ACHT NA nÚDARÁS nÁITIÚIL (COMHAR-ÁRACHAS), 1926.
Míniú.
1.—San Acht so cialluíonn agus foluíonn an focal “údarás áitiúil” na cóluchtaí agus na daoine seo a leanas, sé sin le rá:—
(a) comhairle chontae, chontae-bhuirge, bhuirge, bhailecheanntair, no thuathcheanntair, agus
(b) bord caomhnóirí, agus
(c) údarás sláintíochta puirt, agus
(d) coimisinéirí baile, agus
(e) aon chólucht, daoine, no duine a bunuíodh no a ceapadh le haon reacht, no fé, chun feidhmeanna no aon cheann d'fheidhmeanna aon chomhairle, búird, údaráis, no coimisinéirí den tsórt san roimhráite d'fheidhmiú, agus
(f) coiste no có-choiste d'aon cheann no cinn no do ceapadh ag aon cheann no cinn de sna comhairlí, búird, coimisinéirí, cóluchtaí, no daoine sin, agus
(g) comhlachas d'aon chomhairlí, búird, coimisinéirí, cóluchtaí, daoine no coistí den tsórt san, a bunuíodh agus a cimeádtar ar bun chun crícheanna a bhaineann le rialtas áitiúil amháin.
Cuideachtana le n-a mbaineann an tAcht so.
2.—Baineann an tAcht so le gach cuideachtain atá cláruithe i Saorstát Éireann fén Companies (Consolidation) Act, 1908, agus atá do réir na gcoiníoll so a leanas, sé sin le rá:—
(a) caithfidh gan a bheith in iomlán cuspóirí na cuideachtan no sa chuid is mó dhíobh ach ní no an dá ní acu so a leanas, sé sin le rá:—
(i) a baill do chur fé chomhar-árachas in aghaidh damáiste a dhéanfadh teine no do thiocfadh de dheascaibh teine do thithe no do mhaoin eile is leo no atá ar seilbh acu, agus
(ii) a baill do chur fé chomhar-árachas in aghaidh fiachais in íoc cúitimh no damáiste le fir oibre do bheadh ar fostú acu, agus
(b) caithfidh fiachas a ball do bheith teoranta le hurraíocht agus caithfidh an méid go raghaidh aon bhall aonair in urrús air gan dul thar dheich bpúint, agus
(c) caithfidh scair-chaipital gan bheith ag an gcuideachtain, agus
(d) caithfidh gach ball den chuideachtain do bheith ina údarás áitiúil.
Údaráis áitiúla ag ceangal mar bhaill de chuideachtain.
3.—(1) Féadfidh údarás áitiúil cabhrú chun cuideachta do bhunú 'na bhfuil sé ceaptha an tAcht so do bheith ag baint léi agus féadfidh aon údarás áitiúil ceangal mar bhall agus bheith mar bhall de chuideachtain le n-a mbaineann an tAcht so.
(2) Nuair a bheidh údarás áitiúil mar bhall de chuideachtain le n-a mbaineann an tAcht so, féadfidh duine dá mbaill no dá n-oifigigh no éinne eile 'na mbeidh údarás aige uatha chuige sin an ceart vótála agus gach ceart no comhacht eile a bhaineann leis an mballraíocht san d'fheidhmiú thar cheann an údaráis áitiúla san.
(3) Féadfidh údarás áitiúil is ball de chuideachtain le n-a mbaineann an tAcht so bheith ina stiúrthóir ar an gcuideachtain sin agus i ngach eás den tsórt san isé a fheidhmeoidh na feidhmeanna a bheidh ag an údarás áitiúil mar stiúrthóir den tsórt san ná duine dá mbaill no dá n-oifigigh no éinne eile 'na mbeidh údarás aige uatha chuige sin.
(4) Féadfidh údarás áitiúil liúntas cothuithe agus costaisí taistil d'íoc do réir rialachán a dhéanfidh an tAire Rialtais Áitiúla agus Sláinte Puiblí le héinne dá mbaill no dá n-oifigigh a bheidh i láthair, thar cheann an údaráis áitiúla san, ag aon chruinniú de bhunathóirí, de bhaill no de stiúrthóirí cuideachtan le n-a mbaineann an tAcht so.
Saoirse ón oblagáid chun éarlaisí do chur síos.
4.—An méid d'fhorálacha an Assurance Companies Act, 1909, a bhaineann le héarlaisí fén Acht san, ní bhainfid leis an gcás maidir le gnó teine-árachais ná le gnó fiachais fostóirí a bheidh ar siúl ag cuideachtain a chuirfidh ina luighe ar an Aire Tionnscail agus Tráchtála go bhfuil na coiníollacha uile a horduítear le halt 2 den Acht so cólíonta aici.
Costaisí údarás áitiúil.
5.—Aon chostaisí fé n-a raghaidh údarás áitiúil fén Acht so is mar chuid de sna costaisí generálta a bhí ar an údarás áitiúil sin ag cólíona a ndualgaisí a glanfar agus a híocfar iad.

LOCAL AUTHORITIES (MUTUAL ASSURANCE) ACT, 1926.
Definition.
1.—In this Act the expression “local authority” means and includes the following bodies and persons, that is to say:—
(a) the council of a county, county borough, borough, urban district, or rural district, and
(b) a board of guardians, and
(c) a port sanitary authority, and
(d) the commissioners of a town, and
(e) any body, persons, or person established or appointed by or under any statute to perform the functions or any of the functions of any such council, board, authority, or commissioners as aforesaid, and
(f) a committee or joint committee of or appointed by any one or more of such councils, boards, commissioners, bodies, or persons, and
(g) an association of any such councils, boards, commissioners, bodies, persons, or committees, formed and maintained solely for purposes relating to local government.
Companies to which this Act applies.
2.—This Act applies to every company registered in Saorstát Eireann under the Companies (Consolidation) Act, 1908 which complies with the following conditions, that is to say:—
(a) the objects of the company must be wholly or mainly one or both of the following, that is to say:—
(i) the mutual insurance of its members against damage by or incidental to fire caused to the houses or other property owned or occupied by them, and
(ii) the mutual insurance of its members against liability to pay compensation or damages to workmen employed by them, and
(b) the liability of its members must be limited by guarantee and the amount to be guaranteed by any one member must not exceed ten pounds, and
(c) the company must not have a share capital, and
(d) all the members of the company must be local authorities.
Local authorities becoming members of company.
3.—(1) A local authority may join in promoting a company to which it is intended that this Act shall apply and any local authority may become and be a member of a company to which this Act applies.
(2) When a local authority is a member of a company to which this Act applies, the right of voting and every other right or power incidental to such membership may be exercised on behalf of such local authority by one of their members or officers or any other person authorised in that behalf by them.
(3) A local authority which is a member of a company to which this Act applies may be a director of such company and in every such case the functions of the local authority as such director shall be performed by one of their members or officers or any other person authorised in that behalf by them.
(4) A local authority may pay subsistence allowance and travelling expenses in accordance with regulations to be made by the Minister for Local Government and Public Health to any of their members or officers attending on behalf of such local authority any meeting of the promoters, members or directors of a company to which this Act applies.
Exemption from liability to make deposits.
4.—Such of the provisions of the Assurance Companies Act, 1909, as relate to deposits under that Act shall not apply with respect to fire insurance business or employers liability business carried on by a company which satisfies the Minister for Industry and Commerce that it has complied with all the conditions prescribed by section 2 of this Act.
Expenses of local authorities.
5.—Any expenses incurred by a local authority under this Act shall be defrayed and paid as part of the general expenses of such local authority in the performance of its duties.
Short title.
6.—This Act may be cited as the Local Authorities (Mutual Assurance) Act, 1926.
