PHARMACOPOEIA ACT, 1931.
Definitions.
1.—In this Act—
the expression “the Council” means the Medical Registration Council;
the expression “the British Pharmacopoeia” means the book published in Great Britain under that name by the General Council of Medical Education and Registration of the United Kingdom in pursuance of the statutory provisions in that behalf.
Saorstát Eireann Pharmacopoeia.
2.—(1) The British Pharmacopoeia for the time being in force in Great Britain shall, with such modifications (if any) as may be made therein by the Council under this section and as are for the time being in force, be the Saorstát Eireann Pharmacopoeia.
(2) The Council may, by rules, do any of the following things, that is to say:—
(a) make such modifications (by way of deletion, addition, or amendment) in the British Pharmacopoeia for the time being in force in Great Britain as it thinks fit;
(b) revoke or amend any rule previously made by it under this sub-section.
(3) Whenever the Council makes any rule under this section it shall cause such rule to be published in the Iris Oifigiúil as soon as may be after it is made, and every such rule shall come into operation on such date, subsequent to the publication in the Iris Oifigiúil, as is specified in such rule or, where no such date is so specified, on the date of such publication.
Evidence.
3.—(1) Prima facie evidence of any rule made by the Council under this Act may be given in all Courts of Justice and in all legal proceedings by the production of a copy of the Iris Oifigiúil purporting to contain such rule.
(2) A certificate endorsed on a book purporting; to be a copy of the British Pharmacopoeia and purporting to be signed by the registrar of the Council that such book is a copy of the British Pharmacopoeia in force in Great Britain on a specified day or days or during a specified period shall until the contrary is proved, be evidence in all Courts of Justice and in all legal proceedings of the facts so certified, and it shall not be necessary to prove the signature of such registrar or that he was in fact such registrar.
Prohibition of compounding certain medicines except in accordance with Saorstát Eireann Pharmacopoeia.
4.—(1) It shall not be lawful for any person to compound any medicines of the Saorstát Eireann Pharmacopoeia except according to the formularies of such Pharmacopoeia.
(2) If any person acts in contravention of this section he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Repeals.
5.—The enactment mentioned in the Schedule to this Act is hereby repealed to the extent specified in the third column to that Schedule.
Short title.
6.—This Act may be cited as the Pharmacopoeia Act, 1931.
