AN tACHT UM FHÓIR TEORANTA (LEASÚ), 1982

Mínithe.

1.—San Acht seo—

ciallaíonn “Acht 1976” an tAcht um Fhóir Teoranta (Leasú), 1976:

ciallaíonn “an Chuideachta” Fóir Teoranta;

ciallaíonn “an tAire” an tAire Airgeadais;

ciallaíonn “an Príomh-Acht” an tAcht um Fhóir Teoranta, 1972.

Méadú ar chumhacht na Cuideachta chun iasacht a fháil.

2.—Ní rachaidh comhiomlán iasachtaí na Cuideachta (lena n-áirítear iasachtaí ón Aire agus iasachtaí a fuarthas chun aon cheann de chríocha na Cuideachta de dhroim alt 19 den Phríomh-Acht, ach gan iasachtaí a fuair Taiscí Stáit Teoranta a áireamh) thar £70,000,000 aon tráth áirithe, agus, dá réir sin, forléireofar alt 12 den Phríomh-Acht (arna leasú le hAcht 1976) ionann is dá gcuirfí an tsuim sin in ionad na suime a luaitear san alt sin.

Méadú ar airleacain ón Aire.

3.—Ní rachaidh comhiomlán na n-airleacan a thabharfaidh an tAire don Chuideachta (lena n-áirítear airleacain chun críocha aon cheann d'fheidhmeanna na Cuideachta de dhroim alt 19 den Phríomh-Acht, ach gan airleacain a tugadh do Thaiscí Stáit Teoranta a áireamh) a bheidh gan aisíoc thar £70,000,000 aon tráth áirithe, agus, dá réir sin, forléireofar alt 13 (3) den Phríomh-Acht (arna leasú le hAcht 1976) ionann is da gcuirfí an tsuim sin in ionad na suime a luaitear san alt sin.

Gearrtheideal agus comhlua.

4.—(1) Féadfar an tAcht um Fhóir Teoranta (Leasú), 1982, a ghairm den Acht seo.

(2) Féadfar na hAchtanna um Fhóir Teoranta, 1972 go 1982, a ghairm de na hAchtanna um Fhóir Teoranta, 1972 go 1976, agus den Acht seo le chéile.

Number 1 of 1982

FÓIR TEORANTA (AMENDMENT) ACT, 1982

Definitions.

1.—In this Act—

“the Act of 1976” means the Fóir Teoranta (Amendment) Act, 1976;

“the Company” means Fóir Teoranta;

“the Minister” means the Minister for Finance;

“the Principal Act” means the Fóir Teoranta Act, 1972.

Increase of Company's power to borrow.

2.—The aggregate at any one time of the borrowings of the Company (including borrowings from the Minister and borrowings for any of the purposes of the Company which are consequent upon section 19 of the Principal Act, but excluding borrowings by Taiscí Stáit Teoranta) shall not exceed £70,000,000, and, accordingly, section 12 of the Principal Act (as amended by the Act of 1976) shall be construed as if that sum were substituted for the sum mentioned therein.

Increase of advances by Minister.

3.—The aggregate at any time of advances to the Company by the Minister (including advances for the purposes of any of the functions of the Company consequent upon section 19 of the Principal Act, but excluding advances made to Taiscí Stáit Teoranta) which have not been repaid shall not exceed £70,000,000, and, accordingly, section 13 (3) of the Principal Act (as amended by the Act of 1976) shall be construed as if that sum were substituted for the sum mentioned therein.

Short title and collective citation.

4.—(1) This Act may be cited as the Fóir Teoranta (Amendment) Act, 1982.

(2) The Fóir Teoranta Acts, 1972 to 1976, and this Act may be cited together as the Fóir Teoranta Acts, 1972 to 1982.
