ACHT NA LEANBHAÍ TABHARTHA (ORDUITHE ATHAIRÍOCHTA), 1930.

1.—San Acht so—
cialluíonn an focal “máthair” éinne acu so leanas atá ag iompar cloinne no atá tar éis leanbh tabhartha do thabhairt ar an saol, sé sin le rá, bean singil ar bith no baintreach ar bith, no bean phósta ar bith ná comhnuíonn le n-a fear céile, agus foluíonn sé bean phósta ar bith a chomhnuíonn le n-a fear céile agus do thug leanbh tabhartha ar an saol sarar pósadh í; agus cialluíonn an abairt “athair ceaptha” duine go dtabharfar de bhreith air, tré ordú athairíochta ar n-a dhéanamh fén Acht so, gurb é ceaptar is athair do leanbh thabhartha.
Gairmeacha do thabhairt amach.
2.—(1) Ar a iarraidh sin do mháthair leinbh thabhartha laistigh den am a ceaptar anso ina dhiaidh seo no ar a iarraidh, laistigh den am a ceaptar anso ina dhiaidh seo, do chólucht áitiuil a riarann fóirithin na mbocht agus a bheidh ag tabhairt fóirithine do mháthair leinbh thabhartha no do leanbh thabhartha an uair sin agus, i gceachtar cás, ar thabhairt faisnéise uaithi i scríbhinn agus fé mhionn do mháthair an leinbh sin á rá cé hé athair an leinbh sin, féadfaidh an Breitheamh den Chúirt Dúithche sa Dúthaigh ina gcomhnuíonn an mháthair sin gairm no próiseas eile do thabhairt amach á cheangal ar an duine (dá ngairmtear an t-athair ainmnithe san Acht so) adeirtear sa bhfaisnéis sin is athair don leanbh san teacht i láthair nuair a beifear ag éisteacht iarratais ón máthair sin no ón gcólucht áitiuil sin (pe'ca aca é) ag lorg orduithe (dá ngairmtear ordú athairíochta san Acht so) i dtaobh an leinbh sin.
(2) Ní féadfar iarratas go dtabharfaí gairm no próiseas eile amach fén alt so do dhéanamh ach—
(a) roimh shaolú an leinbh thabhartha gur ina thaobh a déanfar an t-iarratas, no
(b) laistigh de shé mhí tar éis an leanbh san do shaolú, no
(c) i gcás i n-ar thug athair ainmnithe an leinbh sin cabhair uaidh chun an leanbh san do chothú laistigh de shé mhí tar éis an leanbh do shaolú, uair ar bith tar éis na cabhartha san, no
(d) i gcás ná raibh comhnaí ar athair ainmnithe an leinbh sin i Saorstát Éireann ar dháta saoluithe an leinbh sin, uair ar bith laistigh de shé mhí tar éis teacht isteach i Saorstát Éireann don athair ainmnithe sin mar an gcéad uair tar éis an dáta san, no
(e) i gcás ina raibh comhnaí ar athair ainmnithe an leinbh sin i Saorstát Éireann ar dháta saoluithe an leinbh sin ach gur scuir sé de bheith ina chomhnaí ann laistigh de shé mhí tar éis an dáta san, uair ar bith laistigh de shé mhí tar éis teacht isteach i Saorstát Éireann don athair ainmnithe sin mar an gcéad uair tar éis an scurtha san, no
(f) i gcás an leanbh do shaolú laistigh de shé mhí roimh rith don Acht so, laistigh de ráithe tar éis an Achta so do rith.
(3) I gcás ina dtabharfar gairm amach fén alt so roimh shaolú an leinbh thabhartha le n-a mbaineann sí ní bheidh an dáta gur ina chóir a déanfar leis an ngairm sin an t-athair ainmnithe do ghairm chun an Cúirte Dúithche níos luaithe ná ceithre lá déag tar éis an lae meastar a saolófar an leanbh san agus déanfar éisteacht na gairme sin do chur ar athló (má deintear san) go ceann pé tréimhse is gá chun go bhféadfaidh máthair an leinbh sin bheith i láthair le linn na héisteachta san.
Orduithe athairíochta.
3.—(1) Tar éis don Chúirt Dúithche gairm do tugadh amach fén Acht so d'éisteacht féadfaidh an Breitheamh, má bhíonn sé sásta do réir an ailt seo gurb é athair ainmnithe an leinbh thabhartha (pe'ca beo no marbh do saoluíodh é) le n-a mbaineann an ghairm sin is athair don leanbh san, ordú do dhéanamh (dá ngairmtear ordú athairíochta san Acht so) á thabhairt de bhreith ar an athair ainmnithe sin gurb é is athair ceaptha don leanbh san agus á ordú don athair cheaptha san na costaisí do bhain leis an leanbh san do shaolú, fé mar mheasfaidh an Breitheamh iad, d'íoc agus ina theanta san, más beo do saoluíodh an leanbh san, pé suim airgid acu so leanas a bheidh oiriúnach, sé sin le rá:—
(a) má fuair an leanbh san bás roimh an ordú san do dhéanamh, costaisí sochraide an leinbh sin, fé mar mheasfaidh an Breitheamh iad, chó fada le méid nách mó ná cúig púint, no
(b) pé suim sheachtainiuil nách mó ná fiche scilling agus a shocróidh an Breitheamh chun an leanbh san do chothú agus oideachas do thabhairt do, no
(c) má thoilíonn an t-athair ceaptha chuige, suim amháin de pé méid a shocróidh an Breitheamh in ionad aon tsuime seachtainiúla do bheadh iníoctha fén Acht so ag an athair ceaptha san i dtaobh an leinbh sin mara mbeadh san.
(2) Ní bheidh aon Bhreitheamh den Chúirt Dúithche sásta go bhfuil duine ina athair cheaptha do leanbh thabhartha gan fianaise mháthair an leinbh sin agus fós fianaise ag neartú le fianaise na máthar san i bponc no i bpuinc éigin le n-a mbeidh tácht d'éisteacht.
(3) Má orduíonn Breitheamh den Chúirt Dúithche, le hordú athairíochta, d'athair cheaptha leinbh thabhartha suim sheachtainiuil d'íoc i dtaobh an leinbh sin, féadfa sé pé coiníollacha is dó leis is ceart do chur le híoc no le glaca na suime seachtainiúla san.
(4) Na forálacha den Acht so bhaineann le socrú méid na suime amháin a híocfar in ionad suime seachtainiúla is iníoctha fé ordú athairíochta agus le híoc agus riara na suime amháin sin agus le n-a cur chun críche bainfid le suim amháin do cheapa, d'íoc, do riara, agus do chur i gcrích a déanfar iníoctha le hordú athairíochta in ionad aon tsuime seachtainiúla do bheadh iníoctha mara mbeadh san.
(5) Le linn éisteacht aon chúise fén Acht so sa Chúirt Dúithche no le linn athchomhairc sa Chúirt Chuarda, ordóidh an Breitheamh gach duine do chimeád amach as an gCúirt ach amháin na páirtithe, a n-abhcóidí no a n-atúrnaethe, máthair an iarratasóra no bean ghaoil no ban-chara eile don iarratasóir, oifigigh na Cúirte, na fínnithe sa chúis agus aon ionadaithe bona fide do pháipeur nuachta no d'oifig nuachta.
(6) Ní bheidh sé dleathach aon tuarasgabháil, ráiteas, tuairim ná abhar eile, ar ná maidir le haon imeachta cúirte chun ordú athairíochta do dheona, do chlóbhuala ná d'fhoillsiú ná a chur fé ndeár ná a thabhairt chun críche go gclóbhuailfear no go bhfoillseofar a leithéid, ach amháin gach ceann no aon cheann de sna mion-innste seo leanas ar na himeachta san, sé sin le rá:—
(a) ainmneacha na bpáirtithe;
(b) an Chúirt in ar trialadh agus an Breitheamh gur os a chóir a trialadh na himeachta agus ainmneacha na n-atúrnaethe agus na n-abhcóidí do bhí mar dhligheadóirí sna himeachta;
(c) cuntas comair ar na cúisithe, ar na cosanta, agus ar na frith-chúisithe gur tugadh fianaise chun neartuithe leo;
(d) mion-innste ar aon phuínte dlí do tarraigeadh anuas agus do pléidheadh sna himeachta agus breith na Cúirte air;
(e) breith na Cúirte agus an méid adubhairt an Breitheamh agus é ag tabhairt a bhreithe.
(7) Ní bhainfidh éinní san alt so—
(a) le haon phléideail, aithscríbhinn fhianaise, no scríbhinn eile do chlóbhuala chun a húsáidthe i dtaobh aon imeachta cúirte ná le hí do chur in úil do dhaoine go mbeidh baint acu leis na himeachta, ná
(b) le haon ordú, fógra, no tuarasgabháil do chlóbhuala agus d'fhoillsiú do réir orduithe na Cúirte, ná
(c) le haon abhar do chlóbhuala no d'fhoillsiú in aon imleabhar no cuid ar leithligh d'aon tsreath bona fide de thuarasgabhála dlí nách cuid d'aon fhoillseachán eile agus ná beidh ann ach amháin tuarasgabhála ar imeachta i gCúirteanna dlí, no in aon fhoillseachán de shaghas teicniciúil a bheidh ceaptha bona fide chun a chúrsuithe imeasc dligheadóirí no dochtúirí leighis.
(8) Má dheineann aon duine is dílseánach, eagarthóir no foillsitheoir d'aon leabhar no foillseachan tréimhsiúil no is árdchlódóir ag clóbhuala an leabhair no an fhoillseacháin sin no má chuireann sé fé ndeár no má thugann sé chun críche no má cheaduíonn sé aon abhar, mion-aithriste, no mion-innste, i dtaobh aon imeachta cúirte, do chlóbhuala no d'fhoillsiú sa leabhar no sa bhfoillseachán san contrárdha d'aon cheann d'fhorálacha an ailt seo, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneail ná raghaidh thar cúig céad púnt do chur air no, más rogha leis an gCúirt é, príosúntacht i dteanta no d'éamais daor-oibre ar feadh aon téarma nách sia ná sé mhí no an fhíneail sin agus an phríosúntacht san le chéile.
(9) Is ar agra agus in ainm an Phríomh-Atúrnae bunófar gach cúiseamh i gcionta fén alt so.
Suimeanna seachtainiúla d'íoc.
4.—(1) Gach suim sheachtainiúil a bheidh iníoctha ag athair cheaptha fé ordú athairíochta tosnóidh sí o pé dáta socrófar san ordú agus leis an ordú, ag an mBreitheamh a dhéanfaidh an t-ordú, ach ní bheidh an dáta san níos luaithe ná bliain roimh dháta an orduithe ná níos déanaí ná bliain tar éis an dáta san agus ní bheidh sé níos luaithe ná lá saoluithe an leinbh thabhartha gur ina thaobh a bheidh an tsuim sheachtainiúil sin iníoctha.
(2) Gach suim sheachtainiúil a bheidh iníoctha ag athair cheaptha fé ordú athairíochta beidh sé iníoctha, fé réir aon atharú déanfar ar a méid fén Acht so, go dtí go dtárlóidh pé ní de sna nithe seo leanas is túisce thárlóidh, sé sin le rá:—
(a) bás an leinbh thabhartha gur ina thaobh a bheidh an tsuim sheachtainiúil sin iníoctha;
(b) aois a shé mblian déag do bheith slán ag an leanbh san;
(c) íoc suime amháin do chur, fén Acht so, in ionad na suime seachtainiúla san;
(d) deire do chur leis an suim seachtainiúil sin le hordú ón gCúirt Dúithche fén alt so.
(3) Más rud é, ar aois a shé mblian déag do bheith slán ag leanbh tabhartha go raibh suim sheachtainúil iníoctha ina thaobh fé ordú athairíochta díreach sara raibh an aois sin slán aige, gur léir do Bhreitheamh den Chúirt Dúithche go bhfuil aineamh aigne no cuirp ar an leanbh san i slí, agus chó mór san, go bhfuil an leanbh san neamh-oiriúnach, go hiomlán agus go buan, d'aon tsaghas oibre, féadfaidh an Breitheamh san, le hordú, íoc na suime seachtainiúla san do bhuanú fén ordú athairíochta san ar feadh saoil an leinbh sin.
(4) Ar fháil bháis d'athair cheaptha dá ndlightear suim sheachtainiúil d'íoc fé ordú athairíochta beidh an fiachas in íoc na suime seachtainiúla san ar a estát, réalta agus pearsanta, mar fhiacha síbhialta, agus féadfaidh an té le n-a mbeidh an tsuim sheachtainiúil sin iníoctha de thurus na huaire í do bhaint amach dá réir sin.
Suimeanna seachtainiúla d'atharú.
5.—(1) Féadfaidh Breitheamh den Chúirt Dúithche aon uair, ar iarratas ón té ag a mbeidh suim sheachtainiúil iníoctha fé ordú athairíoctha no ón té le n-a mbeidh an tsuim sheachtainiúil sin iníoctha no o dhuine adeir gurb é féin an té dar cheart an tsuim sheachtainiúil sin do ghlaca, gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) méid na suime seachtainiúla san d'atharú;
(b) an tsuim sheachtainiúil sin do dhéanamh iníoctha le duine eile;
(c) gach ceann no aon cheann de sna coiníollacha bhaineann le híoc no le glaca na suime seachtainiúla san d'atharú.
(2) Féadfaidh Breitheamh den Chúirt Dúithche aon uair, ar iarratas ón té ag a mbeidh suim sheachtainiúil iníoctha fé ordú athairíochta agus ar bheith sásta dho go bhfuil deire fén Acht so leis an bhfiachas in íoc na suime seachtainiúla san no ar bheith sásta dho gur gá, do réir chirt, deire do chur leis an bhfiachas san, féadfa sé deire do chur leis an suim seachtainiúil sin ó pé dáta is dó leis is ceart ach i slí ná bronnfar ceart chun aon airgead do bhaint amach do híocadh alos na suime seachtainiúla san roimh dháta an orduithe tré n-a gcuirtear deire leis an suim sin.
Leanbh tabhartha do chur le céird.
6.—(1) Ar iarratas fén alt so i dtaobh leinbh thabhartha fé bhun sé mblian déag d'aois go mbeidh suim sheachtainiúil iníoctha mar gheall air an uair sin fé ordú athairíochta, no i dtaobh leinbh thabhartha de shé bliana déag d'aois go raibh suim sheachtainiúil iníoctha mar gheall air fé ordú athairíochta díreach sara raibh an aois sin slán aige, féadfaidh Breitheamh den Chúirt Dúithche a ordú d'athair cheaptha an leinbh sin no d'ionadaí phearsanta an athar cheaptha san pé suim nách mó ná caoga púnt agus a shocróidh an Breitheamh d'íoc chun an leanbh san do chur le céird.
(2) Ag déanamh orduithe fén alt so dho déanfaidh Breitheamh den Chúirt Dúithche, leis an ordú san, pé socrú is dó leis is ceart chun a chur in áirithe go ndéanfar an leanbh tabhartha gur ina thaobh a bheidh an t-ordú san á dhéanamh do chur go cuibhe le céird agus ar théarmaí le n-a n-aontóidh an Breitheamh san agus chun go ndéanfar an tsuim a bheidh iníoctha fén ordú san do chur go cuibhe chun no mar chabhair chun íoctha na táille is iníoctha alos na príntíseachta san.
(3) Féadfar iarratas fén alt so do dhéanamh aon uair tar éis ceithre bliana déag do bheith slán ag an leanbh tabhartha le n-a mbaineann sé, ach ní níos déanaí ná sé mhí tar éis sé bliana déag do bheith slán ag an leanbh san, agus isé dhéanfaidh é ná an té le n-a mbeidh an tsuim sheachtainiúil iníoctha i dtaobh an leinbh sin fé ordú athairíochta no, má bhíonn sé bliana déag slán ag an leanbh san, an té le n-a raibh an tsuim sheachtainiúil sin iníoctha no le n-a bhféadfaí í d'íoc dá mbeifí á híoc fós.
Costaisí sochraide leinbh thabhartha.
7.—I gcás leanbh tabhartha go ndearnadh ordú athairíochta ina thaobh d'fháil bháis agus suim sheachtainiúil iníoctha mar gheall air fén ordú san, féadfaidh Breitheamh den Chúirt Dúithche, ar a iarraidh sin laistigh de dhá mhí tar éis bháis an leinbh sin don té le n-a raibh an tsuim sheachtainiúil sin iníoctha, a ordú d'athair cheaptha an leinbh sin no d'ionadaí phearsanta an athar cheaptha san costaisí sochraide an leinbh sin, fé mar mheasfaidh an Breitheamh san iad, d'íoc chó fada le suim nách mó ná cúig púint.
Suim amháin d'íoc in ionad suime seachtainiúla.
8.—(1) Féadfaidh Breitheamh den Chúirt Dúithche aon uair, ar a iarraidh sin do dhuine dá ndlightear suim sheachtainiúil d'íoc fé ordú athairíochta, a údarú don duine sin no dá ionadaí phearsanta suim amháin de pé méid a shocróidh an Breitheamh d'íoc in ionad na suime seachtainiúla san.
(2) I gcás athair cheaptha, dá ndlightear fé ordú athairíochta suim sheachtainiúil d'íoc i dtaobh a leinbh thabhartha, d'fháil bháis roimh dheire do bheith curtha leis an suim sheachtainiúil sin féadfaidh Breitheamh den Chúirt Dúithche, aon uair tar éis bháis an athair cheaptha san agus roimh dheire do bheith curtha leis an suim sheachtainiúil sin agus ar iarratas ón té le n-a mbeidh an tsuim sheachtainiúil sin iníoctha, a ordú d'ionadaí phearsanta an athar cheaptha san suim amháin de pé méid a shocróidh an Breitheamh d'íoc in ionad na suime seachtainiúla san.
(3) An tsuim amháin a shocróidh Breitheamh den Chúirt Dúithche le cur in ionad suime seachtainiúla fén alt so, socrófar amhlaidh í d'fhonn a chur in áirithe don leanbh thabhartha gur ina thaobh atá an tsuim sheachtainiúil sin iníoctha buntáistí chó maith ar a laighead leis na buntáistí do gheobhadh sé dá leantaí den tsuim sheachtainiúil sin d'íoc agus, ag socrú na suime amháin sin amhlaidh do, féachfaidh an Breitheamh do gach a mbaineann leis an scéal agus, go sonnrách, más gá sa chás é, féachfa sé don cheist, an dócha go leanfar fén Acht so den tsuim sheachtainiúil d'íoc tar éis sé bliana déag do bheith slán ag an leanbh san.
(4) Nuair a bheidh an Breitheamh á údarú no á ordú fén alt so go n-íocfar suim amháin in ionad suime seachtainiúla ní foláir é bheith sásta go ndearnadh socrú ceart chun an tsuim amháin d'íoc le duine ceart oiriúnach agus chun an tsuim amháin sin do riara agus do chur go cuibhe chun tairbhe an leinbh thabhartha gur ina thaobh a híocfar í agus, sa mhéid gur gá é dar leis, déanfaidh an Breitheamh, san ordú le n-a n-údaruítear an tsuim amháin sin d'íoc amhlaidh, socrú chun an t-íoc, an riara, agus an cur san do dhéanamh.
(5) Nuair a híocfar fé réim agus do réir ordú fén alt so an tsuim amháin a bheidh luaidhte san ordú san beidh deire leis an suim sheachtainiúil gur ina hionad a híocadh an tsuim amháin sin amhlaidh.
Na daoine le n-a n-íocfar suimeanna seachtainiúla agus suimeanna eile.
9.—(1) I ngach ordú athairíochta agus i ngach ordú eile déanfar fén Acht so á ordú go ndéanfaidh athair cheaptha leinbh thabhartha aon airgead d'íoc (nách i dtaobh costaisí an orduithe sin) pe'ca in aon tsuim amháin é no go tréimhsiúil, luadhfar cé leis go n-íocfar an t-airgead san agus, fé réir forálacha an Achta so, isé duine é sin ná pé duine is rogha leis an mBreitheamh a dhéanfaidh an t-ordú.
(2) Pé uair ordóidh Breitheamh den Chúirt Dúithche, le hordú athairíochta no le haon ordú eile fén Acht so, d'athair cheaptha leinbh thabhartha aon airgead d'íoc, pe'ca in aon tsuim amháin é no go tréimhsiúil, féadfaidh an Breitheamh san, leis an ordú san, a chur mar cheangal go n-íocfar an t-airgead san le Cléireach áirithe Cúirte Dúithche chun go ndéanfaidh seisean é do chur, i pé slí ordóidh an Breitheamh o am go ham le hordú no ar aon tslí eile, chun na gcrícheanna chun ar horduíodh amhlaidh an t-airgead san d'íoc.
(3) Gach suim sheachtainiúil a bheidh iníoctha ag athair cheaptha fé ordú athairíochta, féadfar, má bhíonn fóirithin na mbocht á fáil ag an leanbh tabhartha gur ina thaobh a bheidh an tsuim sheachtainiúil sin iníoctha no ag máthair an leinbh sin, í do dhéanamh iníoctha leis an gcólucht áitiúil do bheir an fhóirithin sin uatha.
(4) Gach suim sheachtainiúil a bheidh iníoctha ag athair cheaptha fé ordú athairíochta agus ná déanfar iníoctha leis an gCléireach Cúirte Dúithche ná le cólucht áitiúil ar a mbeidh mar chúram fóirithin na mbocht do riara, déanfar iníoctha í le máthair an leinbh thabhartha gur ina thaobh a bheidh an tsuim sin iníoctha más fé chúram a mháthar a bheidh an leanbh san agus, maran fé chúram a mháthar a bheidh an leanbh san, déanfar iníoctha í leis an té gur fé n-a chúram a bheidh sé.
Có-aontuithe dhéanfaidh daoine dá ndeoin féin chun leanbhaí tabhartha do chothú.
10.—(1) Má dheineann duine (dá ngairmtear athair admhuithe san Acht so) a admhuíonn gurb é féin is athair do leanbh thabhartha, có-aontú le máthair an leinbh sin sara ndéanfar ordú athairíochta i gcoinnibh an athar admhuithe sin i dtaobh an leinbh sin agus go gceanglóidh sé air féin leis an gcó-aontú san soláthar do dhéanamh don leanbh san agus ina thaobh, féadfaidh an t-athair admhuithe sin no an mháthair sin a iarraidh ar an mBreitheamh den Chúirt Dúithche ag a bhfuil dlighinse sa cheanntar ina gcomhnuíonn an mháthair sin aontú leis an gcó-aontú san agus má aontuíonn an Breitheamh san leis an gcó-aontú san féadfa sé, le hordú, an t-aontú san do chur ar breaca.
(2) Más rud é, tar éis ordú athairíochta do bheith déanta i dtaobh leinbh thabhartha, go ndéanfaidh athair ceaptha an leinbh sin có-aontú le máthair an leinbh sin á cheangal air féin soláthar do dhéanamh don leanbh san agus ina thaobh, féadfaidh an t-athair ceaptha san no an mháthair sin a iarraidh ar Bhreitheamh den Chúirt Dúithche aontú leis an gcó-aontú san agus má aontuíonn an Breitheamh san leis an gcó-aontú san féadfa sé, le hordú, an t-aontú san do chur ar breaca.
(3) Féadfaidh Breitheamh den Chúirt Dúithche aontú le có-aontú fén alt so, in ainneoin deifríocht iomlán no leathrannach do bheith idir an soláthar a déanfar leis an gcó-aontú san don leanbh thabhartha agus i dtaobh an leinbh thabhartha le n-a mbaineann an có-aontú san agus na buntáistí d'fhéadfaí d'fháil don leanbh san agus ina thaobh fén Acht so ach ní aontóidh sé le có-aontú fén alt so maran rud é gurb é a thuairim agus go gcuirfe sé ar breaca ina ordú fén alt so gurb é a thuairim go bhfuil an soláthar a déanfar leis an gcó-aontú san don leanbh san agus ina thaobh chó tairbheach tríd is tríd don leanbh san agus dá mháthair leis na buntáistí d'fhéadfaí d'fháil don leanbh san agus ina thaobh fén Acht so.

(2) I gcás—

ILLEGITIMATE CHILDREN (AFFILIATION ORDERS) ACT, 1930.
Definitions.
1.—In this Act—
the word “mother” means any of the following persons who is with child or has been delivered of an illegitimate child, that is to say, any single woman or any widow, or any married woman living separate from her husband, and includes any married woman not living separate from her husband who before her marriage was delivered of an illegitimate child; and the expression “putative father” means a person adjudged by an affiliation order made under this Act to be the putative father of an illegitimate child.
Issue of summonses.
2.—(1) Upon the application, within the time hereinafter limited, of the mother of an illegitimate child or on the application, within the time hereinafter limited, of a local body administering the relief of the poor then giving relief to the mother of an illegitimate child or to an illegitimate child and in either case upon an information in writing upon oath being made by the mother of such child identifying the father of such child the Justice of the District Court in the District in which such mother resides may issue a summons or other process requiring the person (in this Act referred to as the alleged father) identified in such information as the father of such child to appear on the hearing of an application by such mother or such local body (as the case may be) for an order (in this Act called an affiliation order) in respect of such child.
(2) An application for the issue of a summons or other process under this section may be made only—
(a) before the birth of the illegitimate child in respect of whom the application is made, or
(b) within six months after the birth of such child, or
(c) where the alleged father of such child contributed to the maintenance of such child within six months after its birth, at any time after such contribution, or
(d) where the alleged father of such child was not resident in Saorstát Eireann at the date of the birth of such child, at any time within six months after such alleged father first enters Saorstát Eireann after such date, or
(e) where the alleged father of such child was resident in Saorstát Eireann at the date of the birth of such child but ceased to be so resident within six months after such date, at any time within six months after such alleged father first enters Saorstát Eireann after such cesser, or
(f) where the child is born within six months before the passing of this Act, within three months after the passing of this Act.
(3) Where a summons is issued under this Section before the birth of the illegitimate child to which it relates, the date for which the alleged father is thereby summoned to the District Court shall not be earlier than fourteen days after the day on which such child is expected to be born and such (if any) adjournment of the hearing of such summons shall be made as may be necessary to enable the mother of such child to be present at such hearing.
Affiliation orders.
3.—(1) On the hearing by the District Court of a summons issued under this Act the Justice, if he is satisfied in accordance with this section that the alleged father of the illegitimate child (whether born alive or still-born) to whom such summons relates is the father of such child may make an order (in this Act called an affiliation order) adjudging such alleged father to be the putative father of such child and ordering such putative father to pay the expenses, as measured by the Justice, incidental to the birth of such child, and, where such child was born alive, such of the following moneys as may be appropriate, that is to say:—
(a) if such child has died before the making of such order, the funeral expenses, as measured by the Justice, of such child to an amount not exceeding five pounds, or
(b) such weekly sum not exceeding twenty shillings as the Justice shall fix for the maintenance and education of such child, or
(c) where the putative father so consents, a lump sum of such amount as shall be fixed by the Justice in commutation of any weekly sum which might otherwise be payable under this Act by such putative father in respect of such child.
(2) No Justice of the District Court shall be satisfied that a person is the putative father of an illegitimate child without hearing the evidence of the mother of such child and also evidence corroborative in some material particular or particulars of the evidence of such mother.
(3) Where a Justice of a District Court by an affiliation order orders the putative father of an illegitimate child to pay a weekly sum in respect of such child he may attach such conditions as he shall think proper to the payment or to the receipt of such weekly sum.
(4) The provisions of this Act relating to the fixing of the amount of a lump sum paid in commutation of a weekly sum payable under an affiliation order and the payment, administration, and application of such lump sum shall apply to the fixing, payment, administration and application of a lump sum made payable by an affiliation order in commutation of any weekly sum which might otherwise be payable.
(5) On the hearing of any case under this Act in the District Court or on appeal in the Circuit Court, the Judge shall order the exclusion from the Court of all persons other than the parties, their counsel or solicitors, the mother or other female relative or friend of the applicant, the officers of the Court, the witnesses in the case and any bona fide representatives of a newspaper or news agency.
(6) It shall not be lawful to print or publish or cause or procure to be printed or published any report, statement, commentary or other matter of or in relation to any judicial proceedings for the grant of an affiliation order save and except all or any of the following particulars of such proceedings, that is to say:—
(a) the names of the parties;
(b) the Court in which and the Judge before whom the proceedings were tried and the names of the solicitors and counsel professionally engaged in the proceedings;
(c) a concise statement of the charges, defences and counter-charges in support of which evidence was given;
(d) particulars of any point of law raised and discussed in the proceedings and the decision of the Court thereon;
(e) the decision of the Court and the observations of the Judge when pronouncing his decision.
(7) Nothing in this section shall apply—
(a) to the printing of any pleading, transcript of evidence or other document for use in connection with any judicial proceedings, or the communication thereof to persons concerned in the proceedings, or
(b) to the printing and publishing of any order, notice or report in pursuance of the directions of the Court, or
(c) to the printing or publishing of any matter in any separate volume or part of any bona fide series of law reports which does not form part of any other publication and consists solely of reports of proceedings in Courts of law, or in any publication of a technical character bona fide intended for circulation among members of the legal profession or medical profession.
(8) If any person being the proprietor, editor or publisher of any book or periodical publication, or being a master printer engaged in the printing of such book or publication, prints or publishes or causes, procures or permits to be printed or published therein in contravention of any of the provisions of this section any matter, details or particulars in relation to any judicial proceedings, such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five hundred pounds or at the discretion of the Court to imprisonment with or without hard labour for any term not exceeding six months or to both such fine and such imprisonment.
(9) Every prosecution for an offence under this section shall be brought at the suit and in the name of the Attorney-General.
Payment of weekly sums.
4.—(1) Every weekly sum payable by a putative father under an affiliation order shall commence from such date as the Justice making the order shall fix in and by the order but so that such date shall not be more than twelve months before nor more than twelve months after the date of the order and shall not be previous to the date of the birth of the illegitimate child in respect of whom such weekly sum is payable.
(2) Every weekly sum payable by a putative father under an affiliation order shall, subject to any variation in the amount thereof made under this Act, continue to be payable until the happening of whichever of the following events first happens, that is to say:—
(a) the death of the illegitimate child in respect of whom the said weekly sum is payable;
(b) the attainment by such child of the age of sixteen years;
(c) the commutation under this Act of such weekly sum by payment of a lump sum;
(d) the termination of the said weekly sum by an order of the District Court under this section.
(3) Where, upon the attainment of the age of sixteen years by an illegitimate child in respect of whom a weekly sum was immediately before it attained such age payable under an affiliation order, it appears to a Justice of the District Court that such child is mentally or bodily deficient in such manner and to such degree as to render such child totally and permanently unfit for employment of any kind, such Justice may by order continue the payment of such weekly sum under such affiliation order for the life of such child.
(4) On the death of a putative father liable to pay a weekly sum under an affiliation order the liability for the payment of such weekly sum shall attach to his real and personal estate as a civil debt and such weekly sum shall be recoverable accordingly by the person to whom the same is for the time being payable.
Variation of weekly sums.
5.—(1) A Justice of the District Court may at any time on the application of the person by whom a weekly sum is payable under an affiliation order or of the person to whom such weekly sum is payable or of a person claiming to be the proper person to receive such weekly sum do all or any of the following things, that is to say:—
(a) vary the amount of such weekly sum;
(b) change the person to whom such weekly sum is payable;
(c) vary all or any of the conditions relating to the payment or the receipt of such weekly sum.
(2) A Justice of the District Court may at any time, on the application of the person by whom a weekly sum is payable under an affiliation order and on being satisfied that the liability for the payment of such weekly sum has ceased under this Act or on being satisfied that justice requires that such liability should cease, terminate such weekly sum as from such date as he shall think proper but not so as to confer a right to recover any moneys paid in respect of such weekly sum before the date of the order effecting such termination.
Apprenticeship of illegitimate child.
6.—(1) Upon an application under this section in relation to an illegitimate child under the age of sixteen years in respect of whom a weekly sum is then payable under an affiliation order or in relation to an illegitimate child of the age of sixteen years in respect of whom a weekly sum was payable under an affiliation order immediately before he attained that age, a Justice of the District Court may order the putative father of such child or the personal representative of such putative father to pay such sum not exceeding fifty pounds as the Justice shall fix for the purpose of apprenticing such child to a trade.
(2) A Justice of the District Court making an order under this section shall by such order make such provision as he shall think proper to secure the due apprenticeship of the illegitimate child in respect of whom such order is made to a trade and on terms approved of by such Justice and for the due application of the sum payable under such order in or towards the discharge of the fee payable in respect of such apprenticeship.
(3) An application under this section may be made at any time after the illegitimate child to whom it relates has attained the age of fourteen years but not later than six months after such child has attained the age of sixteen years, and shall be made by the person to whom the weekly sum in respect of such child under an affiliation order is payable or, where such child has attained the age of sixteen years, to whom such weekly sum was payable or could be paid if it still continued.
Funeral expenses of illegitimate child.
7.—Where an illegitimate child in respect of whom an affiliation order has been made dies while a weekly sum is payable in respect of it under such order, a Justice of the District Court may, upon the application within two months after the death of such child of the person to whom such weekly sum was payable, order the putative father of such child or the personal representative of such putative father to pay the funeral expenses, as measured by such Justice, of such child to an amount not exceeding five pounds.
Commutation of weekly sums.
8.—(1) A Justice of the District Court may at any time on the application of a person liable to pay a weekly sum under an affiliation order authorise such person or his personal representative to commute such weekly sum by the payment of a lump sum of such amount as shall be fixed by the Justice.
(2) Where a putative father who is liable under an affiliation order to pay a weekly sum in respect of his illegitimate child dies before the termination of such weekly sum a Justice of the District Court may at any time after the death of such putative father and before the termination of such weekly sum, on the application of the person to whom such weekly sum is payable, order the personal representative of such putative father to commute such weekly sum by the payment of a lump sum of such amount as shall be fixed by the Justice.
(3) Every lump sum fixed by a Justice of the District Court for the commutation under this section of a weekly sum shall be so fixed with a view to securing for the illegitimate child in respect of whom such weekly sum is payable benefits at least equal to those which he would derive from a continuation of such weekly sum and in so fixing such lump sum the Justice shall have regard to all the circumstances of the case and in particular shall where the circumstances so require have regard to the probability of the payment of the weekly sum being continued under this Act after such child has attained the age of sixteen years.
(4) When authorising or ordering under this section the commutation of a weekly sum the Justice shall be satisfied that proper arrangements have been made for the payment of the lump sum to a fit and proper person and for the due administration and application of such lump sum for the benefit of the illegitimate child in respect of whom the same is paid and the Justice shall so far as appears to him to be necessary provide for such payment, administration, and application in the order authorising such commutation.
(5) Upon the payment under and in accordance with an order under this section of the lump sum specified in such order the weekly sum in commutation of which such lump sum is so paid shall terminate.
Persons to whom weekly and other sums are to be paid.
9.—(1) Every affiliation order and every other order made under this Act ordering the payment of any money (other than in respect of the costs of such order) whether in one sum or periodically by the putative father of an illegitimate child shall specify the person to whom such money is to be paid and, subject to the provisions of this Act, the choice of such person shall be in the discretion of the Justice making the order.
(2) Whenever a Justice of the District Court by an affiliation order or any other order under this Act orders the putative father of an illegitimate child to pay any money whether in one sum or periodically such Justice may by such order require such money to be paid to a specified District Court Clerk to be applied by him in such manner as the Justice shall from time to time by order or otherwise direct for the purposes for which such money was so ordered to be paid.
(3) Every weekly sum payable by a putative father under an affiliation order may if the illegitimate child in respect of whom such weekly sum is payable or its mother is in receipt of poor relief be made payable to the local body giving such relief.
(4) Every weekly sum payable by a putative father under an affiliation order which is not made payable to the District Court Clerk or to a local body charged with the administration of relief of the poor shall, if the illegitimate child in respect of whom the same is payable is in the custody of its mother, be made payable to such mother and, if such child is not in the custody of its mother, shall be made payable to the person in whose custody such child is.
Voluntary agreements for maintenance of illegitimate children.
10.—(1) Where a person (in this section called an admitted father) who admits himself to be the father of an illegitimate child enters into an agreement with the mother of such child before an affiliation order has been made against such admitted father in respect of such child and by such agreement binds himself to make provision for and in respect of such child, such admitted father or such mother may apply to the Justice of the District Court having jurisdiction in the district in which such mother resides for his approval of such agreement and such Justice, if he approves of such agreement, may by order record such approval.
(2) Where after an affiliation order has been made in respect of an illegitimate child the putative father of such child enters into an agreement with the mother of such child whereby such putative father binds himself to make provision for and in respect of such child, such putative father or such mother may apply to a Justice of the District Court for his approval of such agreement and such Justice, if he approves of such agreement, may by order record such approval.
(3) A Justice of the District Court may approve of an agreement under this section notwithstanding that the provision made by such agreement for and in respect of the illegitimate child to whom the same relates differs wholly or partially from the benefits which could be obtained under this Act for and in respect of such child but he shall not approve of an agreement under this section unless he is of opinion and so records in his order under this section that the provision made by such agreement for and in respect of such child is substantially as beneficial to such child and its mother as the benefits which could be obtained for and in respect of such child under this Act.
(4) An order under this section recording the approval by a Justice of the District Court of an agreement shall, where no affiliation order has been made in respect of the illegitimate child to whom such agreement relates, be a complete bar to proceedings under this Act against any person in respect of such child and, where an affiliation order has been made in respect of such child, shall be a complete bar to any further proceedings under this Act in respect of such child against the putative father of such child and to all proceedings under this Act against any other person in respect of such child.
(5) Before the mother of an illegitimate child in respect of whom no affiliation order has been made under this section applies to a Justice of the District Court for his approval of an agreement she shall make an information in writing upon oath identifying the admitted father as the father of such child and the making of such information shall be a condition precedent to the making of such application by such mother.
Recovery of weekly or other sums.
11.—(1) Every weekly or other sum which is payable in respect of an illegitimate child under an affiliation order or under this Act by the putative father of such child or by any other person may be recovered by the person to whom such sum is so payable from such putative father or such other person (as the case may be) as a civil debt.
(2) Where—
(a) any illegitimate child in respect of whom a weekly sum is payable under an affiliation order is in receipt of relief from any local body administering the relief of the poor, and
(b) any such weekly sum (or any part thereof) which either fell to be paid before the commencement of the receipt of such relief or falls to be paid during the continuance of such relief remains unpaid,
a Justice of the District Court may, on the application of such local body for directions, make such order in the matter, and in particular in regard to weekly sums remaining unpaid at the date of such order, as he shall think proper.
Notice of change of address.
12.—Every person by whom any weekly or other sum is payable under an affiliation order or under this Act shall if he changes his address give notice of such change to the person to whom such weekly or other sum is payable and if he fails without reasonable cause to give such notice shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding two pounds.
Attachment of pension or income.
13.—(1) Where any person by whom any weekly or other sum is payable under an affiliation order or under this Act is in receipt of any pension or income which is capable of being attached and such person makes default in the payment of such weekly or other sum or any part thereof a Justice of the District Court may upon the application of the person or body to whom such sum or the part thereof in respect of which default is made is payable and upon being satisfied of such default may make an order (in this section referred to as an attachment order) directing the payment out of such pension or income to the person named in such order of a sum equal in amount to the amount of the weekly or other sum or the part thereof in respect of which default has been made or, in the case of a continuing default, the payment out of such pension or income of such weekly or other sum as such Justice shall specify in that behalf in such order.
(2) An attachment order shall be sufficient authority to the person by whom the pension or income to which such order relates is payable to make the payment specified therein and the receipt of the person to whom such payment is made in pursuance of such order shall to the extent of such payments be a good discharge for such pension or income as against the person entitled to the same.
Liability of mother of illegitimate child.
14.—Nothing in this Act shall operate to remove or diminish the liability of the mother of an illegitimate child to maintain such child.
Cost of proceedings.
15.—The costs of every summons, application and other proceeding under this Act shall be borne in such manner as the Court by whom such proceeding is heard shall in its discretion direct.
Rules of Court.
16.—The procedure and practice under this Act shall be regulated by Rules of Court.
Repeal.
17.—The Bastardy (Ireland) Act, 1863, is hereby repealed.
Short title.
18.—This Act may be cited as the Illegitimate Children (Affiliation Orders) Act, 1930.
