1.—Féadfar an tAcht Tora Déiríochta, 1931, do ghairm den Acht so, agus féadfar na hAchtanna Tora Déiríochta, 1924 go 1931, do ghairm de sna hAchtanna Tora Déiríochta, 1924 agus 1927, agus den Acht so le chéile.
Mínithe.
2.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Talmhaíochta:
cialluíonn an abairt “an Príomh-Acht” an tAcht Tora Déiríochta, 1924 (Uimh. 58 de 1924);
tá an bhrí sin leis an bhfocal “im” atá leis sa Phríomh-Acht;
cialluíonn an abairt “dílseánach cláruithe” duine is dílseánach cláruithe do réir bhrí an Phríomh-Achta ar áitreabh atá cláruithe i gclár ar bith a choimeádann an tAire do réir an Phríomh-Achta;
cialluíonn an abairt “trádálaí ime” duine dheineann, mar thrádáil no chun brabúis, an gnó san im do dhíol ina mhór-choda no ina mhion-choda i dteanta no d'éamais aon ghnótha eile;

CUID II.
Eolas do Bhailiu agus d'Fhoillsiu i dtaobh Ime bheidh a Choimead ar Laimh.
Cuntaisí i dtaobh ime ar láimh.
3.—(1) Féadfaidh an tAire fógra i scríbhinn (dá ngairmtear fógra um chuntaisí sa Chuid seo den Acht so) do sheirbheáil ar dhílseánach chláruithe á cheangal ar an dílseánach san na cuntaisí luadhfaidh an tAire sa bhfógra san do choimeád san áitreabh cláruithe dar dílseánach cláruithe é i dtaobh an ime go léir a dheineann no do gheibheann sé no chuireann sé dá láimh.
(2) Féadfaidh an tAire fógra i scríbhinn (agus gairmtear fógra um chuntaisí de sin freisin sa Chuid seo den Acht so) do sheirbheáil ar thrádálaí ime á cheangal ar an trádálaí sin na cuntaisí luadhfaidh an tAire sa bhfógra san do choimeád san áitreabh ina ndeineann sé gnó mar thrádálaí ime i dtaobh an ime go léir do gheibheann sé no chuireann sé dá láimh.
(3) Féadfaidh an tAire fógra i scríbhinn (agus gairmtear fógra um chuntaisí de sin freisin sa Chuid seo den Acht so) do sheirbheáil ar stórálaí á cheangal ar an stórálaí sin na cuntaisí luadhfaidh an tAire sa bhfógra san do choimeád san áitreabh ina ndeineann sé gnó mar stórálaí i dtaobh an ime go léir a cuirtear isteach san áitreabh san no a tógtar amach as.
(4) Pé uair a seirbheálfar fógra fén alt so ar dhuine ar bith beidh sé de dhualgas ar an duine sin na cuntaisí do choimeád a cheanglóidh an fógra san air do choimeád.
(5) Féadfaidh cigire gach cuntas a bheidh á choimeád do réir an ailt seo d'iniúchadh gach tráth réasúnta, agus nuair a hiarrfar iad agus chun go n-iniúchfaidh an cigire sin iad beidh sé de dhualgas ar an té dhlighfidh fén alt so an cuntas san do choimeád an cuntas san do thaisbeáint agus fós gach billín, nóta consighneachta, admháil agus scríbhinn eile (ar a n-áirmhítear cóipeanna dhíobh i gcás gan iad féin do bheith ar fáil) a iarrfaidh an cigire sin go réasúnta chun féachaint an fíor aon iontráil áirithe sa chuntas san no cad fé ndeár éinní áirithe do bheith fágtha amach as.
(6) Más rud é—
(a) go dteipfidh ar éinne cuntas do choimeád no a chur fé ndeár cuntas do choimeád den tsórt go gceanglann an t-alt so air é do choimeád no a chur fé ndeár é do choimeád, no
(b) maidir le haon chuntas, scríbhinn, no cóip de scríbhinn a cheanglann an t-alt so ar éinne do thaisbeáint, go dteipfidh ar an duine sin é do thaisbeáint no a chur fé ndeár é do thaisbeáint, nuair a hiarrfar san air, chun go n-iniúchfaidh cigire é, no go gcuirfe sé cosc le haon chigire agus é ag déanamh an iniúchta san, no
(c) go ndéanfaidh éinne no go gcuirfe sé fé ndeár, go toiliúil no tré fhaillí, aon iontráil a bheidh bréagach no mí-threorach in aon phonc táchtach do chur sa chuntas san,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche punt do chur air.
(7) Chun crícheanna an ailt seo—
(a) folóidh iniúchadh cuntais no scríbhinne cóipeanna do dhéanamh de no sleachta do thógaint as, agus
(b) cialluíonn an focal “cigire” duine go n-údarás ón Aire i scríbhinn na comhachta bronntar ar chigire leis an alt so d'fheidhmiú.
Cuntaisí do thabhairt ar im a bheidh á choimeád ar láimh.
4.—(1) Féadfaidh an tAire fógra i scríbhinn (dá ngairmtear fógra um chuntaisí do thabhairt san Acht so) do sheirbheáil ar aon dílseánach cláruithe á cheangal ar an dílseánach san (pe'ca seirbheáladh fógra um chuntaisí air roimhe sin no nár seirbheáladh) gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) pé cuntas no cuntaisí orduithe luadhfar sa bhfógra san (agus gach cuntas acu sa bhfuirm a hordófar do agus na mion-innste sin ann a hordófar do chur ann) do thabhairt, maidir leis an áitreabh a luadhfar sa bhfógra san, don Aire, laistigh de thrí lá tar éis an fhógra san do sheirbheáil, i dtaobh an méid ime (má b'ann do) do bhí á choimeád ar láimh aige no bhí i stór aige do dhaoine eile ar an dáta luadhfar chuige sin sa bhfógra san;
(b) go dtí go n-ordóidh an tAire a mhalairt, pé cuntas no cuntaisí orduithe luadhfar sa bhfógra san (agus gach cuntas acu sa bhfuirm a hordófar do agus na mioninnste sin ann a hordófar do chur ann) do thabhairt, maidir leis an áitreabh a luadhfar sa bhfógra san, don Aire laistigh de thrí lá tar éis deireadh gach tréimhse orduithe chríochnóidh tar éis dáta na seirbheála san—
(i) i dtaobh an méid ime (má b'ann do) bhí á choimeád ar láimh aige no bhí i stór aige do dhaoine eile an chéad lá agus an lá deiridh den tréimhse sin; agus
(ii) i dtaobh an méid ime (má b'ann do) do rinne no do fuair sé no do chuir sé dá láimh i gcaitheamh na tréimhse sin; agus
(iii) i dtaobh an méid ime (má b'ann do), de chuid daoine eile, do cuireadh i stór agus do tógadh as i gcaitheamh na tréimhse sin.
(2) Féadfaidh an tAire fógra i scríbhinn (agus gairmtear fógra um chuntaisí do thabhairt de sin freisin san Acht so) do sheirbheáil ar aon trádálaí ime á cheangal ar an trádálaí sin (pe'ca seirbheáladh fógra um chuntaisí air roimhe sin no nár seirbheáladh) gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) cuntas sa bhfuirm orduithe do thabhairt don Aire laistigh de thrí lá tar éis an fhógra san do sheirbheáil, agus na mion-innste orduithe ann, ar an méid ime (má b'ann do) do bhí á choimeád ar láimh aige ar an dáta luadhfar chuige sin sa bhfógra san;
(b) go dtí go n-ordóidh an tAire a mhalairt, cuntas sa bhfuirm orduithe agus na mion-innste orduithe ar na nithe seo leanas ann do thabhairt don Aire laistigh de thrí lá tar éis deireadh gach tréimhse orduithe chríochnóidh tar éis dáta na seirbheála san:—
(i) an méid ime (má b'ann do) do bhí á choimeád ar láimh aige an chéad lá agus an lá deiridh den tréimhse sin, agus
(ii) an méid ime (má b'ann do) do fuair sé no do chuir sé dá láimh i gcaitheamh na tréimhse sin.
(3) Féadfaidh an tAire fógra i scríbhinn (agus gairmtear fógra um chuntaisí do thabhairt de sin freisin san Acht so) do sheirbheáil ar aon stórálaí á cheangal ar an stórálaí sin (pe'ca seirbheáladh fógra um chuntaisí air roimhe sin no nár seirbheáladh) gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) cuntas sa bhfuirm orduithe do thabhairt don Aire laistigh de thrí lá tar éis an fhógra san do sheirbheáil, agus na mion-innste orduithe ann, ar an méid ime (má b'ann do) do bhí á choimeád i stór aige ar an dáta luadhfar chuige sin sa bhfógra san;
(b) go dtí go n-ordóidh an tAire a mhalairt, cuntas sa bhfuirm orduithe agus na mion-innste orduithe ar na nithe seo leanas ann do thabhairt don Aire laistigh de thrí lá tar éis deireadh gach tréimhse orduithe chríochnóidh tar éis dáta na seirbheála san:—
(i) an méid ime (má b'ann do) do bhí á choimeád i stór aige an chéad lá agus an lá deiridh den tréimhse sin, agus
(ii) an méid ime (má b'ann do) do cuireadh isteach ina stóras agus do tógadh amach as i gcaitheamh na tréimhse sin.
(4) Má dhiúltuíonn éinne ar a seirbheálfar fógra um chuntaisí do thabhairt fén alt so do chuntas no cuntaisí do thabhairt uaidh do réir an fhógra san no má thugann sé faillí ann no má thugann sé uaidh cuntas a bheidh bréagach no mí-threorach in aon phonc táchtach, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche punt do chur air.
Fógraí do sheirbheáil.
5.—Féadfar fógra um chuntaisí no fógra um chuntaisí do thabhairt do sheirbheáil tré n-a sheachadadh don té chun a mbeidh sé dírithe no tré n-a fhágaint ag duine os cionn sé mblian déag d'aois san áitreabh ina mbíonn a ghnó ar siúl ag an té chun a mbeidh sé dírithe no tré n-a chur tríd an bpost cláruithe, chun an té chun a mbeidh sé dírithe, go dtí an t-áitreabh ina mbíonn a ghnó ar siúl aige.
Eolas d'fhoillsiú i dtaobh ime ar láimh.
6.—(1) Féadfaidh an tAire o am go ham eolas (le n-a n-áirítear eolas do gheobhfar o chuntaisí do tugadh do réir fógra um chuntaisí do thabhairt) d'fhoillsiú i dtaobh an méid ime bheidh á choimeád ar láimh agus curtha i stór i Saorstát Éireann o am go ham.
(2) Ní déanfar aon chuntas áirithe ná cuid áirithe de chuntas do bhéarfar do réir fógra um chuntaisí do thabhairt d'fhoillsiú ná do nochtadh ach amháin chun cúisimh do dhéanamh.
Ciontaí.
7.—Féadfaidh an tAire mar chúisitheoir no féadfar ar agra an Aire mar chúisitheoir cúiseamh do dhéanamh i ngach cionta déanfar fé aon fhoráil den Chuid seo den Acht so.
Rialacháin.
8.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh i dtaobh éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no á ordú no le hordú.
(2) Gach rialachán a dhéanfaidh an tAire fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh den Oireachtas, laistigh den lá is fiche shuidhfidh an Tigh sin ina dhiaidh sin, rún do rith ag cur an rialacháin sin ar nea-mbrí, beidh an rialachán san curtha ar nea-mbrí dá réir sin, ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén rialachán san.
Costaisí.
9.—Sa mhéid go gceadóidh an tAire Airgid é is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas a bhainfidh leis an gCuid seo den Acht so do chur in éifeacht.
CUID III.
Tearma Ceadunaisi Airithe do chur i bhfaid.
Téarma ceadúnaisí fé alt 42 den Phríomh-Acht do chur i bhfaid.
10.—Gach ceadúnas do deonadh fé fho-alt (2) d'alt 42 den Phríomh-Acht agus do bhí i bhfeidhm, de bhuadh ailt 1 den Acht Tora Déiríochta (Leasú), 1927 (Uimh. 35 de 1927), ar an 17adh lá de Mhí na Nodlag, 1930, tuigfear é bheith i bhfeidhm go dtí am an Achta so do rith agus, má bhí an t-áitreabh le n-a mbaineann an ceadúnas san cláruithe i gclár na n-easportálaithe ndéantóireachta le linn an Achta so do rith, fanfaidh an ceadúnas san i bhfeidhm go dtí an 31adh lá de Mhárta, 1934, ach go dtí an dáta san leanfa sé de bheith fé réir agus i mbaol an Aire dá cheiliúradh mar is dóich leis agus nuair is dóich leis gur ceart é.

DAIRY PRODUCE ACT, 1931.
PART I.
Preliminary.
Short title and citation.
1.—This Act may be cited as the Dairy Produce Act, 1931, and the Dairy Produce Acts, 1924 and 1927, and this Act may be cited together as the Dairy Produce Acts, 1924 to 1931.
Definitions.
2.—In this Act—
the expression “the Minister” means the Minister for Agriculture;
the expression “the Principal Act” means the Dairy Produce Act, 1924 (No. 58 of 1924);
the word “butter” has the meaning assigned to it by the Principal Act;
the expression “registered proprietor” means a person who is the registered proprietor within the meaning of the Principal Act of premises registered in any register kept by the Minister in pursuance of the Principal Act;
the expression “butter trader” means a person who carries on for trade or gain, whether alone or in conjunction with any other business, the business of selling, by wholesale or retail, butter;
the word “warehouseman” means a person who carries on for trade or gain the business of warehousing goods for other persons;
the word “prescribed” means prescribed by regulations made under Part II of this Act.
PART II.
Collection and Publication of Information in Relation to Butter Held in Stock.
Records of butter in stock.
3.—(1) The Minister may serve a notice in writing (in this Part of this Act referred to as a records notice) on a registered proprietor requiring such proprietor to keep on the registered premises of which he is the registered proprietor such records as the Minister shall specify in such notice of all butter manufactured, acquired or disposed of by him.
(2) The Minister may serve a notice in writing (in this Part of this Act also referred to as a records notice) on a butter trader requiring such trader to keep on the premises where he carries on the business of butter trader such records as the Minister shall specify in such notice of all butter acquired or disposed of by him.
(3) The Minister may serve a notice in writing (in this Part of this Act also referred to as a records notice) on a warehouseman requiring such warehouseman to keep on the premises where he carries on the business of warehouseman such records as the Minister shall specify in such notice of all butter put into or taken out of the said premises.
(4) Whenever a notice has been served under this section on any person, it shall be the duty of such person to keep such records as he is required by such notice to keep.
(5) Every record kept in pursuance of this section may be inspected at all reasonable times by an inspector, and it shall be the duty of the person liable under this section to keep such record to produce for the inspection of such inspector on demand such record and also all invoices, consignment notes, receipts and other documents (including copies thereof where the originals are not available) reasonably demanded by such inspector for the purpose of verifying any entry in or explaining any omission from such record.
(6) If any person—
(a) fails to keep or cause to be kept such record as is required by this section to be kept or caused to be kept by him, or
(b) fails to produce or cause to be produced for inspection by an inspector on demand any record, document, or copy of a document which he is required by this section to produce or obstructs any inspector in the making of such inspection, or
(c) wilfully or negligently makes or causes to be made in such record any entry which is false or misleading in any material particular,
he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(7) For the purposes of this section—
(a) inspection of a record or document shall include taking copies thereof or extracts therefrom, and
(b) the word “inspector” means a person authorised in writing by the Minister to exercise the powers conferred on an inspector by this section.
Returns of butter held in stock.
4.—(1) The Minister may serve a notice in writing (in this Act referred to as a returns notice) on any registered proprietor requiring such proprietor (whether he has or has not been previously served with a records notice) to do either or both of the following things, that is to say:—
(a) to make in respect of the premises specified in such notice to the Minister within three days after the service of such notice such prescribed return or returns (each such return being in the form and containing the particulars prescribed in respect thereof) as may be specified in such notice in relation to the amount of butter (if any) held in stock by him or stored for other persons on the date in that behalf specified in such notice;
(b) until the Minister otherwise directs, to make in respect of the premises specified in such notice to the Minister within three days after the expiration of every prescribed period ending after the date of such service such prescribed return or returns (each such return being in the form and containing the particulars prescribed in respect thereof) as may be specified in such notice in relation to—
(i) the amount of butter (if any) held in stock by him or stored for other persons, on the first and last days of such period; and
(ii) the amount of butter (if any) manufactured or acquired or disposed of by him during such period; and
(iii) the amount of butter (if any) being the property of other persons put into and taken out of store during such period.
(2) The Minister may serve a notice in writing (in this Act also referred to as a returns notice) on any butter trader, requiring such trader (whether he has or has not been previously served with a records notice) to do either or both of the following things, that is to say:—
(a) to make to the Minister within three days after the service of such notice a return in the prescribed form and containing the prescribed particulars of the amount of butter (if any) held in stock by him on the date in that behalf specified in such notice;
(b) until the Minister otherwise directs, to make to the Minister within three days after the expiration of every prescribed period ending after the date of such service a return in the prescribed form and containing the prescribed particulars in relation to—
(i) the amount of butter (if any) held in stock by him on the first and last days of such period, and
(ii) the amount of butter (if any) acquired or disposed of by him during such period.
(3) The Minister may serve a notice in writing (in this Act also referred to as a returns notice) on any warehouseman requiring such warehouseman (whether he has or has not been previously served with a records notice) to do either or both of the following things, that is to say:—
(a) to make to the Minister within three days after the service of such notice a return in the prescribed form and containing the prescribed particulars of the amount of butter (if any) held in store by him on the date in that behalf specified in such notice;
(b) until the Minister otherwise directs, to make to the Minister within three days after the expiration of every prescribed period ending after the date of such service a return in the prescribed form and containing the prescribed particulars in relation to—
(i) the amount of butter (if any) held in store by him on the first and last days of such period, and
(ii) the amount of butter (if any) put into and taken on the first and last days of such period, and
(4) If any person on whom a returns notice is served under this section either refuses or neglects to make a return or returns in accordance with such notice or makes a return which is false or misleading in any material respect, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Service of notices.
5.—A records notice or a returns notice may be served by delivering it to the person to whom it is addressed or by leaving it with a person over the age of sixteen years at the premises where the person to whom it is addressed carries on business or by sending it by registered post to the person to whom it is addressed at the premises where he carries on business.
Publication of information of stocks of butter.
6.—(1) The Minister may, from time to time, publish information (including information derived from returns made in pursuance of a returns notice) with respect to the amount of butter from time to time held in stock and stored in Saorstát Eireann.
(2) No individual return or part of a return furnished in pursuance of a returns notice shall be published or disclosed except for the purpose of a prosecution.
Offences.
7.—Every offence under any provision of this Part of this Act may be prosecuted by or at the suit of the Minister as prosecutor.
Regulations.
8.—(1) The Minister may by order make regulations in regard to any matter or thing referred to in this Act as prescribed, or as being or to be prescribed.
(2) Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat annulling such regulation, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Expenses.
9.—All expenses of carrying this Part of this Act into effect shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
PART III.
Extension of Certain Licences.
Extension of licences under section 42 of the Principal Act.
10.—Every licence granted under sub-section (2) of section 42 of the Principal Act and in force, by virtue of section 1 of the Dairy Produce (Amendment) Act, 1927 (No. 35 of 1927), on the 17th day of December, 1930, shall be deemed to have remained in force until the passing of this Act and shall, if the premises to which such licence relates were registered in the register of manufacturing exporters on the passing of this Act, remain in force until the 31st day of March, 1934, but shall continue until that date to be subject and liable to revocation by the Minister as and when he thinks proper.
