Bunú, cuspóir agus ré na Scéime.

2.—(1) Féadfaidh an tAire, de réir an Achta seo, scéim ar a dtabharfar an Clár Préimheanna Fostaíochta (agus dá ngairtear an Scéim san Acht seo), a bhunú agus a riaradh agus féadfaidh sé an Scéim a leasú ó am go ham.

(2) Is é cuspóir na Scéime uchtach a thabhairt d'fhostóirí atá ag gabháil do thionscail nó do ghníomhaíochtaí lena mbaineann an Scéim chun daoine lena mbaineann an Scéim a fhostú.

(3) Maidir leis an Scéim—

(a) tiocfaidh sí, a mhéid a bhaineann sí le talmhaíocht (lena n-áirítear garraíodóireacht) i ngníomh an 3ú lá de Lúnasa, 1975, agus

(b) measfar, a mhéid a bhaineann sí le tionscail mhonaraíochta, gur tháinig sí i ngníomh an 29ú lá de Mheitheamh, 1975,

agus scoirfidh sí d'éifeacht a bheith aici an 26ú lá de Mheitheamh, 1976, gan dochar d'aon choinníollacha de chuid na Scéime a leanfaidh d'fheidhm a bheith acu tar éis an dáta sin.

Feidhm na Scéime a chinneadh.

3.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, a mhéid a bhaineann an Scéim le tionscail mhonaraíochta a chinneadh (agus sonróidh sé sa Scéim) cé na tionscail nó cé na gníomhaíochtaí i dtionscail shonraithe agus cé na daoine nó na haicmí daoine lena mbaineann an Scéim.

(2) Gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfar cinneadh faoin alt seo a dhéanamh faoi threoir cibé ní nó i cibé slí is cuí leis an Aire agus, maidir le duine nó aicme daoine a chinneadh amhlaidh, féadfaidh tréimhse íosta shonraithe dhífhostaíochta a bheith mar cheanglas ann.

Préimheanna fostaíochta a íoc le fostóirí.

4.—(1) Beidh socrú sa Scéim le go n-íocfaidh an tAire le fostóir lena mbaineann an Scéim suim (ar a dtabharfar, agus dá ngairtear san Acht seo, préimh fhostaíochta) i leith an duine nó na ndaoine lena mbaineann an Scéim agus atá ar fostú ag an bhfostóir sin.

(2) Is é méid a bheidh i bpréimh fhostaíochta cibé méid a bheidh sonraithe sa Scéim, agus féadfar méideanna éagsúla a shonrú amhlaidh do thréimhsí éagsúla.

(3) D'ainneoin fho-ailt (1) agus (2) den alt seo, féadfaidh socrú a bheith sa Scéim le préimh a laghdú nó a bheith gan íoc i gcás inar deimhin leis an Aire go bhfuil airgead á fháil nó faighte ar mhodh deontais nó iasachta ag an bhfostóir lena mbaineann ó aon chomhlacht a bunaíodh le reacht chun fostaíocht nó tionscal a chur ar aghaidh, a ghríosú nó chun cuidiú leis sin.

Eolas agus foirmeacha

5.—Féadfaidh forálacha a bheith sa Scéim á cheangal ar fhostóir a iarrfaidh préimh fhostaíochta cibé eolas a thabhairt don Aire a mheasfaidh an tAire, uaidh féin, is gá lena chur ar a chumas a chinneadh cibé acu a bhaineann nó nach mbaineann an Scéim leis an bhfostóir sin, le tionscal nó le gníomhaíocht i dtionscal sonraithe a sheolann sé nó le fostaí nó le haicme fostaí ina fhostaíocht, agus féadfaidh socrú a bheith inti do cibé foirmeacha is dóigh leis an Aire is gá chuige sin agus, i gcoitinne, chun an Scéim a riaradh go héifeachtúil.

Cigirí.

6.—(1) San alt seo ciallaíonn “cigire” duine arna cheapadh ag an Aire chun bheith ina chigire chun críocha an Achta seo.

[EN]

(2) Féadfaidh cigire—

[EN]

(a) dul isteach gach tráth réasúnach in aon áitreabh nó áit atá ar áitiú ag fostóir a bhfuil préimh fhostaíochta iarrtha aige,

[EN]

(b) aon scrúdú nó fiosrú a dhéanamh ansin is gá chun an Scéim a riaradh go héifeachtúil,

[EN]

(c) a cheangal ar fhostóir nó ar a ionadaí aon taifid a thabhairt ar aird agus iontrálacha sna taifid a iniúchadh agus cóipeanna a dhéanamh díobh,

[EN]

(d) scrúdú a dhéanamh, maidir le haon ábhar faoin Scéim, ar aon duine a mbeidh cúis réasúnach aige a chreidiúint gur fostóir nó fostaí nó gurbh fhostóir nó gurbh fhostaí é agus a cheangal air cibé ceisteanna (seachas ceisteanna a d'ionchoireodh é) a fhreagairt a chuirfidh an cigire i ndáil le hábhar den sórt sin agus dearbhú ar fhírinne na bhfreagraí a shíniú.

(3) Ní bheidh na cumhachtaí a thugtar do chigire le fo-alt (2) (a) den alt seo infheidhmithe maidir le teach cónaí príobháideach mura ndeimhneoidh an tAire (nó oifigeach don Aire arna cheapadh ag an Aire chuige sin) go bhfuil cúiseanna réasúnacha aige a chreidiúint go bhfuil cion faoin Acht seo i ndáil le fostaí a bhí ar fostú sa teach déanta ag an bhfostóir, agus go dtabharfaidh an cigire, an tráth a iarrfaidh sé cead isteach sa teach, an deimhniú ar aird.

(4) Aon duine—

[EN]

(a) a choiscfidh nó a bhacfaidh cigire agus an cigire ag feidhmiú aon chumhachta a thugtar leis an alt seo,

[EN]

(b) a dhiúltóidh aon taifead a thabhairt ar aird a cheanglóidh cigire go dleathach air a thabhairt ar aird,

[EN]

(c) a dhéanfaidh, nó a chuirfidh faoi deara, nó a cheadóidh go feasach, aon taifead is eol dó a bheith bréagach in aon phonc ábhartha a thabhairt ar aird do chigire,

[EN]

(d) a chuirfidh cosc ar aon duine, nó a fhéachfaidh le cosc a chur ar aon duine, láithriú os comhair cigire nó a cheistiú ag cigire, nó

[EN]

(e) a mhainneoidh nó a dhiúltóidh go toiliúil déanamh de réir aon cheanglais dhleathaigh ó chigire faoi fho-alt (2) (d) den alt seo,

beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £300 nó, más é an dara cion nó cion dá éis sin den sórt sin aige é, £400 a chur air.

(5) Tabharfar deimhniú a cheapacháin do chigire agus, nuair a iarrfaidh sé go ligfí isteach in aon áitreabh nó áit é, déanfaidh sé, má iarrtar air é, an deimhniú a thabhairt ar aird don áititheoir agus d'aon duine a bheidh á scrúdú ag an gcigire.

Cionta.

7.—(1) Aon duine a thabharfaidh eolas bréagach nó a dhéanfaidh ráiteas bréagach i ndáil le hiarratas ar phréimh fhostaíochta beidh sé ciontach i gcion.

(2) I gcás comhlacht corpraithe do dhéanamh ciona faoin Acht seo agus go gcruthófar gur le toiliú nó ceadú ó aon stiúrthóir, bainisteoir, rúnaí nó oifigeach eile de chuid an chomhlachta chorpraithe a rinneadh an cion, nó gur urasaíodh a dhéanamh le faillí ag aon duine díobh sin, measfar an duine sin freisin a bheith ciontach sa chion.

(3) Aon duine a bheidh ciontach i gcion faoin alt seo dlífear ar é a chiontú go hachomair fíneáil nach mó ná £300 nó, más é an dara cion nó cion dá éis sin den sórt sin aige é, £400 a chur air.

(4) Féadfaidh an tAire ionchúiseamh a dhéanamh i gcion faoin Acht seo.

(5) Féadfar ionchúiseamh faoin Acht seo a bhunú laistigh de dhá mhí dhéag tar éis an chiona.

EMPLOYMENT PREMIUM ACT, 1975


AN ACT TO ENABLE THE MINISTER FOR LABOUR TO MAKE, BY MEANS OF A SCHEME TO BE KNOWN AS THE PREMIUM EMPLOYMENT PROGRAMME, PAYMENTS TO EMPLOYERS ENGAGED IN AGRICULTURAL (INCLUDING HORTICULTURAL) AND CERTAIN MANUFACTURING INDUSTRIES FOR THE PURPOSE OF ENCOURAGING EMPLOYMENT, AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE AFORESAID MATTER. [6th August, 1975] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS: [GA]

Interpretation.

1.—In this Act—

[GA]

employment premium” has the meaning assigned to it by section 4 of this Act;

[GA]

the Minister” means the Minister for Labour;

[GA]

the Scheme” has the meaning assigned to it by section 2 of this Act.

[GA]

Establishment, purpose and duration of Scheme.

2.—(1) The Minister may, in accordance with this Act, establish and administer a scheme which shall be known as the Premium Employment Programme (and is in this Act referred to as the Scheme) and may from time to time amend the Scheme.

[GA]

(2) The purpose of the Scheme shall be to encourage employers in industries or activities to which the Scheme applies to employ persons to whom it applies.

[GA]

(3) The Scheme shall—

[GA]

(a) so far as it applies to agriculture (including horticulture), come into operation on the 3rd day of August, 1975, and

[GA]

(b) so far as it relates to manufacturing industries, be deemed to have come into operation on the 29th day of June, 1975,

[GA]

and shall cease to have effect on the 26th day of June, 1976, without prejudice to any conditions of the Scheme which continue to apply after that date.

[GA]

Determination of application of Scheme.

3.—(1) The Minister may, with the consent of the Minister for Finance, so far as the Scheme applies to manufacturing industries determine (and shall specify in the Scheme) the industries or the activities in specified industries to which the Scheme applies and the persons or classes of persons to whom it applies.

(2) Without prejudice to the generality of subsection (1) of this section, a determination under this section, may be made by reference to such matter or in such manner as the Minister thinks fit and, in respect of such a determination of a person or class of persons may include a requirement of a specified minimum period of unemployment.

[GA]

(3) The Minister may, with the consent of the Minister for Finance, specify in the Scheme industries, activities in specified industries, persons or classes of persons (denoted by reference to any matter or in any manner which he thinks fit) to which the Scheme does not apply.

[GA]

Payment to employers of employment premiums.

4.—(1) The Scheme shall provide for the payment by the Minister to an employer to whom it applies of a sum (to be known, and in this Act referred to, as an employment premium) in respect of the person or persons to whom the Scheme applies employed by that employer.

[GA]

(2) An employment premium shall be of such amount as may be specified in the Scheme, and different amounts may be so specified for different periods.

[GA]

(3) Notwithstanding subsections (1) and (2) of this section, the Scheme may provide for the reduction or non-payment of an employment premium in a case where the Minister is satisfied that the employer concerned is in receipt of, or has received, moneys by way of a grant or loan from any body established by statute for the purpose of promoting, encouraging or assisting employment or industry.

Information and forms.

5.—The Scheme may contain provisions requiring an employer applying for an employment premium to furnish to the Minister such information as, in his discretion, he considers necessary in order to enable him to determine whether or not the Scheme applies to that employer, to an industry or activity in a specified industry carried on by him or to an employee or class of employee employed by him, and may provide for such forms as the Minister considers necessary for that purpose and generally for the effective administration of the Scheme.

Inspectors.

6.—(1) In this section “inspector” means a person appointed by the Minister to be an inspector for the purposes of this Act.

[GA]

(2) An inspector may—

[GA]

(a) enter at all reasonable times any premises or place occupied by an employer who has applied for an employment premium,

[GA]

(b) make therein any examination or enquiry necessary for the purpose of the effective administration of the Scheme,

[GA]

(c) require an employer or his representative to produce any records and inspect and take copies of entries in the records,

[GA]

(d) examine with regard to any matter under the Scheme any person whom he has reasonable cause to believe to be or to have been an employer or employee and require him to answer such questions (other than questions tending to incriminate him) as the inspector may put relative to such a matter and to sign a declaration of the truth of the answers.

[GA]

(3) The powers conferred on an inspector by subsection (2) (a) of this section shall not be exercisable in respect of a private dwelling house unless the Minister (or an officer of the Minister appointed by the Minister for the purpose) certifies that he has reasonable grounds for believing that an offence under this Act in relation to an employee employed in the house has been committed by the employer, and the inspector in applying for admission to the house produces the certificate.

(4) Any person who—

[GA]

(a) obstructs or impedes an inspector in the exercise of any power conferred by this section,

[GA]

(b) refuses to produce any record which an inspector lawfully requires him to produce,

[GA]

(c) produces, or causes to be produced or knowingly allows to be produced, to an inspector any record which to his knowledge is false in any material respect,

[GA]

(d) prevents, or attempts to prevent, any person from appearing before or being questioned by an inspector, or

[GA]

(e) wilfully fails or refuses to comply with any lawful requirement of an inspector under subsection (2) (d) of this section,

[GA]

shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £300 or, in the case of a second or subsequent such offence, £400.

[GA]

(5) An inspector shall be furnished with a certificate of his appointment and, on applying for admission to any premises or place, shall, if so required, produce the certificate to the occupier and to any person being examined by the inspector.

[GA]

Offences.

7.—(1) A person who furnishes false information or makes a false statement in connection with an application for an employment premium shall be guilty of an offence.

[GA]

(2) Where an offence under this Act was committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of the body corporate, he also shall be deemed to have been guilty of the offence.

[GA]

(3) A person who is guilty of an offence under this section shall be liable on summary conviction to a fine not exceeding £300 or, in the case of a second or subsequent such offence, £400.

[GA]

(4) An offence under this Act may be prosecuted by the Minister.

[GA]

(5) A prosecution under this Act may be instituted within twelve months after the offence.

[GA]

Expenses.

8.—The expenses incurred by the Minister in the administration of this Act shall be paid out of moneys provided by the Oireachtas.

Short title.

9.—This Act may be cited as the Employment Premium Act, 1975.
