Léiriú.

1.—San Acht seo—

ciallaíonn an abairt “an Príomh-Acht” an tAcht Staitistíochta, 1926 (Uimh. 12 de 1926);

ciallaíonn an abairt “údarás Stáit” aon údarás acu seo a leanas:—

(a) Aire Stáit,

(b) Coimisinéirí na nOibreacha Poiblí in Éirinn,

(c) Coimisiún na Talún.

Eolas staidrimh a nochtadh do dhaoine údaraithe.

2.—(1) San alt seo folaíonn an abairt “eolas staidrimh”—

(a) lánas nó aon chuid de lánas aon sceidil, foirme nó doiciméide eile áirithe a líon duine ar bith nó a chomhlánaigh sé ar shlí eile de bhun foréilimh arna dhéanamh faoin bPríomh-Acht;

(b) lánas nó aon chuid de lánas aon bhreacacháin nó doiciméide (nach breacachán ná doiciméid atá ar fáil chun a iniúchta ag an bpobal) a ndearna oifigeach staidrimh, i bhfeidhmiú aon chumhachta chuige sin a tugadh dó leis an bPríomh-Acht, é a iniúchadh nó cóip de a dhéanamh nó a fháil; agus

(c) aon eolas nó freagra ó bhéal a tugadh i dtaobh aon duine, gnótha nó gnólachta áirithe.

(2) Más deimhin leis an Aire Tionnscail agus Tráchtála gur gá sin a dhéanamh chun go gcomhlíonfaí go cuí feadhma údaráis Stáit nó coiste, coimisiúin nó bínse fhiosrúcháin arna bhunú ag an Rialtas nó ag údarás Stáit, féadfaidh sé a údarú eolas staidrimh sonraithe a nochtadh do dhaoine sonraithe, is oifigigh don údarás Stáit sin, nó comhaltaí den choiste, den choimisiún nó den bhínse fiosrúcháin sin nó oifigigh dó, do réir mar a bheas, agus air sin beidh éifeacht ag na forála seo a leanas:—

(a) ar aon duine sonraithe den tsórt sin dá iarraidh sin, déanfar, d'ainneoin aon ní in alt 13 den Phríomh-Acht, an t-eolas staidrimh sin a nochtadh dhó;

(b) ní bhainfidh alt 14 den Phríomh-Acht le nochtadh an eolais sin amhlaidh;

(c) má dhéanann duine ar bith, dar nochtadh an t-eolas staidrimh sin de bhun an ailt seo, an t-eolas staidrimh sin nó aon chuid de a fhoilsiú nó é a nochtadh d'aon duine eile, nach duine sonraithe freisin, beidh an duine sin ciontach i gcion faoin alt seo agus ar a chiontú ann ar an slí achomair dlífear fíneáil nach mó ná caoga punt a chur air nó, más rogha leis an gCúirt, príosúntacht ar feadh aon téarma nach sia ná sé mhí nó an fhíneáil sin agus an phríosúntacht sin le chéile.

3.—(1) Féadfar an tAcht Staidrimh (Leasú), 1946, a ghairm den Acht seo.

(2) Féadfar na hAchta Staidrimh, 1926 agus 1946, a ghairm den Phríomh-Acht agus den Acht seo le chéile.

STATISTICS (AMENDMENT) ACT, 1946.

Interpretation.

1.—In this Act—

the expression “the Principal Act” means the Statistics Act, 1926 (No. 12 of 1926);

the expression “State authority” means any authority being—

(a) a Minister of State,

(b) the Commissioners of Public Works in Ireland,

(c) the Land Commission.

Disclosure of statistical information to authorised persons.

2.—(1) In this section the expression “statistical information” comprises—

(a) the contents or any part of the contents of any individual schedule, form or other document filled in or otherwise completed by any person in pursuance of a requisition made under the Principal Act;

(b) the contents or any part of the contents of any record or document (not being a record or document open to public inspection) which was inspected or of which a copy was taken or obtained by an officer of statistics in exercise of any power in that behalf conferred on him by the Principal Act; and

(c) any verbal information or answer given relating to any individual person, business or concern.

(2) Where the Minister for Industry and Commerce is satisfied that it is necessary for the proper discharge of the functions of a State authority or a committee, commission or tribunal of inquiry set up by the Government or by a State authority so to do, he may authorise the disclosure, to specified persons, being officers of that State authority, or members or officers of that committee, commission or tribunal of inquiry, as the case may be, of specified statistical information, and thereupon the following provisions shall have effect:—

(a) such statistical information shall at the request of any such specified person be, notwithstanding anything in section 13 of the Principal Act, disclosed to him;

(b) section 14 of the Principal Act shall not apply to such disclosure;

(c) if any person, to whom such statistical information has been disclosed in pursuance of this section, publishes or discloses to any other person, not being also a specified person, such statistical information or any part thereof, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding six months or to both such fine and imprisonment.

Short title and collective citation.

3.—(1) This Act may be cited as the Statistics (Amendment) Act, 1946.

(2) The Principal Act and this Act may be cited together as the Statistics Acts, 1926 and 1946.
