ACHT RIALUITHE NA SEIRBHÍSE SIBHIALTA, 1923,
ACHTUIGHEADH OIREACHTAS SHAORSTÁIT ÉIREANN MAR LEANAS:—
Féadfidh an Ard-Chomhairle Coimisinéirí Seirbhíse Síbhialta do cheapa.
1.—(1) Beidh sé dleathach don Ard-Chomhairle daoine cearta oiriúnacha do cheapa o am go ham chun bheith ina gCoimisinéirí Seirbhíse Síbhialta (dá ngairmtear “na Coimisinéirí” san Acht so) chun na feidhmeanna a leagtar amach san Acht so do sna Coimisinéirí sin do chó-líona.
(2) Ní bheidh thar trí Coimisinéirí den tsórt san ann aon uair.
(3) Gach duine a ceapfar fén alt so chun bheith ina Choimisinéir beidh sé i seilbh oifige an fhaid is toil leis an Ard-Chomhairle.
Luach saothair Coimisinéirí agus a n-oifigeach.
2.—(1) Gach duine a ceapfar chun bheith ina Choimisinéir fén Acht so gheobha sé pé luach saothair a shocróidh an tAire Airgid.
(2) Ceapfidh an tAire Airgid pé daoine agus pé méid daoine is dó leis is gá chun bheith ina n-oifigigh do sna Coimisinéirí, agus beidh na daoine sin i seilbh oifige ar pé téarmaí agus tabharfar luach saothair dóibh do réir pé rátaí agus ar pé cuma a shocróidh an tAire Airgid.
(3) Déanfar luach saothair na gCoimisinéirí agus a n-oifigeach agus pé costaisí eile a bhainfidh leis an Acht so do chur in éifeacht agus a cheadóidh an tAire Airgid d'íoc as airgead a sholáthróidh an tOireachtas.
Tabharfidh na Coimisinéirí deimhnithe cáilíochta uatha.
3.—(1) Féachfidh na Coimisinéirí isteach i gcáilíochta gach duine a tairgfear chun a cheaptha chun aon phuist sheasmhaigh i Seirbhís Shíbhialta Rialtais Shaorstáit Éireann le n-a mbaineann an tAcht so, agus ní ceapfar éinne amhlaidh mara ndéanfidh ná go dtí go ndéanfidh na Coimisinéirí deimhniú do thabhairt amach ar an gcáilíocht atá aige i gcóir an phuist sin.
(2) Faisneoidh gach deimhniú cáilíochta a thabharfidh na Coimisinéirí amach, ach sa chás go bhforáltar a mhalairt leis an Acht so, go bhfuil an té le n-a mbaineann an deimhniú san tar éis a chur ina luighe ar na Coimisinéirí—
(a) go bhfuil sé laistigh de sna teoranna aois a ceapadh (má ceapadh iad) i gcóir an phuist 'nar tairgeadh é chuige; agus
(b) go bhfuil sé saor o aon aineamh cuirp no galar is dóichí a choiscfadh é ar a dhualgaisí sa phost san do chó-líona sa cheart; agus
(c) go bhfuil caragdar aige den tsórt a dhineann oiriúnach don phost san é; agus
(d) go bhfuil an t-eolas agus an ábaltacht san aige is gá dho a bheith aige chun dul i mbun a dhualgaisí sa phost san.
(3) An té 'na dtabharfidh na Coimisinéirí deimhniú cáilíochta amach ina thaobh ní gá dho deimhniú nua cáilíochta d'fháil má ceaptar é tré n'aistriú no tré n'árdú chun puist is dó leis na Coimisinéirí is cosúil leis an bpost 'na mbeidh deimhniú den tsórt san tabhartha amach ag na Coimisinéirí cheana féin ina chóir, ná chun puist is féidir a líona go dleathach tré dhuine d'árdú do réir gnáis ón aicme no ón ngrád puist 'na mbeidh deimhniú den tsórt san tabhartha amach cheana féin ina chóir.
Tré scrúduithe comórtais a déanfar na ceaptha.
4.—(1) Gan dochar do pé eisceachtaí a dintar no a déanfar leis an Acht so no fé, isé cuma ina ndéanfar gach ceapa chun aon phuist le n-a mbaineann an tAcht so ná tré scrúduithe comórtais a déanfar do réir rialachán a dhéanfidh na Coimisinéirí agus a cheadóidh an tAire Airgid.
(2) Beidh gach scrúdú comórtais den tsórt san (lasmuich de sna heisceachtaí a luaidhtear ina dhiaidh seo san alt so) ar oscailt do sna daoine sin uile gur mian leo dul fén gcéanna agus a rugadh in Éirinn o thúismitheoirí Eireannacha no is daoine clainne dá leithéidí no is saoránaigh de Shaorstát Éireann no is daoine clainne do shaoránaigh den tsórt san, agus a íocfidh na táillí agus 'na mbeidh aca na cáilíochta, maidir le haos, sláinte agus caragdar, a hordófar leis na rialacháin a déanfar fén alt so.
(3) Féadfidh na Coimisinéirí, le cead ón Aire Airgid, tré rialacháin fé leith do dhéanamh, aon scrúdú comórtais den tsórt san do chimeád ar leithligh i gcóir daoine d'aon aicme áirithe no in aon fhostaíocht áirithe no daoine 'na bhfuil cáilíocht speisialta éigin eile den tsórt san acu, agus nuair a socrófar scrúdú do chimeád ar leithligh mar sin ní leigfar d'éinne dul fé ach daoine 'na bhfuil na cáilíochta san fé leith acu.
Gach rialachán speisialta a dhéanfidh na Coimisinéirí fén alt so leagfar é fé bhráid gach Tighe den Oireachtas mí ar a luíod sara ndéanfar an scrúdú ná aon cheann de sna scrúduithe le n-a mbainfidh an rialachán san agus má dhineann an dá Thigh sin, laistigh den lá is fiche a shuidhfidh aon Tigh díobh tar éis an rialachán san do leaga fé bhráid an dá Thigh, rúin do rith chun an rialachán san do chur ar nea-mbrí, beidh an rialachán san ar nea-mbrí, ach ní dhéanfidh an nea-mbríochaint sin dochar ná díth dleathachta d'aon rud ná d'éinní a dineadh fén rialachán san roimhe sin.
Féadfidh na Coimisinéirí rialacháin do dhéanamh.
5.—Féadfidh na Coimisinéirí, le cead ón Aire Airgid agus fé réir forálacha an Achta so, rialacháin do dhéanamh á rá cadí an tslí ina ndéanfar agus cad iad na coiníollacha ar a ndéanfar daoine do leigint chun fostaíochta, seasmhach no sealadach, i Seirbhís Shíbhialta Rialtais Shaorstáit Éireann no chun aon phuist no aicme de phuist sa tseirbhís sin, agus cad iad na coiníollacha ar a ndéanfaidh na Coimisinéirí deimhnithe cáilíochta do thabhairt amach fén Acht so.
Féadfar scrúduithe d'fhágaint ar lár i gcásanna áirithe
6.—Más dó leis an Aire Airgid agus leis an Aire i bhfeighil Roinne Rialtais—
(a) gur cáilíochta a bhaineann i bpáirt no go hiomlán le gairm fé leith no gur cáilíochta fé leith, i bpáirt no go hiomlán, ar aon tslí eile, agus nách cáilíochta is féidir a shaothrú de ghnáth sa tSeirbhís Shíbhialta, na cáilíochta eolais agus ábaltachta a meastar riachtanach i gcóir aon phuist áirithe le n-a mbaineann an tAcht so agus atá sa Roinn Rialtais sin agus má thairgeann an tAire i bhfeighil na Roinne Rialtais sin duine do cheapa chun an phuist sin a bheidh tar éis na cáilíochta san do shaothrú i slite beatha eile; no
(b) go raghadh sé chun leasa don phuiblíocht na rialacha i dtaobh aois agus an scrúdú i gcóir puist den tsórt san roimhráite no aon chuid de d'fhágaint ar lar;
féadfidh na Coimisinéirí, más oiriúnach leo é, a ndeimhniú cáilíochta i gcóir an phuist sin do dheona tar éis fianaise d'fháil a chuirfidh ina luighe ortha go bhfuil an té a tairgeadh a cheapa chun an phuist sin, lán-cháilithe chuige maidir le haos, sláinte, caragdar, eolas agus ábaltacht.
I gcásanna áirithe féadfidh daoine a ceapfar dul i mbun a ndualgaisí sara dtabharfar amach an deimhniú.
7.—Nuair a bheidh duine roghnaithe chun é do cheapa chun puist in aon Roinn Rialtais agus a bheidh sé riachtanach, mar gheall ar staid gnó na Roinne sin, an duine a roghnaíodh mar sin do dhul i mbun a dhualgaisí sara ndéanfidh na Coimisinéirí deimhniú ar a cháilíocht do thabhairt amach, féadfidh an tAire Airgid, más ceart é dar leis agus más deimhin leis gur nithe ná fuil leigheas ag an duine sin ortha fé ndeár an mhoill atá ar an deimhniú san do thabhairt amach, a ordú go mbeidh tuarastal an duine sin iníoctha ón dáta ar a dtosnóidh sé ar a dhualgaisí do chó-líona.
Cuirfidh na Coimisinéirí scrúduithe ar siúl i gcóir an Airm, na Póilíneachta agus postanna fé údaráis áitiúla má éilítear san ortha.
8.—(1) Cuirfidh na Coimisinéirí ar siúl gach scrúdú i Saorstát Éireann nách foláir do Choimisinéirí Seirbhíse Síbhialta fé láthair, do réir aon reachta, é do chur ar siúl agus, má éilíonn an Ard-Chomhairle ortha é, cuirfid ar siúl leis, scrúduithe comórtais agus scrúduithe tástála, fé mar a ráineoidh, i gcóir gach puist no aon phuist i bhFórsaí Cosanta Shaorstáit Éireann, no i bPóilíneacht Chathrach Bhaile Atha Cliath, sa Ghárda Síochána no in aon fhórsa eile póilíneachta i Saorstát Éireann no i seirbhís aon údaráis no údarásanna áitiúla agus gach scrúdú eile no aon scrúdú eile a éileoidh an Ard-Chomhairle o am go ham.
(2) Féadfidh na Coimisinéirí, le cead ón Aire Airgid, rialacháin do dhéanamh o am go ham chun stiúrtha scrúduithe a bheidh ar siúl acu fén alt so.
Féadfidh an tAire Airgid rialacháin do dhéanamh.
9.—Féadfidh an tAire Airgid rialacháin do dhéanamh o am go ham chun Seirbhís Shíbhialta Rialtais Shaorstáit Éireann do stiúra agus ag socrú i dtaobh na daoine uile ar fostú sa tseirbhís sin, go seasmhach no go sealadach, do roinnt ina n-aicmí agus i dtaobh a luach saothair agus coiníollacha agus téarmaí eile a seirbhíse; agus féadfa sé aon rialachán den tsórt san d'athghairm no d'atharú aon uair.
Cad leis go mbainfidh an tAcht.
10.—(1) Bainfidh an tAcht so le gach post i Seirbhís Shíbhialta Rialtais Shaorstáit Éireann lasmuich d'aon cheann de sna puist a bheidh de thurus na huaire sa Sceideal a ghabhann leis an Acht so.
(2) Féadfidh na Coimisinéirí, le hordú a déanfar ar iarrtas an Aire a bheidh i bhfeighil aon Roinne Rialtais, agus le cead ón Aire Airgid, aon phost sa Roinn sin do chur leis an Sceideal a ghabhann leis an Acht so no aon phost sa Roinn sin do bhaint as an Sceideal san.
Foillseofar orduithe agus rialacháin san “Iris Oifigiúil.”
11.—(1) Gach ordú agus rialachán a dhéanfidh na Coimisinéirí no an tAire Airgid fén Acht so, foillseofar iad san “Iris Oifigiúil” láithreach tar éis iad do bheith déanta.
(2) Déanfidh na Coimisinéirí fógra i dtaobh gach ceapa agus gach árdú puist 'na mbeidh deimhniú cáilíochta ina thaobh tabhartha amach aca fén Acht so d'fhoillsiú san “Iris Oifigiúil” láithreach tar éis dóibh an deimhniú san do thabhairt amach.
Gearr-theideal agus buaine.
12.—(1) Féadfar Acht Rialuithe na Seirbhíse Síbhialta, 1923, do ghairm den Acht so.
(2) Leanfidh an tAcht so i bhfeidhm go ceann sé mhí chaileandair tar éis a rithte agus ragha sé in éag ansan.
SCEIDEAL.
1. Gach post go gceaptar a shealbhóir chuige ag Seanascal Shaorstáit Éireann ar chomhairle na hArd-Chomhairle.
2. Gach post go gceaptar a shealbhóir chuige ag an Ard-Chomhairle féin.
3. An tArd-Scrúdóir.
4. Puist nea-mbunuithe Beirtheoirí, Dóirseoirí, Teachtairí, Fairtheoirí Oíche, Ban-scrubairí, Glantóirí, agus gach duine eile a tógtar in aimsir chun fo-dhualgaisí amháin do chó-líona no chun gnáth-shaothar do dhéanamh fé mar is gá é.

CIVIL SERVICE REGULATION ACT, 1923.
Executive Council may appoint Civil Service Commissioners.
1.—(1) It shall be lawful for the Executive Council from time to time to appoint fit and proper persons to be Civil Service Commissioners (in this Act referred to as “the Commissioners”) to fulfil the functions assigned to such Commissioners by this Act.
(2) The number of such Commissioners shall not at any time be more than three.
(3) Every person appointed under this section to be a Commissioner shall hold office during the pleasure of the Executive Council.
Remuneration of Commissioners and their officers.
2.—(1) Every person appointed to be a Commissioner under this Act shall receive such remuneration as the Minister for Finance shall determine.
(2) The Minister for Finance shall appoint such and so many persons as he may consider necessary to be officers of the Commissioners, and such persons shall hold office upon such terms and be remunerated at such rates and in such manner as the Minister for Finance shall determine.
(3) The remuneration of the Commissioners and their officers and such other expenses of carrying this Act into effect as may be sanctioned by the Minister for Finance shall be paid out of moneys provided by the Oireachtas.
The Commissioners to give certificates of qualification.
3.—(1) The Commissioners shall inquire into the qualifications of every person proposed to be appointed to any permanent situation in the Civil Service of the Government of Saorstát Eireann to which this Act applies, and no person shall be so appointed unless and until a certificate of his qualification for such situation has been issued by the Commissioners.
(2) Every certificate of qualification issued by the Commissioners shall, save as is otherwise provided by this Act, declare that the person to whom such certificate relates has satisfied the Commissioners that—
(a) he is within the limits of age (if any) prescribed for the situation to which it is proposed to appoint him; and
(b) he is free from any physical defect or disease which would be likely to interfere with the proper discharge of his duties in that situation; and
(c) his character is such as to qualify him for such situation; and
(d) he possesses the requisite knowledge and ability to enter on the discharge of his duties in that situation.
(3) It shall not be necessary for any person in respect of whom a certificate of qualification shall have been issued by the Commissioners to obtain a new certificate of qualification on being appointed either by transfer or promotion to a situation which, in the opinion of the Commissioners, is similar to the situation in respect of which such certificate shall have already been issued or may properly be filled in customary course of promotion from the class or grade of situation in respect of which such certificate shall have already been issued.
Appointments to be made by competitive examinations.
4.—(1) Subject to such exceptions as are or may be made by or under this Act, every appointment to any situation to which this Act applies shall be made by means of competitive examinations conducted according to regulations to be made by the Commissioners with the consent of the Minister for Finance.
(2) Every such competitive examination (with the exceptions hereinafter in this section mentioned) shall be open to all persons desiring to attend the same who are born in Ireland of Irish parents or who are the children of such persons or who are citizens of Saorstát Eireann or the children of such citizens, and who pay the fees, and possess the qualifications as to age, health and character, prescribed by the regulations made under this section.
(3) The Commissioners may with the consent of the Minister for Finance by special regulation confine any such competitive examination to persons belonging to a specified class or being in a particular employment or possessing some other similar special qualification, and where an examination is so confined only persons possessing such special qualifications shall be admitted thereto.
Every special regulation made by the Commissioners under this section shall be laid before each House of the Oireachtas at least one month before the examination or any of the examinations to which such regulation relates is held and if both such Houses shall, within the next twenty-one days on which either House has sat after such regulation is laid before both Houses, pass resolutions annulling such regulation, such regulation shall be annulled, but such annulment shall not prejudice or invalidate any matter or thing previously done under such regulation.
The Commissioners may make regulations.
5.—The Commissioners may, with the consent of the Minister for Finance and subject to the provisions of this Act, make regulations prescribing the manner in which and the conditions under which persons are to be admitted either permanently or temporarily to employment in the Civil Service of the Government of Saorstát Eireann or to any situation or class of situations therein, and the conditions on which the Commissioners may issue certificates of qualification under this Act.
Examinations may be dispensed with in certain cases.
6.—In case the Minister for Finance and the Minister in charge of a Government Department shall consider—
(a) that the qualifications in respect of knowledge and ability deemed requisite for any particular situation to which this Act applies in that Government Department are wholly or in part professional or otherwise peculiar and not ordinarily to be acquired in the Civil Service, and the Minister in charge of such Government Department shall propose to appoint to such situation a person who has acquired such qualifications in other pursuits; or
(b) that it would be for the public interest that the rules in regard to age and the whole or any part of the examination for such a situation as aforesaid should be dispensed with;
the Commissioners may, if they think fit, grant their certificate of qualification in respect of such situation upon any evidence which is satisfactory to them that the person proposed to be appointed to such situation is fully qualified therefor in respect of age, health, character, knowledge and ability.
In certain cases persons appointed may enter on duties before certificate issued.
7.—When a person has been selected for appointment to a situation in any Government Department, and the state of business in that Department makes it necessary that the person so selected should enter upon his duties before the issue by the Commissioners of a certificate of his qualification, the Minister for Finance may, if he thinks proper and is satisfied that the delay in the issue of such certificate is wholly due to causes beyond the control of such person, direct that the salary of such person shall be payable from the date on which he commences the discharge of his duties.
The Commissioners to hold examinations for Army, Police and situations under local authorities if required.
8.—(1) The Commissioners shall conduct all examinations in Saorstat Eireann which are now by any statute required to be conducted by Civil Service Commissioners and also shall if so required by the Executive Council conduct examinations, competitive or qualifying as the case may be, for all or any situations in the Defence Forces of Saorstát Eireann, or in the Dublin Metropolitan Police, the Civic Guard or any other police force in Saorstát Eireann or in the service of any local authority or authorities and all or any such other examinations as the Executive Council may from time to time require.
(2) The Commissioners may with the consent of the Minister for Finance from time to time make regulations for the conduct of examinations to be held by them under this section.
Minister for Finance may make regulations.
9.—The Minister for Finance may from time to time make regulations for controlling the Civil Service of the Government of Saorstát Eireann and providing for the classification, remuneration and other conditions and terms of service of all persons employed therein whether permanently or temporarily; and may at any time revoke or vary any such regulation.
Application of Act.
10.—(1) This Act shall apply to every situation in the Civil Service of the Government of Saorstát Eireann other than any of the situations for the time being comprised in the Schedule to this Act.
(2) The Commissioners may by order made on the application of the Minister in charge of any Government Department and with the consent of the Minister for Finance add any situation in that Department to the Schedule to this Act or withdraw any situation in that Department from such Schedule.
Orders and regulations to be published in “Iris Oifigiúil.”
11.—(1) All orders and regulations made under this Act by the Commissioners or by the Minister for Finance shall be published in “Iris Oifigiúil” immediately after they are made.
(2) Notice of every appointment and promotion with respect to which a certificate of qualification is issued by the Commissioners under this Act shall be published by them in “Iris Oifigiúil” immediately after the issue of such certificate.
Short title and duration.
12.—(1) This Act may be cited as the “Civil Service Regulation Act, 1923.”
(2) This Act shall continue in force for six calendar months after the passing thereof and shall then expire.
SCHEDULE.
1. All situations to which the holder is appointed by the Governor-General of the Irish Free State on the advice of the Executive Council.
2. All situations to which the holder is appointed directly by the Executive Council.
3. The Comptroller and Auditor-General.
4. The unestablished situations of Porters, Door-keepers, Messengers, Night-watchmen, Charwomen, Cleaners, and all other persons hired to perform only subordinate duties or ordinary labour as it is required.
5. Artisans and other skilled labourers employed in an unestablished capacity.
6. All situations in the Dublin Metropolitan Police, the Civic Guard, or any other police force.
