LOCAL LOANS FUND (AMENDMENT) ACT, 1987

Waiver of sums advanced under Local Loans Fund Act, 1935.

1.—Where any sum is, or, before the passing of this Act, has been, advanced on foot of a local loan under section 4 of the Local Loans Fund Act, 1935, the Minister for Finance may, if it seems to him desirable so to do, direct that repayment of the whole, or such part as the Minister may specify, of—

(a) such sum, or

(b) the balance at the time of the direction remaining unpaid,

be waived together with the whole, or such part as may be so specified, of the interest on such sum then unpaid.

Statement by Minister for Finance.

2.—(1) The Minister for Finance shall, from time to time, lay before each House of the Oireachtas a statement in accordance with subsection (2) of this section.

(2) Every statement of the Minister pursuant to this section shall specify, in relation to each category of local loan under section 4 of the Local Loans Fund Act, 1935, the repayment of loans in which category has, pursuant to section 1 of this Act, been waived in whole or in part, the following matters:—

(a) the total number of such loans;

(b) the total amount advanced in respect of such loans;

(c) the total amount of principal, the repayment of which is being waived pursuant to the said section 1; and

(d) the total amount of interest, the repayment of which is being waived pursuant to the said section 1.

Repeals.

3.—Section 14 of the Local Loans Fund Act, 1935, and section 10 (6) of the Housing (Miscellaneous Provisions) Act, 1979, are hereby repealed.

Short title and collective citation.

4.—(1) This Act may be cited as the Local Loans Fund (Amendment) Act, 1987.

(2) The Local Loans Fund Acts, 1935 to 1986, and this Act may be cited together as the Local Loans Fund Acts, 1935 to 1987.

Suimeanna a airleacadh faoi Acht Ciste na nIasachtaí Áitiúla, 1935, a tharscaoileadh.

1.—Más rud é go ndéanfar, nó go ndearnadh roimh an Acht seo a rith, aon suim a airleacan de dhroim iasachta áitiúla faoi alt 4 d'Acht Ciste na nIasachtaí Áitiúla, 1935, féadfaidh an tAire Airgeadais, má fheictear dó gurb inmhianaithe déanamh amhlaidh, a ordú go ndéanfar aisíoc—

(a) iomlán na suime sin, nó

(b) iomlán na hiarmhéide a bheidh gan íoc tráth an ordaithe,

nó go ndéanfar aisíoc cibé cuid den tsuim sin nó den iarmhéid sin a shonróidh an tAire, a tharscaoileadh mar aon le hiomlán an úis, nó cibé cuid den ús a bheidh arna sonrú amhlaidh, ar an tsuim sin a bheidh gan íoc an tráth sin.

Ráiteas ag an Aire Airgeadais.

2.—(1) Déanfaidh an tAire Airgeadais, ó am go ham, ráiteas de réir fho-alt (2) den alt seo a leagan faoi bhráid gach Tí den Oireachtas.

(2) Déanfar i ngach ráiteas ón Aire de bhun an ailt seo, i ndáil le gach earnáil iasachta áitiúla faoi alt 4 d'Acht Ciste na nIasachtaí Áitiúla, 1935, is earnáil a bhfuil aisíoc iasachtaí inti tarscaoilte go hiomlán nó go páirteach de bhun alt 1 den Acht seo, na nithe seo a leanas a shonrú:

(a) líon iomlán na n-iasachtaí sin;

(b) an méid iomlán a airleacadh i leith na n-iasachtaí sin;

(c) méid iomlán na príomhshuime, a bhfuil a aisíoc á tharscaoileadh de bhun an ailt sin 1; agus

(d) méid iomlán an úis, a bhfuil a aisíoc á tharscaoileadh de bhun an ailt sin 1.

3.—Aisghairtear leis seo alt 14 d'Acht Ciste na nIasachtaí Áitiúla, 1935, agus alt 10 (6) d'Acht na dTithe (Forálacha Ilghnéitheacha), 1979.

Gearrtheideal agus comhlua.

4.—(1) Féadfar Acht Chiste na nIasachtaí Áitiúla (Leasú), 1987, a ghairm den Acht seo.

(2) Féadfar Achtanna Chiste na nIasachtaí Áitiúla, 1935 go 1987, a ghairm d'Achtanna Chiste na nIasachtaí Áitiúla, 1935 go 1986, agus den Acht seo le chéile.
