ACHT PÓNAÍ (SOLÁTHAR AGUS COTHABHÁIL), 1935.
Mínithe.
1.—(1) San Acht so—
cialluíonn an abairt “an tAire” an tAire Dlí agus Cirt;
foluíonn an abairt “clárathóir contae” fo-shirriam ach ní fholuíonn aon chlárathóir contae ná beidh comhachta, dualgaisí, ceartanna agus oblagáidí fo-shirriaim aistrithe chuige de thurus na huaire de bhuadh ailt 54 den Acht Oifigigh Cúirte, 1926 (Uimh. 27 de 1926), no eile;
léireofar an abairt “an clárathóir contae” mar thagairt don chlárathóir chontae gur ina líomatáiste feidhmiúcháin a bheidh an póna no an áit gur maidir leis a húsáidtear an abairt sin;
foluíonn an focal “póna” aon chlós, foirgint, no áitreabh a bheidh déanta nó oiriúnuithe chun áirnéis no ainmhithe geobhfar no tógfar fé aon phróiseas dlí no barántas dleathach no ainmhithe gheobhfar ag treaspás, ag fánaíocht nó ar seachrán no áirnéis nách fios cé is únaer uirthi no nách féidir teacht ar a húnaer, do ghlacadh, do chothabháil, do choinneáil no do shlánchoimeád ann;

2.—(1) Déanfaidh gach údarás áitiúil pé pónaí ordóidh an clárathóir contae, le haontú an Aire, go generálta no in aon chás áirithe do sholáthar i líomatáiste feidhmiúcháin an údaráis áitiúla san agus déanfaidh gach údarás áitiúil gach póna sholáthróid fén Acht so do chothabháil do réir an Achta so.
(2) Pé uair, tar éis an Achta so do rith, a dhéanfaidh údarás áitiúil do réir na hoblagáide chuige sin a cuirtear ortha leis an Acht so áit do sholáthar chun é theacht chun bheith agus chun é bheith ina phóna agus is deimhin leis an gclárathóir contae an áit sin do bheith oiriúnach chun é d'úsáid mar phóna agus do bheith i dtreo mhaith agus ar staid mhaith bhéarfaidh an clárathóir contae amach don údarás áitiúil sin deimhniú á dhearbhú an áit sin do bheith ina phóna agus leis sin tiocfaidh an áit sin chun bheith agus beidh sé ina phóna ar n-a sholáthar ag an údarás áitiúil sin fén Acht so.
(3) Pé uair a bhíonn aon áit do sholáthruigh údarás áitiúil mar phóna roimh an Acht so do rith á úsáid mar phóna le linn an Achta so do rith déanfaidh an clárathóir contae, más deimhin leis agus nuair is deimhin leis an áit sin do bheith oiriúnach chun é d'úsáid mar phóna agus do bheith i dtreo mhaith agus ar staid mhaith, deimhniú do thabhairt amach don údarás áitiúil sin á dhearbhú an áit sin do bheith ina phóna agus leis sin tiocfaidh an áit sin chun bheith agus beidh sé ina phóna agus tuigfear chun crícheanna an Achta so gur fén Acht so do sholáthruigh an t-údarás áitiúil sin é.
(4) I gcás áit do sholáthruigh údarás áitiúil mar phóna roimh an Acht so do rith do bheith á úsáid mar phóna le linn an Achta so do rith ní chuirfidh éinní san alt so cosc leis an áit sin do leanúint de bheith á úsáid mar phóna go dtí go dtabharfar amach ina thaobh deimhniú fén bhfo-alt deiridh sin roimhe seo den alt so no deimhniú fén Acht so á rá nách gá an áit sin a thuilleadh mar phóna.
Scur de phóna d'úsáid.
3.—(1) Pé uair is deimhin leis an Aire, i dtaobh póna do sholáthruigh údarás áitiúil fén Acht so no i dtaobh áite do sholáthruigh údarás áitiúil mar phóna roimh an Acht so do rith agus do bhí á úsáid mar phóna le linn an Achta so do rith ach ná beidh deimhnithe fén Acht so é bheith ina phóna, nách gá é a thuilleadh mar phóna toisc póna eile do sholáthar ina ionad no toisc aon chúis eile, féadfaidh an clárathóir contae, le haontú an Aire, deimhniú do thabhairt amach don údarás áitiúil sin á dhearbhú gan an póna no an áit sin do bheith ina phóna a thuilleadh agus leis sin scuirfidh an póna no an áit sin de bheith ina phóna no de bheith ion-úsáidte go dleathach mar phóna.
(2) Pé uair a bhéarfaidh an clárathóir contae deimhniú amach fén alt so d'údarás áitiúil féadfaidh an t-údarás áitiúil sin, le ceadú ón Aire Rialtais Áitiúla agus Sláinte Puiblí, an clós, an fhoirgint, no an t-áitreabh le n-a mbaineann an deimhniú san do dhíol, do thabhairt suas no do chur de láimh ar shlí eile no d'úsáid chun aon chríche dleathaighe agus an sochar (más ann do) do gheobhfar as aon díol, tabhairt suas no cur-de-láimh den tsórt san cuirfid chun críche é i pé slí ordóidh an tAire sin.
Pónaí do rialú, etc.
4.—(1) Fé réir orduithe generálta no áirithe an Aire is fén gclárathóir contae a bheidh rialú agus bainistí gach póna dhéanfaidh údarás áitiúil do sholáthar agus do chothabháil fén Acht so.
(2) Na costaisí (sa mhéid ná deintear leis an Acht so no ná déanfar fé a mhalairt de shocrú ina dtaobh) fé n-a raghaidh clárathóir contae maidir le rialú agus bainistí gach póna dhéanfaidh údarás áitiúil do sholáthar agus do chothabháil fén Acht so isé an t-údarás áitiúil gur ina líomatáiste feidhmiúcháin a bheidh an póna san a ghlanfaidh iad agus tuigfear na costaisí sin do bheith ina gcuid de sna costaisí fé n-a raghaidh an t-údarás áitiúil sin chun an phóna san do sholáthar agus do chothabháil.
Coimeádaithe póna do cheapadh.
5.—(1) Gach údarás áitiúil go mbeidh aon phóna ina líomatáiste feidhmiúcháin ceapfaid, chó minic agus is gá é, do gach póna fé leith den tsórt san agus (lasmuich de chás dá bhforáltar a mhalairt leis an Acht so) íocfaid duine ceart oiriúnach chun bheith ina choimeádaí ar an bpóna san agus ceapfaid amhlaidh freisin agus íocfaid pé méid daoine cearta oiriúnacha (más aon mhéid é) ordóidh an clárathóir contae, go generálta no in aon chás áirithe, chun bheith ina gcongantóirí don choimeádaí phóna san.
(2) Pé uair a theipfidh ar údarás áitiúil ar feadh trí mhí aon cheapadh do dhéanamh is gá don údarás san do réir an fho-ailt sin roimhe seo den alt so do dhéanamh féadfaidh an tAire an ceapadh san do dhéanamh agus i ngach cás den tsórt san ordóidh sé an tslí ina dtabharfar luach saothair don té ceapfar amhlaidh.
(3) Pé uair a thárlóidh folúntas i bpost coimeádaí póna ceapfar fén alt so no i bpost congantóra d'aon choimeádaí póna den tsórt san féadfaidh an clárathóir contae fé n-a mbeidh rialú agus bainistí an phóna gur ina thaobh do thárla an folúntas san duine do cheapadh chun an phuist sin do líonadh go sealadach go dtí go líonfar an post san go cuibhe fén alt so agus i ngach cás den tsórt san bhéarfar luach saothair don té ceapfar amhlaidh sa tslí chéanna agus sa mhéid chéanna ina dtugtaí luach saothair don té do shealbhuigh an post san sarar thárla an folúntas san.
(4) Más o údarás áitiúil a gheibheann aon choimeádaí póna ceapfar fén alt so no aon chongantóir d'aon choimeádaí póna den tsórt san a íocaíocht no a luach saothair i bpáirt no go hiomlán féadfaidh an tAire no an t-údarás áitiúil sin é bhriseadh as a phost mar choimeádaí póna no congantóir den tsórt san agus i ngach cás eile féadfaidh an tAire é bhriseadh as an bpost san aige.
(5) Ní bhainfidh an tAcht Oifigigh Cúirte, 1926 (Uimh. 27 de 1926), ná Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926 (Uimh. 39 de 1926), le héinne ceapfar ná le haon cheapadh déanfar fén alt so.
Dualgaisí agus luach saothair coimeádaithe póna.
6.—(1) Déanfaidh gach coimeádaí póna an póna dá gceapfar é mar choimeádaí póna fén Acht so do rialú agus do bhainstí ach is don chlárathóir chontae agus thar ceann agus fé réir orduithe an chlárathóra chontae déanfar an rialú agus an bhainistí sin.
(2) Fé réir forálacha an ailt seo isé slí ina dtabharfar luach saothair do gach coimeádaí póna ceapfar fén Acht so ná tré tháillí a hordófar fén Acht so no tríd an údarás áitiúil a cheapfaidh é d'íoc luach saothair leis de pé méid ar a gcinnfidh an t-údarás áitiúil sin le toiliú an Aire Rialtais Áitiúla agus Sláinte Puiblí no tré sna táillí sin agus an luach saothair sin le chéile.
(3) Pé uair a déanfar coimeádaí póna ceapfar fén Acht so do cheapadh ar na téarmaí go bhfuighidh sé luach saothair ón údarás áitiúil a cheapfadh é agus go ndéanfa sé cuntas in aon táillí de sna táillí orduithe gheobha sé do thabhairt don údarás áitiúil sin agus na táillí sin d'íoc leo, ansan agus sa chás san déanfaidh an coimeádaí póna san cuntas sna táillí orduithe uile gheobha sé do thabhairt don údarás áitiúil sin agus na táillí sin d'íoc leo.
Pónaí do dheisiú mara ndeinidh an t-údarás áitiúil amhlaidh.
7.—(1) Pé uair a theipfidh ar údarás áitiúil no fhailleoid treo ceart agus staid cheart do choimeád ar aon phóna áirithe is gá don údarás san do réir an Achta so do chothabháil féadfaidh an tAire a údaru don chlárathóir chontae a chur fé ndeár pé deisiúchán no obair eile do dhéanamh ar an bpóna san is gá.
(2) Pé uair a theipfidh ar údarás áitiúil no fhailleoid leorsholáthar do chur ar fáil d'aon tsubstaint no rud a theastóidh chun úsáid cheart chuibhe do dhéanamh d'aon phóna áirithe is gá don údarás áitiúil sin, do réir an Achta so, do chothabháil féadfaidh an clárathóir contae, le toiliú an Aire, a chur fé ndeár go gcuirfear ar fáil pé méid (nách mó a chostas ná deich bpúint) den tsubstaint no den rud san a mheasfa sé, leis an toiliú roimhráite, do bheith ceart.
(3) Pé uair a dhéanfaidh clárathóir contae fén alt so a chur fé ndeár deisiúchán no obair eile do dhéanamh no a chur fé ndeár aon tsubstaint no rud do chur ar fáil beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) na costaisí agus na caiteachaisí fé n-a ndeachaidh an clárathóir contae sin ag déanamh an deisiúcháin no na hoibre eile sin no á chur fé ndeár é dhéanamh no á chur fé ndeár an tsubstaint no an rud san do chur ar fáil (pe'ca aca é) beidh an clárathóir contae sin i dteideal iad do bhaint mar fhiacha síbhialta, in aon chúirt dlighinse inniúla, den údarás áitiúil ar a mbeidh sé de dhualgas fén Acht so an póna do chothabháil ar a ndearnadh an deisiúchán no an obair eile sin no gur ina chóir do cuireadh an tsubstaint no an rud san ar fáil;
(b) deimhniú i scríbhinn ar n-a shéalú le séala oifigiúil an Aire agus ag deimhniú méid aon chostaisí no caiteachaisí den tsórt a luaidhtear sa chéad mhír den fho-alt so beidh sé ina fhianaise dho-chlaoite ar mhéid na gcostaisí agus na gcaiteachaisí sin chun críche aon imeachta chun na gcostaisí agus na gcaiteachaisí sin do bhaint amach fén alt so.
Rialacháin.
8.—(1) Féadfaidh an tAire, le hordú rialacháin do dhéanamh i dtaobh gach ní no éinní acu so leanas, sé sin le rá:—
(a) pónaí do bhainistí agus do rialáil go generálta;
(b) comhachta, dualgaisí agus feidhmeanna coimeádaithe póna;
(c) na táillí a híocfar le coimeádaithe póna agus na daoine íocfaidh na táillí sin;
(d) na táillí sin do chur de láimh agus an méid (más aon mhéid é) de sna táillí sin fhéadfaidh aon choimeádaí póna do choimeád;
(e) ainmhithe gheobhfar ag treaspás, ag fánaíocht no ar seachrán, no áirnéis nach fios cé is únaer uirthi no nách féidir teacht ar a húnaer, do dhíol no do chur de láimh no do dhíthiú agus an t-am gur dá éis a déanfar an díol no an cur-de-láimh no an díthiú san;
(f) aon airgead do gheobhfar de bharr aon díola fén mír dheiridh sin roimhe seo do chur de láimh;
(g) éinní no aon rud dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú.
(2) Má dheineann duine ar bith éinní (tré ghníomh no tré fhaillí) contrárdha d'aon rialachán a déanfar fén alt so beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air no, más rogha leis an gcúirt é, príosúntacht ar feadh aon téarma nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.

9.—Gach duine—
(a) dhéanfaidh damáiste d'aon phóna no bhrisfidh isteach ann, no
(b) scaoilfidh no thógfaidh as aon phóna aon ainmhithe no áirnéis a bheidh á gcoimeád go dleathach ann, no
(c) bhainfidh feidhm as fóiréigean, bagairtí no breabanna chun a chur in áirithe go ndéanfar aon ainmhithe no áirnéis a bheidh á gcoimeád go dleathach in aon phóna do scaoileadh no do bhreith chun siúil, no
(d) bhainfidh feidhm as fóiréigean, bagairtí no breabanna chun a thabhairt ar éinne bheidh ceaptha fén Acht so chun bheith ina choimeádaí phóna no ina chongantóir do choimeádaí phóna gan oifig an choimeádaí no an chongantóra san do ghabháil le n-a ais no d'fheidhmiú no chun é chosc ar an oifig sin do ghabháil le n-a ais no d'fheidhmiú no chun a thabhairt ar éinne den tsórt san dualgaisí na hoifige sin d'fheidhmiú go mí-ionnraic no go faillíoch,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air no príosúntacht ar feadh aon téarma nách sia ná naoi mí no, más rogha leis an gcúirt é, an fhíneáil sin agus an phríosúntacht san le chéile.

10.—(1) Pé uair a theipfidh ar údarás áitiúil no fhailleoid dualgas do chólíonadh a cuirtear ar an údarás áitiúil sin leis an Acht so luighfidh imeachta um fhaoiseamh tré mhandamus, ar agra an Aire, chun a chur fhiachaint ar an údarás áitiúil sin an dualgas san do chólíonadh.
(2) Luighfidh imeachta fén bhfo-alt deiridh sin roimhe seo d'ainneoin leigheas eile do bheith ann agus beidh na himeachta san gan dochar don leigheas eile sin agus ní scór chun an fhaoisimh a hiarrfar sna himeachta san do dhiúltadh an leigheas eile sin do bheith ann.
Údaráis áitiúla do chruinniú costaisí.
11.—(1) Isé slí ina gcruinneofar na costaisí fé n-a raghaidh údarás áitiúil chun pónaí do sholáthar agus do chothabháil no chun éinní eile do dhéanamh maidir le pónaí do réir an Achta so ná—
(a) i gcás contae-bhuirge Bhaile Atha Cliath agus buirge Dhún Laoghaire, tríd an ráta bárdais agus
(b) i gcás aon chontae-bhuirge eile, tríd an ráta tré n-a gcruinnítear costaisí (seachas costaisí caomhnóirí no costaisí bhaineann leis an ráta dealbhais) fé fho-alt (3) d'alt 46 den Local Government (Ireland) Act, 1898, agus
(c) i gcás buirge no bailecheanntair, tríd an ráta tré n-a gcruinnítear costaisí fé sna hAchtanna Sláinte Puiblí, 1878 go 1931, agus
(d) i gcás contae, tríd an ráta dealbhais go cothrom ar an gcontae gan aon bhuirg ná bailecheanntar atá ann d'áireamh.
(2) Pé uair a bheidh aon phóna, a bheidh soláthruithe agus á chothabháil do réir an Achta so ag aon údarás áitiúil amháin (dá ngairmtear an príomh-údarás áitiúil sa bhfo-alt so) ag fónamh no á úsáid mar phóna do líomatáiste fheidhmiúcháin údaráis no údarásanna áitiúla eile (dá ngairmtear na húdaráis áitiúla rann íocacha sa bhfo-alt so) íocfaidh gach ceann fé leith de sna húdaráis áitiúla rann-íocacha leis an bpríomh-údarás áitiúil, ar éileamh an phríomh-údaráis áitiúla, pé cion de chostaisí soláthruithe agus cothabhála an phóna san ar a gcó-aontóidh na húdaráis áitiúla san no cheapfaidh an tAire Rialtais Áitiúla agus Sláinte Puiblí cheal an chó-aontuithe sin agus bainfidh an chéad fho-alt den alt so le gach suim is iníoctha ag údarás áitiúil rann-íocach fén bhfo-alt so fé is dá mba chostaisí do réir bhrí an chéad fho-ailt sin an tsuim sin.
(3) Tuigfear chun crícheanna an ailt seo luach saothair choimeádaí phóna agus chongantóirí coimeádaí phóna aon phóna soláthrófar agus a bheidh á chothabháil fén Acht so do bheith ina chuid de chostaisí cothabhála an phóna san.

12.—Féadfaidh an tAire no féadfar ar agra an Aire, mar chúisitheoir, gach cionta fé aon fhoráil den Acht so do chúiseamh.

13.—Sa mhéid go gceadóidh an tAire Airgid é is amach as airgead a sholáthróidh an tOireachtas a híocfar na costaisí uile fé n-a raghaidh an tAire ag cur an Achta so in éifeacht.

POUNDS (PROVISION AND MAINTENANCE) ACT, 1935.
Definitions.
1.—(1) In this Act—
the expression “the Minister” means the Minister for Justice; the expression “county registrar” includes an under-sheriff but does not include any county registrar to whom the powers, duties, rights, and obligations of an under-sheriff have for the time being not been transferred by virtue of section 54 of the Court Officers Act, 1926 (No. 27 of 1926), or otherwise;
the expression “the county registrar” shall be construed as referring to the county registrar within whose functional area the pound or place in relation to which such expression is used is situate;
the word “pound” includes any enclosure, building, or premises constructed or adapted for the reception, maintenance, custody or safe-keeping of chattels or of animals seized or taken under any legal process or lawful warrant or of animals found trespassing, wandering or straying or of chattels of which the owner is unknown or cannot be found;
the word “prescribed” means prescribed by regulations made by the Minister under this Act.
(2) For the purposes of this Act each of the following bodies shall be a local authority, that is to say:—
(a) the council of a county borough;
(b) the council of a county;
(c) the council of a borough;
(d) the council of an urban district.
Duty of local authorities to provide pounds.
2.—(1) Every local authority shall provide in the functional area of such authority such pounds as the county registrar shall, with the approval of the Minister, direct either generally or in any particular case, and every local authority shall maintain in accordance with this Act every pound provided by them under this Act.
(2) Whenever, after the passing of this Act, a local authority provides, in pursuance of the obligation in that behalf imposed on them by this Act, a place to become and be a pound and the county registrar is satisfied that such place is suitable for use as a pound and is in good repair and condition, the county registrar shall issue to such local authority a certificate declaring such place to be a pound and thereupon such place shall become and be a pound provided by such local authority under this Act.
(3) Whenever any place provided as a pound by a local authority before the passing of this Act is at such passing used as a pound, the county registrar shall, if and when he is satisfied that such place is suitable for use as a pound and is in good repair and condition, issue to such local authority a certificate declaring such place to be a pound and thereupon such place shall become and be a pound and shall, for the purposes of this Act, be deemed to have been provided by such local authority under this Act.
(4) Where a place provided as a pound by a local authority before the passing of this Act is at such passing used as a pound, nothing in this section shall prevent such place continuing to be used as a pound until the issue in respect thereof of either a certificate under the next preceding sub-section of this section or a certificate under this Act that such place is no longer required as a pound.
Cesser of use of a pound.
3.—(1) Whenever the Minister is satisfied that a pound provided under this Act by a local authority or a place provided as a pound by a local authority before the passing of this Act and used as a pound at such passing but not certified under this Act to be a pound is, by reason of the provision of another pound in lieu thereof or for any other reason, no longer required as a pound, the county registrar may with the approval of the Minister issue to such local authority a certificate declaring that such pound or place is no longer a pound and thereupon such pound or place shall cease to be a pound or lawfully usable as a pound.
(2) Whenever the county registrar issues under this section a certificate to a local authority, such local authority may, with the sanction of the Minister for Local Government and Public Health, sell, surrender or otherwise dispose of or use for any lawful purpose the enclosure, building, or premises to which suchcertificate relates and shall apply the proceeds (if any) of any such sale, surrender or disposition in such manner as the said Minister shall direct.
Control, etc., of pounds.
4.—(1) Subject to the general or particular directions of the Minister, the control and management of every pound provided and maintained under this Act by a local authority shall be vested in the county registrar.
(2) The expenses (so far as they are not otherwise provided for by or under this Act) incurred by a county registrar in the control and management of every pound provided and maintained under this Act by a local authority shall be defrayed by the local authority in whose funnctional area such pound is situate and such expenses shall be deemed to be part of the expenses incurred by such local authority in the provision and maintenance of such pound.
Appointment of pound-keepers.
5.—(1) Every local authority in whose functional area any pound is situate shall as often as occasion requires appoint for each such pound and (save as is otherwise provided by this Act) shall pay a fit and proper person to be keeper thereof and shall also so appoint and shall pay so many (if any) fit and proper persons as the county registrar shall direct, either generally or in any particular case, to be assistants to such pound-keeper.
(2) Whenever a local authority fails for three months to make any appointment which such authority is required by the foregoing sub-section of this section to make, the Minister may make such appointment, and in every such case shall direct the manner in which the person so appointed shall be remunerated.
(3) Whenever a vacancy occurs in the post of a pound-keeper who is appointed under this section or in the post of assistant to any such pound-keeper the county registrar having the control and management of the pound in respect of which such vacancy occurs may appoint a person to fill such post temporarily until such post is duly filled under this section, and in every such case the person so appointed shall be remunerated in the same manner and to the same extent as the person who held such post prior to such vacancy.
(4) Every pound-keeper appointed under this section and every assistant to any such pound-keeper may, if he is paid or remunerated wholly or partly by a local authority, be dismissed from his post as such pound-keeper or assistant by either the Minister or such local authority and may, in every other case, be dismissed from his said post by the Minister.
(5) Neither the Court Officers Act, 1926 (No, 27 of 1926), nor the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926), shall apply to any person appointed or to any appointment made under this section.
Duties and remuneration of pound-keepers.
6.—(1) Every pound-keeper shall control and manage the pound of which he is appointed pound-keeper under this Act but such control and management shall be for and on behalf of and subject to the directions of the county registrar.
(2) Subject to the provisions of this section, every pound-keeper appointed under this Act shall be remunerated by means of fees to be prescribed under this Act or by means of remuneration paid to him by the local authority by whom he is appointed and of such amount as such local authority shall, with the consent of the Minister for Local Government and Public Health, determine or by means of both such fees and such remuneration.
(3) Whenever any pound-keeper appointed under this Act is appointed on the terms that he shall receive from the local authority by whom he is appointed remuneration and that any of the prescribed fees received by him shall be accounted for and paid over by him to such local authority, then and in such case such pound-keeper shall account for and pay over to such local authority all the prescribed fees which are received by him.
Repair of pounds on default of local authority.
7.—(1) Whenever a local authority fails or neglects to maintain in proper repair and condition any pound which such authority is required by this Act to maintain, the Minister may authorise the county registrar to procure such repairs or other work to be done to such pound as may be necessary.
(2) Whenever a local authority fails or neglects to provide a sufficient supply of any substance or thing required for the due and proper use of any pound which such local authority is required by this Act to maintain, the county registrar may, with the consent of the Minister, procure the supply of such amount (not exceeding ten pounds in cost) as he shall, with the consent aforesaid, think proper of such substance or thing.
(3) Whenever a county registrar has under this section procured repairs or other work to be done or procured the supply of any substance or thing the following provisions shall have effect, that is to say:—
(a) such county registrar shall be entitled to recover the costs and expenses incurred by him in the execution or procuring the doing of such repairs or other work or procuring the supply of such substance or thing (as the case may be) as a civil debt in any court of competent jurisdiction from the local authority charged under this Act with the duty of maintaining the pound to or for which such repairs or other work were done or such substance or thing was supplied;
(b) a certificate in writing sealed with the official seal of the Minister certifying the amount of any such costs or expenses as are mentioned in the first paragraph of this sub-section shall be conclusive evidence of the amount of such costs and expenses for the purpose of any proceedings for the recovery of such costs and expenses under this section.
Regulations.
8.—(1) The Minister may by order make regulations for all or any of the following matters, that is to say:—
(a) the general management and regulation of pounds;
(b) the powers, duties, and functions of pound-keepers;
(c) the fees to be paid to pound-keepers and the persons by whom such fees are to be paid;
(d) the disposal of such fees including the amount (if any) of such fees which may be retained by any pound-keeper;
(e) the sale, disposal, or destruction of animals found trespassing, wandering, or straying or of chattels of which the owner is unknown or cannot be found and the time after which such sale, disposal, or destruction shall take place;
(f) the disposal of any moneys realised by any sale under the next preceding paragraph;
(g) any matter or thing referred to in this Act as prescribed or to be prescribed.
(2) If any person does any act (whether of commission or omission) in contravention of any regulation made under this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds, or at the discretion of the court, to imprisonment for any term not exceeding six months, or to both such fine and such imprisonment.
Offences.
9.—Every person who—
(a) damages or breaks into any pound, or
(b) releases from or takes out of any pound any animals or chattels lawfully impounded therein, or
(c) uses violence, threats, or bribes for the purpose of securing the release from or the taking away of any animals or chattels lawfully impounded in any pound, or
(d) uses violence, threats, or bribes for the purpose of inducing or preventing any person who has been appointed under this Act to be a pound-keeper or to be assistant to a pound-keeper from undertaking or executing the office of such keeper or assistant or for the purpose of inducing any such person to execute the duties of such office corruptly or negligently,
shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or to imprisonment for any term not exceeding nine months or, at the discretion of the court, to both such fine and such imprisonment.
Remedy by mandamus against defaulting local authority.
10.—(1) Whenever a local authority fails or neglects to perform a duty imposed on such local authority by this Act, proceedings for relief by way of mandamus to enforce the performance of such duty by such local authority shall lie at the suit of the Minister.
(2) Proceedings under the foregoing sub-section shall lie notwithstanding the existence of an alternative remedy and shall be without prejudice to such alternative remedy, and the existence of such alternative remedy shall not be a ground for the refusal of the relief sought in such proceedings.
Raising of expenses by local authorities.
11.—(1) The expenses incurred by a local authority in the provision and maintenance of or otherwise in connection with pounds in pursuance of this Act shall be raised—
(a) in the case of the county borough of Dublin and of the borough of Dun Laoghaire by means of the municipal rate, and
(b) in the case of any other county borough by means of the rate by which expenses (other than the expenses of guardians or in connection with the poor rate) are raised under sub-section (3) of section 46 of the Local Government (Ireland) Act, 1898, and
(c) in the case of a borough or an urban district by means of the rate by which expenses under the Public Health Acts, 1878 to 1931, are raised, and
(d) in the case of a county, by means of the poor rate equally over the county exclusive of any borough or urban district therein.
(2) Whenever any pound which is provided and maintained in pursuance of this Act by one local authority (in this sub-section called the principal local authority) serves or is used as a pound in respect of the functional area of one or more other local authorities (in this sub-section called the contributing local authorities), every of the contributing local authorities shall pay to the principal local authority on demand by the principal local authority such proportion of the expenses of the provision and maintenance of such pound as shall be agreed on by such local authorities or, in default of such agreement, shall be fixed by the Minister for Local Government and Public Health, and the first sub-section of this section shall apply to every sum payable by a contributing local authority under this sub-section as if such sum were expenses within the meaning of the said first sub-section.
(3) The remuneration of the pound-keeper and the assistants of the pound-keeper of any pound provided and maintained under this Act shall be deemed, for the purposes of this section, to be part of the expenses of the maintenance of such pound.
Prosecution of offences.
12.—Every offence under any provision of this Act may be prosecuted by or at the suit of the Minister as prosecutor.
Expenses.
13.—All expenses incurred by the Minister in carrying this Act into effect shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
14.—The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of the said Schedule.
Short title.
15.—This Act may be cited as the Pounds (Provision and Maintenance) Act, 1935.
