2.—Do réir an ráta atá leagtha amach sa Chéad Sceideal a ghabhann leis an Acht so isea bheidh pinsean sean-aoise a thosnóidh ar an gcéad lá ceaptha no dá éis sin in ionad é bheith do réir an ráta atá leagtha amach sa Chéad Sceideal a ghabhann le hAcht 1919.

3.—(1) Gach pinsean sean-aoise a thosnuigh no a thosnóidh roimh an gcéad lá ceaptha agus is iníoctha, díreach roimh an lá san, do réir ráta ís mó ná scilling sa tseachtain, agus is iníoctha le duine ná beidh ceithre fichid bliain slán aige an chéad lá ceaptha is do réir an ráta atá leagtha amach sa Dara Sceideal a ghabhann leis an Acht so a bheidh sé iníoctha ar an gcéad lá ceaptha, agus dá éis sin, agus go dtí an dara lá ceaptha, in ionad bheith iníoctha do réir an ráta atá leagtha amach sa Chéad Sceideal a ghabhann le hAcht 1919.

(4) Ní dhéanfidh athchomharc i gcoinnibh rialú oifigigh phinsin, le n-ar luíoduíodh no le n-ar stopadh pinsean fén alt so, oibriú an rialuithe sin do chur ar fionnraoi, ach más i bhfabhar don phinsinéir a tabharfar an bhreith dheiridh ar an athchomharc beidh teideal aige chun gach suim d'fháil a bheadh iníoctha leis dá mbeadh rialú an oifigigh phinsin do réir na breithe deiridh sin.

4.—(1) Díreach tar éis rithte an Achta so cromfidh gach oifigeach pinsin ar ath-fhéachaint do dhéanamh ar gach pinsean sean-aoise is iníoctha ina cheanntar agus—

(a) a thosnuigh roimh rith an Achta so no a thosnóidh roimh an gcéad lá ceaptha, agus

[EN]

(b) is iníoctha, díreach roimh an gcéad lá ceaptha, do réir ráta is mó ná scilling sa tseachtain, agus

(c) is iníoctha le daoine ná bheidh ceithre fichid bliain slán acu ar an gcéad lá ceaptha

[EN]

agus ar dhéanamh na hath-fhéachainte sin déanfidh an t-oifigeach pinsin luíodú no ceartú eile ar an bpinsean san go dtí an ráta ar a mbeadh sé iníoctha do réir an scála atá leagtha amach sa Chéad Sceideal a ghabhann leis an Acht so, agus socróidh sé ráta an phinsin sin dá réir sin.

(2) Gach pinsean is féidir a ath-fhéachaint fén alt so, is do réir an ráta a shocróidh an t-oifigeach pinsin tar éis na hath-fhéachainte sin a bheidh sé iníoctha ar an dara lá ceaptha, agus dá éis sin, in ionad bheith iníoctha do réir an ráta atá leagtha amach sa Dara Sceideal a ghabhann leis an Acht so.

(3) Einne a bheidh, i dtosach feidhme an Achta so, ag fáil pinsin is féidir a ath-fhéachaint fén alt so agus adeir gur dineadh éagcóir air in ath-fhéachaint an phinsin sin fén alt so, féadfa sé athchomharc do dhéanamh chun an phinsean-choiste áitiúla i gcoinnibh tora na hathfhéachainte, agus breithneoidh siad san an scéal agus tabharfid a mbreith air ar an gcuma gcéanna agus fé réir an athchomhairc chéanna chun an árd-údaráis phinsin agus dá mb'é rud a bheadh san athfhéachaint fén alt so ná tuarasgabháil o oifigeach pinsin ar éileamh a cuirfí fé n-a bhráid chun tuairisciú agus fiosrú do dhéanamh ann fé alt 7 d'Acht 1908.

5.—(1) Aireofar mar leanas luach bliantúil aon mhaoine den tsórt a luaidhtear i gclás (a) d'fho-alt (1) d'alt 2 d'Acht 1911 in ionad e áireamh ar an modh a horduítear leis an gclás san no le fo-alt (1) d'alt 4 d'Acht 1919, sé sin le rá:—

OLD AGE PENSION ACT, 1924.


AN ACT TO AMEND THE OLD AGE PENSIONS ACTS, 1908 TO 1919, AND THE BLIND PERSONS ACT, 1920, IN RESPECT OF THE RATE AT WHICH PENSIONS ARE PAYABLE THEREUNDER AND ALSO IN CERTAIN OTHER RESPECTS. [5th June, 1924.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTAT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

the expression “the Old Age Pensions Acts” means and includes the Old Age Pensions Acts, 1908 to 1919 and this Act;

[GA]

the expressions “the Act of 1908,” “the Act of 1911,” “the Act of 1919” and “the Act of 1920” mean respectively the Old Age Pensions Act, 1908, the Old Age Pensions Act, 1911, the Old Age Pensions Act, 1919, and the Blind Persons Act, 1920;

[GA]

the expression “old age pension” means an old age pension under the Old Age Pensions Acts, 1908 to 1919, or an old age pension under the Old Age Pensions Acts, as the context may require, and in either case includes a pension under section 1 of the Act of 1920;

[GA]

the expression “the first appointed day” means the 20th day of June, 1924;

[GA]

the expression “the second appointed day” means the 5th day of September, 1924;

[GA]

the expression “the Minister” means the Minister for Finance.

[GA]

Rate of future old age pensions.

2.—An old age pension which shall commence to accrue on or after the first appointed day shall be at the rate set forth in the First Schedule to this Act in lieu of the rate set forth in the First Schedule to the Act of 1919.

[GA]

First reduction of rates of pensions.

3.—(1) Every old age pension which has or shall have commenced to accrue before the first appointed day and is, immediately before that day payable at a rate exceeding one shilling per week, and is payable to a person who, on the first appointed day, shall not have attained the age of eighty years, shall, on and after the first appointed day and until the second appointed day, be payable at the rate set forth in the Second Schedule to this Act in lieu of the rate set forth in the First Schedule to the Act of 1919.

(2) Every old age pension which has or shall have commenced to accrue before the first appointed day and is, immediately before that day, payable at the rate of one shilling per week to a person who, on the first appointed day, shall not have attained the age of eighty years, shall continue to be payable and paid at that rate until the second appointed day or until the previous death or disqualification of the person entitled to receive the same, and shall then cease.

(3) If any person whose pension is reduced or terminated in pursuance of a ruling by the pension officer under this section claims that by reason of his age his pension should not have been liable to be so reduced or terminated, such person may appeal against such reduction or termination, as the case may be, to the local pension committee, who shall consider the matter and give their decision thereon in the same manner and subject to the like appeal to the central pension authority as if the ruling of the pension officer under this section was the report of a pension officer on a claim referred to him for report and inquiry under Section 7 of the Act of 1908.

(4) An appeal against the ruling of a pension officer reducing or terminating a pension under this section shall not suspend the operation of such ruling, but if the appeal is finally determined in favour of the pensioner, he shall be entitled to receive all sums which would have been payable to him if the ruling of the pension officer had been in accordance with such final determination.

Review of existing old age pensions for purpose of permanent reduction.

4.—(1) Immediately upon the passing of this Act every pension officer shall proceed to review all old age pensions payable in his district which—

(a) have commenced to accrue before the passing of this Act or shall commence to accrue before the first appointed day, and

[GA]

(b) immediately before the first appointed day are payable at a rate exceeding one shilling per week, and

[GA]

(c) are payable to persons who on the first appointed day shall not have attained the age of eighty years,and upon such review the pension officer shall reduce or otherwise adjust such pension to the rate at which the same would be payable according to the scale set forth in the First Schedule to this Act, and shall fix the rate of such pension accordingly.

[GA]

(2) Every pension liable to be reviewed under this section shall, on and after the second appointed day, be payable at the rate fixed by the pension officer on such review in lieu of the rate set forth in the Second Schedule to this Act.

[GA]

(3) Any person who at the commencement of this Act is in receipt of a pension liable to be reviewed under this section and claims to be aggrieved by the review of that pension under this section, may appeal against such review to the local pension committee, who shall consider the matter and give their decision thereon in the same manner and subject to the like appeal to the central pension authority as if the review under this section was the report of a pension officer on a claim referred to him for report and inquiry under section 7 of the Act of 1908.

(4) On and after the Friday next after the final determination of an appeal under the foregoing sub-section, the pension the subject of such appeal shall be payable at the rate (hereinafter called the final rate) finally fixed on such appeal in lieu of the rate (hereinafter called the original rate) fixed by the pension officer under this section, and in the event of the final rate being greater than the original rate the difference between such rates for the period during which the original rate was payable shall, on or as soon as conveniently may be after the Friday aforesaid, be paid to the person entitled to receive such pension.

Amendment of method of calculating value of certain property.

5.—(1) The yearly value of any such property as is mentioned in clause (a) of sub-section (1) of section 2 of the Act of 1911 shall be calculated as follows in lieu of the mode of calculation prescribed by that clause or by sub-section (1) of section 4 of the Act of 1919, that is to say:—

(i.) the first twenty-five pounds of the capital value of the said property shall be excluded, and

[GA]

(ii.) the yearly value of so much of the capital value of the said property as exceeds the sum of twenty-five pounds shall be taken to be one-tenth part of the capital value thereof.

[GA]

(2) This section shall not apply to a calculation of the means of any person who became, before the passing of this Act, entitled to receive an old age pension or who shall, after the passing of this Act, become entitled to receive a pension under Section 1 of the Act of 1920.

[GA]

(3) Clause (a) of sub-section (1) of section 4 of the Act of 1919 shall not apply to any case to which this section applies.

Certain monies not to be included in income.

6.—(1) In calculating the income mentioned in paragraph (b) of sub-section (1) of section 2 of the Act of 1911, no account shall be taken of any amounts received during a period of not more than six months in any year by a person or by the husband or wife of a person (as the case may be) under a medical certificate as sickness benefit or disablement benefit from a Friendly Society or a Trade Union or under the National Insurance Act, 1911.

(2) Clause (b) of sub-section (1) of section 4 of the Act of 1919 is hereby repealed.

Certain property to be included in calculation of means.

7.—(1) If and whenever any person, within three years before or at any time after he becomes entitled to receive an old age pension and either before or after the passing of this Act, assigns any property or income, such property or income shall be taken into account in calculating for the purpose of the Old Age Pensions Acts or section 1 of the Act of 1920 the means of that person, unless it shall appear that the assignment was a conveyance or transfer by operation of law or was a conveyance or transfer on a bona fide sale for valuable consideration in money or money's worth amounting to not less than four-fifths of the value of the property or income, or the estate or interest therein, which was the subject of the sale, or that the property comprised in the assignment consists only of a farm of land the poor law valuation whereof (including the buildings thereon) does not exceed £10, together with or without the stock and chattels thereon.

(2) The yearly value of any property or income which is by virtue of this section to be taken into account in calculating the means of any person shall be calculated in the like manner as the yearly value of property or income of a similar nature in the actual possession of or actual receipt by such person is required to be calculated, save that such value shall be calculated as of the date on which such person assigned such property or income or as of the date upon which the calculation is made by the pension officer, whichever value is the less.

(3) Where any person, by means of an assignment to which this section applies, assigns any property or income for valuable consideration in money or money's worth amounting to less than four-fifths of the value of the property or income, or the estate or interest therein, which is the subject of the transaction, such valuable consideration, if or so far as it is in the possession of the person at the time he becomes entitled to receive an old age pension, shall not be taken into account in calculating the means of that person for the purpose of the Old Age Pensions Acts or section 1 of the Act of 1920.

(4) Sub-section (3) of Section 4 of the Act of 1908 shall not apply to any assignment to, which this section applies.

(5) This section shall not apply to the calculation of the means of any person who became, before the passing of this Act, entitled to receive an old age pension.

(6) In this section the word “assign” includes any form of conveyance, transfer, or other transaction by which a person parts with the ownership or possession of any property or disentitles himself to receive any income, and the word “assignment” and other cognate words shall be construed accordingly.

Amendment of statutory condition as to means.

8.—(1) It shall be a statutory condition for—

(a) the receipt by any person before the second appointed day of an old age pension which, shall commence to accrue on or after the first appointed day, and

[GA]

(b) the receipt by any person on or after the second appointed day of any old age pension,

[GA]

that the person must satisfy the pension authorities that his means as calculated under the Old Age Pensions Acts do not exceed thirty-nine pounds five shillings.

(2) Paragraph (3) of section 2 of the Act of 1908, as amended by sub-section (1) of section 2 of the Act of 1919, shall cease to have effect in respect of any old age pension to which this section for the time being applies.

Short title and construction.

9.—(1) This Act may be cited as the Old Age Pensions Act, 1924.

(2) This Act shall be construed as one with the Old Age Pensions Acts, 1908 to 1919, and those Acts and this Act may be cited together as the Old Age Pensions Acts, 1908 to 1924.
