LOCAL GOVERNMENT ELECTORS REGISTRATION ACT, 1924.


AN ACT TO AMEND THE LAW RELATING TO THE PREPARATION OF THE REGISTER OF LOCAL GOVERNMENT ELECTORS AND FOR OTHER PURPOSES RELATING TO REGISTRATION OF SUCH ELECTORS. [21st March, 1924] BE IT ENACTED BY THE OIREACHTAS OF SAORSTAT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—:

the expression “Principal Act” means the Electoral Act, 1923 (No. 12 of 1923);

[GA]

the expression “local government elector” means a person entitled to vote at an election of members or a member of the council of a county, county borough, or urban or rural district, a board of poor-law guardians, or the board of commissioners of any town;

all words and expressions in this Act which are also used in the Principal Act shall, unless the context otherwise requires, have the same meaning in this Act as in the Principal Act.

Second register of electors to include local government electors.

2.—The second register of electors to be prepared pursuant to the Principal Act, that is to say the register of electors who are qualified on the 15th day of November, 1923, shall in addition to the matters prescribed by or under the Principal Act, contain in the prescribed form the names of all persons who under the existing law as amended by this Act are qualified on the 15th day of November, 1923, to be registered as local government electors.

Alteration of the qualifying period for local government electors.

3.—(1) So much of sub-section (11) of section 44 of the Representation of the People Act, 1918, as enacts that the qualifying period shall be a period of six months ending on the 15th dayof July is hereby repealed and in lieu thereof it is hereby enacted that the qualifying period for local government electors shall be a period of six months ending on the 15th day of November and including that day.

(2) This section shall come into operation and take effect as on and from the 14th day of July, 1923.

Application of Electoral Act, 1923, to registration of local government electors.

4.—(1) Parts II. and VIII. and Schedules I. and IX. of the Principal Act shall apply to the registration of local government electors in the like manner as they apply to the registration of Dáil electors but with the following modifications:—

(a) the provisions relating to the preparation of a postal voters list shall not apply, and

[GA]

(b) the registration officer shall in addition to the duties imposed on him by Rule 22 of Schedule I., make such alterations and corrections in the electors lists as he thinks necessary in order to secure that no person is registered more than once as a local government elector in any county, district, borough, poor law or town electoral area.

(2) So much of any enactment relating to the registration of local government electors as is inconsistent with Parts II. and VIII. and Schedules I. and IX. of the Principal Act shall henceforth not apply to the registration of local government electors.

Adaptation of enactments relating to local government electors.

5.—(1) The Minister may by order make such adaptations of and modifications in any enactment relating to the registration of local government electors (including the Principal Act as applied by this Act) as may appear to him to be necessary for the proper registration of local government electors pursuant to this Act, but so that no such adaptation or modification shall operate to confer on or to take from any person the right to be registered as a local government elector.

(2) Section 64 of the Principal Act shall apply to every order made under this section.

Short title.

6.—This Act may be cited as the Local Government Electors Registration Act, 1924.
