Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Airgid;
cialluíonn an abairt “geall-ghlacadóir ceadúnuithe” duine (nách cólucht corparáideach ná cólucht neamh-ionchorparuithe de dhaoine) a bheidh ina shealbhóir ar cheadúnas geall-ghlacadóra a tugadh amach do no tuigfear a bheith tugtha amach do fén Acht so agus a bheidh i bhfeidhm de thurus na huaire;
cialluíonn an focal “áitreabh” aon tigh no foirgint eile agus foluíonn sé cuid teoranta de thigh no d'fhoirgint eile;
cialluíonn an abairt “áitreabh cláruithe” áitreabh a bheidh cláruithe de thurus na huaire sa chlár d'oifigí glactha geall a bheidh á choimeád ag na Coimisinéirí Ioncuim fén Acht so;
cialluíonn an focal “dílseánach” an té bheidh i dteideal aontseilbhe an áitreibh go n-úsáidtear an focal ina thaobh, agus, i ngach áit ina gceaduíonn an có-théacs é, foluíonn sé roinnt daoine i gcó-theideal na seilbhe sin;
cialluíonn an abairt “dílseánach cláruithe” duine bheidh iontrálta de thurus na huaire sa chlár san d'oifigí glactha geall mar dhílseánach ar áitreabh a bheidh cláruithe sa chlár san, agus i ngach áit ina gceaduíonn an có-théacs é, foluíonn an abairt sin roinnt daoine bheidh iontrálta sa chlár san mar chó-dhílseánaigh ar áitreabh a bheidh cláruithe amhlaidh;
foluíonn an focal “geall” stáca, agus léireofar dá réir sin focail atá gaolmhar do;
nuair a húsáidtear an focal “orduithe” maidir leis an gCúirt Dúithche no le ball den Ghárda Síochána no leis an Aire Dlí agus Cirt cialluíonn sé orduithe le rialacháin ar n-a ndéanamh ag an Aire Dlí agus Cirt fén Acht so agus i ngach cás eile cialluíonn sé orduithe le rialacháin ar n-a ndéanamh ag an Aire Airgid fén Acht so.
Toirmeasc ar ghníomhú mar gheallghlacadóir gan ceadúnas.
2.—(1) Ní dhéanfaidh éinne gnó ná gníomhú mar gheallghlacadóir ná a thabhairt le tuisgint ná a chur in úil gur geallghlacadóir no geall-ghlacadóir ceadúnuithe é mara mbeidh ceadúnas geall-ghlacadóra aige a tugadh amach do no a tuigfear a tugadh amach do fén Acht so agus a bheidh i bhfeidhm de thurus na huaire.
(2) Gach éinne a dhéanfaidh gnó no a ghníomhóidh mar gheallghlacadóir contrárdha don alt so agus gach éinne do bhéarfaidh le tuisgint no a chuirfidh in úil contrárdha don alt so gur geallghlacadóir no geall-ghlacadóir ceadúnuithe é beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós máil de chúig céad punt do chur air.
Seanacheadúnaisí do bhuanú.
3.—(1) Gach ceadúnas do tugadh amach fén Acht um Gheall-Chur, 1926, á údarú do dhuine gníomhú agus gnó do dhéanamh mar gheall-ghlacadóir agus a bheidh i bhfeidhm i dtosach feidhme an Achta so tuigfear gur ceadúnas geall-ghlacadóra é do tugadh amach fén Acht so agus beidh feidhm ag forálacha an Achta so (seachas na forálacha bhaineann le buaine cheadúnais gheallghlacadóra) dá réir sin.
(2) Gach ceadúnas a tuigfear leis an alt so do bheith ina cheadúnas gheall-ghlacadóra do tugadh amach fén Acht so leanfa sé, mara ndeintear agus go dtí go ndéanfar é cheiliúra fén Acht so, i bhfeidhm ar feadh na tréimhse luaidhtear chuige sin sa cheadúnas san agus ní níos sia ná san, ach má thagann deireadh na tréimhse sin i rith no i ndeireadh an chéad mhí Dheire Fomhair no i rith an chéad mhí na Samhna tar éis tosach feidhme an Achta so leanfaidh an ceadúnas san i bhfeidhm go dtí meán oíche ar an 30adh lá den chéad Shamhain tar éis an tosach feidhme sin.
Deimhniú oiriúnachta pearsanta duine chomhnuíonn i Saorstát Éireann.
4.—(1) Einne (nách cólucht corparáideach ná cólucht neamhionchorparuithe de dhaoine) a chomhnuíonn do ghnáth i Saorstát Éireann agus gur mian leis ceadúnas geall-ghlacadóra d'fháil féadfa sé, tar éis an fhógra luaidhtear anso ina dhiaidh seo d'fhoillsiú, deimhniú (dá ngairmtear deimhniú oiriúnachta pearsanta san Acht so) gur duine ceart oiriúnach é chun ceadúnais gheall-ghlacadóra do bheith aige d'iarraidh do réir an ailt seo ar cheannphort Ghárda Síochána an cheanntair ina bhfuil oifig aige atá cláruithe fén Acht so no ina bhfuil sé ar aigne a leithéid do bheith aige no, mara bhfuil aon oifig den tsórt san aige agus ná fuil sé ar aigne a leithéid do bheith aige, ar cheannphort Ghárda Síochána an cheanntair ina bhfuil gnáth-chomhnaí air.
(2) Gach éinne tá ar aigne deimhniú oiriúnachta pearsanta d'iarraidh fén alt so déanfa sé, coicíos ar a laighead no mí ar a mhéid roimh an iarratas san do dhéanamh, fógra go bhfuil sé ar aigne an t-iarratas san do dhéanamh d'fhoillsiú, uair amháin ar a laighead, i ngach ceann de dhá pháipéar nuachta léightear i gceanntar an cheannphuirt go bhfuil sé ar aigne aige an deimhniú san d'iarraidh air.
(3) Is sa tslí orduithe agus sa bhfuirm orduithe déanfar gach iarratas fén alt so ar dheimhniú oiriúnachta pearsanta agus ní foláir beirt Fheadhmannach Síochána i gceanntar an cheannphuirt dá ndéanfar an t-iarratas d'aontú leis agus é do shighniú.
(4) Aon cheannphort den Ghárda Síochána ar a n-iarrfar deimhniú oiriúnachta pearsanta go cuibhe fén alt so, déanfa sé ceachtar den dá ní seo leanas laistigh de cheithre lá déag tar éis an iarratais sin d'fháil, pé ní acu is dóich leis ina aigne féin is ceart, sé sin le rá, deimhniú do thabhairt don iarratasóir, sa bhfuirm orduithe, gur duine ceart oiriúnach é chun ceadúnais gheall-ghlacadóra do bheith aige no, ar aon scór no scóranna dá n-údaruítear ina dhiaidh seo anso, diúltú don deimhniú san do thabhairt uaidh.
Deimhniú oiriúnachta pearsanta duine chomhnuíonn lasmuich de Shaorstát Éireann.
5.—(1) Einne (nách cólucht corparáideach ná cólucht neamhionchorparuithe de dhaoine) a chomhnuíonn de gnáth lasmuich de Shaorstát Éireann agus gur mian leis ceadúnas geall-ghlacadóra d'fháil féadfa sé, tar éis an fhógra luaidhtear anso ina dhiaidh seo d'fhoillsiú, deimhniú (a foluítear sna tagairtí san Acht so do dheimhniú oiriúnachta pearsanta) gur duine ceart oiriúnach é chun ceadúnais gheall-ghlacadóra do bheith aige d'iarriadh ar an Aire Dlí agus Cirt sa tslí agus sa bhfuirm orduithe.
(2) Gach éinne tá ar aigne deimhniú oiriúnachta pearsanta d'iarraidh fén alt so déanfa sé, coicíos ar a laighead no mí ar a mhéid roimh an iarratas san do dhéanamh, fógra go bhfuil sé ar aigne an t-iarratas san do dhéanamh d'fhoillsiú, uair amháin ar a laighead, i bpáipéar nuachta laethiúil a foillsítear agus a léightear i gCathair Bhaile Atha Cliath.
(3) Ar fháil iarratais do fén alt so ar dheimhniú oiriúnachta pearsanta féadfaidh an tAire Dlí agus Cirt pé ní acu so do dhéanamh is dóich leis féin is ceart, eadhon, deimhniú do thabhairt don iarratasóir, sa bhfuirim orduithe, gur duine ceart oiriúnach an t-iarratasóir chun ceadúnais gheall-ghlacadóra do bheith aige, no ar aon scór agus gan an scór do luadh diúltú don deimhniú san do thabhairt uaidh.
Scóranna ar ar féidir deimhniú oiriúnachta pearsanta do dhiúltú.
6.—Féadfaidh ceannphort den Ghárda Síochána diúltú do ghéille d'iarratas ar dheimhniú oiriúnachta pearsanta ar aon scór no scóranna acu so leanas agus ní har aon scór eile in aon chor, sé sin le rá:—
(a) go bhfuil dlite ar an iarratasóir, le linn iarrtha an deimhnithe dho, riaráiste aon diúité is iníoctha de thurus na huaire ar gheallta no ina dtaobh;
(b) gur ciontuíodh an t-iarratasóir roimhe sin i gcoir no i gcionta fén Acht so no fén Acht um Gheall-Chur, 1926, no i gcionta bhaineann leis an diúité ar gheallta no gur ciontuíodh é, o thosach feidhme an Achta um Gheall-Chur, 1926, i gcionta fé aon Acht a bhaineann le cearrbhachas no le tithe cearrbhachais no le geallchur (seachas an Ready Money Football Betting Act, 1920) no gur deineadh dhá uair no níos mó o thosach feidhme an Achta um Gheall-Chur, 1926, é do chiontú i gcionta fén Ready Money Football Betting Act, 1920;
(c) gur ceiliúradh ceadúnas geall-ghlacadóra do bhí ag an iarratasóir fén Acht so no fén Acht um Gheall-Chur, 1926;
(d) gur daingníodh, de bharr ath-chomhairc chun na Cúirte Dúithche, diúltú do rinne ceannphort den Ghárda Síochána roimhe seo do dheimhniú oiriúnachta pearsanta do thabhairt uaidh fén Acht so no fén Acht um Gheall-Chur, 1926;
(e) mar gheall ar a charachtar ghenerálta no ar a bhéasa aitheanta nách duine oiriúnach chun ceadúnais gheallghlacadóra do bheith aige an t-iarratasóir;
(f) ná fuil cúrsaí airgid an iarratasóra i slí d'fhágfadh gur dhuine oiriúnach é chun ceadúnais gheall-ghlacadóra do bheith aige;
(g) i gcás iarratasóra go raibh ceadúnas geall-ghlacadóra aige roimhe sin fén Acht so no fén Acht um Gheall-Chur, 1926, gur theip air no gur dhiúltuigh sé, gan chúis réasúnta chuige, suimeanna d'íoc do bhí iníoctha le daoine do bhuaidh geallta do chuireadar leis;
(h) ná raibh gnáth-chomhnaí ar an iarratasóir i Saorstát Éireann ach ar feadh níos lugha ná bliain roimh an iarratas do dhéanamh;
(i) i gcás iarratasóra ag a raibh ceadúnas geall-ghlacadóra roimhe sin fén Acht so no fén Acht um Gheall-Chur, 1926, go ndearna sé gnó glactha na ngeall i slí mhíordúil no i slí do chuir fé ndeár daoine bheith ag cruinniú agus ag leadránacht san áitreabh ina raibh an gnó san á dhéanamh no lasmuich de no do mheall iad chuige sin no gur cheaduigh sé do dhaoine bheith ag leadránacht san áitreabh san;
(j) go bhfuil an t-iarratasóir ag gníomhú mar ghníomhaire do dhuine go ndiúltfaí dá iarratas ar scór éigin de sna scóranna luaidhtear sna míreanna san roimhe seo den alt so;
(k) ach amháin i gcás iarratasóra atá le linn an Achta so do rith ina shealbhóir ar cheadúnas geall-ghlacadóra tugadh amach fén Acht um Gheall-Chur, 1926, agus atá ar feadh an ama go léir o dháta an Achta so do rith go dtí am déanta an iarratais sin agus le linn a dhéanta ina shealbhóir ar cheadúnas geall-ghlacadóra tugadh amach fén Acht um Gheall-Chur, 1926, no fén Acht so agus a bheidh i bhfeidhm de thurus na huaire, gur sealbhóir ar cheadúnas geall-bhrócaera no gur iasachtaí airgid cláruithe an t-iarratasóir sin.
Ceadúnaisí geallghlacadóirí do thabhairt amach.
7.—(1) Einne dá dtabharfar deimhniú oiriúnachta pearsanta féadfa sé, laistigh de lá is fiche tar éis tabhairt-amach an deimhnithe sin, ceadúnas geall-ghlacadóra d'iarraidh i scríbhinn sa bhfuirm orduithe ar na Coimisinéirí Ioncuim, ceadúnas ag tosnú ar pé dáta (sé sin, an 1adh lá den chéad Mhí na Nodlag ina dhiaidh sin no lá nách déanaí ná coicíos tar éis dáta an iarratais) a luadhfa sé san iarratas.
(2) Beidh griandealbh den iarratasóir ag gabháil le gach iarratas fén alt so ar cheadúnas geall-ghlacadóra, griandealbh a bheidh den tsaghas agus den tuise orduithe agus a tógadh ar dháta nach luatha ná bliain roimh dháta an iarratais.
(3) Nuair a seachadfar do sna Coimisinéirí Ioncuim iarratas fén alt so ar cheadúnas geall-ghlacadóra agus a íocfaidh an t-iarratasóir leis na Coimisinéirí Ioncuim an diúité máil is gá do réir dlí d'íoc ag daoine thógann amach ceadúnas den tsaghas a bheidh luaidhte san iarratas san, déanfaidh na Coimisinéirí Ioncuim ceadúnas geall-ghlacadóra do réir an ailt seo do thabhairt amach don iarratasóir.
(4) Beidh gach ceadúnas geall-ghlacadóra sa bhfuirm orduithe agus beidh ainm agus áit chomhnuithe an té dá dtabharfar amach é luaidhte ann agus beidh greamuithe dhe an ghriandealbh den duine sin gur gá do réir an ailt seo go ndéanfadh an duine sin í chur isteach i dteanta an iarratais ar an gceadúnas san, agus déarfaidh agus déanfaidh údarás do thabhairt don duine sin gníomhú agus gnó do dhéanamh mar gheall-ghlacadóir ar feadh na tréimhse dar tosach an dáta luadhfar ann (sé sin an dáta luadhfar chuige sin san iarratas ar an gceadúnas san) agus dar críoch meán oíche an chéad 30adh lá de Mhí na Samhna ina dhiaidh sin, ach san fé réir gach ceann agus gan dochar d'aon cheann de sna sriantachta agus de sna toirmisc uile bheidh forchurtha de thurus na huaire do réir dlí maidir leis na háiteanna in a bhféadfar gnó glactha na ngeall do dhéanamh.

8.—(1) Leanfaidh na Coimisinéirí Ioncuim den chlár (dá ngairmtear san Acht so an clár d'oifigí glactha geall) d'áitreabhacha ina ndeintear gnó glactha na ngeall do bhunuíodar agus do choimeádadar go dtí so fén Acht um Gheall-Chur, 1926, do choimeád sa bhfuirm orduithe agus cláróid sa chlár san gach áitreabh go mbeidh sé ceangailte ortha de bhua an Achta so é do chlárú ann.
(2) Iontrálfar sa chlár d'oifigí glactha geall, maidir le gach áitreabh a bheidh cláruithe ann, ainm a dhílseánaigh, tuairisc chruinn ar an áitreabh, agus pé mion-innste eile bheidh orduithe.
Clárú áitreabh atá ann anois do bhuanú.
9.—(1) Gach áitreabh a bheidh, díreach roimh thosach feidhme an Achta so, cláruithe sa chlár d'oifigí glactha geall a coimeádtar fén Acht um Gheall-Chur, 1926, leanfa sé de bheith cláruithe sa chlár san ón tosach feidhme sin amach ar feadh na tréimhse luaidhtear anso ina dhiaidh seo agus tuigfear é bheith cláruithe amhlaidh fén Acht so agus beidh feidhm ag an Acht so dá réir sin.
(2) Mara ndeintear agus go dtí go ndéanfar é scriosadh amach as an gclár d'oifigí glactha geall fén Acht so, leanfaidh áitreabh ’na mbuanófar a chlárú sa chlár san fén alt so do bheith cláruithe amhlaidh go meán oíche an chéad 30adh lá de Mhí na Samhna tar éis tosach feidhme an Achta so agus scriosfar amach as an gclár san ansan é (marar hathnuadhadh an clárú san fén Acht so).
Deimhniú oiriúnachta áitreibh.
10.—(1) Einne gur mian leis aon áitreabh dar dílseánach é do chlárú no a chlárú d'athnuachaint sa chlár d'oifigí glactha geall féadfa sé, tar éis an fhógra luaidhtear anso ina dhiaidh seo d'fhoillsiú, deimhniú (dá ngairmtear deimhniú oiriúnachta áitreibh san Acht so) go bhfuil an t-áitreabh san oiriúnach chun a chláruithe sa chlár d'oifigí glactha geall d'iarraidh do réir an ailt seo ar cheannphort Ghárda Síochána an cheanntair ina bhfuil an t-áitreabh san suidhte.
(2) Gach éinne atá ar aigne deimhniú oiriúnachta áitreibh d'iarraidh fén alt so déanfa sé, coicíos ar a laighead no mí ar a mhéid roimh an iarratas san do dhéanamh, fógra go bhfuil sé ar aigne an t-iarratas san do dhéanamh d'fhoillsiú, uair amháin ar a laighead, i ngach ceann de dhá pháipéar nuachta léightear sa cheanntar ina bhfuil an t-áitreabh suidhte le n-a mbaineann an t-iarratas san atá sé ar aigne a dhéanamh.
(3) Is sa tslí orduithe agus sa bhfuirm orduithe déanfar gach iarratas fén alt so ar dheimhniú oiriúnachta áitreibh agus ní foláir beirt Fheadhmannach Síochána don cheanntar ina mbeidh an t-áitreabh le n-a mbaineann an t-iarratas suidhte d'aontú leis agus é do shighniú.
(4) Aon cheannphort den Ghárda Síochána ar a n-iarrfar deimhniú oiriúnachta áitreibh go cuibhe fén alt so, más deimhin leis gur geall-ghlacadóir ceadúnuithe an t-iarratasóir no gur sealbhóir é ar dheimhniú oiriúnachta pearsanta tugadh amach tar éis dáta an iarratais no seacht lá ar a mhéid roimhe sin, déanfa sé ceachtar den dá ní seo leanas laistigh de cheithre lá déag tar éis do an t-iarratas san d'fháil, pé ní acu is dóich leis ina aigne féin is ceart, sé sin le rá, deimhniú do thabhairt don iarratasóir, sa bhfuirm orduithe, go bhfuil an t-áitreabh le n-a mbaineann an t-iarratas oiriúnach chun a chláruithe sa chlár d'oifigí glactha geall no, ar aon scór no scóranna dá n-údaruítear ina dhiaidh seo anso, diúltú don deimhniú san do thabhairt uaidh.
Scóranna ar ar féidir deimhniú oiriúnachta áitreibh do dhiúltú.
11.—(1) Féadfar deimhniú oiriúnachta áitreibh do dhiúltú ar aon scór no scóranna acu so leanas agus ní har aon scór eile in aon chor, sé sin le rá:—
(a) nách geall-ghlacadóir ceadúnuithe ná sealbhóir deimhniú oiriúnachta pearsanta an t-iarratasóir;
(b) nách é an t-iarratasóir dílseánach an áitreibh;
(c) go bhfuil an t-áitreabh ana-chomhgarach d'áit adhartha Dé, d'fhundúireacht chreidimh, do scoil, do bhureau fostaíochta, do mhonarchain no d'oibreacha, no d'áit eile den tsórt san go gcruinníonn sluaite móra daoine ann no in aice leis, no go bhfuil an t-áitreabh i líomatáiste chomhnuithe;
(d) go bhfuil an t-áitreabh ana-chomhgarach d'áitreabh is eol a bheith á ghnáthú ag lucht droch-fhuadair;
(e) go bhfuil slí isteach san áitreabh chun áitreibh eile;
(f) go raibh an t-áitreabh cláruithe roimhe sin sa chlár d'oifigí glactha geall atá no do bhí á choimeád fén Acht so no fén Acht um Gheall-Chur, 1926, agus gur scriosadh amach as an gclár san é do réir ordú ón gcúirt;
(g) go bhfuil an t-áitreabh cláruithe sa chlár d'oifigí glactha geall agus le linn a bheith cláruithe amhlaidh no le linn an áitreibh sin do bheith cláruithe sa chlár d'oifigí glactha geall a bhí á choimeád fén Acht um Gheall-Chur, 1926, gur thárla nea-rialtachtaí de dheascaibh an áitreibh do bheith ana-chomhgarach d'áitreabh fé cheadúnas chun deocha meisciúla do dhíol;
(h) gur ciontuíodh an t-iarratasóir roimhe sin i gcionta fén Acht so no fén Acht um Gheall-Chur, 1926, no fé aon Acht eile maidir leis an áitreabh no maidir le haon áitreabh cláruithe eile dar dhílseánach cláruithe é nuair do rinneadh an cionta;
(i) má bhíonn an t-áitreabh no má bhí sé roimhe sin cláruithe sa chlár d'oifigí glactha geall atá no a bhí á choimeád fén Acht so no fén Acht um Gheall-Chur, 1926, gur thárla uair éigin le linn don iarratasóir bheith ina dhílseánach chláruithe ar an áitreabh go ndearnadh gnó glactha na ngeall ann i slí mhí-ordúil no i slí do chuir fé ndeár daoine bheith ag cruinniú agus ag leadránacht san áitreabh no lasmuich de no do mheall iad chuige sin no le linn don iarratasóir bheith ina dhílseánach chláruithe amhlaidh gur cheaduigh sé do dhaoine bheith ag leadránacht san áitreabh san;
(j) go bhfuil an t-iarratasóir ina dhílseánach chláruithe ar áitreabh chláruithe eile no go raibh roimhe sin agus go bhfuil no, le linn don iarratasóir bheith ina dhílseánach chláruithe amhlaidh, go raibh gnó glactha na ngeall á dhéanamh san áitreabh san i slí mhí-ordúil no i slí a chur fé ndeár daoine bheith ag cruinniú agus ag leadránacht san áitreabh no lasmuich de no do mheall iad chuige sin;
(k) más le háitreabh nách áitreabh cláruithe le linn an iarratais do dhéanamh a bhaineann an t-iarratas go bhfuil an iomarca áitreabhacha cláruithe cheana sa cheanntar ina bhfuil an t-áitreabh le n-a mbaineann an t-iarratas suidhte;
(l) nuair is le háitreabh ná raibh roimh an 28adh lá d'Iúl, 1926, ina chuid d'áitreabh fé cheadúnas chun deocha meisciúla do dhíol a bhaineann an t-iarratas go bhfuil an t-iarratasóir ina shealbhóir ar cheadúnas chun deocha meiscúla do dhíol;
(m) más le háitreabh nách áitreabh cláruithe le linn an iarratais do dhéanamh a bhaineann an t-iarratas, go bhfuil luach bliantúil an áitreibh sin fé sna hAchtanna Luachála níos lugha ná cúig puint déag más áitreabh é atá suidhte i gcontae-bhuirg Bhaile Atha Cliath, no níos lugha ná deich bpuint más áitreabh é atá suidhte in aon chontae-bhuirg eile no i mbuirg Dhún Laoghaire, no níos lugha ná cúig puint más áitreabh é atá suidhte in aon áit eile;
(n) ach amháin i gcás iarratasóra is dílseánach cláruithe ar an áitreabh fén Acht um Gheall-Chur, 1926, le linn an Achta so do rith agus is dílseánach cláruithe ar an áitreabh fén Acht um Gheall-Chur, 1926, no fén Acht so, riamh is i gcomhnaí o dháta an rithte sin go dtí am an iarratais do dhéanamh agus an t-am san féin d'áireamh, gur sealbhóir ceadúnais gheall-bhrócaera no gur iasachtaí airgid cláruithe an t-iarratasóir sin.
(2) Más alos áitreibh ná dearnadh luacháil ar leithligh air fé sna hAchtanna Luachála bheidh deimhniú oiriúnachta áitreibh á iarraidh no a beifear ar aigne é d'iarraidh, féadfaidh an Coimisinéir Luachála agus an Suirbhéir Teorann, ar a iarraidh sin don té bheidh ag déanamh an iarratais sin no ar aigne a dhéanta, luacháil na hionoighreachta no an tionontacháin gur cuid de an t-áitreabh san do roinnt agus luach ar leithligh do chur ar gach ceann de sna coda sa tslí foráltar leis na hAchtanna Luachála agus déanfaidh an té gur ar a iarratas do rinneadh an roinnt sin an táille orduithe d'íoc leis an gCoimisinéir sin as an roinnt sin do dhéanamh.
(3) Déanfaidh an Coimisinéir Luachála agus an Suirbhéir Teorann gach táille a híocfar leis fén bhfo-alt san roimhe seo d'íoc isteach sa Stát-Chiste no do chur chun tairbhe dho i pé slí ordóidh an tAire Airgid.
Clárú sa chlár d'oifigí glactha geall.
12.—(1) Aon gheall-ghlacadóir ceadúnuithe dar tugadh deimhniú oiriúnachta áitreibh i dtaobh aon áitreibh dar dílseánach é féadfa sé, laistigh de lá is fiche tar éis tabhairt-amach an deimhnithe sin agus (i gcás iarratais ar chlárú d'athnuachaint) laistigh den tréimhse luaidhtear anso ina dhiaidh seo, a iarraidh ar na Coimisinéirí Ioncuim i scríbhinn sa bhfuirm orduithe an t-áitreabh a luaidhtear sa deimhniú san do chlárú no a chlárú d'athnuachaint sa chlár d'oifigí glactha geall agus, nuair a seachadfar an t-iarratas san do sna Coimisinéirí Ioncuim agus a íocfaidh an t-iarratasóir leis na Coimisinéirí Ioncuim an diúité máil is gá do réir dlí de thurus na huaire a íoc nuair a cláruítear áitreabh no a hathnuaitear clárú áitreibh sa chlár d'oifigí glactha geall, cláróidh na Coimisinéirí Ioncuim an t-áitreabh san no athnuafaid a chlárú sa chlár d'oifigí glactha geall agus bhéarfaid amach don iarratasóir deimhniú sa bhfuirm orduithe ar an gclárú san no ar an athnuachaint sin ar chlárú.
(2) Mara ndeintear agus do dtí go ndéanfar é scriosadh amach as an gclár fén Acht so no dá bhua, leanfaidh aon áitreabh a clárófar sa chlár d'oifigí glactha geall de bheith cláruithe amhlaidh go meán oíche an chéad 30adh lá de Mhí na Samhna tar éis a chláruithe agus scriosfar amach as an gclár san ansan é (marar hathnuadhadh an clárú fén Acht so).
(3) Gach athnuachaint ar chlárú aon áitreibh sa chlár d'oifigí glactha geall tosnóidh sí agus raghaidh sí in éifeacht o dhul in éag do chlárú an áitreibh sin no don athnuachaint is déanaí do rinneadh ar an gclárú san (pe'ca aca is gá sa chás) sa chlár san agus mara ndeintear agus go dtí go ndéanfar é scriosadh amach as an gclár fén Acht so no dá bhua, leanfaidh an t-áitreabh san de bheith cláruithe amhlaidh go meán oíche an chéad 30adh lá de Mhí na Samhna tar éis tosach feidhme na hathnuachainte sin agus scriosfar amach as an gclár san ansan é (mara n-athnuaitear an clárú fén Acht so).
(4) Isé am ina n-iarrfar go n-athnuaifí clárú aon áitreibh sa chlár d'oifigí glactha geall ná roimh dhul in éag ach ní níos luatha ná ceithre lá déag roimh dhul in éag do chlárú no don athnuachaint is déanaí do rinneadh ar chlárú an áitreibh sin sa chlár san.
Athchomharc i gcoinnibh deimhniú do dhiúltú.
13.—(1) Pé uair a dhiúltóidh ceannphort den Ghárda Síochána do dheimhniú oiriúnachta pearsanta no deimhniú oiriúnachta áitreibh do thabhairt uaidh, ansan, ar a éileamh san don té d'iarr an deimhniú laistigh de shé lá tar éis an diúltuithe, déanfa sé ráiteas i scríbhinn do thabhairt don iarratasóir sin sa bhfuirm orduithe i dtaobh na scóranna ar ar dhiúltuigh sé don deimhniú do thabhairt uaidh.
(2) Einne dar dhiúltuigh ceannphort den Ghárda Síochána deimhniú oiriúnachta pearsanta no deimhniú oiriúnachta áitreibh, féadfa sé athchomharc do dhéanamh sa tslí orduithe chun na Cúirte Dúithche i gcoinnibh an diúltuithe sin laistigh de cheithre lá déag tar éis ráitis i scríbhinn d'fháil ón gceannphort san i dtaobh na scóranna ar a ndearnadh an diúltú san.
(3) Gach éinne a dhéanfaidh athchomharc chun na Cúirte Dúithche fén alt so déanfa sé, sa tslí orduithe agus laistigh den aimsir orduithe, fógra i dtaobh an athchomhairc sin do thabhairt don cheannphort san den Ghárda Síochána agus fós do sna Coimisinéirí Ioncuim.
(4) Ar éisteacht aon athchomhairc den tsórt san féadfaidh an Chúirt Dúithche diúltú an deimhnithe do dhaingniú no do nealomháil, agus pé uair a nea-lomhálfaidh an Chúirt Dúithche amhlaidh diúltú do rinneadh ar an deimhniú, déanfaidh an ceannphort san den Ghárda Síochána deimhniú oiriúnachta pearsanta no deimhniú oiriúnachta áitreibh, pe'ca aca is gá sa chás, do thabhairt don athchomharcóir laistigh de thrí lá tar éis na nealomhála san.
(5) Bainfidh na forálacha so leanas le gach athchomharc fén alt so, sé sin le rá:—
(a) ní bheidh éinne i dteideal a éistithe ná i dteideal fianaise do thairisgint i gcoinnibh an athchomhairc ach ceannphort an Ghárda Síochána agus na Coimisinéirí Ioncuim;
(b) bainfidh alt 27 den Inland Revenue Regulation Act, 1890, leis an athchomharc sa tslí chéanna ina mbaineann sé le himeachta i dtaobh ioncuim dhúithche;
(c) féadfar aon scór chun diúltuithe luaidhtear sa ráiteas scríbhte i dtaobh scóranna chun diúltuithe agus ní féadfar aon scór eile do chur i gcoinnibh an athchomhaire;
(d) pé uair a daingneofar an diúltú féadfaidh an Chúirt a ordú don athchomharcóir costaisí cheannphort an Ghárda Síochána d'íoc agus féadfa sí méid na gcostaisí sin do mheas;
(e) ní luighfidh aon athchomharc chun na Cúirte Cuarda fé alt 84 den Acht Cúirteanna Breithiúnais, 1924 (Uimh. 10 de 1924).
Ceadúnas sealadach agus clárú sealadach go breith ar athchomharc.
14.—(1) Pé uair a dhiúltóidh ceannphort den Ghárda Síochána do ghéille d'iarratas ar dheimhniú oiriúnachta pearsanta agus a lóisteálfar athchomharc chun na Cúirte Dúithche i gcoinnibh an diúltuithe sin, ansan, má ba gheall-ghlacadóir ceadúnuithe an t-iarratasóir le linn an iarratais do dhéanamh, féadfaidh na Coimisinéirí Ioncuim, gan aon diúité d'íoc ach fé réir pé coinníollacha is oiriúnach leo d'fhorchur, ceadúnas sealadach geall-ghlacadóra do thabhairt amach don iarratasóir sin i gcóir pé tréimhse is oiriúnach leo ach gan í dhul thar deire seacht lá tar éis breith do bheith tugtha ar an athchomharc san agus faid a bheidh gach ceadúnas sealadach geall-ghlacadóra den tsórt san i bhfeidhm beidh sé ina cheadúnas gheall-ghlacadóra do réir bhrí an Achta so.
(2) Pé uair a dhiúltóidh ceannphort den Ghárda Síochána do ghéille d'iarratas ar dheimhniú oiriúnachta áitreibh i dtaobh áitreibh is áitreabh cláruithe ar dháta an iarratais sin, agus a lóisteálfar athchomharc chun na Cúirte Dúithche i gcoinnibh an diúltuithe sin, féadfaidh na Coimisinéirí Ioncuim, gan aon diúité d'íoc ach fé réir pé coinníollacha is oiriúnach leo d'fhorchur, an t-áitreabh san do choinneáil ar an gclár d'oifigí glactha geall go dtí go dtabharfar breith ar an athchomharc san.
Féadfaidh an Chúirt ceadúnas no clárú do cheiliúradh.
15.—(1) Pé uair a ciontófar geall-ghlacadóir ceadúnuithe in aon choir no in aon chionta fén Acht so no fé aon Acht eile agus is dóich leis an gCúirt a chiontóidh no gur ina láthair a ciontófar an geall-ghlacadóir sin amhlaidh, maidir leis an gcoir no leis an gcionta san, gur ní é de shaghas no de charachtar no do rinneadh ina leithéid de chás go mbeadh an geall-ghlacadóir do rinne é ina dhuine neamh-oiriúnach chun leanúint i seilbh cheadúnais gheallghlacadóra, féadfaidh an Chúirt sin an ceadúnas geall-ghlacadóra do bhí ag an ngeall-ghlacadóir sin do cheiliúradh nuair a bheidh sí ag tabhairt breithe air.
(2) Pé uair a ciontófar dílseánach cláruithe aon áitreibh chláruithe i gcionta fé aon alt den Acht so maidir leis an áitreabh san no le haon áitreabh eile agus, mar gheall ar shaghas agus ar charachtar an chionta agus mar gheall ar an gcás in a ndearnadh é, is dóich leis an gCúirt a chiontóidh no gur ina láthair a ciontófar an dílseánach san amhlaidh ná fuil sé oiriúnach go leanfadh an t-áitreabh san de bheith cláruithe sa chlár d'oifigí glactha geall, féadfaidh an Chúirt sin, le linn breithe do thabhairt ar an dílseánach san agus i dteanta no d'éamais an ceadúnas geallghlacadóra bheidh ar seilbh aige do cheiliúradh, a ordú go scriosfar an t-áitreabh san amach as an gclár d'oifigí glactha geall.
(3) Pé uair a dhéanfaidh cúirt ceadúnas geall-ghlacadóra do cheiliúradh fén alt so no ordóidh cúirt fén alt so aon áitreabh cláruithe do scriosadh amach as an gclár d'oifigí glactha geall, déanfaidh clárathóir, cléireach, no príomh-oifigeach eile na cúirte sin an ceiliúradh san no an t-ordú san (pe'ca aca é) do chur in úil do sna Coimisinéirí Ioncuim agus leis sin cuirfidh na Coimisinéirí Ioncuim an ceiliúradh san ar breaca no scriosfaid an t-áitreabh san amach as an gclár d'oifigí glactha geall, pe'ca aca is gá sa chás.
(4) Pé uair a ceiliúrfar ceadúnas geall-ghlacadóra fén alt so déanfaidh an geall-ghlacadóir no an duine eile go mbeidh an ceadúnas san ar seilbh no i gcoimeád aige le linn an cheiliúrtha san an ceadúnas san do sheachada d'oifigeach custum agus máil laistigh de sheacht lá tar éis an cheiliúrtha san agus cuirfidh an t-oifigeach san an ceadúnas san ar ceal láithreach, agus gach geallghlacadóir no duine eile den tsórt san go dteipfidh air an ceadúnas san do sheachada amhlaidh beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós máil de dheich bpuint do chur air.
An tAire Dlí agus Cirt do cheiliúradh ceadúnas áirithe.
16.—(1) Féadfaidh an tAire Dlí agus Cirt aon uair, más rogha leis féin é, aon cheadúnas geall-ghlacadóra do tugadh amach do dhuine fén Acht so de bhuadh é bheith i seilbh dheimhnithe oiriúnachta pearsanta do thug an tAire sin uaidh do cheiliúradh.
(2) Pé uair a dhéanfaidh an tAire Dlí agus Cirt ceadúnas geall-ghlacadóra do cheiliúradh fén alt so déanfaidh an tAire sin an ceiliúradh san do chur in úil do sna Coimisinéirí Ioncuim agus leis sin cuirfidh na Coimisinéirí Ioncuim an ceiliúradh san ar breacadh.
Aitreabh do scriosadh amach as clár d'oifigí glactha geall.
17.—(1) Pé uair a scuirfidh dílseánach cláruithe aonair aon áitreibh chláruithe de bheith ina gheall-ghlacadóir cheadúnuithe no de bheith ina dhílseánach ar an áitreabh san, scriosfaidh na Coimisinéirí Ioncuim an t-áitreabh san amach as an gclár d'oifigí glactha geall láithreach ar fháil eolais dóibh ar an scur san.
(2) Pé uair a bheidh roinnt daoine cláruithe sa chlár d'oifigí glactha geall mar chó-dhílseánaigh chláruithe ar aon áitreabh cláruithe agus a scuirfidh na daoine sin uile de bheith ina ndílseánaigh ar an áitreabh san, scriosfaidh na Coimisinéirí Ioncuim an t-áitreabh san amach as an gclár d'oifigí glactha geall láithreach ar fháil eolais dóibh ar an scur san.
(3) Pé uair a bheidh roinnt daoine cláruithe sa chlár d'oifigí glactha geall mar chó-dhílseánaigh chláruithe ar aon áitreabh cláruithe agus a scuirfidh gach duine no aon duine no daoine acu san de bheith ina gheall-ghlacadóir cheadúnaithe no ina ngeallghlacadóirí ceadúnuithe, scriosfaidh na Coimisinéirí Ioncuim an t-áitreabh san amach as an gclár d'oifigí glactha geall láithreach ar fháil eolais dóibh ar an scur san.
(4) Pé uair a scriosfaidh na Coimisinéirí Ioncuim aon áitreabh cláruithe amach as an gclár d'oifigí glactha geall fén alt so no do réir ordú ón gcúirt, ansan, an té ba dhílseánach cláruithe ar an áitreabh san díreach sarar scriosadh an t-áitreabh san amach as an gclár amhlaidh déanfa sé, ar éileamh i scríbhinn a seachadfar ag an áitreabh san no a cuirfear tríd an bpost chun an áitreibh sin, an deimhniú is déanaí ar chlárú no ar athnuachaint chlárú an áitreibh sin do sheachada do sna Coimisinéirí Ioncuim no do chur chúcha agus gach duine den tsórt san go dteipfidh air an deimhniú san do sheachada dhóibh no do chur chúcha amhlaidh laistigh de sheacht lá tar éis an éilimh sin beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós máil d'fhiche púnt do chur air.
Forálacha i dtaobh códhílseánach cláruithe.
18.—(1) Féadfar beirt gheall-ghlacadóirí ceadúnuithe no níos mó do chlárú sa chlár d'oifigí glactha geall mar chó-dhílseánaigh ar aon áitreabh a bheidh cláruithe sa chlár san.
(2) Pé uair a thiocfaidh geall-ghlacadóir ceadúnuithe chun bheith ina dhílseánach, i dteanta an dílseánaigh no na ndílseánach cláruithe, ar aon áitreabh cláruithe, déanfaidh na Coimisinéirí Ioncuim, ar na dátáin agus ar aontú an dílseánaigh no na ndílseánach cláruithe do bheith cruthuithe chun sástachta dhóibh, an geall-ghlacadóir ceadúnuithe sin d'iontráil sa chlár d'oifigí glactha geall mar dhílseánach chláruithe ar an áitreabh san i dteanta an duine no na ndaoine bheidh cláruithe cheana mar dhílseánach no mar dhílseánaigh den tsórt san.
(3) Pé uair a scuirfidh duine amháin de chó-dhílseánaigh chláruithe uile agus fé seach aon áitreibh chláruithe de bheith ar dhuine de dhílseánaigh an áitreibh sin déanfaidh na Coimisinéirí Ioncuim, ar na dátáin agus ar aontú na ndílseánach no an dílseánaigh chláruithe eile do bheith cruthuithe chun sástachta dhóibh, ainm an dílseánaigh chláruithe céad-luaidhtear do scriosadh amach as an gcuid den chlár d'oifigí glactha geall a bhaineann leis an áitreabh san.
Gnó ceaduítear do dhéanamh in áitreabh cláruithe.
19.—(1) Beidh sé dleathach do dhílseánach chláruithe áitreibh chláruithe faid a leanfa sé de bheith ina gheall-ghlacadóir cheadúnuithe gnó glactha geall do dhéanamh san áitreabh san fé réir forálacha an Achta so.
(2) Ní dhéanfaidh éinne ach dílseánach cláruithe an áitreibh aon cheárd, gairm, ná gnó in aon chor do chleachta in aon áitreabh cláruithe.
(3) Ní chleachtfaidh dílseánach cláruithe áitreibh chláruithe san áitreabh san, ná ní cheadóidh sé go gcleachtfar ann, ná go n-úsáidfí é chun go gcleachtfaí ann, aon cheárd, gairm ná gnó in aon chor ach amháin an gnó glactha geall a dheineann an dílseánach cláruithe ann.
(4) Ní bhainfidh an Betting Houses Act, 1853, le háitreabhacha cláruithe.
(5) Gach éinne a chleachtfaidh aon chéard, gairm, no gnó in aon áitreabh cláruithe no a cheadóidh a leithéid do chleachta ann no a cheadóidh aon áitreabh cláruithe d'úsáid chun a leithéid do chleachta ann contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar céad punt do chur air no más rogha leis an gcúirt é príosúntacht ar feadh téarma nách sia ná ráithe.
Srianta áirithe le háitreabh cláruithe d'úsáid.
20.—(1) Ní bhunóidh an té is dílseánach cláruithe ar áitreabh chláruithe ná ní choimeádfa sé ar siúl san áitreabh san ná lasmuich de aon tarrac (lasmuich dá ghnó glactha geall amháin do dhéanamh) a dhéanfadh no is dócha do dhéanfadh daoine do thabhairt no do mhealla chun cruinniú le chéile san áitreabh san no lasmuich de.
(2) Ní cheadóidh an té is dílseánach cláruithe ar áitreabh chláruithe an iomarca daoine bheith san áitreabh san ná daoine bheith ag leadránacht ann.
(3) Ní dhéanfaidh an té is dílseánach cláruithe ar áitreabh chláruithe ná ní cheadóidh sé d'éinne eile na téarmaí ná na rátaí gur dá réir atá sé sásta gill do ghlaca maidir le haon rás, comórtas, no iomaíocht eile áirithe no maidir le haon iomathóir in aon iomaíocht den tsórt san d'fhógairt ná do chraoladh san áitreabh san do sna daoine bheidh i láthair ann.
(4) Ní dhéanfaidh an té is dílseánach cláruithe ar áitreabh chláruithe ná ní cheadóidh sé éinní acu so leanas do thaisbeáint san áitreabh san ná lasmuich de i slí go mbeadh sé le feiscint ón sráid, eadhon, aon liostaí no ráitisí ina luaidhtear na téarmaí no na rátaí gur dá réir atá sé sásta gill do ghlaca maidir le haon rás, comórtas no iomaíocht eile áirithe no maidir le haon iomathóir in aon iomaíocht den tsórt san, no liostaí no ráitisí ina luaidhtear na hiomathóirí do hiontráladh no a ghlacfaidh páirt no is dócha a ghlacfaidh páirt in no do tarraigeadh siar as aon iomaíocht den tsórt san no ráitisí ina luaidhtear dátáin, scéala no roimh-bharúla i dtaobh aon iomaíochta den tsórt san, no aon ghríosa no mealla eile chun gill do chur.
(5) Lá ar bith go gcomórfar rásanna capall i Saorstát Éireann, i dTuaisceart Éireann, no sa Bhreatain Mhóir ní dhéanfaidh an té is dílseánach cláruithe ar áitreabh chláruithe, i rith na tréimhse idir an am a ceapfar chun an chéad ráis an lá san de sna rásanna san do thosnú agus ceathrú uair a' chluig tar éis an ama ceapfar chun an ráis dheiridh an lá san de sna rásanna san do thosnú, íocaíocht ar bith d'íoc ná a cheadú íocaíocht ar bith d'íoc san áitreabh san alos airgid do buadhadh le haon gheall do cuireadh leis an dílseánach cláruithe sin maidir le rás de sna rásanna san do ritheadh an lá san.
(6) Gach dílseánach cláruithe dhéanfaidh ní ar bith (pe'ca gníomh no faillí é) is sárú ar an alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar céad punt do chur air.
Uaire gnótha in áitreabh cláruithe.
21.—(1) Ní déanfar áitreabh cláruithe d'oscailt ná do choimeád ar oscailt chun gnótha dhéanamh aon uair aon Domhnach, Lá Nodlag, ná Aoine an Chéasta ná roimh a naoi a chlog ar maidin ná tar éis a sé a chlog tráthnóna aon lá eile.
(2) Má deintear agus pé uair a déanfar aon áitreabh cláruithe d'oscailt no do choimeád ar oscailt contrárdha don alt so beidh dílseánach cláruithe an áitreibh sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air.
Toirmeasc ar ghill fé bhun scillinge.
22.—(1) Ní bheidh sé dleathach do gheall-ghlacadóir cheadúnuithe geall níos lugha ná scilling do chur ná do ghlaca ná do dhéanamh.
(2) Gach geall-ghlacadóir ceadúnuithe chuirfidh no ghlacfaidh no dhéanfaidh geall contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche punt do chur air.
(3) Chun crícheanna an ailt seo tuigfear gurb é méid gill ná an tsuim airgid a bheidh an geall-ghlacadóir ceadúnuithe i dteideal do réir téarmaí an ghill a fháil no a choinneáil no creidiúint do ghlaca inti má bhíonn tora an ní is abhar don gheall fábharach do.
Toirmeasc ar ghill do chur le daoine fé bhun ocht mblian déag.
23.—(1) Ní chuirfidh aon gheall-ghlacadóir ceadúnuithe geall ná ní dhéanfaidh gnó gill le duine fé bhun ocht mblian déag d'aois pe'ca ar a shon féin no mar ghníomhaire do dhuine eile a bheidh an duine sin ag gníomhú.
(2) Ní cheadóidh dílseánach cláruithe aon áitreibh chláruithe d'éinne fé bhun ocht mblian déag d'aois (seachas daoine chomhnuíonn do ghnáth san áitreabh san agus oifigigh don Aire Puist agus Telegrafa bheidh ag dul isteach san áitreabh san i gcúrsa a ndualgais mar oifigigh den tsórt san) dul isteach san áitreabh sna ná bheith ann.
(3) Gach duine dhéanfaidh ní ar bith (pe'ca gníomh no faillí é) is sárú ar an alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar céad punt do chur air.
(4) Nuair a cuirfear i leith duine go ndearna sé cionta fén alt so is leor-chosaint air sin a chruthú gur chreid an duine ’na gcuirtear san ina leith agus go raibh cúis réasúnta aige chun a chreidiúint go raibh an té gur maidir leis adeirtear a rinneadh an cionta ocht mbliana déag d'aois no os a chionn san.
An deimhniú ar chlárú do bheith ar taisbeáint.
24.—(1) Cuirfidh gach dílseánach cláruithe áitreibh chláruithe fé ndeár an deimhniú ar chlárú an áitreibh sin no, má hathnuadhadh an clárú san, an deimhniú is déanaí ar athnuachaint chlárú an áitreibh sin, do bheith ar taisbeáint go so-fheicse san áitreabh san gach aon uair a bheidh an t-áitreabh san ar oscailt chun gnótha do dhéanamh.

Ceadúnaisí geall-ghlacadóirí do thaisbeáint ar san d'éileamh.
25.—(1) Féadfaidh aon oifigeach custum agus máil no aon bhall den Ghárda Síochána a éileamh ar éinne a bhéarfa sé fé ndeara a bheith i mbun no ag déanamh gnótha glactha na ngeall a cheadúnas geall-ghlacadóra do thaisbeáint, agus más rud é go n-eiteoidh an duine sin no go dteipfidh air an ceadúnas san do thaisbeáint no má thaisbeánann sé an ceadúnas san ach go n-eiteoidh sé no go dteipfidh air a cheadú don oifigeach no don bhall san an ceadúnas san do léigheamh agus do scrúdú beidh sé ciontach i gcionta fén alt so.
(2) Pé uair a héileofar ar éinne go dleathach fén alt so a cheadúnas geall-ghlacadóra do thaisbeáint agus a eiteoidh an duine sin no go dteipfidh air an ceadúnas san do thaisbeáint no a thaisbeánfa sé an ceadúnas san ach go dteipfidh air no go n-eiteoidh sé a cheadú don oifigeach custum agus máil no don bhall den Ghárda Síochána do rinne an t-éileamh an ceadúnas san do léigheamh agus do scrúdú, féadfaidh an t-oifigeach no an ball san a ainm agus a sheola d'éileamh ar an duine sin agus más rud é go n-eiteoidh an duine sin no go dteipfidh air a ainm do thabhairt uaidh no a sheola do thabhairt uaidh no go dtabharfa sé uaidh ainm no seola bheidh bréagach no mí-threorach, beidh sé ciontach i gcionta fén alt so.
(3) Féadfaidh aon bhall den Ghárda Síochána gabháil gan barántas do dhéanamh—
(a) ar éinne a eiteoidh no go dteipfidh air a cheadúnas geallghlacadóra do thaisbeáint nuair a héileofar air go dleathach fén alt so an ceadúnas san do thaisbeáint, no a thaisbeánfaidh an ceadúnas san ar san d'éileamh ach a eiteoidh no go dteipfidh air a cheadú don oifigeach custum agus máil no don bhall den Ghárda Síochána do rinne an t-éileamh an ceadúnas san do léigheamh agus do scrúdú, no
(b) ar éinne a eiteoidh no go dteipfidh air a ainm do thabhairt uaidh no a sheola do thabhairt uaidh nuair a héileofar a ainm agus a sheola air go dleathach fén alt so no do bhéarfaidh uaidh ar san d'éileamh ainm no seola bheidh bréagach no mí-threorach go bhfios don oifigeach custum agus máil no don bhall den Ghárda Síochána do rinne an t-éileamh.
(4) Einne bheidh ciontach i gcionta fén alt so dlighfear ar a chiontú ann ar an slí achmair pionós máil d'fhiche punt do chur air.
(5) Duine ná déanfaidh, toisc nách geall-ghlacadóir ceadúnuithe é, a cheadúnas geall-ghlacadóra do thaisbeáint nuair a héileofar air go dleathach fén alt so an ceadúnas san do thaisbeáint tuigfear gur theip air a cheadúnas geall-ghlacadóra do thaisbeáint do réir bhrí an ailt seo.
Comhachta chun dul isteach agus lorgaireacht do dhéanamh.
26.—(1) Féadfaidh aon oifigeach custuim agus máil no aon bhall den Ghárda Síochána dul isteach in aon áitreabh cláruithe aon uair a bheidh an t-áitreabh san no a bheidh amhras ag an oifigeach no ag an mball san an t-áitreabh san do bheith ar oscailt chun aon ghnótha do dhéanamh, agus pé cuardach agus lorgaireacht do dhéanamh ann is dóich leis an oifigeach no leis an mball san is ceart agus pé ceisteanna is dóich leis an oifigeach no leis an mball san is ceart i dtaobh an áitreibh sin agus i dtaobh an ghnótha deintear ann do chur chun éinne gheobhfar san áitreabh san.
(2) Féadfaidh aon oifigeach custum agus máil aon uair dul isteach in aon áitreabh (nách áitreabh cláruithe) ina ndeintear no go mbeidh amhras ag an oifigeach san go ndeintear ann gnó glactha na ngeall, agus pé cuardach agus lorgaireacht do dhéanamh ann is dóich leis an oifigeach san is ceart, agus a ainm agus a sheola d'éileamh ar éinne gheobhar san áitreabh san agus pé ceisteanna is dóich leis an oifigeach san is ceart i dtaobh an áitreibh sin agus i dtaobh an ghnótha deintear ann do chur chun éinne den tsórt san.
(3) Gach éinne dhéanfaidh éinní acu so leanas, sé sin le rá:—

(4) Féadfaidh aon bhall den Ghárda Síochána duine ar bith do ghabháil gan barántas a dhéanfaidh ní ar bith ina láthair (pe'ca gníomh no faillí é) a dearbhuítear leis an alt so do bheith ina chionta fén alt so.
Cosaint do chongantóirí geallghlacadóirí.
27.—(1) I dteanta aon fhorála agus gan dochar d'aon fhoráil den Acht so cheaduíonn do dhílseánach chláruithe áitreibh chláruithe cléirigh agus congantóirí d'fhostú, beidh sé dleathach do gheall-ghlacadóir cheadúnuithe duine ar bith do bheith ar fostú aige mar chongantóir ar na forálacha so leanas do chólíonadh, sé sin le rá:—
(a) go raibh an té bheidh ar fostú amhlaidh ar fostú aige mar chléireach no mar chongantóir ar an 1adh lá de Mhárta, 1931, no go bhfuil sé ocht mbliana déag d'aois no os a chionn san, agus
(b) ná gníomhuíonn an duine sin mar chongantóir don gheall-ghlacadóir cheadúnuithe sin ach le linn an gheall-ghlacadóra cheadúnuithe sin féin do bheith i láthair no in áitreabh cláruithe dar dílseánach cláruithe an geall-ghlacadóir ceadúnuithe sin, agus
(c) nách do réir an mhéid gnótha ná brabúis a dheineann an geall-ghlacadóir ceadúnuithe sin a híoctar ná a háirítear i bpáirt ná go hiomlán luach saothair an duine sin, agus
(d) ná déanfaidh an duine sin don gheall-ghlacadóir cheadúnuithe sin ná thar a cheann ná mar chongantóir do gníomh ar bith go dtiocfadh as é dhéanamh go ndlighfí fén alt so a thuisgint go raibh an duine sin féin ag gníomhú mar gheall-ghlacadóir do réir bhrí an Achta so.
(2) Duine dhéanfaidh aon ghníomh acu so leanas do gheallghlacadóir cheadúnuithe no thar a cheann no mar chongantóir no mar chléireach do, sé sin le rá:—
(a) cuireadh do thabhairt do dhaoine no a iarraidh ortha gill do chur leis féin no leis an ngeall-ghlacadóir ceadúnuithe sin, no
(b) na téarmaí no na rátaí do chraoladh gur dá réir atá sé féin no an geall-ghlacadóir ceadúnuithe sin sásta gill do ghlaca maidir le haon rás, comórtas no iomaíocht eile no maidir le haon iomathóir in aon iomaíocht den tsórt san, no
(c) aon gheall do ghlacadh, do chur no do shocrú pe'ca thar a cheann féin no thar ceann an gheall-ghlacadóra cheadú nuithe sin a dheallróidh sé bheith á dhéanamh san.
tuigfear é féin do bheith ag gníomhú mar gheall-ghlacadóir do réir bhrí an Achta so más in áit ar bith seachas in áitreabh cláruithe dar dílseánach cláruithe an geall-ghlacadóir ceadúnuithe sin a déanfar an gníomh san.
(3) Duine bheidh ar fostú ag geall-ghlacadóir ceadúnuithe mar chongantóir do agus 'na mbeidh a fhostú dleathach de bhuadh an ailt seo ní tuigfear é bheith ag gníomhú ná ag déanamh gnótha mar gheall-ghlacadóir do réir bhrí an Achta so de dhruim é bheith ar fostú agus ag gníomhú mar chongantóir den tsórt san agus dá dhruim sin amháin.
Cosaint do chléirigh agus do chongantóirí in áitreabhacha cláruithe.
28.—(1) I dteanta aon fhorála agus gan dochar d'aon fhoráil den Acht so cheaduíonn do gheall-ghlacadóir cheadúnuithe congantóir do bheith ar fostú aige beidh sé dleathach do dhílseánach chláruithe áitreibh chláruithe cléirigh agus congantóirí (eadhon, daoine atá ocht mbliana déag d'aois no os a chionn san no do bhí ar fostú san áitreabh san ag an ngeall-ghlacadóir ceadúnuithe sin ar an 1adh lá de Mhárta, 1931) do bheith ar fostú aige san áitreabh san fé mar a bheidh riachtanach do réir réasúin chun a ghnótha mar gheall-ghlacadóir do dhéanamh san áitreabh san, ach nách do réir an mhéid gnótha ná brabúis a dheineann an dílseánach cláruithe a híoctar ná a háirítear i bpáirt ná go hiomlán suim luacha saothair fé seach na gcléireach agus na gcongantóirí sin.
(2) Duine bheidh ar fostú ag dílseánach cláruithe áitreibh chláruithe mar chléireach no mar chongantóir san áitreabh san agus 'na mbeidh a fhostú mar chléireach no mar chongantóir den tsórt san dleathach de bhuadh an ailt seo, ní tuigfear é bheith ag gníomhú ná ag déanamh gnótha mar gheall-ghlacadóir do réir bhrí an Achta so de dhruim é bheith ag gníomhú mar chléireach no mar chongantóir den tsórt san agus dá dhruim sin amháin.

29.—(1) Ní bheidh sé dleathach do dhuine ar bith aon duine fé bhun ocht mblian déag d'aois do chur isteach no do thabhairt isteach in aon áitreabh cláruithe ach daoine chomhnuíonn do ghnáth san áitreabh san agus oifigigh don Aire Puist agus Telegrafa raghaidh isteach san áitreabh san i gcúrsa a ndualgas mar oifigigh den tsórt san.
(2) Gach duine (seachas dílseánach cláruithe an áitreibh chláruithe bheidh i gceist) a dhéanfaidh éinne do chur isteach no do thabhairt isteach in áitreabh cláruithe contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear, má sé an chéad chionta aige é, fíneáil ná raghaidh thar caoga punt do chur air no, má sé an dara cionta aige é no aon chionta ina dhiaidh sin, fíneáil ná raghaidh thar céad punt no, más rogha leis an gcúirt é, príosúntacht ar feadh aon téarma nách sia ná ráithe no an fhíneáil sin agus an phríosúntacht san le chéile.

30.—(1) Gach duine bheidh ina sheasamh no ag leadránacht lasmuich d'aon áitreabh cláruithe no in a aice tar éis do bhall den Ghárda Síochána in éide a iarraidh air boga leis beidh sé (pe'ca chuirfidh an seasamh no an leadránacht san isteach ar thrácht no ná cuirfidh) ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig puint do chur air no, más rogha leis an gcúirt é, príosúntacht ar feadh aon téarma nách sia ná mí.
(2) Féadfaidh ball den Ghárda Síochána in éide duine go dteipfidh air no a dhiúltóidh boga leis ar a iarraidh san air fén alt so don bhall san do ghabháil gan barántas.

31.—(1) Gach duine dhéanfaidh, tré n-a leigint air go bhfuil sé ocht mbliana déag d'aois no os a chionn san, geall-ghlacadóir ceadúnuithe do thabhairt chun gill do chur leis no chun gnótha gill do dhéanamh leis no dílseánach cláruithe áitreibh chláruithe do thabhairt chun a cheadú dho dul isteach no fanúint san áitreabh san beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig puint do chur air.
(2) Gach duine ordóidh d'aon duine eile cionta do dhéanamh fén bhfo-alt san roimhe seo den alt so no chuirfidh fé ndeár go ndéanfa sé amhlaidh no do bhéarfaidh chun a dhéanta é beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig puint do chur air.

32.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, ní bheidh sé dleathach d'éinne aon fhógrán, cearcalán ná gearrthán ag moladh geall do chur ar chluichí peile no ag tabhairt cuiridh chuige sin no a bhaineann leis sin ar shlí eile do scríobhadh, do chlóbhualadh ná d'fhoillsiú ná é do chur timpeal go feasach, ná a chur fé ndeár ná a thabhairt chun críche go feasach aon fhógrán, cearcalán no gearrthán den tsórt san do scríobhadh, do chlóbhualadh, d'fhoillsiú no do chur timpeal ná tabhairt fé n-a leithéid sin do dhéanamh go feasach.
(2) Ní bheidh sé nea-dhleathach do dhílseánach chláruithe áitreibh chláruithe de dhruim éinní san alt so aon fhográn, cearcalán no gearrthán i dtaobh gnótha na geall-ghlacadóireachta deintear san áitreabh san (pe'ca alos cluichí peile no alos éinní eile deintear é) do bheith aige agus do scaipeadh san áitreabh san, ná d'éinne aon fhógrán, cearcalán no gearrthán den tsórt san do scríobhadh no do chlóbhualadh don dílseánach cláruithe sin.
(3) Gach duine dhéanfaidh gníomh ar bith is sárú ar an alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear, má sé an chéad chionta aige é, fíneáil ná raghaidh thar cúig puint fhichead no príosúntacht ar feadh aon téarma nách sia ná mí do chur air agus, má sé an dara cionta aige é no aon chionta ina dhiaidh sin, fíneáil ná raghaidh thar céad punt no príosúntacht ar feadh aon téarma nách sia ná ráithe.

33.—(1) Ní bheidh sé dleathach d'éinne agus é i Saorstát Éireann geall do chur ná do dhéanamh ná tabhairt fé gheall do chur no do dhéanamh le duine a bheidh lasmuich de Shaorstát Éireann an uair sin ná éinne a bheidh lasmuich de Shaorstát Éireann de thurus na huaire d'fhostú ná d'údarú ná ordú do thabhairt do chun gill do chur no do dhéanamh do no ar a shon, ná tabhairt fé éinne den tsórt san d'fhostú no d'údarú no ordú do thabhairt do chuige sin.
(2) Gach éinne a chuirfidh no a dhéanfaidh geall, no a thabharfaidh fé gheall do chur no do dhéanamh, contrárdha don alt so, no a fhostóidh no a údaróidh éinne no do bhéarfaidh ordú dho chun gill do chur no do dhéanamh, contrárdha don alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós máil de chéad punt do chur air.
(3) Ní bheidh sé nea-dhleathach do gheall-ghlacadóir cheadúnuithe de dhruim éinní san alt so geall do chur no do dhéanamh, agus é i Saorstát Éireann, le duine bheidh lasmuich de Shaorstát Éireann an uair sin agus ná deineann gnó mar gheall-ghlacadóir.
Comhachta don Aire Puist agus Telegrafa.
34.—(1) Féadfaidh an tAire Puist agus Telegrafa aon phacáid phuist do choinneáil 'na mbeidh amhras scéala le n-a mbaineann an t-alt so do bheith inti agus cuirfe sé chun na gCoimisinéirí Ioncuim gach pacáid phuist a coinneofar amhlaidh agus féadfaidh na Coimisinéirí sin an phacáid d'oscailt agus do scrúdú agus má gheibhid inti aon scéala le n-a mbaineann an t-alt so féadfaid an phacáid agus a mbeidh inti do choinneáil chun cúisimh do dhéanamh, agus mara bhfaghaid aon scéala den tsórt san inti dúnfaid an phacáid agus cuirfid thar n-ais chun an Aire Puist agus Telegrafa í agus cuirfidh seisean an phacáid agus a mbeidh inti tríd an bpost chun an té chun ar seoladh í.
(2) Pé uair a gheobhaidh an tAire Puist agus Telegrafa, le cur ar aghaidh tríd an telegraf, teachtaireacht a dheabhróidh bheith ina scéala le n-a mbaineann an t-alt so, féadfa sé cóip den teachtaireacht san do chur chun na gCoimisinéirí Ioncuim maraon le pé eolas ina taobh is oiriúnach leis a chur chucha no a iarrfaidh na Coimisinéirí Ioncuim.
(3) Féadfaidh an tAire Puist agus Telegrafa, tar éis do dul i gcomhairle leis na Coimisinéirí Ioncuim, rialacháin do dhéanamh chun na gcomhacht d'fheidhmiú agus chun na ndualgas do dhéanamh a bronntar no a forchuirtear air leis an alt so.
(4) Baineann an t-alt so le gach scéala o dhuine i Saorstát Éireann (dá ngairmtear an seoltóir anso feasta) chun duine lasmuich de Shaorstát Éireann (dá ngairmtear an seolaí anso feasta) tré n-a dtugann an seoltóir le tuisgint ar a shon féin no ar son duine eile go bhfuil sé ag cur no ag déanamh gill leis an seolaí no tré n-a dtugann an seoltóir le tuisgint go bhfuil sé ag fostú no ag údarú an tseolaí no ag tabhairt orduithe dho chun gill do chur no do dhéanamh don tseoltóir no d'éinne eile no ar a shon.
(5) Sa mhéid go mbaineann an t-alt so le pacáidí puist léighfear agus léireofar é i dteanta na Post Office Acts, 1908 to 1920, agus sa mhéid go mbaineann sé le telegrama léighfear agus léireofar é mar éinní amháin leis na hAchtanna Telegrafa, 1863 go 1928.

35.—(1) Féadfaidh an tAire Dlí agus Cirt, le hordú, rialacháin do dhéanamh ag ordú éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú agus a bhaineann leis an gCúirt Dúithche, le baill den Ghárda Síochána no leis an Aire Dlí agus Cirt.
(2) Féadfaidh an tAire Airgid, le hordú, rialacháin do dhéanamh ag ordú éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú agus ná húdaruítear leis an Acht so a ordú le rialacháin a dhéanfaidh an tAire Dlí agus Cirt.

Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Finance;
the expression “licensed bookmaker” means a person (not being a body corporate or an unincorporated body of persons) who is the holder of a bookmaker's licence issued or deemed to have been issued to him under this Act and for the time being in force;
the word “premises” means any house or other building and includes a defined part of a house or other building;
the expression “registered premises” means premises for the time being registered in the register of bookmaking offices kept by the Revenue Commissioners under this Act;
the word “proprietor” means the person entitled to the exclusive occupation of the premises in relation to which the word is used, and, where the context so admits, includes a number of persons jointly so entitled;
the expression “registered proprietor” means a person who is for the time being entered in the said register of bookmaking offices as the proprietor of premises registered in that register, and, where the context so admits, the said expression includes a number of persons entered in the said register as joint proprietors of premises so registered;
the word “bet” includes wager, and cognate words shall be construed accordingly;
the word “prescribed” when used in relation to the District Court, a member of the Gárda Síochána, or the Minister for Justice means prescribed by regulations made under this Act by the Minister for Justice and in every other case means prescribed by regulations made under this Act by the Minister for Finance.
Prohibition of acting as bookmaker without licence.
2.—(1) No person shall carry on business or act as a bookmaker or hold himself out or represent himself to be a bookmaker or a licensed bookmaker unless he holds a bookmaker's licence issued or deemed to have been issued to him under this Act and for the time being in force.
(2) Every person who carries on business or acts as a bookmaker in contravention of this section and every person who holds himself out or represents himself to be a bookmaker or a licensed bookmaker in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to an excise penalty of five hundred pounds.
Continuance of existing licence.
3.—(1) Every licence issued under the Betting Act, 1926, authorising a person to act and carry on business as a bookmaker which is in force at the commencement of this Act shall be deemed to be a bookmaker's licence issued under this Act and the provisions of this Act (other than the provisions relating to the duration of a bookmaker's licence) shall apply accordingly.
(2) Every licence deemed by this section to be a bookmaker's licence issued under this Act shall, unless and until revoked under this Act, continue in force during the period specified in that behalf in such licence and no longer, save that, where such period expires during or at the end of the month of October or during the month of November next after the commencement of this Act, such licence shall continue in force until midnight on the 30th day of November next after such commencement.

4.—(1) Any person (other than a body corporate or an unincorporated body of persons) who is ordinarily resident in Saorstát Eireann and desires to obtain a bookmaker's licence may, after publishing the notice hereinafter mentioned, apply in accordance with this section to the superintendent of the Gárda Síochána for the district in which he has or proposes to have an office registered under this Act or, if he has not and does not propose to have any such office, to the superintendent of the Gárda Síochána for the district in which he ordinarily resides for a certificate (in this Act referred to as a certificate of personal fitness) that he is a fit and proper person to hold a bookmaker's licence.
(2) Every person intending to apply under this section for a certificate of personal fitness shall, not less than one fortnight nor more than one month before making such application, publish notice of his intention to make such application at least once in each of two newspapers circulating in the district of the superintendent to whom he intends to make such application.
(3) Every application under this section for a certificate of personal fitness shall be made in the prescribed manner and on the prescribed form and shall be approved of and signed by two Peace Commissioners in the district of the superintendent to whom the application is made.
(4) A superintendent of the Gárda Síochána to whom an application for a certificate of personal fitness is duly made under this section shall, within fourteen days after the receipt of such application, do one or other as he in his discretion shall think proper of the following things, that is to say, either give to the applicant a certificate in the prescribed form that he is a fit and proper person to hold a bookmaker's licence or on any one or more of the grounds hereinafter authorised refuse to give such certificate.
Certificate of personal fitness of resident outside Saorstát Eireann.
5.—(1) Any person (other than a body corporate or an unincorporated body of persons) who is ordinarily resident outside Saorstát Eireann and desires to obtain a bookmaker's licence may, after publishing the notice hereinafter mentioned, apply in the prescribed manner and form to the Minister for Justice for a certificate (included in the references in this Act to a certificate of personal fitness) that he is a fit and proper person to hold a bookmaker's licence.
(2) Every person intending to apply under this section for a certificate of personal fitness shall, not less than one fortnight nor more than one month before making such application, publish notice of his intention to make such application at least once in a daily newspaper published and circulating in the City of Dublin.
(3) On receiving an application under this section for a certificate of personal fitness the Minister for Justice may in his absolute discretion either give to the applicant a certificate in the prescribed form that such applicant is a fit and proper person to hold a bookmaker's licence or may on any ground and without stating the ground refuse to give such certificate.
Grounds for refusal of certificate of personal fitness.
6.—A superintendent of the Gárda Síochána may refuse an application for a certificate of personal fitness on any one or more of the following grounds and on no other ground whatsoever, that is to say:—
(a) that at the time of the application for the certificate arrears of any duty for the time being payable on or in respect of bets are due and owing by the applicant;
(b) that the applicant had been previously convicted of a crime or of an offence under this Act or under the Betting Act, 1926, or of an offence in relation to the duty on bets or has since the commencement of the Betting Act, 1926, been convicted of an offence under any Act relating to gaming or gaming houses or to betting (other than the Ready Money Football Betting Act, 1920) or has since the commencement of the Betting Act, 1926, been twice or oftener convicted of an offence under the Ready Money Football Betting Act, 1920;
(c) that a bookmaker's licence held by the applicant under this Act or the Betting Act, 1926, was revoked;
(d) that a previous refusal by a superintendent of the Gárda Síochána to give a certificate of personal fitness under this Act or under the Betting Act, 1926, had been confirmed on appeal to the District Court;
(e) that the applicant is by reason of his general character or his known habits not a fit person to hold a bookmaker's licence;
(f) that the financial circumstances of the applicant are not such as to render him a fit person to hold a bookmaker's licence;
(g) in the case of an applicant who had previously held a bookmaker's licence under this Act or the Betting Act, 1926, that he had without reasonable cause failed or refused to pay sums payable to persons who had won bets made with him;
(h) that the applicant had ordinarily resided in Saorstát Eireann for less than twelve months before making the application;
(i) that, in the case of an applicant who previously held a bookmaker's licence under this Act or the Betting Act, 1926, the business of bookmaking had been conducted by him in a disorderly manner or in such a manner as to cause or encourage persons to congregate and loiter in or outside the premises where such business was conducted or he had permitted persons to loiter in such premises;
(j) that the applicant is acting as agent for a person whose application would be refused on one or other of the grounds set out in the foregoing paragraphs of this section;
(k) except in the case of an applicant who is at the passing of this Act the holder of a bookmaker's licence issued under the Betting Act, 1926, and is continuously from the date of such passing up to and including the time of making such application the holder of a bookmaker's licence issued under the Betting Act, 1926, or this Act and for the time being in force, that such applicant is the holder of a pawnbroker's licence or is a registered moneylender.
Issue of bookmakers' licences.
7.—(1) Any person to whom a certificate of personal fitness has been given may, within twenty-one days after the issue of such certificate, apply to the Revenue Commissioners in writing in the prescribed form for a bookmaker's licence commencing on such date (being either the next following 1st day of December or a day not more than fourteen days after the date of the application) as he shall specify in the application.
(2) Every application under this section for a bookmaker's licence shall be accompanied by a photograph of the applicant of the prescribed character and size and taken not more than one year before the date of the application.
(3) Upon delivery to the Revenue Commissioners of an application under this section for a bookmaker's licence and payment to the Revenue Commissioners by the applicant of the excise duty required by law to be paid by persons taking out such licence as is specified in such application, the Revenue Commissioners shall issue to the applicant a bookmaker's licence in accordance with this section.
(4) Every bookmaker's licence shall be in the prescribed form, and shall state the name and place of residence of the person to whom it is issued and shall have affixed thereto by adhesion the photograph of such person required by this section to be sent by him with the application for such licence, and shall operate and be expressed to authorise such person to act and carry on business as a bookmaker during the period commencing on the date specified therein (which shall be the date specified in that behalf in the application for such licence) and ending at midnight on the next following 30th day of November, but subject and without prejudice to all restrictions and prohibitions for the time being imposed by law in respect of the places in which the business of bookmaking may be carried on.
The register of bookmaking offices.
8.—(1) The Revenue Commissioners shall continue to keep in the prescribed form the register (in this Act referred to as the register of bookmaking offices) established and heretofore kept by them under the Betting Act, 1926, of premises in which the business of bookmaking is carried on and shall register therein all such premises as they are by virtue of this Act required to register therein.
(2) There shall be entered in the register of bookmaking offices in respect of all premises registered therein the name of the proprietor thereof, a precise description of the premises, and such other particulars as shall be prescribed.
Continuance of existing registrations of premises.
9.—(1) All premises which immediately before the commencement of this Act are registered in the register of bookmaking offices kept under the Betting Act, 1926, shall from and after such commencement continue for the period hereinafter mentioned to be registered in that register and shall be deemed to be so registered under this Act and this Act shall apply accordingly.
(2) Premises continued in the register of bookmaking offices under this section shall, unless and until removed from the said register under this Act, continue to be so registered until midnight on the 30th day of November next after the commencement of this Act and shall then (unless such registration has been renewed under this Act) be removed from the said register.
Certificate of suitability of premises.
10.—(1) Any person desiring to register or renew the registration of any premises of which he is the proprietor in the register of bookmaking offices may, after publishing the notice hereinafter mentioned, apply in accordance with this section to the superintendent of the Gárda Síochána for the district in which such premises are situate for a certificate (in this Act referred to as a certificate of suitability of premises) that such premises are suitable for registration in the register of bookmaking offices.
(2) Every person intending to apply under this section for a certificate of suitability of premises shall, not less than one fortnight nor more than one month before making such application, publish notice of his intention to make such application at least once in each of two newspapers circulating in the district in which the premises to which such intended application relates are situate.
(3) Every application under this section for a certificate of suitability of premises shall be made in the prescribed manner and on the prescribed form and shall be approved of and signed by two Peace Commissioners for the district in which the premises to which the application relates are situate.
(4) A superintendent of the Gárda Síochána to whom an application for a certificate of suitability of premises is duly made under this section shall, if he is satisfied that the applicant is either a licensed bookmaker or the holder of a certificate of personal fitness issued after or not more than seven days before the date of the application, do one or other as he in his discretion shall think proper of the following things within fourteen days after the receipt by him of such application, that is to say, either give to the applicant a certificate in the prescribed form that the premises the subject of the application are suitable for registration in the register of bookmaking offices or on any one or more of the grounds hereinafter authorised refuse to give such certificate.
Grounds for refusal of certificate of suitability of premises.
11.—(1) A certificate of suitability of premises may be refused on any one or more of the following grounds and on no other ground whatsoever, that is to say:—
(a) that the applicant is neither a licensed bookmaker nor the holder of a certificate of personal fitness;
(b) that the applicant is not the proprietor of the premises;
(c) that the premises are in close proximity to a place of worship, a religious institution, a school, an employment exchange, a factory or works, or other similar place in or near which large numbers of persons congregate, or are situate in a residential area;
(d) that the premises are in close proximity to premises known to be resorted to habitually by evilly-disposed persons;
(e) that the premises communicate internally with other premises;
(f) that the premises had previously been registered in the register of bookmaking offices kept under this Act or under the Betting Act, 1926, and had been removed from that register pursuant to an order of the court;
(g) that the premises are registered in the register of bookmaking offices and during such registration or during the registration of such premises in the register of bookmaking offices kept under the Betting Act, 1926, irregularities had occurred owing to the close proximity of the premises to premises licensed for the sale of intoxicating liquor;
(h) that the applicant had previously been convicted of an offence under this Act, the Betting Act, 1926, or any other Act in relation to the premises or in relation to any other registered premises of which he was the registered proprietor at the time the offence was committed;
(i) if the premises are or had been previously registered in the register of bookmaking offices kept under this Act, or under the Betting Act, 1926, that at some time while the applicant was the registered proprietor thereof the business of bookmaking had been conducted therein in a disorderly manner or in such manner as to cause or encourage persons to congregate and loiter in or outside the premises or that while the applicant was such registered proprietor he had permitted persons to loiter in such premises;
(j) that the applicant is or had previously been the registered proprietor of other registered premises and that the business of bookmaking is being or had while the applicant was such registered proprietor been conducted in such premises in a disorderly manner or in such manner as to cause or encourage persons to congregate and loiter in or outside the premises;
(k) if the application is in respect of premises which are not registered premises at the time the application is made, that there are already an excessive number of registered premises in the district in which the premises to which the application relates are situate;
(l) when the application is in respect of premises which did not before the 28th day of July, 1926, form part of premises licensed for the sale of intoxicating liquor, that the applicant is the holder of a licence for the sale of intoxicating liquor;
(m) if the application is in respect of premises which are not registered premises at the time the application is made, that the annual value under the Valuation Acts of such premises is, in the case of premises situate in the county borough of Dublin, less than fifteen pounds, in the case of premises situate in any other county borough, or in the borough of Dun Laoghaire, less than ten pounds, or in the case of premises situate elsewhere, less than five pounds;
(n) except in the case of an applicant who is at the passing of this Act the registered proprietor of the premises under the Betting Act, 1926, and is continuously from the date of such passing up to and including the time of making the application the registered proprietor of the premises under the Betting Act, 1926, or this Act, that such applicant is the holder of a pawnbroker's licence or is a registered moneylender.
(2) Where an application for a certificate of suitability of premises is made or intended to be made in respect of premises which are not separately valued under the Valuation Acts, the Commissioner of Valuation and Boundary Surveyor may, on the request of the person making or intending to make such application, divide the valuation of the hereditament or tenement of which such premises form part and place a separate value on each of the parts in the manner provided by the Valuation Acts, and there shall be paid in respect of the making of such division to the said Commissioner by the person on whose request such division was made the prescribed fee.
(3) Every fee paid to the Commissioner of Valuation and Boundary Surveyor under the foregoing sub-section shall be paid into or disposed of by him for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Registration in register of bookmaking offices.
12.—(1) Any licensed bookmaker to whom a certificate of suitability of premises has been given in respect of any premises of which he is the proprietor may, within twenty-one days after the issue of such certificate and (in the case of an application for a renewal of registration) within the period hereinafter mentioned, apply to the Revenue Commissioners in writing in the prescribed form to register or renew the registration of the premises mentioned in such certificate in the register of bookmaking offices and upon delivery of such application to the Revenue Commissioners and payment to the Revenue Commissioners by the applicant of the excise duty for the time being required by law to be paid on the registration or the renewal of the registration of premises in the register of bookmaking offices, the Revenue Commissioners shall register or renew the registration of the said premises in the register of bookmaking offices and shall issue to the applicant a certificate in the prescribed form of such registration or renewal of registration.
(2) Unless and until removed from the register under or by virtue of this Act, any premises registered in the register of bookmaking offices shall continue to be so registered until midnight on the 30th day of November next after the registration thereof and shall then (unless the registration has been renewed under this Act) be removed from the said register.
(3) Every renewal of the registration of any premises in the register of bookmaking offices shall commence and take effect as from the expiration of the registration or the last renewal of the registration (as the case may require) of the said premises in the said register, and unless and until removed from the register under or by virtue of this Act such premises shall continue so registered until midnight on the 30th day of November next after the commencement of such renewal and shall then (unless the registration is renewed under this Act) be removed from the said register.
(4) An application for the renewal of the registration of any premises in the register of bookmaking offices shall be made before but not more than fourteen days before the expiration of the registration or the last renewal of the registration of such premises in the said register.
Appeal from refusal of certificate.
13.—(1) Whenever a superintendent of the Gárda Síochána refuses to give a certificate of personal fitness or a certificate of suitability of premises, he shall, on demand made by the applicant for the certificate within six days after the refusal, give to such applicant a statement in writing in the prescribed form of the grounds on which he refused to give the certificate.
(2) Any person to whom a certificate of personal fitness or a certificate of suitability of premises has been refused by a superintendent of the Gárda Síochána may, within fourteen days after receiving from such superintendent a statement in writing of the grounds of such refusal, appeal in the prescribed manner from such refusal to the District Court.
(3) Every person who appeals to the District Court under this section shall in the prescribed manner and within the prescribed time give notice of such appeal to the said superintendent of the Gárda Síochána and also to the Revenue Commissioners.
(4) On the hearing of any such appeal the District Court may either confirm or disallow the refusal of the certificate, and, whenever the District Court so disallows a refusal of the certificate, the said superintendent of the Gárda Síochána shall within three days after such disallowance give to the appellant a certificate of personal fitness or a certificate of suitability of premises, as the case may require.
(5) The following provisions shall apply to every appeal under this section, that is to say:—
(a) the superintendent of the Gárda Síochána and the Revenue Commissioners and no other person shall be entitled to be heard and to adduce evidence in opposition to the appeal;
(b) section 27 of the Inland Revenue Regulation Act, 1890 shall apply to the appeal in like manner as it applies to proceedings relating to inland revenue;
(c) any ground of refusal mentioned in the written statement of grounds of refusal and no other ground may be advanced in opposition to the appeal;
(d) whenever the refusal is confirmed the court may order the appellant to pay the costs of the superintendent of the Gárda Síochána and may measure the amount of such costs;
(e) no appeal shall lie to the Circuit Court under section 84 of the Courts of Justice Act, 1924 (No. 10 of 1924).
Temporary licence and registration pending appeal.
14.—(1) Whenever an application for a certificate of personal fitness is refused by a superintendent of the Gárda Síochána and an appeal from such refusal to the District Court is lodged, then if the applicant was at the time of making the application a licensed bookmaker, the Revenue Commissioners may, without payment of any duty but subject to such conditions as they may think fit to impose, issue to such applicant a temporary bookmaker's licence for such period not extending beyond the expiration of seven days after the decision of such appeal as they may think fit, and every such temporary bookmaker's licence shall while it remains in force be a bookmaker's licence within the meaning of this Act.
(2) Whenever an application for a certificate of suitability of premises in respect of premises which are registered premises at the date of such application is refused by the superintendent of the Gárda Síochána and an appeal from such refusal to the District Court is lodged, the Revenue Commissioners may, without the payment of any duty but subject to such conditions as they may think fit to impose, retain such premises on the register of bookmaking offices pending the decision of such appeal.
Revocation of licence or registration by court.
15.—(1) Whenever a licensed bookmaker is convicted of any crime or of any offence under this or any other Act and the court by or before whom such bookmaker is so convicted is of opinion that such crime or offence was of such nature or character or was committed in such circumstances that the commission thereof rendered such bookmaker unfit to continue to hold a bookmaker's licence, such court may when imposing sentence revoke the bookmaker's licence held by such bookmaker.
(2) Whenever the registered proprietor of any registered premises is convicted of an offence under any section of this Act in relation to such or any other premises and the court by or before whom such proprietor is so convicted is of opinion that, having regard to the nature and character of the offence and the circumstances in which it was committed, it is not expedient that such premises should continue to be registered in the register of bookmaking offices, such court may, when imposing sentence and with or without revoking the bookmaker's licence held by such proprietor, direct that such premises be removed from the register of bookmaking offices.
(3) Whenever a bookmaker's licence is revoked by a court under this section or a court directs under this section any registered premises to be removed from the register of bookmaking offices, the registrar, clerk, or other principal officer of such court shall communicate the fact of such revocation or such direction (as the case may be) to the Revenue Commissioners and the Revenue Commissioners shall thereupon record such revocation or remove such premises from the register of bookmaking offices, as the case may require.
(4) Whenever a bookmaker's licence is revoked under this section, the bookmaker or other person who has possession or custody of such licence at the time of such revocation shall within seven days after such revocation deliver such licence to an officer of customs and excise and such officer shall forthwith cancel such licence, and every such bookmaker or other person who fails so to deliver such licence shall be guilty of an offence under this section and shall be liable on summary conviction thereof to an excise penalty of ten pounds.
Revocation of certain licences by the Minister for Justice.
16.—(1) The Minister for Justice may at any time at his absolute discretion revoke any bookmaker's licence issued under this Act to a person by virtue of his holding a certificate of personal fitness given by the said Minister.
(2) Whenever a bookmaker's licence is revoked by the Minister for Justice under this section the said Minister shall communicate the fact of such revocation to the Revenue Commissioners and the Revenue Commissioners shall thereupon record such revocation.
Removal of premises from register of bookmaking offices.
17.—(1) Whenever the sole registered proprietor of any registered premises ceases to be a licensed bookmaker or ceases to be the proprietor of such premises, the Revenue Commissioners shall, immediately upon such cesser coming to their knowledge, remove the said premises from the register of bookmaking offices.
(2) Whenever a number of persons are registered in the register of bookmaking offices as joint registered proprietors of any registered premises and all such persons cease to be proprietors of such premises, the Revenue Commissioners shall, immediately upon such cesser coming to their knowledge, remove the said premises from the register of bookmaking offices.
(3) Whenever a number of persons are registered in the register of bookmaking offices as joint registered proprietors of any registered premises and all or any one or more of such persons cease or ceases to be licensed bookmakers or a licensed bookmaker, the Revenue Commissioners shall, immediately upon such cesser coming to their knowledge, remove the said premises from the register of bookmaking offices.
(4) Whenever any registered premises are removed from the register of bookmaking offices by the Revenue Commissioners under this section or pursuant to a direction of the court, the person who was the registered proprietor of such premises immediately before such removal shall on demand in writing delivered at or sent by post to such premises deliver or send to the Revenue Commissioners the latest certificate of the registration or renewal of registration of such premises, and every such person who fails so to deliver or send such certificate within seven days after such demand shall be guilty of an offence under this section and shall be liable on summary conviction thereof to an excise penalty of twenty pounds.
Provisions as to joint registered proprietors.
18.—(1) Two or more licensed bookmakers may be registered in the register of bookmaking offices as joint proprietors of any premises registered in that register.
(2) Whenever a licensed bookmaker becomes a proprietor jointly with the registered proprietor or proprietors of any registered premises, the Revenue Commissioners shall, on proof to their satisfaction of the facts and of the consent of the registered proprietor or proprietors, enter such licensed bookmaker in the register of bookmaking offices as a registered proprietor of the said premises jointly with the person or persons already registered as such proprietor or proprietors.
(3) Whenever one of the several joint registered proprietors of any registered premises ceases to be one of the proprietors of such premises the Revenue Commissioners shall, on proof to their satisfaction of the facts and of the consent of the other registered proprietors or proprietor, remove the name of the first-mentioned registered proprietor from the portion of the register of bookmaking offices which relates to such premises.
Business permitted in registered premises.
19.—(1) It shall be lawful for the registered proprietor of registered premises, so long as he continues to be a licensed bookmaker, to carry on in such premises the business of bookmaking subject to the provisions of this Act.
(2) No person except the registered proprietor of the premises shall carry on any trade, profession, or business whatsoever in any registered premises.
(3) The registered proprietor of registered premises shall not carry on nor permit to be carried on in such premises nor permit such premises to be used for the purpose of carrying on any trade, profession or business whatsoever save and except only the business of bookmaking carried on by the registered proprietor.
(4) The Betting Houses Act, 1853, shall not apply to registered premises.
(5) Every person who carries on or permits to be carried on in any registered premises or permits any registered premises to be used for carrying on any trade, profession or business in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds or at the discretion of the court to imprisonment for a term not exceeding three months.
Certain restrictions on the use of registered premises.
20.—(1) The registered proprietor of registered premises shall not set up or maintain in or outside such premises any attraction (other than the mere carrying on of his business of bookmaking) which causes or encourages or is likely to cause or encourage persons to congregate in or outside such premises.
(2) The registered proprietor of registered premises shall not permit overcrowding or loitering in such premises.
(3) The registered proprietor of registered premises shall not proclaim or announce or permit any other person to proclaim or announce in such premises to the persons there present the terms or odds on or at which he is willing to take bets in relation to any particular race, match, or other contest, or in respect of any competitor in any such contest.
(4) The registered proprietor of registered premises shall not exhibit or permit to be exhibited in or outside such premises so as to be seen from the street any lists or statements of the terms or odds on or at which he is willing to take bets in relation to any particular race, match, or other contest, or in respect of any competitor in any such contest, or lists or statements of the competitors entered for or withdrawn from or taking or likely to take part in any such contest, or statements of facts, news, or forecasts in respect of any such contest, or any other incitement or inducement to bet.
(5) On any day on which a horse race-meeting is held in Saorstát Eireann, Northern Ireland, or Great Britain, the registered proprietor of registered premises shall not, during the period between the time fixed for the starting of the first race on that day at such race-meeting and the expiration of one-quarter of an hour after the time fixed for the starting of the last race on that day at such race-meeting, make or permit to be made in such premises any payment in respect of moneys won on any bet made with such registered proprietor in relation to a race run on that day at such race-meeting.
(6) Every registered proprietor who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.
Hours of business in registered premises.
21.—(1) Registered premises shall not be opened or kept open for the transaction of business at any time on any Sunday, Christmas Day, or Good Friday, nor before the hour of nine o'clock in the morning nor after the hour of six o'clock in the afternoon on any other day.
(2) If and whenever any registered premises are opened or kept open in contravention of this section the registered proprietor of such premises shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
Prohibition of bets under one shilling.
22.—(1) It shall not be lawful for a licensed bookmaker to make, take, or enter into a bet of a lesser amount than one shilling.
(2) Every licensed bookmaker who makes, takes, or enters into a bet in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(3) For the purposes of this section the amount of a bet shall be taken to be the sum of money which by the terms of the bet the licensed bookmaker will be entitled to receive, retain, or take credit for if the event the subject of the bet is determined in his favour.
Prohibition of betting with persons under the age of eighteen.
23.—(1) No licensed bookmaker shall make a bet or engage in a betting transaction with a person under the age of eighteen years whether such person is acting on his own behalf or as agent for another person.
(2) No registered proprietor of registered premises shall permit any person under the age of eighteen years (other than persons ordinarily resident on such premises and officers of the Minister for Posts and Telegraphs entering such premises in the course of their duty as such officers) to enter or be on such premises.
(3) Every person who does any act (whether of commission or omission) which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds.
(4) Where a person is charged with having committed an offence under this section it shall be a good defence to such charge to prove that the person so charged believed and had reasonable cause for believing that the person in respect of whom such offence is alleged to have been committed was of or over the age of eighteen years.
Display of certificate of registration.
24.—(1) Every registered proprietor of registered premises shall cause the certificate of registration or, where such registration has been renewed, the latest certificate of renewal of registration of those premises to be displayed prominently in the said premises at all times during which such premises are open for the transaction of business.
(2) Every registered proprietor who fails to comply with this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds together with, in the case of a continuing offence, a further fine not exceeding ten pounds for every day during which the offence continues.
Production of bookmakers' licences on demand.
25.—(1) Any officer of customs and excise or any member of the Gárda Síochána may demand of any person whom he observes to be engaged in or carrying on the business of bookmaking the production of his bookmaker's licence, and if such person refuses or fails to produce such licence or produces such licence but refuses or fails to permit such officer or member to read and examine such licence he shall be guilty of an offence under this section.
(2) Whenever any person of whom the production of his bookmaker's licence is lawfully demanded under this section refuses or fails to produce such licence or produces such licence but fails or refuses to permit the officer of customs and excise or the member of the Gárda Síochána making the demand to read and examine such licence, such officer or member may demand of such person his name and address and if such person refuses or fails to give his name or fails or refuses to give his address or gives a name or an address which is false or misleading he shall be guilty of an offence under this section.
(3) Any member of the Gárda Síochána may arrest without warrant—
(a) any person who, when the production of his bookmaker's licence is lawfully demanded of him under this section, refuses or fails to produce such licence or produces such licence but refuses or fails to permit the officer of customs and excise or the member of the Gárda Síochána making the demand to read and examine such licence, or
(b) any person who, when his name and address is lawfully demanded of him under this section, refuses or fails to give his name or refuses or fails to give his address or gives a name or an address which is known to the officer of customs and excise or the member of the Gárda Síochána making the demand to be false or misleading.
(4) Any person guilty of an offence under this section shall be liable on summary conviction thereof to an excise penalty of twenty pounds.
(5) A person who, when the production of his bookmaker's licence is lawfully demanded of him under this section, does not produce such licence because he is not a licensed bookmaker shall be deemed to fail to produce his bookmaker's licence within the meaning of this section.
Powers of entry and investigation.
26.—(1) Any officer of customs and excise or any member of the Gárda Síochána may enter any registered premises at any time during which such premises are or are suspected by such officer or member of being open for the transaction of any business, and may there make such searches and investigations as such officer or member shall think proper and may ask of any person found in such premises such questions in relation to the said premises and the business carried on therein as such officer or member shall think proper.
(2) Any officer of customs and excise may at any time enter any premises (not being registered premises) in which the business of bookmaking is being carried on, or in which such officer suspects that such business is being carried on and may there make such searches and investigations as such officer shall think proper and may demand of any person found in such premises his name and address and may ask of any such person such questions in relation to such premises and the business carried on therein as such officer shall think proper.
(3) Every person who shall do any of the following things, that is to say:—
(a) obstruct or impede any officer of customs and excise or any member of the Gárda Síochána in the exercise of any of the powers conferred on such officer or member by this section; or
(b) fail or refuse to answer to the best of his knowledge and ability any question asked of him by any such officer or member in exercise of a power in that behalf conferred by this section; or
(c) give an answer to any such question which is to his knowledge false or misleading; or
(d) when his name or his address is demanded of him by any such officer or member in exercise of a power in that behalf conferred by this section fail or refuse to give his name, or fail or refuse to give his address, or give a name or an address which is false or misleading,
shall be guilty of an offence under this section and shall be liable on summary conviction thereof to an excise penalty of twenty pounds.
(4) Any member of the Gárda Síochána may arrest without warrant any person who does in his presence any act (whether of commission or omission) the doing of which is declared by this section to be an offence under this section.
Saving for bookmakers' assistants.
27.—(1) In addition and without prejudice to any provision of this Act permitting the registered proprietor of registered premises to employ clerks and assistants, it shall be lawful for a licensed bookmaker to employ any person as his assistant provided the following provisions are complied with, that is to say:—
(a) the person so employed was employed as his clerk or assistant on the 1st day of March, 1931, or is of or over the age of eighteen years, and
(b) such person acts as assistant to such licensed bookmaker only in either the personal presence of such licensed bookmaker or in registered premises of which such licensed bookmaker is the registered proprietor, and
(c) the remuneration of such person is not wholly or partly dependent on or calculated by reference to the amount of business done or profits made by such licensed bookmaker, and
(d) such person does not do for or on behalf of or as assistant to such licensed bookmaker any act the doing of which would render such person liable under this section to be deemed to be himself acting as a bookmaker within the meaning of this Act.
(2) A person who does any of the following acts for or on behalf of or as assistant to or clerk of a licensed bookmaker, that is to say:—
(a) invites or solicits persons to make bets with himself or with such licensed bookmaker, or
(b) announces the terms or odds on or at which he himself or such licensed bookmaker is willing to take bets in relation to any race, match, or other contest or in relation to any competitor in any such contest, or
(c) takes, makes, or negotiates any bet whether he purports so to do on his own behalf or on behalf of such licensed bookmaker,
shall, if such act is done elsewhere than on registered premises of which such licensed bookmaker is the registered proprietor, be deemed to be acting himself as a bookmaker within the meaning of this Act.
(3) A person who is employed by a licensed bookmaker as his assistant and whose employment is lawful by virtue of this section shall not be deemed to act or carry on business as a bookmaker within the meaning of this Act merely by reason of his being employed and acting as such assistant.
Saving for clerks and assistants in registered premises.
28.—(1) In addition and without prejudice to any provision of this Act permitting a licensed bookmaker to employ an assistant, it shall be lawful for the registered proprietor of registered premises to employ in those premises such clerks and assistants (being persons who are of or over the age of eighteen years or who were employed in such premises by such licensed bookmaker on the 1st day of March, 1931) as shall be reasonably necessary for the carrying on of his business of bookmaking in the said premises provided the amount of the respective remunerations of such clerks and assistants is not wholly or partly dependent on or calculated by reference to the amount of business done or profits made by such registered proprietor.
(2) A person who is employed by the registered proprietor of registered premises as a clerk or assistant in those premises and whose employment as such clerk or assistant is lawful by virtue of this section shall not be deemed to act or carry on business as a bookmaker within the meaning of this Act merely by reason of his acting as such clerk or assistant.
Persons under eighteen years in betting offices.
29.—(1) It shall not be lawful for any person to send or bring into any registered premises any person under the age of eighteen years other than persons ordinarily resident in such premises and officers of the Minister for Posts and Telegraphs entering such premises in the course of their duty as such officers.
(2) Every person (other than the registered proprietor of the registered premises concerned) who sends or brings any person into registered premises in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding fifty pounds or, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Loitering near registered premises.
30.—(1) Every person who stands or loiters outside or near any registered premises after he has been requested by a member of the Gárda Síochána in uniform to move on shall (whether such standing or loitering is or is not an obstruction to traffic) be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds or, at the discretion of the court, to imprisonment for any term not exceeding one month.
(2) A member of the Gárda Síochána in uniform may arrest without warrant a person who fails or refuses to move on when requested under this section by such member so to do.
Penalty for false statement of age.
31.—(1) Every person who by falsely representing himself to be of or over the age of eighteen years either induces a licensed bookmaker to make a bet or enter into a betting transaction with him or induces the registered proprietor of registered premises to permit him to enter or remain in such premises shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(2) Every person who directs, causes or induces any other person to commit an offence under the foregoing sub-section of this section shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
Prohibition of advertisement, etc., relating to betting on football games.
32.—(1) Save as is otherwise provided by this section, it shall not be lawful for any person to write, print, publish or knowingly circulate any advertisement, circular or coupon advocating or inviting or otherwise relating to betting on football games or knowingly to cause or procure, or attempt to cause or procure, any such advertisement, circular or coupon to be written, printed, published or circulated.
(2) Nothing in this section shall render it unlawful for the registered proprietor of registered premises to have and distribute in such premises any advertisement, circular, or coupon relating to the business of bookmaking carried on in such premises (whether in respect of football games or any other event) or for any person to write or print any such advertisement, circular, or coupon for such registered proprietor.
(3) Every person who does any act which is a contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty-five pounds or to imprisonment for any term not exceeding one month and, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds or to imprisonment for any term not exceeding three months.
Prohibition of betting with persons outside Saorstát Eireann.
33.—(1) It shall not be lawful for any person while in Saorstát Eireann to make or enter into or attempt to make or enter into a bet with a person who is then outside Saorstát Éireann or to employ, commission, or instruct or attempt to employ, commission, or instruct any person who is for the time being outside Saorstát Éireann to make or enter into a bet for him or on his behalf.
(2) Every person who makes or enters into or attempts to make or enter into a bet in contravention of this section or who employs, commissions, or instructs any person to make or enter into a bet in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to an excise penalty of one hundred pounds.
(3) Nothing in this section shall render it unlawful for a licensed bookmaker while in Saorstát Eireann to make or enter into a bet with a person who is then outside Saorstát Eireann and does not carry on business as a bookmaker.
Powers of the Minister for Posts and Telegraphs.
34.—(1) The Minister for Posts and Telegraphs may detain any postal packet suspected of containing a communication to which this section applies and shall forward every postal packet so detained to the Revenue Commissioners and those Commissioners may open and examine the packet, and if they find therein any communication to which this section applies may detain the packet and its contents for the purpose of prosecution, and if they find no such communication therein shall close the packet and return the same to the Minister for Posts and Telegraphs who shall forward the packet and its contents by post to the person to whom it was addressed.
(2) Whenever the Minister for Posts and Telegraphs receives for transmission by telegraph a message which appears to be a communication to which this section applies, he may send to the Revenue Commissioners a copy of such message and such information in regard thereto as he shall think fit to send or the Revenue Commissioners may ask for.
(3) The Minister for Posts and Telegraphs may after consultation with the Revenue Commissioners make regulations for the exercise of the powers and the performance of the duties conferred or imposed on him by this section.
(4) This section applies to every communication from a person in Saorstát Éireann (hereinafter called the sender) to a person outside Saorstát Éireann (hereinafter called the addressee) by which the sender purports either on his own behalf or on behalf of another person to make or enter into a bet with the addressee or by which the sender purports to employ, commission, or instruct the addressee to make or enter into a bet for or on behalf of the sender or any other person.
(5) This section in so far as it relates to postal packets shall be read and construed together with the Post Office Acts, 1908 to 1920, and in so far as it relates to telegrams shall be read and construed as one with the Telegraph Acts, 1863 to 1928.
Regulations.
35.—(1) The Minister for Justice may by order make regulations prescribing any matter or thing relating to the District Court, members of the Gárda Síochána, or the Minister for Justice which is in this Act referred to as prescribed or to be prescribed.
(2) The Minister for Finance may by order make regulations prescribing any matter or thing which is in this Act referred to as prescribed or to be prescribed and is not authorised by this Act to be prescribed by regulations made by the Minister for Justice.
Expenses.
36.—All expenses incurred in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
37.—The several enactments specified in the Schedule to this Act are hereby repealed to the extent mentioned in the third column of the said Schedule.
Short title and commencement.
38.—(1) This Act may be cited as the Betting Act 1931.
(2) This Act shall come into operation on such day as the Minister shall by order appoint.
