ACHT DRÉINEÁLA NA BEARBHA, 1933.

An Príomh-Acht.
1.—(1) San Acht so cialluíonn an abairt “an Príomh-Acht” Acht Dréineála na Bearbha, 1927 (Uimh. 26 de 1927).
(2) Gach focal agus abairt dá dtugtar brí áirithe leis an bPríomh-Acht chun crícheanna an Achta san tá aige san Acht so an brí tugtar do amhlaidh.
Alt 9 den Phríomh-Acht do leasú.
2.—(1) An méid de mhír (a) d'alt 9 den Phríomh-Acht le n-a bhforáltar gan méid an roimh-íoca o sna Coimisinéirí do dhul thar suim dhá chéad is dhá mhíle dhéag agus cúig céad púnt scuirfidh d'éifeacht do bheith aige, agus achtuítear leis seo ina ionad san ná raghaidh méid an roimh-íoca o sna Coimisinéirí thar suim dhá chéad is cúig mhíle seachtód púnt.
(2) An méid de mhír (b) d'alt 9 den Phríomh-Acht le n-a bhforáltar gan méid an airgid a sholáthróidh an tAire Airgid fén alt san do dhul thar suim dhá chéad is dhá mhíle dhéag agus cúig céad púnt scuirfidh d'éifeacht do bheith aige, agus achtuítear leis seo ina ionad san ná raghaidh na méideanna sholáthróidh an tAire Airgid fén alt san, amach as airgead a sholáthróidh an tOireachtas, thar suim dhá chéad is cúig mhíle seachtód púnt.
Alt 19 den Phríomh-Acht do leasú.
3.—Deintear leis seo alt 19 den Phríomh-Acht do leasú sna slite seo leanas, agus léireofar é agus beidh éifeacht aige dá réir sin, sé sin le rá:—
(a) tré sna focail “thrí mhíle dhá chéad agus caoga” do chur in ionad na bhfocal “dhá mhíle” i bhfo-alt (1) den alt san, agus
(b) tré sna focail “thrí mhíle dhá chéad agus caoga” do chur in ionad na bhfocal “dhá mhíle” i bhfo-alt (2) den alt san.
An tAire do dhéanamh roimhíocanna le Bord Dréineála na Bearbha.
4.—(1) Más rud é, aon tráth no tráthanna roimh dheireadh na céad bhliana airgeadais áitiúla díreach tar éis an 31adh lá de Mhárta i ndiaidh dáta an mholta dheiridh, gur dóich leis na Coimisinéirí gur gá do Bhord Dréineála na Bearbha, chun na n-oibreacha dréineála do choinneáil i dtreo i rith na tréimhse idir dáta an mholta dheiridh agus deireadh na bliana airgeadais áitiúla san, aon airgead d'fháil de bhreis ar an suim a bheidh Bord Dréineála na Bearbha i dteideal d'fháil an bhliain airgeadais áitiúil sin fé fho-alt (1) d'alt 19 den Phríomh-Acht mar a leasuítear san leis an Acht so no de bhreis ar an suim sin agus ar aon airgead a bheidh roimh-íoctha roimhe sin fén alt so, féadfaidh na Coimisinéirí a dheimhniú don Aire méid áirithe do bheith ag teastáil amhlaidh o Bhord Dréineála na Bearbha.
(2) Ar an Aire Airgid d'fháil deimhnithe ar bith fén bhfo-alt san roimhe seo féadfaidh méid nách mó ná an méid a bheidh luaidhte sa deimhniú san do roimh-íoc do réir an ailt seo amach as airgead a sholáthróidh an tOireachtas.
(3) Ní raghaidh iomlán na méideanna féadfar do roimh-íoc fén alt so thar suim trí mhíle dhá chéad agus caoga púnt agus ní roimh-íocfaidh an tAire méid ar bith a dhéanfadh an t-iomlán san níos mó ná an tsuim sin.
(4) Déanfar an t-airgead uile a roimh-íocfar fén alt so d'aisíoc leis an Aire Airgid, agus chun an airgid sin d'aisíoc beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) féadfaidh an tAire Airgid pé méideanna is oiriúnach leis do bhaint as gach íocaíocht no as aon íocaíocht dá dtiocfaidh chun bheith iníoctha aige le Bord Dréineála na Bearbha fé fho-alt (3) d'alt 19 den Phríomh-Acht;
(b) Más rud é, tar éis na híocaíochta deiridh d'íoc a thiocfaidh chun bheith iníoctha ag an Aire Airgid le Bord Dréineála na Bearbha fé fho-alt (3) d'alt 19 den Phríomh-Acht, ná beidh na suimeanna uile do roimhíoc an tAire sin fén alt so aisíoctha tiocfaidh an t-iarmhéid (dá ngairmtear san alt so an t-iarmhéid neamh-aisíoctha) chun bheith agus beidh sé, go dtí go n-aisíocfaidh Bord Dréineála na Bearbha é, ina mhuirear ar an airgead uile do gheobhaidh Bord Dréineála na Bearbha ina dhiaidh sin;
(c) féadfaidh an tAire Airgid a ordú do Bhord Dréineála na Bearbha an t-iarmhéid neamh-aisíoctha (más ann do) d'aisíoc i gceachtar slí acu so leanas, sé sin le rá:—
(i) i suim amháin i mbliain airgeadais áitiúil áirithe ar bith; no
(ii) i dtráthchoda de mhéideanna áirithe i mblianta airgeadais áitiúla áirithe;
agus má orduíonn an tAire an t-iarmhéid neamhaisíoctha d'aisíoc i gceachtar slí acu san déanfaidh Bord Dréineála na Bearbha an t-iarmhéid neamhaisíoctha san d'aisíoc sa tslí ordóidh an tAire;
(d) má bhíonn ar Bhord Dréineála na Bearbha, fén mír sin roimhe seo, suim ar bith d'íoc leis an Aire Airgid i mbliain airgeadais áitiúil ar bith, tuigfear íoc na suime sin do bheith ina chuid de chostas na n-oibreacha dréineála do choinneáil i dtreo in aghaidh na bliana airgeadais áitiúla san do réir bhrí ailt 21 den Phríomh-Acht agus beidh feidhm agus éifeacht ag an alt san dá réir sin.

5.—(1) Féadfar Acht Dréineála na Bearbha, 1933, do ghairm den Acht so.
(2) Féadfar Achtanna Dréineála na Bearbha, 1927 agus 1933, do ghairm den Phríomh-Acht agus den Acht so le chéile.

BARROW DRAINAGE ACT, 1933.
The Principal Act.
1.—(1) In this Act the expression “the Principal Act” means the Barrow Drainage Act, 1927 (No. 26 of 1927).
(2) Every word and expression to which a particular meaning is given by the Principal Act for the purposes of that Act has in this Act the meaning so given.
Amendment of section 9 of the Principal Act.
2.—(1) So much of paragraph (a) of section 9 of the Principal Act as limits the amount of the advance by the Commissioners to a sum of two hundred and twelve thousand five hundred pounds shall cease to have effect, and in lieu thereof it is hereby enacted that the amount of the advance by the Commissioners shall not exceed the sum of two hundred and seventy-five thousand pounds.
(2) So much of paragraph (b) of section 9 of the Principal Act as limits the amount of the moneys to be provided by the Minister for Finance under that section to the sum of two hundred and twelve thousand five hundred pounds shall cease to have effect, and in lieu thereof it is hereby enacted that the amounts to be provided by the Minister for Finance under that section out of moneys to be provided by the Oireachtas shall not exceed the sum of two hundred and seventy-five thousand pounds.
Amendment of section 19 of the Principal Act.
3.—Section 19 of the Principal Act is hereby amended in the following respects, and shall be construed and have effect accordingly, that is to say:—
(a) by the substitution in sub-section (1) of the said section of the words “three thousand two hundred and fifty” for the words “two thousand”, and
(b) by the substitution in sub-section (2) of the said section of the words “three thousand two hundred and fifty” for the words “two thousand”.
Advances by Minister to Barrow Drainage Board.
4.—(1) If, at any time or times before the expiration of the first local financial year next after the 31st day of March following the date of the final award, the Commissioners are of opinion that the Barrow Drainage Board requires for the maintenance of the drainage works during the period between the date of the final award and the expiration of such local financial year any moneys in addition to the sum which the Barrow Drainage Board is entitled to receive in such local financial year under sub-section (1) of section 19 of the Principal Act, as amended by this Act, or in addition to such sum and any moneys previously advanced under this section, the Commissioners may certify to the Minister that a specified amount is so required by the Barrow Drainage Board.
(2) The Minister for Finance, on receipt of any certificate under the foregoing sub-section may, out of moneys to be provided by the Oireachtas, make an advance in accordance with this section of an amount not exceeding the amount specified in such certificate.
(3) The aggregate of the advances which may be made under this section shall not exceed the sum of three thousand two hundred and fifty pounds and the Minister shall make no advance which would cause such aggregate to exceed that sum.
(4) All moneys advanced under this section shall be refunded to the Minister for Finance and for the purpose of the refunding of such moneys the following provisions shall have effect, that is to say:—
(a) the Minister for Finance may make such deductions as he may think fit from all or any of the payments which may become due by him to the Barrow Drainage Board under sub-section (3) of section 19 of the Principal Act;
(b) if after the making of the last payment which may become due by the Minister for Finance to the Barrow Drainage Board under sub-section (3) of section 19 of the Principal Act all sums advanced by the said Minister under this section have not been refunded the balance (in this section referred to as the outstandingbalance) shall until repaid by the Barrow Drainage Board become and be a charge on all moneys thereafter received by the Barrow Drainage Board;
(c) the Minister for Finance may direct the Barrow Drainage Board to repay the outstanding balance (if any) in either of the following ways, that is to say:—
(i) in one sum in any specified local financial year; or
(ii) in instalments of specified amounts in specified local financial years;
and if the Minister directs the repayment of the outstanding balance in either of such ways the Barrow Drainage Board shall repay such outstanding balance in the way directed by the Minister;
(d) if the Barrow Drainage Board becomes liable under the foregoing paragraph to make any payment to the Minister for Finance in any local financial year, the making of such payment shall be deemed to be part of the cost of the maintenance of the drainage works for that local financial year within the meaning of section 21 of the Principal Act and that section shall apply and have effect accordingly.
Short title and citation.
5.—(1) This Act may be cited as the Barrow Drainage Act, 1933.
(2) The Principal Act and this Act may be cited together as the Barrow Drainage Acts, 1927 and 1933.
