ACHT IASCAIGH MHARA (IASC NEAMH-FHÁSTA DO CHAOMHAINT), 1937.

1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Talmhaíochta;
cialluíonn an abairt “iasc mara” iasc de chineál ar bith (seachas bradáin agus eascoin fíor-uisce) do gheibhtear sa bhfairrge, pe'ca úr no i staid eile dhó, agus foluíonn sí blaosc-iasc agus molluis do gheibhtear sa bhfairrge;
cialluíonn an focal “líon” aon trál, saighean no líon eile tarraigtear, no atá beartuithe le tarrac, ar ghrinneall no in aice grinnill na fairrge;
cialluíonn an abairt “iascaireacht mhara” iascaireacht do dhéanamh ar iasc mhara no iasc mara do thógaint in uiscí taoide;

(b) is bád go bhfuil a húnaer no, más le níos mó ná éinne amháin í, a húnaer bainistí ina dhuine atá ina chomhnaí no ag á bhfuil a phríomh-áit ghnótha i Saorstát Éireann;
cialluíonn an abairt “achar aon-chirt iascaigh Shaorstáit Éireann” an chuid sin den fhairrge gur laistigh di atá an t-aoncheart iascaireachta ag saoránaigh de Shaorstát Éireann do réir dlí eadarnáisiúnta, agus, i gcás teoranta na coda san do bheith leagtha amach i dtéarmaí aon chonvensiúin, connartha no socruithe ar n-a dhéanamh idir Shaorstát Éireann agus aon Stát eile agus a bheidh i bhfeidhm de thurus na huaire, foluíonn an abairt sin, maidir le longa agus le géilliúnaigh an Stáit sin, an chuid sin go mbeidh a teoranta leagtha amach amhlaidh;
nuair a húsáidtear an abairt “an máistir” maidir le bád iascaireachta mara cialluíonn sí máistir no scibire an bháid sin no an duine eile bheidh i bhfeighil an bháid sin de thurus na huaire;
cialluíonn an abairt “oifigeach caomhanta iascaigh mhara” duine is oifigeach caomhanta iascaigh mhara chun crícheanna an Achta chun Iascaigh Mhara do Chaomhnadh, 1933 (Uimh. 53 de 1933).

2.—(1) Féadfaidh an tAire, pé uair agus chó minic agus is oiriúnach leis é, a dhearbhú le hordú aon chineál áirithe éise mhara gur lugha a thuise, ar n-a thomhas sa tslí a hordófar leis an ordú san, ná an tuise do réir na dtomhas orduithe do bheith, chun crícheanna an Achta so, ina iasc ró-bheag, agus pé uair a déanfar aon ordú fén alt so maidir le haon chineál áirithe éisc mhara, ansan, faid a bheidh an t-ordú san i bhfeidhm, beidh gach iasc mara den chineál san gur lugha a thuise ná an tuise do réir na dtomhas orduithe, beidh sé, chun crícheanna an Achta so, ina iasc ró-bheag.
(2) In ordú déanfar fén alt so maidir le hiasc mara de chineál áirithe féadfar faideanna deifriúla d'ordú maidir leis na héisc mhara den chineál san a bheidh iomlán no go mbeidh aon choda bainte dhíobh.
(3) Féadfaidh ordú fén alt so baint le cineálacha deifriúla d'iasc mhara agus sa chás san féadfaidh forálacha deifriúla do bheith ann maidir le gach cineál fé leith d'iasc mhara le n-a mbainfidh an t-ordú.

3.—(1) Féadfaidh an tAire, pé uair agus chó minic agus is oiriúnach leis é, a dhearbhú le hordú é bheith nea-dhleathach aon líon le haghaidh iascaireachta mara ná beidh déanta sa tslí sin agus ná beidh mogall den tuise sin ar a laighead air a hordófar san ordú san, d'iompar ar bord aon bháid iascaireachta mara de chuid Shaorstáit Éireann i líomatáiste áirithe no ar bord aon bháid iascaireachta mara eile sa mhéid sin (más aon mhéid é) den líomatáiste sin atá laistigh d'achar aon-chirt iascaigh Shaorstáit Éireann.
(2) Maidir le hordú fén alt so—
(a) féadfa sé baint le níos mó ná aon líomatáiste amháin agus sa chás san féadfaidh forálacha deifriúla do bheith ann alos gach líomatáiste fé leith le n-a mbainfe sé;
(b) féadfar modhanna deifriúla déantóireachta agus tuisí minimum deifriúla d'ordú ann maidir leis na mogaill a húsáidfear chun iascaireacht do dhéanamh ar chineálacha deifriúla d'iasc mhara, i gcóir modhanna deifriúla iascaireachta, chun iascaireacht do dhéanamh i líomatáistí deifriúla agus chun iascaireacht do dhéanamh i rith tréimhsí deifriúla;
(c) féadfa sé a ordú cadé an tslí ina ndéanfar na tuisí minimum mogall a hordófar ann do thomhas chun crícheanna an orduithe sin;
(d) féadfar, i gcás aon tsaghas líon, tuisí minimum deifriúla d'ordú ann i gcóir mogall na líon agus iad tirm no fliuch agus roimh iad do chóireáil no tar éis iad do chóireáil le leasuitheoirí.
(3) Má deintear, tráth ar bith a bheidh ordú fén alt so i bhfeidhm, aon líon d'iompar ar bord aon árthaigh iascaireachta mara contrárdha don ordú san, beidh gach duine fé leith acu so leanas, eadhon, máistir agus únaer an bháid sin, agus a fostóir (más ann dó), ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air.
(4) Má ciontuítear duine i gcionta fén alt so ordóidh an chúirt an líon, gurbh é a iompar an cionta san, do gheallbhruideadh.

4.—(1) Ní bheidh sé dleathach aon fheiste d'iompar ar bord aon bháid iascaireachta mara de chuid Shaorstáit Éireann in áit ar bith ná ar bord aon bháid iascaireachta mara eile laistigh d'achar aon-chirt iascaigh Shaorstáit Éireann is feiste tré n-a bhféadfaí an mogall d'aon chuid de líon a bheidh ar iompar an tráth san ar bord an bháid sin do chumhangú no é laigheadú ar shlí eile.
(2) Má bhíonn aon fheiste ar iompar ar bord báid iascaireachta mara contrárdha don alt so beidh gach duine fé leith so leanas, eadhon, máistir agus únaer an bháid sin, agus a fostóir (más ann dó), ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air.
(3) Má ciontuítear duine i gcionta fén alt so ordóidh an chúirt an fheiste, gurbh é a hiompar an cionta san, agus aon líon dá mbeidh an fheiste ceangailte do gheallbhruideadh.
Toirmeasc ar iasc mhara bheidh ró-bheag do bheith ar seilbh, chun a dhíolta, ar bord bád iascaireachta mara.
5.—(1) Ní bheidh sé dleathach aon iasc mara bheidh ró-bheag do bheith ar seilbh, chun a dhíolta, ar bord aon bháid iascaireachta mara de chuid Shaorstáit Éireann in áit ar bith ná ar bord aon bháid iascaireachta mara eile laistigh d'achar aon-chirt iascaigh Shaorstáit Éireann.
(2) Má sáruítear an t-alt so ar bord aon bháid iascaireachta mara, beidh gach duine fé leith acu so leanas, eadhon, máistir agus únaer an bháid sin, agus a fostóir (más ann dó), ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air.
(3) Má ciontuítear duine i gcionta fén alt so ordóidh an chúirt an t-iasc mara, gurbh é a shealbhú an cionta san, do dhíthiú mara mbeidh an t-iasc mara san díthithe cheana féin.
(4) In aon imeachta fén alt so beidh sealbhú aon éisc mhara ar bord báid iascaireachta mara ina fhianaise prima facie ar an iasc mara san do bheith ar seilbh chun a dhíolta.
Toirmeasc ar iasc mhara bheidh ró-bheag do chalú, do dhíol, etc.
6.—(1) Ní bheidh sé dleathach do dhuine ar bith aon iasc mara bheidh ró-bheag do chalú, do dhíol, do thaisbeáint chun a dhíolta ná do bheith ar seilbh aige chun a dhíolta.
(2) Má dheineann duine ar bith éinní is sárú ar an alt so beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air.
(3) Má ciontuítear duine i gcionta fén alt so, ordóidh an chúirt an t-iasc mara, gurbh é a shealbhú an cionta san, do dhíthiú mara mbeidh an t-iasc san díthithe cheana féin.
(4) Chun crícheanna aon imeachta fén alt so—
(a) má bhíonn iasc mara ina sheilbh ag duine ar bith in aon mhargadh no siopa no ag aon mhangaire cheadúnuithe in áit ar bith beidh san ina fhianaise prima facie ar é bheith ar seilbh chun a dhíolta;
(b) aon iasc mara a gheobhfar i seilbh dhuine ar bith ar chósta na fairrge no ina aice, tuigfear, d'éamais fianaise contrárdha dhó san, gurbh é an duine sin do chaluigh é.
Eisceachtaí chun crícheanna eolaíochta.
7.—Pé uair agus chó minic agus is oiriúnach leis é, féadfaidh an tAire, le deimhniú i scríbhinn agus fé réir pé coinníollacha is oiriúnach leis agus a luadhfa sé sa deimhniú san, a údarú do dhuine ar bith (le n-a n-áirmhítear fostaithe an duine sin a bheidh ag gníomhú fé n-a orduithe) éinní no aon nithe acu san a toirmeasctar le haon cheann de sna forálacha san roimhe seo den Acht so do dhéanamh ar feadh tréimhse áirithe chun crícheanna eolaíochta no chun crícheanna transplandála, agus pé uair a deonfar aon deimhniú den tsórt san do dhuine ar bith, ansan, d'ainneoin éinní atá san Acht so, beidh sé dleathach don duine sin agus (má socruítear amhlaidh leis an deimhniú) d'aon fhostaithe leis an duine sin a bheidh ag gníomhú fé n-a orduithe gach ní no éinní acu san do dhéanamh dá mbeidh údaruithe dhó leis an deimhniú san a dhéanamh.
Feidhm fhorálacha áirithe den Acht chun Iascaigh Mhara do Chaomhnadh, 1933.
8.—(1) Chun an Achta so agus aon orduithe bheidh déanta fé d'fhoirfheidhmiú beidh ag oifigeach caomhanta iascaigh mhara, maidir le haon bhád iascaireachta mara agus le n-a húnaer, le n-a máistir no le n-a fuirinn, na comhachta céanna bronntar ar oifigeach chaomhanta iascaigh mhara le fo-alt (1) d'alt 7 den Acht chun Iascaigh Mhara do Chaomhnadh, 1933 (Uimh. 53 de 1933), chun an Achta san is déanaí luaidhtear d'fhoirfheidhmiú, agus beidh feidhm dá réir sin ag fo-ailt (2) agus (3) den alt san 7 agus ag alt 8 den Acht san is déanaí luaidhtear.
(2) Beidh feidhm ag ailt 11, 12, 13 agus 16 den Acht chun Iascaigh Mhara do Chaomhnadh, 1933, maidir le cionta fé aon alt den Acht so fé mar atá feidhm acu maidir le cionta fé aon alt den Acht san a céad-luaidhtear.
Comhachta chun iasc, etc., d'iniúchadh, do scrúdú, agus do choinneáil.
9.—(1) Tugtar údarás agus comhacht leis seo do gach oifigeach caomhanta iascaigh mhara chun gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) éinne bheidh ag iompar no a creidfear a bheith ag iompar éisc mhara d'aon tsaghas do stop agus do chuardach agus aon iasc mara a gheobhfar ar iompar ag an duine sin d'iniúchadh agus, chuige sin, aon fheithicil no pacáiste ina mbeidh an t-iasc mara san á iompar, no ina bhféadfa sé bheith no ina gcreidfear é bheith á iompar, d'oscailt agus do chuardach;
(b) dul isteach agus saor-chead istigh do bheith aige gach tráth réasúnta—
(i) in aon áitreabh ina ndeintear no ina gcreidtear go ndeintear iasc do dhíol, no do choimeád no do thaisbeáint no do stóráil chun a dhíolta, no
(ii) in áitreabh éinne bhíonn ag iompar earraí ar luach saothair, no
(iii) in aon phiara, cé, caladh, fánán, duga no áitreabh duga, no
(iv) in aon luing, bád, bhaigín traenach, laraí, cairt no árthach no feithicil eile a húsáidtear chun earraí d'iompar;
(c) an t-iasc mara uile do gheobhfar in áit ar bith dá n-údaruítear dó leis an alt so dul isteach ann do scrúdú agus, chuige sin, aon phacáiste gheobhfar san áit sin agus ina mbeidh iasc mara no ina gcreidfear iasc mara do bheith d'oscailt;
(d) aon bhád, báirse, curach, no árthach eile a húsáidtear no a creidtear a húsáidtear le haghaidh iascaireachta no ina mbeidh iasc mara bheidh ró-bheag no go mbeifear in amhrus iasc mara bheidh ró-bheag a bheith ann do stop, dul isteach ann agus é chuardach ar aon chuid den fhairrge no ar a cladaigh, agus an t-iasc go léir agus na líonta agus na gléasanna eile go léir a húsáidtear chun iascaireachta agus a gheobhfar ann do scrúdú, agus, chuige sin, aon phacáiste ina mbeidh aon iasc, líonta, no gléasanna eile mar adubhradh no go mbeifear in amhrus san do bheith ann d'oscailt;
(e) aon iasc mara (maraon le haon phacáiste no d'éamais aon phacáiste ina mbeidh an céanna) a gheobhfar i gcúrsa aon chomhachta d'fheidhmiú dá mbronntar leis an alt so, agus go mbeidh cionta fén Acht so á dhéanamh no go mbeifear in amhrus cionta fén Acht so do bheith á dhéanamh maidir leis, do thógaint, d'aistriú agus do choinneáil ina choimeád;
(f) aon líon no gléas eile a húsáidtear chun iascaireachta no aon earra a dlightear no a creidtear a dlightear a gheallbhruideadh fén Acht so do thógaint, d'aistriú, agus do choinneáil ina choimeád;
(g) ainm agus seoladh an duine go mbeidh aon iasc mara, no aon earra eile a húdaruítear don oifigeach san leis an alt so a scrúdú, ina choimeád aige d'éileamh agus do thógaint, agus fós ainm agus seoladh únaera an éise mhara san no na hearra eile sin d'éileamh agus do thógaint ón duine sin.
(2) Nuair a choinneoidh oifigeach caomhanta iascaigh mhara aon iasc mara no earra eile ina choimeád fé údarás an ailt seo déanfaidh, chó luath agus a bheidh caoi ann chuige sin, na nithe sin is ceart chun a chur fé ndeár go ndeighleálfar do réir dlí leis an duine bheidh ciontach sa chionta no creidfear a bheith ciontach sa chionta do rinneadh no creidfear do rinneadh maidir leis an iasc mara san no leis an earra eile sin.
(3) Má choinníonn oifigeach caomhanta iascaigh mhara aon iasc mara ina choimeád fé údarás an ailt seo agus gur deallrathach go dtiocfaidh an t-iasc mara san chun bheith neamhoiriúnach mar bhia do dhaoine sara mbeidh caoi ag aon chúirt chun deighleáil leis an scéal, taisbeánfa sé an t-iasc mara san d'Fheadhmannach Síochána agus dítheoidh sé an t-iasc mara san má údaruíonn an Feadhmannach Síochána san dó déanamh amhlaidh.
(4) Másé tuairim Fheadhmannaigh Shíochána, dá dtaisbeánfar aon iasc mara do réir an ailt seo, gur cheart an t-iasc mara do dhíthiú toisc cúrsaí an cháis, bhéarfaidh don oifigeach chaomhanta iascaigh mhara thaisbeánfaidh an t-iasc mara deimhniú i scríbhinn ag tabhairt tuairisce ar an iasc mara agus ar aon mharcanna, nithe nea-choitianta no nithe eile maidir leis an iasc mara san a thaisbeánfaidh an t-oifigeach san dó agus á údarú don oifigeach san an t-iasc mara do dhíthiú, agus beidh an deimhniú san ina fhianaise dho-chlaoidhte i ngach cúirt ar gach fíoras den tsórt san adubhradh a bheidh luaidhte ann.
(5) Ní bheidh duine ar bith freagarthach in aon chaillteanas ná damáiste thiocfaidh de dheascaibh no i gcúrsa aon chomhachta dá mbronntar air leis an alt so d'fheidhmiú marab é an duine sin fé ndeár, agus san gan chúis gan abhar no go mailíseach, an caillteanas no an damáiste sin do thárlachtaint.
(6) Gach duine—
(a) bhacfaidh no choiscfidh aon oifigeach caomhanta iascaigh mhara agus an t-oifigeach san ag feidhmiú aon chomhachta dá mbronntar ar an oifigeach san leis an alt so, no
(b) dhiúltóidh no go dteipfidh air a ainm agus a sheoladh do thabhairt uaidh nuair éileoidh oifigeach caomhanta iascaigh mhara a ainm agus a sheoladh air go dleathach fén alt so, no bhéarfaidh uaidh ainm no seoladh bheidh bréagach no mí-threorach, no
(c) dhiúltóidh no go dteipfidh air, nuair éileoidh oifigeach caomhanta iascaigh mhara ainm agus seoladh éinne eile air go dleathach fén alt so, an ainm no an seoladh san do thabhairt uaidh agus fios na hainme agus an tseolta san aige, no bhéarfaidh uaidh ainm no seoladh bheidh bréagach no mí-threorach,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air no, más rogha leis an gcúirt é, príosúntacht ar feadh aon téarma nach sia ná dhá mhí.
(7) Má dheineann duine ar bith, go n-éileoidh oifigeach caomhanta iascaigh mhara go dleathach air fén alt so a ainm agus a sheoladh do thabhairt uaidh, diúltú dá ainm agus dá sheoladh do thabhairt uaidh no má thugann uaidh, mar a ainm no mar a sheoladh, ainm no seoladh a chreidfidh an t-oifigeach san do réir réasúin a bheith bréagach no mí-threorach, féadfaidh an t-oifigeach san, gan barántas, an duine sin a ghabháil agus, sa chás san, bhéarfaidh, chó luath agus is féidir é, i láthair breithiún den Chúirt Dúithche é no, mara mbeidh aon bhreitheamh den tsórt san ar fáil láithreach, i láthair Fheadhmannaigh Shíochána, agus leis sin deighleálfaidh an breitheamh no an Feadhmannach Síochána san leis an duine sin do réir dlí.

10.—Nuair a dhéanfaidh cúirt aon líon no feiste do gheallbhruideadh fén Acht so cuirfidh an tAire an líon no an feiste sin de láimh i pé slí is oiriúnach leis, agus déanfar aon airgead a gheobhfar de dhruim aon churtha de láimh den tsórt san d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste i pé slí ordóidh an tAire Airgid.
Forálacha maidir le horduithe.
11.—(1) Féadfaidh an tAire, le hordú, aon ordú dhéanfa sé fén Acht so (le n-a n-áirmhítear an fo-alt so) do cheiliúradh no do leasú.
(2) Gach ordú dhéanfaidh an tAire fén Acht so (le n-a n-áirmhítear an t-alt so)—
(a) foillseofar san Iris Oifigiúil é chó luath agus is féidir é tar éis a dhéanta, agus
(b) luadhfar ann an dáta (nach luatha na ceithre lá déag tar éis an orduithe sin d'fhoillsiú san Iris Oifigiúil) ar a dtiocfaidh an t-ordú san i bhfeidhm.
Ciontaí cóluchtaí corpruithe.
12.—Má dheineann cólucht corpruithe cionta fé aon alt den Acht so agus go gcruthófar go ndearnadh amhlaidh é le toiliú no le ceadú éinne, no gur cuireadh a dhéanamh in usacht le haon fhaillí i bpáirt éinne, is stiúrthóir no bainisteoir ar an gcólucht chorpruithe sin no is rúnaí no oifigeach eile dhó, tuigfear freisin an stiúrthóir, an bainisteoir, an rúnaí no an t-oifigeach eile sin do bheith ciontach sa chionta san agus féadfar imeachta do bhunú ina choinnibh agus é phionósú dá réir sin.

13.—Ní léireofar éinní atá san Acht so mar ní chuireann teora le hoibriú no dheineann deifir d'oibriú na nAchtanna Iascaigh, 1842 go 1935, i slí ar bith.
Leathnú ar an mbrí atá le hiasc sna hAchtanna Iascaigh, 1842 go 1935.
14.—Gach áit ina bhfuil an focal “fish” no an focal “iasc” sna hAchtanna Iascaigh, 1842 go 1935, léireofar iad mar fhocail fholuíonn gach blaosc-iasc agus mollus a gheibhtear sa bhfairrge.

15.—Sa mhéid go gceadóidh an tAire Airgid é, is amach as airgead a sholáthróidh an tOireachtas a híocfar na costaisí uile fé n-a raghfar chun an Achta so do chur i bhfeidhm.

SEA FISHERIES (PROTECTION Of IMMATURE FISH) ACT, 1937.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Agriculture;
the expression “sea-fish” means fish of any kind (except salmon and fresh water eels) found in the sea and whether fresh or in other condition, and includes crustaceans and molluscs found in the sea;
the word “net” means any trawl, seine or other net towed or hauled, or intended to be towed or hauled, on or near the bottom of the sea;
the expression “sea-fishing” means fishing for or taking sea-fish in tidal waters;
the expression “sea-fishing boat” means any ship, boat or other vessel of whatsoever kind used for sea-fishing, and includes any vessel or boat used for the treatment of fish or partly or wholly for the transport of fish;
the expression “Saorstát Eireann sea-fishing boat” means a sea-fishing boat which is either—
(a) a boat registered in Saorstát Eireann under the Merchant Shipping Acts, 1894 to 1933, or
(b) a boat the owner, or, if there is more than one owner, the managing owner of which resides or has his principal place of business in Saorstát Eireann;
the expression “the exclusive fishery limits of Saorstát Eireann” means that portion of the seas within which citizens of Saorstát Eireann have, by international law, the exclusive right of fishing, and, where such portion is defined by the terms of any convention, treaty or arrangement for the time being in force made between Saorstát Eireann and any other State, includes as regards the ships and subjects of such State the portion so defined;
the expression “the master” when used in relation to a sea-fishing boat means the master, skipper or other person for the time being in charge of such boat;
the expression “sea fisheries protection officer” means a person who is a sea fisheries protection officer for the purposes of the Sea Fisheries Protection Act, 1933 (No. 53 of 1933).
Under-sized fish.
2.—(1) The Minister may, whenever and so often as he thinks fit, by order declare that any specified kind of sea-fish which, when measured in the manner directed by such order, is less in dimension than the specified measurements, shall be, for the purposes of this Act, undersized, and whenever any order is made under this section in relation to any particular kind of sea-fish, then, so long as such order is in force, every sea-fish of that kind which is less in dimension than the specified measurements shall be, for the purposes of this Act, undersized.
(2) An order made under this section in relation to sea-fish of a particular kind may specify different lengths in relation to such sea-fish which are either whole or have any parts removed.
(3) An order under this section may relate to different kinds of sea-fish and in that case may contain different provisions in relation to each kind of sea-fish to which the order relates.
Restriction on carriage of fishing nets on board sea-fishing boats.
3.—(1) The Minister may, whenever and so often as he thinks fit, by order declare it to be unlawful to carry, on board any Saorstát Eireann sea-fishing boat in a specified area or on board any other sea-fishing boat in so much (if any) of that area as is within the exclusive fishery limits of Saorstát Eireann, any net for sea-fishing which is not constructed in such manner and has not a mesh of at least such size as may be specified in such order.
(2) An order under this section—
(a) may relate to more than one area, and in that case may contain different provisions in respect of each area to which it relates;
(b) may specify different modes of construction and different minimum sizes of mesh for fishing for different kinds of sea-fish, for different methods of fishing, for fishing in different areas and for fishing during different periods;
(c) may direct the manner in which the minimum sizes of mesh specified in such order are to be measured for the purposes of such order;
(d) may, in the case of any class of nets, specify different minimum sizes for the mesh of the nets when dry or wet and before or after treatment with preservatives.
(3) If, whenever an order under this section is in force, any net is carried on board any sea-fishing vessel in contravention of such order, each of the following persons, namely, the master, the owner and the charterer (if any) of such boat, shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
(4) Where a person is convicted of an offence under this section the court shall order the net, the carriage whereof constituted such offence, to be forfeited.
Restriction on carriage of devices for obstructing meshes of net.
4.—(1) It shall not be lawful to carry, on board any Saorstát Eireann sea-fishing boat anywhere or on board any other sea-fishing boat within the exclusive fishery limits of Saorstát Eireann, any device by means of which the mesh of any part of a net then carried on board such boat could be obstructed or otherwise in effect diminished.
(2) If any device is carried on board a sea-fishing boat in contravention of this section, each of the following persons, namely, the master, the owner and the charterer (if any) of such boat, shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
(3) Where a person is convicted of an offence under this section the court shall order the device, the carriage whereof constituted such offence, and any net to which the device is attached, to be forfeited.
Prohibition of having in possession for sale on board sea-fishing boats undersized sea-fish.
5.—(1) It shall not be lawful to have in possession for the purposes of sale, on board any Saorstát Eireann sea-fishing boat anywhere or on board any other sea-fishing boat within the exclusive fishery limits of Saorstát Eireann, any undersized sea-fish.
(2) If there is a contravention on board any sea-fishing boat of this section, each of the following persons, namely, the master, the owner and the charterer (if any) of such boat shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
(3) Where a person is convicted of an offence under this section the court shall order the sea-fish, the possession whereof constituted such offence, to be destroyed unless such sea-fish have been previously destroyed.
(4) In any proceedings under this section the possession of any sea-fish on board a sea-fishing boat shall be prima facie evidence of possession of such sea-fish for the purposes of sale.
Prohibition on landing, selling, etc., undersized sea-fish.
6.—(1) It shall not be lawful for any person to land, sell, expose for sale, or have in possession for the purposes of sale any undersized sea-fish.
(2) If any person acts in contravention of this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
(3) Where a person is convicted of an offence under this section, the court shall order the sea-fish, the possession whereof constituted such offence, to be destroyed unless such fish have been previously destroyed.
(4) For the purposes of any proceedings under this section—
(a) the possession of sea-fish by any person in any market or shop or by any licensed hawker anywhere shall be prima facie evidence of possession for the purposes of sale;
(b) any sea-fish found in the possession of any person on or near the sea coast shall, in the absence of evidence to the contrary, be deemed to have been landed by such person.
Exemptions for scientific purposes.
7.—The Minister may, whenever and so often as he thinks fit, by certificate in writing and subject to such conditions as he thinks fit and specifies in such certificate, authorise any person (including the employees of such person acting under his directions) to do during a specified period, for scientific purposes or for the purposes of transplantation, any one or more of the things prohibited by any of the preceding provisions of this Act, and whenever any such certificate is granted to any person it shall, notwithstanding anything contained in this Act, be lawful for such person and (if the certificate so provides) any employees of such person acting under his directions to do all or any of the things which he is authorised by such certificate to do.
Application of certain provisions of the Sea Fisheries Protection Act, 1933.
8.—(1) A sea fisheries protection officer shall, for the purposes of enforcing this Act and any order made thereunder, have with respect to any sea-fishing boat and the owner, master or crew thereof the like powers as are conferred upon a sea fisheries protection officer by sub-section (1) of section 7 of the Sea Fisheries Protection Act, 1933 (No. 53 of 1933), for the purposes of enforcing the said last-mentioned Act, and sub-sections (2) and (3) of the said section 7 and section 8 of the said last-mentioned Act shall apply accordingly.
(2) Sections 11, 12, 13 and 16 of the Sea Fisheries Protection Act, 1933, shall apply in respect of an offence under any section of this Act in like manner as they apply in respect of an offence under any section of such first-mentioned Act.
Powers of inspection, examination and detention of fish, etc.
9.—(1) Every sea fisheries protection officer is hereby authorised and empowered to do all or any of the following things, that is to say:—
(a) to stop and search any person conveying or believed to be conveying sea-fish of any kind and to inspect any sea-fish which such person is found to be conveying and for that purpose to open and search any vehicle or package in which such sea-fish is or may be or is believed to be conveyed;
(b) at all reasonable times to enter upon and have free access to the interior of—
(i) any premises in which fish is or is believed to be sold, or kept, exposed, or stored for sale, or
(ii) the premises of any person engaged in the business of carrying goods for reward, or
(iii) any pier, quay, wharf, jetty, dock or dock premises, or
(iv) any ship, boat, railway waggon, lorry, cart, or other vessel or vehicle used for the conveyance of goods;
(c) to examine all sea-fish found in any place which he is authorised by this section to enter and for that purpose to open any package found in such place and containing or believed to contain sea-fish;
(d) to stop, enter, and search, on any part of the sea or the shores thereof, any boat, barge, corach, or other vessel used or believed to be used for fishing or containing or suspected of containing undersized sea-fish, and to examine all fish and all nets and other instruments used in fishing found therein, and for that purpose to open any package which contains or is suspected of containing any fish, nets, or other instruments as aforesaid;
(e) to take, remove, and detain in his custody any sea-fish (either together with or without any package in which the same may be contained) found in the course of the exercise of any of the powers conferred by this section in respect of which an offence under this Act is being or is suspected of being committed;
(f) to take, remove, and detain in his custody any net or other instrument used in fishing or any article which is liable or is believed to be liable to forfeiture under this Act;
(g) to demand and take the name and address of the person having custody of any sea-fish or other article which he is authorised under this section to examine, and also to demand and take from such person the name and address of the owner of such sea-fish or other article.
(2) When a sea fisheries protection officer detains in his custody under the authority of this section any sea-fish or other article, he shall as soon as conveniently may be take such steps as may be proper to have the person guilty or believed to be guilty of the offence committed or believed to have been committed in relation to such sea-fish or other article dealt with according to law.
(3) Where a sea fisheries protection officer detains in his custody under the authority of this section any sea-fish and such sea-fish is likely to become unfit for human food before the matter can conveniently be dealt with by any court, he shall produce such sea-fish to a Peace Commissioner, and if authorised so to do by such Peace Commissioner shall destroy such sea-fish.
(4) A Peace Commissioner to whom any sea-fish is produced in pursuance of this section shall, if he is of opinion that the sea-fish ought in the circumstances to be destroyed, give to the sea fisheries protection officer producing the sea-fish a certificate in writing describing the sea-fish and any marks, peculiarities, or other particulars thereof pointed out to him by such officer and authorising such officer to destroy the sea-fish, which certificate shall be conclusive evidence in every court of all such matters of fact as aforesaid stated therein.
(5) No person shall be liable for any loss or damage occasioned by or in the course of the exercise of any of the powers conferred on him by this section unless such loss or damage was caused by such person wantonly or maliciously.
(6) Every person—
(a) who obstructs or impedes any sea fisheries protection officer in the exercise of any of the powers conferred on such officer by this section, or
(b) who, when his name and address is lawfully demanded of him by a sea fisheries protection officer under this section, refuses or fails to give his name and address or gives a name or address which is false or misleading, or
(c) who, when the name and address of any other person is lawfully demanded of him by a sea fisheries protection officer under this section, refuses or fails, knowing such name and address, to give such name or address or gives a name or address which is false or misleading
shall be guilty of an offence under this section and shall be liable on summary conviction to a fine not exceeding ten pounds, or at the discretion of the court, to imprisonment for any term not exceeding two months.
(7) If any person whose name and address is lawfully demanded by a sea fisheries protection officer under this section refuses to give his name and address or gives, as his name or address, a name or address which is reasonably believed by such officer to be false or misleading, such officer may, without warrant, arrest such person and, in that case, shall as soon as may be bring him before a justice of the District Court or, where no such justice is immediately available, a Peace Commissioner, and thereupon such justice or Peace Commissioner shall deal with such person according to law.
Disposal of nets and devices forfeited.
10.—When any net or device is forfeited by a court under this Act such net or device shall be disposed of by the Minister in such manner as he thinks fit, and any moneys arising on any such disposal shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance may direct.
Provisions in relation to orders.
11.—(1) The Minister may by order revoke or amend any order made by him under this Act (including this sub-section).
(2) Every order made by the Minister under this Act (including this section) shall—
(a) be published in the Iris Oifigiúil as soon as may be after it is made, and
(b) shall specify the date (not being earlier than fourteen days after the publication thereof in the Iris Oifigiúil) on which such order is to come into force.
Offences by bodies corporate.
12.—Where an offence under any section of this Act was committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of such body corporate, such director, manager, secretary or other officer shall also be deemed to be guilty of such offence and shall be liable to be proceeded against and punished accordingly.
Saving for Fisheries Acts, 1842 to 1935.
13.—Nothing in this Act shall be construed as limiting or affecting in any way the operation of the Fisheries Acts, 1842 to 1935.
Extension of meaning of fish in Fisheries Acts, 1842 to 1935.
14.—The word “fish” where it occurs in the Fisheries Acts, 1842 to 1935, shall be construed as including all crustaceans and molluscs found in the sea.
Expenses.
15.—All expenses of carrying this Act into execution shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Short title and collective citation.
16.—This Act may be cited as the Sea Fisheries (Protection of Immature Fish) Act, 1937, and the Fisheries Acts, 1842 to 1935, and this Act may be cited together as the Fisheries Acts, 1842 to 1937.
