1.—(1) San Acht seo—
ciallaíonn “Acht 1937” An tAcht Muc agus Bagúin, 1937;
ciallaíonn “Acht 1939” an tAcht Muc agus Bagúin (Leasú), 1939;
ciallaíonn “Acht 1956” an tAcht Muc agus Bagúin (Leasú), 1956;
ciallaíonn “An Coimisiún” an Coimisiún Muc agus Bagúin;
ciallaíonn “an Príomh-Acht” an tAcht Muc agus Bagúin, 1935.
(2) Déanfar na hAchtanna Muc agus Bagúin, 1935 go 1956, agus an tAcht seo a fhorléiriú le chéile mar aon Acht amháin.
Tosach feidhme.
2.—Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a shocrófar chuige sin le hordú nó le horduithe a dhéanfaidh an tAire faoin alt seo go ginearálta nó maidir le haon chríoch nó foráil áirithe agus féadfar laethanta éagsúla a shocrú le haghaidh críocha éagsúla agus forálacha éagsúla.

3.—Leasaítear leis seo alt 65 den Phríomh-Acht trí “, ach amháin don Choimisiún Muc agus Bagúin nó do dhuine a bheidh ag onnmhairiú bagúin thar a cheann,” a chur isteach i bhfo-alt (1) i ndiaidh “dhuine ar bith”.
Alt 30 d'Acht 1937 a leasú.
4.—Leasaítear leis seo alt 30 (a cuireadh isteach le hAcht 1956) d'Acht 1937—
(a) tríd an bhfomhír seo a leanas a chur in ionad fhomhír (1) de mhír (b), eadhon: “(i) cainníocht sonraithe bagúin nó cainníocht sonraithe de chineál áirithe bagúin nó cainníochtaí sonraithe de chineálacha áirithe bagúin, a mhíneofar i cibé slí is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú, a cheapadh mar chuóta eachtar-dhíola in aghaidh na tréimhse sin, nó”,
(b) trí na fomhíreanna seo a leanas a chur in ionad fhomhíreanna (ii) agus (iii) den mhír sin (b), eadhon:
“(ii) cuóta eachtar-dhíola bagúin nó cuóta eachtardhíola de chineál áirithe nó de chineálacha áirithe bagúin (a mhíneofar i cibé slí is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú) a cheapadh in aghaidh na tréimhse sin, a bheidh i gcoibhneas, ar cibé modh is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú, leis an gcainníocht bhagúin nó na cainníochtaí bagúin nó leis an gcainníocht nó na cainníochtaí de chineál áirithe nó de chineálacha áirithe bagúin (a mhíneofar i cibé slí is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú) a tháirgfear in áitreabh ceadúnaithe tréimhse áirithe, nó
(iii) cuóta eachtar-dhíola bagúin nó cuóta eachtardhíola de chineál áirithe nó de chineálacha áirithe bagúin (a mhíneofar i cibé slí is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú) a cheapadh in aghaidh na tréimhse sin a bheidh i gcoibhneas, ar cibé modh is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú, leis an líon muc de chineál áirithe nó de chineálacha áirithe muc (a mhíneofar i cibé slí is oiriúnach leis an gCoimisiún agus a shonróidh sé san ordú) a mharófar in áitreabh ceadúnaithe tréimhse áirithe, agus”,
(c) trí “ach amháin cibé cuid (más aon chuid é) de a shonrófar san ordú” a chur isteach i mír (c) i ndiaidh “bagún sin”, agus
(d) tríd an bhfo-alt seo a leanas a chur isteach, eadhon:
“(2) Nuair a bheidh aon chnóta eachtar-dhíola bagúin á cheapadh aige faoi mhír (b) den fho-alt sin roimhe seo den alt seo, tabharfaidh an Coimisiún aird ar na nithe seo a leanas, eadhon:
(a) an méid bagúin is féidir leis na margaí (cois baile agus lasmuigh) a ghlacadh,
(b) an méid muc atá ar fáil nó is dóigh a bheidh ar fáil ag ceadúnaithe le marú,
(c) an stoc bagúin atá ar láimh,
(d) a inmhianaithe atá sé soláthar bagúin a choinneáil leis na margaí lasmuigh den Stát, agus
(e) cibé nithe eile is dóigh leis an gCoimisiún a bhaineann le hábhar.”.

5.—(1) Leasaítear leis seo alt 33 (a cuireadh isteach le hAcht 1956) d'Acht 1937 trí—
(a) “ná an chainníocht a cheanglaítear leis an deimhniú a onnmhairiú ón” a chur isteach i mír (b) d'fho-alt (1) in ionad “ná an fo-chuóta eachtar-dhíola don”,
(b) “cúig phunt” a chur in ionad “dhá phunt” agus “an chainníocht a cheanglaítear leis an deimhniú a onnmhairiú ón” a chur in ionad “an fho-chuóta eachtar-dhíola don” san fho-alt sin (1), agus
(c) “cúig phunt” a chur in ionad “dhá phunt” i bhfo-alt (2).
(2) Ní bheidh feidhm ag fo-alt (1) den alt seo in aon chás ina ndearnadh deimhniú fo-chuóta eachtar-dhíola dá dtagraítear san alt sin 33 a sheirbheáil roimh thosach feidhme an ailt seo.
Alt 2 d'Acht 1939 a leasú.
6.—Leasaítear leis seo alt 2 d'Acht 1939 trí “(seachas comhalta den Choimisiún)” a chur isteach sa mhíniú ar “oifigeach údaraithe don Choimisiún” i bhfo-alt (1) i ndiaidh “duine”.
Alt 4 d'Acht 1939 a leasú.
7.—Leasaítear leis seo alt 4 d'Acht 1939 tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (3), eadhon:
“(3) (a) Is seachtar comhalta a bheidh ar an gCoimisiún, is é sin, cathaoirleach (dá ngairtear an Cathaoirleach san Acht seo) agus seisear gnáthchomhalta (dá ngairtear gnáthchomhaltaí san Acht seo).
(b) Is iad a bheidh mar ghnáthchomhaltaí—
(i) beirt daoine arb éard gach duine acu—
(I) duine a ainmneofar chun bheith ina ghnáthchomhalta ag comhlacht nó comhlachtaí a mbeidh dearbhaithe ag an Aire le hordú gurb é an comhlacht ainmniúcháin é nó gurb iad na comhlachtaí ainmniúcháin iad chun críocha na fomhíre seo (is comhlacht nó comhlachtaí a mheasann sé a bheith ionadach do leasa táirgeoirí muc) agus a ndéanfar maidir lena ainmniú fógra i scríbhinn a sheachadadh don Aire (maraon le ráiteas i scríbhinn arna shíniú ag an duine á chur in iúl go dtoilíonn sé leis an ainmniú) lá is fiche ar a laghad roimh an lá a thosódh téarma oifige an duine sin mar ghnáthchomhalta dá dtiocfadh sé chun bheith ina ghnáthchomhalta, nó
(II) duine a ainmneofar chun bheith ina ghnáthchomhalta faoi mhír (c) den fho-alt seo,
(ii) triúr duine arb éard gach duine acu—
(I) duine a ainmneofar chun bheith ina ghnáthchomhalta ag comhlacht nó comhlachtaí a mbeidh dearbhaithe ag an Aire le hordú gurb é an comhlacht ainmniúcháin é nó gurb iad na comhlachtaí ainmniúcháin iad chun críocha na fomhíre seo (is comhlacht nó comhlachtaí a mheasann sé a bheith ionadach do leasa leasaitheoirí bagúin) agus a ndéanfar maidir lena ainmniú fógra i scríbhinn a sheachadadh don Aire (maraon le ráiteas i scríbhinn arna shíniú ag an duine á chur in iúl go dtoilíonn sé leis an ainmniú) lá is fiche ar a laghad roimh an lá a thosódh téarma oifige an duine sin mar ghnáthchomhalta dá dtiocfadh sé chun bheith ina ghnáthchomhalta, nó

(iii) duine amháin a ainmneoidh an tAire agus is oifigeach don Aire.
(c) Má tharlaíonn aon bhliain, de dhroim comhlacht nó comhlachtaí dá dtagraítear i bhfomhír (i) nó i bhfomhír (ii), cibé acu é, de mhír (b) den fho-alt seo do mhainniú duine a ainmniú nó forálacha na fomhíre sin (i) nó (ii), cibé acu é, a chomhlíonadh, nach mbeidh an líon riachtanach daoine ainmnithe faoi na fomhíreanna sin, déanfaidh an tAire, roimh an lá a thosóidh téarma oifige daoine a ainmneofar mar ghnáthchomhaltaí faoin mír sin (b) an bhliain sin, duine nó daoine, de réir mar a bheidh, a ainmniú, chun bheith ina ghnáthchomhalta nó ina ngnáthchomhaltaí agus is éard a bheidh sa duine nó sna daoine a ainmneofar amhlaidh—
(i) i gcás inar mhainneachtain é ag comhlacht nó comhlachtaí dá dtagraítear san fhomhír sin (i), duine nó daoine a mheasann an tAire a bheith ionadach do leasa táirgeoirí muc, agus
(ii) i gcás inar mhainneachtain é ag comhlacht nó comhlachtaí dá dtagraítear san fhomhír sin (ii), duine nó daoine a mheasann an tAire a bheith ionadach do leasa leasaitheoirí bagúin.
(d) Féadfaidh an tAire le hordú ordú faoin bhfo-alt seo, lena n-áirítear ordú faoin mír seo, a chúlghairm nó a leasú.”.
Cathaoirleach an Choimisiúin.
8.—Déantar leis seo an t-alt seo a leanas a chur in ionad alt 5 d'Acht 1939, eadhon:
“5.—(1) (a) Déanfaidh an tAire roimh an lá ceaptha duine a cheapadh chun bheith ina Chathaoirleach agus, as sin amach agus de réir mar is gá, déanfaidh na gnáthchomhaltaí duine a cheapadh chun bheith ina Chathaoirleach.
(b) Cinnfidh na gnáthchomhaltaí an nós imeachta chun duine a roghnú chun a cheaptha mar Chathaoirleach, agus mura gcinnfidh na gnáthchomhaltaí an nós imeachta nó mura roghnófar duine de réir an nós imeachta, roghnófar an Cathaoirleach trí thoghchán a sheolfar idir na gnáthchomhaltaí ag cruinniú de na gnáthchomhaltaí agus beidh feidhm ag forálacha mhíreanna (a) go (h) d'fho-alt (1) d'alt 43 den Acht Rialtais Áitiúil, 1941, maidir leis an toghchán ionann is dá mba thagairt do dhuine nó daoine an tagairt san fhomhír sin (a) do bhall nó baill agus ionann is dá mba thagairtí do ghnáthchomhaltaí na tagairtí ina dhiaidh sin san fho-alt sin do bhaill.
(c) Tabharfaidh príomh-oifigeach an Choimisiúin fógra i scríbhinn don Aire i dtaobh Cathaoirleach a bheith ceaptha ag na gnáthchomhaltaí maraon le ráiteas i scríbhinn a bheidh sínithe ag an duine á chur in iúl go dtoilíonn sé leis an gceapadh.
(2) (a) Murab éag, éirí as, teacht faoi dhícháilíocht nó cur as oifig roimhe sin dó, beidh Cathaoirleach a bheidh arna cheapadh roimh an lá ceaptha i seilbh oifige go ceann tréimhse bliana dar tosach an lá ceaptha.
(b) Murab éag, éirí as, teacht faoi dhícháilíocht nó cur as oifig roimhe sin do, beidh gach Cathaoirleach ina dhiaidh sin i seilbh oifige go ceann tréimhse trí bliana dar tosach an lá díreach tar éis an lae a scoir an Cathaoirleach de bheith i seilbh oifige a bhí díreach roimhe in oifig an Chathaoirligh.
(3) Féadfaidh an duine a bheidh i seilbh oifig an Chathaoirligh éirí as a oifig aon tráth trí litir a dhíreofar, i gcás an éirí as tarlú i rith na bliana dar tosach an lá ceaptha, chun an Aire, agus, i gcás aon éirí as eile, chun príomh-oifigeach an Choimisiúin, agus beidh éifeacht ag an éirí-as amhail ar an agus ón dáta a gheobhaidh an tAire nó an príomh-oifigeach, de réir mar bheidh, an litir, agus beidh an duine inathcheaptha mar Chathaoirleach.
(4) (a) Féadfaidh an tAire aon tráth i rith na bliana dar tosach an lá ceaptha an Cathaoirleach a chur as oifig.
(b) Féadfaidh an tAire, aon tráth tar éis an bhliain dar tosach an lá ceaptha a bheith caite, an Cathaoirleach a chur as oifig, ar thromlach na ngnáthchomhaltaí á iarraidh sin, más dóigh leis an Aire buan-éagumas de dheasca easláinte a bheith ar an gCathaoirleach chun dualgais a oifige a chomhlíonadh.
(5) (a) Má thagann an Cathaoirleach chun bheith ina chomhalta de cheachtar Teach den Oireachtas, ansin, ar é a theacht faoi Bhuan-Orduithe an Tí sin chun teideal a bheith aige suí sa Teach sin, scoirfidh sé de bheith ina Chathaoirleach.
(b) Aon duine a mbeidh, de thuras na huaire, teideal aige faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin, beidh sé dícháilithe chun bheith ina Chathaoirleach.
(6) Beidh an Cathaoirleach dícháilithe chun bheith, agus scoirfidh sé de bheith, i seilbh oifige má bhreithnítear ina fhéimheach é, nó má dhéanann sé imshocraíocht nó comhshocraíocht le creidiúnaithe, nó má thugann cúirt dlínse inniúla pianbhreith phríosúnachta nó phianseirbhíse air nó má scoireann sé de bheith ina ghnáthchónaí sa Stát nó má bhíonn sé as láthair, seachas le cead ón gCoimisiún nó mar gheall ar bhreoiteacht, i rith aon tréimhse trí mhí as a chéile ó gach cruinniú den Choimisiún a chomórfar i rith na tréimhse sin.
(7) (a) Má tharlaíonn corrfholúntas in oifig an Chathaoirligh, tabharfaidh príomh-oifigeach an Choimisiúin fógra i scríbhinn ina thaobh don Aire a luaithe is féidir agus—
(i) i gcás corrfholúntas tarlú i rith na bliana dar tosach an lá ceaptha, líonfaidh an tAire an folúntas trí cheapachán, agus
(ii) i gcás corrfholúntas tarlú tar éis an bhliain dar tosach an lá ceaptha a bheith caite, líonfaidh na gnáthchomhaltaí an folúntas trí cheapachán,
agus beidh an duine a cheapfar amhlaidh i seilbh oifige go ceann na coda eile den tréimhse a bheadh a réamhtheachtaí, dá leanadh sé ina Chathaoirleach i seilbh oifige agus, más gnáthchomhalta é, measfar, ar é a cheapadh amhlaidh, é a bheith tar éis éirí as oifig mar ghnáthchomhalta.
(b) Tabharfar fógra i scríbhinn do phríomh-oifigeach an Choimisiúin a luaithe is féidir i dtaobh ceapachán faoi fhomhír (i) de mhír (a) den fho-alt seo agus tabharfaidh príomh-oifigeach an Choimisiúin fógra i scríbhinn don Aire i dtaobh ceapachán faoi fhomhír (ii) den mhír sin (a) agus, i ngach cás, tosóidh téarma oifige an duine a cheapfar faoin mír sin (a) ar dháta an fhógra sin.
(8) I gcás téarma oifige an Chathaoirligh dul in éag trí imeacht aimsire beidh sé inathcheaptha.
(9) Má bhíonn duine, díreach roimh thosach feidhme alt 8 den Acht Muc agus Bagúin (Leasú), 1961, i seilbh oifig an Chathaoirligh, leanfaidh an duine sin de bheith i seilbh oifige go dtí an lá roimh an lá ceaptha agus measfar é a bheith arna cheapadh ag an Aire faoi fho-alt (1) den alt seo roimh an lá ceaptha chun bheith ina Chathaoirleach.
(10) (a) Má bhíonn éagumas sealadach ar an gCathaoirleach chun dualgais a oifige a chomhlíonadh mar gheall ar easláinte nó cúis leordhóthaineach eile, ceapfaidh na gnáthchomhaltaí duine (is duine de na gnáthchomhaltaí) chun dualgais an Chathaoirligh a chomhlíonadh le linn an éagumais agus beidh ag an duine sin le linn an éagumais cumhachtaí uile an Chathaoirligh agus measfar chun críocha an Achta seo gurb é an duine sin an Cathaoirleach, agus measfar freisin le linn an éagumais nach gnáthchomhalta é.
(b) Íocfaidh an Coimisiún le haon duine a cheapfar faoin bhfo-alt seo cibé luach saothair agus cibé liúntais i leith caiteachais a cheapfaidh an tAire tar éis do dul i gcomhairle leis an Aire Airgeadais.
(11) Má fhaigheann an duine a cheapfar roimh an lá ceaptha chun bheith ina Chathaoirleach bás roimh an lá sin, measfar, chun críocha fho-alt (7) den alt seo, gurb é an lá ceaptha a fuair sé bás, agus, má fhaigheann duine a cheapfaidh na gnáthchomhaltaí chun bheith ina Chathaoirleach bás roimh thosach a théarma oifige mar Chathaoirleach, measfar corrfholúntas a bheith in oifig an Chathaoirligh an lá a thosódh an téarma oifige sin.
(12) Sa Chuid seo den Acht ciallaíonn “lá ceaptha” an lá a cheapfaidh an tAire le hordú faoin bhfo-alt seo chun bheith ina lá ceaptha chun críocha na Coda seo den Acht seo.”
Gnáthchomhaltaí an Choimisiúin.
9.—Déantar leis seo an t-alt seo a leanas a chur in ionad alt 6 d'Acht 1939, eadhon:
“6 (1) Beidh na gnáthchomhaltaí, murab éag, éirí as oifig, teacht faoi dhícháilíocht nó cur as oifig roimhe sin dóibh, i seilbh oifige go ceann tréimhse trí bliana dar tosach, i gcás comhaltaí a ainmníodh roimh an lá ceaptha, an lá ceaptha agus, i gcás comhaltaí dá éis sin, an lá díreach tar éis an lae a scoir na comhaltaí a bhí in oifig díreach rompu de bheith i seilbh oifige.
(2) Féadfaidh duine is gnáthchomhalta éirí as a oifig tráth ar bith trí litir chuig príomh-oifigeach an Choimisiúin agus beidh éifeacht ag an éirí as amhail ar an agus ón dáta ar a bhfaighidh an príomh-oifigeach an litir agus beidh an duine inathainmnithe mar chomhalta.
(3) (a) Má thagann gnáthchomhalta chun bheith ina chomhalta de cheachtar Teach den Oireachtas, ansin, ar é a theacht faoi Bhuan-Orduithe an Tí sin chun teideal a bheith aige suí ann, scoirfidh sé de bheith ina ghnáthchomhalta.
(b) Aon duine a bheidh i dteideal de thuras na huaire faoi Bhuan-Orduithe ceachtar Tí den Oireachtas suí sa Teach sin, beidh sé, an fad a bheidh sé i dteideal suí amhlaidh, dícháilithe chun bheith ina ghnáthchomhalta.
(4) Beidh gnáthchomhalta dícháilithe chun bheith, agus scoirfidh sé de bheith, i seilbh oifige má bhreithnítear ina fhéimheach é, nó má dhéanann sé imshocraíocht nó comhshocraíocht le creidiúnaithe, nó má thugann cúirt dlínse inniúla pianbhreith phríosúnachta nó phianseirbhíse air nó má scoireann sé de ghnáthchónaí a bheith air sa Stát nó má fhanann sé as láthair, ar aon chúinse seachas le cead an Choimisiúin nó mar gheall ar bhreoiteacht, ar feadh aon tréimhse trí mhí as a chéile ó gach cruinniú den Choimisiún a chomórfar i rith na tréimhse sin.
(5) (a) Aon ghnáthchomhalta arb oifigeach don Aire é a d'ainmnigh an tAire, féadfaidh an tAire é a chur as oifig tráth ar bith.
(b) Féadfaidh an tAire tráth ar bith duine is gnáthchomhalta a chur as oifig ar iarratas ón gcomhlacht nó ó na comhlachtaí a d'ainmnigh an duine sin mar ghnáthchomhalta nó arb é a mainneachtain duine a ainmniú nó forálacha mhír (b) d'fho-alt (3) d'alt 4 den Acht seo a chomhlíonadh faoi deara an duine sin a ainmniú, más é tuairim an Aire buan-éagumas de bhíthin easláinte a bheith ar an gcomhalta chun dualgais a oifige a chomhlíonadh.
(6) (a) Má tharlaíonn corrfholúntas i measc na ngnáthchomhaltaí, tabharfaidh an príomh-oifigeach, a luaithe is féidir, fógra i scríbhinn—
(i) don Aire, agus
(ii) más faoi mhír (b) d'fho-alt (3) d'alt 4 den Acht seo a ainmníodh an comhalta is cúis leis an bhfolúntas, don chomhlacht nó do na comhlachtaí a d'ainmnigh an comhalta sin nó arb é a mainneachtain duine a ainmniú nó forálacha na míre sin (b) a chomhlíonadh ba chúis leis an duine sin a ainmniú.
(b) Déanfar corrfholúntas a tharlóidh i measc na ngnáthchomhaltaí a líonadh—
(i) i gcás inar oifigeach don Aire a d'ainmnigh an tAire faoi fhomhír (iii) den mhír sin (b) an comhalta is cúis leis an bhfolúntas, tríd an Aire d'ainmniú oifigeach don Aire, agus
(ii) i gcás inar faoi fhomhír (i) nó faoi fhomhír (ii) den mhír sin (b) a ainmníodh an comhalta is cúis leis an bhfolúntas—
(I) trí dhuine dá dtagraítear san fhomhír réamhráite faoinar ainmníodh an comhalta a ainmniú laistigh de thríocha lá tar éis an lae a fuair an comhlacht nó na comhlachtaí réamhráite fógra i dtaobh an fholúntais ó phríomhoifigeach an Choimisiúin, agus trí fhógra i scríbhinn i dtaobh an ainmnithe, maraon le ráiteas i scríbhinn a bheidh sínithe ag an duine á chur in iúl go dtoilíonn sé leis an ainmniú, a sheachadadh don Aire laistigh de dhaichead lá tar éis an lae a fuarthas amhlaidh an fógra réamhráite, nó
(II) i gcás an comhlacht nó na comhlachtaí a bheidh i dteideal duine a ainmniú chun corrfholúntas a líonadh do mhainniú duine a ainmniú nó forálacha na míre seo a chomhlíonadh, tríd an Aire d'ainmniú—
(A) i gcás inarb é an comhlacht nó inarb iad na comhlachtaí réamhráite an comhlacht nó na comhlachtaí dá dtagraítear san fhomhír sin (i), duine is dóigh leis an Aire a bheith ionadach do leasa táirgeoirí muc, agus
(B) i gcás inarb é an comhlacht nó inarb iad na comhlachtaí réamhráite an comhlacht nó na comhlachtaí dá dtagraítear san fhomhír sin (ii), duine is dóigh leis an Aire a bheith ionadach do leasa leasaitheoirí bagúin.
(c) Tabharfar fógra i scríbhinn do phríomh-oifigeach an Choimisiúin a luaithe is féidir i dtaobh an tAire do dhéanamh ainmniú faoin bhfo-alt seo agus tosóidh téarma oifige gnáthchomhalta a ainmneofar faoin bhfo-alt seo—
(i) i gcás inarb é an tAire a d'ainmnigh an comhalta, ar dháta an fhógra sin, agus
(ii) in aon chás eile, ar an dáta ar a bhfaighidh an tAire an fógra agus an ráiteas dá dtagraítear i mír (b) den fho-alt seo nó, más laethanta éagsúla a gheofar na doiciméid sin, ar an dáta ar a bhfaighfear an doiciméad is deirearnaí acu.
(d) Beidh an duine a ainmneofar mar ghnáthchomhalta chun corrfholúntas a líonadh i measc na ngnáthchomhaltaí i seilbh oifige go ceann na coda eile den tréimhse a bheadh an comhalta ba chúis leis an bhfolúntas i seilbh oifige dá leanadh sé de bheith ina ghnáthchomhalta.
(7) I gcás téarma oifige gnáthchomhalta dul in éag trí imeacht aimsire beidh sé inathainmnithe.
(8) Má fhaigheann duine a ainmneofar roimh an lá ceaptha chun bheith ina ghnáthchomhalta bás roimh an lá sin, measfar, chun críocha fho-alt (6) den alt seo, gurb é an lá ceaptha a fuair sé bás, agus má fhaigheann duine a ainmneofar dá éis sin chun bheith ina ghnáthchomhalta bás roimh thosach a théarma oifige mar ghnáthchomhalta, measfar corrfholúntas i measc na ngnáthchomhaltaí a bheith ann an lá a thosódh an téarma oifige sin.
(9) Má tharlaíonn, díreach roimh thosach feidhme alt 9 den Acht Muc agus Bagúin (Leasú), 1961, go mbeidh duine i seilbh oifige mar ghnáthchomhalta, beidh an duine sin i seilbh oifige go dtí an lá roimh an lá ceaptha agus ansin scoirfidh sé de bheith i seilbh oifige.”

10.—Ní bheidh feidhm ag alt 7 d'Acht 1939 maidir leis an gCathaoirleach ná le gnáthchomhalta den Choimisiún a ainmníodh faoi fhomhír (i) nó (ii) de mhír (b) d'fho-alt (3) d'alt 4 den Acht sin nó faoi fhomhír (ii) de mhír (b) d'fho-alt (6) d'alt 6 den Acht sin.

11.—Déantar leis seo alt 8 d'Acht 1939 a leasú trí—
(a) “, tar éis dó dul i gcomhairle leis an Aire Airgeadais,” a chur isteach i bhfo-alt (1) i ndiaidh “ó am go ham”, agus
(b) “tar éis dó dul i gcomhairle leis” a chur i bhfo-alt (2) in ionad “le haontú”.

12.—Déantar leis seo an t-alt seo a leanas a chur in ionad alt 9 d'Acht 1939, eadhon:
“9. (1) Féadfaidh an Coimisiún cibé oifigí agus áitribh eile a cheannach, a ghlacadh ar léas, a thógáil nó a fháil ar shlí eile, agus iad a ghléasadh agus a chothabháil, i cibé áiteanna is dóigh leis is gá chun a ndualgais a chomhlíonadh go cuí agus féadfaidh siad aon áitribh a bheidh dílsithe iontu agus is dóigh leis nach mbeidh ag teastáil a thuilleadh chun na críche sin a dhíol, a chur ar léas nó a dhiúscairt ar shlí eile.
(2) Déanfaidh an Coimisiún a luaithe is féidir tar éis an lae cheaptha agus dá éis sin de réir mar is gá duine a cheapadh chun bheith ina phríomh-oifigeach don Choimisiún.
(3) Féadfaidh an Coimisiún cibé oifigigh, seirbhísigh agus gníomhairí, agus cibé méid acu, a cheapadh is dóigh leis an gCoimisiún ó am go ham is gá chun feidhmeanna an Choimisiún a fheidhmiú go cuí agus sealbhóidh gach oifigeach, seirbhíseach agus gníomhaire a cheapfar amhlaidh agus príomh-oifigeach an Choimisiúin oifig ar cibé téarmaí agus faoi réir cibé coinníollacha a chinnfidh an Coimisiún.
(4) Íocfaidh an Coimisiún le hoifigigh an Choimisiúin (lena n-áirítear an príomh-oifigeach), le seirbhísigh agus le gníomhairí an Choimisiúin cibé luach saothair agus cibé liúntais i leith caiteachais a cheapfaidh an Coimisiún ó am go ham agus le toiliú an Aire agus an Aire Airgeadais i gcás an phríomh-oifigigh.
(5) Faoi réir fho-alt (6) den alt seo, ní cheapfar duine faoin alt seo chun bheith ina oifigeach don Choimisiún mura mbeifear tar éis é a roghnú trí chomórtas poiblí.
(6) An ceanglas roghnaithe trí chomórtas poiblí a fhorchuireann fo-alt (5) den alt seo ní bheidh feidhm aige maidir le—
(a) ceapachán is ardú céime do dhuine is oifigeach cheana féin don Choimisiún,
(b) oifig ar gá, i dtuairim an Choimisiúin, saincháilíochtaí chuici nach gnách ag daoine, nó
(c) oifig ar go ceann tréimhsí teoranta, tréimhsí dhá bhliain ar a mhéid, a dhéantar ceapacháin chuici.
(7) Má thagann oifigeach (lena n-áirítear an príomhoifigeach) nó seirbhíseach don Choimisiún chun bheith ina chomhalta de cheachtar Teach den Oireachtas, ansin, ar é a theacht faoi Bhuan-Orduithe an Tí sin chun teideal a bheith aige suí sa Teach sin scoirfidh sé de bheith ina oifigeach nó ina sheirbhíseach den sórt sin.
(8) Aon duine a mbeidh de thuras na huaire teideal aige faoi Bhuan-Orduithe ceachtar Tí den Oireachtas suí sa Teach sin, beidh sé, an fad a bheidh sé i dteideal amhlaidh, dícháilithe chun teacht chun bheith ina oifigeach (lena n-áirítear príomh-oifigeach) nó ina sheirbhíseach don Choimisiún.
(9) Ní bheidh príomh-oifigeach an Choimisiúin ina chomhalta den Choimisiún.
(10) (a) I gcás duine a bheith, díreach roimh thosach feidhme alt 12 den Acht Muc agus Bagúin (Leasú), 1961, ar fostú mar oifigeach nó mar sheirbhíseach don Choimisiún, leanfaidh an duine sin, tar éis tosach feidhme an ailt sin 12, de bheith ar fostú mar oifigeach nó mar sheirbhíseach, de réir mar a bheidh, don Choimisiún, agus beidh sé ar fostú ar cibé téarmaí agus faoi réir cibé coinníollacha a chinnfidh an Coimisiún (lena n-áirítear téarmaí agus coinníollacha maidir le luach saothair agus liúntais i leith caiteachais) is téarmaí agus coinníollacha nach lú fábhar ná iad sin faoina raibh sé ar fostú díreach roimh an tosach feidhme sin, ach féadfar a oifig nó a phost a athrú agus féadfar a dhualgais a athrú nó a athshocrú.
(b) Aon duine a bheidh ar fostú mar oifigeach nó mar sheirbhíseach don Choimisiún díreach roimh thosach feidhme an ailt sin 12, ní chuirfear as an bhfostaíocht sin é gan toiliú an Aire.”

18.—(1) Féadfaidh an tAire ó am go ham, más cuí leis, a ordú don Choimisiún aon cheann de na horduithe dá dtagraítear i bhfo-alt (2) d'alt 34 d'Acht 1939 nó ordú faoi fho-alt (3) den alt sin a dhéanamh ag socrú an ráta tobhaigh faoin alt sin agus féadfaidh sé freisin más cuí leis, in ordachán a bhainfidh le hordú faoin bhfo-alt sin (3), an ráta nó na rátaí tobhaigh a shocrófar san ordú agus an tréimhse a dhéanfar an t-ordú a shonrú.
(2) Is i scríbhinn a thabharfar ordachán faoin alt seo don Choimisiún.
(3) Déanfaidh an Coimisiún de réir ordachán faoin alt seo.

19.—Ní dhéanfar (ach amháin le toiliú an duine i scríbhinn) eolas i dtaobh aon duine a fuarthas chun críche alt 58 d'Acht 1939—
(a) a fhoilsiú ag an gCoimisiún de bhun an ailt sin 58, ná
(b) a thaispeáint ná a thabhairt d'aon duine ach amháin d'oifigeach don Choimisiún a mbeidh baint aige leis i gcúrsa a dhualgais mar oifigeach den sórt sin,
i bhfoirm ná modh a thabharfadh go mbeadh a fhios gur eolas é a bhaineann leis an duine sin nó leis an áitreabh atá á áitiú aige.

21.—Ní dhéanfaidh an Coimisiún ordú faoi alt 54 ná alt 55 d'Acht 1937, ná faoi alt 34 ná alt 36 d'Acht 1939 ná faoi alt 3 d'Acht 1956 gan toiliú an Aire.
Aoisliúntas d'oifigigh agus do sheirbhísigh an Choimisiúin.
22.—(1) Féadfaidh an Coimisiún scéim nó scéimeanna a ullmhú agus a chur faoi bhráid an Aire chun pinsin, aiscí agus liúntais a dheonú, ar scor dóibh, do cibé oifigigh nó seirbhísigh, nó i leith cibé oifigeach nó seirbhíseach, de chuid an Choimisiúin is cuí leis an gCoimisiún.
(2) Socróidh gach scéim den sórt sin an tráth scoir agus na coinníollacha scoir do na daoine uile a mbeidh pinsin, aiscí nó liúntais iníoctha leo nó ina leith faoin scéim ar scor dóibh, agus féadfar tráthanna agus coinníollacha éagsúla a shocrú i leith aicmí éagsúla daoine.
(3) Féadfaidh an Coimisiún tráth ar bith scéim do leasú scéime a cuireadh faoi bhráid an Aire agus a ceadaíodh roimhe sin a ullmhú agus a chur faoi bhráid an Aire.
(4) Déanfaidh an Coimisiún scéim a chuirfear faoi bhráid an Aire faoin alt seo, má cheadaíonn an tAire í le comhthoiliú an Aire Airgeadais, a chur i gcrích de réir a téarmaí.
(5) Má tharlaíonn aon díospóid maidir le héileamh aon duine ar aon phinsean, aisce nó liúntas is iníoctha de bhun scéime faoin alt seo, nó i dtaobh méid an chéanna, cuirfear an díospóid sin faoi bhráid an Aire agus tarchuirfidh seisean chun an Aire Airgeadais í lena cinneadh.
(6) Gach scéim a chuirfear faoi bhráid an Aire agus a cheadófar faoin alt seo leagfar í faoi bhráid gach Tí den Oireachtas a luaithe is féidir é tar éis a ceadaithe agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an scéim a leagan faoina bhráid, rún a rith ag neamhniú na scéime, beidh an scéim ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin scéim.
Onnmhairiú bagúin ag an gCoimisiún.
23.—(1) Féadfaidh an Coimisiún bagún a onnmhairiú de na gráid sin a shonróidh an tAire le toiliú an Aire Airgeadais ó am go ham i bhfoirm taobhanna Wiltshire nó mórghearrtha díobh sin agus an droim ag gabháil leo.
(2) Féadfaidh an Coimisiún ó am go ham a cheangal ar shealbhóirí ceadúnas bagún de cibé grád nó gráid (is grád nó gráid a bheidh sonraithe faoi fho-alt (1) den alt seo) a dhíol leis an gCoimisiún, i cibé riocht a shonróidh sé, agus cibé cainníocht díobh a shonróidh sé, sa cheanglas faoi ghné taobhanna Wiltshire nó mórghearrtha díobh a mbeidh an droim ag gabháil leo agus, de réir mar a shonróidh an Coimisiún—
(i) an bagún a sheachadadh don Choimisiún lena onnmhairiú ag an gCoimisiún, nó
(ii) an bagún a onnmhairiú thar ceann an Choimisiúin go dtí cibé tír nó tíortha nó cibé duine nó daoine nó áit nó áiteanna sa tír nó sna tíortha sin agus de réir cibé coinníollacha, más aon choinníoll é, a shonróidh an Coimisiún.
(3) Íocfaidh an Coimisiún le sealbhóirí ceadúnas ar aon ghné bagúin a dhíolfar leis an gCoimisiún faoin alt seo an praghas is iomchuí ag féachaint do na praghsanna a bheidh socraithe de thuras na huaire faoi fho-alt (4) den alt seo don ghné sin bagúin.
(4) (a) Tar éis dó dul i gcomhairle leis an gCoimisiún, socróidh an tAire ó am go ham i cibé slí agus faoi threoir cibé ábhair is oiriúnach leis praghsanna (de réir an chéad meáchain) gach gné bagúin a dhíolfar leis an gCoimisiún faoin alt seo is bagún de ghrád a bheidh sonraithe faoi fho-alt (1) den alt seo agus é sa riocht a shonróidh an tAire.
(b) Tabharfar fógra i scríbhinn don Choimisiún a luaithe is féidir i dtaobh aon phraghas a shocrófar faoi mhír (a) den fho-alt seo agus i dtaobh na ngrád a shonrófar faoi fho-alt (1) den alt seo.
(5) Comhlíonfaidh sealbhóirí ceadúnas aon cheanglas de chuid an Choimisiúin faoin alt seo agus más rud é, maidir le haon bhagún, go mainneoidh sealbhóir ceadúnais ceanglas de chuid an Choimisiúin faoin alt seo a chomhlíonadh beidh sé ciontach i gcion agus ar é a chiontú ann go hachomair dlífear fíneáil a chur air a ríomhfar de réir cúig phunt in aghaidh gach céad meáchain bagúin ar mhainnigh an sealbhóir an ceanglas a chomhlíonadh ina leith.
(6) I gcás inarb é tuairim an Choimisiúin maidir le bagún a sheachaid sealbhóir ceadúnais don Choimisiún nó a d'onnmhairigh sé thar a cheann de bhun ceanglais faoin alt seo nach bagún den ghrád é nó nach bagún sa riocht é a shonraigh an Coimisiún sa cheanglas, féadfaidh an Coimisiún—
(a) (i) an bagún a chur ar ais chuig sealbhóir an cheadúnais, agus a cheangal ar shealbhóir an cheadúnais an chainníocht chéanna bagúin den ghrád a shonraigh agus sa riocht a shonraigh an Coimisiún sa cheanglas bunaidh a sheachadadh don Choimisiún nó a onnmhairiú thar a cheann, agus
(ii) aon chaillteanas nó costas faoina ndeachaigh an Coimisiún i ndáil leis an mbagún a cuireadh ar ais chuig sealbhóir an cheadúnais a bhaint as an bpraghas is iníoctha ar an mbagún nó ar aon bhagún eile arna sheachadadh don Choimisiún nó arna onnmhairiú thar a cheann ag sealbhóir an cheadúnais, nó
(b) cibé suim is dóigh leis an gCoimisiún is suim réasúnach, ag féachaint do ghrád agus riocht an bhagúin, a bhaint as an bpraghas is iníoctha ar an mbagún faoin alt seo le sealbhóir an cheadúnais nó ar aon bhagún eile arna sheachadadh don Choimisiún nó arna onnmhairiú thar a cheann.
(7) (a) Ní cheanglóidh an Coimisiún ar shealbhóir ceadúnais cainníocht bhagúin de bhreis ar an gcainníocht a bheidh sonraithe sa deimhniú fo-chuóta eachtardhíola (de réir bhrí Chuid III d'Acht 1937) don áitreabh lena mbaineann an ceadúnas a dhíol leis i rith aon tréimhse eachtar-dhíola (de réir bhrí na Coda sin III).
(b) Má tharlaíonn i rith aon tréimhse eachtar-dhíola (de réir bhrí na Coda sin III) go dtairgfidh sealbhóir ceadúnais don Choimisiún chun a dhíolta cainníocht bhagúin faoi ghné taobhanna Wiltshire nó mórghearrtha díobh sin a mbeidh an droim ag gabháil leo agus is de ghrád nó gráid a bheidh sonraithe, agus a bheidh sa riocht a bheidh sonraithe, in aon cheanglas de chuid an Choimisiúin arna dhéanamh i rith na tréimhse sin, ceannóidh an Coimisiún ar an bpraghas is iomchuí ag féachaint do na praghasanna a bheidh socraithe de thuras na huaire faoi fho-alt (4) den alt seo do na gnéithe sin bagúin—
(i) i gcás an chainníocht, dá ndéantaí í a mhéadú den chainníocht (más ann) bhagúin a cheannaigh an Coimisiún cheana féin ón sealbhóir i rith na tréimhse sin, a bheith comhionann leis an gcainníocht, nó níos lú ná an chainníocht, a bheidh sonraithe sa deimhniú fo-chuóta eachtardhíola (de réir bhrí na Coda sin III) in aghaidh na tréimhse sin don áitreabh lena mbaineann an ceadúnas, an bagún go léir, agus
(ii) in aon chás eile, cibé cainníocht (más ann) bhagúin is cuí leo, ag féachaint do na cainníochtaí (más ann) bagúin a d'onnmhairigh an sealbhóir réamhráite an lú lá d'Eanáir, 1960, nó dá éis agus roimh thosach feidhme an Achta seo, ar choinníoll nach lú an chainníocht a cheannófar ná an chainníocht (más ann) a bheadh, dá ndéantaí í a mhéadú de chainníocht (más ann) bhagúin a cheannaigh an Coimisiún cheana féin ón sealbhóir i rith na tréimhse eachtar-dhíola réamhráite, comhionann leis an gcainníocht a bheidh sonraithe sa deimhniú fo-chuóta eachtar-dhíola sin.
(8) Aon bhagún a bheidh sealbhóir ceadúnais tar éis a sheachadadh don Choimisiún nó a onnmhairiú thar a cheann aon tráth faoi alt seo, measfar, chun críocha alt 33 (a cuireadh isteach le hAcht 1956) d'Acht 1937, gur onnmhairíodh é an tráth sin ón áitreabh lena mbaineann an ceadúnas agus go gcomhlíonann sé forálacha aon ordaithe eachtar-dhíola faoi alt 30 (a cuireadh isteach le hAcht 1956) d'Acht 1937 a bhí i bhfeidhm an tráth sin maidir leis an mbagún.
(9) Déanfar airgead a bheidh dlite den Choimisiún i leith bagún a bheifear tar éis a dhíol leis faoin alt seo a íoc as Ciste an Bhagúin (Praghas a Chobhsú) agus déanfar airgead a gheobhaidh an Coimisiún i leith bagún a onnmhaireofar faoin alt seo a íoc leis an gCiste sin.
(10) Cuirfear ceanglais a dhéanfaidh an Coimisiún in iúl do shealbhóirí ceadúnas trí fhógraí i scríbhinn agus seirbheálfar na fógraí de réir fhorálacha Chuid 3 den Phríomh-Acht.
(11) San alt seo ciallaíonn “sealbhóir ceadúnais” duine a shealbhaíonn ceadúnas um leasú nó ceadúnas um leasú agus marú faoi Chuid II den Phríomh-Acht.

24.—(1) Féadfaidh an Coimisiún, le toiliú an Aire, foráil a dhéanamh trí rialacháin i dtaobh—
(a) an modh agus an tslí ina n-ullmhófar bagún a dhíolfar leis faoi alt 23 den Acht seo,
(b) an modh agus an tslí ina bpacálfar bagún a dhíolfar leis faoin alt sin 23 ar a n-áirítear na hábhair agus na pacáistí a bheidh le húsáid le haghaidh na pacála,
(c) an modh agus an tslí ina marcálfar bagún a dhíolfar leis faoin alt sin 23, an modh agus an tslí ina marcálfar na hábhair agus na pacáistí a úsáidfear le haghaidh na pacála, na marcanna a chuirfear agus na nithe a thaispeánfar leis na marcanna sin,
(d) glaineacht agus aimridiú na n-ábhar agus na bpacáistí,
(e) rangú agus grádú lánas na bpacáistí,
(f) deiseanna iompair agus láimhsithe an bhagúin a dhíolfar leis faoin alt sin 23 agus é ar bealach ó áitreabh na ndíoltóirí go dtí áitreabh an Choimisiúin nó go dtí an long, an fheithicil nó an deis iompair ina n-iomprófar é amach as an Stát, agus
(g) feistis, aerú agus glaineacht longa, feithiclí agus deiseanna iompair eile ina ndéanfar bagún a díoladh leis faoin alt sin 23 a iompar amach as an Stát.
(2) Aon duine a sharóidh foráil rialachán faoin alt seo beidh sé ciontach i gcion agus ar a chiontú ann go hachomair dlífear fineáil nach mó ná cúig phunt is fiche a chur air más é an chéad chion aige é agus fíneáil nach mó ná caoga punt más é an dara cion é nó aon chion dá éis sin aige é.
(3) Ní bheidh feidhm ag rialacháin faoi alt 45 nó alt 46 den Phríomh-Acht maidir le bagún lena mbainfidh rialacháin faoin alt seo agus ní bheidh feidhm ag alt 66 den Acht sin, sa mhéid a bhaineann sé le rialacháin faoi na hailt sin 45 agus 46, maidir le bagún lena mbainfidh rialacháin faoin alt seo.
(4) Féadfaidh an Coimisiún cion faoin alt seo a ionchúiseamh.
Cumhacht an Aire chun onnmhairiú bagúin áirithe a thoirmeasc.
25.—(1) D'ainneoin aon ní in alt 65 den Phríomh-Acht, féadfaidh an tAire, le hordú, toirmeasc a chur le bagún de cibé grád nó gráid a shonrófar san ordú faoi ghné taobhanna Wiltshire nó mórghearrtha díobh a mbeidh an droim ag gabháil leo a onnmhairiú, i gcoitinne nó go dtí tír nó tíortha sonraithe, ach amháin ag an gCoimisiún nó thar a gceann.
(2) Féadfaidh an tAire ordú a dhéanfar faoin alt seo, lena n-áirítear ordú faoin bhfo-alt seo, a chúlghairm nó a leasú le hordú.
Bagún agus feoil muice a réamhphacáillena dhíol ar mionreic.
26.—(1) Féadfaidh an tAire, le rialacháin, foráil a dhéanamh i dtaobh—
(a) toirmeasc a chur le réamhphacáil bagúin agus feoil muice ach amháin faoi réim agus de réir cheadúnais (dá ngairtear ceadúnas réamhphacála san alt seo),
(b) an tAire do dheonú agus do chúlghairm ceadúnas réamhphacála,
(c) an tAire do chur coinníollacha ag gabháil le ceadúnais réamhphacála agus an tAire do leasú agus do chúlghairm na gcoinníollacha,
(d) modh agus slí réamhphacála bagúin agus feoil muice eile lena n-áirítear na hábhair fillteála agus na pacáistí a bheidh le húsáid le haghaidh na réamhphacála,
(e) glaineacht agus aimridiú na n-ábhar fillteála agus na bpacáistí, agus
(f) rangú agus grádú lánas na bpacáistí,
agus féadfaidh rialacháin faoin alt seo a fhoráil go mbeidh feidhm ag forálacha éagsúla díobh maidir le gnéithe éagsúla bagúin agus feoil muice eile.
(2) Aon duine a sháróidh foráil de rialacháin a dhéanfar faoin alt seo beidh sé ciontach i gcion agus ar é a chiontú ann go hachomair dlífear fineáil nach mó ná cúig phunt is fiche a chur air más é an chéad chion aige é agus fíneáil nach mó ná caoga punt más é an dara cion nó aon chion dá éis sin aige é.
(3) Na rialacháin a rinneadh faoi alt 45 den Phríomh-Acht maidir le bagún a phacáil agus na hábhair agus na pacáistí a bheidh le húsáid le haghaidh na pacála ní bheidh feidhm acu maidir le pacáil bagúin lena mbainfidh rialacháin a dhéanfar faoin alt seo ná leis na hábhair ná na pacáistí a bheidh le húsáid sa phacáil.
(4) San alt seo ciallaíonn “réamhphacáil”, i ndáil le bagún nó feoil muice eile, an bagún nó an fheoil muice eile a ullmhú agus a phacáil, in áit seachas an t-áitreabh a mbeidh sé beartaithe an bagún nó an fheoil muice eile a dhíol ar mionreic ann, i slí nach gá aon ullmhú ná pacáil eile ar an mbagún ná ar an bhfeoil muice eile sula ndíolfar ar mionreic é nó chun é a dhíol ar mionreic.
Cumhachtaí an Choimisiúin maidir le margaí a fhorbairt i gcóir bagúin agus feoil muice eile agus táirgí feoil muice.
27.—Féadfaidh an Coimisiún gach ní nó aon ní acu seo a leanas a dhéanamh:
(a) poiblíocht in aon fhoirm nó meán a chur ar fáil, nó socrú a dhéanamh lena chur ar fáil nó cabhrú, le hairgead nó ar shlí eile lena chur ar fáil, sa Stát agus lasmuigh den Stát chun daoine a spreagadh chun tuilleadh bagúin agus feoil muice eile agus táirgí feoil muice a táirgeadh sa Stát a thomhailt agus a úsáid agus chun dlús a chur le méadú ar na cainníochtaí bagúin agus feoil muice eile agus táirgí feoil muice a onnmhaireofar as an Stát,
(b) fiosrúcháin, suirbhéireachtaí, anailíseanna, staidéir agus tuarascálacha maidir le margaí, margaí ionchasacha agus cúrsaí margaidh do bhagún agus d'fheoil muice eile agus do tháirgí feoil muice sa Stát agus lasmuigh den Stát a dhéanamh nó socrú a dhéanamh faoina chomhair sin,
(c) aithbhreithnithe, suirbhéireachtaí agus staidéir fhorleitheadúla, thréimhsiúla maidir le trádáil i mbagún agus i bhfeoil muice eile agus i dtáirgí feoil muice lasmuigh den Stát a dhéanamh nó socrú a dhéanamh faoina chomhair sin,
(d) obair thurgnamhach agus forbartha agus fiosrúcháin, maidir le soláthar cineálacha nua agus feabhsaithe bagúin agus feoil muice eile agus táirgí feoil muice, pacála le haghaidh bagúin agus feoil muice eile agus táirgí feoil muice agus modhanna chun bagún agus feoil muice eile agus táirgí feoil muice a thairiscint le haghaidh an mhargaidh, a dhéanamh nó socrú a dhéanamh faoina chomhair sin agus cabhrú, le hairgead nó ar shlí eile chuige sin,
(e) seomraí taispeántais, buróanna eolais agus bunachais dá samhail a bheidh beartaithe chun dlús a chur le tuilleadh bagúin agus feoil muice eile agus táirgí feoil muice a thomhailt agus dlús a chur le méadú ar na cainníochtaí bagúin agus feoil muice eile agus táirgí feoil muice a onnmhaireofar as an Stát a bhunú, a fheistiú agus a oibriú, agus socrú a dhéanamh chun iad a bhunú, a fheistiú agus a oibriú, agus cabhrú leis an oibriú sin, le hairgead nó ar shlí eile, sa Stát agus lasmuigh den Stát,
(f) paimfléid, fógraí, irisí, iriseáin, nuachtáin, irisleabhair agus ábhar eile dá samhail is oiriúnach leis a fhoilsiú agus a imdháil, nó socrú a dhéanamh lena bhfoilsiú agus lena n-imdháil, sa Stát agus lasmuigh den Stát, chun daoine a spreagadh chun tuilleadh bagúin agus feoil muice eile agus táirgí feoil muice a thomhailt agus chun dlús a chur le méadú ar na cainníochtaí bagúin agus feoil muice eile agus táirgí feoil muice a onnmhaireofar as an Stát,
(g) onnmhairiú bagúin agus feoil muice eile agus táirgí feoil muice a chur chun cinn, a urasú, a spreagadh, a chomhoirdniú agus a fhorbairt, agus cabhrú (le hairgead nó ar shlí eile) leis an onnmhuiriú sin, i cibé cuma is dóigh leis an gCoimisiún is gá nó is inmhianaithe,
(h) aon ghníomhaíocht a mheasfaidh an Coimisiún dá dtiocfaidh nó ar dócha go dtiocfaidh di, go díreach nó go neamhdhíreach, méadú ar na cainníochtaí bagúin agus feoil muice eile agus táirgí feoil muice a onnmhaireofar as an Stát a ghabháil de láimh nó a chur chun cinn nó socrú a dhéanamh agus cabhrú, le hairgead nó ar shlí eile, lena gabháil de láimh nó a cur chun cinn.
Deontais don Choimisiún.
28.—(1) Gach bliain airgeadais, féadfar deontas nó deontais de cibé méid nó méideanna a shocróidh an tAire, le toiliú an Aire Airgeadais tar éis dó dul i gcomhairle leis an gCoimisiún maidir le clár caiteachais an Choimisiúin don bhliain airgeadais sin, a íoc leis an gCoimisiún as airgead a sholáthróidh an tOireachtas.
(2) Úsáidfidh an Coimisiún deontas faoin alt seo, faoi réir cibé coinníollacha a shonróidh an tAire i scríbhinn ó am go ham le toiliú an Aire Airgeadais, chun aon chaillteanas a ghlanadh faoina rachaidh an Coimisiún i ndáil le honnmhairiú bagúin agus ní úsáidfear é chun aon críche eile.
(3) Íocfaidh an Coimisiún deontas faoin Acht seo isteach i gCiste an Bhagúin (Praghas a Chobhsú).
Iasachtaí a ráthú.
29.—(1) Féadfaidh an tAire, más oiriúnach leis agus le toiliú an Aire Airgeadais, iasacht chun an Choimisiúin a ráthú.
(2) Aon uair a ráthóidh an tAire iasacht faoin alt seo, féadfaidh sé ráthaíocht a thabhairt, i cibé foirm agus slí agus ar cibé téarmaí agus coinníollacha a cheadóidh an tAire Airgeadais, go n-ais íocfaidh an Coimisiún go cuí príomhshuim na hiasachta nó go n-íocfar ús ar an iasahct nó go ndéanfar an phríomhshuim sin a aisíoc agus an t-ús sin a íoc.
(3) Ní dhéanfaidh an tAire na cumhachtaí a thugtar le fo-ailt (1) agus (2) den alt seo a fheidhmiú i slí gur mó ná £500,000 an méid, nó an méid comhiomlán, príomhshuime a dhlífidh sé aon tráth a íoc ar scór aon ráthaíochta nó ráthaíochtaí faoi na fo-ailt sin a bheidh i bhfeidhm de thuras na huaire i dteannta méid na príomhshuime (más ann) a bheidh íoctha cheana féin ag an Aire ar scór aon ráthaíocht den sórt sin agus nach mbeidh aisíoctha ag an gCoimisiún.
(4) I gcás ina dtabharfar nó inar tugadh ráthaíocht faoin alt seo, tabharfaidh an Coimisiún don Aire, má fhoréilíonn an tAire é, cibé urrús a shonrófar san fhoréileamh chun aisíoc aon airgid a urrú don Aire a bheidh sé faoi dhliteanas a íoc nó tar éis a íoc faoin ráthaíocht.
(5) A luaithe is féidir é tar éis deireadh gach bliana airgeadais, leagfaidh an tAire faoi bhráid gach Tí den Oireachtas ráiteas ina luafar, maidir le gach ráthaíocht faoin alt seo a tugadh i rith na bliana sin nó a tugadh aon tráth roimh thosach, agus a bhí i bhfeidhm i dtosach, na bliana sin—
(a) sonraí na ráthaíochta,
(b) má rinne an tAire aon íocaíocht faoin ráthaíocht roimh dheireadh na bliana sin, méid na híocaíochta agus an méid a aisíocadh (má aisíocadh) leis an Aire ar scór na híocaíochta,
(c) an méid príomhshuime a bhí faoi réim na ráthaíochta agus gan aisíoc i ndeireadh na bliana sin.
(6) Déanfaidh an Coimisiún aon airgead a d'íoc an tAire faoi ráthaíocht faoin alt seo a aisíoc leis an Aire (maraon le hús air, má cheanglaíonn an tAire Airgeadais sin, de réir cibé rátaí a cheapfaidh an tAire Airgeadais) laistigh de dhá bhliain ó dháta an t-airgead a airleacan faoi fho-alt (10) den alt seo.
(7) Má bhíonn an t-airgead go léir, nó aon chuid den airgead, a cheanglaíonn fo-alt (6) den alt seo a aisíoc leis an Aire gan aisíoc de réir an fho-ailt sin, déanfar an méid a bheidh gan aisíoc amhlaidh a aisíoc leis an bPríomh-Chiste as airgead a sholáthróidh an tOireachtas.
(8) D'ainneoin airgead a sholáthar faoi fho-alt (7) den alt seo chun suim a aisíoc leis an bPríomh-Chiste, leanfaidh an Coimisiún de bheith faoi dhliteanas don Aire i leith na suime sin agus déanfaidh an Coimisiún an tsuim sin (maraon le hús uirthi, má cheanglaíonn an tAire Airgeadais é, de réir cibé rátaí a cheapfaidh an tAire Airgeadais) a aisíoc leis an Aire cibé tráthanna agus i cibé tráthchodanna a cheapfaidh an tAire Airgeadais agus, mura ndéanfar aisíoc mar a dúradh, beidh sé, gan dochar d'aon mhodh gnóthaithe eile, inghnóthaithe mar fhiach gnáth-chonartha in aon chúirt dlínse inniúla.
(9) Déanfar airgead a aisíocfaidh an Coimisiún leis an Aire nó a ghnóthóidh an tAire ón gCoimisiún faoin alt seo a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste.
(10) Is as an bPríomh-Chiste nó a thoradh fáis a airleacfar an t-airgead go léir a theastóidh ó am go ham ón Aire chun suimeanna a íoc a thiocfaidh chun bheith iníoctha aige faoin alt seo.
(11) Féadfaidh an tAire Airgeadais, d'fhonn soláthar a dhéanamh faoi chomhair airleacan as an bPríomh-Chiste faoin alt seo, aon suim nó suimeanna a thógáil ar iasacht ó dhuine ar bith agus féadfaidh sé, chun críocha na hiasachta sin, urrúis a bhunú agus a eisiúint agus iad faoi cibé ráta úis agus faoi réir cibé coinníollacha i dtaobh aisíoca, fuascailte nó eile is oiriúnach leis agus íocfaidh sé isteach sa Státchiste an t-airgead a thógfar ar iasacht amhlaidh.
(12) Déanfar príomhshuim agus ús aon urrús a eiseofar faoin alt seo agus na costais faoina rachfar i ndáil leis na hurrúis sin a eisiúint a mhuirearú ar an bPríomh-Chiste nó a thoradh fáis agus beidh siad iníoctha as an gcéanna.

30.—Íocfar as Ciste Ginearálta an Choimisiúin Muc agus Bagúin an t-airgead go léir a cheanglaítear nó a cheadaítear leis an Acht seo a íoc ag an gCoimisiúin (seachas airgead a cheanglaítear leis an Acht seo a íoc as Ciste an Bhagúin (Praghas a Chobhsú) agus fós an caiteachas go léir faoina rachaidh an Coimisiún faoin Acht seo.

31.—Gach ordú agus rialachán a dhéanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú nó an rialachán, de réir mar a bheidh, a leagan faoina bhráid rún a rith ag neamhniú an ordaithe nó an rialacháin, de réir mar a bheidh, beidh an t-ordú nó an rialachán, de réir mar a bheidh, ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin gcéanna.

Aisghairm.
33.—(1) Faoi réir fho-alt (2) den alt seo, déantar leis seo na hachtacháin a luaitear i gcolún (2) den Sceideal a ghabhann leis an Acht seo a aisghairm a mhéid a luaitear i gcolún (3) den Sceideal sin.
(2) Ní bheidh feidhm ag an aisghairm ar ailt 40 go 43 d'Acht 1939 maidir le bagún arna onnmhairiú nó arna dhíol roimh thosach feidhme an ailt seo.

34.—(1) Féadfar an tAcht Muc agus Bagúin (Leasú), 1961, a ghairm den Acht seo.

PIGS AND BACON (AMENDMENT) ACT, 1961.
Interpretation.
1.—(1) In this Act—
“the Act of 1937.” means the Pigs and Bacon Act, 1937;
“the Act of 1939” means the Pigs and Bacon (Amendment) Act, 1939;
“the Act of 1956” means the Pigs and Bacon (Amendment) Act, 1956;
“the Commission” means the Pigs and Bacon Commission;
“the Principal Act” means the Pigs and Bacon Act, 1935.
(2) The Pigs and Bacon Acts, 1935 to 1956, and this Act shall be construed together as one Act.
Commencement.
2.—This Act shall come into operation on such day or days as, by order or orders made by the Minister under this section, may be fixed therefor either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions.
Amendment of section 65 of the Principal Act.
3.—Section 65 of the Principal Act is hereby amended by the insertion in subsection (1) after “any person” of “, other than the Pigs and Bacon Commission or a person exporting bacon on its behalf,”.
Amendment of section 30 of the Act of 1937.
4.—Section 30 (inserted by the Act of 1956) of the Act of 1937 is hereby amended by—
(a) the insertion after “bacon” in subparagraph (i) of paragraph (b) of “or of a particular type of bacon or specified quantities of particular types of bacon, defined in such manner as the Commission thinks fit and specifies in the order,”,
(b) the substitution of the following subparagraphs for subparagraphs (ii) and (iii) of the said paragraph (b), namely:
“(ii) appoint in respect of that period an external-sales quota of bacon or of a particular type or particular types of bacon (defined in such manner as the Commission thinks fit and specifies in the order) which shall be related, in such manner as the Commission thinks fit and specifies in the order, to the quantity or quantities of bacon or of a particular type or types of bacon (defined in such manner as the Commission thinks fit and specifies in the order) produced at licensed premises in a particular period, or
(iii) appoint in respect of that period an external-sales quota of bacon or of a particular type or particular types of bacon (defined in such manner as the Commission thinks fit and specifies in the order) which shall be related, in such manner as the Commission thinks fit and specifies in the order, to the number or numbers of pigs or of a particular type or types of pig (defined in such manner as the Commission thinks fit and specifies in the order) slaughtered at licensed premises in a particular period, and”,
(c) the insertion in paragraph (c) after “bacon” of “except such part (if any) thereof as may be specified in the order”, and
(d) the insertion of the following subsection, namely:
“(2) When appointing any external-sales quota of bacon under paragraph (b) of the preceding subsection of this section, the Commission shall have regard to the following matters, namely:
(a) the capacity of the markets (both home and export) for bacon,
(b) the supply of pigs available or likely to be available to licensees for slaughter,
(c) the stock of bacon on hands,
(d) the desirability of continuity in the supply of bacon to export markets, and
(e) such other matters as the Commission considers relevant.”.
Amendment of section 33 of the Act of 1937.
5.—(1) Section 33 (inserted by the Act of 1956) of the Act of 1937 is hereby amended by—
(a) the substitution of “than the quantity required by the certificate to be exported from” for “than the external-sales sub-quota for” in paragraph (b) of subsection (1),
(b) the substitution of “five pounds” for “two pounds” and of “of the quantity required by the certificate to be exported from” for “of the external-sales sub-quota for” in the said subsection (1), and
(c) the substitution of “five pounds” for “two pounds” in subsection (2).
(2) Subsection (1) of this section shall not apply in any case where the external-sales sub-quota certificate referred to in the said section 33 was served before the commencement of this section.
Amendment of section 2 of the Act of 1939.
6.—Section 2 of the Act of 1939 is hereby amended by the insertion in the definition of “authorised officer of the Commission” in subsection (1) after “person” of “(other than a member of the Commission)”.
Amendment of section 4 of the Act of 1939.
7.—Section 4 of the Act of 1939 is hereby amended by the substitution of the following subsection for subsection (3), namely:
“(3) (a) The Commission shall consist of seven members, namely a chairman (in this Act referred to as the Chairman) and six ordinary members (in this Act referred to as ordinary members).
(b) The ordinary members shall comprise—
(i) two persons each of whom is—
(I) a person nominated to be an ordinary member by a body or bodies declared by the Minister by order to be the nominating body or nominating bodies for the purposes of this subparagraph (being a body or bodies that he considers to be representative of the interests of pig producers) and as respects whose nomination notification in writing is delivered to the Minister (together with a statement in writing signed by the person signifying his consent to the nomination) not less than twenty-one days before the day on which the term of office of that person as an ordinary member, if he became an ordinary member, would commence, or
(II) a person nominated to be an ordinary member under paragraph (c) of this subsection,
(ii) three persons each of whom is—
(I) a person nominated to be an ordinary member by a body or bodies declared by the Minister by order to be the nominating body or nominating bodies for the purposes of this subparagraph (being a body or bodies that he considers to be representative of the interests of curers of bacon) and as respects whose nomination notification in writing is delivered to the Minister (together with a statement in writing signed by the person signifying his consent to the nomination) not less than twenty-one days before the day on which the term of office of that person as an ordinarymember, if he became an ordinary member, would commence, or
(II) a person nominated to be an ordinary member under paragraph (c) of this subsection and
(iii) one person nominated by the Minister who is an officer of the Minister.
(c) If in any year, owing to the failure of a body or bodies referred to in subparagraph (i) or subparagraph (ii), as the case may be, of paragraph (b) of this subsection to nominate a person or to comply with the provisions of the said subparagraph (i) or (ii), as the case may be, the required number of persons is not nominated under those subparagraphs, the Minister shall, before the day on which the term of office of persons nominated as ordinary members under the said paragraph (b) in that year commences, nominate a person or persons, as the case may be, to be an ordinary member or ordinary members and the person or persons so nominated shall—
(i) in case the failure was of a body or bodies referred to in the said subparagraph (i), be a person or persons whom the Minister considers to be representative of the interests of pig producers, and
(ii) in case the failure was of a body or bodies referred to in the said subparagraph (ii), be a person or persons whom the Minister considers to be representative of the interests of curers of bacon.
(d) The Minister may by order revoke or amend an order under this subsection including an order under this paragraph.”.
Chairman of the Commission.
8.—The following section is hereby substituted for section 5 of the Act of 1939, namely:
“5.—(1) (a) The Minister shall before the appointed day appoint a person to be the Chairman and thereafter as occasion requires the ordinary members shall appoint a person to be the Chairman.
(b) The ordinary members shall determine the procedure for the selection of a person for appointment as Chairman, and if the ordinary members do not determine the procedure or if a person is not selected in accordance with the procedure, the Chairman shall be selected by means of an election held among the ordinary members at a meeting of the ordinary members and the provisions of paragraphs (a) to (h) of subsection (1) of section 43 of the Local Government Act, 1941, shall apply in relation to the election as if the reference in the said paragraph (a) to a member or members were a reference to a person or persons and as if the subsequent references in that subsection to members were references to ordinary members.
(c) The chief officer of the Commission shall deliver to the Minister notification in writing of the appointment of a Chairman by the ordinary members together with a statement in writing signed by the person signifying his consent to the appointment.
(2) (a) The Chairman appointed before the appointed day shall, unless he sooner dies, resigns, becomes disqualified or is removed from office, hold office for a period of one year commencing on the appointed day.
(b) Every subsequent Chairman shall, unless he sooner dies, resigns, becomes disqualified or is removed from office, hold office for a period of three years commencing on the day next following the day on which the Chairman who immediately preceded him in the office of Chairman, ceased to hold office.
(3) A person holding the office of Chairman may at any time resign his office by letter addressed, in the case of a resignation occurring during the year commencing on the appointed day, to the Minister, and, in the case of any other resignation, to the chief officer of the Commission, and the resignation shall take effect as on and from the date of the receipt of the letter by the Minister or the chief officer, as the case may be, and the person shall be eligible for re-appointment as Chairman.
(4) (a) The Minister may at any time during the year commencing on the appointed day remove the Chairman from office.
(b) The Minister may, at any time after the expiration of the year commencing on the appointed day, at the request of a majority of the ordinary members, remove the Chairman from office if, in the opinion of the Minister, the Chairman is permanently incapacitated, through ill-health, from performing the duties of his office.
(5) (a) Where the Chairman becomes a member of either House of the Oireachtas, he shall, upon his becoming entitled under the Standing Orders of that House to sit therein, cease to be Chairman.
(b) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein, shall, while so entitled, be disqualified from being Chairman.
(6) The Chairman shall be disqualified from holding and shall cease to hold office if he is adjudged bankrupt, or makes a composition or arrangement with creditors, or is sentenced by a court of competent jurisdiction to suffer imprisonment or penal servitude or ceases to be ordinarily resident in the State or absents himself, otherwise than with the permission of the Commission or through illness, during any period of three consecutive months, from every meeting of the Commission held during that period.
(7) (a) Where a casual vacancy occurs in the office of Chairman, the chief officer of the Commission shall, as soon as may be, notify the Minister thereof in writing and the vacancy shall—
(i) in the case of a casual vacancy occurring during the year commencing on the appointed day, be filled by appointment by the Minister, and
(ii) in the case of a casual vacancy occurring after the expiration of the year commencing on the appointed day, be filled by appointment by the ordinary members,
and the person so appointed shall hold office for the remainder of the period for which his predecessor, if he had continued to be Chairman, would have held office and shall, if he is an ordinary member, be deemed on such appointment to have resigned his office as an ordinary member.
(b) The chief officer of the Commission shall be notified in writing as soon as may be of an appointment under subparagraph (i) of paragraph (a) of this subsection and the Minister shall be notified in writing by the chief officer of the Commission of an appointment under subparagraph (ii) of the said paragraph (a) and, in each case, the term of office of the person appointed under the said paragraph (a) shall commence on the date of such notification.
(8) Where the term of office of the Chairman expires by the effluxion of time he shall be eligible for re-appointment.
(9) Where immediately before the commencement of section 8 of the Pigs and Bacon (Amendment) Act, 1961, a person holds the office of Chairman, that person shall continue to hold office until the day before the appointed day and shall be deemed to have been appointed by the Minister under subsection (1) of this section before the appointed day to be the Chairman.
(10) (a) Whenever the Chairman is through ill-health or other sufficient cause temporarily incapacitated from performing the duties of his office, the ordinary members shall appoint a person (being one of the ordinary members) to perform during the incapacity the duties of the Chairman and the person so appointed shall during the incapacity have all the powers of the Chairman and be deemed for the purposes of this Act to be the Chairman, and shall also be deemed during the incapacity not to be an ordinary member.
(b) There shall be paid by the Commission to any person appointed under this subsection such remuneration and such allowances for expenses as the Minister, after consultation with the Minister for Finance, may appoint.
(11) If the person appointed before the appointed day to be the Chairman dies before that day, he shall be deemed, for the purposes of subsection (7) of this section, to have died on the appointed day, and, if a person appointed by the ordinary members to be the Chairman, dies before the commencement of his term of office as Chairman, there shall, on the day on which such term of office would have commenced, be deemed to be a casual vacancy in the office of Chairman
(12) In this Part of this Act ‘appointed day’ means the day appointed by the Minister by order made under this subsection to be the appointed day for the purposes of this Part of this Act.”
Ordinary members of the Commission.
9.—The following section is hereby substituted for section 6 of the Act of 1939, namely:
“6 (1) The ordinary members shall, unless they sooner die, resign, become disqualified or are removed from office, hold office for a period of three years commencing, in the case of members nominated before the appointed day, on the appointed day and, in the case of subsequent members, on the day next following the day on which the members who immediately preceded them in office ceased to hold office.
(2) A person who is an ordinary member may at any time resign his office by letter addressed to the chief officer of the Commission and the resignation shall take effect as on and from the date of the receipt of the letter by the chief officer and the person shall be eligible for re-nomination as a member.
(3) (a) Where an ordinary member becomes a member of either House of the Oireachtas, he shall, upon his becoming entitled under the Standing Orders of that House to sit therein, cease to be an ordinary member.
(b) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein, shall, while so entitled, be disqualified from being an ordinary member.
(4) An ordinary member shall be disqualified from holding and shall cease to hold office if he is adjudged bankrupt, or makes a composition or arrangement with creditors, or is sentenced by a court of competent jurisdiction to sufferimprisonment or penal servitude or ceases to be ordinarily resident in the State or absents himself, otherwise than with the permission of the Commission or through illness, during any period of three consecutive months, from every meeting of the Commission held during that period.
(5) (a) The Minister may at any time remove an ordinary member, being an officer of the Minister nominated by the Minister, from office.
(b) The Minister may at any time remove a person who is an ordinary member from office at the request of the body or bodies that nominated the person as an ordinary member or whose failure to nominate a person or to comply with the provisions of paragraph (b) of subsection (3) of section 4 of this Act occasioned the nomination of the person if, in the opinion of the Minister, the member is permanently incapacitated through ill-health, from performing the duties of his office.
(6) (a) Where a casual vacancy occurs among the ordinary members, the chief officer shall, as soon as may be, notify in writing—
(i) the Minister, and
(ii) if the member occasioning the vacancy was nominated under paragraph (b) of subsection (3) of section 4 of this Act, the body or bodies that nominated or whose failure to nominate a person or to comply with the provisions of the said paragraph (b) occasioned the nomination of the person.
(b) A casual vacancy occurring among the ordinary members shall be filled—
(i) in case the member occasioning the vacancy was an officer of the Minister nominated by the Minister under subparagraph (iii) of the said paragraph (b), by the nomination by the Minister of an officer of the Minister, and
(ii) in case the member occasioning the vacancy was nominated under subparagraph (i) or subparagraph (ii) of the said paragraph (b)—
(I) by the nomination of a person referred to in the subparagraph aforesaid under which the member was nominated, within thirty days after the day on which notification of the vacancy was received by the body or bodies aforesaid from the chief officer of the Commission, and the delivery to the Minister, within forty days after the day on which the notification aforesaid was so received, of notification in writing of the nomination together with a statement in writing signed by the person signifying his consent to the nomination, or
(II) in case the body or bodies entitled to nominate a person to fill a casual vacancy fails or fail to nominate a person or to comply with the provisions of this paragraph, by the nomination by the Minister—
(A) in case the body or bodies aforesaid is or are the body or bodies referred to in the said subparagraph (i), of a person whom the Minister considers to be representative of the interests of pig producers, and
(B) in case the body or bodies aforesaid is or are the body or bodies referred to in the said subparagraph (ii), of a person whom the Minister considers to be representative of the interests of curers of bacon.
(c) The chief officer of the Commission shall be notified in writing as soon as may be of a nomination by the Minister under this subsection and the term of office of an ordinary member nominated under this subsection shall commence—
(i) in case the member was nominated by the Minister, on the date of such notification, and
(ii) in any other case, on the date of the receipt by the Minister of the notification and statement referred to in paragraph (b) of this subsection or, if those documents are received on different days, on the date of the receipt of the document which is last received.
(d) A person nominated as an ordinary member to fill a casual vacancy among the ordinary members shall hold office for the remainder of the period for which the member occasioning the vacancy, if he had continued to be an ordinary member, would have held office.
(7) Where the term of office of an ordinary member expires by the effluxion of time he shall be eligible for re-nomination.
(8) If a person nominated before the appointed day to be an ordinary member dies before that day, he shall be deemed for the purposes of subsection (6) of this section to have died on the appointed day, and if a person nominated subsequently to be an ordinary member dies before the commencement of his term of office as an ordinary member, there shall, on the day on which such term of office would have commenced, be deemed to be a casual vacancy among the ordinary members.
(9) Where immediately before the commencement of section 9 of the Pigs and Bacon (Amendment) Act, 1961, a person holds office as an ordinary member, that person shall hold office until the day before the appointed day and shall then cease to hold office.”
Restriction of section 7 of the Act of 1939.
10.—Section 7 of the Act of 1939 shall not apply in relation to the Chairman or an ordinary member of the Commission nominated under subparagraph (i) or (ii) of paragraph (b) of subsection (3) of section 4 of that Act or subparagraph (ii) of paragraph (b) of subsection (6) of section 6 of that Act.
Amendment of section 8 of the Act of 1939.
11.—Section 8 of the Act of 1939 is hereby amended by—
(a) the insertion in subsection (1) after “Minister” of “, after consultation with the Minister for Finance,”, and
(b) the substitution in subsection (2) of “after consultation with” for “with the approval of”.
Offices and staff of the Commission.
12.—The following section is hereby substituted for section 9 of the Act of 1939, namely:
“9. (1) The Commission may purchase, take on lease, build or otherwise acquire and may equip and maintain such offices and other premises in such places as it considers necessary for the due performance of its functions and may sell, lease or otherwise dispose of any premises vested in it which it considers to be no longer necessary for that purpose.
(2) The Commission shall as soon as may be after the appointed day and thereafter as occasion requires appoint a person to be chief officer of the Commission.
(3) The Commission may appoint such and so many officers, servants and agents as the Commission shall from time to time consider necessary for the due performance of its functions and every officer, servant and agent so appointed and the chief officer of the Commission shall hold office upon such terms and subject to such conditions as the Commission shall determine.
(4) There shall be paid by the Commission to the officers (including the chief officer), servants and agents of the Commission such remuneration and allowances for expenses as the Commission may from time to time appoint with, in the case of the chief officer, the consent of the Minister and the Minister for Finance.
(5) Subject to subsection (6) of this section, a person shall not be appointed under this section to be an officer of the Commission unless he has been selected by means of a public competition.
(6) The requirement under subsection (5) of this section of being selected by means of a public competition shall not apply in relation to—
(a) an appointment consisting of the promotion of a person who is already an officer of the Commission,
(b) an office for which, in the opinion of the Commission, specialised qualifications not commonly held are required, or
(c) an office to which appointments are made for limited periods only, being periods not exceeding two years.
(7) Where an officer (including the chief officer) or servant of the Commission becomes a member of either House of the Oireachtas, he shall, upon his becoming entitled under the Standing Orders of that House to sit therein, cease to be such officer or servant.
(8) A person who is for the time being entitled under the Standing Orders of either House of the Oireachtas to sit therein, shall, while so entitled, be disqualified from becoming an officer (including chief officer) or servant of the Commission.
(9) The chief officer of the Commission shall not be a member of the Commission.
(10) (a) Where immediately before the commencement of section 12 of the Pigs and Bacon (Amendment) Act, 1961, a person is employed as an officer or servant of the Commission, that person, after the commencement of the said section 12, shall continue to be employed as an officer or servant, as the case may be, of the Commission and shall be employed on such terms and subject to such conditions as the Commission may determine (including terms and conditions in relation to remuneration and allowances for expenses) being terms and conditions not less favourable than those subject to which he was employed immediately before such commencement, but the office or position held by him may be changed and his duties may be changed or re-arranged.
(b) A person who, immediately before the commencement of the said section 12, is employed as an officer or servant of the Commission shall not be removed from such employment without the consent of the Minister.”
Amendment of section 11 of the Act of 1939.
13.—Section 11 of the Act of 1939 is hereby amended by the insertion in subsection (3) after “this Act” of “or the Pigs and Bacon (Amendment) Act, 1961,”.
Amendment of section 12 of the Act of 1939.
14.—Section 12 of the Act of 1939 is hereby amended by—
(a) the substitution of “three” for “two” in subsection (1),
(b) the substitution of “or more vacancies”for “vacancy”in subsection (4), and
(c) the deletion in subsection (5) of “with the approval of the Minister”
Amendment of section 14 of the Act of 1939.
15.—Section 14 of the Act of 1939 is hereby amended by the insertion in subsection (2) after “Chairman” of “or an ordinary member authorised by the Commission to act in that behalf and the signature of an officer of the Commission authorised by the Commission to act in that behalf.”
Amendment of section 15 of the Act of 1939.
16.—Section 15 of the Act of 1939 is hereby amended by the substitution of the following subsection for subsection (1), namely:
“(1) The Commission shall—
(a) keep, in such form as may be approved by the Minister with the concurrence of the Minister for Finance, all proper and usual accounts of all moneys received or expended by it, and
(b) as soon as may be after the end of each year submit its accounts for that year, a balance sheet as of the last day of that year and a statement of accounts for that year to the Comptroller and Auditor-General who shall audit the accounts and make a report thereon and on the other documents submitted to him, and
(c) as soon as may be after audit under this section of its accounts, send to the Minister a copy of the statement of accounts and the balance sheet certified by the Comptroller and Auditor-General and a copy of the Comptroller and Auditor-General's report and the Minister shall cause copies of those documents to be laid before each House of the Oireachtas, and
(d) as soon as may be after the laying aforesaid, send copies of the documents of which copies have been laid to every licensee.”.
Amendment of section 19 of the Act of 1939.
17.—(1) Section 19 of the Act of 1939 is hereby amended by the substitution of “chief officer” for “Secretary” in subsection (2).
(2) A certificate given under the said subsection (2) before the commencement of this section shall have effect, on such commencement, as if it purported to be under the hand of the chief officer of the Commission.
Orders under section 34 of the Act of 1939.
18.—(1) The Minister may from time to time, if he so thinks fit, direct the Commission to make any of the orders referred to in subsection (2) of section 34 of the Act of 1939 or an order under subsection (3) of that section fixing the rate of levy under that section and may also, if he thinks fit, specify, in a direction relating to an order under the said subsection (3), the rate or rates of levy to be fixed in the order and the period within which the order is to be made.
(2) A direction under this section shall be given to the Commission in writing.
(3) The Commission shall comply with a direction under this section.
Restriction on disclosure of information obtained for purposes of section 58 of the Act of 1939.
19.—Information in relation to any person obtained for the purpose of section 58 of the Act of 1939 shall not (except with the consent in writing of the person) be—
(a) published by the Commission pursuant to the said section 58, or
(b) shown or communicated to any person other than an officer of the Commission concerned therewith in the course of his duties as such officer,
in such form or manner as to enable the information to be identified as information relating to that person or to premises occupied by him.
Amendment of section 5 of the Act of 1956.
20.—Section 5 of the Act of 1956 is hereby amended by the insertion in subsection (1) after “Act of 1939,” of “where the Minister is of opinion that there are moneys in the General Fundthat are not required for the purposes of that fund and so informs the Commission in writing or”.
Consent of the Minister to the making of certain orders by the Commission.
21.—The Commission shall not make an order under section 54 or section 55 of the Act of 1937, section 34 or section 36 of the Act of 1939 or section 3 of the Act of 1956 without the consent of the Minister.
Superannuation of officers and servants of the Commission.
22.—(1) The Commission may prepare and submit to the Minister a scheme or schemes for the granting of pensions, gratuities and other allowances on retirement to or in respect of such officers or servants of the Commission as it may think fit.
(2) Every such scheme shall fix the time and conditions of retirement for all persons to or in respect of whom pensions, gratuities or allowances on retirement are payable under the scheme, and different times and conditions may be fixed in respect of different classes of persons.
(3) The Commission may at any time prepare and submit to the Minister a scheme amending a scheme previously submitted and approved of under this section.
(4) A scheme submitted to the Minister under this section shall, if approved of by the Minister with the concurrence of the Minister for Finance, be carried out by the Commission in accordance with its terms.
(5) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity or allowance payable in pursuance of a scheme under this section, such dispute shall be submitted to the Minister who shall refer it to the Minister for Finance for his decision.
(6) Every scheme submitted and approved of under this section shall be laid before each House of the Oireachtas as soon as may be after it is approved of and if either House, within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Exportation of bacon by the Commission.
23.—(1) The Commission may export bacon of such grades as may be specified by the Minister with the consent of the Minister for Finance from time to time in the form of Wiltshire sides or major cuts thereof which include the back.
(2) The Commission may from time to time require the holders of licences to sell to the Commission bacon of such grade or grades (being a grade or grades specified under subsection (1) of this section), in such condition and in such quantity as it may specify in the requirement in the form of Wiltshire sides or major cuts thereof which include the back and either, as the Commission may specify—
(i) to deliver the bacon to the Commission for exportation by the Commission, or
(ii) to export the bacon on behalf of the Commission to such country or countries or to such person or persons or place or places in such country or countries and in accordance with such conditions, if any, as the Commission may specify.
(3) The Commission shall pay to the holders of licences for any form of bacon sold to the Commission under this section the price which is appropriate having regard to the prices standing fixed for the time being under subsection (4) of this section for that form of bacon.
(4) (a) The Minister shall, after consultation with the Commission, fix from time to time in such manner and by reference to such matters as he thinks fit prices (in terms of a rate per hundredweight) for each form of bacon sold to the Commission under this section which is of a grade specified under subsection (1) of this section and is in the condition specified by the Minister.
(b) The Commission shall be notified in writing as soon as may be of any price fixed under paragraph (a) of this subsection and of the grades specified under subsection (1) of this section.
(5) Holders of licences shall comply with any requirement of the Commission under this section and where, in respect of any bacon, the holder of a licence fails to comply with a requirement of the Commission under this section he shall be guilty of an offence and shall be liable on summary conviction thereof to a fine calculated at the rate of five pounds for every hundredweight of bacon in respect of which the holder has failed to comply with the requirement.
(6) Where, in the opinion of the Commission, bacon delivered to or exported on behalf of the Commission by the holder of a licencein pursuance of a requirement under this section is not of the grade or in the condition specified by the Commission in the requirement, the Commission may either—
(a) (i) return the bacon to the holder of the licence, and require the holder of the licence to deliver to or export on behalf of the Commission the same quantity of bacon of the grade and in the condition specified by the Commission in the original requirement, and
(ii) deduct from the price payable for the bacon or for any other bacon delivered to or exported on behalf of the Commission by the holder of the licence any loss or expense incurred by the Commission in relation to the bacon returned to the holder of the licence, or
(b) deduct from the price payable for the bacon under this section to the holder of the licence or for any other bacon delivered to or exported on behalf of the Commission by the holder of the licence such amount as it considers reasonable having regard to the grade and condition of the bacon.
(7) (a) The Commission shall not require a holder of a licence to sell to it during any external-sale period (within the meaning of Part III of the Act of 1937) a quantity of bacon in excess of the quantity specified in the external-sales sub-quota certificate (within the meaning of the said Part III) for the premises to which the licence relates.
(b) If during any external-sale period (within the meaning of the said Part III) a quantity of bacon which is in the form of Wiltshire sides or major cuts thereof which include the back and is of a grade or grades and in the condition specified in any requirement of the Commission made during that period is offered for sale to the Commission by the holder of a licence, the Commission shall purchase at the price which is appropriate having regard to the prices standing fixed for the time being under subsection (4) of this section for those forms of bacon—
(i) in case the quantity would, if increased by the quantity (if any) of bacon already purchased by the Commission from the holder during that period, be equal to or less than the quantity specified in the external-sales sub-quota certificate (within the meaning of the said Part III) in respect of that period for the premises to which the licence relates, the whole of the bacon, and
(ii) in any other case, such quantity (if any) of the bacon as it thinks proper, having regard to the quantities (if any) of bacon exported by the holder aforesaid on or after the 1st day of January, 1960, and before the commencement of this Act, provided that the quantity purchased shall not be less than the quantity (if any) which if increased by the quantity (if any) of bacon already purchased by the Commission from the holder during the external-sale period aforesaid would be equal to the quantity specified in the said external-sales sub-quota certificate.
(8) Bacon delivered to, or exported on behalf of, the Commission at any time under this section by the holder of a licence shall be deemed, for the purposes of section 33 (inserted by the Act of 1956) of the Act of 1937, to have been exported at that time from the premises to which the licence relates and to comply with the provisions of any external-sales order under section 30 (inserted by the Act of 1956) of the Act of 1937, in relation to the bacon in force at that time.
(9) Moneys due by the Commission for bacon sold to it under this section shall be paid out of, and moneys received by the Commission in respect of bacon exported under this section, shall be paid into, the Bacon (Price Stabilisation) Fund.
(10) Holders of licences shall be informed by notices in writing of requirements made by the Commission and service of the notices shall be effected in accordance with the provisions of section 3 of the Principal Act.
(11) In this section “holder of a licence” means a person who is the holder of a curing licence or a curing and slaughtering licence under Part II of the Principal Act.
Preparation, packing and conveyance of bacon for exportation by or on behalf of the Commission.
24.—(1) The Commission may, with the consent of the Minister, provide by regulations for—
(a) the method and manner of preparing bacon sold to it under section 23 of this Act,
(b) the method and manner of packing bacon sold to it under the said section 23 including the materials and packages to be used for the packing,
(c) the method and manner of marking bacon sold to it under the said section 23, the method and manner of marking the materials and packages used for the packing, the marks to be applied and the matters to be indicated by the marks,
(d) the cleanliness and sterilisation of the materials and packages,
(e) the classification and grading of the contents of the packages,
(f) the means of conveyance and handling of bacon sold to it under the said section 23 during transit from the premises of the vendors to the premises of the Commission or to the ship, vehicle or other conveyance in which it is transported out of the State, and
(g) the fittings, ventilation and cleanliness of ships, vehicles and other conveyances in which bacon sold to it under the said section 23 is transported out of the State.
(2) A person who contravenes a provision of regulations under this section shall be guilty of an offence and shall be liable on summary conviction thereof in the case of a first offence to a fine not exceeding twenty-five pounds and in the case of a second or any subsequent offence to a fine not exceeding fifty pounds.
(3) Regulations under section 45 or section 46 of the Principal Act shall not apply in relation to bacon in relation to which regulations under this section apply and section 66 of that Act shall not, in so far as it relates to regulations under the said sections 45 and 46, apply in relation to bacon in relation to which regulations under this section apply.
(4) An offence under this section may be prosecuted by the Commission.
Power of Minister to prohibit exportation of certain bacon.
25.—(1) Notwithstanding anything contained in section 65 of the Principal Act, the Minister may by order prohibit the exportation, except by or on behalf of the Commission, either generally or to a specified country or specified countries, of bacon of such grade or grades as may be specified in the order in the form of Wiltshire sides or major cuts thereof which include the back.
(2) The Minister may by order revoke or amend an order made under this section including an order made under this subsection.
Pre-packaging of bacon and other pigmeat for sale by retail.
26.—(1) The Minister may by regulations provide for—
(a) the prohibition of the pre-packaging of bacon or other pigmeat otherwise than under and in accordance with a licence (in this section referred to as a pre-packaging licence),
(b) the grant and revocation of pre-packaging licences by the Minister,
(c) the attaching of conditions to pre-packaging licences by the Minister and the amendment and revocation of the conditions by the Minister,
(d) the method and manner of pre-packaging bacon and other pigmeat including the wrapping materials and packages to be used for the pre-packaging,
(e) the cleanliness and sterilisation of the wrapping materials and packages, and
(f) the classification and grading of the contents of the packages,
and regulations under this section may provide that different provisions thereof shall apply in relation to different forms of bacon and other pigmeat.
(2) A person who contravenes a provision of regulations made under this section shall be guilty of an offence and shall be liable on summary conviction thereof in the case of a first offence to a fine not exceeding twenty-five pounds and in the case of a second or any subsequent offence to a fine not exceeding fifty pounds.
(3) Regulations made under section 45 of the Principal Act in relation to the packing of bacon and the materials and packages tobe used for the packing shall not apply in relation to the packing, or the materials or packages to be used in the packing, of bacon in relation to which regulations made under this section apply.
(4) In this section “pre-packaging”, in relation to bacon or other pigmeat, means the preparation and packing of bacon or other pigmeat, elsewhere than in the premises where it is intended to sell the bacon or other pigmeat by retail, in such manner that the bacon or other pigmeat does not require further preparation or packing before or for the purpose of being sold by retail.
Powers of the Commission in relation to the development of markets for bacon and other pigmeat and pigmeat products.
27.—The Commission may do all or any of the following:
(a) provide, or arrange for, or assist, financially or otherwise, in the provision of publicity in any form or medium both in and outside the State for the purpose of encouraging the increased consumption of bacon and other pigmeat and pigmeat products produced in the State and promoting increases in the quantities of bacon and other pigmeat and pigmeat products exported from the State,
(b) conduct, or provide for the conducting of, investigations, surveys, analyses, studies and reports in relation to markets, potential markets and market conditions for, bacon and other pigmeat and pigmeat products in the State and outside the State,
(c) conduct, or provide for the conducting of, periodic comprehensive reviews, surveys and studies of trade in bacon and other pigmeat and pigmeat products outside the State,
(d) carry out, or provide for the carrying out of, and assist, financially or otherwise, experimental and development work and investigations in relation to the provision of new and improved types of bacon and other pigmeat and pigmeat products, packing for bacon and other pigmeat and pigmeat products and methods of presentation for marketing of bacon and other pigmeat and pigmeat products,
(e) establish, equip and operate, and provide for the establishment, equipment and operation of, and assist, financially or otherwise, in the operation of, showrooms, information bureaux, and similar establishments, in the State and outside the State, designed to promote the increased consumption of bacon and other pigmeat and pigmeat products and to promote increases in the quantities of bacon and other pigmeat and pigmeat products exported from the State,
(f) publish and distribute, or provide for the publication and distribution of, pamphlets, notices, bulletins, journals, magazines and such other similar matter as it thinks fit, in the State and outside the State, for the purpose of encouraging the increased consumption of bacon and other pigmeat and pigmeat products and promoting increases in the quantities of bacon and other pigmeat and pigmeat products exported from the State,
(g) promote, facilitate, encourage, assist (financially or otherwise), co-ordinate and develop the exportation of bacon and other pigmeat and pigmeat products by such means as the Commission considers necessary or desirable,
(h) undertake, promote, or provide for the undertaking and promotion of, and assist in, financially or otherwise, any activity which, in the opinion of the Commission, will, or is likely to, result in, directly or indirectly, increases in the quantities of bacon and other pigmeat and pigmeat products exported from the State.
Grants to the Commission.
28.—(1) There may be paid to the Commission in each financial year out of moneys provided by the Oireachtas a grant or grants of such amount or amounts as the Minister, with the consent of the Minister for Finance and after consultation with the Commission in relation to its programme of expenditure for that financial year, may fix.
(2) A grant under this section shall be used by the Commission, subject to such conditions as may be specified in writing from timeto time by the Minister, with the consent of the Minister for Finance to defray any loss incurred by the Commission in relation to the export of bacon and shall not be used for any other purpose.
(3) A grant under this section shall be paid into the Bacon (Price Stabilisation) Fund by the Commission.
Guarantee of loans.
29.—(1) The Minister may, if he so thinks fit and with the consent of the Minister for Finance, guarantee a loan to the Commission.
(2) Whenever the Minister guarantees a loan under this section, he may guarantee in such form and manner and on such terms and conditions as the Minister for Finance may sanction, the due repayment by the Commission of the principal of the loan or the payment of interest on the loan or both the repayment of such principal and the payment of such interest.
(3) The Minister shall not so exercise the powers conferred by subsections (1) and (2) of this section that the amount, or the aggregate amount, of principal which he may at any one time be liable to pay on foot of any guarantee or guarantees under those subsections for the time being in force, together with the amount of principal (if any) which the Minister has previously paid on foot of any such guarantees and has not been repaid by the Commission, exceeds £500,000.
(4) Where a guarantee under this section is or has been given, the Commission shall, if the Minister so requires, give to him such security as may be specified in the requisition for the purpose of securing to the Minister the repayment of any moneys which he may be liable to pay or has paid under the guarantee.
(5) The Minister shall, as soon as may be after the expiration of every financial year, lay before each House of the Oireachtas a statement setting out with respect to each guarantee under this section given during that year or given at any time before, and in force at, the commencement of that year—
(a) particulars of the guarantee,
(b) in case any payment has been made by the Minister under the guarantee before the end of that year, the amount of the payment and the amount (if any) repaid to the Minister on foot of the payment,
(c) the amount of principal covered by the guarantee which was outstanding at the end of that year.
(6) Moneys paid by the Minister under a guarantee under this section shall be repaid to the Minister (with, if the Minister for Finance so requires, interest thereon at such rates as the Minister for Finance appoints) by the Commission within two years from the date of the advance of the moneys under subsection 10 of this section.
(7) Where the whole or any part of moneys required by subsection (6) of this section to be repaid to the Minister has not been repaid in accordance with that subsection, the amount so remaining outstanding shall be repaid to the Central Fund out of moneys provided by the Oireachtas.
(8) Notwithstanding the provision of moneys under subsection (7) of this section to repay an amount to the Central Fund, the Commission shall remain liable to the Minister in respect of that amount and that amount (with, if the Minister for Finance so requires, interest thereon at such rates as the Minister for Finance appoints) shall be repaid to the Minister by the Commission at such times and in such instalments as the Minister for Finance appoints and, in default of repayment as aforesaid and without prejudice to any other method of recovery, shall be recoverable as a simple contract debt in any court of competent jurisdiction.
(9) Moneys repaid by the Commission to the Minister, or recovered from the Commission by the Minister, under this section shall be paid into or disposed of for the benefit of the Exchequer.
(10) All moneys from time to time required by the Minister to meet sums which may become payable by him under this section shall be advanced out of the Central Fund or the growing produce thereof.
(11) For the purpose of providing for advances out of the Central Fund under this section, the Minister for Finance may borrow from any person any sum or sums, and for the purpose of such borrowing he may create and issue securities bearing such rate of interest and subject to such conditions as to repayment, redemption or any other matter as he thinks fit, and shall pay the moneys so borrowed into the Exchequer.
(12) The principal of and interest on any securities issued under this section and the expenses incurred in connection with the issue of such securities shall be charged on and payable out of the Central Fund or the growing produce thereof.
Payments out of the General Fund of the Pigs and Bacon Commission.
30.—There shall be paid out of the General Fund of the Pigs and Bacon Commission all moneys required or permitted by this Act to be paid by the Commission (other than moneys required by this Act to be paid out of the Bacon (Price Stabilisation) Fund) and all expenses incurred by the Commission under this Act.
Laying of orders and regulations before Houses of the Oireachtas.
31.—Every order and regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution is passed by either House within the next twenty-one days upon which that House has sat after the order or regulation, as the case may be, is laid before it annulling the order or regulation, as the case may be, the order or regulation, as the case may be, shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.
Expenses of the Minister.
32.—The expenses incurred in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
33.—(1) Subject to subsection (2) of this section, the enactments mentioned in column (2) of the Schedule to this Act are hereby repealed to the extent mentioned in column (3) of that Schedule.
(2) The repeal of sections 40 to 43 of the Act of 1939 shall not have effect in relation to bacon exported or sold before the commencement of this section.
Short title and collective citation.
34.—(1) This Act may be cited as the Pigs and Bacon (Amendment) Act, 1961.
(2) The Pigs and Bacon Acts, 1935 to 1956, and this Act may be cited together as the Pigs and Bacon Acts, 1935 to 1961.
