ACHT DO LEASÚ AN ACHTA UM CHOINNÍOLLACHA FOSTAÍOCHTA, 1936 [26adh Abrán, 1944.]

An Príomh-Acht.

1.—San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht um Choinníollacha Fostaíochta, 1936 (Uimh. 2 de 1936).

Alt 3 den Phríomh-Acht do leasú.

2.—(1) Leasuítear leis seo fo-alt (1) d'alt 3 den Phríomh-Acht trí na focail “ná iascaireacht” do chur isteach roimh na focail “ná daoine no earraí d'iompar”.

(2) Is tuigthe fo-alt (1) den alt so do theacht i ngníomh ar an dáta ar a dtáinig an Príomh-Acht i ngníomh.

Alt 9 den Phríomh-Acht do leasú.

3.—Leasuítear leis seo alt 9 den Phríomh-Acht tríd an bhfo-alt so leanas do chur isteach ann i ndiaidh fo-ailt (2):—

“(2A) Féadfar cúiseamh, mar gheall ar chionta fé aon alt den Acht so dhéanfaidh fostóir oibrí i leith an oibrí sin, do bhunú ar agra an oibrí sin no ar agra aon oifigigh do cheárdchumann dar comhalta an t-oibrí sin.”

4.—(1) Leasuítear leis seo fo-alt (3) d'alt 43 den Phríomh-Acht trí na focail “(maidir le hoibrithe bheidh ag déanamh uain-oibre próisis leanúnaigh) an méid aimsire in aon tseachtain a leigfidh fostóir ar bith d'aon oibrí oibriú tar éis dó sé huaire caogad a' chluig oibre do bheith curtha isteach aige agus (maidir le gach oibrí eile)” do chur isteach roimh na focail “an méid aimsire”.

(2) Is tuigthe fo-alt (1) den alt so do theacht i ngníomh ar an dáta ar a dtáinig an Príomh-Acht i ngníomh.

Cosaint d'imeachta áirithe.

5.—I gcás imeachta ar bith do bhunú roimh an 16adh lá d'Fheabhra, 1944, chun aon airgead do bhaint amach adeirtear do bheith iníoctha, de bhíthin fo-ailt (2) d'alt 43 den Phríomh-Acht, le hoibrí bhí ag déanamh uain-oibre próisis leanúnaigh—

(a) má tugadh an bhreith dheiridh ar na himeachta roimh dháta an Achta so do rith, ní oibreoidh alt 4 den Acht so chun an bhreith do dhéanamh neambailidhe,

(b) marar tugadh an bhreith dheiridh ar na himeachta roimh dháta an Achta so do rith, is amhlaidh a dhéanfaidh aon chúirt a dtiocfaidh na himeachta os a cóir amhail mar dhéanfadh dá mba ná hachtófaí alt 4 den Acht so.

Gearr-theideal agus có-luadh.

6.—(1) Féadfar an tAcht um Choinníollacha Fostaíochta, 1944, do ghairm den Acht so.

(2) Féadfar na hAchtanna um Choinníollacha Fostaíochta, 1936 agus 1944, do ghairm den Phríomh-Acht agus den Acht so le chéile.

CONDITIONS OF EMPLOYMENT ACT, 1944.

The Principal Act.

1.—In this Act the expression “the Principal Act” means the Conditions of Employment Act, 1936. (No. 2 of 1936).

Amendment of section 3 of the Principal Act.

2.—(1) Sub-section (1) of section 3 of the Principal Act is hereby amended by the insertion before the words “nor the transport of persons or goods” of the words “nor fishing”.

(2) Sub-section (1) of this section shall be deemed to have come into operation on the date on which the Principal Act came into operation.

Amendment of section 9 of the Principal Act.

3.—Section 9 of the Principal Act is hereby amended by the insertion therein after sub-section (2) of the following sub-section:—

“(2A) A prosecution for an offence under any section of this Act committed by an employer of a worker in relation to such worker may be brought at the suit of such worker or of any official of a trade union of which such worker is a member.”

Amendment of section 43 of the Principal Act.

4.—(1) Sub-section (3) of section 43 of the Principal Act is hereby amended by the insertion before the words “the amount of time” of the words “(as respects workers doing continuous process shift work) the amount of time in any week for which any employer permits any worker to work after having completed fifty-six hours of work and (as respects all other workers)”.

(2) Sub-section (1) of this section shall be deemed to have come into operation on the date on which the Principal Act came into operation.

Savers in relation to certain proceedings.

5.—Where any proceedings were commenced before the 16th day of February, 1944, to recover any moneys alleged to be payable by reason of sub-section (2) of section 43 of the Principal Act to a worker doing continuous process shift work—

(a) if the proceedings were finally determined before the date of the passing of this Act, section 4 of this Act shall not operate to invalidate the determination,

(b) if the proceedings were not finally determined before the date of the passing of this Act, any court before which the proceedings may come shall proceed as if section 4 of this Act had not been enacted.

Short title and collective citation.

6.—(1) This Act may be cited as the Conditions of Employment Act, 1944.

(2) The Principal Act and this Act may be cited together as the Conditions of Employment Acts, 1936 and 1944.
