ACHT OIFIGIGH CÚIRTE (CEAPACHÁIN SHEALADACHA), 1924.
Comhacht chun duine cheapa chun dualgaisí oifigí a luaidhtear sa Sceideal d'fheidhmiú.
1.—(1) Más folamh le linn rithte an Achta so aon oifig dá luaidhtear sa Sceideal don Acht so no má bhíonn sí folamh laistigh de dhá mhí dhéag tar éis rithte an Achta so, ansan agus in aon chás den tsórt san,
(a) Más san Aire a bheidh an chomhacht dílsithe do réir dlí chun duine do cheapa chun na hoifige folmha san, no mara mbeidh éinne ann go mbeidh comhacht aige chun duine do cheapa chun na hoifige folmha san, féadfidh an tAire aon uair laistigh de cheithre mhí dhéag tar éis rithte an Achta so, in ionad duine do cheapa chun na hoifige folmha san, duine oiriúnach go mbeidh aige na cáilíochta a horduítear (má orduítear aon cheann) le dlí i gcóir na hoifige sin do cheapa chun dualgaisí na hoifige sin d'fheidhmiú go sealadach, agus
(b) má bhíonn aon duine ann (seachas an tAire) go mbeidh comhacht aige chun duine do cheapa chun na hoifige folmha san, féadfidh an duine sin le toil an Aire, agus má orduíonn an tAire dho é déanfa sé, aon uair laistigh de cheithre mhí dhéag tar éis rithte an Achta so, in ionad duine do cheapa chun na hoifige folmha san, duine oiriúnach go mbeidh aige na cáilíochta a horduítear (má orduítear aon cheann) le dlí i gcóir na hoifige sin do cheapa chun dualgaisí na hoifige sin d'fheidhmiú go sealadach.
(2) Einne a ceapfar fén Acht so chun dualgaisí oifige d'fheidhmiú ní leanfa sé d'fheidhmiú na ndualgaisí sin tar éis dhá bhliain o am rithte an Achta so do bheith caithte.
(3) Féadfidh an tAire aon uair deire do chur le haon cheapa a déanfar fén Acht so.
Duine a ceapfar fén Acht so beidh comhachta sealbhóir na hoifige aige.
2.—Gach éinne a ceapfar fén Acht so chun dualgaisí oifige d'fheidhmiú beidh aige na comhachta go léir a bheidh dílsithe i sealbhóir na hoifige sin de thuras na huaire do réir dlí, agus i gcás ceapa a shínfidh siar, tuigfar chun gach críche go raibh na comhachta san aige ón dáta go dtuigtar do réir an Achta so gur air a ceapadh é.
Féadfidh ceapa síne siar i gcásanna áirithe.
3.—I gcás éinne bhí, roimh rith an Achta so, ag feidhmiú dualgaisí aon oifige a luaidhtear sa Sceideal don Acht so agus atá folamh le linn rithte an Achta so, má ceaptar an duine sin fén Acht so chun dualgaisí na hoifige sin d'fheidhmiú, féadfidh an tAire, más é a dhin an ceapa, agus in aon chás eile féadfidh an té dhin an ceapa, a fhaisnéis go bhfuil an ceapa in éifeacht ón dáta ar ar dhin an duine a ceapadh amhlaidh tosnú ar dhualgaisí na hoifige sin d'fheidhmiú agus sa chás san tuigfar chun gach críche gur ceapadh an duine sin fén Acht so ar an dáta roimhráite.
Féadfar déanamh gan na cáilíochta i gcásanna áirithe.
4.—(1) Aon uair is dó leis an Aire gur ceart do é mar gheall ar nithe fé leith, féadfa sé, má thoilíonn Coimisinéirí na Stát-Sheirbhíse chuige, duine do cheapa no a údarú go gceapfar duine (pe'ca dhíobh is gá sa chás) chun dualgaisí oifige d'fheidhmiú fén Acht so gan na cáilíochta san a bheith aige is gá dho a bheith aige do réir dlí i gcóir na hoifige sin.
(2) Coicíos ar a luíod roimh cheapa do dhéanamh no d'údarú fén alt so, cuirfidh an tAire fé ndeár fógra d'fhoillsiú san Iris Oifigiúil i dtaobh é bheith ar aigne an ceapa san do dhéanamh no d'údarú (pe'ca aca é), agus tar éis an ceapa bheith déanta déanfidh an tAire, no an té dhin an ceapa, a chur fé ndeár fógra i dtaobh an cheapa d'fhoillsiú san Iris Oifigiúil maraon le hainm an té a ceapadh.

5.—(1) Gheobhaidh gach éinne a ceapfar fén Acht so pé luach saothair a cheadóidh an tAire Airgid, ach gan é bheith níos mó ná an luach saothair a bheadh iníoctha leis an té a bheadh i seilbh na hoifige na gceapfar an duine sin chun na dualgaisí a ghabhann léi d'fheidhmiú.
(2) Ní bheidh ag éinne a ceapfar fén Acht so teideal chun aon phinsin, cúitimh, ná liúntais mar gheall ar an gceapa do chur ar nea-mbrí.

6.—Aon uair a ceapfar éinne fén Acht so chun dualgaisí oifige d'fheidhmiú, féadfidh an tAire a shocrú,
(a) cadé an t-urrús a bheidh (má bhíonn) le tabhairt ag an duine sin ar a dhualgaisí do chó-líona go cuibhe, ach in aon chás áirithe ní bheidh an t-urrús san níos mó ná an t-urrús a iarann an dlí ar dhuine ceaptar chun na hoifige sin, agus
(b) cadé an mionn no an fhaisnéis a bheidh (má bhíonn) le tabhairt no le déanamh ag an duine sin nuair a ceapfar é.

7.—(1) O am rithte an Achta so agus dá éis, ní ceapfar éinne, gan cead ón Aire agus ón Aire Airgid, chun aon oifige le n-a mbaineann an t-alt so más oifig den Chúirt Uachtarach Údaráis í no d'aon Chúirt Chontae i Saorstát Éireann, no oifig atá fé cheachtar acu no a bhaineann le ceachtar acu.
(2) Gach ceapa a déanfar tar éis rithte an Achta so chun aon oifige den tsórt a luaidhtear sa bhfo-alt san roimhe seo, ní bheidh sé ach sealadach agus féadfidh an tAire é do chur ar nea-mbrí aon uair.
(3) Ní bhaineann an t-alt so le haon oifig dá luaidhtear sa Sceideal don Acht so ná le haon oifig nách amach as airgead a sholáthruíonn an tOireachtas a híoctar an luach saothair a ghabhann léi.

COURT OFFICERS (TEMPORARY APPOINTMENTS) ACT, 1924.
Power to appoint person to execute duties of offices in Schedule.
1.—(1) If any of the offices mentioned in the Schedule to this Act are vacant at the passing of this Act or shall become vacant within twelve months after the passing of this Act, then and in any such case,
(a) if the power of appointing to such vacant office is vested by law in the Minister, or if there is no person in existence having the power of appointment to such vacant office the Minister may at any time within fourteen months after the passing of this Act in lieu of making an appointment to such vacant office, appoint a fit person possessing the qualifications (if any) prescribed by law for such office to execute temporarily the duties of such office, and
(b) if there is a person (other than the Minister) in existence having the power of appointing to such vacant office that person may with the consent of the Minister, and shall if so directed by the Minister, at any time within fourteen months after the passing of this Act in lieu of making an appointment to such vacant office appoint a fit person possessing the qualifications (if any) prescribed by law for such office to execute temporarily the duties of such office.
(2) No person appointed under this Act to execute the duties of an office shall continue to execute those duties after the expiration of two years from the passing of this Act.
(3) Every appointment under this Act may be terminated at any time by the Minister.
Person appointed under this Act to have powers of holder of office.
2.—Every person appointed under this Act to execute the duties of an office shall have all the powers for the time being vested by law in the holder of that office and in the case of a retrospective appointment shall be deemed for all purposes to have had such powers as from the date on which he is deemed by this Act to have been appointed.
Appointments may be retrospective in certain cases.
3.—Wherever any person has been, previous to the passing of this Act, executing the duties of any office mentioned in the Schedule to this Act which is vacant at the passing of this Act, and such person is appointed under this Act to execute the duties of that office, the appointment of such person may be declared by the Minister where the appointment is made by him and in any other case by the person making the appointment, to take effect as from the date on which the person so appointed commenced to execute the duties of that office and in such case such person shall be deemed for all purposes to have been appointed under this Act on the date aforesaid.
Qualifications may be dispensed with in certain cases.
4.—(1) The Minister may whenever owing to special circumstances he thinks it proper so to do, subject to the consent of the Civil Service Commissioners, appoint or authorize the appointment (as the case may require) to execute the duties of an office under this Act of a person who does not possess the qualifications prescribed by law for that office.
(2) At least one fortnight before making or authorizing an appointment under this section the Minister shall cause notice of his intention to make or authorize (as the case may be) such appointment to be published in the Iris Oifigiúil, and after such appointment has been made the Minister or other person making the appointment shall cause notice of the appointment together with the name of the person appointed to be published in the Iris Oifigiúil.
Remuneration of persons appointed under this Act.
5.—(1) Every person appointed under this Act shall receive such remuneration as shall be sanctioned by the Minister for Finance, but not exceeding the remuneration payable to a person holding the office the duties of which such person is appointed to execute.
(2) No person appointed under this Act shall be entitled to any pension, compensation, or allowance on account of the termination of the appointment.
Security to be given and oath to be taken.
6.—Whenever any person is appointed under this Act to execute the duties of an office, the Minister may prescribe,
(a) the security (if any) to be given by such person for the due performance of his duties, but such security shall not in any case exceed the security required by law to be given by a person appointed to that office, and
(b) the oath or declaration (if any) to be taken by such person on appointment.
Appointments to Supreme and County Court Offices.
7.—(1) From and after the passing of this Act no person shall be appointed without the consent of the Minister and of the Minister for Finance to any office to which this section applies of, under, or attached to the Supreme Court of Judicature in Ireland or any County Court in Saorstát Eireann.
(2) Every appointment made after the passing of this Act to any such office as is mentioned in the foregoing sub-section shall be temporary only and shall be terminable at any time by the Minister.
(3) This section does not apply to any of the offices mentioned in the Schedule to this Act or to any office the remuneration of which is not paid out of moneys provided by the Oireachtas.
Definition of “Minister.”
8.—In this Act the word “Minister” means the Minister for Home Affairs.
Short title.
9.—This Act may be cited as the Court Officers (Temporary. Appointments) Act, 1924.
