Mínithe.
1.—San Acht so—
folaíonn an abairt “feabhsú cathartha” éinní a rachas chun soighnis líomatáiste fheidhmiúcháin an údaráis áitiúil a bheas i gceist d'fheabhsú nó a rachas ar aon tslí eile chun leasa áitreabhóirí nó aon aicme d'áitreabhóirí an líomatáiste fheidhmiúcháin sin;
ciallaíonn an abairt “scéim feabhsuithe chathartha” scéim faoi fho-alt (1) d'alt 2 den Acht so;
ciallaíonn an abairt “údarás áitiúil” aon chomhlucht is—
(a) bardas contae-bhuirge nó buirge eile, nó
(b) comhairle chontae nó bhaile-cheanntair, nó
(c) coimisinéirí baile, nó
(d) coiste gairm-oideachais, nó
(e) coiste talmhaíochta;
ciallaíonn an abairt “an tAire” an tAire Rialtais Áitiúil agus Sláinte Poiblí;
ciallaíonn an abairt “feidhm fhorcoimeáta”—
(a) i gcás bardais chontae-bhuirge, feidhm fhorcoimeáta chun críocha na n-achtachán a bhaineas le bainistí na contaebhuirge sin,
(b) i gcás aon údaráis áitiúil eile, feidhm fhorcoimeáta chun críocha na nAcht um Bainistí Chontae, 1940 agus 1942;
ciallaíonn an abairt “ciste feabhsuithe chathartha toildheonach” ciste arna bhunú faoi scéim feabhsuithe chathartha.
Scéim feabhsuithe chathartha.
2.—(1) Feadfaidh údarás áitiúil, ó am go ham, scéimeanna do ghabháil chucu chun bronntais mhaoine réalta nó pearsanta le haghaidh feabhsuithe cathartha do ghlacadh, do shealbhú agus do riaradh agus féadfaidh aon scéim den tsórt san bheith ina scéim le haghaidh feabhsuithe cathartha go ginearálta, le haghaidh cineál nó cineálacha áirithe feabhsuithe cathartha nó le haghaidh aon fheabhsuithe chathartha áirithe amháin.
(2) Déanfar go sonnruch, i scéim feabhsuithe chathartha, socrú—
(a) i dtaobh ciste ar leithligh do bhunú faoi urlámhas an údaráis áitiúil a ghabhfas an scéim chucu agus i dtaobh aon airgead a bhéarfar chun críocha na scéime agus aon ioncam ó mhaoin seachas airgead a bhéarfar amhlaidh d'íoc isteach sa chiste sin,
(b) i dtaobh airgead a bheas sa chiste sin agus ná beidh riachtanas lena chaitheamh de thuras na huaire do shuncáil,
(c) i dtaobh airgead a bheas sa chiste sin do chaitheamh agus i dtaobh an nós imeachta agus na srianta (más ann) maidir le híocaíochta do dhéanamh as an gciste sin.
(3) Féadfaidh an t-údarás áitiúil a ghabhfaidh scéim feabhsuithe chathartha chucu an scéim d'athrú má dhéanann an Ard-Chúirt, de dhruim iarratais ina mbeidh an tAire ainmnithe mar fhreagraí, an t-athrú do cheadú.
(4) Chun críocha na n-achtachán a bhaineas le hiniúchadh cuntas údarás áitiúla beidh cuntais chiste feabhsuithe chathartha thoildheonaigh ina gcuid de chuntais an údaráis áitiúil a ghabh an scéim chucu.
(5) Is feidhm fhorcoimeáta gabháil scéime feabhsuithe chathartha chucu ag údarás áitiúil.
Bronntas maoine le haghaidh scéime feabhsuithe chathartha do ghlacadh.
3.—Má tairgtear bronntas maoine réalta nó pearsanta le haghaidh aon fheabhsuithe chathartha d'údarás áitiúil féadfaid—
(a) i gcás scéim feabhsuithe chathartha do bheith gafa chucu acu agus an bronntas do thairgsint dóibh chun críocha na scéime, an bronntas do ghlacadh, do shealbhú agus do riaradh do réir na scéime,
(b) in aon chás eile, faoi réir iad do ghabháil scéime feabhsuithe chathartha chucu a mbeidh glacadh, sealbhú agus riaradh an bhronntais mar chuspóir ar fad nó i bpáirt aici, an bronntas do ghlacadh, do shealbhú agus do riaradh do réir na scéime,
agus i gceachtar cás féadfaid gach ní do dhéanamh a ghabhfas leis an nglacadh, an sealbhú agus an riaradh san nó a leanfas as.
Fógra i dtaobh scéime feabhsuithe chathartha d'fhoillsiú.
4.—(1) Má ghabhann údarás áitiúil scéim feabhsuithe chathartha chucu, déanfaid, a luaithe is féidir tar éis í do ghabháil chucu agus uair amháin ar a laghad sa bhliain uaidh sin amach, fógra d'fhoillsiú i dtrí nuachtáin (ar nuachtán laethúil ceann amháin ar a laghad díobh) a léitear ina líomatáiste feidhmiúcháin á rá go bhfuil an scéim ann agus go bhféadfaidh duine ar bith síntiúis do thabhairt don chiste feabhsuithe chathartha thoildheonach atá bunaithe fúithi.
(2) Na costais faoina raghfar faoin alt so maidir le scéim feabhsuithe chathartha, déanfar—
(a) más coiste gairm-oideachas nó coiste talmhaíochta a rachas fúthu, iad d'íoc as an gciste feabhsuithe chathartha toildheonach a bheas bunaithe faoin scéim,
(b) más aon údarás áitiúil eile a rachas fúthu, iad d'íoc—
(i) as an gciste feabhsuithe chathartha toildheonach san, nó
(ii) (I) i gcás bardais chontae-bhuirge nó buirge Dhún Laoghaire, as an gciste bardasach,
(II) i gcás comhairle contae, tríd an ráta dealúis mar mhuirear ar cheanntar sláinte contae na contae sin,
(III) i gcás bardais bhuirge (nach contae-bhuirg ná buirg Dhún Laoghaire), tríd an ráta buirge,
(IV) gcás comhairle baile-cheanntair nó coimisinéirí baile, tríd an ráta baile.
Bailechoimisinéirí do chorprú chun críocha an Achta so.
5.—Chun bronntais mhaoine réalta nó pearsanta le haghaidh feabhsuithe cathartha do ghlacadh, do shealbhú agus do riaradh agus chun an dlí do shaothrú acu nó orthu ina dtaobh san, beidh coimisinéirí baile (mura comhlucht corpraithe iad cheana) ina gcomhlucht corpraithe go síor-chomharbas, agus beidh ionstraim ar bith a bhainfeas le maoin den tsórt san comhlánaithe go cuibhe ag na Coimisinéirí sin má comhlánaítear í sa tslí a foráltar le halt 59 den Commissioners Clauses Act, 1847, maidir le leithlithe ag coimisinéirí nach comhlucht corpraithe.

LOCAL AUTHORITIES (ACCEPTANCE OF GIFTS) ACT, 1945.
Definitions.
1.—In this Act—
the expression “civic improvement” includes, anything which tends to improve the amenities of the functional area of the local authority concerned or is otherwise conducive to the welfare of the inhabitants or any class of the inhabitants of that functional area;
the expression “civic improvement scheme” means a scheme under subsection (1) of section 2 of this Act;
the expression “local authority” means any body being either—
(a) the corporation of a county or other borough, or
(b) the council of a county or an urban district, or
(c) the commissioners of a town, or
(d) a, vocational education committee, or
(e) a committee of agriculture;
the expression “the Minister” means the Minister for Local Government and Public Health;
the expression “reserved function” means—
(a) in the case of the corporation of a county borough, a reserved function for the purposes of the enactments relating to the management of that county borough,
(b) in the case of any other local authority, a reserved function for the purposes of the County Management Acts, 1940 and 1942;
the expression “voluntary civic improvement fund” means a fund established under a civic improvement scheme.
Civic improvement scheme.
2.—(1) A local authority may, from time to time, adopt schemes for the acceptance, holding and administration of gifts of real or personal property for civic improvements and any such scheme may be in respect of civic improvements generally, a particular class or particular classes of civic improvements or one particular civic improvement.
(2) A civic improvement scheme shall, in particular provide for—
(a) the establishment of a separate fund under the control of the local authority adopting the scheme and the payment into such fund of any moneys given for the purposes of the scheme and any revenues arising from property other than money so given,
(b) the investment of moneys in such fund which are not for the time being required to be expended,
(c) the expenditure of moneys in such fund and the procedure for and the restrictions (if any) on the making of payments therefrom.
(3) A civic improvement scheme may be varied by the local authority which adopted it if the High Court, on an application in which the Minister is named as respondent, sanctions the variation.
(4) The accounts of a voluntary civic improvement fund shall be part of the accounts of the local authority which adopted the scheme for the purposes of the enactments relating to the audit of the accounts of local authorities.
(5) The adoption of a civic improvement scheme shall be a reserved function.
Acceptance of gift of property for purposes of civic improve ment scheme.
3.—Where a gift of real or personal property for any civic improvement is offered to a local authority they may—
(a) in case they have adopted a civic improvement scheme and the gift is offered for the purposes of the scheme, accept, hold and administer the gift in accordance with the scheme,
(b) in any other case, subject to the adoption of a civic improvement scheme, the purpose of which is or includes the acceptance, holding and administration of the gift, accept, hold and administer the gift in accordance with the scheme,
and in either case may do all things incidental to or consequential on such acceptance, holding and administration.
Publication of notice of civic improvement scheme.
4.—(1) Where a local authority adopt a civic improvement scheme, they shall, as soon as may be after the adoption thereof and thereafter at least once annually, publish, in three newspapers (of which one at least is a daily newspaper) circulating in their functional area, notice of the existence of the scheme and of the fact that any person may make contributions to the voluntary civic improvement fund established thereunder.
(2) The expenses incurred under this section in relation to a civic improvement scheme shall—
(a) if incurred by a vocational education committee or a committee of agriculture, be defrayed out of the voluntary civic improvement fund established thereunder,
(b) if incurred by any other local authority, be defrayed either—
(i) out of such voluntary civic improvement fund, or
(ii) (I) in the case of the corporation of a county borough or the borough of Dún Laoghaire, out of the municipal fund,
(II) in the case of the council of a county, by means of the poor rate as a charge on the county health district of that county,
(III) in the case of the corporation of a borough (not being a county borough or the borough of Dún Laoghaire), by means of the borough rate,
(IV) in the case of the council of an urban district or the commissioners of a town, by means of the town rate.
Incorporation of towns commissioners for purposes of this Act.
5.—The commissioners of a town (if not already a body corporate) shall, for the purpose of accepting, holding and administering gifts of real or personal property for civic improvements and of suing and being sued in respect thereof, be a body corporate with perpetual succession and any instrument relating to such property shall be duly executed by such commissioners if executed in manner provided by section 59 of the Commissioners Clauses Act, 1847, with respect to conveyances by commissioners who are not a body corporate.
Short title.
6.—This Act may be cited as the Local Authorities (Acceptance of Gifts) Act, 1945.
