemed to be paid to the said trustees in pursuance of this Act.
(6) The National Hospital Trustees shall pay out of the Hospitals Trust Fund all such grants, expenses, and other moneys as are directed or authorised by this Act to be paid out of that Fund but, where any direction, authority, or sanction is required by this Act for such payment, only upon such direction, authority, or sanction.
Applications for grants out of the Hospitals Trust Fund.
24.—(1) The governing body of any hospital or nursing organisation in Saorstát Eireann or any person about to establish any such hospital or nursing organisation may at any time apply to the Minister for a grant out of the Hospitals Trust Fund for the benefit of such hospital or organisation.
(2) Every application under this section for a grant out of the Hospitals Trust Fund shall state with such particularity as the circumstances may require the purposes for which such grant is proposed to be expended and the suggested amount of such grant.
(3) The Minister shall refer to the Hospitals Commission for investigation and report every application made to him under this section for a grant out of the Hospitals Trust Fund and shall not make any determination in regard to such application until he has received the report of the Hospitals Commission thereon.
(4) In considering an application under this section for a grant out of the Hospitals Trust Fund the Minister shall have regard to the report of the Hospitals Commission on such application, but shall not be bound by such report.
Making of grants out of the Hospitals Trust Fund.
25.—(1) Subject to the provisions of this Act, the Minister may at any time, either on his own motion or in consequence of an application to him under this Act, make for the benefit of any existing or proposed hospital or nursing organisation in Saorstát Eireann a grant out of the Hospitals Trust Fund of such amount and for such purposes authorised by this section as the Minister shall think proper.
(2) A grant made out of the Hospitals Trust Fund under this section shall be made to either (as the case may be) the governing body of the existing hospital or nursing organisation or the person establishing the proposed hospital or nursing organisation for the benefit of which such grant is made and the word “grantee” shall in this section be construed as meaning such governing body or such person, as the case may require.
(3) A grant made out of the Hospitals Trust Fund under this section may, as the Minister shall in each case think proper, be in the form of a sum to be paid out of the capital of the Hospitals Trust Fund or in the form of payments to be made annually, for such period as the Minister shall direct, out of the income of the Hospitals Trust Fund and the National Hospital Trustees shall if so directed by the Minister set aside a portion of the capital of the Hospitals Trust Fund and invest such portion for the purpose of securing any grant made in the form of payments to be made annually.
(4) Whenever the Minister determines to make under this section a grant out of the Hospitals Trust Fund he shall direct the National Hospital Trustees to pay such grant out of the Hospitals Trust Fund and thereupon the said trustees shall pay the amount of such grant out of the said Fund to such person and at such time or in instalments at such times as the Minister directs.
(5) Whenever the Minister makes under this section a grant out of the Hospitals Trust Fund, he shall specify the purposes for which such grant is to be expended and may attach to the receipt of such grant such conditions (whether to be performed before or after such receipt) as he thinks proper for securing the due expenditure of such grant on the purposes specified by the Minister or for securing or attaining any other object: Provided, however, that no conditions shall be attached to the receipt of any such grant in any way relating to the appointment, dismissal or control of the staff of any hospital or nursing organisation.
(6) If, after the making of a grant out of the Hospitals Trust Fund under this section to any grantee and before payment of such grant or before the making of any particular payment in respect of such grant, the Minister is satisfied that any condition attached under the foregoing sub-section to the receipt of such grant has not been complied with by such grantee, the Minister may certify to the National Hospital Trustees that such condition has not been complied with and upon the Minister so certifying, the National Hospital Trustees shall not make, and such grantee shall cease to be entitled to, any such payment of or in respect of such grant or to any future payment in respect thereof unless and until the Minister otherwise directs.
(7) A grant made by the Minister under this section for the benefit of any existing or proposed hospital or nursing organisation may be made for all or any of the following purposes, that is to say:—
(a) the purchase of land or buildings, including any superior or outstanding estate or interest in land or buildings;
(b) the construction of buildings;
(c) the reconstruction, extension, alteration or improvement of buildings;
(d) the purchase of hospital, nursing and other equipment;
(e) the endowment of any such hospital or nursing organisation or any part of the activities of any such hospital or nursing organisation, including in the case of any such hospital the endowment of a bed or beds in such hospital;
(f) the payment of maintenance expenses;
(g) the discharge of debts.
Hospital library grant.
26.—(1) The Minister may at any time, at the request of any person controlling or about to establish a lending library for supplying books for the use of patients or inmates in hospitals, make a grant (to be known and in this section referred to as a hospital library grant) to such person out of the Hospitals Trust Fund, of such amount as the Minister shall think proper, for the purpose of defraying all or any of the expenses of such lending library.
(2) A hospital library grant may, as the Minister shall in each case think proper, be in the form of a sum to be paid out of the capital of the Hospitals Trust Fund or in the form of payments to be made annually, for such period as the Minister shall direct, out of the income of the Hospitals Trust Fund and the National Hospital Trustees shall, if so directed by the Minister, set aside a portion of the capital of the Hospitals Trust Fund and invest such portion for the purpose of securing any hospital library grant made in the form of payments to be made annually.
(3) Whenever the Minister determines to make under this section a hospital library grant, he shall direct the National Hospital Trustees to pay such grant out of the Hospitals Trust Fund and thereupon the said Trustees shall pay the amount of such grant out of the said Fund to such person and at such time or in instalments at such times as the Minister directs.
(4) Whenever the Minister makes under this section a hospital library grant, he shall specify the purposes for which such hospital library grant is to be expended and may attach to the receipt of such hospital library grant such conditions (whether to be performed before or after such receipt) as he thinks proper for securing the due expenditure of such hospital library grant on the purposes specified by the Minister.
(5) If, after the making of a hospital library grant under this section to any person and before payment of such hospital library grant or before the making of any particular payment in respect thereof, the Minister is satisfied that any condition attached under the foregoing sub-section to the receipt of such hospital library grant has not been complied with by the person to whom such grant was made, the Minister may certify to the National Hospital Trustees that such condition has not been complied with and, upon the Minister so certifying, the National Hospital Trustees shall not make, and the person to whom such grant was made shall cease to be entitled to, any such payment of or in respect of such hospital library grant or to any future payment in respect thereof unless and until the Minister otherwise directs.
Short title.
27.—This Act may be cited as the Public Hospitals Act, 1933.
