LOCAL GOVERNMENT (WATER POLLUTION) (AMENDMENT) ACT, 1990
Interpretation.
1.—(1) In this Act—
“the Act of 1959” means the Fisheries (Consolidation) Act, 1959;
“the Principal Act” means the Local Government (Water Pollution) Act, 1977.
(2) A reference in this Act to any enactment shall be construed as a reference to that enactment as amended or adapted by or under any subsequent enactment (including this Act).
Amendment of section 1 of Principal Act.
2.—Section 1 (1) of the Principal Act is hereby amended by the deletion of the definitions of “aquifer” and “sewer” and the insertion of the following definitions before the definition of “board of conservators”;
“‘aquifer’ means any stratum or combination of strata that stores or transmits groundwater;
‘combined drain’ means a drainage pipe, or a system of such pipes, that is not vested in or controlled by a sanitary authority and is used to convey trade effluent or other matter (other than storm water) from two or more premises to any waters or to a sewer;
‘fisheries region’ has the meaning assigned to it by the Fisheries Act, 1980, and includes the Foyle Area, within the meaning of the Foyle Fisheries Act, 1952;
‘regional board’ has the meaning assigned to it by the Fisheries Act, 1980, and includes the Foyle Fisheries Commission;
‘sewer’ means a sewer within the meaning of the Local Government (Sanitary Services) Acts, 1878 to 1964, that is vested in or controlled by a sanitary authority and includes a sewage treatment works, and a sewage disposal works, that is vested in or controlled by a sanitary authority;”.
Amendment of section 3 of Principal Act.
3.—(1) Section 3 of the Principal Act is hereby amended by—
(a) the substitution for subsection (3) of the following subsection—
“(3) It shall be a defence to a charge of committing an offence under this section for the accused to prove that he took all reasonable care to prevent the entry to waters to which the charge relates by providing, maintaining, using, operating and supervising facilities, or by employing practices or methods of operation, that were suitable for the purpose of such prevention.”, and
(b) the substitution for paragraph (a) of subsection (5) of the following paragraphs—
“(a) (i) a discharge of a trade effluent or a sewage effluent which is made under and in accordance with a licence under section 4;
(ii) a discharge of a sewage effluent from a sewer: Provided that, where a standard applying to the effluent stands prescribed under section 26, the discharge complies with that standard;
(iii) a discharge of a trade effluent or sewage effluent to which regulations under section 4 (10) apply: Provided that, where a standard applying to the effluent stands prescribed under section 26, the discharge complies with that standard;
(aa) any entry authorised by or under an enactment specified in the Table to subsection (6);”.
(2) (a) The Minister may, after consultation with any other Minister of the Government who, having regard to his functions, he considers ought to be consulted, by regulations, restrict, attach conditions to, or repeal all or any of the exemptions specified in subsection (5) or (6) of section 3 of the Principal Act.
(b) Where it is proposed to make regulations under this subsection, a draft of the regulations shall be laid before each House of the Oireachtas and the regulations shall not be made until a resolution approving of the draft has been passed by each such House.
(3) A reference in any enactment specified in the Table to section 3 of the Principal Act to the Act of 1959 shall be construed as including a reference to subsection (1) of that section.
Amendment of section 6 of Principal Act.
4.—Section 6 of the Principal Act is hereby amended by the insertion of the following subsections after subsection (2):
“(2A) Regulations under this section may make provision for—
(a) the payment to a local authority of a fee of such amount as may be specified in respect of an application to it for a licence under section 4, and
(b) the payment to An Bord Pleanála of a fee of such amount as may be specified in respect of an appeal to it under section 8,
and any such regulations may make provision for—
(i) the payment of fees of different amounts in respect of different classes of such applications and appeals as aforesaid,
(ii) exemption from the payment of fees provided for under paragraph (a) or (b) in such circumstances as may be specified,
(iii) the waiver, remission or refund (in whole or in part) of any such fees as aforesaid in such circumstances as may be specified, and
(iv) the manner in which such fees may be disposed of.
(2B) Where, pursuant to regulations under this section, a fee is payable to a local authority in respect of an application for a licence under section 4, the local authority shall not entertain the application unless the fee is received by the local authority.
(2C) Where, pursuant to regulations under this section, a fee is payable to An Bord Pleanála in respect of an appeal under section 8, the appeal shall not be entertained unless the fee is received by An Bord Pleanála before the expiration of the prescribed period referred to in subsection (1) of that section.
(2D) Where, pursuant to regulations under this section, a fee is payable to An Bord Pleanála in respect of an appeal under section 8 and the person by whom the fee is payable is neither the applicant for the licence to which the appeal relates nor the person or one of the persons who brought the appeal, An Bord Pleanála shall not entertain submissions or observations in relation to the appeal made by or on behalf of the person by whom the fee is payable unless the fee is received by An Bord Pleanála.
(2E) Where, pursuant to regulations under this section, a fee is payable to An Bord Pleanála in respect of a request for the oral hearing of an appeal, An Bord Pleanála shall not consider the request unless the fee is received by An Bord Pleanála.”.
Amendment of section 7 of Principal Act.
5.—Section 7 of the Principal Act is hereby amended by—
(a) the substitution for subsections (2) and (3) of the following subsections:
“(2) Notwithstanding any other provision of this Act or any condition in a licence under section 4, any such licence may be reviewed at any time by the local authority that granted it if—
(a) the local authority has reasonable grounds for believing that the discharge authorised by the licence is or is likely to be injurious to public health or renders or is likely to render the waters concerned unfit for use for domestic, commercial, industrial, fishery (including fish-farming), agricultural or recreational uses,
(b) there has been a material change in the nature or volume of the discharge,
(c) there has been a material change in relation to the waters to which the discharge is made,
(d) further information has become available since the date of the granting of the licence relating to polluting matter present in the discharge concerned or relating to the effects of such matter, or
(e) the licensee applies to the local authority concerned to review the licence.
(2A) Notwithstanding any other provision of this Act or any condition in a licence under section 4, where regulations are in force under section 26 such a licence relating to an effluent or waters to which the regulations apply shall be reviewed by the local authority that granted it—
(a) in case it was in force before the commencement of the regulations, as soon as may be after such commencement and thereafter at such intervals as may be specified in the regulations, and
(b) in any other case, at such intervals as may be specified in the regulations.
(3) Upon completion of a review under this section, a local authority may amend or delete any condition of the licence or attach conditions or additional conditions to the licence or revoke the licence; and if the local authority proposes to exercise a power aforesaid, it shall do so as soon as may be after the completion of the relevant review under this section.”,
(b) the insertion in subsection (4) after paragraph (b) of the following paragraph:
“(c) Without prejudice to the generality of paragraph (a), regulations under this subsection may also make provision in relation to any of the following matters:
(i) the payment to local authorities of fees of such amounts as may be specified in the regulations in relation to reviews of licences,
(ii) the payment of fees of different amounts in respect of different classes of such reviews as aforesaid,
(iii) exemption from the payment of such fees in such circumstances as may be specified,
(iv) the waiver, remission or refund (in whole or in part) of such fees in such circumstances as may be specified, and
(v) the manner in which such fees may be disposed of.”,
and
(c) the insertion after subsection (4) of the following subsection:
“(5) Where, pursuant to regulations under this section, a fee is payable to a local authority, the local authority shall not conduct the review in relation to which it is payable until the receipt thereof by the local authority.”.
Appeals in relation to sections 4 and 7 of Principal Act.
6.—(1) The following section shall be substituted for section 8 of the Principal Act:
“8.—(1) (a) A person may, before the expiration of such period as may be prescribed, appeal to An Bord Pleanála in relation to—
(i) the grant, refusal to grant or revocation of a licence under section 4,
(ii) the attachment of conditions or additional conditions to such a licence, or
(iii) the amendment or deletion of any condition attached to such a licence,
by a local authority.
(b) An act of a local authority referred to in paragraph (a) shall have effect—
(i) in case an appeal is not brought against it, upon the expiration of the period referred to in paragraph (a),
(ii) in case an appeal is brought against it and the final determination of the appeal does not set the act aside, in accordance with such final determination,
(iii) in case an appeal or appeals is or are brought against it and the appeal or appeals is or are withdrawn—
(I) if the period referred to in paragraph (a) has expired, upon such withdrawal, and
(II) if the period aforesaid has not expired, upon its expiry.
(2) An Bord Pleanála, after consideration of an appeal under this section, shall (as it thinks proper) allow or refuse the appeal and may give any direction consequent on its decision that it considers appropriate to the local authority concerned (including a direction that a specified condition be attached to the licence concerned or be amended or deleted) and a local authority shall comply with any such direction.”.
(2) Appeals brought under section 8 of the Principal Act and not finally determined upon the commencement of this section shall be continued and determined as if so brought after such commencement.
Powers of courts, local authorities and regional boards in relation to the mitigation and remedying of effects of pollution.
7.—The following section shall be substituted for section 10 of the Principal Act:
“10.—(1) (a) Where, on application by any person to the appropriate court, whether or not the person has an interest in the waters concerned, that court is satisfied that another person—
(i) is causing or permitting, or has caused or permitted, polluting matter to enter waters and the entry is or was not one to which section 3 (5) applies and is or was not under and in accordance with a licence under section 171 of the Act of 1959, or
(ii) is discharging or causing or permitting to be discharged, or has discharged or caused or permitted to be discharged, trade effluent or sewage effluent to waters and the discharge is or was not one to which subsection (2) of section 4 applies and is or was not under and in accordance with a licence under that section or the said section 171,
that court may make an order directing that other person to do one or more of the following, that is to say:
(I) to terminate the entry or discharge within such period as may be specified in the order, or
(II) to mitigate or remedy any effects of the entry or discharge concerned in such manner and within such period as may be specified in the order, or
(III) to pay to the applicant or such other person as may be specified in the order a specified amount to defray all or part of any costs incurred by the applicant or that other person in investigating, mitigating or remedying the effects of the entry or discharge concerned.
(b) In this subsection ‘appropriate court’, in relation to an application under paragraph (a) means—
(i) in case the estimated cost of complying with the order to which the application relates does not exceed £2,500, the District Court,
(ii) in case the estimated cost aforesaid does not exceed £15,000, the Circuit Court, and
(iii) in any case, the High Court.
(c) (i) If, in relation to an application under this section to the District Court, that court becomes of opinion during the hearing of the application that the estimated cost aforesaid will exceed £2,500, it may, if it so thinks fit, transfer the application to the Circuit Court or the High Court, whichever it considers appropriate having regard to the estimated cost aforesaid.
(ii) If, in relation to an application under this section to the Circuit Court, that court becomes of opinion during the hearing of the application that the estimated cost aforesaid will exceed £15,000, it may, if it so thinks fit, by order transfer the application to the High Court.
(iii) This paragraph is without prejudice to the jurisdiction of a court (being either the District Court or the Circuit Court) to determine an application under this section in relation to which it was, at the time of the making of the application, the appropriate court.
(d) An application under this section shall be brought in a summary manner.
(e) A court may, if it so thinks fit, make such interim or interlocutory order as it considers appropriate in proceedings under this section and, where an application is transferred under paragraph (c), the court to which it is transferred shall be deemed to have made any order made under this paragraph by the court from which it is so transferred in the proceedings in relation to the application.
(2) Without prejudice to any power of a court to enforce orders made by it, a person who does not comply with an order under subsection (1) shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000 or imprisonment for a term not exceeding 6 months or both.
(3) (a) An order shall not be made by a court under this section unless the person named in the order has been given an opportunity of being heard by the court in the proceedings relating to the application for the order.
(b) The court concerned may make such order as to the costs of the parties to or persons heard by the court in proceedings relating to an application for an order under this section as it considers appropriate.
(4) (a) Where a person does not comply with an order under subsection (1), the local authority, or the regional board, in whose functional area the waters concerned are situated, may take any steps specified in the order to mitigate or remedy the effects of the entry or discharge concerned.
(b) The amount of any expenditure incurred by a local authority or regional board in relation to steps taken by it under paragraph (a) shall be a simple contract debt owed by the person in respect of whom the order under subsection (1) was made to the authority or board, as the case may be, and may be recovered by it from the person as a simple contract debt in any court of competent jurisdiction.
(5) A local authority may serve on a person who is—
(a) causing or permitting polluting matter to enter waters and the entry is not one to which section 3 (5) applies and is not under and in accordance with a licence under section 171 of the Act of 1959, or
(b) causing or permitting trade effluent or sewage effluent to be discharged to waters and the discharge is not one to which section 4 (2) applies, and is not under and in accordance with a licence under that section or under the said section 171,
a notice in writing requiring the cesser of the entry or discharge concerned within such period as may be specified in the notice and requiring the mitigation or remedying of any effects of such entry or discharge in such manner and within such period as may be specified in the notice.
(6) Where a person does not comply with a notice under subsection (5), the local authority concerned may take any steps it considers necessary to terminate the entry or discharge concerned and to mitigate or remedy any effects thereof and the amount of any expenditure incurred by it in relation to any such steps shall be a simple contract debt owed by the person to it and may be recovered by it from the person as a simple contract debt in any court of competent jurisdiction.
(7) (a) An application under subsection (1) to the District Court shall be made to the justice of the District Court for the District Court district in which the waters concerned or the land or other premises from which the entry or discharge concerned takes place, is situated.
(b) An application under subsection (1) to the Circuit Court shall be made to the judge of the Circuit Court for the circuit in which the waters concerned or the land or other premises from which the entry or discharge concerned takes place, is situated.
(8) Without prejudice to the generality of subsections (1) and (5), an order under subsection (1) or a notice under subsection (5) may require—
(a) the replacement of fish stocks,
(b) the restoration of spawning grounds,
(c) the taking of measures to prevent the continuance of the entry or discharge to which the order or notice relates,
(d) the removal of polluting matter from waters,
(e) the treatment of affected waters so as to mitigate or remedy the effects of the entry or discharge concerned,
(f) the making of alternative arrangements for the supply of water for domestic, commercial, industrial, fishery (including fish-farming), agricultural or recreational purposes or the payment of a specified amount to the sanitary authority or other person concerned to defray all or part of the costs of such arrangements,
(g) the making good of any damage to plant or equipment or to any water abstraction or treatment works and any consequential losses incurred by any person by reason of the entry of polluting matter into waters.
(9) An application may be made under subsection (1) and a notice may be served under subsection (5) notwithstanding that a prosecution under section 3 or 4 has not been brought in respect of the relevant entry or discharge referred to in subsection (1) or (5), as may be appropriate.”.
Amendment of section 11 of Principal Act.
8.—Section 11 of the Principal Act is hereby amended by the substitution of the following subsection for subsection (1):
“(1) Where, on application by any person to the High Court, whether or not that person has an interest in the waters concerned, that Court is satisfied that—
(a) polluting matter is being, has been or is likely to be caused or permitted to enter waters and the entry is not one to which section 3 (5) applies or would apply and is not under and in accordance with a licence under section 171 of the Act of 1959,
(b) trade effluent or sewage effluent is being, has been or is likely to be discharged or caused or permitted to be discharged to waters and the discharge is not one to which subsection (2) of section 4 applies or would apply and is not under and in accordance with a licence under that section or the said section 171, or
(c) polluting matter has escaped, is escaping or is likely to escape accidentally from premises to waters,
the High Court may by order—
(i) prohibit any person from causing or permitting or continuing to cause or permit the entry of polluting matter to the waters or the discharge aforesaid of trade effluent or sewage effluent to the waters,
(ii) require the carrying out of specified measures by any person having the custody or control of polluting matter or trade effluent or sewage effluent to prevent an entry or discharge referred to in subparagraph (i) or the continuance or recurrence of such an entry or discharge,
(iii) for the purpose of preventing, or preventing the continuance or recurrence of, such an entry or discharge as aforesaid, or of avoiding any risk that a person having custody or control of polluting matter or trade effluent or sewage effluent may cause or permit such an entry or discharge as aforesaid, require the person to do, refrain from or cease doing any specified act or to refrain from or cease making any specified omission,
(iv) for the purpose of preventing the escape aforesaid or the continuance or recurrence of such an escape, require the carrying out of specified measures by the occupier of the premises aforesaid and for the purpose of avoiding any risk of such an escape, require the occupier to do, refrain from or cease doing any specified act or to refrain from or cease making any specified omission, and
(v) make such other provision as that Court considers appropriate.
(1A) An application may be brought under subsection (1) notwithstanding that a prosecution under section 3 or 4 in respect of the relevant entry or discharge referred to in subsection (1) has not been brought.”.
Amendment of section 12 of Principal Act.
9.—Section 12 of the Principal Act is hereby amended by—
(a) the insertion after subsection (2) of the following subsection:
“(2A) Notwithstanding subsection (2), a notice under this subsection may, either in addition to, or in lieu of complying with that subsection—
(a) regulate or restrict in such manner and to such extent and for such period as may be specified in the notice or make subject to specified conditions the carrying on of any activity, practice or use of premises that, in the opinion of the local authority concerned, could result in the entry of polluting matter to waters, and
(b) require the provision, re-location or alteration of facilities for the collection or storage of polluting matter.”, and
(b) the substitution of the following subsection for subsection (3)—
“(3) A person on whom a notice under this section is served may, within such period as may be specified in the notice, make representations to the local authority concerned in writing regarding the terms of the notice and the authority, after consideration of any such representations, may amend a provision of the notice (including the provision relating to subsection (2) (c)) or may confirm or revoke the notice and shall inform the person of such amendment, confirmation or revocation.”.
Power of local authority to prevent and abate pollution.
10.—The following section shall be substituted for section 13 of the Principal Act:
“13.—(1) Where it appears to a local authority or a sanitary authority that for the purpose of—
(a) preventing the entry of polluting matter to any waters or to any drain or sewer provided solely for the reception or disposal of storm water in its functional area,
(b) removing polluting matter from any such waters, drain or sewer,
(c) preventing polluting matter in waters outside its functional area from affecting such area or any seashore (within the meaning of the Foreshore Act, 1933) adjoining such area, or
(d) mitigating or remedying in relation to its functional area or any such seashore as aforesaid the effects of any polluting matter in any such waters, drain or sewer as aforesaid,
it is necessary to do so, it may take such measures (including the giving of assistance, whether financial or otherwise, to others and the procuring of the taking of measures by others) as it considers appropriate for those purposes and may dispose of any such polluting matter in such manner as it thinks fit.
(2) To the extent (if any) that any measures taken by a local authority or a sanitary authority under this section were necessitated by the acts or omissions of a person (being acts or omissions that the person ought reasonably to have foreseen would or might necessitate the taking of the measures by the authority), the expenditure incurred by the authority in relation to the measures may be recovered by the authority from the person as a simple contract debt in any court of competent jurisdiction.”.
Amendment of section 15 of Principal Act.
11.—Section 15 of the Principal Act is hereby amended—
(a) by the substitution of the following subsections for subsection (3):
“(3) Two or more local authorities may jointly make a water quality management plan in relation to waters part of which are in or adjoin the functional area of each local authority.
(3A) A water quality management plan may be revised or replaced by the local authority or local authorities that made it.”, and
(b) by the substitution of the following subsection for subsection (6):
“(6) As soon as practicable after the making, revision or replacement of a plan under this section, a copy of the plan as so made or revised or of the replacement plan shall be given by the local authority concerned to the Minister and the Minister for the Marine and to any local authority, sanitary authority or regional board whose functional area either adjoins the waters to which the plan relates or the performance of whose functions would be affected by or would affect the implementation of the plan.”.
Amendment of section 16 of Principal Act.
12.—Section 16 of the Principal Act is hereby amended—
(a) by the substitution in subsection (4) of the following paragraph for paragraph (b):
“(b) provide for the payment by the holder of the licence to the sanitary authority concerned of such amount or amounts as may be determined by the sanitary authority having regard to the expenditure incurred or to be incurred by it in monitoring, treating and disposing of discharges of trade effluent, sewage effluent and other matter to sewers in its functional area or a specified part of its functional area.”, and
(b) the insertion of the following subsection after subsection (13):
“(13A) Where a notice under this section is not complied with, the person on whom it was served shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000 or imprisonment for a term not exceeding 6 months or both.”.
Amendment of section 17 of Principal Act.
13.—Section 17 of the Principal Act is hereby amended by—
(a) the substitution for subsections (2) and (3) of the following subsections:
“(2) Notwithstanding any other provision of this Act or any condition in a licence under section 16, any such licence may be reviewed at any time by the sanitary authority that granted it if—
(a) the sanitary authority has reasonable grounds for believing that the discharge authorised by the licence is or is likely to be injurious to public health or is or is likely to render the waters to which the sewer concerned discharges unfit for use for domestic, commercial, industrial, fishery (including fish-farming), agricultural or recreational uses,
(b) there has been a material change in the nature or volume of the discharge,
(c) there has been a material change in relation to the waters to which the sewer concerned discharges,
(d) further information has become available since the date of the granting of the licence relating to polluting matter present in the discharge concerned or relating to the effects of such matter, or
(e) the licensee applies to the sanitary authority concerned to review the licence.
(2A) Notwithstanding any other provision of this Act or any condition in a licence under section 16, where regulations are in force under section 26 relating to a trade effluent or sewage effluent from a sewer or to waters to which a sewer discharges, such a licence relating to the trade effluent or authorising the discharge of a trade effluent to the sewer shall be reviewed by the local authority that granted it—
(a) in case it was in force before the commencement of the regulations, as soon as may be after such commencement and thereafter at such intervals as may be specified in the regulations, and
(b) in any other case, at such intervals as may be specified in the regulations.
(3) Upon completion of a review under this section, a sanitary authority may amend or delete any condition of the licence or attach conditions or additional conditions to the licence or revoke the licence; and if a sanitary authority proposes to exercise a power aforesaid, it shall do so as soon as may be after the completion of the relevant review under this section.”,
(b) the insertion in subsection (4) after paragraph (b) of the following paragraph:
“(c) Without prejudice to the generality of paragraph (a), regulations under this subsection may also make provision in relation to all or any of the following matters:
(i) the payment to sanitary authorities of fees of such amounts as may be specified in the regulations in relation to reviews of licences,
(ii) the payment of fees of different amounts in respect of different classes of such reviews as aforesaid,
(iii) exemption from the payment of such fees in such circumstances as may be specified,
(iv) the waiver, remission or refund (in whole or in part) of such fees in such circumstances as may be specified, or
(v) the manner in which fees may be disposed of.”,
and
(c) the insertion after subsection (4) of the following subsection:
“(5) Where, pursuant to regulations under this section, a fee is payable to a sanitary authority, the sanitary authority shall not conduct the review in relation to which the fee is payable until the receipt thereof by the sanitary authority.”.
Amendment of section 19 of Principal Act.
14.—Section 19 of the Principal Act is hereby amended by the insertion of the following subsections after subsection (2):
“(2A) Regulations under this section may make provision for—
(a) the payment to a sanitary authority of a fee of such amount as may be specified in respect of an application to it for a licence under section 16, and
(b) the payment to An Bord Pleanála of a fee of such amount as may be specified in respect of an appeal to it under section 20,
and any such regulations may make provision for—
(i) the payment of fees of different amounts in respect of different classes of such applications and appeals as aforesaid,
(ii) exemption from the payment of fees provided for under paragraph (a) or (b) in such circumstances as may be specified,
(iii) the waiver, remission or refund (in whole or in part) of such fees in such circumstances as may be specified, and
(iv) the manner in which such fees may be disposed of.
(2B) Where, pursuant to regulations under this section, a fee is payable to a sanitary authority in respect of an application for a licence under section 16, the sanitary authority shall not consider the application unless the fee is received by the sanitary authority.
(2C) Where, pursuant to regulations under this section, a fee is payable to An Bord Pleanála in respect of an appeal under section 20, the appeal shall not be entertained unless the fee is received by An Bord Pleanála before the expiration of the prescribed period referred to in subsection (1) of that section.
(2D) Where, pursuant to regulations under this section, a fee is payable to An Bord Pleanála in respect of a request for the oral hearing of an appeal, An Bord Pleanála shall not consider the request unless the fee is received by An Bord Pleanála.”.
Appeals in relation to sections 16 and 17 of Principal Act.
15.—(1) The following section shall be substituted for section 20 of the Principal Act:
“20.—(1) (a) The occupier of premises from which a discharge to which a licence under section 16 relates is made may, before the expiration of such period as may be prescribed, appeal to An Bord Pleanála in relation to—
(i) the revocation of the licence,
(ii) the attachment of conditions or additional conditions to the licence, or
(iii) the amendment or deletion of any condition attached to the licence,
by a sanitary authority.
(b) A person whose application for a licence under section 16 has been refused by a sanitary authority may, before the expiration of such period as may be prescribed, appeal to An Bord Pleanála in relation to the refusal.
(c) An act of a sanitary authority referred to in paragraph (a) or (b) shall have effect—
(i) in case an appeal is not brought against it, upon the expiration of the period referred to in paragraph (a) or (b), as the case may be,
(ii) in case an appeal is brought against it and the final determination of the appeal does not set the act aside, upon and in accordance with such final determination,
(iii) in case an appeal is brought against it and the appeal is withdrawn, upon the withdrawal of the appeal.
(2) An Bord Pleanála, after consideration of an appeal under this section, shall, as it thinks proper, allow or refuse the appeal and may give any direction consequent on its decision that it considers appropriate to the sanitary authority concerned (including a direction that a specified condition be attached to the licence concerned or be amended or deleted) and a sanitary authority shall comply with any such direction.”.
(2) Appeals brought under section 20 of the Principal Act and not finally determined upon the commencement of this section shall be continued and determined as if so brought after such commencement.
Provisions in relation to appeals under sections 8 and 20 of Principal Act.
16.—(1) The following section shall be substituted for section 21 of the Principal Act:
“21.—(1) The Minister may by regulations provide for—
(a) any procedural matter in relation to appeals under sections 8 and 20, and
(b) such incidental and supplementary matters (including the modification of any provision of the Local Government (Water Pollution) Acts, 1977 and 1990, and the Local Government (Planning and Development) Acts, 1963 to 1983) as appear to the Minister to be necessary or expedient for the purpose of such appeals.
(2) Sections 6 (2) (d), 19 (2) (d) and subsections (1) (a) and (9) of section 28 shall, as respects such appeals as aforesaid, have effect as if the references therein to the Minister were references to An Bord Pleanála.”.
(2) The Local Government (Water Pollution) Act, 1977 (Transfer of Appeals) Order, 1978 (other than Article 4) (which order was made under section 21 of the Principal Act) shall continue in force and may be amended or revoked by the Minister by order.
Information to local authorities and sanitary authorities.
17.—The following section shall be substituted for section 23 of the Principal Act:
“23.—(1) A local authority may, for the purposes of its functions under this Act, by notice in writing given to or served on a person who—
(a) is abstracting water from any waters in the functional area of the authority,
(b) is discharging, or causing or permitting the discharge of, trade effluent or sewage effluent or other matter to any such waters,
(c) has custody or control of any polluting matter in its functional area,
(d) is engaged in activities or practices that, in the opinion of the local authority, may cause or permit polluting matter to enter waters,
require the person to give to the local authority in writing, within such period (being not less than 14 days) beginning on the date of the giving or serving of the notice as may be specified in the notice, such particulars as may be so specified in relation to any of the activities or practices aforesaid (including the custody or control of polluting matter) and such other information (if any) as it may consider necessary for the purposes of those functions.
(2) A sanitary authority may, for the purposes of its functions under this Act, by notice in writing given to or served on a person, require the person who is making, causing or permitting a discharge to a sewer to give to the sanitary authority in writing, within such period (being not less than 14 days) beginning with the date of the giving or serving of the notice as may be specified in the notice, such particulars as may be so specified in relation to the discharge and such other information (if any) as it may consider necessary for the purposes of those functions.
(3) Without prejudice to the generality of subsections (1) and (2), a notice under either of those subsections relating to trade effluent, sewage effluent or other polluting matter may require the person to or on whom it is given or served to give to the local authority or, as the case may be, the sanitary authority, concerned—
(a) maps, plans, drawings or photographs showing the location, nature, extent and condition of—
(i) any facilities for the collection, storage, treatment or disposal of the effluent or other polluting matter,
(ii) any other premises from which polluting matter may enter waters, or
(iii) any sewer,
and showing their relationship to any waters, and
(b) such other particulars as may be specified in the notice of the matters aforesaid, including particulars of the arrangements, systems and methods in use or proposed for the disposal of the effluent or other polluting matter, and of the times and rates at which such disposal is effected.
(4) A person who—
(a) fails or refuses to comply with a requirement in a notice under this section, or
(b) in purported compliance with such a requirement gives to a local authority or sanitary authority information that, to his knowledge, is false or is misleading in a material respect,
shall be guilty of an offence and shall be liable on summary conviction, to a fine not exceeding £1,000 or to imprisonment for a term not exceeding 6 months or both.”.
Amendment of section 26 of Principal Act.
18.—Section 26 of the Principal Act is hereby amended by the insertion of the following subsection after subsection (3):
“(4) (a) Regulations under this section may require persons to take such steps as may be specified in the regulations to secure compliance with quality standards standing prescribed under subsection (1) and may contain such incidental, supplementary and consequential provisions as appear to the Minister to be necessary or expedient for the purpose of the regulations (including provisions modifying any provision of the Local Government (Water Pollution) Acts, 1977 and 1990).
(b) Where it is proposed to make regulations under this section modifying a provision of this Act, a draft of the regulations shall be laid before each House of the Oireachtas and the regulations shall not be made until a resolution approving of the draft shall have been passed by each such House.”.
Amendment of section 28 of Principal Act.
19.—Section 28 of the Principal Act is hereby amended by the insertion of the following subsection after subsection (3):
“(3A) (a) Where an authorised person who is on premises or a vessel in pursuance of the powers conferred by this section reasonably believes that an offence under section 3 (1), 4 (1) or 16 (1) of this Act or section 21 (3) of the Local Government (Water Pollution) (Amendment) Act, 1990, is being or has been committed in relation to the premises or vessel, he may request from any person he finds on the premises or vessel his name and address and a description of his occupation and his functions and responsibilities as respects the premises or vessel, as the case may be, and any enterprise carried on at the premises or on the vessel and (in so far as they are known to him) the name and address of the occupier of the premises, the owner of the vessel and the person in charge of the premises or vessel.
(b) A person who fails or refuses to comply with a request under this subsection or, in pursuance of such a request, furnishes information to an authorised person that is false or misleading shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000 or to imprisonment for a term not exceeding 6 months or both.”.
Civil liability for pollution.
20.—(1) Where trade effluent, sewage effluent or other polluting matter enters waters and causes injury, loss or damage to a person or to the property of a person, the person may, without prejudice to any other cause of action that he may have in respect of the injury, loss or damage, recover damages in any court of competent jurisdiction in respect of such injury, loss or damage—
(a) from the occupier of the premises from which the effluent or matter originated unless the entry to the waters was caused by an act of God or an act or omission of a third party over whose conduct such occupier had no control, being an act or omission that such occupier could not reasonably have foreseen and guarded against, or
(b) if the entry to the waters was occasioned by an act or omission of any person that, in the opinion of the court, constitutes a contravention by the person of a provision of the Principal Act or this Act, from that person.
(2) Subsection (1) does not apply to the entry of trade effluent, sewage effluent or other polluting matter to waters by virtue of anything specified in section 3 (5) of the Principal Act or under and in accordance with a licence under section 4 of the Principal Act or section 171 of the Act of 1959.
Regulation and prohibition of certain agricultural activities.
21.—(1) In this section “activity” means any one or more of the following:
(a) the collection, storage, treatment and disposal of any polluting matter used in connection with, or arising from any operation, activity, practice or use of land or other premises carried on for the purposes of agriculture, horticulture or forestry;
(b) any activity that involves the application to land or to growing crops, or the injection into land, of any silage effluent, animal slurry, manure, fertiliser, pesticide or other polluting matter;
(c) any other operation, activity, practice or use of land or other premises for the purposes of agriculture, horticulture or forestry.
(2) (a) Whenever a local authority considers that, for the purpose of preventing or eliminating the entry of polluting matter to waters, it is necessary to do so, it may make bye-laws prohibiting the carrying on of a specified activity in the whole or a specified part of its functional area or providing for the regulation of the carrying on of a specified activity in the whole or a specified part of its functional area.
(b) Whenever the Minister considers that, for the purpose of preventing or eliminating the entry of polluting matter to waters, it is necessary to do so, the Minister may direct a local authority to make bye-laws prohibiting the carrying on of a specified activity in the functional area of the authority or in a specified part of that area or providing for the regulation in such manner as the Minister may specify of the carrying on of a specified activity in the functional area of the authority or in a specified part of that functional area and the local authority shall comply with the direction.
(c) Without prejudice to the generality of paragraphs (a) and (b), bye-laws under this subsection may specify the manner in which, the conditions subject to which, the times at which and the circumstances in which an activity may be carried on and may impose restrictions, controls and requirements in relation to the carrying on of the activity and the bye-laws may make different provisions in relation to different areas, different parts of areas, different activities and different circumstances.
(d) Bye-laws under this subsection may make provision for such incidental, supplementary and consequential provisions as appear to the local authority making the bye-laws to be necessary or expedient for the purposes of the bye-laws or the functions of the authority under this section.
(e) Bye-laws under this subsection shall be subject to the approval of the Minister.
(3) (a) A person who contravenes or fails to comply with bye-laws under subsection (2) shall be guilty of an offence.
(b) A person guilty of an offence under this subsection shall be liable—
(i) on summary conviction, to a fine not exceeding £1,000 or to imprisonment for a term not exceeding 6 months or to both, or
(ii) if the offence is a contravention of or failure to comply with a bye-law prohibiting the carrying on of a specified activity or a bye-law relating to a matter referred to in subsection (2) (c), on conviction on indictment, to a fine not exceeding £25,000 or to imprisonment for a term not exceeding 5 years or to both.
(4) Where a local authority proposes to make bye-laws under paragraph (a) or (b) of subsection (2)—
(a) it shall publish notice of the proposal, of the area to which the proposed bye-laws will apply and of the place where and period during which copies of the proposed bye-laws may be inspected and purchased in at least one newspaper circulating in that area,
(b) the notice published pursuant to paragraph (a) shall contain a statement to the effect that any person aggrieved by the proposed bye-laws may make representations in writing to the Minister in relation to them during the period specified in the notice,
(c) it shall deposit copies of the proposed bye-laws at its offices, and they shall be made available there for inspection and purchase by members of the public at all reasonable times during the period specified in the notice under paragraph (a),
(d) any person aggrieved by the proposed bye-laws may make representations in writing to the Minister in relation to them during such period as may be specified in the notice (not being less than 30 days from the latest date on which the notice is published pursuant to paragraph (a)),
(e) the Minister shall consider any representations duly made under paragraph (d) before deciding whether to give or refuse to give his approval to the proposed bye-laws,
(f) the Minister may direct the authority to make specified amendments to the proposed bye-laws and, if he does so, paragraphs (a) to (e) shall be deemed to have been complied with in relation to the bye-laws as amended in accordance with the direction,
(g) if, upon the expiration of the period of 6 months from the latest date upon which representations may be made to the Minister under paragraph (d) in relation to the proposed bye-laws, the Minister has not given a decision under paragraph (e) and has not given a direction in relation to them under paragraph (f), the Minister shall be deemed to have given his approval to the proposed bye-laws under paragraph (e),
(h) the bye-laws shall, as soon as may be after they are made, be published in Iris Oifigiúil and notice of their making, of the area to which they apply and of the place where copies of them may be purchased or inspected shall be published in at least one newspaper circulating in the area to which they relate.
(5) For the purposes of the application of section 28 of the Principal Act in relation to this section, the reference in subsection (1) (c) of that section to regulations under the Principal Act shall be construed as including a reference to bye-laws under this section.
Power to declare combined drains to be sewers for certain purposes.
22.—(1) A sanitary authority may declare by order that a specified combined drain shall become and be a sewer for the purposes of the Principal Act and this Act and, whenever it does so, the drain concerned shall, upon the commencement of the order concerned, become and be a sewer for those purposes.
(2) Whenever a sanitary authority proposes to make an order under subsection (1) in relation to a combined drain—
(a) it shall, not less than 30 days before the date of the making of the order, give notice in writing of its intention to make the order to the owner of the drain and the occupier of each premises from which trade effluent or sewage effluent is being discharged to the drain, and
(b) the owner of the drain or an occupier such as aforesaid may within 30 days of the giving to him of the notice aforesaid make representations in writing to the sanitary authority in relation to the making of the order and the authority shall, before deciding whether to make the order, take into consideration any representations made by the owner or occupier.
(3) An order under subsection (1) shall come into operation on such date (not being less than 6 months after the date of its making) as may be specified therein.
(4) Copies of an order under subsection (1) shall, within 10 days after the date of its making, be deposited and made available for inspection and purchase at the offices of the sanitary authority by which it was made and a copy thereof shall, within the period aforesaid, be given or served on the owner of the drain concerned and each occupier such as aforesaid.
(5) Where an order is made by a sanitary authority under subsection (1)—
(a) the occupier of each premises from which trade effluent or sewage effluent is being discharged to the drain concerned immediately after the making of the order shall, within 6 months after such making apply to the authority for a licence under section 16 of the Principal Act in respect of the discharge,
(b) an occupier referred to in paragraph (a) who, in pursuance of that paragraph, duly applies for a licence under section 16 of the Principal Act and furnishes any information duly required by the sanitary authority concerned in relation to the application shall be deemed not to have contravened section 16 (1) of the Principal Act during the period from the commencement of the order to the grant or, as the case may be, the expiration of one month after the refusal to grant, the licence, in respect of any discharge to the drain concerned that is similar in nature, composition, temperature and volume, and is made, during that period, at a rate similar to that of the discharge referred to in paragraph (a) during the corresponding period before such commencement; and in a prosecution for an offence under the said section 16, it shall be presumed until the contrary is shown that the discharge concerned is not one to which this paragraph applies,
(c) a licence under section 4 or 16 of the Principal Act in respect of the discharge of trade effluent or sewage effluent, from the drain to waters or a sewer, as the case may be, shall cease to have effect on the commencement of the order.
(6) A document purporting to be a copy of an order under subsection (1) and to be certified by an officer of the sanitary authority by which the order was made to be a true copy of the order shall be admissible in any proceedings as evidence of the order.
(7) A sanitary authority may by order amend or revoke an order made by it under this section.
(8) In this section “sewage effluent” does not include domestic sewage being discharged to a combined drain and from the combined drain to a sewer.
(9) An order under subsection (1) may relate to a specified part only of a specified combined drain and references in the preceding subsections of this section to a combined drain shall be construed accordingly.
Offences under Principal Act and this Act by directors, etc., of bodies corporate.
23.—(1) Where an offence under the Principal Act or this Act has been committed by a body corporate and is proved to have been committed with the consent or connivance of or to be attributable to any neglect on the part of a person being a director, manager, secretary or other officer of that body corporate, or a person who was purporting to act in any such capacity, that person shall also be guilty of an offence and be liable to be proceeded against and punished as if he were guilty of the first mentioned offence.
(2) Where the affairs of a body corporate are managed by its members, subsection (1) shall apply in relation to the acts and defaults of a member in connection with his functions of management as if he were a director or manager of the body corporate.
Increase of certain penalties under Principal Act.
24.—(1) A person guilty of an offence under section 3, 4 or 16 of the Principal Act shall, in lieu of the penalty specified in the section concerned, be liable—
(a) on summary conviction to a fine not exceeding £1,000 or imprisonment for a term not exceeding 6 months, or both, or
(b) on conviction on indictment, to a fine not exceeding £25,000 or imprisonment for a term not exceeding 5 years, or both.
(2) A person guilty of an offence under section 6, 12, 19, 27 or 28 (4) of the Principal Act shall, in lieu of the penalty specified in the section concerned, be liable on summary conviction to a fine not exceeding £1,000 or imprisonment for a term not exceeding 6 months or both.
(3) A person guilty of an offence under section 14 of the Principal Act shall, in lieu of the penalty specified in that section, be liable on summary conviction to a fine not exceeding £1,000.
(4) This section shall have effect as respects offences committed after the commencement of this section.
Provisions in relation to offences under sections 171 and 172 of Act of 1959.
25.—A person guilty of an offence under section 171 or 172 of the Act of 1959 committed after the commencement of this section shall, in lieu of the penalties specified in section 50 of the Fisheries Act, 1980, be liable—
(a) on summary conviction, to a fine not exceeding £1,000 or imprisonment for a term not exceeding 6 months, or both, or
(b) on conviction on indictment, to a fine not exceeding £25,000 or imprisonment for a term not exceeding 5 years, or both.
Payment of certain fines to local authorities, sanitary authorities and regional boards.
26.—Where a court imposes a fine or affirms or varies a fine imposed by another court for an offence under the Principal Act or this Act, prosecuted by a local authority, a sanitary authority or a regional board, it shall, on the application of the authority or board concerned (made before the time of such imposition, affirmation or variation), provide by order for the payment of the amount of the fine to the authority or board, as the case may be, and such payment may be enforced by the authority or board, as the case may be, as if it were due to it on foot of a decree or order made by the court in civil proceedings.
Prosecution of certain offences.
27.—(a) An offence under a section of the Principal Act mentioned in column (1) of Part I of the Table to this section may be prosecuted by any person mentioned in column (2) of the said Part I opposite the mention of the section in the said column (1).
(b) A summary offence under a section of the Principal Act mentioned in column (1) of Part II of the said Table may be prosecuted by any person mentioned in column (2) of the said Part II opposite the mention of the section in the said column (1).
(c) A summary offence under section 21 may be prosecuted by the local authority concerned.
(d) (i) Notwithstanding the provisions of section 10 (4) of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under the Principal Act, this Act or section 171 or 172 of the Act of 1959, may be commenced at any time within 6 months from the date on which evidence sufficient, in the opinion of the person by whom the proceedings are initiated, to justify the proceedings comes to such person's knowledge:
Provided that no such proceedings shall be initiated later than 5 years from the date on which the offence concerned was committed.
(ii) For the purposes of this paragraph, a certificate signed by or on behalf of the person initiating the proceedings specifying the date or dates on which evidence relating to the offence concerned came to his knowledge shall be prima facie evidence of such date or dates and in any legal proceedings a document purporting to be a certificate under this paragraph and to be so signed shall be deemed to be so signed and shall be admitted as evidence without proof of the signature of the person purporting to sign the certificate, unless the contrary is shown.

Costs of prosecutions.
28.—Where a person is convicted of an offence under the Principal Act, this Act or sections 171 or 172 of the Act of 1959 committed after the commencement of this section, the court shall, unless it is satisfied that there are special and substantial reasons for not so doing, order the person to pay to any local authority, sanitary authority or regional board concerned the costs and expenses, measured by the court, reasonably incurred by the authority or board in relation to the investigation, detection and prosecution of the offence, including costs incurred in the taking of samples, the carrying out of tests, examinations and analyses and in respect of the remuneration and other expenses of employees, consultants and advisers.
Consultation by Minister in relation to making of regulations.
29.—(1) Where the Minister considers that, having regard to the functions of any Minister of the Government, that Minister of the Government ought to be consulted in relation to the making of regulations under section 4 (10), 16 (10), 24, 25 (1), 26 (1) or 27 (1) of the Principal Act, he shall not make the regulations without having consulted with that Minister of the Government.
(2) So much of the enactments aforesaid as provide for consultation with specified persons in relation to the making of regulations shall cease to have effect.
Repeals.
30.—Section 2, subsections (4) and (6) (other than the Table) of section 3 and sections 4 (9), 6 (5), 12 (6), 14 (3), 16 (9), 19 (5), 27 (4), 28 (8), 31 and 34 (c) of the Principal Act are hereby repealed.
Short title, construction, collective citation and commencement.
31.—(1) This Act may be cited as the Local Government (Water Pollution) (Amendment) Act, 1990.
(2) The Local Government (Water Pollution) Act, 1977, and this Act shall be construed together as one Act and may be cited together as the Local Government (Water Pollution) Acts, 1977 and 1990.
(3) The Fisheries Acts, 1959 to 1987, and sections 23, 25 and 28 (in so far as they relate to those Acts) shall be construed together as one Act and may be cited together as the Fisheries Acts, 1959 to 1990.
(4) Sections 4, 5, 6, 13, 14, 15 and 16 of this Act shall come into operation on such day or days as may be appointed by order or orders of the Minister, either generally or with reference to a particular purpose or provision, and different days may be fixed for different purposes and different provisions of those sections.

ciallaíonn ‘séarach’ séarach de réir bhrí na nAchtanna Rialtais Áitiúil (Seirbhísí Sláintíochta), 1878 go 1964, atá dílsithe d'údarás sláintíochta nó faoina rialú agus folaíonn sé oibreacha cóireála séarachta, agus oibreacha diúscartha séarachta, atá dílsithe d'údarás sláintíochta nó faoina rialú;”.
Leasú ar alt 3 den Phríomh-Acht.
3.—(1) Leasaítear leis seo alt 3 den Phríomh-Acht—
(a) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (3)—
“(3) Is cosaint é ar chúiseamh go ndearnadh cion faoin alt seo má chruthaíonn an cúisí gur ghlac sé gach cúram réasúnach chun an dul amach in uiscí lena mbaineann an cúiseamh a chosc trí shaoráidí a chur ar fáil, a chothabháil, a úsáid, a oibriú agus a mhaoirsiú, nó trí fheidhm a bhaint as cleachtais nó modhanna oibriúcháin, a bhí oiriúnach chun an dul amach sin a chosc.”, agus
(b) trí na míreanna seo a leanas a chur in ionad mhír (a) d'fho-alt (5)—
“(a) (i) le scardadh eisiltigh trádála nó eisiltigh séarachta a dhéantar faoi réim agus de réir ceadúnais faoi alt 4;
(ii) le scardadh eisiltigh séarachta as séarach: Ar choinníoll, i gcás caighdeán a bhaineann leis an eisilteach a bheith forordaithe faoi alt 26, go bhfuil an scardadh de réir an chaighdeáin sin;
(iii) le scardadh eisiltigh trádála nó eisiltigh séarachta lena mbaineann rialacháin faoi alt 4 (10): Ar choinníoll, i gcás caighdeán a bhaineann leis an eisilteach a bheith forordaithe faoi alt 26, go bhfuil an scardadh de réir an chaighdeáin sin;
(aa) le haon dul amach a údaraítear le hachtachán, nó faoi achtachán, a shonraítear sa Tábla a ghabhann le fo-alt (6);”.
(2) (a) Féadfaidh an tAire le rialacháin, tar éis dul i gcomhairle le haon Aire eile den Rialtas ar dóigh leis, ag féachaint dá fheidhmeanna, gur chóir dul i gcomhairle leis, na díolúintí go léir nó aon cheann de na díolúintí a shonraítear i bhfo-alt (5) nó (6) d'alt 3 den Phríomh-Acht a shrianadh nó coinníollacha a chur ag gabháil leo nó iad a aisghairm.
(b) I gcás ina mbeartaítear rialacháin a dhéanamh faoin bhfo-alt seo, leagfar dréacht de na rialacháin faoi bhráid gach Tí den Oireachtas agus ní dhéanfar na rialacháin go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach acu sin.
(3) Déanfar aon tagairt d'Acht 1959 in aon achtachán a shonraítear sa Tábla a ghabhann le halt 3 den Phríomh-Acht a fhorléiriú mar thagairt a fholaíonn tagairt d'fho-alt (1) den alt sin.
Leasú ar alt 6 den Phríomh-Acht.
4.—Leasaítear leis seo alt 6 den Phríomh-Acht trí na fo-ailt seo a leanas a chur isteach i ndiaidh fho-alt (2):
“(2A) Féadfaidh rialacháin faoin alt seo foráil a dhéanamh do na nithe seo a leanas—
(a) táille de cibé méid a bheidh sonraithe a íoc le húdarás áitiúil maidir le hiarratas chuige ar cheadúnas faoi alt 4, agus
(b) táille de cibé méid a bheidh sonraithe a íoc leis an mBord Pleanála maidir le hachomharc chuige faoi alt 8,
agus féadfaidh aon rialacháin den sórt sin foráil a dhéanamh do na nithe seo a leanas—
(i) íoc táillí de mhéideanna éagsúla maidir le haicmí éagsúla d'iarratais agus d'achomhairc den sórt sin a dúradh.
(ii) díolúine ó íoc táillí dá bhforáiltear faoi mhír (a) nó (b) i cibé imthosca a bheidh sonraithe,
(iii) aon táillí den sórt sin a dúradh a tharscaoileadh, a loghadh nó a aisíoc (go hiomlán nó go páirteach) i cibé imthosca a bheidh sonraithe, agus
(iv) an modh ina bhféadfar na táillí sin a dhiúscairt.
(2B) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha le húdarás áitiúil i leith iarratas ar cheadúnas faoi alt 4, ní thabharfaidh an t-údarás áitiúil aird ar an iarratas mura bhfaighidh an t-údarás áitiúil an táille.
(2C) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha leis an mBord Pleanála i leith achomhairc faoi alt 8, ní thabharfar aird ar an achomharc mura bhfaighidh an Bord Pleanála an táille roimh dheireadh na tréimhse forordaithe dá dtagraítear i bhfo-alt (1) den alt sin.
(2D) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha leis an mBord Pleanála i leith achomhairc faoi alt 8 agus, maidir leis an duine a bhfuil an táille iníoctha aige, nach é an t-iarratasóir é ar an gceadúnas lena mbaineann an t-achomharc, ná an duine nó duine de na daoine a thionscain an t-achomharc, ní thabharfaidh an Bord Pleanála aird ar aighneachtaí ná ar bharúlachtaí i ndáil leis an achomharc ón duine, nó thar ceann an duine, a bhfuil an táille iníoctha aige mura bhfaighidh an Bord Pleanála an táille.
(2E) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha leis an mBord Pleanála i leith iarrata go dtabharfaí éisteacht ó bhéal d'achomharc, ní bhreithneoidh an Bord Pleanála an iarraidh mura bhfaighidh an Bord Pleanála an táille.”.
Leasú ar alt 7 den Phríomh-Acht.
5.—Leasaítear leis seo alt 7 den Phríomh-Acht—
(a) trí na fo-ailt seo a leanas a chur in ionad fho-ailt (2) agus (3):
“(2) D'ainneoin aon fhorála eile den Acht seo nó aon choinníll i gceadúnas faoi alt 4, féadfaidh an t-údarás áitiúil a dheonaigh aon cheadúnas den sórt sin é a athbhreithniú tráth ar bith más rud é—
(a) go mbeidh forais réasúnacha ag an údarás áitiúil chun a chreidiúint go bhfuil an scardadh a údaraítear leis an gceadúnas, nó gur dóigh dó a bheith, dochrach do shláinte an phobail nó go ndéanann sé na huiscí lena mbaineann, nó gur dóigh dó iad a dhéanamh, neamhoiriúnach d'úsáidí tís, tráchtála, tionscail, iascaigh (lena n-áirítear feirmeoireacht éisc), talmhaíochta nó áineasa,
(b) go mbeidh athrú ábhartha tagtha ar nádúr nó ar thoilleadh an scardaidh,
(c) go mbeidh athrú ábhartha ann i ndáil leis na huiscí a bhfuil an scardadh á dhéanamh amach iontu,
(d) go bhfuil faisnéis bhreise ar fáil, ón dáta ar ar deonaíodh an ceadúnas, i ndáil le hábhar truailliúcháin atá sa scardadh lena mbaineann nó i ndáil le hiarmhairtí an ábhair sin, nó
(e) go ndéanfaidh an ceadúnaí iarratas chuig an údarás áitiúil lena mbaineann chun an ceadúnas a athbhreithniú.
(2A) D'ainneoin aon fhorála eile den Acht seo nó aon choinníll i gceadúnas faoi alt 4, i gcás rialacháin a bheith i bhfeidhm faoi alt 26 déanfaidh an t-údarás áitiúil a dheonaigh ceadúnas den sórt sin, a bhaineann le heisilteach nó le huiscí lena mbaineann na rialacháin, an ceadúnas sin a athbhreithniú—
(a) i gcás ina raibh sé i bhfeidhm roimh thosach feidhme na rialachán, a luaithe is féidir tar éis an tosach feidhme sin agus, dá éis sin, i gceann cibé tréimhsí a bheidh sonraithe sna rialacháin, agus
(b) in aon chás eile, i gceann cibé tréimhsí a bheidh sonraithe sna rialacháin.
(3) Ar athbhreithniú faoin alt seo a bheith críochnaithe, féadfaidh údarás áitiúil aon choinníoll de chuid an cheadúnais a leasú nó a scriosadh, nó coinníollacha nó coinníollacha breise a chur ag gabháil leis an gceadúnas. nó an ceadúnas a chúlghairm; agus má bheartaíonn an t-údarás áitiúil cumhacht mar a dúradh a fheidhmiú, déanfaidh sé amhlaidh a luaithe is féidir tar éis dó an t-athbhreithniú iomchuí faoin alt seo a chríochnú.”,
(b) tríd an mír seo a leanas a chur isteach i bhfo-alt (4) i ndiaidh mhír (b):
“(c) Gan dochar do ghinearáltacht mhír (a), féadfaidh rialacháin faoin bhfo-alt seo foráil a dhéanamh freisin i ndáil le haon ní díobh seo a leanas:
(i) táillí de cibé méideanna a bheidh sonraithe sna rialacháin i ndáil le hathbhreithnithe ar cheadúnais a íoc le húdaráis áitiúla,
(ii) íoc táillí de mhéideanna éagsúla i leith aicmí éagsúla d'athbhreithnithe den sórt sin mar a dúradh,
(iii) díolúine ó íoc na dtáillí sin i cibé imthosca a bheidh sonraithe,
(iv) na táillí sin a tharscaoileadh, a loghadh nó a aisíoc (go hiomlán nó go páirteach) i cibé imthosca a bheidh sonraithe, agus
(v) an modh ina bhféadfar na táillí sin a dhiúscairt.”,
agus
(c) tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (4):
“(5) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha le húdarás áitiúil, ní sheolfaidh an t-údarás áitiúil an t-athbhreithniú a bhfuil an táille iníoctha i ndáil leis go dtí go mbeidh sí faighte ag an údarás áitiúil.”.
Achomhairc i ndáil le hailt 4 agus 7 den Phríomh-Acht.
6.—(1) Cuirfear an t-alt seo a leanas in ionad alt 8 den Phríomh-Acht:
“8.—(1) (a) Féadfaidh duine, roimh dheireadh cibé tréimhse a bheidh forordaithe, achomharc a dhéanamh chun an Bhoird Pleanála i ndáil le—
(i) ceadúnas faoi alt 4 a dheonú, diúltú é a dheonú, nó é a chúlghairm,
(ii) coinníollacha nó coinníollacha breise a chur ag gabháil le ceadúnas den sórt sin, nó
(iii) leasú nó scriosadh aon choinníll atá ag gabháil le ceadúnas den sórt sin,
ag údarás áitiúil.
(b) Beidh éifeacht le gníomh de chuid údaráis áitiúil dá dtagraítear i mír (a)—
(i) i gcás nach dtionscnaítear achomharc ina choinne, ar an tréimhse dá dtagraítear i mír (a) a bheith caite,
(ii) i gcás go dtionscnaítear achomharc ina choinne agus nach é cinneadh críochnaitheach an achomhairc an gníomh a chur ar ceal, de réir an chinnidh chríochnaithigh sin,
(iii) i gcás go dtionscnaítear achomharc nó achomhairc ina choinne agus go ndéantar an t-achomharc nó na hachomhairc a tharraingt siar—
(I) má tá an tréimhse dá dtagraítear i mír (a) caite, ar an tarraingt siar sin, agus
(II) mura bhfuil an tréimhse sin a dúradh caite, ar í a bheith caite.
(2) Tar éis don Bhord Pleanála achomharc faoin alt seo a bhreithniú, ceadóidh sé an t-achomharc nó diúltóidh sé dó (de réir mar is cuí leis) agus féadfaidh sé aon ordachán is dóigh leis is iomchuí, de dhroim an chinnidh atá déanta aige, a thabhairt don údarás áitiúil lena mbaineann (lena n-áirítear ordachán á ordú go ndéanfar coinníoll sonraithe a chur ag gabháil leis an gceadúnas lena mbaineann nó a leasú nó a scriosadh) agus déanfaidh údarás áitiúil de réir aon ordacháin den sórt sin.”.
(2) Aon achomhairc a bheidh tionscanta faoi alt 8 den Phríomh-Acht agus nach mbeidh cinnte go críochnaitheach ar thosach feidhme an ailt seo, leanfar leo agus cinnfear iad ionann is dá mbeidís tionscanta amhlaidh tar éis an tosach feidhme sin.
Cumhachtaí cúirteanna, údarás áitiúil agus bord réigiúnach i ndáil le hiarmhairtí truaillithe a mhaolú agus a leigheas.
7.—Cuirfear an t-alt seo a leanas in ionad alt 10 den Phríomh-Acht:
“10.—(1) (a) Más rud é, ar iarratas ó aon duine chuig an gcúirt iomchuí, bíodh nó ná bíodh leas ag an duine sna huiscí lena mbaineann, gur deimhin leis an gcúirt sin go bhfuil duine eile—
(i) ag cur faoi deara nó ag ceadú, nó tar éis cur faoi deara nó tar éis ceadú, ábhar truailliúcháin do dhul amach in uiscí agus nach dul amach lena mbaineann alt 3 (5) agus nach dul amach faoi réim agus de réir ceadúnais faoi alt 171 d'Acht 1959 an dul amach atá nó a bhí i gceist, nó
(ii) ag scardadh eisiltigh trádála nó eisiltigh séarachta amach in uiscí nó á chur sin faoi deara nó á cheadú, nó tar éis scardadh den sórt sin a dhéanamh, a chur faoi deara nó a cheadú, agus nach scardadh lena mbaineann fo-alt (2) d'alt 4 agus nach scardadh faoi réim agus de réir ceadúnais faoin alt sin nó faoin alt sin 171 an scardadh atá nó a bhí i gceist,
féadfaidh an chúirt sin ordú a dhéanamh á ordú don duine eile sin aon ní amháin nó níos mó de na nithe seo a leanas a dhéanamh, is é sin le rá:
(I) deireadh a chur leis an dul amach nó leis an scardadh laistigh de cibé tréimhse a bheidh sonraithe san ordú, nó
(II) aon iarmhairtí ón dul amach nó ón scardadh lena mbaineann a mhaolú nó a leigheas i cibé slí agus laistigh de cibé tréimhse a bheidh sonraithe san ordú, nó
(III) méid sonraithe a íoc leis an iarratasóir nó le cibé duine eile a bheidh sonraithe san ordú chun íoc as na costais go léir, nó as cuid d'aon chostais, a thabhaigh an t-iarratasóir nó an duine eile sin ag imscrúdú, ag maolú nó ag leigheas na n-iarmhairtí ón dul amach nó ón scardadh lena mbaineann.
(b) San fho-alt seo ciallaíonn ‘cúirt iomchuí’, i ndáil le hiarratas faoi mhír (a) —
(i) i gcás nach mó ná £2,500 an costas measta as déanamh de réir an ordaithe lena mbaineann an t-iarratas, an Chúirt Dúiche,
(ii) i gcás nach mó ná £15,000 an costas measta sin a dúradh, an Chúirt Chuarda, agus
(iii) in aon chás, an Ard-Chúirt.
(c) (i) Más rud é, i ndáil le hiarratas faoin alt seo chun na Cúirte Dúiche, go dtiocfaidh an chúirt sin, le linn an t-iarratas a éisteacht, chun bheith den tuairim go rachaidh an costas measta sin a dúradh thar £2,500, féadfaidh sí, más cuí léi, an t-iarratas a aistriú go dtí an Chúirt Chuarda nó go dtí an Ard-Chúirt, cibé cúirt acu is dóigh léi is iomchuí ag féachaint don chostas measta sin a dúradh.
(ii) Más rud é, i ndáil le hiarratas faoin alt seo chun na Cúirte Cuarda, go dtiocfaidh an chúirt sin, le linn an t-iarratas a éisteacht, chun bheith den tuairim go rachaidh an costas measta sin a dúradh thar £15,000, féadfaidh sí, más cuí léi, an t-iarratas a aistriú le hordú go dtí an Ard-Chúirt.
(iii) Ní dochar an mhír seo do dhlínse cúirte (arb í an Chúirt Dúiche nó an Chúirt Chuarda í) chun iarratas a chinneadh faoin alt seo ar iarratas é arbh í an chúirt iomchuí í i ndáil leis an tráth a ndearnadh an t-iarratas.
(d) Tionscnófar iarratas faoin alt seo ar an tslí achomair.
(e) Féadfaidh cúirt, más cuí léi é, cibé ordú eatramhach nó idirbhreitheach is dóigh léi is cuí a dhéanamh in imeachtaí faoin alt seo agus, i gcás ina n-aistreofar iarratas faoi mhír (c), measfar gurbh í an chúirt chuig a n-aistrítear é a rinne aon ordú a bheidh déanta faoin mír seo ag an gcúirt óna n-aistrítear amhlaidh é sna himeachtaí i ndáil leis an iarratas.
(2) Gan dochar d'aon chumhacht atá ag cúirt orduithe a bheidh déanta aici a fhorfheidhmiú, beidh duine nach gcomhlíonfaidh ordú faoi fho-alt (1) ciontach i gcion agus dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air.
(3) (a) Ní dhéanfaidh cúirt ordú faoin alt seo gan caoi a thabhairt don duine atá ainmnithe san ordú éisteacht a fháil sa chúirt sna himeachtaí a bhaineann leis an iarratas ar an ordú.
(b) Féadfaidh an chúirt áirithe cibé ordú a dhéanamh is dóigh léi is cuí i dtaobh costas na bpáirtithe, nó na ndaoine a fhaigheann éisteacht sa chúirt, in imeachtaí a bhaineann le hiarratas ar ordú faoin alt seo.
(4) (a) I gcás nach gcomhlíonfaidh duine ordú faoi fho-alt (1) féadfaidh an t-údarás áitiúil, nó an bord réigiúnach, ar ina limistéar feidhmiúcháin atá na huiscí lena mbaineann, aon bhearta a bheidh sonraithe san ordú a dhéanamh chun na hiarmhairtí ón dul amach nó ón scardadh lena mbaineann a mhaolú nó a leigheas.
(b) Beidh méid aon chaiteachais a thabhóidh údarás áitiúil nó bord réigiúnach, i ndáil le bearta arna nglacadh aige faoi mhír (a), ina fhiach conartha shimplí a bheidh dlite don údarás nó don bhord, de réir mar a bheidh, den duine ar ina leith a rinneadh an t-ordú faoi fho-alt (1) agus féadfaidh an t-údarás nó an bord é a ghnóthú ón duine mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
(5) Féadfaidh údarás áitiúil fógra i scríbhinn a sheirbheáil ar dhuine—
(a) atá ag cur faoi deara nó ag ceadú ábhar truailliúcháin do dhul amach in uiscí agus nach dul amach lena mbaineann alt 3 (5) agus nach dul amach faoi réim agus de réir ceadúnais faoi alt 171 d'Acht 1959 an dul amach atá i gceist, nó
(b) atá ag cur faoi deara nó ag ceadú eisilteach trádála nó eisilteach séarachta a scardadh amach in uiscí agus nach scardadh lena mbaineann alt 4 (2), agus nach scardadh faoi réim agus de réir ceadúnais faoin alt sin nó faoin alt sin 171, an scardadh atá i gceist,
á cheangal air deireadh a chur leis an dul amach nó leis an scardadh lena mbaineann laistigh de cibé tréimhse a bheidh sonraithe san fhógra agus á cheangal aon iarmhairtí ón dul amach nó ón scardadh sin a mhaolú nó a leigheas i cibe slí agus laistigh de cibé tréimhse a bheidh sonraithe san fhógra.
(6) I gcás nach gcomhlíonfaidh duine fógra faoi fho-alt (5), féadfaidh an t-údarás áitiúil lena mbaineann aon bhearta a dhéanamh is dóigh leis is gá chun deireadh a chur leis an dul amach nó leis an scardadh lena mbaineann agus chun aon iarmhairtí ón gcéanna a mhaolú nó a leigheas agus beidh méid aon chaiteachais a thabhóidh sé i ndáil le haon bhearta den sórt sin ina fhiach conartha shimplí a bheidh dlite den duine dó agus féadfaidh sé é a ghnóthú ón duine mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
(7) (a) Aon iarratas faoi fho-alt (1) chun na Cúirte Dúiche déanfar é chuig an mbreitheamh den Chúirt Dúiche don dúiche Cúirte Dúiche ina bhfuil na huiscí lena mbaineann nó ina bhfuil an talamh nó an t-áitreabh eile as a ndéantar an dul amach nó an scardadh lena mbaineann.
(b) Aon iarratas faoi fho-alt (1) chun na Cúirte Cuarda déanfar é chuig an mbreitheamh den Chúirt Chuarda don chuaird ina bhfuil na huiscí lena mbaineann nó ina bhfuil an talamh nó an t-áitreabh eile as a ndéantar an dul amach nó an scardadh lena mbaineann.
(8) Gan dochar do ghinearáltacht fho-ailt (1) agus (5), féadfar a cheangal le hordú faoi fho-alt (1) nó le fógra faoi fho-alt (5)—
(a) stoic éisc a athsholáthar,
(b) leapacha sceite a athshuíomh,
(c) bearta a dhéanamh chun cosc a chur ar dhuine leanúint leis an dul amach nó leis an scardadh lena mbaineann an t-ordú nó an fógra,
(d) ábhar truailliúcháin a bhaint amach as uiscí,
(e) uiscí a ndearnadh dochar dóibh a chóireáil ar chaoi a mhaolóidh nó a leigheasfaidh na hiarmhairtí ón dui amach nó ón scardadh lena mbaineann,
(f) malairt comhshocruithe a dhéanamh chun uisce a sholáthar le haghaidh úsáidí tís, tráchtála, tionscail, iascaigh (lena n-áirítear feirmeoireacht éisc), talmhaíochta nó áineasa nó méid sonraithe a íoc leis an údarás sláintíochta nó leis an duine eile lena mbaineann faoi chomhair na gcostas go léir nó cuid de na costais a bhaineann leis na comhshocruithe sin,
(g) aon damáiste a rinneadh do ghléasra nó do threalamh, nó d'aon oibreacha astógála nó cóireála uisce, agus aon chaillteanais iarmhartacha a thabhaigh aon duine mar gheall ar ábhar truailliúcháin do dhul amach in uiscí, a chur ina cheart.
(9) Féadfar iarratas a dhéanamh faoi fho-alt (1) agus féadfar fógra a sheirbheáil faoi fho-alt (5) d'ainneoin nár tionscnaíodh ionchúiseamh faoi alt 3 nó 4 maidir leis an dul amach nó an scardadh iomchuí dá dtagraítear i bhfo-alt (1) nó (5), de réir mar is cuí.”.

8.—Leasaítear leis seo alt 11 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (1):
“(1) Más rud é, ar iarratas ó aon duine chun na hArd-Chúirte, bíodh nó ná bíodh leas ag an duine sin sna huiscí lena mbaineann, gur deimhin leis an gCúirt sin—
(a) go bhfuiltear, go rabhthas nó gur dóigh go mbeifear ag cur faoi deara nó ag ceadú ábhar truailliúcháin do dhul amach in uiscí agus nach dul amach lena mbaineann nó lena mbainfeadh alt 3 (5) agus nach dul amach faoi réim agus de réir ceadúnais faoi alt 171 d'Acht 1959 an dul amach atái gceist,
(b) go bhfuiltear, go rabhthas nó gur dóigh go mbeifear ag scardadh eisiltigh trádála nó eisiltigh séarachta amach in uiscí nó á chur sin faoi deara nó á cheadú agus nach scardadh lena mbaineann nó lena mbainfeadh fo-alt (2) d'alt 4 agus nach scardadh faoi réim agus de réir ceadúnais faoin alt sin nó faoin alt sin 171 an scardadh, nó
(c) go bhfuil ábhar truailliúcháin tar éis éalú, ag éalú nó gur dóigh dó éalú, de thaisme, as áitreabh amach in uiscí,
féadfaidh an Ard-Chúirt le hordú—
(i) a thoirmeasc ar aon duine a chur faoi deara nó a cheadú, nó leanúint de bheith ag cur faoi deara nó de bheith ag ceadú, ábhar truailliúcháin do dhul amach sna huiscí nó eisilteach trádála nó eisilteach séarachta a scardadh mar a dúradh amach sna huiscí,
(ii) a cheangal ar aon duine a bhfuil ábhar truailliúcháin nó eisilteach trádála nó eisilteach séarachta ina choimeád nó faoina rialú bearta sonracha a chur i gcrích chun cosc a chur le dul amach nó scardadh dá dtagraítear i bhfomhír (i) nó le tarlú leanúnach nó le hatarlú an dul amach nó an scardaidh sin,
(iii) d'fhonn dul amach nó scardadh den chineál a dúradh a chosc, nó d'fhonn tarlú leanúnach nó atarlú an chéanna a chosc, nó d'fhonn aon bhaol a sheachaint go ndéanfaidh duine a bhfuil ábhar truailliúcháin nó eisilteach trádála nó eisilteach séarachta ina choimeád nó faoina rialú dul amach nó scardadh den chineál a dúradh a chur faoi deara nó a cheadú, a cheangal ar an duine aon ghníomh sonraithe a dhéanamh nó staonadh óna dhéanamh nó éirí as é a dhéanamh nó staonadh ó aon neamhghníomh sonraithe a dhéanamh nó éirí as é a dhéanamh,
(iv) d'fhonn an t-éalú a dúradh a chosc nó d'fhonn tarlú leanúnach nó atarlú an éalaithe sin a chosc, a cheangal ar áititheoir an áitribh sin a dúradh bearta sonraithe a dhéanamh agus, d'fhonn aon bhaol go dtarlóidh éalú den sórt sin a sheachaint, a cheangal ar an áititheoir aon ghníomh sonraithe a dhéanamh nó staonadh óna dhéanamh nó éirí as é a dhéanamh nó staonadh ó aon neamhghníomh sonraithe a dhéanamh nó éirí as é a dhéanamh, agus
(v) cibé foráil eile a dhéanamh is dóigh leis an gCúirt is cuí.
(1A) Féadfar iarratas a dhéanamh faoi fho-alt (1) d'ainneoin nár tionscnaíodh ionchúiseamh faoi alt 3 nó 4 maidir leis an dul amach nó an scardadh iomchuí dá dtagraítear i bhfo-alt (1).”.

9.—Leasaítear leis seo alt 12 den Phríomh-Acht—
(a) tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (2):
“(2A) D'ainneoin fho-alt (2), féadfar, le fógra faoin bhfo-alt seo, i dteannta nó in ionad an fo-alt sin a chomhlíonadh—
(a) seoladh aon ghníomhaíochta, cleachtais nó úsáid áitribh a mbeadh de thoradh air, i dtuairim an údaráis áitiúil lena mbaineann, ábhar truailliúcháin do dhul amach in uiscí, a rialáil nó a shrianadh i cibé slí agus go feadh cibé méid agus go ceann cibé tréimhse a bheidh sonraithe san fhógra nó an seoladh sin a chur faoi réir coinníollacha sonraithe, agus
(b) a cheangal go soláthrófar, go n-athlonnófar nó go n-athrófar saoráidí chun ábhar truailliúcháin a bhailiú nó a stóráil.”, agus
(b) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (3)—
“(3) Féadfaidh duine ar ar seirbheáladh fógra faoin alt seo uiríll i scríbhinn a dhéanamh chun an údaráis áitiúil lena mbaineann maidir le téarmaí an fhógra laistigh de cibé tréimhse a bheidh sonraithe san fhógra agus féadfaidh an t-údarás, tar éis aon uiríll den sórt sin a bhreithniú, aon fhoráil san fhógra (lena n-áirítear an fhoráil a bhaineann le fo-alt (2) (c)) a leasú nó féadfaidh sé an fógra a dhaingniú nó a chúlghairm agus cuirfidh sé in iúl don duine go bhfuil an leasú, an daingniú nó an chúlghairm sin déanta.”.
Cumhacht údaráis áitiúil truailliú a chosc agus a laghdú.
10.—Cuirfear an t-alt seo a leanas in ionad alt 13 den Phríomh-Acht:
“13.—(1) I gcás ar dealraitheach d'údarás áitiúil nó d'údarás sláintíochta gur gá déanamh amhlaidh—
(a) chun ábhar truailliúcháin a chosc ar dhul amach in aon uiscí nó go dtí aon silteán nó séarach atá curtha ar fáil chun uisce báistí ina limistéar feidhmiúcháin a ghlacadh nó a dhiúscairt, agus chuige sin amháin,
(b) chun ábhar truailliúcháin a bhaint as aon uiscí, silteán nó séarach den sórt sin,
(c) chun ábhar truailliúcháin in uiscí lasmuigh dá limistéar feidhmiúcháin a chosc ar an limistéar sin, nó ar aon trá mhara (de réir bhrí an Achta Imeall Trágha, 1933) atá tadhlach leis an limistéar sin, a dhochrú, nó
(d) chun iarmhairtí aon ábhair truailliúcháin in aon uiscí. silteán nó séarach den chineál a dúradh a mhaolú nó a leigheas i ndáil lena limistéar feidhmiúcháin nó le haon trá mhara den chineál a dúradh,
féadfaidh sé cibé bearta a dhéanamh (lena n-áirítear cúnamh a thabhairt, cibé acu cúnamh airgid nó cúnamh eile, do dhaoine eile agus a chur faoi deara do dhaoine eile bearta a dhéanamh) is dóigh leis is cuí chun na gcríoch sin agus féadfaidh sé aon ábhar truailliúcháin den sórt sin a dhiúscairt i cibé slí a mheasfaidh sé is iomchuí.
(2) Sa mhéid (más aon mhéid é) gurbh iad gníomhartha nó neamhghníomhartha duine (ba ghníomhartha nó neamhghníomhartha ar chóir le réasún don duine a shamhlú go dtabharfaidís nó go bhféadfaidís a thabhairt ar an údarás na bearta a dhéanamh) a thug ar údarás áitiúil nó ar údarás sláintíochta aon bhearta a dhéanamh faoin alt seo, féadfaidh an t-údarás an caiteachas a thabhaigh an t-údarás i ndáil leis na bearta a ghnóthú ón duine mar fhiach conartha shimplí in aon chúirt dlínse inniúla.”.

11.—Leasaítear leis seo alt 15 den Phríomh-Acht—
(a) trí na fo-ailt seo a leanas a chur in ionad fho-alt (3):
“(3) Féadfaidh dhá údarás áitiúla nó níos mó, i gcomhpháirt, plean bainistithe cáilíochta uisce a dhéanamh i ndáil le huiscí a bhfuil cuid díobh i limistéar feidhmiúcháin gach údaráis áitiúil acu nó tadhlach leis.
(3A) Féadfaidh an t-údarás áitiúil nó na húdaráis áitiúla a rinne plean bainistithe cáilíochta uisce é a athchóiriú nó plean eile a chur ina ionad.”, agus
(b) tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (6):
“(6) A luaithe is féidir tar éis plean faoin alt seo a dhéanamh nó a athchóiriú nó tar éis plean eile a chur ina ionad, déanfaidh an t-údarás áitiúil áirithe cóip den phlean arna dhéanamh nó arna athchóiriú amhlaidh, nó cóip den phlean a cuireadh ina ionad, a thabhairt don Aire agus d'Aire na Mara agus d'aon údarás áitiúil, údarás sláintíochta nó bord réigiúnach a bhfuil a limistéar feidhmiúcháin tadhlach leis na huiscí lena mbaineann an plean nó a ndéanfadh comhlíonadh a fheidhmeanna difear d'fheidhmiú an phlean nó a ndéanfadh feidhmiú an phlean difear do chomhlíonadh a fheidhmeanna.”.

12.—Leasaítear leis seo alt 16 den Phríomh-Acht—
(a) tríd an mír seo a leanas a chur in ionad mhír (b) d'fho-alt (4):
“(b) socrú a dhéanamh go n-íocfaidh sealbhóir an cheadúnais leis an údarás sláintíochta áirithe cibé méid nó méideanna a chinnfidh an t-údarás sláintíochta ag féachaint don chaiteachas a thabhaigh nó a thabhóidh sé i ndáil le faireachán, cóireáil agus diúscairt a dhéanamh ar eisilteach trádála, eisilteach séarachta agus ábhar eile a scardtar amach i séaraigh ina limistéar feidhmiúcháin nó i gcuid shonraithe dá limistéar feidhmiúcháin.”, agus
(b) tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (13):
“(13A) I gcás nach gcomhlíonfar fógra faoin alt seo, beidh an duine ar ar seirbheáladh é ciontach i gcion agus dlífear ar é a chiontú go hachomair fíneáil nach mó ná £1,000, nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air.”.

13.—Leasaítear leis seo alt 17 den Phríomh-Acht—
(a) trí na fo-ailt seo a leanas a chur in ionad fho-ailt (2) agus (3):
“(2) D'ainneoin aon fhorála eile den Acht seo nó aon choinníll i gceadúnas faoi alt 16, féadfaidh an t-údarás sláintíochta a dheonaigh aon cheadúnas den sórt sin é a athbhreithniú tráth ar bith más rud é—
(a) go mbeidh forais réasúnacha ag an údarás sláintíochta chun a chreidiúint go bhfuil an scardadh a údaraítear leis an gceadúnas, nó gur dóigh dó a bheith, dochrach do shláinte an phobail nó go ndéanann sé na huiscí a scardann an séarach áirithe amach iontu, nó gur dóigh dó iad a dhéanamh, neamhoiriúnach d'úsáidí tís, tráchtála, tionscail, iascaigh (lena n-áirítear feirmeoireacht éisc), talmhaíochta nó áineasa,
(b) go mbeidh athrú ábhartha tagtha ar nádúr nó ar thoilleadh an scardaidh,
(c) go mbeidh athrú ábhartha ann i ndáil leis na huiscí a bhfuil an séarach lena mbaineann ag scardadh amach iontu,
(d) go bhfuil faisnéis bhreise ar fáil, ón dáta ar ar deonaíodh an ceadúnas, i ndáil le hábhar truailliúcháin atá sa scardadh lena mbaineann nó i ndáil le hiarmhairtí an ábhair sin, nó
(e) go ndéanfaidh an ceadúnaí iarratas chuig an údarás sláintíochta lena mbaineann chun an ceadúnas a athbhreithniú.
(2A) D'ainneoin aon fhorála eile den Acht seo nó aon choinníll i gceadúnas faoi alt 16, i gcás rialacháin a bheith i bhfeidhm faoi alt 26 a bhaineann le heisilteach trádála nó eisilteach séarachta as séarach nó le huiscí a scardann séarach amach iontu, déanfaidh an t-údarás áitiúil a dheonaigh ceadúnas den sórt sin a bhaineann leis an eisilteach trádála nó a údaraíonn eisilteach trádála a scardadh amach i séarach, an ceadúnas sin a athbhreithniú—
(a) i gcás ina raibh sé i bhfeidhm roimh thosach feidhme na rialachán, a luaithe is féidir tar éis an tosach feidhme sin agus, dá éis sin, i gceann cibé tréimhsí a bheidh sonraithe sna rialacháin, agus
(b) in aon chás eile, i gceann cibé tréimhsí a bheidh sonraithe sna rialacháin.
(3) Ar athbhreithniú faoin alt seo a bheith críochnaithe, féadfaidh údarás sláintíochta aon choinníoll de chuid an cheadúnais a leasú nó a scriosadh, nó coinníollacha nó coinníollacha breise a chur ag gabháil leis an gceadúnas, nó an ceadúnas a chúlghairm; agus má bheartaíonn údarás sláintíochta cumhacht mar a dúradh a fheidhmiú, déanfaidh sé amhlaidh a luaithe is féidir tar éis dó an t-athbhreithniú iomchuí faoin alt seo a chríochnú.”,

(i) táillí de cibé méideanna a bheidh sonraithe sna rialacháin i ndáil le hathbhreithnithe ar cheadúnais a íoc le húdaráis sláintíochta,
(ii) íoc táillí de mhéideanna éagsúla i leith aicmí éagsúla d'athbhreithnithe den sórt sin mar a dúradh,
(iii) díolúine ó íoc na dtáillí sin i cibé imthosca a bheidh sonraithe,
(iv) na táillí sin a tharscaoileadh, a loghadh nó a aisíoc (go hiomlán nó go páirteach) i cibé imthosca a bheidh sonraithe, nó
(v) an modh ina bhféadfar táillí a dhiúscairt.”,
agus
(c) tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (4):
“(5) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha le húdarás sláintíochta ní sheolfaidh an t-údarás sláintíochta an t-athbhreithniú a bhfuil an táille iníochta i ndáil leis go dtí go mbeidh sí faighte ag an údarás sláintíochta.”,

14.—Leasaítear leis seo alt 19 den Phríomh-Acht trí na fo-ailt seo a leanas a chur isteach i ndiaidh fho-alt (2):
“(2A) Féadfaidh rialacháin faoin alt seo foráil a dhéanamh do na nithe seo a leanas—
(a) táille de cibé méid a bheidh sonraithe a íoc le húdarás sláintíochta maidir le hiarratas chuige ar cheadúnas faoi alt 16, agus
(b) táille de cibé méid a bheidh sonraithe a íoc leis an mBord Pleanála maidir le hachomharc chuige faoi alt 20,
agus féadfaidh aon rialacháin den sórt sin foráil a dhéanamh do na nithe seo a leanas—
(i) íoc táillí de mhéideanna éagsúla maidir le haicmí éagsúla d'iarratais agus d'achomhairc den sórt sin a dúradh,
(ii) díolúine ó íoc táillí dá bhforáiltear faoi mhír (a) nó (b) i cibé imthosca a bheidh sonraithe,
(iii) aon táillí den sórt sin a tharscaoileadh, a loghadh nó a aisíoc (go hiomlán nó go páirteach) i cibé imthosca a bheidh sonraithe, agus

(2B) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha le húdarás sláintíochta i leith iarratas ar cheadúnas faoi alt 16, ní bhreithneoidh an t-údarás sláintíochta an t-iarratas mura bhfaighidh an t-údarás sláintíochta an táille.
(2C) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha leis an mBord Pleanála i leith achomhairc faoi alt 20, ní thabharfar aird ar an achomharc mura bhfaighidh an Bord Pleanála an táille roimh dheireadh na tréimhse forordaithe dá dtagraítear i bhfo-alt (1) den alt sin.
(2D) Más rud é, de bhun rialachán faoin alt seo, go mbeidh táille iníoctha leis an mBord Pleanála i leith iarrata go dtabharfaí éisteacht ó bhéal d'achomarc, ní bhreithneoidh an Bord Pleanála an iarraidh mura bhfaighidh an Bord Pleanála an táille.”.
Achomhairc i ndáil le hailt 16 agus 17 den Phríomh-Acht.
15.—(1) Cuirfear an t-alt seo a leanas in ionad alt 20 den Phríomh-Acht:
“20.—(1) (a) Féadfaidh áititheoir áitribh as a ndéantar scardadh lena mbaineann ceadúnas faoi alt 16 achomharc a dhéanamh chun an Bhoird Pleanála, roimh dheireadh cibé tréimhse a bheidh forordaithe, i ndáil le—
(i) cúlghairm an cheadúnais,
(ii) coinníollacha nó coinníollacha breise a chur ag gabháil leis an gceadúnas, nó
(iii) leasú nó scriosadh aon choinníll atá ag gabháil leis an gceadúnas,
ag údarás sláintíochta.
(b) Féadfaidh duine ar dhiúltaigh údarás sláintíochta d'iarratas uaidh ar cheadúnas faoi alt 16 achomharc a dhéanamh chun an Bhoird Pleanála, roimh dheireadh cibé tréimhse a bheidh forordaithe, i ndáil leis an diúltú.
(c) Beidh éifeacht le gníomh de chuid údaráis sláintíochta dá dtagraítear i mír (a) nó (b)—
(i) i gcás nach dtionscnaítear achomharc ina choinne, ar an tréimhse dá dtagraítear i mír (a) nó (b), de réir mar a bheidh, a bheith caite,
(ii) i gcás go dtionscnaítear achomharc ina choinne agus nach é cinneadh críochnaitheach an achomhairc an gníomh a chur ar ceal, ar an gcinneadh críochnaitheach sin a dhéanamh agus dá réir,
(iii) i gcás go dtionscnaítear achomharc ina choinne agus go dtarraingítear siar an t-achomharc, ar an achomharc a tharraingt siar.
(2) Tar éis don Bhord Pleanála achomharc faoin alt seo a bhreithniú, ceadóidh sé an t-achomharc nó diúltóidh sé dó, de réir mar is cuí leis, agus féadfaidh sé aon ordachán is dóigh leis is iomchuí, de dhroim an chinnidh atá déanta aige, a thabhairt don údarás sláintíochta lena mbaineann (lena n-áirítear ordachán á ordú go ndéanfar coinníoll sonraithe a chur ag gabháil leis an gceadúnas lena mbaineann nó a leasú nó a scriosadh) agus déanfaidh údarás sláintíochta de réir aon ordacháin den sórt sin.”.
(2) Aon achomhairc a bheidh tionscanta faoi alt 20 den Phríomh-Acht agus nach mbeidh cinnte go críochnaitheach ar thosach feidhme an ailt seo, leanfar leo agus cinnfear iad ionann is dá mbeidís tionscanta amhlaidh tar éis an tosach feidhme sin.
Forálacha i ndáil le hachomhairc faoi ailt 8 agus 20 den Phríomh-Acht.
16.—(1) Cuirfear an t-alt seo a leanas in ionad alt 21 den Phríomh-Acht:
“21.—(1) Féadfaidh an tAire, le rialacháin, foráil a dhéanamh—
(a) le haghaidh aon ní a bhaineann le nós imeachta i ndáil le hachomhairc faoi ailt 8 agus 20, agus
(b) le haghaidh cibé nithe teagmhasacha agus forlíontacha (lena n-áirítear modhnú aon fhorála de na hAchtanna Rialtais Áitiúil (Truailliú Uisce), 1977 agus 1990, agus de na hAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 go 1983) is dóigh leis an Aire is gá nó is fóirsteanach chun críche na n-achomharc sin.
(2) Beidh éifeacht le hailt 6 (2) (d), 19 (2) (d) agus fo-ailt (1) (a) agus (9) d'alt 28, maidir le hachomhairc den chineál a dúradh, ionann is dá mba thagairtí don Bhord Pleanála na tagairtí iontu don Aire.”.
(2) Leanfaidh an tOrdú um an Acht Rialtais Áitiúil (Truailliú Uisce), 1977 (Aistriú Achomharc), 1978 (seachas Airteagal 4) (is ordú a rinneadh faoi alt 21 den Phríomh-Acht) de bheith i bhfeidhm agus féadfaidh an tAire é a leasú nó a chúlghairm le hordú.

17.—Cuirfear an t-alt seo a leanas in ionad alt 23 den Phríomh-Acht:
“23.—(1) Féadfaidh údarás áitiúil, chun críocha a fheidhmeanna faoin Acht seo, trí fhógra i scríbhinn a thabhairt do dhuine, nó a sheirbheáil ar dhuine—
(a) a thógann uisce as aon uiscí i limistéar feidhmiúcháin an údaráis,
(b) a scardann, nó a chuireann faoi deara nó a cheadaíonn go scardtar, eisilteach trádála nó eisilteach séarachta nó ábhar eile amach in aon uiscí den sórt sin,
(c) a bhfuil aon ábhar truailliúcháin ina limistéar feidhmiúcháin ina choimeád nó faoina rialú,
(d) atá ag gabháil do ghníomhaíochtaí nó do chleachtais a fhéadfaidh, i dtuairim an údaráis áitiúil, a chur faoi deara nó a cheadú ábhar truailliúcháin do dhul amach in uiscí,
a cheangal ar an duine cibé sonraí a bheidh sonraithe san fhógra i ndáil le haon cheann de na gníomhaíochtaí nó de na cleachtais a dúradh (lena n-áirítear coimeád nó rialú ábhair truailliúcháin) agus cibé faisnéis eile (más ann) is dóigh leis an údarás áitiúil is gá chun críocha na bhfeidhmeanna sin, a thabhairt i scríbhinn don údarás áitiúil laistigh de cibé tréimhse (nach giorra ná 14 lá), dar tosach an dáta a thabharfar nó a sheirbheálfar an fógra, a bheidh sonraithe san fhógra.
(2) Féadfaidh údarás sláintíochta, chun críocha a fheidhmeanna faoin Acht seo, trí fhógra i scríbhinn a thabhairt do dhuine nó a sheirbheáil air, a cheangal ar an duine a bhfuil scardadh chun séaraigh á dhéanamh aige, nó atá á chur sin faoi deara nó á cheadú, cibé sonraí i ndáil leis an scardadh a bheidh sonraithe san fhógra agus cibé faisnéis eile (más ann) is dóigh leis an údarás sláintíochta is gá chun críocha na bhfeidhmeanna sin, a thabhairt i scríbhinn don údarás sláintíochta laistigh de cibé tréimhse (nach giorra ná 14 lá), dar tosach an dáta a thabharfar nó a sheirbheálfar an fógra, a bheidh sonraithe san fhógra.
(3) Gan dochar do ghinearáltacht fho-ailt (1) agus (2), féadfar, le fógra faoi cheachtar de na fo-ailt sin a bhaineann le heisilteach trádála, le heisilteach séarachta nó le hábhar truailliúcháin eile, a cheangal ar an duine dá dtugtar é nó ar a seirbheáiltear é na nithe seo a leanas a thabhairt don údarás áitiúil nó, de réir mar a bheidh, don údarás sláintíochta, lena mbaineann, eadhon—

agus a thaispeánann a gcoibhneas le haon uiscí, agus
(b) cibé sonraí eile a bheidh sonraithe san fhógra i dtaobh na nithe a dúradh, lena n-áirítear sonraí maidir leis na comhshocruithe, na córais agus na modhanna atá in úsáid nó a bheartaítear a úsáid chun an t-eisilteach nó an t-ábhar truailliúcháin eile a dhiúscairt, agus maidir leis na tráthanna agus na rátaí ag a ndéantar an diúscairt sin.
(4) Aon duine—
(a) a mhainneoidh nó a dhiúltóidh déanamh de réir ceanglais i bhfógra faoin alt seo, nó
(b) a dhéanann, i gcomhlíonadh airbheartaithe ceanglais den sórt sin, faisnéis is eol dó a bheith bréagach nó a bheith míthreorach i bponc ábhartha a thabhairt d'údarás áitiúil nó d'údarás sláintíochta,

18.—Leasaítear leis seo alt 26 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (3):
“(4) (a) Féadfaidh rialacháin faoin alt seo a cheangal ar dhaoine cibé bearta a bheidh sonraithe sna rialacháin a dhéanamh chun a áirithiú go gcomhlíonfar caighdeáin cháilíochta a bheidh forordaithe faoi fho-alt (1) agus féadfaidh cibé forálacha teagmhasacha, forlíontacha agus iarmhartacha a bheith iontu is dóigh leis an Aire is gá nó is fóirsteanach chun críche na rialachán (lena n-áirítear forálacha ag modhnú aon fhorála de na hAchtanna Rialtais Áitiúil (Truailliú Uisce), 1977 agus 1990).
(b) I gcás ina mbeartaítear rialacháin ag modhnú forála den Acht seo a dhéanamh faoin alt seo, leagfar dréacht de na rialacháin faoi bhráid gach Tí den Oireachtas agus ní dhéanfar na rialacháin go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach acu sin.”.
Leasú ar alt 28 den Phríomh-Acht.
19.—Leasaítear leis seo alt 28 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (3):
“(3A) (a) Más rud é, maidir le duine údaraithe atá in áitreabh nó i soitheach de bhun na gcumhachtaí a thugtar leis an alt seo, go gcreidfidh sé le réasún go bhfuil cion faoi alt 3 (1), 4 (1) nó 16 (1) den Acht seo nó alt 21 (3) den Acht Rialtais Áitiúil (Truailliú Uisce) (Leasú), 1990, á dhéanamh nó déanta i ndáil leis an áitreabh nó leis an soitheach, féadfaidh sé a iarraidh ar aon duine a gheobhaidh sé san áitreabh nó sa soitheach a ainm agus a sheoladh a thabhairt dó, mar aon le tuairisc ar a shlí bheatha agus na feidhmeanna agus na freagrachtaí atá aige i ndáil leis an áitreabh nó leis an soitheach, de réir mar a bheidh, agus aon fhiontar atá á sheoladh san áitreabh nó sa soitheach agus (a mhéid atá siad ar eolas aige) ainm agus seoladh áititheoir an áitribh, úinéir an tsoithigh agus an duine atá i bhfeighil an áitribh nó an tsoithigh.
(b) Aon duine a mhainneoidh nó a dhiúltóidh déanamh de réir iarrata faoin bhfo-alt seo nó a thugann, de bhun iarrata den sórt sin, faisnéis atá bréagach nó míthreorach do dhuine údaraithe, beidh sé ciontach i gcion agus dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air.”.
Dliteanas sibhialta i leith truailliú.
20.—(1) I gcás ina rachaidh eisilteach trádála, eisilteach séarachta nó ábhar truailliúcháin eile amach in uiscí agus gur trúig díobhála, caillteanais nó damáiste é do dhuine nó do mhaoin duine, féadfaidh an duine, gan dochar d'aon chúis chaingne eile a bheidh aige i leith na díobhála, an chaillteanais nó an damáiste, damáistí a ghnóthú in aon chúirt dlínse inniúla i leith na díobhála, an chaillteanais nó an damáiste sin—
(a) ó áititheoir an áitribh ónar tháinig an t-eisilteach nó an t-ábhar i dtosach, murarbh é ba chúis leis an dul amach sna huiscí foiche Dé nó gníomh nó neamhghníomh de chuid tríú páirtí nach raibh rialú ag an áititheoir sin ar a chuid iompair, ar ghníomh nó neamhghníomh é nárbh fhéidir leis an áititheoir sin, le réasún, a shamhlú agus cosaint a dhéanamh ina aghaidh, nó
(b) má ba é ba chionsiocair leis an dul amach sna huiscí gníomh nó neamhghníomh de chuid aon duine ar sárú é. i dtuairim na cúirte, ar thaobh an duine sin ar aon fhoráil den Phríomh-Acht nó den Acht seo, ón duine sin.
(2) Ní bhaineann fo-alt (1) le heisilteach trádála, eisilteach séarachta nó ábhar truailliúcháin eile do dhul amach in uiscí de bhua aon ní atá sonraithe in alt 3 (5) den Phríomh-Acht nó faoi réim agus de réir ceadúnais faoi alt 4 den Phríomh-Acht nó alt 171 d'Acht 1959.
Gníomhaíochtaí talmhaíochta áirithe a rialáil agus a thoirmeasc.
21.—(1) San alt seo ciallaíonn “gníomhaíocht” aon ní amháin nó níos mó díobh seo a leanas:
(a) bailiú, stóráil, cóireáil agus diúscairt aon ábhair truailliúcháin a úsáidtear i dtaca le haon oibríocht, gníomhaíocht, cleachtas nó úsáid talún nó áitribh eile a sheoltar chun críocha talmhaíochta, gairneoireachta nó foraoiseachta, nó dá mbarr sin;
(b) aon ghníomhaíocht ar cuid de aon eisilteach sadhlais, sciodar ainmhíoch, aoileach, leasachán, lotnaidicíd nó ábhar truailliúcháin eile a chur ar thalamh nó ar bharraí fáis nó a instealladh isteach sa talamh;
(c) aon oibríocht, gníomhaíocht nó cleachtas eile, nó aon úsáid eile talún nó áitribh eile, chun críocha talmhaíochta, gairneoireachta nó foraoiseachta.
(2) (a) Aon uair a mheasfaidh údarás áitiúil gur gá déanamh amhlaidh chun ábhar truailliúcháin a chosc ar dhul amach in uiscí nó chun deireadh a chur le dul amach den sórt sin, féadfaidh sé fodhlíthe a dhéanamh á thoirmeasc gníomhaíocht shonraithe a sheoladh i ngach cuid nó i gcuid shonraithe dá limistéar feidhmiúcháin nó á shocrú go rialálfar seoladh gníomhaíochta sonraithe i ngach cuid nó i gcuid shonraithe dá limistéar feidhmiúcháin.
(b) Aon uair a mheasfaidh an tAire gur gá déanamh amhlaidh chun ábhar truailliúcháin a chosc ar dhul amach in uiscí nó chun deireadh a chur le dul amach den sórt sin, féadfaidh an tAire a ordú d'údarás áitiúil fodhlíthe a dhéanamh á thoirmeasc gníomhaíocht shonraithe a sheoladh i limistéar feidhmiúcháin an údaráis nó i gcuid shonraithe den limistéar sin nó á shocrú go rialálfar, i cibé slí a shonróidh an tAire, seoladh gníomhaíochta sonraithe i limistéar feidhmiúcháin an údaráis nó i gcuid shonraithe den limistéar feidhmiúcháin sin agus déanfaidh an t-údarás áitiúil de réir an ordacháin.
(c) Gan dochar do ghinearáltacht mhíreanna (a) agus (b) féadfar a shonrú, i bhfodhlíthe faoin bhfo-alt seo, an modh ina bhféadfar, na coinníollacha ar faoina réir a fhéadfar, na tráthanna ag a bhféadfar agus na himthosca ina bhféadfar gníomhaíocht a sheoladh agus féadfaidh na fodhlíthe sin srianta, rialuithe agus ceanglais a fhorchur i ndáil leis an ngníomhaíocht a sheoladh agus féadfaidh na fodhlíthe forálacha éagsúla a dhéanamh i ndáil le limistéir éagsúla, codanna éagsúla de limistéir, gníomhaíochtaí éagsúla agus imthosca éagsúla.
(d) Féadfaidh fodhlíthe faoin bhfo-alt seo socrú a dhéanamh le haghaidh cibé forálacha teagmhasacha, forlíontacha agus iarmhartacha is dóigh leis an údarás áitiúil, a dhéanfaidh na fodhlíthe, is gá nó is fóirsteanach chun críocha na bhfodhlíthe nó chun críocha fheidhmeanna an údaráis faoin alt seo.
(e) Beidh fodhlíthe faoin bhfo-alt seo faoi réir cheadú an Aire.
(3) (a) Beidh duine a sháróidh nó nach gcomhlíonfaidh fodhlíthe faoi fho-alt (2) ciontach i gcion.
(b) Aon duine a bheidh ciontach i gcion faoin bhfo-alt seo dlífear—
(i) ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air, nó
(ii) más é atá sa chion sárú fodhlí, nó mainneachtain déanamh de réir fodhlí, a thoirmisceann gníomhaíocht shonraithe a sheoladh nó a bhaineann le ní dá dtagraítear i bhfo-alt (2) (c), ar é a chiontú ar díotáil, fíneáil nach mó ná £25,000 nó príosúnacht ar feadh téarma nach faide ná 5 bliana, nó iad araon, a chur air.
(4) I gcás ina mbeartaíonn údarás áitiúil fodhlíthe a dhéanamh faoi mhír (a) nó (b) d'fho-alt (2)—
(a) déanfaidh sé fógra faoina bhfuil beartaithe aige, faoin limistéar a mbeidh feidhm ag na fodhlíthe beartaithe maidir leis agus faoin áit ar féidir, agus an tréimhse ar féidir lena linn, cóipeanna de na fodhlíthe beartaithe a iniúchadh agus a cheannach, a fhoilsiú i nuachtán amháin ar a laghad a léitear sa limistéar sin,
(b) beidh ráiteas san fhógra a fhoilseofar de bhun mhír (a) á rá go bhféadfaidh aon duine arb éagóir leis na fodhlíthe beartaithe úiríll i scribhinn a dhéanamh chun an Aire i ndáil leo laistigh den tréimhse a bheidh sonraithe san fhógra,
(c) taiscfidh sé cóipeanna de na fodhlíthe beartaithe ina chuid oifigí, agus cuirfear ar fáil ansin iad lena n-iniúchadh agus lena gceannach ag daoine den phobal gach uile thráth réasúnach le linn na tréimhse a bheidh sonraithe san fhógra faoi mhír (a),
(d) féadfaidh aon duine arb éagóir leis na fodhlíthe beartaithe uiríll i scríbhinn a dhéanamh chun an Aire i ndáil leo laistigh de cibé tréimhse a bheidh sonraithe san fhógra (is tréimhse nach giorra ná 30 lá ón dáta is déanaí a fhoilsítear an fógra de bhun mhír (a)),
(e) breithneoidh an tAire aon uiríll a bheidh déanta go cuí faoi mhír (d) sula gcinnfidh sé ar a cheadú a thabhairt, nó ar dhiúltú é a thabhairt, le haghaidh na bhfodhlíthe beartaithe,
(f) féadfaidh an tAire a ordú don údarás leasuithe sonraithe a dhéanamh ar na fodhlíthe beartaithe agus, má dhéanann sé amhlaidh, measfar míreanna (a) go (e) a bheith comhlíonta i ndáil leis na fodhlíthe arna leasú de réir an ordacháin,
(g) más rud é, ag deireadh na tréimhse 6 mhí ón dáta is déanaí ar ar féidir uiríll a dhéanamh chun an Aire faoi mhír (d) i ndáil leis na fodhlíthe beartaithe, nach mbeidh cinneadh tugtha ag an Aire faoi mhír (e) agus nach mbeidh ordachán tugtha aige i ndáil leo faoi mhír (f), measfar ceadú a bheith tugtha ag an Aire le haghaidh na bhfodhlíthe beartaithe faoi mhír (e),
(h) foilseofar na fodhlíthe san Iris Oifigiúil a luaithe is féidir tar éis a ndéanta agus déanfar fógra faoina ndéanamh, faoin limistéar a bhfuil feidhm acu maidir leis, agus faoin áit inar féidir cóipeanna díobh a cheannach nó a iniúchadh, a fhoilsiú i nuachtán amháin ar a laghad a léitear sa limistéar lena mbaineann siad.
(5) Chun críocha fheidhm alt 28 den Phríomh-Acht i ndáil leis an alt seo, déanfar an tagairt i bhfo-alt (1) (c) den alt sin do rialacháin faoin bPríomh-Acht a fhorléiriú mar thagairt a fholaíonn tagairt d'fhodhlíthe faoin alt seo.
Cumhacht chun a dhearbhú gur séaraigh iad comhshilteáin chun críocha áirithe.
22.—(1) Féadfaidh údarás sláintíochta a dhearbhú le hordú go dtiocfaidh comhshilteán sonraithe chun bheith, agus go mbeidh sé, ina shéarach chun críocha an Phríomh-Achta agus an Achta seo agus, aon uair a dhéanfaidh sé amhlaidh, tiocfaidh an silteán lena mbaineann chun bheith agus beidh sé, ar thosach feidhme an ordaithe lena mbaineann, ina shéarach chun na gcríoch sin.
(2) Aon uair a bheartóidh údarás sláintíochta ordú a dhéanamh faoi fho-alt (1) i ndáil le comhshilteán—
(a) déanfaidh sé, 30 lá ar a laghad roimh dháta déanta an ordaithe, fógra i scríbhinn á rá go bhfuil beartaithe aige an t-ordú a dhéanamh a thabhairt d'úinéir an tsilteáin agus d'áititheoir gach áitribh a bhfuil eisilteach trádála nó eisilteach séarachta á scardadh amach as chun an tsilteáin, agus
(b) féadfaidh úinéir an tsilteáin nó áititheoir den chineál a dúradh, laistigh de 30 lá ón dáta a tugadh an fógra a dúradh dó, uiríll i scríbhinn a dhéanamh chun an údaráis sláintíochta i ndáil leis an ordú a dhéanamh agus, sula gcinnfidh an t-údarás cé acu ar chóir an t-ordú a dhéanamh, cuirfidh an t-údarás i gcuntas aon uiríll a bheidh déanta ag an úinéir nó ag an áititheoir.
(3) Tiocfaidh ordú faoi fho-alt (1) i ngníomh ar cibé dáta (is dáta nach luaithe ná 6 mhí tar éis dháta a dhéanta) a bheidh sonraithe ann.
(4) Déanfar, laistigh de 10 lá tar éis dháta a dhéanta, cóipeanna d'ordú faoi fho-alt (1) a thaisceadh agus a chur ar fáil lena n-iniúchadh agus lena gceannach in oifigí an údaráis sláintíochta a rinne é agus tabharfar cóip den ordú d'úinéir an tsilteáin lena mbaineann agus do gach áititheoir den chineál a dúradh, nó seirbheálfar air é, laistigh den tréimhse a dúradh.
(5) I gcas ina ndéanfadh údarás sláintíochta ordú faoi fho-alt (1)—
(a) déanfaidh áititheoir gach áitribh, a bhfuil eisilteach trádála nó eisilteach séarachta á scardadh amach as chun an tsilteáin lena mbaineann díreach tar éis an t-ordú a dhéanamh, iarratas chun an údaráis, laistigh de 6 mhí tar éis an t-ordú a dhéanamh, ar cheadúnas faoi alt 16 den Phríomh-Acht maidir leis an scardadh,
(b) maidir le haon áititheoir dá dtagraítear i mír (a) a dhéanfaidh iarratas go cuí, de bhun na míre sin, ar cheadúnas faoi alt 16 den Phríomh-Acht agus a sholáthróidh aon fhaisnéis a bheidh ag teastáil go cuí ón údarás sláintíochta áirithe i ndáil leis an iarratas, measfar nach mbeidh alt 16 (1) den Phríomh-Acht sáraithe aige sa tréimhse ó thosach feidhme an ordaithe go dtí go ndeonófar an ceadúnas nó, de réir mar a bheidh, go dtí go mbeidh mí amháin caite ó diúltaíodh an ceadúnas a dheonú, maidir le haon scardadh chun an tsilteáin áirithe arb ionann dó maidir lena nádúr, lena chomhdhéanamh, lena theocht agus lena thoilleadh, agus a dhéantar, le linn na tréimhse sin, de réir ráta arb ionann dó agus don scardadh dá dtagraítear i mír (a) a rinneadh le linn na tréimhse comhréire roimh an tosach feidhme sin; agus, in aon ionchúiseamh mar gheall ar chion faoin alt sin 16, toimhdeofar go dtí go suífear a mhalairt nach scardadh lena mbaineann an mhír seo an scardadh áirithe sin,
(c) scoirfidh ceadúnas faoi alt 4 nó 16 den Phríomh-Acht a bhaineann le heisilteach trádála nó eisilteach séarachta a scardadh amach as an silteán go dtí uiscí nó séarach, de réir mar a bheidh, d'éifeacht a bheith leis ar thosach feidhme an ordaithe.
(6) Aon doiciméad a airbheartaíonn gur cóip é d'ordú faoi fho-alt (1) agus go bhfuil sé deimhnithe ag oifigeach don údarás sláintíochta a rinne an t-ordú mar chóip dhílis den ordú, beidh sé inghlactha in aon imeachtaí mar fhianaise ar an ordú.
(7) Féadfaidh údarás sláintíochta, le hordú, ordú a rinne sé faoin alt seo a leasú nó a chúlghairm.
(8) San alt seo ní fholaíonn “eisilteach séarachta” séaracht tís atá á scardadh go dtí comhshilteán agus as an gcomhshilteán go dtí séarach.
(9) Féadfaidh ordú faoi fho-alt (1) baint a bheith aige le cuid shonraithe de chomhshilteán sonraithe agus leis an gcuid sin amháin, agus déanfar tagairtí sna fo-ailt roimhe seo den alt seo do chomhshilteán a fhorléiriú dá réir sin.
Cionta faoin bPríomh-Acht agus faoin Acht seo ag stiúrthóirí, etc. de chuid comhlachtaí corpraithe.
23.—(1) I gcás cion faoin bPríomh-Acht nó faoin Acht seo a bheith déanta ag comhlacht corpraithe agus go gcruthófar go ndearnadh é le toiliú nó le cúlcheadú, nó gurb inchurtha é i leith aon fhaillí ar thaobh, aon duine is stiúrthóir, bainisteoir, rúnaí nó oifigeach eile de chuid an chomhlachta chorpraithe sin, nó aon duine a d'airbheartaigh bheith ag gníomhú in aon cháil den sórt sin, beidh an duine sin freisin ciontach i gcion agus dlífear imeachtaí a shaothrú ina choinne agus é a phionósú ionann is dá mbeadh sé ciontach sa chion céadluaite.
(2) I gcás gnóthaí comhlachta chorpraithe a bheith á mbainistiú ag a chomhaltaí, beidh feidhm ag fo-alt (1) i ndáil le gníomhartha agus le mainneachtana comhalta i dtaca lena fheidhmeanna bainisteoireachta ionann is dá mba stiúrthóir nó bainisteoir de chuid an chomhlachta chorpraithe é.
Pionóis áirithe faoin bPríomh-Acht a mhéadú.
24.—(1) Aon duine a bheidh ciontach i gcion faoi alt 3, 4 nó 16 den Phríomh-Acht dlífear, in ionad an phionóis a shonraítear san alt lena mbaineann—
(a) ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air, nó
(b) ar é a chiontú ar díotáil, fíneáil nach mó ná £25,000 nó príosúnacht ar feadh téarma nach faide ná 5 bliana, nó iad araon, a chur air.
(2) Aon duine a bheidh ciontach i gcion faoi alt 6, 12, 19, 27 nó 28 (4) den Phríomh-Acht, dlífear ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air, in ionad an phionóis a shonraítear san alt lena mbaineann.
(3) Aon duine a bheidh ciontach i gcion faoi alt 14 den Phríomh-Acht dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 a chur air in ionad an phionóis a shonraítear san alt sin.
(4) Beidh éifeacht leis an alt seo maidir le cionta a dhéanfar tar éis thosach feidhme an ailt seo.
Forálacha i ndáil le cionta faoi ailt 171 agus 172 d'Acht 1959.
25.—Aon duine a bheidh ciontach i gcion faoi alt 171 nó 172 d'Acht 1959 a dhéanfar tar éis thosach feidhme an ailt seo dlífear, in ionad na bpionós a shonraítear in alt 50 den Acht Iascaigh, 1980—
(a) ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná 6 mhí, nó iad araon, a chur air, nó
(b) ar é a chiontú ar díotáil, fíneáil nach mó ná £25,000 nó príosúnacht ar feadh téarma nach faide ná 5 bliana, nó iad araon, a chur air.
Fíneálacha áirithe a íoc le húdaráis áitiúla, le húdaráis sláintíochta agus le boird réigiúnacha.
26.—I gcás ina bhforchuirfidh cúirt fíneáil, nó ina ndaingneoidh nó ina n-athróidh sí fíneáil a bheidh forchurtha ag cúirt eile, maidir le cion faoin bPríomh-Acht nó faoin Acht seo, arna ionchúiseamh ag údarás áitiúil, ag údarás sláintíochta nó ag bord réigiúnach, déanfaidh sí, ar iarratas ón údarás nó ón mbord lena mbaineann (a bheidh déanta roimh an bhforchur, an daingniú nó an athrú sin), a fhoráil le hordú go n-íocfar méid na fíneála leis an údarás nó leis an mbord, de réir mar a bheidh, agus féadfaidh an t-údarás nó an bord, de réir mar a bheidh, an íocaíocht sin a fhorfheidhmiú ionann is dá mbeadh sí dlite dó ar scór foraithne nó ordaithe arna dhéanamh ag an gcúirt in imeachtaí sibhialta.
Ionchúiseamh i gcionta áirithe.
27.—(a) Maidir le cion faoi aon alt den Phríomh-Acht a luaitear i gcolún (1) de Chuid I den Tábla a ghabhann leis an alt seo, féadfaidh aon duine a luaitear i gcolún (2) den Chuid sin I os coinne lua an ailt sa cholún sin (1), an cion sin a ionchúiseamh.
(b) Maidir le cion achomair faoi aon alt den Phríomh-Acht a luaitear i gcolún (1) de Chuid II den Tábla sin, féadfaidh aon duine a luaitear i gcolún (2) den Chuid sin II os coinne lua an ailt sa cholún sin (1) an cion sin a ionchúiseamh.
(c) Féadfaidh an t-údarás áitiúil áirithe cion achomair faoi alt 21 a ionchúiseamh.
(d) (i) D'ainneoin fhorálacha alt 10 (4) den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achoimre i leith ciona faoin bPríomh-Acht, faoin Acht seo nó faoi alt 171 nó 172 d'Acht 1959 a thosú tráth ar bith laistigh de 6 mhí ón dáta ar a dtagann fianaise is leor faoi chomhair na n-imeachtaí, i dtuairim an duine a thionscnaíonn na himeachtaí, ar iúl don duine sin:
Ar choinníoll nach dtionscnófar aon imeachtaí den sórt sin tráth nach déanaí ná 5 bliana ón dáta a ndearnadh an cion áirithe.
(ii) Chun críocha na míre seo, beidh deimhniú arna shíniú ag an duine nó thar ceann an duine a thionscnaíonn na himeachtaí, ag sonrú an dáta nó na ndátaí ar ar tháinig fianaise a bhaineann leis an gcion áirithe ar iúl dó, ina fhianaise prima facie maidir leis an dáta nó na dátaí sin agus, in aon imeachtaí dlí, aon doiciméad a airbheartaíonn gur deimhniú faoin mír seo é, agus a bheith sínithe amhlaidh, measfar é a bheith sínithe amhlaidh, agus glacfar i bhfianaise é gan cruthúnas ar shíniú an duine a airbheartaíonn an deimhniú a shíniú, mura suífear a mhalairt.

28.—I gcás ina gciontófar duine i gcion faoin bPríomh-Acht, faoin Acht seo nó faoi ailt 171 nó 172 d'Acht 1959 a rinneadh tar éis thosach feidhme an ailt seo, ordóidh an chúirt don duine sin, mura deimhin léi go bhfuil cúiseanna speisialta substaintiúla ann gan é sin a dhéanamh, na costais agus na caiteachais, arna dtomhas ag an gcúirt, a thabhaigh aon údarás áitiúil, údarás sláintíochta nó bord réigiúnach i ndáil le himscrúdú, brath agus ionchúiseamh an chiona, lena n-áirítear costais a tabhaíodh maidir le samplaí a thógáil, tástálacha, scrúduithe agus anailísí a sheoladh agus maidir le luach saothair agus caiteachais eile fostaithe, sainchomhairleoirí agus comhairleoirí, a íoc leis an údarás nó leis an mbord lena mbaineann.
An tAire do ghlacadh comhairle i ndáil le rialacháin a dhéanamh.
29.—(1) I gcás ina measann an tAire gur chóir, ag féachaint d'fheidhmeanna aon Aire den Rialtas, dul i gcomhairle leis an Aire sin den Rialtas i ndáil le rialacháin a dhéanamh faoi alt 4 (10), 16 (10), 24, 25 (1), 26 (1) nó 27 (1) den Phríomh-Acht, ní dhéanfaidh sé na rialacháin gan dul i gcomhairle leis an Aire sin den Rialtas.
(2) Scoirfidh an oiread sin de na hachtacháin a dúradh a fhorálann go rachfar i gcomhairle le daoine sonraithe i ndáil le rialacháin a dhéanamh, d'éifeacht a bheith leis.

30.—Aisghairtear leis seo alt 2, fo-ailt (4) agus (6) (seachas an Tábla) d'alt 3 agus ailt 4 (9), 6 (5), 12 (6), 14 (3), 16 (9), 19 (5), 27 (4), 28 (8), 31 agus 34 (c) den Phríomh-Acht.

31.—(1) Féadfar an tAcht Rialtais Áitiúil (Truailliú Uisce) (Leasú), 1990, a ghairm den Acht seo.
(2) Féadfar an tAcht Rialtais Áitiúil (Truailliú Uisce), 1977, agus an tAcht seo a fhorléiriú le chéile mar aon Acht amháin agus féadfar na hAchtanna Rialtais Áitiúil (Truailliú Uisce), 1977 agus 1990, a ghairm díobh le chéile.
(3) Déanfar na hAchtanna Iascaigh, 1959 go 1987, agus ailt 23, 25 agus 28 (a mhéid a bhaineann siad leis na hAchtanna sin) a fhorléiriú le chéile mar aon Acht amháin agus féadfar na hAchtanna Iascaigh, 1959 go 1990, a ghairm díobh le chéile.
(4) Tiocfaidh ailt 4, 5, 6, 13, 14, 15 agus 16 den Acht seo i ngníomh cibé lá nó laethanta a cheapfar le hordú nó le horduithe ón Aire, i gcoitinne nó faoi threoir críche nó forála áirithe, agus féadfar laethanta éagsúla a shocrú chun críoch éagsúil agus le haghaidh forálacha éagsúla de na hailt sin.
