ACHT AN ARD-REACHTAIRE CUNTAS AGUS CISTE (LEASÚ), 1944.

An Príomh-Acht.

1.—San Acht so, ciallaíonn an abairt “an Príomh-Acht” Acht an Árd-Scrúdóra, 1923 (Uimh. 1 de 1923).

Na hAchta Aoisliúntas do bhaint leis an Árd-Reachtaire Cuntas agus Ciste.

2.—(1) I gcás duine ag fónamh i bhfeadhmannas bunaithe sa Stát-Sheirbhís do cheapadh ina Árd-Reachtaire Cuntas agus Ciste, beidh an duine sin, má ghlacann de roghain é, i dteideal go gcuirfí i mbaint leis forála na nAcht Aoisliúntas, 1834 go 1942, mar bhí na hAchta san ionchurtha i mbaint leis agus é ag fónamh amhlaidh sa Stát-Sheirbhís, in ionad forál fó-ailt (2) d'alt 2 den Phríomh-Acht, agus is tuigthe chun críoch a mbainte leis amhlaidh a sheirbhís mar Árd-Reachtaire Cuntas agus Ciste do bheith ina seirbhís i bhfeadhmannas bunaithe sa Stát-Sheirbhís agus í bheith ionáirithe i dteanta a sheirbhíse iarbhír i bhfeadhmannas bunaithe sa Stát-Sheirbhís.

(2) Is ar an bPríomh-Chiste nó ar a thoradh fáis a bheas muirear agus íoc aon phinsin is iníoctha de bhun fó-ailt (2) d'alt 2 den Phríomh-Acht nó aon mholta fá na hAchta Aoisliúntas, 1834 go 1942, a deonfar de bhuaidh fó-ailt (1) den alt so.

(3) Na tagairtí atá san alt so do na hAchta Aoisliúntas, 1834 go 1942, léireofar iad mar thagairtí do na hAchta san arna leasú ag aon achtachán iaraimseartha.

4.—(1) Féadfar Acht an Árd-Reachtaire Cuntas agus Ciste (Leasú), 1944, do ghairm den Acht so.

(2) Is tuigthe an tAcht so do theacht i ngníomh an lú lá d'Abrán, 1944, agus beidh éifeacht aige amhail ar an lá san agus ón lá san amach.

COMPTROLLER AND AUDITOR GENERAL (AMENDMENT) ACT, 1944.

The Principal Act.

1.—In this Act, the expression “the Principal Act” means the Comptroller and Auditor-General Act, 1923 (No. 1 of 1923).

Application of the Superannuation Acts to the Comptroller and Auditor General.

2.—(1) Where a person who is serving in an established capacity in the Civil Service is appointed Comptroller and Auditor General, he shall, if he so elects, be entitled to have applied to him the provisions of the Superannuation Acts, 1834 to 1942, as those Acts were applicable to him while so serving in the Civil Service, in lieu of the provisions of sub-section (2) of section 2 of the Principal Act and his service as Comptroller and Auditor General shall, for the purposes of such application, be deemed to be service in an established capacity in the Civil Service and to be reckonable with his actual service in an established capacity in the Civil Service.

(2) Any pension payable in pursuance of sub-section (2) of section 2 of the Principal Act or any award under the Superannuation Acts, 1834 to 1942, granted by virtue of sub-section (1) of this section shall be charged on and payable out of the Central Fund or the growing produce thereof.

(3) References in this section to the Superannuation Acts, 1834 to 1942, shall be construed as references to those Acts as amended by any subsequent enactment.

Repeal.

3.—Sub-section (4) of section 2 of the Principal Act is hereby repealed.

Short title and commencement.

4.—(1) This Act may be cited as the Comptroller and Auditor General (Amendment) Act, 1944.

(2) This Act shall be deemed to have come into operation on, and shall have effect as on and from, the 1st day of April, 1944.
