cialluíonn an focal “orduithe” orduithe le rialacháin ar n-a ndéanamh fén bPríomh-Acht no fén Acht so.

2.—Léighfear agus léireofar an Príomh-Acht agus an tAcht so mar aon Acht amháin, agus dá réir sin ciallóidh an abairt “an tAcht so,” i ngach áit ina bhfuil sé sa Phríomh-Acht, an Príomh-Acht agus an tAcht so á léiriú mar aon Acht amháin, agus (lasmuich de chás dá bhforáltar a mhalairt leis an Acht so) tá le habairtí agus le focail a húsáidtear san Acht so agus a húsáidtear, leis, sa Phríomh-Acht na brigheanna céanna san Acht so atá leo, fé seach, sa Phríomh-Acht.
CUID I.
An Priomh-Acht do Leasu.
Alt 3 den Phríomh-Acht do leasú.
3.—Ní bhainfidh alt 3 den Phríomh-Acht le huibhe do bhéarfaidh no iompróidh feirmeoir no a shearbhóntaí o Shaorstát Éireann go Tuaisceart Éireann agus é ag déanamh a ghnótha mar fheirmeoir.
Alt 4 den Phríomh-Acht do leasú.
4.—(1) Cigire bheidh ag scrúdú aon uibhe no aon phacáiste in aon áit, fé alt 4 den Phríomh-Acht, féadfa sé, i dteanta no in ionad gach ní no éinní dá n-údaruíonn an t-alt san do, gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) aon uibhe do gheobhaidh sé i bpacáiste osclóidh sé fén alt san do scrúdú, agus
(b) an pacáiste a hosclófar amhlaidh do choinneail chó fada agus is gá, go réasúnta, chun an scrúduithe sin do dhéanamh agus fós gach pacáiste no aon phacáiste eile (más ann do) a bheidh ina theanta san chonsighneacht chéanna, agus
(c) ordú i scríbhinn do thabhairt don iompróir, ag toirmeasc gach pacáiste bheidh á choinneail amhlaidh d'easportáil más léir don chigire sin, ar dhéanamh an scrúduithe sin, go ndearnadh sárú no gur tugadh fé shárú do dhéanamh, maidir leis an gconsighneacht san, ar an bPríomh-Acht mar a leasuítear leis an Acht so é no ar an Acht so no ar aon rialachán do rinneadh fé na hAchtanna san no fé cheachtar acu agus, mara mbeidh thar fiche pacáiste sa chonsighneacht san, go mbaineann an sárú san, no an sárú san fé n-ar tugadh, le ceann no níos mó no le gach ceann de sna pacáistí sin no, má bhíonn thar fiche pacáiste sa chonsighneacht san, go mbaineann sé le cúig per cent. ar a laighead de sna pacáistí sa chonsighneacht san.
(2) Pé uair do bhéarfaidh cigire don iompróir fén alt so ordú ag toirmeasc aon phacáiste áirithe ubh d'easportáil, beidh sé de dhualgas ar an gcigire sin, maran leis an iompróir sin an pacáiste sin, a chur in úil do chonsighneoir an phacáiste sin gur tugadh an t-ordú san.
(3) Gach duine dhéanfaidh no do bhéarfaidh iarracht ar aon phacáiste ubh d'easportáil go mbeidh ordú tugtha uaidh ina thaobh ag cigire fén alt so ag toirmease an phacáiste sin d'easportáil, beidh sé ciontach i gcionta fén alt so agus, ar a thiontú ann ar an slí achmair, dlighfear fíneail ná raghaidh thar fiche púnt do chur air.
(4) Pé uair do bhéarfar don iompróir fén alt so ordú ag toirmease pacáiste ubh d'easportáil agus a bheidh an pacáiste sin curtha ar bord luinge i bport i Saorstát Éireann le linn an orduithe sin do thabhairt, ní tuigfear chun críche an ailt seo gurb ionann an pacáiste sin d'iompar ar an luing sin agus an pacáiste sin d'easportáil má chruthuíonn an t-iompróir sin go ndearna sé ina dhiaidh sin, an túisce go raibh caoi aige chuige, an pacáiste sin do thabhairt thar n-ais go dtí an port céanna i Saorstát Éireann agus do chur i dtír ag an bport san agus gur fé chúram an iompróra san amháin a bhí an pacáiste sin agus nár hoscladh é ná nár baineadh leis in aon tslí idir an t-am d'fhág an pacáiste sin an port san agus an t-am do cuireadh i dtír ag an bport san é.
(5) Léireofar alt 4 den Phríomh-Acht agus beidh éifeacht aige fé is dá ndeintí—
(a) na focail “is consighneacht ubh no” do chur isteach tar éis an fhocail “áirithe” i mír (c) d'fho-alt (2) de; agus
(b) na focail “ná moill réasúnta” do chur isteach i bhfo-alt (6) de tar éis an fhocail “damáiste” i ngach áit ina bhfuil an focal san sa bhfo-alt san.
(6) Le linn na gcomhacht a bronntar air leis an alt so do bheith á bhfeidhmiú aige in áitreabh aon chuideachtan bóthair iarainn no loingseoireachta, déanfaidh cigire pé nithe réasúnta iarrfaidh an chuideachta san air agus is gá chun ná cuirfí cosc ar oibriú an tráchta san áitreabh san ná ná déanfaí cur-isteach air.
(7) I ngach áit ina bhfuil an abairt “alt so” in alt 4 den Phríomh-Acht, ciallóidh sé an t-alt san 4 mar a leasúitear é leis an alt so agus chun na críche sin tuigfear gur leasú ar an alt san 4 gach foráil den alt so.

5.—(1) Sara ndéanfaidh an tAire aon áitreabh do chlárú i gclár na n-easportálaithe déanfa sé deimhin de (maraon le deimhin do dhéanamh de sna nithe luaidhtear i bhfo-alt (3) d'alt 7 den Phríomh-Acht) go bhfuil an té atá á iarraidh go gclárófaí an t-áitreabh san, no duine amháin ar a laighead atá ar fostú aige san áitreabh san, oilte ar uibhe do thástáil, do ghrádáil, agus do phacáil do réir an Phríomh-Achta agus do réir rialachán fén Acht san.
(2) Go ceann tréimhse bhliana ón Acht so do rith ní tuigfear, chun crícheanna ailt 10 den Phríomh-Acht, áitreabhacha atá cláruithe i gclár na n-easportálaithe le linn an Achta so do rith agus a leanfaidh de bheith cláruithe amhlaidh do scur de bheith ionchláruithe i gclár na n-easportálaithe toisc gan únaer cláruithe an aitreibh sin ná éinne ar fostú aige san áitreabh san do bheith oilte ar uibhe do thástáil, do ghrádáil, agus do phacáil do réir an Phríomh-Achta agus do réir rialachán fén Acht san.
Réasúin chun diúlta d'áitreabh do chlárú.
6.—Gan dochar d'aon réasún eile chun diúltuithe eireoidh fén bPríomh-Acht no fén Acht so, is réasún maith ceachtar réasún acu so leanas chun an tAire do dhiúlta d'iarratas ar áitreabh do chlárú i gclár na n-easportálaithe no i gclár na leasuitheoirí, sé sin le rá:—
(a) gur deineadh an t-áitreabh san do chlárú amhlaidh roimhe sin agus gur chuir an tAire an clárú san i nea-mbrí, fén bPríomh-Acht no fén Acht so, no
(b) go raibh an té bheidh ag iarraidh an chláruithe sin ina únaer chláruithe roimhe sin ar áitreabh eile do cláruíodh amhlaidh, agus le linn é do bheith ina únaer chláruithe amhlaidh gur chuir an tAire clárú an áitreibh eile sin i nea-mbrí fén bPríomh-Acht no fén Acht so.
Alt 9 den Phríomh-Acht do leasú.
7.—Léireofar fo-alt (8) d'alt 9 den Phríomh-Acht agus beidh éifeacht aige agus tuigfear go raibh éifeacht riamh aige fé is dá gcuirtí na focail “sa chéad bhliain eile tar éis na bliana” isteach ann in ionad na bhfocal “na bliana.”

8.—Pé uair do bhéarfar an bhreith gur duine gnó-bhriste únaer cláruithe aon áitreibh a bheidh cláruithe fén bPríomh-Acht no fén Acht san mar a leasuítear é leis an Acht so, féadfaidh an tAire clárú an áitreibh sin do chur ar nea-mbrí.
Fógra go bhfuiltear chun clárú áitreibh do chur ar neambri.
9.—(1) Roimh atharú no nea-mbríochaint do dhéanamh (ar aon tslí seachas do réir iarratais a déanfar chuige sin fé alt 10 den Príomh-Acht) ar chlárú aon áitreibh fén bPríomh-Acht no fén Acht so, bhéarfaidh an tAire, i scríbhinn, d'únaer chláruithe an áitreibh sin no dá ionadaí phearsanta (más ann do) no do shocruitheoir an áitreibh sin (pe'ca aca é) fógra coicíse ar a laighead go bhfuil sé chun an chláruithe sin d'atharú no do chur ar nea-mbrí amhlaidh agus breithneoidh aon aithris chúise dhéanfaidh an t-únaer cláruithe no an t-ionadaí pearsanta no an socruitheoir sin (pe'ca aca é) sara mbeidh téarma an fhógra san istigh agus féadfaidh, más oiriúnach leis é, a chur fé ndeár go gcomórfar fiosrúchán i dtaobh an scéil.
(2) Féadfar fógra go bhfuil an tAire chun clárú áitreibh fén bPríomh-Acht no fén Acht so d'atharú no do chur ar nea-mbrí do sheirbheáil tré n-a sheachada don té chun a mbeidh sé dírithe no tré n-a fhágaint do le duine os cionn sé mblian déag d'aois san áitreabh le n-a mbaineann sé no tré n-a chur tríd an bpost chun an té chun a mbeidh sé dírithe go dtí an áit chomhnaithe is déanaí is eol a bheith aige.
(3) Athghairmtear leis seo fo-alt (4) d'alt 10 den Phríomh-Acht.

10.—(1) Ní dhéanfaidh éinne marc a bheidh orduithe no ceaptha fé alt 15 den Phríomh-Acht chun a thaisbeaint cadé an t-áitreabh in ar pacáladh uibhe d'úsáid ná do chur ar uibhe ná ar phacáistí ubh ach na daoine seo leanas, sé sin le rá, an té is únaer cláruithe de thurus na huaire ar an áitreabh cláruithe dá mbeidh an marc san orduithe no ceaptha no duine éigin ar fostú ag an únaer san chun na críche sin agus ní bheidh sé dleathach d'éinne eile an marc san d'úsáid ná an marc san do chur ar aon uibhe ná pacáistí ubh.
(2) Ní dhéanfaidh éinne marc a bheidh orduithe fé alt 15 den Phríomh-Acht le cur ar phacáistí ubh chun a thaisbeaint gur i Saorstát Éireann do rugadh na huibhe sin d'úsáid ná do chur ar phacáistí ubh ach na daoine seo leanas, sé sin le rá, an té is únaer cláruithe de thurus na huaire ar áitreabh a bheidh cláruithe i gclár na n-easportálaithe no duine éigin ar fostú ag an únaer san chun na críche sin agus ní bheidh sé dleathach d'éinne eile an marc san d'úsáid ná an marc san do chur ar aon phacáistí ubh.
(3) Gach éinne úsáidfidh no chuirfidh ar aon uibhe no pacáistí ubh, contrárdha don alt so, aon mharc a bheidh orduithe no ceaptha fé alt 15 den Phríomh-Acht, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é agus fíneail ná raghaidh thar fiche púnt má sé an dara cionta aige é no aon chionta ina dhiaidh sin no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná ráithe no an fhíneail sin agus an phríosúntacht san le chéile.
Meáchaint na n-ubh do mharcáil ar na pacáistí.
11.—(1) Má deintear pacáiste ina mbeidh uibhe do mharcáil le marc (dá ngairmtear an marc gráda san alt so) ar n-a ordú le rialacháin fén bPríomh-Acht mar mharc d'uibhe de ghrád áirithe agus go marcálfar ar an bpacáiste sin, leis, marc (dá ngairmtear an marc meáchainte san alt so) a bheidh ceaptha chun a thaisbeaint no a chur i dtuisgint go bhfuil gach céad ubh sa phacáiste sin níos mó meáchaint ná an mheáchaint a bheidh orduithe mar mheáchaint mhinimum do chéad ubh a bhaineann leis an ngrád a taisbeántar leis an marc gráda, ní bheidh sé dleathach d'únaer chláruithe an pacáiste sin d'easportáil mara mbeidh gach céad ubh sa phacáiste sin chó mór meáchaint ar a laighead leis an meáchaint a thaisbeánann an marc meáchainte.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é, no fíneail ná raghaidh thar fiche púnt má sé an dara cionta aige é no aon chionta ina dhiaidh sin no, más rogha leis an gCúirt é, príosúntacht ar feadh aon téarma nách sia ná sé mhí no an fhíneail sin agus an phríosúntacht san le chéile.
(3) San alt so, cialluíonn an abairt “céad ubh” céad agus fiche ubh.
Alt 17 den Phríomh-Acht do leasú.
12.—(1) I dteanta na gcomhacht a bronntar ar chigire le fo-alt (1) d'alt 17 den Phríomh-Acht, beidh teideal ag cigire chun dul isteach ar gach tráth réasúnta in aon áitreabh a bheidh cláruithe i gclár na n-easportálaithe no go mbeifear tar éis iarratais do dhéanamh chun é chlárú sa chlár san, agus gach ní no éinní acu so leanas do dhéanamh ann, sé sin le rá:—
(a) uibhe do chuardach san áitreabh san;
(b) a cheangal ar an únaer cláruithe no ar aon duine ar fostú ag an únaer cláruithe sin san áitreabh san pé eolas is dó leis an gcigire sin is gá chun crícheanna riartha an Phríomh-Achta agus an Achta so i dtaobh ainm agus seola duine ar bith do thabhairt don chigire sin.
(2) I dteanta na gcomhacht a bronntar ar chigire le fo-alt (2) d'alt 17 den Phríomh-Acht, beidh teideal ag cigire chun dul isteach ar gach tráth réasúnta in aon áitreabh a bheidh cláruithe i gclár na leasuitheoirí no go mbeifear tar éis iarratais do dhéanamh chun é chlárú sa chlár san, agus gach ní no éinní acu so leanas do dhéanamh ann, sé sin le rá:—
(a) uibhe do chuardach agus do scrúdú san áitreabh san;
(b) a cheangal ar an únaer cláruithe no ar aon duine ar fostú ag an únaer cláruithe sin san áitreabh san pé eolas is dó leis an gcigire sin is gá chun crícheanna riartha an Phríomh-Achta agus an Achta so i dtaobh ainm agus seola duine ar bith do thabhairt don chigire sin.
(3) Gach n-aon a chuirfidh cosc no bac le haon chigire agus é ag feidhmiú aon chomhachta dá mbronntar air leis an alt so no go dteipfidh air no dhiúltóidh eolas ar bith do thabhairt do chigire ar bith ar n-a éileamh san air, eolas go mbeidh teideal ag an gcigire sin a éileamh fén alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar cúig púint do chur air.
Alt 18 den Phríomh-Acht do leasú.
13.—Léireofar alt 18 den Phríomh-Acht agus beidh éifeacht aige fé is dá gcuirtí an fo-alt so leanas isteach ann in ionad fo-ailt (1) atá ann anois, sé sin le rá:—
“(1) Einne—
(a) a dhéanfaidh aon uibhe bheidh salach ar an taobh amuich no bheidh neamh-oiriúnach mar bhia don duine do dhíol, do mhargáil no do mhalairtiú, no iad do thairisgint no do thaisbeaint chun a ndíolta, a margála no a malairtithe, pe' ca déanfar an díol, an mhargáil no an malairtiú san ar choiníoll go seasóidh na huibhe tástáil áirithe no ná déanfar; no
(b) is ceannaí ubh, agus a cheannóidh uibhe ar bith bheidh salach ar an taobh amuich no bheidh neamh-oiriúnach mar bhia don duine no go mbeidh a leithéidí ar seilbh aige in áitreabh ina ndeineann sé an cheannaíocht san; no
(c) is ceannaí ubh, agus a fhágfaidh síos in aon áit aon uibhe bheidh salach ar an taobh amuich no bheidh neamhoiriúnach mar bhia don duine; no
(d) a chonsighneoidh chun a ndíolta ar coimisiún no ar aon tslí eile uibhe bheidh salach ar an taobh amuich no bheidh neamh-oiriúnach mar bhia don duine;
beidh sé ciontach i gcionta fén alt so, agus féadfar pionós do chur air dá réir sin.”
Atharú déanmhais ar áitreabh cláruithe.
14.—(1) Ní bheidh sé dleathach d'éinne, gan cead roimh ré ón Aire, aon atharú déanmhais do dhéanamh ar aon áitreabh a bheidh cláruithe i gclár na n-easportálaithe no i gclár na leasuitheoirí.
(2) Gach n-aon a dhéanfaidh aon atharú déanmhais ar aon áitreabh contrárdha don alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar deich bpúint do chur air.
CUID II.
Clar na Leasuitheoiri.
Cláruithe atá i gclár na leasuitheoirí do dhul ar ceal.
15.—Gach clárú áitreibh i gclár na leasuitheoirí atá ann le linn an Achta so do rith tiocfaidh chun bheith agus beidh gan brí gan éifeacht díreach ar rith an Achta so.
Coiníollacha bhainfidh le háitreabh do chlárú i gclár na leasuitheoirí.
16.—Sara ndéanfaidh an tAire aon áitreabh do chlárú i gclár na leasuitheoirí fén bPríomh-Acht, déanfa sé deimhin de go bhfuil an t-áitreabh san do réir na gcoiníollacha so leanas, sé sin le rá:—
(a) go bhfuil an t-áitreabh agus an chóir oibre, na feistisí agus na fearaistí ann glan agus dea-dheisithe, agus
(b) go bhfuil leor-shlí san áitreabh chun uibhe agus pacáistí ubh do stóráil ann i dtreo gur féidir teacht ar na huibhe agus ar na pacáistí bheidh stórálta amhlaidh chun iad do scrúdú fén bPríomh-Acht mar atá sé leasuithe leis an Acht so.
An táille is iníoctha ar chlárú i gclár na leasuitheoirí d'iarraidh.
17.—An té bheidh á iarraidh go gclárófaí aon áitreabh i gclár na leasuitheoirí íocfa sé táille phúint leis an Aire agus beidh sé ina choiníoll, le cólíona roimh bhreithniú an iarratais don Aire, an táille sin d'íoc.

18.—(1) Ní bheidh sé dleathach do dhuine ar bith uibhe do leasú, tré stóráil fhuair, tré stóráil cheimiciuil, tré phicleail, no ar aon tslí eile, chun trádála ná chun brabúis, in áitreabh ná beidh cláruithe i gclár na leasuitheoirí.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar fiche púnt do chur air má sé an chéad chionta aige é agus fíneail ná raghaidh thar caoga púnt, má sé an dara cionta aige é no aon chionta ina dhiaidh sin, no, más rogha leis an gCúirt é, príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneail sin agus an phríosúntacht san le chéile.
(3) Ní thiocfaidh an t-alt so i bhfeidhm go ceann ráithe ón Acht so do rith.
Rialacháin ghenerálta i dtaobh uibhe leasuithe do mharcáil.
19.—Féadfaidh an tAire rialacháin do dhéanamh (dá ngairmtear san Acht so na rialacháin ghenerálta i dtaobh uibhe leasuithe do mharcáil) i dtaobh gach ní no éinní acu so leanas, sé sin le rá:—
(a) na marcanna bheidh ar uibhe cuirfear no consighneofar go dtí aon áitreabh no aistreofar as aon áitreabh a bheidh cláruithe i gclár na leasuitheoirí;
(b) an módh ina gcuirfear agus an gléas le n-a gcuirfear na marcanna san ar na huibhe sin;
agus féadfar marcanna deifriúla d'ordú maidir le saghsanna deifriúla ubh chun a thaisbeaint cadé an chóir atá beartuithe do chur no do cuireadh ar na huibhe sin san áitreabh san.
Toirmeasc ar uibhe neamarcálta do chur amach no d'fháil.
20.—(1) Fé réir forálacha an ailt seo, ní bheidh sé dleathach do dhuine ar bith aon uibhe do chur ná do chonsighniú go dtí aon áitreabh ná do sheachada in aon áitreabh a bheidh cláruithe i gclár na leasuitheoirí agus iad, le linn a gcurtha amach no a gconsighnithe no a seachadtha amhlaidh, gan bheith marcálta do réir na rialachán ngenerálta i dtaobh uibhe leasuithe do mharcáil.
(2) Fé réir forálacha an ailt seo, ní bheidh sé dleathach d'únaer chláruithe áitreibh a bheidh cláruithe i gclár na leasuitheoirí glaca san áitreabh san le seachada aon ubh ná beidh marcálta do réir na rialachán ngenerálta i dtaobh uibhe leasuithe do mharcáil ná aon uibhe ná beidh marcálta amhlaidh do ghlaca isteach san áitreabh san.
(3) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é, agus fíneail ná raghaidh thar fiche púnt má sé an dara cionta aige é no aon chionta ina dhiaidh sin no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná sé mhí no an fhíneail sin agus an phríosúntacht san le chéile.
(4) Féadfaidh an tAire le hordú dhéanfa sé fén bhfo-alt so a dhearbhú ná bainfidh na forálacha san roimhe seo den alt so le huibhe bheidh le leasú ar shlí no ar shlite áirithe luadhfar san ordú san, agus pé uair a déanfar ordú den tsórt san agus a bheidh sé i bhfeidhm ní bhainfidh na forálacha so le huibhe bheidh le leasú ar an slí no ar na slite áirithe luadhfar san ordú san.
(5) Féadfar ordú fén bhfo-alt san roimhe seo d'athghairm, do leasú, no d'atharú le hordú dhéanfaidh an tAire fén bhfo-alt so.

21.—(1) Ní bheidh sé dleathach d'únaer chláruithe aon áitreibh a bheidh cláruithe i gclár na leasuitheoirí aon uibhe do dhíol, do chonsighniú ná d'aistriú ar aon tslí eile as an áitreabh san mara mbeidh ar na huibhe sin go soiléir so-léighte na marcanna bheidh orduithe leis na rialacháin ghenerálta i dtaobh uibhe leasuithe do mharcáil.
(2) Ní bheidh sé dleathach do dhuine ar bith aon uibhe do cheannach in aon áitreabh a bheidh cláruithe i gclár na leasuitheoirí mara mbeidh ar na huibhe sin go soiléir so-léighte na marcanna bheidh orduithe leis na rialacháin ghenerálta i dtaobh uibhe leasuithe do mharcáil ná glaca le haon uibhe á seachada o áitreabh ar bith den tsórt san mara mbeidh na marcanna san go soiléir so-léighte ar na huibhe sin.
(3) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é, agus fíneail ná raghaidh thar fiche púnt má sé an dara cionta aige é no aon chionta ina dhiaidh sin no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná ráithe no an fhíneail sin agus an phríosúntacht san le chéile.

22.—Má dheineann éinne—

Cimeádfar clár in áitreabh a bheidh cláruithe i gclár na leasuitheoirí.
23.—(1) Beidh sé de dhualgas ar únaer chláruithe gach áitreibh a bheidh cláruithe i gclár na leasuitheoirí clár sa bhfuirm orduithe do chimeád no a chur fé ndeár é do chimeád san áitreabh san, clár de sna huibhe go léir do gheobhfar san áitreabh san agus a cuirfear amach as, agus, fé cheann dhá uair dhéag a' chluig tar éis aon uibhe den tsórt san d'fháil no do chur amach, na mion-innste orduithe i dtaobh na n-ubh san do chur sa chlár san no a chur fé ndeár iad do chur ann.
(2) Féadfaidh aon chigire gach clár a bheidh á chimeád do réir an ailt seo d'iniúcha uair ar bith le linn tráthanna oifige agus beidh sé de dhualgas ar an únaer cláruithe an clár san do thaisbeaint, ar a iarraidh sin air, chun go n-iniúchfaidh an cigire sin é agus fós gach billín, nóta consighneachta, admháil agus scríbhinn eile (ar a n-áirítear cóipeanna dhíobh i gcás ná beid féin ar fáil) a iarrfaidh an cigire sin, go réasúnta, chun féachaint an fíor aon iontráil áirithe sa chlár san no cad fé ndeár éinní áirithe d'fhágaint amach as.
(3) Má thárlann d'aon únaer cláruithe—
(a) go dteipfidh air an clár san a héilítear leis an alt so do chimeád no a chur fé ndeár é do chimeád, no
(b) go dteipfidh air aon iontráil, a héilítear leis an alt so do chur sa chlár san, do chur no a chur fé ndeár é do chur sa chlár san laistigh den am a horduítear leis an alt so, no
(c) go dteipfidh air aon chlár, scríbhinn, no cóip de scríbhinn, a héilítear leis an alt so do thaisbeaint, do thaisbeaint no a chur fé ndeár é do thaisbeaint, ar iarratas cigire, chun go n-iniúchfaidh an cigire é, no go gcuirfe sé cosc le haon chigire den tsórt san agus é ag déanamh an iniúchta san, no

(4) Chun crícheanna an ailt seo—
(a) folóidh clár no scríbhinn d'iniúcha cóipeanna dhéanamh de no sleachta thógaint as; agus
(b) tuigfear gur hiarradh go cuibhe ar an únaer cláruithe clár no scríbhinn eile do thaisbeaint chun go n-iniúchfaí é má hiarradh san de bhréithre béil san áitreabh cláruithe ar dhuine ar bith ar fostú ag an únaer cláruithe; agus
(c) más san áitreabh cláruithe do rinneadh agus más duine ar fostú ag an únaer cláruithe do rinne diúlta no teip maidir le clár no scríbhinn eile do thaisbeaint chun go n-iniúchfaí é, tuigfear gurb é an t-únaer cláruithe do rinne an diúlta no an teip sin; agus
(d) cialluíonn an abairt “tráthanna oifige” aon am idir a deich a chlog ar maidin agus a cúig a chlog um thráthnóna go mbíonn gnó ar siúl no obair á déanamh le n-a linn san áitreabh cláruithe.
(5) Scuirfidh alt 13 den Phríomh-Acht d'éifeacht do bheith aige maidir le háitreabhacha atá cláruithe i gclár na leasuitheoirí.
CUID III.
Ilghneitheach agus Generalta.
Toirmeasc ar uibhe do dhíol in áiteacha áirithe.
24.—(1) Ní bheidh sé dleathach do dhuine ar bith aon uibhe do dhíol, do mhargáil, ná do mhalairtiú, ná iad do thairisgint ná do thaisbeaint chun a ndíolta, a margála, ná a malairtithe, in áit ná i slí ná beidh leor-chosaint ag na huibhe sin ar fhliche, ar thaise, ar shalachar no ar thruailliú de shórt ar bith.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é, agus fíneail ná raghaidh thar fiche púnt má sé an dara cionta aige é no aon chionta ina dhiaidh sin no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná ráithe no an fhíneail sin agus an phríosúntacht san le chéile.
Comhachta an Ghárda Síochána.
25.—(1) Beidh teideal ag ball den Ghárda Síochána dul isteach ar gach tráth réasúnta in áitreabh ar bith (nách áitreabh a bheidh cláruithe i gclár na n-easportálaithe ná i gclár na leasuitheoirí) ina dtairgtear no ina dtaisbeántar uibhe chun a ndíolta.
(2) Féadfaidh ball den Ghárda Síochána iniúcha do dhéanamh ar aon uibhe tairgfear no taisbeánfar chun a ndíolta in aon áit go mbeidh teideal aige dul isteach ann fén bhfo-alt san roimhe seo no in aon áit phuiblí agus féadfa sé somplaí réasúnta d'aon uibhe a tairgfear no a taisbeánfar chun a ndíolta in aon áit den tsórt san agus iad salach ar an taobh amuich do thógaint agus d'aistriú gan íoc asta.
(3) Gach n-aon a chuirfidh cosc no bac le ball den Ghárda Síochána agus é ag feidhmiú aon chomhachta dá mbronntar air leis an alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar cúig púint do chur air.
Rialacháin.
26.—(1) Féadfaidh an tAire le hordú rialacháin do dhéanamh i dtaobh éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú agus ná horduítear ná nách féidir d'ordú fén bPríomh-Acht.
(2) Gach rialachán a dhéanfaidh an tAire fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh den Oireachtas, laistigh den lá is fiche shuidhfidh an Tigh sin ina dhiaidh sin, rún do rith ag cur an rialacháin sin ar nea-mbrí beidh an rialachán san curtha ar nea-mbrí dá réir sin, ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén rialachán san.

Preliminary.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Agriculture;
the expression “the Principal Act” means the Agricultural Produce (Eggs) Act, 1924 (No. 35 of 1924);
the expression “chemical storage” means storage for the purpose of preserving eggs by any process which does not alter the composition of the shells, including storage in any gas, vapour, or gaseous mixture;
the word “prescribed” means prescribed by regulations made under the Principal Act or under this Act.
Construction of the Principal Act and this Act.
2.—The Principal Act and this Act shall be read and construed as one Act, and accordingly the expression “this Act” wherever it occurs in the Principal Act shall mean the Principal Act and this Act construed as one Act, and (save where otherwise provided by this Act) expressions and words used in this Act which are also used in the Principal Act have the same meanings in this Act as they respectively have in the Principal Act.
PART I.
Amendment of the Principal Act.
Amendment of section 3 of the Principal Act.
3.—Section 3 of the Principal Act shall not apply to eggs carried or driven by a farmer or his servants from Saorstát Eireann into Northern Ireland in the course of his business as a farmer.
Amendment of section 4 of the Principal Act.
4.—(1) An inspector, inspecting under section 4 of the Principal Act any eggs or any package in any place, may, in addition to or in lieu of all or any of the things which he is authorised by that section to do, do all or any of the following things, that is to say:—
(a) examine any eggs found by him in a package opened by him under the said section, and
(b) detain for so long as may be reasonably necessary for the purpose of such examination, the package so opened and all or any other packages (if any) included there with in the same consignment, and
(c) give a direction in writing to the carrier prohibiting the export of all packages so detained where it appears to such inspector on such examination that there has been a contravention or an attempted contravention of the Principal Act as amended by this Act or of this Act or of any regulation made under those Acts or either of them in relation to such consignment, and that such contravention or attempted contravention extends, where such consignment consists of not more than twenty packages, to one or more or all of such packages or, where such consignment consists of more than twenty packages, to not less than five per cent, of the packages comprised in such consignment.
(2) Whenever an inspector gives a direction under this section to the carrier prohibiting the export of any package of eggs, it shall be the duty of such inspector, where such carrier is not the owner of such package, to notify the consignor of such package of the giving of such direction.
(3) Every person who exports or attempts to export any package of eggs in respect of which a direction prohibiting the export of such package has been given by an inspector under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(4) Whenever a direction prohibiting the export of a package of eggs has been given to the carrier under this section and such package is, at the time such direction is given, actually loaded on a ship at a port in Saorstát Eireann, the carriage of such package on such ship shall not for the purpose of this section be deemed an exportation of such package if such carrier proves that such package was subsequently returned to and landed at the same port in Saorstát Eireann by him at the first available opportunity and that between the time such package left and was landed at such port it was in the sole charge of such carrier and was not opened or interfered with in any way.
(5) Section 4 of the Principal Act shall be construed and have effect as if—
(a) the words “the whole or” were inserted after the word “forming” in paragraph (c) of sub-section (2) thereof; and
(b) the words “or reasonable delay” were inserted in sub-section (6) thereof after the word “damage” wherever that word occurs in that sub-section.
(6) In the exercise in or upon the premises of any railway or shipping company of the powers conferred on him by this section, an inspector shall conform to such reasonable requirements of such company as are necessary to prevent the working of the traffic on such premises being obstructed or interfered with.
(7) The expression “this section” wherever it occurs in section 4 of the Principal Act shall mean the said section 4 as amended by this present section and for that purpose every provision of this present section shall be deemed to be an amendment of the said section 4.
Additional condition of registration in register of exporters.
5.—(1) The Minister shall, before registering any premises in the register of exporters, be satisfied (in addition to the matters mentioned in sub-section (3) of section 7 of the Principal Act) that either the applicant for registration of such premises or one person at least employed by him on such premises is skilled in the business of testing, grading, and packing eggs in accordance with the Principal Act and regulations made thereunder.
(2) Until the expiration of a period of twelve months from the passing of this Act, premises which are registered in the register of exporters at the passing of this Act and continue to be so registered shall not be deemed, for the purposes of section 10 of the Principal Act, to have ceased to be eligible for registration in the register of exporters by reason merely of the fact that neither the registered owner of such premises nor any person employed by him on such premises is skilled in the business of testing, grading, and packing eggs in accordance with the Principal Act and regulations made thereunder.
Reasons for refusal to register premises.
6.—Without prejudice to any other reason for refusal which may arise under the Principal Act or this Act, each of the following shall be a good reason for the refusal by the Minister of an application for the registration of premises in the register of exporters or in the register of preservers, that is to say:—
(a) that such premises were previously so registered and such registration was cancelled by the Minister under the Principal Act or this Act, or
(b) that the person applying for such registration was previously the registered proprietor of other premises so registered and, while he was such registered owner, the registration of such other premises was cancelled by the Minister under the Principal Act or this Act.
Amendment of section 9 of the Principal Act.
7.—Sub-section (8) of section 9 of the Principal Act shall be construed and have effect and be deemed always to have had effect as if the words “next following the year” were inserted therein after the words “in the year.”
Cancellation of registration of premises on bankruptcy.
8.—Whenever the registered proprietor of any premises registered under the Principal Act or under that Act as amended by this Act is adjudicated a bankrupt, the Minister may cancel the registration of such premises.
Notice of intention to cancel registration of premises.
9.—(1) Before altering or cancelling (otherwise than in accordance with an application in that behalf made under section 10 of the Principal Act) the registration of any premises under the Principal Act or this Act, the Minister shall give at least one fortnight's notice in writing of his intention so to alter or cancel such registration to the registered proprietor of such premises or his personal representative (if any) or its liquidator (as the case may be) and shall consider any representations made before the expiration of such notice by such registered proprietor or personal representative or liquidator (as the case may be) and may, if he thinks fit, cause an inquiry to be held in relation to the matter.
(2) A notice of the Minister's intention to cancel or alter registration of premises under the Principal Act or this Act may be served by delivering it to the person to whom it is addressed or by leaving it for him with a person over sixteen years of age on the premises to which it relates or by sending it by post to the person to whom it is addressed at his last known place of abode.
(3) Sub-section (4) of section 10 of the Principal Act is hereby repealed.
Restriction on use of prescribed marks.
10.—(1) A mark prescribed or assigned under section 15 of the Principal Act for the purpose of indicating the premises on which eggs were packed shall be used and shall be placed on eggs or packages of eggs by the following persons only, that is to say, the registered proprietor for the time being of the registered premises for or to which such mark is prescribed or assigned or some person employed by such proprietor for that purpose, and it shall not be lawful for any other person to use such mark or to place such mark on any eggs or packages of eggs.
(2) A mark prescribed under section 15 of the Principal Act to be placed on packages of eggs for the purpose of indicating that such eggs were produced in Saorstát Eireann shall be used and shall be placed on packages of eggs by the following persons only, that is to say, the registered proprietor for the time being of premises registered in the register of exporters or some person employed by such proprietor for that purpose and it shall not be lawful for any other person to use such mark or to place such mark on any packages of eggs.
(3) Every person who uses or places on any eggs or packages of eggs in contravention of this section any mark prescribed or assigned under section 15 of the Principal Act shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Branding of weights of eggs on packages.
11.—(1) Where a package containing eggs is marked with a mark (in this section called the grade mark) prescribed by regulations made under the Principal Act as -the mark for eggs of a particular grade and there is also marked on such package a mark (in this section called the weight mark) intended to indicate or convey that each great hundred of eggs in such package is greater in weight than the weight prescribed as the minimum weight for a great hundred of eggs belonging to the grade indicated by the grade mark, it shall not be lawful for a registered proprietor to export such package unless each great hundred of eggs contained in such package is not less in weight than the weight indicated by the weight mark.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds or, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
(3) In this section the expression “great hundred” means one hundred and twenty.
Amendment of section 17 of the Principal Act.
12.—(1) In addition to the powers conferred on an inspector by sub-section (1) of section 17 of the Principal Act, an inspector shall be entitled at all reasonable times to enter any premises registered in the register of exporters or in respect of which an application for registration in such register has been made, and do all or any of the following things, that is to say:—
(a) search for eggs on such premises;
(b) require the registered proprietor or any person employed by such registered proprietor on such premises to furnish such inspector with such information as to the name and address of any person which such inspector may deem necessary for the purposes of the administration of the Principal Act and this Act.
(2) In addition to the powers conferred on an inspector by sub-section (2) of section 17 of the Principal Act, an inspector shall be entitled at all reasonable times to enter any premises registered in the register of preservers or in respect of which an application for registration in such register has been made and do all or any of the following things, that is to say:—
(a) search for and inspect eggs on such premises;
(b) require the registered proprietor or any person employed by such registered proprietor on such premises to furnish such inspector with such information as to the name and address of any person which such inspector may deem necessary for the purposes of the administration of the Principal Act and this Act.
(3) Every person who obstructs or impedes any inspector in the exercise of any of the powers conferred on him by this section or fails or refuses to give to any inspector on demand any information which such inspector is entitled to demand under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
Amendment of section 18 of the Principal Act.
13.—Section 18 of the Principal Act shall be construed and have effect as if the following sub-section were inserted therein in lieu of sub-section (1) now contained therein, that is to say:—
“(1) Any person who—
(a) sells, exchanges, or barters, or offers or exposes for sale, exchange, or barter any eggs which are externally dirty or which are unfit for human consumption, whether such sale, exchange, or barter is or is not made subject to the condition that the eggs shall pass a particular test; or
(b) being a person engaged in the egg trade, buys or has in his possession on premises on which he carries on such trade any eggs which are externally dirty or which are unfit for human consumption; or
(c) being a person engaged in the egg trade, deposits in any place any eggs which are externally dirty or which are unfit for human consumption; or
(d) consigns for sale on commission or otherwise eggs which are externally dirty or which are unfit for human consumption;
shall be guilty of an offence under this section and shall be punishable accordingly.”
Structural alterations of registered premises.
14.—(1) It shall not be lawful for any person to make, without the previous approval of the Minister, any structural alterations in any premises registered in the register of exporters or the register of preservers.
(2) Every person who makes any structural alterations in any premises in contravention of this section shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding ten pounds.
PART II.
The Register of Preservers.
Avoidance of existing registrations in register of preservers.
15.—Every registration of premises in the register of preservers existing at the passing of this Act shall, immediately upon such passing, become and be void and of no effect.
Conditions of registration of premises in register of preservers.
16.—The Minister shall, before registering any premises in the register of preservers under the Principal Act, be satisfied that such premises comply with the following conditions, that is to say:—
(a) that the premises and the equipment, fittings, and appliances thereof are in a state of cleanliness and good repair, and
(b) that the premises contain adequate accommodation for the storage therein of eggs and of packages of eggs in such manner that the eggs and packages so stored are accessible for inspection under the Principal Act as amended by this Act.
Fees on application for registration in register of preservers.
17.—There shall be paid to the Minister by the person applying for the registration of any premises in the register of preservers the fee of one pound and the payment of such fee shall be a condition precedent to the entertainment of the application by the Minister.
Prohibition of business of preserving eggs in unregistered premises.
18.—(1) It shall not be lawful for any person to carry on by way of trade or gain in premises which are not registered in the register of preservers the business of preserving eggs, whether by cold storage, chemical storage, pickling, or otherwise.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding twenty pounds and, in the case of a second or any subsequent offence, to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
(3) This section shall not come into force until the expiration of three months from the passing of this Act.
General regulations for marking preserved eggs.
19.—The Minister may make regulations (in this Act referred to as the general regulations for the marking of preserved eggs) in relation to all or any of the following matters, that is to say:—
(a) the marks to be borne on eggs sent or consigned to or removed from any premises registered in the register of preservers;
(b) the mode in and the means by which such marks are to be placed on such eggs;
and different marks may be prescribed in respect of different classes of eggs with the object of indicating the manner in which such eggs are intended to be or have been treated in such premises.
Prohibition of sending or receiving unmarked eggs.
20.—(1) Subject to the provisions of this section, it shall not be lawful for any person to send or consign to or deliver at any premises registered in the register of preservers any eggs which at the time of such sending, consigning, or delivery are not marked in accordance with the general regulations for the marking of preserved eggs.
(2) Subject to the provisions of this section, it shall not be lawful for the registered proprietor of premises registered in the register of preservers to accept on such premises delivery of any eggs which are not marked in accordance with the general regulations for the marking of preserved eggs or to receive into such premises any eggs not so marked.
(3) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
(4) The Minister may by order made under this sub-section declare that the foregoing provisions of this section shall not apply in the case of eggs intended to be preserved by a particular process or processes specified in such order, and whenever any such order is made and is in force these provisions shall not apply to eggs intended to be preserved by the particular process or processes specified in such order.
(5) An order under the foregoing sub-section may be revoked, amended, or varied by an order made by the Minister under this sub-section.
Prohibition of removal, etc., of unmarked eggs.
21.—(1) It shall not be lawful for the registered proprietor of any premises registered in the register of preservers to sell, consign, or otherwise remove from such premises any eggs which do not bear visibly and legibly thereon the marks prescribed by the general regulations for the marking of preserved eggs.
(2) It shall not be lawful for any person to purchase at any premises registered in the register of preservers any eggs which do not bear visibly and legibly thereon the marks prescribed by the general regulations for the marking of preserved eggs or to accept delivery from any such premises of any eggs which do not bear visibly and legibly thereon such marks.
(3) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Prohibition of removal, etc., of marks from preserved eggs.
22.—If any person—
(a) removes, alters, or obliterates from or on any egg a mark prescribed by the general regulations for the marking of preserved eggs, or
(b) sells, exchanges, or barters, or offers or exposes for sale, exchange, or barter any egg from or on which a mark prescribed by the general regulations for the marking of preserved eggs has been removed, altered, or obliterated,
he shall, unless he proves that he acted without intent to defraud, be guilty of an offence under this section and be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Register to be kept on premises registered in register of preservers.
23.—(1) It shall be the duty of the registered proprietor of every premises registered in the register of preservers to keep or cause to be kept in such premises a register in the prescribed form of all eggs received at and despatched from such premises and within twelve hours after the reception or dispatch of any such eggs to enter or cause to be entered in such register the prescribed particulars in relation to such eggs.
(2) Every register kept in pursuance of this section may be inspected at any time during office hours by any inspector, and it shall be the duty of the registered proprietor to produce for the inspection of such inspector on demand such register and also all invoices, consignment notes, receipts, and other documents (including copies thereof where the originals are not available) reasonably demanded by such inspector for the purpose of verifying any entry in or explaining any omission from such register.
(3) If any registered proprietor—
(a) fails to keep or cause to be kept such register as is required by this section, or
(b) fails to make or cause to be made in such register within the time prescribed by this section any entry required by this section to be made therein, or
(c) fails to produce or cause to be produced for the inspection of an inspector on demand any register, document, or copy of a document which he is required by this section so to produce, or obstructs any such inspector in the making of such inspection, or
(d) wilfully or negligently makes or causes to be made in such register any entry which is false or misleading in any material particular,
he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(4) For the purposes of this section—
(a) inspection of a register or document shall include taking copies thereof or extracts therefrom; and
(b) a demand for inspection of a register or other document shall be deemed to have been duly made to the registered proprietor if such demand is made verbally on the registered premises to any person in the employment of the registered proprietor; and
(c) a refusal or failure to produce a register or other document for inspection, if made or committed on the registered premises by a person in the employment of the registered proprietor, shall be deemed to have been made or committed by the registered proprietor; and
(d) the expression “office hours” means any time between the hours of ten o'clock in the morning and five o'clock in the afternoon during which business is being carried on or work is being done on the registered premises.
(5) Section 13 of the Principal Act shall cease to have effect in relation to premises registered in the register of preservers.
PART III.
Miscellaneous and General.
Prohibition of sale of eggs in certain places.
24.—(1) It shall not be lawful for any person to sell, exchange, or barter, or offer or expose for sale, exchange, or barter, any eggs in a place or under conditions which does or do not afford adequate protection to such eggs against wet, damp, dirt, or contamination of any sort.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
Powers of the Gárda Síochána.
25.—(1) A member of the Gárda Síochána shall be entitled at all reasonable times to enter any premises (not being premises registered in the register of exporters or the register of preservers) in which eggs are offered or exposed for sale.
(2) A member of the Gárda Síochána may inspect any eggs offered or exposed for sale in any place upon which he is entitled under the foregoing sub-section to enter or in any public place and may take and remove without payment reasonable samples of any eggs which are offered or exposed for sale in any such place and are externally dirty.
(3) Every person who obstructs or impedes a member of the Gárda Síochána in the exercise of any of the powers conferred on him by this section shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine not exceeding five pounds.
Regulations.
26.—(1) The Minister may by order make regulations in relation to any matter or thing referred to in this Act as prescribed or to be prescribed and which is not prescribed or capable of being prescribed under the Principal Act.
(2) Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either House of the Oireachtas within the next twenty-one days on which that House has sat annulling such regulation such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Expenses.
27.—All expenses of carrying this Act into effect shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Offences.
28.—Every offence under any provision of this Act may be prosecuted by or at the suit of the Minister as prosecutor.
Short title and citation.
29.—This Act may be cited as the Agricultural Produce (Eggs) Act, 1930, and the Principal Act and this Act may be cited together as the Agricultural Produce (Eggs) Acts, 1924 and 1930.
