HOSPITALS FEDERATION AND AMALGAMATION ACT, 1961.
Interpretation.
1.—(1) In this Act—
“the Act of 1729” means the pre-Union Irish Statute passed in the year 1729 entitled “Act for furnishing and regulating the Hospital founded by Richard Stephens, Esquire, Doctor of Physic” (3Geo. II, c. 23);
“the Act of 1750” means the pre-Union Irish Statute passed in the year 1750 and entitled “An Act for regulating the Hospital founded by Mary Mercer, Spinster” (23 Geo. II, c. 18);
“the Act of 1800” means the pre-Union Irish Statute passed in the year 1800 and entitled “An Act for repealing an Act passed in the twenty-fifth Year of his present Majesty, entitled An Act for establishing a complete School of Physic in this Kingdom; and also for repealing an Act passed in the thirty-first Year of his present Majesty, entitled an Act to explain and amend an Act for establishing a complete School of Physic in this Kingdom and also for extending and enlarging the Powers of the President and Fellows of the King and Queen's College of Physicians, and establishing a complete School of Physic in this Kingdom” (40 Geo. III, c. 84);
“the Board of Management of the Adelaide Hospital” means the Board in whom the management of the Adelaide Hospital is vested under the Charter dated the 15th day of February, 1921, by which that Hospital was constituted;
“the Board of Governors of the National Children's Hospital” means the Board established by the Articles of Association of the National Children's Hospital in whom the management of the business of that Hospital is vested;
“the Board of Directors of the Royal City of Dublin Hospital” means the Board established by the Deed of Co-Partnership of 1875 in whom the general management, care and superintendence of the Royal City of Dublin Hospital is vested;
“the Council” has the meaning specified in subsection (1) of section 5;
“the Deed of Co-Partnership of 1875” means the Indenture made on the 12th day of January, 1875, between Henry Gray Croly, John Hawtrey Benson, Loftie Stoney, William Ireland Wheeler, Arthur Edward J. Barket, John Magee Finny, and Henry Fitzgibbon of the First part, Alfred Hancock Middleton of the second part, and Joseph Boyce, Joseph W. Casson, Jonathan Hogg, Edward Hudson Kinahan, Francis Low, Joseph Manning, Archibald McComas, Thomas Pim, junior, John Robinson, John J. Robertson, Robert Stanley, Alfred Clayton Thistleton, John E. Vernon, and William Watson of the third part, and the said Edward Hudson Kinahan, Jonathan Hogg and Thomas Pim, junior, of the fourth part;
“the establishment day” means the day appointed to be the establishment day for the purposes of this Act by order of the Minister under section 2;
“functions” includes powers and duties;
“the governing body” means—
(a) in relation to the Adelaide Hospital—the Board of management of the Adelaide Hospital,
(b) in relation to the Meath Hospital—the joint committee of that Hospital,
(c) in relation to Mercer's Hospital—the members of the body corporate established by the Act of 1750,
(d) in relation to the National Children's Hospital—the Board of Governors of the National Children's Hospital,
(e) in relation to the Royal City of Dublin Hospital—the Board of Directors of the Royal City of Dublin Hospital,
(f) in relation to Sir Patrick Dun's Hospital—the Governors of Sir Patrick Dun's Hospital,
(g) in relation to Dr. Steevens' Hospital—the members of the body corporate established by the Act of 1729;
“the Governors of Sir Patrick Dun's Hospital” means the board in whom the government of Sir Patrick Dun's Hospital is vested by section 4 of the Act of 1800;
“hospital board” has the meaning specified in section 6;
“the Minister” means the Minister for Health;
“the Meath Hospital” means the Meath Hospital or County of Dublin Infirmary;
“participating hospitals” means the hospitals specified in the First Schedule;
“prescribed” means prescribed by the Council by regulations;
“transfer day” means the day appointed to be the transfer day for the purposes of this Act by order of the Minister under subsection (1) of section 3;
“visiting medical staff”, in relation to a hospital or hospitals, includes all physicians, surgeons and other visiting medical practitioners (other than house officers, casualty officers and registrars) who attend the hospital or hospitals, either in the wards or in specialists' or out-patient departments.
(2) A reference in this Act to performance of functions includes, with respect to powers, a reference to exercise of powers.
(3) A reference in this Act to any other enactment shall, except so far as the context otherwise requires, be construed as a reference to that enactment as amended by or under any other enactment, including this Act.
Establishment day.
2.—The Minister may by order appoint a day to be the establishment day for the purposes of this Act.
Transfer day.
3.—(1) The Minister may, at the request of the Council, by order appoint a day to be the transfer day for the purposes of this Act.
(2) (a) A request under subsection (1) of this section shall not be made save with the consent of two-thirds of such of the following hospital boards as exist when the request is made, that is to say:
(i) the hospital board of the Adelaide Hospital,
(ii) the hospital board of the Meath Hospital,
(iii) the hospital board of Mercer's Hospital,
(iv) the hospital board of the National Children's Hospital,
(v) the hospital board of the Royal City of Dublin Hospital,
(vi) the hospital board of Sir Patrick Dun's Hospital,
(vii) the hospital board of Dr. Steevens' Hospital.
(b) Where the calculation of two-thirds pursuant to paragraph (a) of this subsection gives a whole number and a fractional remainder, the next higher whole number shall be taken as the result of the calculation.
(c) Where two or more hospital boards are amalgamated under section 16 of this Act, paragraph (a) of this subsection shall have effect as if the subparagraphs in that paragraph referring to those boards were deleted and, for the first of those subparagraphs, there were substituted a subparagraph referring to the board into which those boards are amalgamated.
(3) Where a hospital board has not given its consent to a request made under subsection (1) of this section—
(a) the Minister shall inform the board of the request having been made and shall not make an order under subsection (1) of this section before the expiration of one month after the board have been so informed,
(b) the board may, within the said month, resolve that the hospital of the board shall cease to be a member of the Federated Dublin Voluntary Hospitals,
(c) if the board resolve as aforesaid, the Minister shall by order effect the cesser of the membership of the hospital of the Federated Dublin Voluntary Hospitals and shall not, until after the commencement of such order, make an order under subsection (1) of this section,
(d) an order made under the foregoing paragraph may—
(i) contain all such provisions as appear to the Minister to be necessary or expedient for the purpose of effecting the cesser, including provisions modifying any of the provisions of this Act,
(ii) provide for the cesser of any amendments which have been made by or under this Act in any Act or instrument specified in the Third Schedule to this Act relating to the hospital,
(iii) provide for any modifications in any such Act or instrument which the board may have proposed to the Minister.
(4) Where the hospital of a hospital board which will be dissolved on the transfer day is of a particular denominational character, the Council shall, before the transfer day, enter into such agreement with the board as will preserve the rights conferred in the case of the hospital by subsection (3) of section 14 of this Act, and the agreement shall be binding on the Council after the transfer day.
Federated Dublin Voluntary Hospitals.
4.—(1) There shall, by virtue of this section, be established on the establishment day a hospital group which shall be known as the Federated Dublin Voluntary Hospitals and the members of which shall be the participating hospitals.
(2) The Minister may, by order made on the request of the Council, change the name of the said hospital group.
Central Council of Federated Dublin Voluntary Hospitals.
5.—(1) There shall, by virtue of this section, be established on the establishment day a body which shall be known as the Central Council of the Federated Dublin Voluntary Hospitals (in this Act referred to as the Council) and which shall be charged with the performance of the functions assigned to it by the subsequent provisions of this Act.
(2) The Council shall be a body corporate with perpetual succession and power to sue and be sued in its corporate name and to acquire, hold and dispose of land.
(3) The Council may build, equip, maintain and administer hospitals.
(4) The Council shall provide and have an official seal.
(5) The seal of the Council shall be authenticated by the signature of the chairman or vice-chairman of the Council and the signature of an officer of the Council duly authorised by the Council to act in that behalf.
(6) Judicial notice shall be taken of the seal of the Council, and every document purporting to be an instrument made by the Council and to be sealed with the seal (purporting to be authenticated in accordance with this section) of the Council shall be received in evidence and be deemed to be such instrument without further proof unless the contrary is shown.
(7) The Minister may, by order made on the request of the Council, change the corporate name of the Council.
Hospital boards.
6.—(1) On the establishment day, there shall, by virtue of this section, be established for each participating hospital a board (in this Act referred to as a hospital board) the members of which shall be the persons who, immediately before the establishment day, constituted the governing body of the hospital.
(2) Subject to this Act and any orders made thereunder—
(a) a hospital board shall stand substituted for all purposes for the governing body of its hospital and that body shall be regarded as merged in the board,
(b) the hospital board shall accordingly meet, act and perform functions as if it were that body and for that purpose shall be subject, as if it were that body, to the provisions which, immediately before the establishment day, applied to that body with respect to meeting, acting and performing functions.
Membership of the Council.
7.—(1) (a) The number of members of the Council shall, subject to the next paragraph, be forty.
(b) Whenever—
(i) the Council and a university, college or other institution enter into an agreement for the clinical education of medical students, and
(ii) the agreement provides for the appointment by the university, college or other institution of two members of the Council,
there shall be an additional two members of the Council to be appointed by the university, college or other institution.
(2) Before the establishment day—
(a) each of the governing bodies of the participating hospitals shall appoint five persons (two, but not more than two, of whom shall be members of the visiting medical staff of the hospital concerned) to be members of the Council.
(b) the Dublin Health Authority shall appoint five persons to be members of the Council.
(3) Before the 1st day of December in each appointment year for members of the Council appointed by hospital boards, each hospital board shall appoint five persons (two, but not more than two, of whom shall be members of the visiting medical staff of the hospital concerned or of the visiting medical staff of all the participating hospitals) to be members of the Council.
(4) In each appointment year for members of the Council appointed by the Dublin Health Authority, that authority shall, at their first meeting after the quinquennial appointment of their members in that year, appoint five persons to be members of the Council.
(5) Where an agreement under paragraph (b) of subsection (1) of this section is entered into—
(a) the university, college or other institution shall forthwith appoint two persons to be members of the Council,
(b) before the 1st day of December in each appointment year for members of the Council appointed consequent upon an agreement under paragraph (b) of subsection (1) of this section, the university, college or other institution shall appoint two persons to be members of the Council.
(6) The term of office of a member of the Council shall commence—
(a) in the case of a member appointed before the establishment day—on that day,
(b) in the case of a member appointed by a hospital board—on the 1st day of December in the year in which he is appointed or, where he is a member filling a casual vacancy, the day on which he is appointed,
(c) in the case of a member appointed by the Dublin Health Authority on or after the establishment day—on the day after the day on which he is appointed,
(d) in the case of a member appointed consequent upon an agreement under paragraph (b) of subsection (1) of this section—
(i) where he is appointed pursuant to paragraph (b) of subsection (5) of this section—on the 1st day of December in the year in which he is appointed, and
(ii) where he is not so appointed—on the day on which he is appointed.
(7) The term of office of a member of the Council shall, unless he sooner dies, resigns or ceases to be a member under subsection (8) of this section, terminate—
(a) in the case of a member appointed, during an appointment year for members appointed by hospital boards and before the 1st day of December in that year, by a hospital board to fill a casual vacancy—on the 30th day of November in that year,
(b) in the case of a member appointed by the governing body of a participating hospital or a member, other than a member referred to in the foregoing paragraph, appointed by a hospital board—on the 30th day of November in such appointment year for members of the Council appointed by hospital boards as next follows the commencement of his term of office,
(c) in the case of a member appointed by the Dublin Health Authority—on the day of such first meeting of that Authority after a quinquennial appointment of the members of that Authority as next follows the commencement of his term of office,
(d) in the case of a member appointed consequent upon an agreement under paragraph (b) of subsection (1) of this section—
(i) where the appointment is made in an appointment year for members of the Council appointed consequent upon an agreement under paragraph (b) of subsection (1) of this section and before the 1st day of December in that year and is an appointment pursuant to paragraph (a) of subsection (5) of this section or an appointment to fill a casual vacancy—on the 30th day of November in that year, and
(ii) where the appointment is not so made—on the 30th day of November in such appointment year for members of the Council appointed consequent upon an agreement under paragraph (b) of subsection (1) of this section as next follows the commencement of his term of office.
(8) Any member of the Council who is absent from meetings of the Council for a continuous period of six months and who, on being requested by the Council to furnish an explanation of such absence, fails to furnish an explanation which is satisfactory to the Council shall cease to be a member thereof on a date to be determined by the Council.
(9) A member of the Council may at any time resign his office by letter sent to the Council and every such resignation shall, unless previously withdrawn, take effect as from the commencement of the meeting of the Council held next after the receipt of the letter.
(10) Where a casual vacancy in the membership of the Council occurs, it shall be filled—
(a) in case the member by whom the vacancy was occasioned was appointed by the governing body of a participating hospital—by appointment by the hospital board of that hospital,
(b) in case such member was appointed by a hospital board—by appointment by that board,
(c) in case such member was appointed by a university, college or other institution consequent upon an agreement under paragraph (b) of subsection (1) of this section—by that university, college or other institution,
(d) in case such member was appointed by the Dublin Health Authority—by appointment by that Authority.
(11) For the purposes of this section—
(a) the appointment years for members of the Council appointed by hospital boards shall be the third year after the year in which the establishment day falls and each third successive year thereafter (not being the year in which the transfer day occurs or any subsequent year), and
(b) the appointment years for members of the Council appointed by the Dublin Health Authority shall be the years after the establishment day in which there are quinquennial appointments of the members of that Authority, and
(c) the appointment years for members of the Council appointed consequent upon an agreement under paragraph (b) of subsection (1) of this section shall be the third year after the year in which the establishment day falls and each third successive year thereafter.
(12) The Minister, at any time before the transfer day, may, at the request of the Council and with the consent of the boards of all the participating hospitals, by order vary the composition of the Council and any such order may modify the foregoing subsections of this section.
Membership of hospital boards.
8.—(1) Every person who, on the establishment day, becomes a member of a hospital board (other than the board of the Meath Hospital) shall continue to be a member of that board until he dies, resigns or ceases under subsection (2) or subsection (3) of this section to be a member thereof.
(2) Any member of a hospital board who is absent from meetings of the board for a continuous period of six months and who, on being requested by the board to furnish an explanation of such absence, fails to furnish an explanation which is satisfactory to the board shall cease to be a member thereof on a date to be determined by the board.
(3) Any member of a hospital board who
(a) became a member of the board by virtue of his having been, immediately before the establishment day, a member, appointed on the recommendation of a local authority, of the governing body of the hospital, or
(b) was co-opted as a member of the board on the recommendation of the Dublin Health Authority,
shall cease to be a member of the board on the day of such first meeting of the Dublin Health Authority after a quinquennial appointment of the members of that Authority as next follows the commencement of his term of office.
(4) Where a vacancy occurs in the membership of a hospital board (other than the board of the Meath Hospital), the vacancy shall be filled by co-option by the board.
(5) Where a vacancy in the membership of a hospital board falling to filled under subsection (4) of this section is caused by—
(a) a person ceasing under subsection (3) of this section to be a member of the board, or
(b) the death, resignation or cesser of membership under subsection (2) of this section of a person who, if he had not died, resigned or so ceased to be a member of the board, would have ceased under subsection (3) of this section to be a member of the board,
the hospital board, in filling the vacancy, shall have regard to any recommendation made by the Dublin Health Authority as to the person to be co-opted.
(6) The membership of the hospital board of the Meath Hospital shall be governed by the provisions of sections 4, 4A, 5, 6, 7, 8, 10 and 11 of the Meath Hospital Act, 1951, as amended by subsection (12) of section 24 of the Health Authorities Act, 1960, in like manner as if the board were the joint committee of the Meath Hospital, and, for that purpose, a member of the board ceasing under subsection (2) of this section to be a member of the board shall be deemed to have resigned.
(7) (a) The Minister may, if he so thinks proper but subject to the next paragraph, by order modify the composition of a hospital board (other than the board of the Meath Hospital).
(b) An order under this subsection shall not be made save on and in accordance with the request of the hospital board concerned.
Meetings of the Council.
9.—(1) The Council shall hold its first meeting on the establishment day at such time and in such place as the Minister may appoint.
(2) The Council shall in every year commencing after the establishment day hold a meeting (in this Act referred to as an annual meeting) on such day as the Council may appoint.
(3) Subject to the provisions of this section, the Council shall hold such and so many meetings as may be necessary for the performance of its functions.
Chairman and vice-chairman of the Council.
10.—(1) The Council shall—
(a) at its first meeting, and
(b) at its first meeting after the 1st day of December in—
(i) the third year after the year in which the establishment day falls, and
(ii) each successive third year thereafter,
elect one of its members to be chairman of the Council and another of its members to be vice-chairman of the Council.
(2) Every person elected to be chairman or vice-chairman of the Council shall, unless he sooner dies, resigns or is disqualified, hold office as chairman or vice-chairman until his successor is elected.
(3) Where the office of chairman or vice-chairman becomes vacant through the death, resignation or disqualification of the chairman or vice-chairman, the Council shall at the next meeting after the vacancy has taken place elect one of its members to be chairman or vice-chairman.
(4) The chairman or vice-chairman of the Council may at any time resign his office as chairman or vice-chairman by letter sent to the Council, and every such resignation shall, unless previously withdrawn, take effect at the commencement of the meeting of the Council held next after the receipt of the letter.
(5) Where the chairman or the vice-chairman of the Council ceases during his term of office as chairman or vice-chairman to be a member of the Council, he shall be disqualified for being and shall forthwith cease to be chairman or vice-chairman.
(6) Where at the election of chairman of the Council, there is an equality of votes for two or more persons, one of those persons shall be elected by lot.
Procedure at meetings of the Council.
11.—(1) The quorum for a meeting of the Council shall be one-third of the number of the members of the Council or, where that number is not divisible by three without a remainder, one-third of the next higher number so divisible.
(2) At a meeting of the Council—
(a) the chairman of the Council shall, if he is present, be chairman of the meeting;
(b) if and so long as the chairman of the Council is not present or if the office of chairman is vacant, the vice-chairman of the Council shall, if and so long as he is present, be chairman of the meeting;
(c) if and so long as the chairman of the Council is not present or if the office of chairman is vacant and the vice-chairman is not present or the office of vice-chairman is vacant, the members of the Council who are present shall choose one of their number to be chairman of the meeting.
(3) Every question at a meeting of the Council shall be determined by a majority of the votes of the members present and voting on the question and, in case of an equal division of votes, the chairman of the meeting shall have a second or casting vote save where the question is the election of the chairman of the Council.
(4) The Council may act notwithstanding one or more vacancies amongst its members.
(5) Where—
(a) any body purports to appoint a person a member of the Council, and
(b) such person acts as such member, and
(c) there was any informality in the purported appointment of such person,
then, the acts and proceedings of such person shall, for the purposes of the proceedings of the Council but not further or otherwise, be as valid and effectual as if there had been no such informality.
(6) Subject to the provisions of this Act, the Council may, by standing orders or otherwise, regulate the procedure and business of the Council.
Committees of the Council.
12.—(1) The Council may from time to time appoint such and so many committees as it may think fit for purposes connected with the exercise of any of the functions of the Council which in the opinion of the Council would be better or more conveniently regulated or managed by or through a committee.
(2) Every committee appointed under this section shall consist of such number of members as the Council may direct and may be composed either wholly of members of the Council or partly of such members and partly of other persons.
(3) Where a committee appointed under this section is composed partly of members of the Council and partly of other persons, the number of such other persons shall not exceed one-fourth of the total membership of such committee.
(4) The quorum and procedure of any committee appointed under this section shall be such as may be determined by the Council.
(5) The Council may delegate any of its functions to a committee appointed under this section.
(6) The acts of every committee appointed under this section shall be subject to confirmation by the Council, save that the Council may empower any particular such committee to do any act within the authority conferred on the committee by the Council which the Council itself could lawfully do.
Staff of the Council.
13.—(1) The Council may employ such staff as is necessary for the performance of its functions.
(2) The numbers, grades, remuneration, tenure of office and conditions of service of the members of the staff of the Council shall be determined from time to time by the Council.
Functions assigned to the Council.
14.—(1) The following functions in relation to the participating hospitals (in this Act referred to as functions assigned to the Council) shall be performed by the Council:
(a) during the period of four years beginning on the establishment day, the examination of annual estimates and supplementary estimates of expenditure on the running of hospitals, and suggesting of amendments to such estimates,
(b) after the expiration of the said period, the approval of estimates and supplementary estimates of expenditure on the running of hospitals and the approval of any amendments of such estimates,
(c) the submission of claims to the Hospitals Commission for payment on foot of deficits,
(d) the control of capital expenditure (that is to say, expenditure in respect of major structural undertakings, expenditure in respect of the provision and renewal of equipment for specialised units and all other expenditure of an exceptional or extraordinary nature) and of applications for funds for such expenditure,
(e) the determination of the form of accounts to be kept by hospitals,
(f) the appointment of visiting medical staff (all such appointments being to the Federated Dublin Voluntary Hospitals and not to an individual hospital),
(g) the assignment, subject to subsection (2) of this section, to individual hospitals of the visiting medical staff so appointed,
(h) the determination of the hospitals in which particular clinical units shall be located,
(i) the assignment of professorial units to particular hospitals,
(j) the apportionment of beds among the visiting medical staff,
(k) the co-ordination of activities in relation to medical education, the conduct of negotiations in regard to such education with the appropriate university, college or other institution (including the making of suitable agreements with such bodies to ensure efficient clinical instruction for medical students) and the provision of facilities for post graduate instruction,
(l) subject to subsection (3) of this section, the co-ordination of activities in relation to nursing education and the conduct of negotiations in regard to such education with An Bord Altranais,
(m) any other functions which may be assigned to the Council by resolution passed by the boards of all the hospitals.
(2) The Council shall not assign any visiting medical staff to a participating hospital of a particular denominational character unless the assignment is in accord with such character save with the approval of the hospital board concerned.
(3) In the exercise of its functions in relation to the co-ordination of the activities of the participating hospitals in the matter of nursing education and the conduct of negotiations in regard to such matters with An Bord Altranais, the Council shall take no action which would operate to—
(a) involve a student nurse in any arrangement for attending lectures on the ethics and psychology of nursing which do not conform to her religious beliefs, or
(b) interfere with the autonomy of a nursing school attached to any participating hospital of a particular denominational character.
(4) On and after the transfer day, the Council shall perform the functions which, immediately before the transfer day, were performable by hospital boards.
(5) Nothing in this section shall operate to terminate or affect in any way any rights which a person who, immediately before the establishment day, was a member of the visiting medical staff of a particular participating hospital then had as such member.
Functions of hospital board.
15.—(1) A hospital board shall not perform any of the functions assigned to the Council.
(2) After the expiration of the period of four years beginning on the establishment day, a hospital board shall not incur expenditure save within the limits of an estimate or an amended estimate approved of by the Council.
(3) Moneys collected by a hospital board by public appeal shall not be used by the board for capital purposes without the consent of the Council.
(4) Subject to the foregoing subsections of this section, a hospital board shall perform all the functions which, immediately before the establishment day, were performable by the governing body of the hospital of the board.
Amalgamation of hospital boards.
16.—(1) The Council may, with the consent of two or more hospital boards (given in accordance with such procedure as may be prescribed) and with the consent of the Minister, by order amalgamate the boards into one board and transfer their functions to that board.
(2) An order under this section may contain all such provisions as appear to the Council to be necessary or expedient for the purpose of enabling the amalgamation and transfer to have effect, including provisions modifying any of the provisions of this Act, and it shall be obligatory for the order to modify section 7 of this Act so that the representation on the Council of the new amalgamated board shall be equal in numbers to the sum of the representation thereon prior to the amalgamation of the two or more boards which were the subject of the amalgamation.
Dissolution of hospital board.
17.—(1) The Council may, with the consent of a hospital board (given in accordance with such procedure as may be prescribed) and with the consent of the Minister, by order dissolve the board and transfer its functions to the Council.
(2) An order under this section may contain all such provisions as appear to the Council to be necessary or expedient for the purpose of enabling the dissolution and transfer to have effect, including provisions modifying any of the provisions of this Act, and it shall be obligatory for the order to modify section 7 of this Act so that the representation of the dissolved board on the Council shall cease.
Agreement for joint action.
18.—The Council and the body controlling a hospital which is not a participating hospital may make and carry out an agreement for joint action with respect to any matters on such terms as may be agreed upon between the Council and the body with the consent of the Minister.
Dissolutions on transfer day.
19.—(1) On the transfer day, the following provisions shall, by virtue of this subsection, have effect:
(a) the Adelaide Hospital, Dublin, and the hospital board for the Adelaide Hospital shall be dissolved and shall cease to exist,
(b) the Governors and Governesses of the Meath Hospital or County of Dublin Infirmary and the hospital board for the Meath Hospital shall be dissolved and shall cease to exist,
(c) the body corporate established by the Act of 1750 and the hospital board for Mercer's Hospital shall be dissolved and shall cease to exist,
(d) National Children's Hospital and the hospital board for the National Children's Hospital shall be dissolved and shall cease to exist,
(e) the organisation of Sir Patrick Dun's Hospital and the hospital board therefor shall be dissolved and shall cease to exist,
(f) the organisation of the Royal City of Dublin Hospital and the hospital board therefor shall be dissolved and shall cease to exist,
(g) the body corporate established by the Act of 1729 and the hospital board for Dr. Steevens' Hospital shall be dissolved and shall cease to exist.
(2) The provisions contained in the Second Schedule to this Act shall have effect in relation to the dissolutions under subsection (1) of this section and, for that purpose, in that Schedule—
(a) “hospital” shall be construed as referring to any participating hospital,
(b) “appropriate body” shall be construed as referring to any hospital board and as also referring to—
(i) in the case of the Adelaide Hospital—the Adelaide Hospital, Dublin,
(ii) in the case of the Meath Hospital—the Governors and Governesses of the Meath Hospital or County of Dublin Infirmary,
(iii) in the case of Mercer's Hospital—the Governors of Mercer's Hospital,
(iv) in the case of the National Children's Hospital—National Children's Hospital,
(v) in the case of Dr. Steevens' Hospital—the Governors of Dr. Steevens' Hospital.
(3) Section 12 of the Finance Act, 1895, shall not apply to the vesting of property in the Council by the Second Schedule to this Act.
(4) In any conveyance, deed, will or other instrument, whether made before, on or after the transfer day, any reference to a participating hospital shall, on or after that day, be construed as a reference to that hospital as amalgamated pursuant to this Act with the other participating hospitals and any reference to the governing body or the hospital board of any participating hospital shall, on and after that day, be construed as a reference to the Council.
Expenses of the Council prior to transfer day.
20.—(1) The expenses of the Council prior to the transfer day shall, to the extent that they are not met by other receipts, be met by contributions from the participating hospitals.
(2) For the purposes of subsection (1) of this section—
(a) as respects—
(i) the year in which the establishment day falls where that day is the 1st day of January in that year, and
(ii) a year after that in which the establishment day falls and before that in which the transfer day falls,
a hospital board shall pay to the Council such sum as bears to the expenses of the Council for the year the same proportion as the number of hospital beds available for patients in the hospital on the 1st day of January in the year bears to the total number of hospital beds available for patients in the participating hospitals on that 1st day of January,
(b) as respects the period beginning on the establishment day, where that day is not a 1st day of January, and ending on the 31st day of December in the year in which the establishment day falls—a hospital board shall pay to the Council such sum as bears to the expenses of the Council for the period the same proportion as the number of hospital beds available for patients in the hospital on the establishment day bears to the total number of hospital beds available for patients in the participating hospitals on that day,
(c) as respects the period beginning on the 1st day of January in the year in which the transfer day falls, where that day is not that 1st day of January, and ending on the transfer day—a hospital board shall pay to the Council such sum as bears to the expenses of the Council for the period the same proportion as the number of hospital beds available for patients in the hospital on that 1st day of January bears to the total number of hospital beds available for patients in the participating hospitals on that 1st day of January.
Membership of the Council after transfer day.
21.—Notwithstanding any other provision of this Act—
(a) a member of the Council on the transfer day who was appointed by the governing body of a participating hospital or a hospital board shall continue to be a member of the Council until his death, resignation or cesser of membership under subsection (8) of section 7 of this Act,
(b) where a casual vacancy in the membership of the Council occurs on or after the transfer day and the member by whose death, resignation or cesser of membership under subsection (8) of section 7 of this Act the vacancy was occasioned was appointed by the governing body of a participating hospital or a hospital board or by co-option under this paragraph—
(i) the vacancy shall be filled by co-option by the other members of the Council,
(ii) if such member was a member of the visiting medical staff of a participating hospital or of the visiting medical staff of the participating hospitals or of the visiting medical staff of any hospital administered by the Council, the person co-opted shall also be a member of one of those visiting medical staffs,
(iii) the person co-opted shall continue to be a member of the Council until death, resignation or cesser of membership under subsection (8) of section 7 of this Act.
Provisions relating to Acts and instruments specified in Third Schedule.
22.—(1) This Act and any orders made thereunder shall have effect notwithstanding anything contained in the Acts and instruments specified in the Third Schedule to this Act and the said Acts and instruments shall be construed accordingly.
(2) Without prejudice to subsection (1) of this section, the Minister may, on the request of the Council and if he so thinks proper, by order make any modifications of any of the provisions of the Acts and instruments specified in the Third Schedule to this Act which the Council consider are necessary or expedient for enabling this Act or any orders made thereunder to have effect, but an order under this subsection which alters the functions of a hospital board shall be made only with the consent of that board.
Alteration of composition of governing body of participating hospital.
23.—(1) At any time before the establishment day, the Minister may, if he so thinks proper but subject to the next subsection, by order modify the composition of the governing body of a participating hospital (other than the governing body of the Meath Hospital).
(2) An order under this section shall not be made save on and in accordance with the request of the governing body concerned.
Laying of orders before Houses of the Oireachtas.
24.—Every order made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order is passed by either House, within the next twenty-one days on which that House has sat after the order has been laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Confirmation of agreement between Trinity College, the Royal College of Physicians and Sir Patrick Dun's Hospital.
25.—The agreement made on the 15th day of May, 1961, a copy whereof is set out in the Fourth Schedule to this Act, is hereby confirmed and for that purpose it is hereby declared and enacted as follows:
(a) the said agreement shall have statutory effect and shall be binding on the several parties thereto as fully as if it had been enacted in this Act;
(b) each party to the said agreement shall, notwithstanding any limitations on the power of such party to enter into the said agreement, have and be deemed always to have had power to enter into the said agreement;
(c) it shall be the duty of each party to the said agreement and such party is hereby empowered to carry out the said agreement so far as the provisions thereof are to be performed by such party.
Liability for debts of Board of Directors of Royal City of Dublin Hospital and extent of liability of that Board.
26.—(1) From and after the passing of this Act, no member of the Board of Directors of the Royal City of Dublin Hospital, whether past or present, shall be adjudged personally liable for any debt or other liability incurred or to be incurred by or on behalf of and with the sanction of the said Board and for the benefit of or in respect of the running, upkeep, maintenance or administration of the Royal City of Dublin Hospital.
(2) The liability of the said Board for the debts or other liabilities mentioned in the foregoing subsection shall extend only to the general funds and other assets of the said Hospital in the hands or under the control of the said Board or of any trustee or trustees appointed by the said Board.
Short title.
27.—This Act may be cited as the Hospitals Federation and Amalgamation Act, 1961.

Provisions Consequetial on Dissolutions.
Transfer of property.
1. (1) All property, whether real or personal (including choses-in-action) which immediately before the transfer day was vested in or belonged to or was held in trust for any appropriate body of any hospital or was held in trust for any of the purposes of any hospital and all rights, powers, and privileges relating to or connected with any such property shall, on the transfer day and without any conveyance or assignment but subject where necessary to transfer in the books of any bank, corporation, or company, become and be vested in or become and be the property of or be held in trust for (as the case may require) the Council for all the estate, term or interest for which the same immediately before the transfer day was vested in or belonged to or was held in trust for such appropriate body or was held in trust for the purposes of such hospital.
(2) All property transferred by this paragraph which, immediately before the transfer day, was standing in the books of any bank or is registered in the books of any bank, corporation, or company shall, upon the request of the Council made on or at any time after the transfer day, be transferred in such books by such bank, corporation, or company into the name of the Council.
(3) On or as soon as may be after the transfer day all trust funds and the investments for the time being representing the same which immediately before the transfer day were held by the Commissioners of Charitable Donations and Bequests in Ireland in trust for any appropriate body of any hospital or for any of the purposes of any hospital shall be transferred to the Council.
(4) On and after the transfer day, every chose-in-action transferred by this paragraph to the Council may be sued upon, recovered, or enforced by the Council in its own name, and it shall not be necessary for the Council to give notice to the person bound by such chose-in-action of the transfer effected by this paragraph.
(5) Where any property transferred to the Council by this paragraph was immediately before the transfer day held upon trust for the endowment of a bed or a medical prize or medical fund or upon other special trusts, such property shall, on and after the transfer day, be held by the Council upon such trusts as may be declared by the Council of and concerning the same, and the trusts so to be declared shall be such as, in the opinion of the Council, correspond as far as the circumstances allow to the trusts which immediately before the transfer day affected such property.
Transfer of liabilities.
2. (1) Every debt and other liability (including unliquidated liabilities arising from torts or breaches of contract) which immediately before the transfer day was owing or unpaid or has been incurred and is undischarged by the appropriate body of any hospital shall, on the transfer day, become and be the debt or liability of the Council and shall be paid or discharged by and may be recovered from or enforced against the Council accordingly.
(2) In this paragraph “liability” includes any pension or allowance granted before the transfer day by any appropriate body of any hospital to a person who, having been employed as an officer, nurse or servant of such appropriate body, was not so employed immediately before the transfer day.
Preservation of continuing contracts.
3. Every bond, guarantee, or other security of a continuing nature made or given by any appropriate body of any hospital to any person, or by any person to such appropriate body, and in force immediately before the transfer day, and every contract or agreement in writing made between any appropriate body of any hospital and another person and not fully executed and completed before the transfer day, shall notwithstanding the dissolution of such appropriate body, continue in force on and after the transfer day, but shall be construed and have effect as if the name of the Council were substituted therein for the name of such appropriate body, and such security, contract or agreement shall be enforceable by or against the Council accordingly.
Continuance of pending legal proceedings.
4. In every action, suit, or proceeding which is pending on the transfer day in any court or tribunal and to which any appropriate body of any hospital is a party, the Council shall on the transfer day become and be a party in the place of such appropriate body and such proceeding shall be continued between the Council and the other parties thereto accordingly and no such proceeding shall abate or be discontinued or prejudicially affected by reason of the dissolution of such appropriate body.
Preservation of contracts of service.
5. Every contract of service expressed or implied which is in force immediately before the transfer day between any appropriate body of any hospital and any person being a salaried officer or employee of such appropriate body shall continue in force on and after the transfer day, but shall be construed and have effect as if the Council were substituted therein for such appropriate body, and every such contract shall be enforceable by or against the Council accordingly.
Provisions as regards salaried officers and salaried employees.
6. (1) The following provisions shall have effect in relation to any person who immediately before the transfer day is a salaried officer or salaried employee of any appropriate body of any hospital:
(a) such person shall not in the service of the Council receive less remuneration or be subject to less beneficial conditions of service than the remuneration to which he was entitled and the conditions of service to which he was subject in the service of such appropriate body immediately before the transfer day,
(b) the Council may rearrange the duties to be performed by such person,
(c) where the Council terminates the services of such person on the ground that no suitable position is available for him under the Council, the Council shall pay to him such compensation (either by way of annuity for life or for a limited period or by way of gratuity) as the Council, having regard to all the circumstances of the case (including the nature of the employment, the length of service, the rate of remuneration and the prospects of such person in the position which he occupied under such appropriate body immediately before the transfer day), consider fair and reasonable.
(2) (a) Where a person is aggrieved by the failure or refusal of the Council to pay compensation under subparagraph (1) of this paragraph, he may appeal to the designated person against the failure or refusal.
(b) Where a person is aggrieved by the amount of any compensation (whether annuity or gratuity) paid by the Council under subparagraph (1) of this paragraph, or by the amount of any part of any such compensation, he may appeal to the designated person against the amount.
(c) An appeal under this subparagraph shall, in the case of an appeal against the failure of the Council to pay compensation, be brought within six months after the termination of the appellant's services and shall, in any other case, be brought within six months after the giving of the decision appealed from.
(d) The designated person shall, in deciding an appeal under this subparagraph, have regard to the annual allowance or gratuity which, in circumstances analogous to those of the appellant, might be granted to an officer or servant (as may be appropriate) under the law relating to the superannuation of officers and servants of local authorities.
(e) The decision of the designated person on an appeal under this section shall be final and, where the appeal is allowed (whether wholly or partly), the Council shall pay compensation or increased compensation accordingly.
(f) In this subparagraph “the designated person” means the person designated by the Minister for the purposes of hearing and deciding appeals under this subparagraph.

AND WHEREAS the duty of the said King's Professors includes the reading and giving of Clinical Lectures upon the Patients in Sir Patrick Dun's Hospital at the times and subject to the conditions prescribed by the Statutes aforesaid AND WHEREAS the above-mentioned Statute 30 Vic. cap. 9 provided for the delivery by the Professor of Surgery in Trinity College, Dublin, and the University Anatomist of the Clinical Lectures required by the School of Physic Act to be delivered by the University Professors of Chemistry and of Botany and empowered the College of Physicians and the Provost (or in his absence the Vice-Provost) and Senior Fellows of Trinity College, Dublin, respectively to appoint a Physician or Surgeon to attend Sir Patrick's Dun's Hospital and deliver Clinical Lectures in the place of any of the King's Professors or University Professors or the University Anatomist neglecting to attend the said Hospital or to deliver Clinical Lectures AND WHEREAS a Bill has been introduced before the Oireachtas providing for the Federation and ultimate Amalgamation of Sir Patrick Dun's Hospital with certain other Hospitals AND WHEREAS the parties hereto having regard to such proposed Federation have mutually agreed that it would be expedient to sever the relations hitherto existing between the College of Physicians and Trinity College Dublin and Sir Patrick Dun's Hospital and that on such severance the provisions of these presents shall take effect AND WHEREAS these presents cannot take effect without the sanction of the Oireachtas and it is intended that these presents shall be provisional and conditional only pending the passing and enactment of the said Bill as an Act NOW THIS INDENTURE WITNESSETH AND IT IS HEREBY AGREED AND DECLARED AS FOLLOWS:—
1. In these presents the expression “the operative date” means the date upon which these presents shall be given Statutory effect.
2. Immediately after the operative date the College of Physicians shall proceed to sell and convert into money the trust funds and property representing Sir Patrick Dun's Estate and shall out of the moneys arising from such sale and conversion pay the Costs incurred in respect thereof and shall pay and apply the residue of the said proceeds of sale (hereinafter referred to as “the net proceeds of sale”) in manner hereinafter provided.
3. (a) There shall be set apart and retained by the College of Physicians a capital sum equal to 232/500ths of the net proceeds of sale.
(b) After such sum shall have been so set aside and retained by the College of Physicians the remaining 268/500ths of the net proceeds of sale shall be paid and transferred by the College of Physicians to the Governors of Sir Patrick Dun's Hospital to be held by them UPON TRUST to apply the same whether capital or income in their discretion for or towards the cost of Medical Surgical or Nursing education or instruction in connection with the said Hospital or of research in the arts of Medicine or Surgery and of Sciences connected therewith or of any specialised appliances or equipment for use in the said Hospital.
(c) Out of the said sum so retained by the College of Physicians a capital sum equal to 43/500ths of the net proceeds of sale shall be paid by the College of Physicians to Trinity College Dublin on the date upon which the first King's Professor holding office on the operative date vacates office and a like sum equal to 43/500ths of the net proceeds of sale shall be paid by the College of Physicians to Trinity College Dublin on the date upon which the second King's Professor holding office on the operative date vacates office.
(d) The balance of the capital sum retained by the College of Physicians remaining after payment thereout of the said sums to Trinity College Dublin shall remain the property of the College of Physicians.
4. The right and obligation of the College of Physicians to appoint King's Professors shall cease as from the operative date as from which date the right to appoint all future King's Professors shall be vested solely in Trinity College, Dublin.
5. Each of the King's Professors holding office on the operative date shall retain his office for the period for which he has been elected or until (under any of the terms and conditions under which he holds the same) such appointment shall in the meantime cease or determine.
6. The salaries of each of the King's Professors holding office on the operative date shall be paid by the College of Physicians during the remainder of their period of office and the salaries of all the King's Professors to be hereafter appointed or elected by Trinity College Dublin, under the provisions of Clause 4 hereof shall be fixed from time to time and paid by Trinity College Dublin who hereby undertake to apply to the payment of such salaries all income which may be received by them from time to time from the said Capital sums to be handed over to them as aforesaid pursuant to the provisions of Clause 3 (c) hereof.
7. As from the operative date the King's Professors, University Professors and University Anatomist shall not by virtue of their office as such be required or entitled either in person or by substitute to attend or deliver clinical lectures at Sir Patrick Dun's Hospital provided always that this clause shall not in any way affect or interfere with the right of any individual person who shall on the operative date be a member of the Hospital Staff by virtue of his being a King's Professor, University Professor, University Anatomist or a Physician or Surgeon duly appointed in the place of a King's Professor, University Professor or University Anatomist to continue to hold office as a member of the Hospital staff upon the terms and conditions existing on the operative date.
8. As from the operative date the right of the College of Physicians to appoint Physicians and the right of the Provost or Vice-Provost and Senior Fellows of Trinity College Dublin to appoint Surgeons to attend and deliver Clinical Lectures at Sir Patrick Dun's Hospital shall cease and determine.
9. As from the operative date the Visitors of the College of Physicians, the President, Vice-President and Censors of the same, and the Provost of Trinity College Dublin shall cease to be Governors of Sir Patrick Dun's Hospital ex officio.
10. During such period as shall intervene between the operative date and the date referred to in the said Bill as “the Establishment Day” the Board of Governors of Sir Patrick Dun's Hospital shall have power and the exclusive right to appoint Physicians and Surgeons for the purpose of filling up any vacancies occurring in the Hospital Staff.
11. From and after the operative date and until the date in the said Bill referred to as “the Establishment Day” all the powers to appoint Governors of Sir Patrick Dun's Hospital vested on the operative date in the Visitors, President, Vice-President and Censors of the College of Physicians and the Provost of Trinity College Dublin shall be vested in and exercisable by the Board of Governors of Sir Patrick Dun's Hospital.

ciallaíonn “Acht 1729” an Reacht Réamh-Aontachta Éireannach a ritheadh sa bhliain 1729 agus dar teideal “Act for furnishing and regulating the Hospital founded by Richard Stephens, Esquire, Doctor of Physic” (3 Geo. II, c. 23);
ciallaíonn “Acht 1750” an Reacht Réamh-Aontachta Éireannach a ritheadh sa bhliain 1750 agus dar teideal “An Act for regulating the Hospital founded by Mary Mercer, Spinster” (23 Geo. II, c. 18);

(3) Déanfar tagairt san Acht seo d'aon achtachán eile a fhorléiriú, ach amháin sa mhéid go n-éilíonn an comhthéasc a mhalairt, a fhorléiriú mar thagairt don achtachán sin arna leasú le haon achtachán eile nó faoi aon achtachán eile, lena n-áirítear an tAcht seo.
An lá bunaithe.
2.—Féadfaidh an tAire le hordú lá a cheapadh chun bheith in a lá bunaithe chun críocha an Achta seo.
An lá aistrithe.
3.—(1) Féadfaidh an tAire, ar iarratas ón gComhairle, lá a cheapadh, le hordú, chun bheith ina lá aistrithe chun críocha an Achta seo.
(2) (a) Ní dhéanfar iarratas faoi fho-alt (1) den alt seo ach amháin le toiliú dhá thrian de cibé acu de na boird ospidéal seo a leanas a bheidh ann nuair a bheidh an t-iarratas á dhéanamh, is é sin le rá:
(i) bord ospidéil Ospidéal Adelaide,
(ii) bord ospidéil Ospidéal na Mí,
(iii) bord ospidéil Ospidéal Mercer,
(iv) bord ospidéil Ospidéal Náisiúnta na Leanaí,
(v) bord ospidéil Ospidéal Ríoga Chathair Bhaile Atha Cliath,
(vi) bord ospidéil Ospidéal Sir Patrick Dun,
(vii) bord ospidéil Ospidéal Dr. Steevens.
(b) I gcás ina ndéanfar ríomh dhá thrian de bhun mhír (a) den fho-alt seo agus gur slán-uimhir agus iarmhéid codánach an toradh, measfar gurb í an slán-uimhir díreach os a chionn sin toradh an ríofa.
(c) I gcás ina ndéanfar dhá bhord ospidéil nó níos mó a chónascadh faoi alt 16 den Acht seo, beidh éifeacht ag mír (a) den fho-alt seo amhail is dá scriosfaí na fomhíreanna sa mhír sin a thagraíonn do na boird sin agus go gcuirfí, in ionad na céad fhomhíre acu sin, fomhír ag tagairt don bhord ina mbeidh na boird sin cónasctha.
(3) I gcás nach mbeidh bord ospidéil tar éis toiliú le hiarratas arna dhéanamh faoi fho-alt (1) den alt seo—
(a) cuirfidh an tAire in iúl don bhord go ndearnadh an t-iarratas agus ní dhéanfaidh sé ordú faoi fho-alt (1) den alt seo roimh dheireadh míosa tar éis sin a chur in iúl don bhord amhlaidh,
(b) Féadfaidh an bord, laistigh den mhí sin, a bheartú go scoirfidh ospidéal an bhoird de bheith ina chomhalta d'Ospidéil Shaorálacha Chónaidhmthe Bhaile Atha Cliath,
(c) má bheartaíonn an bord mar a dúradh, cuirfidh an tAire in éifeacht le hordú scor an ospidéil de bheith ina chomhalta d'Ospidéil Shaorálacha Chónaidhmthe Bhaile Atha Cliath agus ní dhéanfaidh sé, go dtí tar éis tosach feidhme an ordaithe sin, ordú faoi fho-alt (1) den alt seo,
(d) maidir le hordú faoin mír sin roimhe seo—
(i) féadfaidh na forálacha sin go léir a bheith ann is dóigh leis an Aire is gá nó is fóirsteanach chun an scor a chur in éifeacht, lena n-áirítear forálacha ag modhnú aon cheann d'fhorálacha an Achta seo,
(ii) féadfaidh foráil a bheith ann le haghaidh scor aon leasuithe arna ndéanamh leis an Acht seo nó faoi in aon Acht nó ionstraim a shonraítear sa Tríú Sceideal a ghabhann leis an Acht seo maidir leis an ospidéal,
(iii) féadfaidh foráil a bheith ann le haghaidh aon mhodhnuithe in aon Acht nó ionstraim den sórt sin a bheidh an Bord tar éis a mholadh don Aire.
(4) Más de ghné creidimh áirithe ospidéal boird ospidéil a dhíscaoilfear an lá aistrithe, déanfaidh an Chomhairle, roimh an lá aistrithe, comhaontú de shórt leis an mbord a chaomhnóidh na cearta a thugtar i gcás an ospidéil le fo-alt (3) d'alt 14 den Acht seo, agus beidh an comhaontú ina cheangal ar an gComhairle tar éis an lá aistrithe.
Ospidéil Shaorálacha Chonaidhmthe Bhaile Atha Cliath.
4.—(1) Déanfar, de bhua an ailt seo, ospidéal-ghrúpa a bhunú an lá bunaithe ar a dtabharfar Ospidéil Shaorálacha Chónaidhmthe Bhaile Atha Cliath agus is iad na hospidéil rannpháirteacha a bheidh ina gcomhaltaí de.
(2) Féadfaidh an tAire, le hordú a dhéanfar ar iarratas ón gComhairle, ainm an ospidéil-ghrúpa sin a athrú.
Príomh-Chomhairle Ospidéil Shaorálacha Chónaidhmthe Bhaile Atha Cliath.
5.—(1) Déanfar, de bhua an ailt seo, comhlacht a bhunú an lá bunaithe ar a dtabharfar Príomh-Chomhairle Ospidéil Shaorálacha Chónaidhmthe Bhaile Atha Cliath (dá ngairtear An Chomhairle san Acht seo) agus ar a mbeidh de chúram na feidhmeanna a chomhlíonadh a shanntar dó leis na forálacha ina dhiaidh seo den Acht seo.
(2) Beidh an Chomhairle ina comhlacht corpraithe le comharbas suthain agus beidh cumhacht aici agra a dhéanamh agus chun bheith inagartha faoina hainm chorpraithe, agus beidh cumhacht aici talamh a ghlacadh chuici, a theachtadh agus a dhiúscairt.
(3) Féadfaidh an Chomhairle ospidéil a thógáil, a threalamhú, a chothabháil agus a riaradh.
(4) Soláthróidh agus sealbhóidh an Chomhairle séala oifigiúil.
(5) Fíordheimhneofar séala na Comhairle le síniú chathaoirleach nó leas-chathaoirleach na Comhairle agus le síniú oifigigh don Chomhairle a mbeidh údarás cuí aige ón gComhairle gníomhú chuige sin.
(6) Tabharfar aird bhreithiúnach ar shéala na Comhairle, agus glacfar i bhfianaise gach doiciméad a airbheartóidh gur ionstraim é a rinne an Chomhairle agus a bheith séalaithe le séala (a airbheartóidh a bheith fíordheimhnithe de réir an ailt seo) na Comhairle agus measfar gurb é an ionstraim sin é gan a thuilleadh cruthúnais mura suítear a mhalairt.
(7) Féadfaidh an tAire, le hordú a dhéanfar ar iarratas ón gComhairle, ainm chorpraithe na Comhairle a athrú.
Boird ospidéal.
6.—(1) An lá bunaithe, bunófar de bhua an ailt seo do gach ospidéal rannpháirteach bord (dá ngairtear bord ospidéil san Acht seo) arb iad a chomhaltaí na daoine arbh iad comhlacht rialaithe an ospidéil iad díreach roimh an lá bunaithe.
(2) Faoi réir an Achta seo agus aon ordaithe faoi—
(a) seasfaidh bord ospidéil chun gach críche in ionad chomhlacht rialaithe a ospidéil agus measfar an comhlacht sin a bheith cumasctha leis an mbord,
(b) beidh cruinnithe ag an mbord ospidéil agus gníomhóidh sé agus comhlíonfaidh sé dá réir sin feidhmeanna amhail is dá mba é an comhlacht sin é agus, chuige sin, beidh sé, amhail is dá mba é an comhlacht sin é, faoi réir na bhforálacha a bhain, díreach roimh an lá bunaithe, leis an gcomhlacht sin maidir le cruinnithe, gníomhú agus feidhmeanna a chomhlíonadh.
Comhaltas na Comhairle.
7.—(1) (a) Faoi réir na chéad mhíre eile, daichead an líon comhaltaí a bheidh ar an gComhairle.
(b) Aon uair—
(i) a dhéanfaidh an Chomhairle agus ollscoil, coláiste nó foras eile comhaontú le haghaidh oideachas cliniciúil do mhic léinn leighis, agus
(ii) a fhorálfaidh an comhaontú go gceapfaidh an ollscoil, an coláiste nó an foras eile dhá chomhalta den Chomhairle,
beidh dhá chomhalta breise ar an gComhairle agus is í an ollscoil, nó is é an coláiste nó an foras eile a cheapfaidh iad.
(2) Roimh an lá bunaithe—
(a) déanfaidh gach ceann de chomhlachtaí rialaithe na n-ospidéal rannpháirteacha cúigear duine (ar comhaltaí d'fhoireann liachta fiosraithe an ospidéil lena mbainfaidh beirt, ach ní níos mó ná beirt, acu) a cheapadh ina gcomhaltaí den Chomhairle,
(b) ceapfaidh Údarás Sláinte Bhaile Atha Cliath cúigear duine ina gcomhaltaí den Chomhairle.
(3) Roimh an lú lá de Nollaig gach bliain is bliain cheapacháin le haghaidh comhaltaí den Chomhairle a cheapfaidh boird ospidéal, ceapfaidh gach bord ospidéil cúigear duine (ar comhaltaí d'fhoireann liachta fiosraithe an ospidéil lena mbainfadh nó d'fhoireann liachta fiosraithe na n-ospidéal rannpháirteacha go léir beirt, ach ní níos mó ná beirt, acu) ina gcomhaltaí den Chomhairle.
(4) Gach bliain is bliain cheapacháin le haghaidh comhaltaí den Chomhairle a cheapfaidh Údarás Sláinte Bhaile Atha Cliath, déanfaidh an t-údarás sin, ag a gcéad chruinniú tar éis ceapachán cúigbhlianach a gcomhaltaí an bhliain sin, cúigear duine a cheapadh ina gcomhaltaí den Chomhairle.
(5) I gcás ina ndéanfar comhaontú faoi mhír (b) d'fho-alt (1) den alt seo—
(a) déanfaidh an ollscoil, an coláiste nó an foras eile beirt duine a cheapadh láithreach ina gcomhaltaí den Chomhairle,
(b) roimh an lú lá de Nollaig gach bliain is bliain cheapacháin le haghaidh comhaltaí na Comhairle a cheapfar de dhroim comhaontú faoi mhír (b) d'fho-alt (1) den alt seo, déanfaidh an ollscoil, an coláiste nó an foras eile beirt duine a cheapadh ina gcomhaltaí den Chomhairle.
(6) Tosóidh téarma oifige chomhalta den Chomhairle—
(a) i gcás comhalta a cheapfar roimh an lá bunaithe—an lá sin,
(b) i gcás comhalta a cheapfaidh bord ospidéil—an lú lá de Nollaig an bhliain a cheapfar é nó, más comhalta é a líonann corrfholúntas, an lá a cheapfar é,
(c) i gcás comhalta a cheapfaidh Údarás Sláinte Bhaile Atha Cliath an lá bunaithe nó dá éis—an lá tar éis an lae a cheapfar é,
(d) i gcás comhalta a cheapfar de dhroim comhaontú faoi mhír (b) d'fho-alt (1) den alt seo—
(i) más de bhun mhír (b) d'fho-alt (5) den alt seo a cheapfar é—an lú lá de Nollaig an bhliain a cheapfar é, agus
(ii) mura mar sin a cheapfar é—an lá a cheapfar é.

(b) i gcás comhalta a cheapfaidh comhlacht rialaithe ospidéil rannpháirtigh nó comhalta, seachas comhalta dá dtagraítear sa mhír sin roimhe seo, a cheapfaidh bord ospidéil—an 30ú lá de Samhain an chéad bhliain cheapacháin eile le haghaidh comhaltaí den Chomhairle a cheapfar ag boird ospidéal i ndiaidh tosach a théarma oifige,
(c) i gcás comhalta a cheapfaidh Údarás Sláinte Bhaile Atha Cliath—lá an chéad chruinnithe eile den Údarás sin tar éis ceapachán chúigbhlianach chomhaltaí an Údaráis sin a thionólfar tar éis tosach a théarma oifige,
(d) i gcás comhalta a cheapfar de dhroim chomhaontú faoi mhír (b) d'fho-alt (1) den alt seo—
(i) i gcás an ceapachán a dhéanamh bliain is bliain cheapacháin le haghaidh comhaltaí den Chomhairle a cheaptar de dhroim chomhaontú faoi mhír (b) d'fho-alt (1) den alt seo agus roimh an lú lá de Nollaig an bhliain sin agus gur ceapachán é de bhun mhír (a) d'fho-alt (5) den alt seo nó ceapachán chun corrfholúntas a líonadh—an 30ú lá de Shamhain an bhliain sin, agus
(ii) i gcás nach mar sin a dhéantar an ceapachán —an 30ú lá de Shamhain an chéad bhliain cheapacháin eile le haghaidh comhaltaí den Chomhairle a cheaptar de dhroim chomhaontú faoi mhír (b) d'fho-alt (1) den alt seo tar éis tosach a théarma oifige.
(8) Aon chomhalta den Chomhairle a bheidh as láthair ó chruinnithe den Chomhairle ar feadh tréimhse leanúnaí sé mhí agus nach dtabharfaidh míniú sásúil don Chomhairle i dtaobh na hasláithreachta sin ar an gComhairle dá iarraidh sin air, scoirfidh sé de bheidh ina chomhalta den Chomhairle ar dháta a chinnfidh an Chomhairle.
(9) Féadfaidh comhalta den Chomhairle, tráth ar bith, éirí as a oifig trí litir chun na Comhairle agus beidh éifeacht ag gach éirí as den sórt sin amhail ó tosach an chéad chruinnithe den Chomhairle a thionólfar tar éis an litir a fháil, mura dtarraingeofar siar roimhe sin é.
(10) I gcás ina dtarlóidh corrfholúntas i gcomhaltas na Chomhairle, líonfar é—
(a) i gcás inar comhlacht rialaithe ospidéil rannpháirtigh a cheap an comhalta arbh é faoi deara an folúntas—trí cheapachán ag bord ospidéil an ospidéil sin,
(b) i gcás inar bord ospidéil a cheap an comhalta sin—trí cheapachán ag an mbord sin,
(c) i gcás inar ollscoil, coláiste nó foras eile a cheap an comhalta sin de dhroim chomhaontú faoi mhír (b) d'fho-alt (1) den alt seo—ag an ollscoil, an coláiste nó an foras eile sin,
(d) i gcás inarb é Údarás Sláinte Bhaile Atha Cliath a cheap an comhalta sin—trí cheapachán ag an Údarás sin.
(11) Chun críocha na ailt seo—
(a) is iad na blianta ceapacháin le haghaidh comhaltaí den Chomhairle a cheapfaidh boird ospidéal an tríú bliain tar éis na bliana ar lá di an lá bunaithe agus gach tríú bliain dá éis sin (nach bliain ar lá di an lá aistrithe ná aon bhliain dá éis sin), agus
(b) is iad na blianta ceapacháin le haghaidh comhaltaí den Chomhairle a cheapfaidh Údarás Sláinte Bhaile Atha Cliath na blianta tar éis an lae bhunaithe a dhéanfar ceapacháin chúigbhlianacha chomhaltaí an Údaráis sin, agus
(c) is iad na blianta ceapacháin do chomhaltaí den Chomhairle a cheapfar de dhroim chomhaontú faoi mhír (b) d'fho-alt (1) den alt seo an tríú bliain tar éis na bliana ar lá di an lá bunaithe agus gach tríú bliain chomhleanúnach ina dhiaidh sin.
(12) Féadfaidh an tAire, aon tráth roimh an lá aistrithe, ar iarratas ón gComhairle agus le toiliú bord na n-ospidéal rannpháirteacha uile, comhdhéanamh na Comhairle a athrú le hordú agus féadfaidh aon ordú den sórt sin na fo-ailt sin roimhe seo den alt seo a mhodhnú.
Comhaltas bord ospidéal.
8.—(1) Gach duine a thiocfaidh an lá bunaithe chun bheith ina chomhalta de bhord ospidéil (seachas bord Ospidéal na Mí) leanfaidh sé de bheith ina chomhalta den bhord sin go dtí go n-éagfaidh sé nó go dtí go n-éireoidh sé as nó go dtí go scoirfidh sé faoi fho-alt (2) nó fo-alt (3) den alt seo de bheith ina chomhalta den bhord sin.
(2) Aon chomhalta de bhord ospidéil a bheidh as láthair ó chruinnithe den bhord ar feadh tréimhse leanúnaí sé mhí agus nach dtabharfaidh míniú sásúil don bhord i dtaobh na hasláithreachta sin ar an mbord dá iarraidh sin air, scoirfidh sé de bheith ina chomhalta den bhord ar dháta a chinnfidh an bord.
(3) Aon chomhalta de bhord ospidéil
(a) a tháinig chun bheith ina chomhalta den bhord de bhun é a bheith, díreach roimh an lá bunaithe, ina chomhalta, a ceapadh ar mholadh údaráis áitiúil, de chomhlacht rialaithe an ospidéil, nó
(b) a comhthoghadh mar chomhalta den bhord ar mholadh Údarás Sláinte Bhaile Atha Cliath,
scoirfidh sé de bheith ina chomhalta den bhord lá an chéad chruinnithe eile d'Údarás Sláinte Bhaile Atha Cliath tar éis ceapachán cúigbhlianach a dhéanfar ar chomhaltaí an Údaráis sin a thionólfar tar éis tosach a théarma oifige,
(4) Má tharlaíonn folúntas i gcomhaltas bord ospidéil (seachas bord Ospidéal na Mí), líonfaidh an bord an folúntas trí chomhthoghadh.
(5) Más é is cúis le folúntas i gcomhaltas bord ospidéil a bheidh le líonadh faoi fho-alt (4) den alt seo—
(a) duine do scor faoi fho-alt (3) den alt seo de bheith ina chomhalta den bhord, nó
(b) duine d'éag nó d'éirí as nó do scor de bheith ina chomhalta faoi fho-alt (2) den alt seo agus is duine a mbeadh scortha aige faoi fho-alt (3) den alt seo de bheith ina chomhalta den bhord dá mba nár éag sé, nár éirigh sé as nó nár scoir sé amhlaidh de bheith ina chomhalta don bhord,
tabharfaidh an bord ospidéil aird, nuair a bheidh an folúntas á líonadh aige, ar aon mholadh ó Údarás Sláinte Bhaile Atha Cliath i dtaobh an duine a bheidh le comhthoghadh.
(6) Déanfaidh forálacha alt 4, 4A, 5, 6, 7, 8, 10 agus 11 d'Acht Ospidéal na Midhe, 1951, arna leasú le fo-alt (12) d'alt 24 den Acht um Údaráis Sláinte, 1960, rialú ar chomhaltas bhord Ospidéal na Mí díreach is dá mba é an bord comhchoiste Ospidéal na Mí, agus, chun na críche sin, measfar go mbeidh comhalta den bhord a scoirfidh faoi fho-alt (2) den alt seo de bheith ina chomhalta den bhord tar éis éirí as.
(7) (a) Féadfaidh an tAire, más cuí leis é ach faoi réir na chéad mhíre eile, comhdhéanamh bord ospidéil (seachas bord Ospidéal na Mí) a mhodhnú le hordú.
(b) Ní dhéanfar ordú faoin bhfo-alt seo ach amháin ar iarratas agus de réir iarratais ón mbord ospidéil lena mbainfidh.
Cruinnithe na Comhairle.
9.—(1) Beidh a céad chruinniú ag an gComhairle an lá bunaithe cibé am agus cibé áit a cheapfaidh an tAire.
(2) Gach bliain a thosóidh tar éis an lae bhunaithe, beidh cruinniú (dá ngairtear cruinniú bliantúil san Acht seo) ag an gComhairle cibé lá a cheapfaidh an Chomhairle.
(3) Faoi réir fhorálacha an ailt seo, beidh cibé cruinnithe agus cibé méid cruinnithe ag an gComhairle is gá chun a feidhmeanna a chomhlíonadh.
Cathaoirleach agus leas-chathaoirleach na Comhairle.
10.—(1) Déanfaidh an Chomhairle—
(a) ag a céad chruinniú, agus
(b) ag a céad chruinniú tar éis an 1ú lá de Nollaig—
(i) an tríú bliain tar éis na bliana ar lá di an lá bunaithe, agus
(ii) gach tríú bliain chomhleanúnach dá éis sin,
duine dá comhaltaí a thoghadh chun bheith ina chathaoirleach ar an gComhairle agus duine eile dá comhaltaí a thoghadh chun bheith ina leas-chathaoirleach ar an gComhairle.
(2) Gach duine a thoghfar chun bheith ina chathaoirleach nó ina leas-chathaoirleach ar an gComhairle beidh sé, murab éag nó éirí as nó teacht faoi dhícháilíocht dó roimhe sin, i seilbh oifige mar chathaoirleach nó leas-chathaoirleach go dtí go gceapfar a chomharba.
(3) Má tharlaíonn oifig an chathaoirligh nó an leaschathaoirligh a bheith folamh mar gheall ar an gcathaoirleach nó an leascathaoirleach d'éag, d'éirí as nó do theacht faoi dhícháilíocht, déanfaidh an Chomhairle, ag an gcéad chruinniú eile tar éis an folúntas tarlú, duine dá comhaltaí a thoghadh chun bheith ina chathaoirleach nó ina leas-chathaoirleach.
(4) Féadfaidh cathaoirleach nó leas-cathaoirleach na Comhairle tráth ar bith éirí as a oifig mar chathaoirleach nó leas-chathaoirleach trí litir chun na Comhairle, agus beidh éifeacht ag gach éirí as den sórt sin i dtosach an chéad chruinnithe eile den Chomhairle a thionólfar tar éis an litir a fháil mura dtarraingeofar siar roimhe sin é.
(5) Má scoireann cathaoirleach nó leas-chathaoirleach na Comhairle, le linn a théarma oifige mar chathaoirleach nó leaschathaoirleach, de bheith ina chomhalta den Chomhairle, beidh sé dícháilithe chun bheith, agus scoirfidh sé láithreach de bheith, ina chathaoirleach nó ina leas-chathaoirleach.
(6) Má tharlaíonn nuair a bheidh cathaoirleach na Comhairle á thoghadh go mbeidh comhionannas vótaí ann do bheirt daoine nó níos mó, toghfar duine acu sin trí crannchur.
Nós imeachta ag cruinnithe na Comhairle.
11.—(1) Is é is córam do chruinniú na Comhairle an tríú cuid de uimhir chomhaltaí na Comhairle nó, i gcás nach inroinnte ar thrí gan iarmhéid an uimhir sin, an tríú cuid den chéad uimhir eile os a chionn sin is inroinnte amhlaidh.
(2) Ag cruinniú den Chomhairle—
(a) is é cathaoirleach na Comhairle, má bhíonn sé i láthair, a bheidh ina chathaoirleach ar an gcruinniú;
(b) má bhíonn agus an fad a bheidh cathaoirleach na Comhairle as láthair nó oifig an chathaoirligh folamh, is é leas-chathaoirleach na Comhairle, má bhíonn agus an fad a bheidh sé i láthair, a bheidh ina chathaoirleach ar an gcruinniú;
(c) má bhíonn agus an fad a bheidh cathaoirleach na Comhairle as láthair nó oifig an cathaoirligh folamh agus go mbeidh an leas-chathaoirleach as láthair nó oifig an leas-chathaoirligh folamh, roghnóidh na comhaltaí den Chomhairle a bheidh i láthair duine dá líon chun bheith ina chathaoirleach ar an gcruinniú.
(3) Déanfar gach ceist ag cruinniú den Chomhairle a chinneadh le tromlach vótaí na gcomhaltaí a bheidh i láthair agus a vótálfaidh ar an gceist agus, i gcás comhionannas vótaí, beidh an dara vóta nó vóta cinniúna ag cathaoirleach an chruinnithe ach amháin nuair is toghadh cathaoirleach na Comhairle a bheidh i gceist.
(4) Féadfaidh an Chomhairle gníomhú d'ainneoin folúntas nó folúntais i measc a comhaltaí.
(5) Más rud é—
(a) go n-airbheartóidh aon chomhlacht duine a cheapadh ina chomhalta den Chomhairle, agus
(b) go ngníomhóidh an duine sin mar chomhalta den Chomhairle, agus
(c) go raibh aon neamhfhoirmiúlacht ag baint le ceapadh airbheartaithe an duine sin,
ansin, chun críocha imeachtaí na Comhairle ach ní thairis sin ná ar shlí eile, beidh gníomhartha agus imeachtaí an duine sin chomh bailí éifeachtúil agus dá mba nach raibh aon neamhfhoirmiúlacht den sórt sin ann.
(6) Faoi réir fhorálacha an Achta seo, féadfaidh an Chomhairle nós imeachta agus gnó na Comhairle a rialú le buan-orduithe nó ar shlí eile.
Coistí na Comhairle.
12.—(1) Féadfaidh an Chomhairle ó am go ham cibé coistí agus cibé méid coistí a cheapadh is cuí léi chun críocha a bhaineann le feidhmiú aon fheidhm d'fheidhmeanna na Comhairle arb é tuairim na Comhairle gur le coiste nó trí choiste is fearr nó is caothúla a dhéanfaí é a rialú nó a bhainistí.
(2) Gach coiste a cheapfar faoin alt seo is iad a bheidh air cibé líon comhaltaí a ordóidh an Chomhairle agus féadfaidh sé a bheith comhdhéanta go hiomlán de chomhaltaí den Chomhairle nó go páirteach de chomhaltaí den sórt sin agus go páirteach de dhaoine eile.
(3) Má bhíonn coiste a cheapfar faoin alt seo comhdhéanta go páirteach de chomhaltaí den Chomhairle agus go páirtaech de dhaoine eile, ní rachaidh líon na ndaoine sin thar an gceathrú cuid de chomhaltas iomlán an choiste sin.
(4) Is mar a chinnfidh an Chomhairle a bheidh córam agus nós imeachta aon choiste a cheapfar faoin alt seo.
(5) Féadfaidh an Chomhairle aon cheann dá feidhmeanna a tharmligean chun coiste a cheapfar faoin alt seo.
(6) Beidh gníomhartha gach coiste a cheapfar faoin alt seo faoi réir a ndaingnithe ag an gComhairle, ach amháin go bhféadfaidh an Chomhairle cumhacht a thabhairt d'aon choiste áirithe den sórt sin aon ghníomh a dhéanamh faoi réim an údaráis a bheidh tugtha don choiste ag an gComhairle agus ar gníomh é a fhéadfadh an Chomhairle féin a dhéanamh go dleathach.
Foireann na Comhairle.
13.—(1) Féadfaidh an Chomhairle cibé foireann a fhostú is gá chun a feidhmeanna a chomhlíonadh.
(2) Cinnfidh an Chomhairle, ó am go ham, líon, gráid, luach saothair, seilbh oifige agus coinníollacha seirbhíse chomhaltaí fhoireann na Comhairle.
Feidhmeanna a shannfar don Chomhairle.
14.—(1) Comhlíonfaidh an Chomhairle na feidhmeanna seo a leanas maidir leis na hospidéil rannpháirteacha (dá ngairtear san Acht seo feidhmeanna a shannfar don Chomhairle):
(a) i rith na tréimhse ceithre bliana dar tosach an lá bunaithe, meastacháin bhliantúla agus meastacháin fhorlíontacha an chaiteachais ag stiúradh ospidéal a scrúdú, agus leasuithe ar na meastacháin sin a mholadh,
(b) tar éis deireadh na tréimhse sin, meastacháin agus meastacháin fhorlíontacha an chaiteachais ag stiúradh ospidéal a cheadú agus aon leasuithe ar na meastacháin sin a cheadú,
(c) éilimh a chur faoi bhráid Choimisiún na nOspidéal le haghaidh íocaíocht ar scór easnamh,
(d) rialú a dhéanamh ar chaiteachas caipitiúil (is é sin le rá, caiteachas i leith gnóthas mór-dhéanmhas, caiteachas i leith trealamh le haghaidh sain-aonad a sholáthar agus a athnuachan agus an caiteachas neamhghnách nó an caiteachas neamhchoitianta eile go léir) agus ar iarratais ar airgead le haghaidh an chaiteachais sin,
(e) foirm na gcuntas a bheidh le coimeád ag ospidéil a chinneadh,
(f) foireann liachta fiosraithe a cheapadh (ar ceapachán chun Ospidéil Shaorálacha Chónaidhmthe Bhaile Atha Cliath agus ní chun ospidéil ar leithligh gach ceapachán den sórt sin),
(g) an fhoireann liachta fiosraithe a cheapfar amhlaidh a shannadh, faoi réir fho-alt (2) den alt seo, d'ospidéil ar leithligh,
(h) na hospidéil ina mbeidh aonaid chliniciúla áirithe a chinneadh,
(i) aonaid ollúnta a shannadh d'ospidéil áirithe,
(j) leapacha a chionroinnt ar an bhfoireann liachta fiosraithe,
(k) ghníomhaíochtaí maidir le hoideachas liachta a chomhoirdniú, idirbheartaíocht a dhéanamh leis an ollscoil, an coláiste nó an foras iomchuí eile (lena n-áirítear comhaontuithe oiriúnacha a dhéanamh leis na comhlachtaí sin d'fhonn leor-theagasc cliniciúil a áirithiú do mhic léinn leighis) i dtaobh an oideachais sin agus saoráidí a sholáthar le haghaidh teagaisc iarchéime,
(l) faoi réir fho-alt (3) den alt seo, ghíomhaíochtaí maidir le hoideachas altranais a chomhoirdniú agus idirbheartaíocht a dhéanamh leis an mBord Altranais i dtaobh an oideachais sin,
(m) aon fheidhmeanna eile a shannfar don Chomhairle le rún a rithfidh boird na n-ospidéal uile.
(2) Ní dhéanfaidh an Chomhairle aon fhoireann liachta fiosraithe a shannadh d'ospidéal rannpháirteach d'aicme áirithe creidimh muran sannadh é a bheidh ag teacht leis an aicme sin, ach amháin le haontú an bhoird ospidéil lena mbainfidh.
(3) Nuair a bheidh a feidhmeanna á bhfeidhmiú aici i ndáil le gníomhachtaí na n-ospidéal rannpháirteacha a chomhoirdniú i gcúrsaí oideachais altranais agus idirbheartaíocht leis an mBord Altranais i dtaobh na nithe sin, ní dhéanfaidh an Chomhairle aon ní d'oibreodh—
(a) go mbeadh banaltra foghlama faoi réim aon socrú chun freastal ar léachtaí ar eitic agus síceolaíocht an altranais nach mbeadh ag teacht lena creideamh, nó
(b) ar mhodh a chuirfeadh isteach ar neamhspleáchas scoil altranais a bheidh ag gabháil le haon ospidéal rannpháirteach d'aicme creidimh áirithe.
(4) An lá aistrithe agus dá éis, comhlíofaidh an Chomhairle na feidhmeanna a bhí, díreach roimh an lá aistrithe, inchomhlionta ag boird ospidéal.
(5) Ní oibreoidh aon ní san alt seo chun deireadh a chur, ná chun baint in aon sli, le haon chearta a bhí ag duine a bhí, díreach roimh an lá bunaithe, ina chomhalta d'fhoireann liachta fiosraithe ospidéil rannpháirtigh áirithe, ar cearta iad a bhí an tráth sin ag an duine sin mar chomhalta den sórt sin.
Feidhmeanna boird ospidéil.
15.—(1) Ní chomhlíonfaidh bord ospidéil aon cheann de na feidhmeanna a shanntar don Chomhairle.
(2) Tar éis bheith caite don tréimhse cheithre bliana dar tosach an lá bunaithe, ní rachaidh bord ospidéil faoi chaiteachas ach amháin laistigh de theorainneacha meastacháin nó meastacháin leasaithe a bheidh ceadaithe ag an gComhairle.
(3) Ní dhéanfaidh bord ospidéil airgead a chruinneoidh sé trí achainí phoiblí a úsáid chun críocha caipitiúla gan toiliú na Comhairle.
(4) Faoi réir na bhfo-alt sin roimhe seo den alt seo, comhlíonfaidh bord ospidéil na feidhmeanna uile a bhí, díreach roimh an lá bunaithe, inchomhlíonta ag bord rialaithe ospidéal an bhoird.
Boird ospidéal a chónascadh.
16.—(1) Féadfaidh an Chomhairle le hordú, le toiliú dhá bhord ospidéil nó níos mó (a thabharfar de réir cibé nós imeachta a fhorordófar) agus le toiliú an Aire, na boird a chónascadh in aon bhord amháin agus a bhfeidhmeanna a aistriú chun an bhoird sin.
(2) Féadfaidh na forálacha sin go léir a bheith in ordú faoin alt seo is dóigh leis an gComhairle is gá nó is fóirsteanach chun go mbeidh éifeacht ag an gcónascadh agus ag an aistriú, lena n-airítear forálacha ag modhnú aon cheann d'fhorálacha an Achta seo, agus beidh oibleagáid ann go modhnóidh an t-ordú alt 7 den Acht seo ionas gur ionann líon na n-ionadaithe ar Chomhairle an bhoird chónasatha nua agus suim líon na n-ionadaithe ar na boird sin sula ndearnadh cónascadh ar an dá bhord nó níos mó ab ábhar don chónascadh.
Bord ospidéil a dhíscaoileadh.
17.—(1) Féadfaidh an Chomhairle le hordú, lé toiliú boird ospidéil (a thabharfar de réir cibé nós imeachta a fhorordófar) agus le toiliú an Aire, an bord a dhíscaoileadh agus a fheidhmeanna a aistriú chun na Comhairle.
(2) Féadfaidh na forálacha sin go léir a bheith in ordú faoin alt seo is dóigh leis an gComhairle is gá nó is fóirsteanach chun go mbeidh éifeacht ag an díscaoileadh agus ag an aistriú, lena n-áirítear forálacha ag modhnú aon cheann d'fhorálacha an Achta seo, agus beidh oibleagáid ann go modhnóidh an t-ordú alt 7 den Acht seo ionas go mbeidh deireadh le hionadaíocht an bhoird dhíscaoilte ar an gComhairle.
Comhaontú i leith comhghnímh.
18.—Féadfaidh an Chomhairle agus an comhlacht a bheidh ag rialú ospidéil nach ospidéal rannpháirteach comhaontú a dhéanamh agus a chur i gcrích i leith comhghnímh maidir le haon nithe ar cibé téarmaí ar a gcomhaontófar idir an Chomhairle agus an comhlacht le toiliú an Aire.
Díscaoileadh an lá aistrithe.

19.—(1) An lá bunaithe, beidh éifeacht de bhua an fho-ailt seo ag na forálacha seo a leanas:
(a) díscaoilfear Ospidéal Adelaide, Baile Átha Cliath, agus bord ospidéil Ospidéal Adelaide agus scoirfidh siad de bheith ann,
(b) díscaoilfear Gobharnóirí agus Ban-Ghobharnóirí Ospidéal na Mí nó Otharlann Chontae Bhaile Atha Cliath agus bord ospidéil Ospidéal na Mí agus scoirfidh siad de bheith ann,
(c) díscaoilfear an comhlacht corpraithe a bunaíodh le hAcht 1750 agus bord ospidéil Ospidéal Mercer agus scoirfidh siad de bheith ann,
(d) díscaoilfear Ospidéal Náisiúnta na Leanaí agus bord ospidéil Ospidéal Náisiúnta na Leanaí agus scoirfidh siad de bheith ann,
(e) díscaoilfear eagras Ospidéal Sir Patrick Dun agus bord ospidéil an chéanna agus scoirfidh siad de bheith ann,
(f) díscaoilfear eagras Ospidéal Ríoga Chathair Bhaile Átha Cliath agus bord ospidéil an chéanna agus scoirfidh siad de bheith ann,
(g) díscaoilfear an comhlacht corpraithe a bunaíodh le hAcht 1729 agus bord ospidéil Ospidéal Dr. Steevens agus scoirfidh siad de bheith ann.
(2) Beidh éifeacht ag na forálacha atá sa Dara Sceideal a ghabhann leis an Acht seo maidir leis an díscaoileadh faoi fho-alt (1) den alt seo agus, chuige sin, sa Sceideal sin—
(a) forléireofar “ospidéal” mar thagairt d'aon ospidéal rannpháirteach,
(b) forléireofar “comhlacht iomchuí” mar thagairt d'aon bhord ospidéil agus freisin mar thagairt—
(i) i gcás Ospidéal Adelaide— d'Ospidéal Adelaide, Baile Atha Cliath,
(ii) i gcás Ospidéil na Mí—do Ghobharnóirí agus Ban-Ghobharnóirí Ospidéal na Mí nó Otharlann Chontae Bhaile Atha Cliath,
(iii) i gcás Ospidéal Mercer—do Ghobharnóirí Ospidéal Mercer,
(iv) i gcás Ospidéal Náisiúnta na Leanaí—d'Ospidéal Náisiúnta na Leanaí,
(v) i gcás Ospidéal Dr. Steevens—do Ghobharnóirí Ospidéal Dr. Steevens.
(3) Ní beidh feidhm ag alt 12 den Finance Act, 1895, maidir leis an Dara Sceideal a ghabhann leis an Acht seo do dhílsiú maoine don Chomhairle.
(4) In aon tíolacas, gníomhas, uacht nó ionstraim eile, arna dhéanamh roimh an lá aistrithe nó an lá aistrithe nó dá éis, forléireofar, an lá sin nó dá éis, aon tagairt d'ospidéal rannpháirteach mar thagairt don ospidéal sin arna chónascadh de bhun an Achta seo leis na hospidéil rannpháirteacha eile agus déanfar aon tagairt do bhord rialaithe nó do bhord ospidéil aon ospidéil rannpháirtigh a fhorléiriú, an lá sin agus dá éis, mar thagairt don Chomhairle.
Caiteachais na Comhairle roimh an lá aistrithe.
20.—(1) Íocfar caiteachais na Comhairle roimh an lá aistrithe, a mhéid nach n-íocfar iad as fáltais eile, trí ranníoca ó na hospidéil rannpháirteacha.

(a) (i) maidir leis an mbliain ar lá di an lá bunaithe i gcás inarb é an lú lá d'Eanáir an bhliain sin an lá sin, agus
(ii) maidir le bliain i ndiaidh na bliana ar lá di an lá bunaithe agus roimh an mbliain ar lá di an lá aistrithe,
íocfaidh bord ospidéil leis an gComhairle an tsuim a mbeidh idir í agus caiteachais na Comhairle in aghaidh na bliana sin an chomhréir chéanna a bheidh idir an méid leapacha ospidéil a bheidh ar fáil d'othair san ospidéal an lú lá d'Eanáir an bhliain sin agus an méid iomlán leapacha ospidéil a bheidh ar fáil d'othair sna hospidéil rannpháirteacha an lú lá sin d'Eanáir,
(b) maidir leis an tréimhse dar tosach an lá bunaithe, i gcás nach lú lá d'Eanáir an lá sin, agus dar críoch an 3lú lá de Nollaig an bhliain ar lá di an lá bunaithe— íocfaidh bord ospidéil leis an gComhairle an tsuim sin a mbeidh idir í agus caiteachais na Comhairle in aghaidh na tréimhse an chomhréir chéanna a bheidh idir an méid leapacha ospidéil a bheidh ar fáil d'othair san ospidéal an lá bunaithe agus an méid iomlán leapacha ospidéil a bheidh ar fáil d'othair sna hospidéil rannpháirteacha an lá sin,
(c) maidir leis an tréimhse dar tosach an lú lá d'Eanáir an bhliain ar lá di an lá aistrithe, i gcás nach lú lá d'Eanáir an lá sin, agus dar críoch an lá aistrithe—íocfaidh bord ospidéil leis an gComhairle an tsuim sin a mbeidh idir í agus caiteachais na Comhairle in aghaidh an tréimhse an chomhréir chéanna a bheidh idir a méid leapacha ospidéil a bheidh ar fáil d'othair san ospidéal an lú lá sin d'Eanáir agus an méid iomlán leapacha ospidéil a bheidh ar fáil d'othair sna hospidéil rannpháirteacha an lú lá sin d'Eanáir.
Comhaltas na Comhairle tar éis an lá aistrithe.
21.—D'ainneoin an fhoráil eile den Acht seo—
(a) aon duine is comhalta den Chomhairle an lá aistrithe agus a cheap comhlacht rialaithe ospidéil rannpháirtigh nó bord ospidéil leanfaidh sé de bheith ina chomhalta den Chomhairle go dtí go n-éagfaidh sé nó go dtí go n-éireoidh sé as nó go dtí scoirfidh sé de bheith ina chomhalta faoi fho-alt (8) d'alt 7 den Acht seo,
(b) i gcás ina dtarlóidh corrfholúntas i gcomhaltas na Comhairle an lá aistrithe nó dá éis agus gur comhlacht rialaithe ospidéil rannpháirtigh nó bord ospidéil a cheap, nó gur trí chomhthoghadh faoin mír seo a ceapadh, an comhalta ar mar gheall ar é éag, éirí as nó scor de bheith ina chomhalta faoi fho-alt (8) d'alt 7 den Acht seo a tharla an folúntas—
(i) líonfar an folúntas trí chomhthoghadh ag na comhaltaí eile den Chomhairle,
(ii) má bhí an comhalta sin ina chomhalta d'fhoireann liachta fiosraithe ospidéil rannpháirtigh nó d'fhoireann liachta fiosraithe na n-ospidéal rannpháirteacha nó d'fhoireann liachta fiosraithe aon ospidéil faoi riaradh na Comhairle, beidh an duine a chomhthoghfar ina chomhalta freisin de cheann de na foirne liachta fiosraithe sin,
(iii) leanfaidh an duine a chomhthoghfar de bheith ina chomhalta den Comhairle go dtí go n-éagfaidh sé nó go dtí go n-éireoidh sé as nó go dtí go scoirfidh sé de bheith ina chomhalta faoi fho-alt (8) d'alt 7 den Acht seo.

22.—(1) Beidh éifeacht ag an Acht seo agus ag aon orduithe faoi d'ainneoin aon ní sna hAchtanna agus sna hionstraimí a shonraítear sa Tríú Sceideal a ghabhann leis an Acht seo agus forléireofar dá réir sin na hAchtanna agus na hionstraimí sin.
(2) Gan dochar d'fho-alt (1) den alt seo, féadfaidh an tAire, le hordú ar iarratas ón gComhairle agus más cuí leis é, aon mhodhnuithe a dhéanamh ar aon cheann d'fhorálacha na nAchtanna agus na n-ionstraimí a shonraítear sa Tríú Sceideal a ghabhann leis an Acht seo is dóigh leis an gComhairle is gá nó is fóirsteanach chun go mbeidh éifeacht ag an Acht seo nó ag aon orduithe faoi, ach ní dhéanfar ordú faoin bhfo-alt seo a athróidh feidhmeanna bord ospidéil ach amháin le toiliú an bhoird sin.
Athrú ar chomhdhéanamh bord rialaithe ospidéil rannpháirtigh.
23.—(1) Tráth ar bith roimh an lá bunaithe, féadfaidh an tAire le hordú, más cuí leis é ach faoi réir an chéad fho-ailt eile, comhdhéanamh bord rialaithe ospidéil rannpháirtigh (seachas bord rialaithe Ospidéal an Mí) a mhodhnú.
(2) Ní dhéanfar ordú faoin alt seo ach amháin ar iarratas agus de réir iarratais an bhoird rialaithe lena mbainfidh.

24.—Gach ordú a dhéanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu, laistigh den lá agus fiche a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe, beidh an t-ordú ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.

25.—Daingnítear leis seo an comhaontú a rinneadh an 15ú lá de Bhealtaine, 1961, agus a bhfuil cóip de leagtha amach sa Cheathrú Sceideal a ghabhann leis an Acht seo, agus chuige sin dearbhaítear agus achtaítear leis seo mar a leanas:
(a) beidh éifeacht reachtúil ag an gcomhaontú sin agus beidh sé ina cheangal ar na páirtithe iomaí ann chomh hiomlán agus dá mbeadh sé achtaithe san Acht seo;
(b) beidh ag gach páirtí, agus measfar go raibh i gcónaí ag gach pairtí, sa chomhaontú sin, d'ainneoin aon teorainneacha le cumhacht an pháirtí sin chun an comhaontú sin a dhéanamh, cumhacht chun an comhaontú sin a dhéanamh;
(c) beidh sé de dhualgas ar gach páirtí sa chomhaontú sin, agus tugtar cumhacht dó leis seo, an comhaontú sin a chur i gcrích a mhéid a bheidh forálacha an chomhaontaithe sin le comhlíonadh ag an bpáirtí sin.
Dliteanas i leith fiacha Bhord Stiúrthóirí Ospidéal Ríoga Chathair Bhaile Atha Cliath agus réim dliteanais an Bhoird sin.
26.—(1) Ó dháta an Achta seo a rith agus dá éis, ní bhreithneofar aon chomhalta de Bhord Stiúrthóirí Ospidéal Ríoga Cathair Bhaile Atha Cliath, cibé acu is athchomhalta nó comhalta láithreach é, a bheith faoi dhliteanas go pearsanta i leith aon fhéich nó dliteanais eile faoina ndeachaigh an Bord sin nó faoina rachaidh an Bord sin nó faoina ndeachthas nó faoina rachfar thar a cheann agus le cead uaidh agus chun sochair Ospidéal Ríoga Chathair Bhaile Atha Cliath nó i leith an tOspidéal sin a sheoladh, a choimeád i gcaoi, a chothabháil nó a riaradh.
(2) Ní shroichfidh dliteanas an Bhoird sin i leith na bhfiacha nó na ndliteanais eile a luaitear san fho-alt roimhe seo ach amháin na cistí ginearálta agus na sócmhainní eile de chuid an Ospidéil sin a bheidh i lámha nó faoi urláimh an Bhoird sin nó aon iontaobhaí nó iontaobhaithe a bheith ceaptha ag an mBord.

AN DARA SCEIDEAL.
Forálacha de Dhroim Díscaoileadh.
1. (1) An mhaoin uile, réadach nó pearsanta (lena n-áirítear ábhair i gcaingean) a bhí díreach roimh an lá aistrithe dílsithe d'aon chomhlacht iomchuí de chuid aon ospidéil nó dá chuid féin aige nó ar teachtadh ar iontaobhas dó nó ar teachtadh ar iontaobhas chun aon chríche de chríocha aon ospidéil agus gach ceart, cumhacht agus pribhléid a bhaineann nó a ghabhann le haon mhaoin den sórt sin tiocfaidh siad chun bheith agus beidh siad an lá aistrithe agus gan tíolacadh ná sannadh ar bith eile ach faoi réir a n-aistrithe, más gá sin, i leabhair aon bhainc nó corparáide nó cuideachta, dílsithe don Chomhairle nó dá cuid féin aici nó ar teachtadh ar iontaobhas di (de réir mar is gá sa chás) chun an eastáit, an téarma nó an leasa uile chun a raibh an céanna, díreach roimh an lá aistrithe, dílsithe don chomhlacht iomchuí sin nó dá chuid féin aige nó ar teachtadh ar iontaobhas dó nó ar teachtadh ar iontaobhas chun críocha an ospidéil sin.
(2) An mhaoin uile a aistrítear leis an mír seo agus a bhí, díreach roimh an lá aistrithe, i leabhair aon bhainc nó cláraithe i leabhair aon bhainc, corparáide nó cuideachta, déanfaidh an banc, an chorparáid nó an chuideachta sin, ar an gComhairle dá iarraidh sin an lá aistrithe nó tráth ar bith tar éis an lae aistrithe, í a aistriú sna leabhair sin chun ainme na Comhairle.
(3) An lá aistrithe nó a luaithe is féidir dá éis aistreofar chun na Comhairle na cistí iontaobhais agus na hinfheistíochtaí a bheidh de thuras na huaire in ionannas leis an gcéanna agus a bheidh díreach roimh an lá aistrithe ar teachtadh ag Coimisinéirí na dTabhartas agus na dTiomnachtaí Carthanúla in Éirinn ar iontaobhas d'aon chomhlacht iomchuí de chuid aon ospidéil nó chun críche ar bith de chríocha aon ospidéil.
(4) Gach ábhar i gcaingean a aistrítear leis an mír seo chun na Comhairle féadfaidh an Chomhairle, an lá aistrithe agus dá éis, agra a dhéanamh ina leith, é a ghnóthú nó a chur i bhfeidhm ina hainm féin, agus ní gá don Chomhairle fógra i dtaobh an aistrithe a dhéantar leis an mír seo a thabhairt don duine atá faoi cheangal ag an ábhar i gcaingean sin.
(5) Má bhí aon mhaoin a aistrítear chun na Comhairle leis an mír seo ar teachtadh ar intaobhas díreach roimh an lá aistrithe le haghaidh leaba nó duais leighis nó ciste leighis a mhaoiniú nó ar iontaobhais speisialta eile, beidh an mhaoin sin, an lá aistrithe agus dá éis, ar teachtadh ag an gComhairle ar cibé iontaobhais a dhearbhóidh an Chomhairle i leith agus i dtaobh an chéanna, agus na hiontaobhais a dhearbhófar amhlaidh is iontaobhais a bheidh, i dtuairim na Comhairle, ar comhréir, a mhéid a cheadóidh na himthosca, leis an hiontaobhais a bhain íreach roimh an lá aistrithe leis an maoin sin.
2. (1) Gach fiach agus gach dliteanas eile (lena n-áirítear dliteanais neamhleachtaithe as torta nó as sáruithe conartha) a bhí, díreach roimh an lá aistrithe, dlite ó chomhlacht iomchuí aon ospidéil nó gan íoc aige, nó tabhaithe agus gan fuascailt aige, tiocfaidh sé chun bheith agus beidh sé, an lá aistrithe, ina fhiach nó ina dhliteanas ar an gComhairle agus íocfaidh nó fuasclóidh an Chomhairle é agus féadfar é a ghnóthú ón gComhairle nó é a chur i bhfeidhm ina coinne dá réir sin.
(2) Sa mhír seo folaíonn “dliteanas” aon phinsean nó liúntas a dheonaigh aon chomhlacht iomchuí de chuid aon ospidéil roimh an lá aistrithe do dhuine a bhí ar fostú mar oifigeach, altra nó seirbhíseach don chomhlacht iomchuí sin ach nach raibh ar fostú amhlaidh díreach roimh an lá aistrithe.
3. Gach banna, ráthaíocht nó urrús eile de chineál leanúnach a rinne nó a thug aon chomhlacht iomchuí de chuid aon ospidéil do dhuine ar bith, nó a rinne nó a thug duine ar bith don chomhlacht iomchuí sin agus a bhí i bhfeidhm díreach roimhe an lá aistrithe, agus gach conradh nó comhaontú i scríbhinn a rinneadh idir aon chomhlacht iomchuí de chuid aon ospidéil agus duine eile agus nár forghníomhaíodh agus nár comhlánaíodh go hiomlán roimh an lá aistrithe leanfaidh sé, d'ainneoin díscaoileadh an chomhlachta iomchuí sin, d'fheidhm a bheith aige an lá aistrithe agus dá éis, ach forléireofar é agus beidh éifeacht aige amhail is dá gcuirtí ainm na Comhairle ann in ionad ainm an chomhlachta iomchuí sin agus beidh an t-urrús, an conradh nó an comhaontú sin inchurtha i bhfeidhm ag an gComhairle nó ina coinne dá réir sin.
4. Gach caingean, agra, nó imeacht eile a bheidh ar feitheamh an lá aistrithe in aon chúirt nó binse agus a mbeidh aon chomhlacht iomchuí de chuid aon ospidéil ina pháirtí ann, tiocfaidh an Chomhairle chun bheith agus beidh sí, an lá asitrithe, ina páirtí ann in ionad an chomhlachta iomchuí sin agus leanfar den imeacht sin idir an Chomhairle agus na páirtithe eile ann dá réir sin agus ní thitfidh aon imeacht den sórt sin ar lár ná ní thiocfaidh deireadh leis ná ní dhéanfar dochar dó mar gheall ar dhíscaoileadh an chomhlachta iomchuí sin.
5. Gach conradh seirbhíse sainráite nó intuigthe a bhí i bhfeidhm díreach roimh an lá aistrithe idir aon chomhlacht iomchuí de chuid aon ospidéil agus aon duine is oifigeach nó fostaí faoi thuarastal don chomhlacht iomchuí sin leanfaidh sé i bhfeidhm an lá aistrithe agus dá éis, ach forléireofar é agus beidh éifeacht aige amhail is dá gcuirfí an Chomhairle ann in ionad an chomhlachta iomchuí sin, agus beidh gach conradh den sórt sin inchurtha i bhfeidhm ag an gComhairle nó ina coinne dá réir sin.
6. (1) Beidh éifeacht ag na forálacha seo a leanas maidir le haon duine is oifigeach faoi thuarastal nó fostaí faoi thuarastal d'aon chomhlacht iomchuí de chuid aon ospidéil díreach roimh an lá aistrithe:
(a) ní lú an luach saothair a gheobhaidh an duine sin i seirbhís na Comhairle ná ní lú de thairbhe na coinníollacha seirbhíse a mbeidh sé faoina réir ná an tuarastal a raibh teideal aige chuige agus na coinníollacha seirbhíse a raibh sé faoina réir i seirbhís an chomhlachta iomchuí sin díreach roimh an lá aistrithe,
(b) féadfaidh an Chomhairle na dualgais a bheidh le comhlíonadh ag an duine sin a athleagan amach,
(c) má dhéanann an Chomhairle seirbhísí an duine sin a fhoirceannadh toisc gan aon phost oiriúnach a bheith ar fáil dó faoin gComhairle, íocfaidh an Chomhairle leis cibé cúiteamh (i bhfoirm blianachta saoil nó blianachta go ceann tréimhse theoranta nó i bhfoirm aisce) is dóigh leis an gComhairle a bheidh cothrom réasúnach ag féachaint d'imthoscaí uile an cháis (lena n-áirítear an cineál fostaíochta, fad na seirbhíse, an ráta luach saothair agus ionchas an duine sin sa phost a bhí aige faoin gcomhlacht iomchuí sin díreach roimh an lá aistrithe).
(2) (a) Más éagóir le duine an Chomhairle do mhainniú nó do dhiúltú cúiteamh a íoc faoi fhomhír (1) den mhír seo, féadfaidh sé achomharc a dhéanamh chun an duine ainmnithe i gcoinne na mainneachtana nó an diúltaithe.
(b) Más éagóir le duine méid aon chúitimh (cibé acu blianacht nó aisce é) a íocfaidh an Chomhairle faoi fhomhír (1) den mhír seo, nó méid aon choda den chúiteamh sin, féadfaidh sé achomharc a dhéanamh chun an duine ainmnithe i gcoinne na méide.
(c) Aon achomharc faoin bhfomhír seo, i gcás achomhairc i gcoinne mainneachtain na Comhairle cúiteamh a íoc, déanfar é laistigh de shé mhí tar éis seirbhísí an achomharcóra a fhoirceannadh agus, in aon chás eile, déanfar é laistigh de shé mhí tar éis an cinneadh a dhéanamh a mbeifear ag déanamh an achomhairc ina choinne.
(d) Nuair a bheifear ag cinneadh achomhairc faoin bhfomhír seo, tabharfaidh an duine ainmnithe aird ar an liúntas bliantúil nó an aisce a fhéadfaí, in imthoscaí cosúil le imthoscaí an achomharcóra, a dheonú d'oifigeach nó do sheirbhíseach (de réir mar is iomchuí) faoin dlí a bhaineann le haoisliúntas d'oifigigh agus do sheirbhísigh údarás áitiúil.
(e) Is cinneadh críochnaitheach a bheidh i gcinneadh an duine ainmnithe ar achomharc faoin alt seo agus, má ghéilltear don achomharc (go hiomlán nó go páirteach), íocfaidh an Chomhairle cúiteamh nó cúiteamh méadaithe dá réir sin.
(f) San fhomhír seo ciallaíonn “an duine ainmnithe” an duine a ainmneoidh an tAire chun achomhairc a éisteacht agus a chinneadh faoin bhfomhír seo.

AGUS DE BHRÍ go bhfolaíonn dualgas na nOllúna Ríoga Léachtaí Cliniciúla a léamh agus a thabhairt ar na hOthair in Ospidéal Sir Patrick Dun na tráthanna agus faoi réir na gcoinníollacha a fhorordaítear leis na Reachtanna réamhráite AGUS DE BHRÍ go ndearna an Reacht thuasluaite 30 Vic. cap. 9 foráil go dtabharfadh an tOllamh le Máinliacht i gColáiste na Tríonóide, Baile Atha Cliath, agus an Corpshanasaí Ollscoile na Léachtaí Cliniciúla a cheanglaíonn Acht Scoil na Liachta ar na hOllúna Ollscoile le Ceimíocht agus le Luibheolaíocht a thabhairt agus cumhacht a thabhairt do Choláiste na Leá agus do Phrofast (nó má bhíonn sé as láthair do Leas-Phrofast) agus d'Anraí Sinsearacha Choláiste na Tríonóide, Baile Atha Cliath, faoi seach Lia nó Máinlia a cheapadh chun freastal ar Ospidéal Sir Patrick Dun agus Léachtaí Cliniciúla a thabhairt in áit aon duine de na hOllúna Ríoga nó de na hOllúna Ollscoile nó in áit an Chorpshanasaí Ollscoile a mhainneoidh freastal ar an Ospidéal sin nó Léachtaí Cliniciúla a thabhairt AGUS DE BHRÍ go bhfuiltear tar éis Bille a thabhairt os comhair an Oireachtais ina bhfuil foráil chun Ospidéal Sir Patrick Dun a chónaidhmeadh agus leis an aimsir a chónascadh le hOspidéil áirithe eile AGUS DE BHRÍ go bhfuil na páirtithe sa Dintiúr seo agus iad ag féachaint don chónaidhmeadh sin tar éis comhaontú le chéile go mb'fhóirsteanach na ceangail a bhí go dtí seo idir Coláiste na Leá agus Coláiste na Tríonóide Baile Atha Cliath agus Ospidéal Sir Patrick Dun a bhriseadh agus nuair a dhéanfar an briseadh sin go mbeidh éifeacht ag forálacha an Dintiúr seo AGUS DE BHRÍ nach féidir éifeacht a bheith ag an Dintiúir seo gan cead ón Oireachtas agus go bhfuil sé beartaithe nach mbeidh ach éifeacht shealadach choinníollach ag an Dintiúr seo go dtí go rithfear agus n-achtófar an Bille sin mar Acht ANOIS FIANAIONN AN DINTIÚR SEO AGUS COMHAONTAITEAR AGUS DEARBHAITEAR LEIS SEO MAR A LEANAS:—
1. Sa Dintiúr seo ciallaíonn an abairt “an dáta feidhme” an dáta a thabharfar éifeacht Reachtúil don Dintiúr seo.
2. Díreach tar éis an dáta feidhme rachaidh Coláiste na Leá i mbun na gcistí iontaobhais agus na maoine atá in ionannas le hEastát Sir Patrick Dun a dhíol agus a chomhshó ina n-airgead agus déanfaidh siad as an airgead a gheofar de thoradh an díola agus an chomhshó sin na Costais faoina ndeachthas ina leith a íoc agus íocfaidh siad agus úsáidfidh siad iarmhar na bhfáltas díola sin (dá ngairtear “an glan-fháltas díola” anseo feasta) sa tslí a fhoráiltear anseo ina dhiaidh seo.
3. (a) Cuirfear ar leithligh agus coimeádfaidh Coláiste na Leá suim chaipitiúil is comhionann le 232/500ú den ghlanfháltas díola.
(b) Tar éis an tsuim sin a chur ar leithligh amhlaidh agus Coláiste na Leá dá choimeád íocfaidh Coláiste na Leá an 268/500ú a bheidh fágtha den ghlan-fháltas díola le Gobharnóirí, agus aistreoidh siad é chun Gobharnóirí, Ospidéal Sir Patrick Dun le teachtadh acu sin AR IONTAOBHAS chun an céanna cibé acu caipiteal nó ioncam a úsáid dá roghain féin le haghaidh nó i leith costas oideachais nó teagaisc Leighis Mháinliachta nó Altranais i ndáil leis an Ospidéal sin nó taighde in ealaíona na Míochaine nó na Máinliachta agus Eolaíochtaí a bhaineann leo sin nó aon sainfhearas nó saintrealamh le húsáid san Ospidéal sin.
(c) As an tsuim sin a choimeádfaidh Coláiste na Leá amhlaidh déanfaidh Coláiste na Leá suim chaipitiúil is comhionann le 43/500ú den ghlan-fháltas díola a íoc le Coláiste na Tríonóide Baile Atha Cliath an dáta a fhágfaidh an chéad-Ollamh Ríoga a bheidh i seilbh oifige ar an dáta feidhme a oifig agus déanfaidh Coláiste na Leá a chóimhéid sin de shuim is comhionann le 43/500ú den ghlan-fháltas díola a íoc le Coláiste na Tríonóide Baile Atha Cliath an dáta a fhágfaidh an dara Ollamh Ríoga a bheidh i seilbh oifige ar an dáta feidhme a oifig.
(d) An iarmhéid a bheidh fágtha den tsuim chaipitiúil a choimeádfaidh Coláiste na Leá tar éis na suimeanna sin a bheith íoctha aisti le Coláiste na Tríonóide Baile Atha Cliath fanfaidh sé dá chuid féin ag Coláiste na Leá.
4. Amhail ón dáta feidhme scoirfidh ceart agus oibleagáid Choláiste na Leá chun Ollúna Ríoga a cheapadh agus amhail ón dáta sin beidh an ceart chun gach Ollamh Ríoga a cheapadh feasta dílsithe do Choláiste na Tríonóide, Baile Atha Cliath, go haonarach.
5. Gach Ollamh Ríoga a bheidh i seilbh oifige ar an dáta feidhme coinneoidh sé a oifig go ceann na tréimhse ar ina haghaidh a toghadh é nó go dtí go scoirfidh nó go bhfoirceannfar an ceapachán sin idir an dá linn (faoi aon cheann de na téarmaí agus na coinníollacha faoina mbeidh seilbh aige ar an gcéanna).
6. Déanfaidh Coláiste na Leá tuarastail gach duine de na hOllúna Ríoga a bheidh i seilbh oifige ar an dáta feidhme a íoc go ceann na coda a bheidh fágtha dá dtréimhse oifige agus socróidh Coláiste na Tríonóide Baile Atha Cliath ó am go ham agus íocfaidh siad tuarastail na nOllúna Ríoga uile a cheapfaidh nó a thoghfaidh Coláiste na Tríonóide Baile Atha Cliath, ina dhiaidh seo faoi fhorálacha Chlásal 4 de seo agus gabhann Coláiste na Tríonóide Baile Atha Cliath orthu féin leis seo an t-ioncam go léir a gheobhaidh siad ó am go ham as na suimeanna Caipitiúla sin a thabharfar dóibh mar a dúradh de bhun fhorálacha Chlásal 3 (c) de seo a úsáid chun na tuarastail sin a íoc.
7. Amhail ón dáta feidhme ní bheidh de cheangal ar na hOllúna Ríoga, ar na hOllúna Ollscoile ná ar an gCorpshanasaí Ollscoile ná ní bheidh de theideal acu de bhua a n-oifige sa cháil sin, i bpearsain ná trí ionadaí, bheith i láthair nó leachtaí cliniciúla a thabhairt in Ospidéal Sir Patrick Dun ar choinníoll i gcónaí nach ndéanfaidh an clásal seo i slí ar bith difir ná dochar do cheart aon duine ar leithligh a bheidh ar an dáta feidhme ina chomhalta d'Fhoireann an Ospidéil de bhua gur Ollamh Ríoga, Ollamh Ollscoile, Corpshanasaí Ollscoile nó Lia nó Máinlia é a ceapadh go cuí in áit Ollamh Ríoga, Ollamh Ollscoile nó Chorpshanasaí Ollscoile chun leanúint de bheith i seilbh oifige mar chomhalta d'fhoireann an Ospidéil ar na téarmaí agus na coinníollacha a bheidh ann ar an dáta feidhme.
8. Amhail ón dáta feidhme beidh deireadh agus críoch le ceart Choláiste na Leá chun Leá a cheapadh agus le ceart Phrofast nó Leas-Phrofast agus Anraí Sinsearacha Choláiste na Tríonóide Baile Atha Cliath chun Máinleá a cheapadh chun bheith i láthair agus Léachtaí Cliniciúla a thabhairt in Ospidéal Sir Patrick Dun.
9. Amhail ón dáta feidhme scoirfidh Fiosraitheoirí Choláiste na Leá, Uachtarán, Leas-Uachtarán agus Cinsirí an chéanna, agus Profast Choláiste na Tríonóide Baile Atha Cliath de bheith ina nGobharnóirí ex-officio ar Ospideal Sir Patrick Dun.
10. I rith na tréimhse idir an dáta feidhme agus an dáta dá ngairtear “an Lá Bunaithe” sa Bhille sin beidh sé de chumhacht agus de cheart eisiatach ag Bord Gobharnóirí Ospidéal Sir Patrick Dun Leá agus Máinleá a cheapadh chun aon fholúntais ar Fhoireann an Ospidéil a líonadh.
11. Na cumhachtaí go léir chun Gobharnóirí Ospidéal Sir Patrick Dun a cheapadh a bheidh dílsithe an lá feidhme d'Fhiosraitheoirí, Uachtarán, Leas-Uachtarán agus Cinnsirí Choláiste na Leá agus do Phrofast Choláiste na Tríonóide Baile Atha Cliath beidh siad amhail ón dáta feidhme agus dá éis agus go dtí an dáta dá ngairtear “an Lá Bunaithe” sa Bhille sin dílsithe do Bhord Gobharnóirí Ospidéal Sir Patrick Dun agus infheidhmithe acu.
