ACHT TORTHAÍ TALMHAÍOCHTA (EASPORTÁIL DO RIALÁIL), 1933.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Talmhaíochta;
foluíonn an abairt “tora talmhaíochta” aon tora talmhaíochta no garnóireachta agus aon earra bhídh no dighe do rinneadh no do fuarthas, i bpáirt no go hiomlán, as aon tora den tsórt san agus lomraí agus seithí ainmhithe ach ní fholuíonn sí deoch mheisciúil.
Comhacht chun easportála torthaí talmhaíochta do rialáil agus do stiúradh.
2.—(1) I gcás aon tire chun a ndeintear de ghnáth aon tora talmhaíochta d'easportáil o Shaorstát Éireann do bhunú aon chórais ag srianadh no ag rialú iomportála an tora talmhaíochta san isteach sa tír sin o Shaorstát Éireann féadfaidh an tAire, le hordú (dá ngairmtear ordú easportála san Acht so), easportáil an tora talmhaíochta san chun na tíre sin o Shaorstát Éireann do rialáil agus do stiúradh i pé slí chífear do is deallrathach a chuirfidh in áirithe go bhfuighidh easportálaithe o Shaorstát Éireann an tairbhe maximum a lomhálfaidh an córas sriantachta agus rialuithe sin a bheidh bunuithe ag an tír sin amhlaidh agus go sonnrách féadfaidh, gan dochar do gheneráltacht na forála san roimhe seo, socrú do dhéanamh, leis an ordú san, i gcóir gach ní no éinní acu so leanas, sé sin le rá:—
(a) daoine bhíonn ag casportáil an tortha san chun na tíre sin do chlárú;
(b) easportáil an tortha san chun na tíre sin o Shaorstát Éireann do rialú agus do shrianadh;
(c) a chur de cheangal ar dhaoine cláruithe easportáil do dhéanamh chun na tíre sin, i rith aon tréimhse no tréimhsí áirithe, ar chaindíocht áirithe den tora san nách mó ná an chaindíocht a bheidh geallta ag na daoine sin fé seach a easportáil i rith na tréimhse no na dtréimhsí sin;
(d) aon easportáil eile chun na tíre sin, a bheidh ceaduithe mar mhalairt de thurus na huaire, do rialáil agus do stiúradh;
(e) a chur in áirithe go dtabharfar cuntaisí;
(f) a shocrú sáruithe áirithe ar an ordú san do bheith ina gciontaí is ionphionósuithe ar dhaoine do chiontú ionta ar an slí achmair, agus na pionóisí gheobhaidh leis na ciontaí sin do cheapadh.
(2) Féadfaidh an tAire, le hordú, ordú do rinneadh roimhe sin fén alt so do cheiliúradh no do leasú.
(3) Gach ordú déanfar fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid amhlaidh, rún do rith ag cur an orduithe sin ar nea-mbrí, beidh an t-ordú san curtha ar nea-mbrí dá réir sin, ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.
Comhachta don Aire chun torthaí talmhaíochta do cheannach, d'easportáil agus do dhíol.
3.—(1) Pé uair a bheidh ordú easportála i bhfeidhm ag rialáil agus ag stiúradh easportála aon tortha talmhaíochta go tír áirithe féadfaidh an tAire, tar éis do dul i gcomhairle leis an Aire Airgid, pé caindíochtaí den tora san is oiriúnach leis do cheannach, do dhíol agus d'easportáil chun na tíre sin o am go ham más dóich leis go raghadh san chun leasa na puiblíochta.
(2) Déanfar aon airgead do gheobhfar as aon díolachán fén alt so d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste ar pé slí ordóidh an tAire Airgid.
(3) Féadfaidh an tAire in aon ordú easportála a fhoráil, í gcás é do dhul fé chostas fén alt so de bhíthin no de dheascaibh é do theip ar dhuine ar bith éinní áirithe do dhéanamh a húdaruítear don duine sin no a cuirtear mar cheangal ar an duine sin leis an ordú san no fé a dhéanamh, go bhféadfaidh an tAire an costas san do bhaint den duine sin mar fhiacha gnáth-chonnartha agus féadfaidh an tAire leis an ordú san a fhoráil go mbeidh deimhniú ón Aire ina fhianaise dho-chlaoite ar é do dhul fén gcostas san agus fós ar mhéid an chostais sin.
(4) Déanfar aon airgead a bhainfidh an tAire amach fén bhfo-alt deiridh sin roimhe seo d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste ar pé slí ordóidh an tAire Airgid.
Forálacha custum.
4.—(1) Féadfaidh aon oifigeach Custum agus Máil tora talmhaíochta ar bith, a bheidh á easportáil no go mbeifear a d'iarraidh é d'easportáil contrárdha d'ordú easportála do choinneáil agus do thógaint agus chuige sin féadfaidh pacáid ar bith d'oscailt ina mbeidh tora talmhaíochta ar bith den tsórt san no ’na mbeidh amhras aige a leithéid do bheith inti, agus na forálacha den Customs Consolidation Act, 1876, i dtaobh earraí tógfar fén Acht san d'ordú a bheith geallbhruidthe agus do chur de láimh bainfid le tora talmhaíochta ar bith tógfar fén alt so fé is dá mba fén Acht san do tógfaí é.
(2) Na forálacha, maidir le heasportáil tora talmhaíochta ar bith do rialú agus do shrianadh, a bheidh in ordú easportála beidh éifeacht acu fé is dá mbeadh na forálacha san sa Customs Consolidation Act, 1876, agus beidh baint dá réir sin ag an Acht san agus ag aon Acht le n-a leasuítear no le n-a leathnuítear an tAcht san agus má deintear tora talmhaíochta ar bith go dtoirmeasctar a easportáil leis an ordú san d'easportáil contrárdha don ordú san no é do thabhairt go dtí aon ché no áit eile chun é d'easportáil amhlaidh no é d'iompar ar uisce chun é d'easportáil amhlaidh dlighfear an pionós céanna do chur ar an easportálaí no ar a ghníomhaire dlightear do chur ar dhuine, fé alt 186 den Acht san, mar gheall ar earraí toirmiscthe d'iomportáil go nea-dhleathach.
Comhairlí comhairlitheacha.
5.—(1) Déanfaidh an tAire pé uair agus chó minic agus is oiriúnach leis é, le toiliú an Aire Airgid agus tar éis do dul i gcomhairle le pé cóluchta agus daoine is dóich leis is fearr ionaduíonn na dreamanna uile le n-a mbaineann, comhairle chomhairlitheach do bhunú le hordú chun comhairle agus congnamh do thabhairt do i dtaobh na nithe (eadhon, nithe bhaineann le horduithe easportála do dhéanamh, do cheiliúradh, agus do leasú) luadhfaidh san ordú san.
(2) Isiad a bheidh ar chomhairle chomhairlitheach a bunófar fén alt so ná pé daoine, go dtaithí no go n-eolas fé leith acu ar na nithe go bhféadfaidh an chomhairle sin comhairle no congnamh do thabhairt don Aire ina dtaobh, a dhéanfaidh an tAire, tar éis do dul i gcomhairle mar adubhradh, a ainmniú o am go ham chun bheith ina mbaill di.
(3) Marab éag no eirghe as roimhe sin do beidh gach ball de chomhairle chomhairlitheach a bunófar fén alt so ina bhall amhlaidh go ceann dhá bhlian, agus go ceann na tréimhse sin amháin, o dháta a ainmnithe, ach beidh sé ion-athainmnithe.
(4) Tiocfaidh comhairle chomhairlitheach a bunófar fén alt so le chéile pé uair a ghairmfidh an tAire le chéile iad agus fós ar pé ócáidí eile ar a gcinnfidh an chomhairle sin o am go ham.
(5) Féadfaidh an tAire íocaíochtaí, i pé méideanna cheadóidh an tAire Airgid, d'íoc, amach as airgead a sholáthróidh an tOireachtas, le baill de chomhairle chomhairlitheach a bunófar fén alt so no le baill de choiste dhi, ar scór aisíoca costaisí taistil agus íoca liúntais chothuithe.

6.—Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a raghaidh an tAire fén Acht so.

AGRICULTURAL PRODUCTS (REGULATION OF EXPORT) ACT, 1933.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Agriculture;
the expression “agricultural product” includes any product of agriculture or horticulture and any article of food or drink wholly or partly manufactured or derived from any such product, and fleeces and skins of animals but does not include intoxicating liquor.
Power to regulate and control export of agricultural products.
2.—(1) If any country to which any agricultural product is usually exported from Saorstát Eireann establishes any system of restriction or control of the import of that agricultural product into that country from Saorstát Eireann the Minister may by order (in this Act referred to as an export order) regulate and control the export of that agricultural product to that country from Saorstát Eireann in such manner as appears to him to be calculated to secure for exporters from Saorstát Eireann the maximum benefit permitted by the said system of restriction and control so established by such country and in particular may, without prejudice to the generality of the foregoing provision, by such order provide for all or any of the following matters, that is to say:—
(a) for the registration of persons engaged in exporting such product to such country;
(b) for the control and restriction of the export of such product to such country from Saorstát Eireann;
(c) for requiring registered persons to export to such country during any specified period or periods a specified quantity of such product not exceeding the quantity such persons respectively undertake to export during such period or periods;
(d) for regulating and controlling any alternative export to such country which may for the time being be permitted;
(e) for securing the making of returns;
(f) for making specified infringements of such order offences punishable on summary conviction and fixing the penalties for such offences.
(2) The Minister may by order revoke or amend an order previously made under this section.
(3) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such order is passed by either such House within the next subsequent twenty-one days on which that House has sat after such order is so laid before it, such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.
Powers of the Minister to purchase, export and sell agricultural products.
3.—(1) Whenever an export order regulating and controlling the export of any agricultural product to a particular country is in force, the Minister after consultation with the Minister for Finance may, if he considers it desirable in the public interest so to do, from time to time purchase, sell and export to such country such quantities of such product as he thinks fit.
(2) Any moneys received on any sale under this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
(3) The Minister may in any export order provide that where he incurs expense under this section by reason or in consequence of the failure of any person to do any specified thing which such person is authorised or required by or under such order to do, the Minister may recover such expense from such person as a simple contract debt and the Minister may by such order provide that a certificate of the Minister shall be conclusive evidence of the incurring of such expense and of the amount of such expense.
(4) Any moneys recovered by the Minister under the immediately preceding sub-section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Customs provisions.
4.—(1) Any officer of Customs and Excise may detain and seize any agricultural product being or attempted to be exported in contravention of an export order and for that purpose may open any packet containing or suspected by him of containing any such agricultural product and the provisions of the Customs Consolidation Act, 1876, in relation to the condemnation and disposal of goods seized under that Act shall apply to any agricultural product seized under this section in like manner as if it had been seized under that Act.
(2) The provisions, relating to the control and restriction of the export of any agricultural product, contained in an export order shall have effect as though those provisions were included in the Customs Consolidation Act, 1876, and that Act and any Act amending or extending that Act shall apply accordingly, and if any agricultural product the export of which is prohibited by such order is exported in contravention of such order or is brought to any quay or other place for the purpose of being so exported or is waterborne to be so exported, the exporter or his agent shall be liable to the same penalty as that to which a person is liable under section 186 of that Act for illegally importing prohibited goods.
Consultative Councils.
5.—(1) The Minister shall, whenever and so often as he thinks fit with the consent of the Minister for Finance and after consultation with such bodies and persons as he may consider most representative of the several interests concerned, establish by order a consultative council for giving advice and assistance to him in relation to such matters (being matters relating to or concerned with the making, revoking, and amending of export orders) as he may specify in such order.
(2) A consultative council established under this section shall consist of such persons having experience or special knowledge of the matters on which such council may give advice or assistance to the Minister as the Minister, after such consultation as aforesaid, shall from time to time nominate to be members thereof.
(3) Every member of a consultative council established under this section shall unless he previously dies or resigns, retain his membership for two years only from the date of his nomination, but shall be eligible for renomination.
(4) A consultative council established under this section shall meet whenever summoned by the Minister and also on such other occasions as such council shall from time to time determine.
(5) Payments may be made by the Minister out of moneys provided by the Oireachtas, to members of a consultative council established under this section or of a committee thereof, to such extent as may be sanctioned by the Minister for Finance, in respect of repayment of travelling expenses and payment of subsistence allowance.
Expenses.
6.—All expenses incurred by the Minister under this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Short title.
7.—This Act may be cited as the Agricultural Products (Regulation of Export) Act, 1933.
