ACHT UM CHÚITEAMH STÁT-SHEIRBHÍSE (OIFIGIGH AISTRITHE), 1929.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an Connra” Connra 1921;
cialluíonn an abairt “an tAire” an tAire Airgid; agus
foluíonn an abairt “oifigeach aistrithe” gach oifigeach, státsheirbhíseach, no seirbhíseach puiblí eile do haistríodh, de bhua aon aistriú seirbhísí, o sheirbhís Rialtais Ríocht Aontuithe na Breataine Móire agus na hÉireann do bhí ann le déanaí go dtí seirbhís Rialtais Shealadaigh na hÉireann no go dtí seirbhís Rialtais Shaorstáit Éireann no do haistríodh roimhe seo no a haistreofar ina dhiaidh seo o sheirbhís Rialtais Ríocht Aontuithe na Breataine Móire agus Thuaiscirt Éireann go dtí seirbhís Rialtais Shaorstáit Éireann, ach ní fholuíonn sí aon bhall d'fhórsa phóilíneachta ná éinne gur dhin Rialtas na Ríochta Aontuithe sin do bhí ann le déanaí a sheirbhísí do thabhairt ar iasacht don Rialtas Sealadach san.
An Có-aontú do dhaingniú.
2.—Daingnítear leis seo an Có-aontú atá leagtha amach sa Chéad Sceideal a ghabhann leis an Acht so, eadhon, có-aontú le n-a léirítear agus le n-a bhfoirlíontar Airtiogal 10 den Chonnra, agus beidh éifeacht ag an gConnra dá réir sin.
Bord na Stát-Sheirbhíse (Cúiteamh) do bhunú.
3.—(1) Chó luath agus is féidir é tar éis an Achta so do rith bunófar do réir an Achta so bord ar a dtabharfar mar ainm agus mar theideal Bord na Stát-Sheirbhíse (Cúiteamh) (dá ngairmtear an Bord san Acht so) chun na comhachta agus na dlighinsí a bronntar ar an mBord leis an Acht so d'fheidhmiú.
(2) Beidh an Bord có-dhéanta—
(a) de Chathaoirleach (dá ngairmtear an Cathaoirleach san Acht so) a cheapfaidh an Seanascal ar chomhairle na hArd-Chomhairle, agus
(b) de phaineul (dá ngairmtear paineul an Aire san Acht so) de chúigear a cheapfaidh an tAire do réir an Achta so, agus
(c) de phaineul (dá ngairmtear paineul na n-oifigeach san Acht so) de chúigear is fiche, a cuirfear le chéile agus a cimeádfar ar bun sa tslí a horduítear leis an Acht so.
(3) Ag gach suidhe bheidh ag an mBord chun crícheanna an Achta so beidh an Bord có-dhéanta den Chathaoirleach, de bheirt bhall a gheobhfar as paineul an Aire agus de bheirt bhall a gheobhfar as paineul na n-oifigeach.
Cathaoirleach an Bhuird.
4.—(1) Gach duine ceapfar chun bheith ina Chathaoirleach beidh sé, ar dháta a cheaptha, ina Bhreitheamh den Chúirt Uachtarach, den Ard-Chúirt no den Chúirt Chuarda agus féadfar, le n-a thoil féin agus le toil Phrímh-Bhreithimh Shaorstáit Éireann, é do cheapa amhlaidh ar na téarmaí go bhféadfa sé fanúint in oifig mar bhreitheamh den tsórt san d'ainneoin a cheaptha mar Chathaoirleach.
(2) Gach duine ceapfar chun bheith ina Chathaoirleach beidh sé i seilbh oifige mar Chathaoirleach den tsórt san go dtí éag no eirghe as do no scur do de bheith ina Bhreitheamh den Chúirt Uachtarach, den Ard-Chúirt no den Chúirt Chuarda (pe'ca aca é).
(3) Pé uair a bheidh an Cathaoirleach go sealadach, de dheascaibh breoiteachta, gan bheith ábalta ar a dhualgaisí mar Chathaoirleach do chólíona, féadfaidh an Seanascal, ar chomhairle na hArd-Chomhairle, éinne bheidh cáilithe chun a cheaptha mar Chathaoirleach do cheapa chun bheith ina leas-chathaoirleach le linn mí-ábaltachta san an Chathaoirligh agus é do chur as an oifig sin aon uair, agus faid a bheidh sé ceaptha beidh comhachta agus dualgaisí uile an Chathaoirligh ag gach leas-chathaoirleach den tsórt san agus chuige sin déanfar gach tagairt san Acht so (lasmuich den alt so) don Chathaoirleach do léiriú mar thagairt a fholuíonn an leas-chathaoirleach san.
Paineul an Aire.
5.—(1) Isé an tAire cheapfidh baill phaineul an Aire agus féadfaidh iad do chur as an bpaineul aon uair.
(2) Beidh gach ball de phaineul an Aire i seilbh oifige mar bhall den tsórt san go dtí éag no eirghe as do no go dtí n-a chur as oifig.
(3) An bheirt bhall den Bhord a gheobhfar as paineul an Aire chun crícheanna aon tsuidhe bheidh ag an mBord déanfaidh baill an phainéil sin iad do rogha i pé slí ordóidh an tAire.
Paineul na n-oifigeach.
6.—(1) San alt so—
cialluíonn an abairt “bun-bhall” ball de phaineul na n-oifigeach atá ina bhall amhlaidh de bhua a ainmnithe sa Dara Sceideal a ghabhann leis an Acht so;
cialluíonn an abairt “ball có-thogtha” ball de phaineul na n-oifigeach a thoghfaidh baill phaineul na n-oifigeach fén Acht so chun bheith ina bhall amhlaidh;
foluíonn an abairt “ball de phaineul na n-oifigeach” bun-bhaill agus baill chó-thoghtha;
foluíonn an abairt “oifigeach aistrithe ar fostú ag Rialtas Shaorstáit Éireann” oifigeach aistrithe do scuireadh no d'imigh as seirbhís Rialtais Shaorstáit Éireann i slí go raibh teideal aige chun cúitimh fé Airtiogal 10 den Chonnra agus do chuaidh isteach sa tseirbhís sin arís ar n-a cheapa chun oifige no puist nua;
cialluíonn an abairt “foth-fholúntas” folúntas a thiocfaidh imeasc ballra phaineul na n-oifigeach tré éag, eirghe as, no teacht fé dhí-cháilíocht do bhall den phaineul san no tré n-a chur as fén alt so agus foluíonn sí folúntas a thiocfaidh tré éag no teacht fé dhí-cháilíocht do bhun-bhall roimh an Acht so do rith.
(2) Beidh paineul na n-oifigeach có-dhéanta den chúigear is fiche a hainmnítear sa Dara Sceideal a ghabhann leis an Acht so agus de pé daoine eile toghfar o am go ham fén alt so chun fothfholúntaisí imeasc ballra an phainéil sin, no a ceapfar fén gcéad alt ina dhiaidh seo den Acht so chun folúntaisí thárlóidh fén alt san.
(3) Féadfaidh ball de phaineul na n-oifigeach eirghe as bheith ina bhall de aon uair tré fhógra i scríbhinn do thabhairt don Chathaoirleach.
(4) Pé uair a scuirfidh ball de phaineul na n-oifigeach de bheith ina oifigeach aistrithe ar fostú ag Rialtas Shaorstáit Éireann, beidh sé dí-cháilithe chun bheith agus scuirfidh láithreach de bheith ina bhall de phaineul na n-oifigeach.
(5) Féadfar aon uair ball de phaineul na n-oifigeach do chur as an bpaineul san ar chúis aithriste tré rún i scríbhinn fé láimh ocht mball déag ar a laighead de phaineul na n-oifigeach do sheachada don Chathaoirleach.
(6) Pé uair a thiocfaidh foth-fholúntas imeasc ballra phaineul na n-oifigeach, déanfaidh a mbeidh fágtha de bhaill phaineul na n-oifigeach oifigeach aistrithe ar fostú ag Rialtas Shaorstáit Éireann do thogha i pé slí is oiriúnach leo chun an fholúntais sin.
(7) An bheirt bhall den Bhord a gheobhfar as paineul na n-oifigeach chun críche aon tsuidhe bheidh ag an mBord déanfaidh baill an phainéil sin iad do rogha ar pé slí shocróid eatorra féin.
Baill de phaineul na n-oifigeach do chur as an bpaineul ar achuinghe.
7.—(1) Má tíoclaictear agus pé uair a tíolaicfear don Bhord achuinghe fé láimh chúig céad ar a laighead d'oifigigh aistrithe ar fostú ag Rialtas Shaorstáit Éireann á iarraidh go gcuirfí as paineul na n-oifigeach ball no baill ainmnithe den phaineul san (ach ní níos mó ná cúigear in éineacht), cuirfidh an Bord as paineul na n-oifigeach láithreach na baill den phaineul san a bheidh ainmnithe san achuinghe sin.
(2) Pé uair a cuirfear ball de phaineul na n-oifigeach as an bpaineul fén alt so déanfaidh an Bord, chó luath agus bheidh san caothúil dóibh, oifigeach aistrithe ar fostú ag Rialtas Shaorstáit Éireann ainmneoidh an Cathaoirleach, tar éis do dul i gcomhairle le có-ghléasa admhuíonn sé do bheith ag ionadú na n-oifigeach n-aistrithe, do cheapa chun bheith ina bhall de phaineul na n-oifigeach chun an folúntas do thárla de dhruim an churtha-as san do líona.
(3) Ní thárlóidh foth-fholúntas do réir bhrí an ailt deiridh roimhe seo den Acht so de dhruim ball de phaineul na n-oifigeach do chur as an bpaineul fén alt so.
(4) San alt so foluíonn an abairt “oifigeach aistrithe ar fostú ag Rialtas Shaorstáit Éireann” na daoine foluítear leis an abairt sin chun crícheanna an ailt deiridh roimhe seo den Acht so.
Nós-imeachta an Bhuird.
8.—(1) Fé réir forálacha an Achta so rialálfaidh an Bord a nós-imeachta féin.
(2) Féadfaidh an Bord gníomhú d'ainneoin foth-fholúntais no foth-fholúntaisí i bpaineul an Aire no i bpaineul na n-oifigeach no sa dá phaineul san.
(3) Beidh an Cathaoirleach i gceannas gach suidhe bheidh ag an mBord.
(4) Is do réir bharúil an mhóráirimh de bhaill an Bhuird a bheidh breith an Bhuird ar aon iarratas, éileamh no ceist, éistfid agus a shocróid fén Acht so, ach isé an Cathaoirleach fhógróidh an bhreith sin agus ní fhógróidh aon bhall eile den Bhord aon bharúil ag aontú ná ag deifriú leis an mbreith sin ná ag tagairt di.
(5) Beidh ag an mBord, chun a chur d'fhiachaibh ar fhínnithe teacht i láthair agus chun a scrúduithe fé mhionn agus chun a chur d'fhiachaibh scríbhinní do thabhairt i láthair, gach comhacht, ceart agus príbhléid den tsórt atá dílsithe san Ard-Chúirt no i mBreitheamh den Ard-Chúirt maidir le triail aicsin, agus beidh gairm fé láimh an Chathaoirligh có-ionann agus den éifeacht chéanna le próiseas fuirmeálta do thabharfadh an Ard-Chúirt amach chun a chur d'fhiachaibh ar fhínnithe teacht i láthair no chun a chur d'fhiachaibh scríbhinní do thabhairt i láthair.
(6) Más rud é, ar ghairm éinne go cuibhe fén alt so chun teacht i láthair an Bhuird mar fhínné, ná tiocfa sé i láthair amhlaidh no, ar bheith i láthair an Bhuird do mar fhínné, go ndiúltóidh sé do mhionn do thabhairt a cheanglóidh an Cathaoirleach air do thabhairt no go ndiúltóidh sé d'aon scríbhinn do thabhairt i láthair a bheidh fé n-a chúram no ar fáil aige agus a cheanglóidh an Cathaoirleach air do thabhairt i láthair no go ndiúltóidh sé d'aon cheist d'fhreagairt a cheanglóidh an Cathaoirleach air d'fhreagairt, féadfaidh an Cathaoirleach cionta an duine sin do dheimhniú don Ard-Chúirt agus, tar éis pé fiosrú is dó leis an gCúirt sin is ceart do dhéanamh, féadfa sí pionós do chur ar an duine sin no cur chuige sin do dhéanamh díreach fé is dá mbeadh sé ciontach sa Chúirt sin do dhísbeaga.
Dlighinse an Bhuird.
9.—(1) Fiosróidh an Bord i dtaobh gach éilimh, ar chúiteamh fé Airtiogal 10 den Chonnra, a chuirfidh an tAire fé n-a mbráid fén Acht so, agus socróid do réir an Achta so ce'ca tá neach déanta an éilimh sin i dteideal cúitimh fén Airtiogal san 10 mar oifigeach aistrithe no ná fuil agus pé uair a shocróidh an Bord go bhfuil an duine sin i dteideal an chúitimh sin amhlaidh socróidh an Bord fós cineál agus méid an chúitimh sin agus na nithe eile bhaineann leis.
(2) Chun crícheanna gach fiosruithe, socruithe agus breithe cheanglann an tAcht so ortha do dhéanamh no do thabhairt beidh lán-chomhacht agus lán-dlighinse ag an mBord gach ní do bhreithniú agus do shocrú a tabharfar os a gcóir le linn no i dtaobh an fhiosruithe, an tsocruithe no na breithe sin agus ní féadfar srian do chur leo le hordú aon chúirte agus iad ag feidhmiú a gcomhacht agus a ndlighinsí fén Acht so ná ní déanfar aon imeachta bheidh ar siúl os a gcóir do thabhairt isteach in aon chúirt le certiorari.
(3) Gach éileamh ar chúiteamh fé Airtiogal 10 den Chonnra a cheanglann no a údaruíonn an tAcht so do chur fé bhráid an Bhuird agus gach ceist eile a cheanglann no a údaruíonn an tAcht so do chur fé n-a mbráid, is ag an mBord amháin a bheidh dlighinse chun iad d'éisteacht agus do shocrú agus fós chun gach ní do shocrú a ghabhann le socrú no eireoidh le linn socruithe aon éilimh no ceiste den tsórt san agus ní fhéadfaidh aon chúirt ná aon bhinse eile seachas an Bord aon éileamh, ceist ná ní den tsórt san do bhreithniú, d'éisteacht, ná do shocrú.
(4) An bhreith a thabharfaidh an Bord ar aon éileamh ar chúiteamh fé Airtiogal 10 den Chonnra a éistfid agus a shocróid fén Acht so beidh sí ina socrú dheiridh dhochlaoite ar an éileamh san agus ní féadfar athchomharc chun aon chúirte, údaráis ná binse ar bith ina coinnibh ná ní fhéadfaidh aon cheann acu san í d'aithbhreithniú.
Eilithe ar chúiteamh do bheith ionchurtha fé bhráid an Bhuird.
10.—(1) Gach duine adéarfaidh go bhfuil sé i dteideal cúitimh fé Airtiogal 10 den Chonnra mar oifigeach aistrithe, agus nár dhin éileamh (seachas éileamh fé alt 14 den Acht so) ar an Aire roimhe sin, ag lorg an chúitimh sin, beidh sé i dteideal (fé réir na heisceachta dintear anso ina dhiaidh seo) an cúiteamh san d'éileamh ar an Aire.
(2) Cuirfidh an tAire fé bhráid an Bhuird (fé réir na heisceachta dintear anso ina dhiaidh seo)—
(a) gach éileamh, ag lorg cúitimh fé Airtiogal 10 den Chonnra, a déanfar ar an Aire, tar éis an Achta so do rith, ag duine adeir gurb oifigeach aistrithe é agus nár dhin eileamh (seachas éileamh fé alt 14 den Acht so) ar an Aire roimhe sin ag lorg an chúitimh sin no gur dhin a leithéide sin d'éileamh ach gur tharraig siar gan coiníoll é sarar thug an tAire breith ar bith air; agus
(b) gach éileamh, ag lorg cúitimh fén Airtiogal san 10, do dineadh ar an Aire, roimh an Acht so do rith, ag duine adeir gurb oifigeach aistrithe é, agus—
(i) nár tarraigeadh siar roimh an Acht so do rith, agus
(ii) nár tháinig a leithéid eile d'éileamh roimhe do tarraigeadh siar ar coiníoll tar éis a bhreith nithe ag coiste do cheap an tAire chun comhairle do thabhairt do i dtaobh éilithe den tsórt san, agus
(iii) nár dhin an tAire ar a scór roimh an Acht so do rith cúiteamh do dheona ná diúltú do chúiteamh do dheona.
(3) I gcás in ar dhin duine adeir gurb oifigeach aistrithe é cúiteamh fé Airtiogal 10 den Chonnra d'éileamh ar an Aire roimh an Acht so do rith agus in ar dhin an tAire, ar dhéanamh an éilimh sin, an cúiteamh san do dheona no do dhiúltú don duine sin agus nách ionann an deona no an diúltú san agus deona no diúltú cúitimh a fógartar leis an gCó-aontú atá leagtha amach sa Chéad Sceideal a ghabhann leis an Acht so do bheith ina shocrú dheiridh dhochlaoite ar éileamh an duine sin ar chúiteamh fén Airtiogal san 10, féadfaidh an duine sin, aon uair tar éis an Achta so do rith, a iarraidh ar an Aire an t-éileamh san do chur fé bhráid an Bhuird agus ar a iarraidh sin air déanfaidh an tAire (fé réir na heisceachta a dintear anso ina dhiaidh seo) an t-éileamh san do chur fé bhráid an Bhuird agus leis sin deighleálfaidh an Bord leis an éileamh san fé is ná déanfaí an cúiteamh san do dheona no do dhiúltú amhlaidh (pe'ca aca é).
(4) Ní bhainfidh an t-alt so le héileamh ar chúiteamh fé Airtiogal 10 den Chonnra dob abhar aicsin no lán-imeachta eile san Ard-Chúirt gur dhin an Chúirt sin a thriail d'éisteacht agus breith do thabhairt inti roimh an Acht so do rith.
Eilithe do socruíodh do réir dlí.
11.—(1) Baineann an t-alt so le gach éileamh ar chúiteamh fé Airtiogal 10 den Chonnra o dhuine adeir gurb oifigeach aistrithe é agus—
(a) nár dhin an tAire ar a scór deona no diúltú cúitimh fén Airtiogal san 10 atá, de bhua an Chó-aontuithe atá leagtha amach sa Chéad Sceideal a ghabhann leis an Acht so, ina shocrú dheiridh dhochlaoite ar an éileamh san, agus
(b) dob abhar aicsin no lán-imeachta eile san Ard-Chúirt gur dhin an Chúirt sin a thriail d'éisteacht agus breith do thabhairt inti roimh an Acht so do rith, agus
(c) nárbh abhar athchomhairc chun na Cúirte Uachtaraighe d'éist an Chúirt sin agus ar ar thug sí breith roimh an Acht so do rith.
(2) Beidh breithiúntas na hArd-Chúirte, ar n-a fhógairt roimh an Acht so do rith, ar éileamh le n-a mbaineann an t-alt so, ina shocrú dheiridh dhochlaoite ar an éileamh san agus ní luighfidh ná ní déanfar aon athchomharc chun na Cúirte Uachtaraighe ná chun aon bhinse eile i gcoinnibh an bhreithiúntais sin, ach amháin—
(a) i gcás athchomharc chun na Cúirte Uachtaraighe, i gcoinnibh an bhreithiúntais sin, do bheith ar feitheamh le linn an Achta so do rith, go bhféadfaidh neach déanta an athchomhairc sin athchomharc chun an Bhuird i gcoinnibh an bhreithiúntais sin agus leis sin éistfidh an Bord an t-athchomharc san agus tabharfaidh breith air agus chuige sin beidh dlighinse aige gach cuid no aon chuid den bhreithiúntas san do chlaochló, do dhaingniú, no d'atharú sa mhéid agus sa tslí is dó leis is ceart, agus
(b) má eiríonn ceist ar bith i dtaobh éilimh le n-a mbaineann an t-alt so agus ná socruítear an cheist sin le breithiúntas na hArd-Chúirte ar an éileamh san no má eiríonn ceist ar bith, i dtaobh éilimh le n-a mbaineann an t-alt so, as no fé bhreithiúntas na hArd-Chúirte ar an éileamh san, go gcuirfar an cheist sin fé bhráid an Bhuird agus gur ag an mBord amháin a bheidh dlighinse í d'éisteacht agus breith do thabhairt uirthi.
Cúiteamh d'íoc.
12.—(1) Tuairisceoidh an Bord don Aire a mbreith ar gach éileamh a cuirfear fé n-a mbráid fén Acht so agus pé uair a chinnfidh an Bord go bhfuil duine i dteideal cúitimh mar oifigeach aistrithe fé Airtiogal 10 den Chonnra íocfaidh an tAire cúiteamh leis an oifigeach san, ar gach slí do réir na breithe sin, as airgead a sholáthróidh an tOireachtas no as aon chiste eile ar ar féidir a mhuirearú le ceart.
(2) Íocfaidh an tAire, amach as airgead a sholáthróidh an tOireachtas no as aon chiste eile ar ar féidir a mhuirearú le ceart, le gach oifigeach aistrithe dá mbeidh sé tar éis deona cúitimh do thabhairt fé Airtiogal 10 den Chonnra a fógartar leis an gCó-aontú atá leagtha amach sa Chéad Sceideal a ghabhann leis an Acht so do bheith ina shocrú dheiridh dhochlaoite, íocfa sé leis an cúiteamh a deonadh amhlaidh don oifigeach aistrithe sin.
Costaisí an Bhuird.
13.—Sa mhéid go gceadóidh an tAire é, is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas a bheidh ar an mBord maidir le feidhmiú na gcomhacht agus na ndlighinsí bronntar ar an mBord leis an Acht so (ar a n-áirítear luach saothair (más ann do) bhall an Bhuird).
Sealbhaíocht oifige oifigeach n-aistrithe do bhuan-chimeád.
14.—(1) Beidh gach oifigeach aistrithe le n-a mbaineann an t-alt so i seilbh oifige i seirbhís Rialtais Shaorstáit Éireann do réir na sealbhaíochta céanna agus ar na téarmaí agus ar na coiníollacha céanna (ar a n-áirítear coiníollacha i dtaobh tuarastail agus aois-liúntais) gur dá réir agus ortha do bhí sé i seilbh oifige i seirbhís Rialtais Ríocht Aontuithe na Breataine Móire agus na hÉireann do bhí ann le déanaí no Rialtais Ríocht Aontuithe na Breataine Móire agus Thuaiscirt Éireann (pe'ca aca é) díreach roimh a aistriú ón seirbhís sin go dtí seirbhís an Rialtais Shealadaigh no Rialtais Shaorstáit Éireann (pe'ca aca é).
(2) Pé uair a ceanglófar ar oifigeach aistrithe le n-a mbaineann an t-alt so, le linn bheith i seilbh bhirte i seirbhís Rialtais Shaorstáit Éireann do atá có-ionann no ar có-réir leis an mbirt do bhí ar seilbh aige i seirbhís Rialtais Ríocht Aontuithe na Breataine Móire agus na hÉireann do bhí ann le déanaí no Rialtais Ríocht Aontuithe na Breataine Móire agus Thuaiscirt Éireann (pe'ca aca é) in am a aistrithe ón seirbhís sin, dualgaisí ná beidh cóghaolmhar agus a bheidh ina mbreis nea-réasúnta leis agus ar na dualgaisí do bhí air in am a aistrithe amhlaidh do chólíona no nuair a bheidh atharú mór chun donais do ar staid an oifigigh sin de dheascaibh atharuithe i gcoiníollacha a fhostaíochta, beidh an t-oifigeach san i dteideal imeacht as seirbhís Rialtais Shaorstáit Éireann más mian leis é ach é do thabhairt fógra don Aire gur mian leis imeacht amhlaidh agus an tAire d'admháil no an Bord do dhaingniú a chirt chun imeacht amhlaidh.

(5) Nuair a thabharfaidh oifigeach aistrithe fógra don Aire gur mian leis imeacht, fén alt so, as seirbhís Rialtais Shaorstáit Éireann agus a admhóidh an tAire no a dhaingneoidh an Bord a cheart chun imeacht amhlaidh, tuigfear gur scuir Rialtas Shaorstáit Éireann an t-oifigeach san do réir bhrí Airtiogal 10 den Chonnra agus beidh sé i dteideal cúitimh fén Airtiogal san dá réir sin.
(6) Baineann an t-alt so le gach oifigeach aistrithe do bhí, in am a aistrithe go dtí seirbhís Rialtais Shaorstáit Éireann, ag fónamh mar oifigeach bhunuithe, no, cé ná raibh ag fónamh mar oifigeach bhunuithe, do thugadh a chuid aimsire uile do dhualgaisí a oifige.

15.—(1) I gcás in ar thug oifigeach aistrithe (nách oifigeach do haistríodh tar éis an 5adh lá de Mhí na Nodlag, 1928) roimh an Acht so do rith no ina dtabharfaidh ar no roimh an 5adh lá de Mhí na Nodlag, 1929, fógra gur mian leis imeacht as seirbhís Rialtais Shaorstáit Éireann do bhíthin an atharuithe rialtais do réir bhrí Airtiogal 10 den Chonnra, is ar pé dáta shocróidh an Bord chuige sin a imeoidh an t-oifigeach san as an seirbhís sin do réir an fhógra san.
(2) Bainfidh na forálacha so leanas leis an mBord do shocrú an dáta, fén bhfo-alt san roimhe seo, chun oifigeach aistrithe le n-a mbaineann an fo-alt san d'imeacht as oifig, sé sin le rá:—

AGREEMENT INTERPRETING AND SUPPLEMENTING ARTICLE TEN OF THE ARTICLES OF AGREEMENT FOR A TREATY BETWEEN GREAT BRITAIN AND IRE-LAND TO WHICH THE FORCE OF LAW WAS GIVEN BY THE IRISH FREE STATE (AGREEMENT) ACT, 1922 AND BY THE CONSTITUTION OF THE IRISH FREE STATE (SAORSTáT ÉIREANN) ACT, 1922.
1. Article 10 of the Articles of Agreement for a Treaty between Great Britain and Ireland signed at London on the 6th day of December, 1921, and confirmed and ratified by the Irish Free State (Agreement) Act, 1922, and the Constitution of the Irish Free State (Saorstát Éireann) Act, 1922, shall be construed with reference to this Agreement, and the said Article 10 shall have effect and be deemed always to have had effect accordingly.
2. In this Agreement the expression “transferred officer” includes every official, civil servant, or other public servant who by virtue of any transfer of services has been transferred from the service of the Government of the late United Kingdom of Great Britain and Ireland to the service of the Provisional Government or the service of the Government of the Irish Free State or has heretofore been or shall hereafter be transferred from the service of the Government of the United Kingdom of Great Britain and Northern Ireland to the service of the Government of the Irish Free State, but does not include any member of a police force nor any person whose services were lent by the Government of the said late United Kingdom to the Provisional Government.
3. Where the Minister for Finance of the Irish Free State has, before the date of this Agreement and in accordance with a recommendation whether general or particular made to him by a committee set up by him to advise him as to the payment of compensation under the said Article 10, granted or refused to grant compensation under the said Article 10 to a person claiming to be a transferred officer, such grant and the award made thereon (but subject as respects cost-of-living bonus to the terms of this Agreement) or such refusal (as the case may be) shall be and be deemed always to have been a final and conclusive determination of the claim of such person for such compensation, and such person shall be entitled accordingly to such compensation or to no compensation as the case may be.
4. There shall be established in the Irish Free State in the manner prescribed by legislation to be passed for that purpose by the Oireachtas of the Irish Free State a board (hereinafter called the Board) to hear and determine every claim pending at the date of this Agreement or hereafter to be made by any person claiming to be a transferred officer for compensation under the said Article 10, and to hear and determine every other matter which shall be referred to them in pursuance of this Agreement.
5. The Board shall have exclusive jurisdiction to determine the right of any person claiming to be a transferred officer to compensation under the said Article 10 and the amount of such compensation (if any) and all matters incidental to such determination, and the Board may, for the purpose of such determination, take into consideration in relation to any transferred officer any matter which the Civil Service Committee mentioned in section 56 of the Government of Ireland Act, 1920, might under that Act have taken into consideration when considering a claim by such person for compensation under that Act, and every such determination by the Board shall be a final and conclusive determination of the claim of such person to compensation under the said Article 10.
6. The amount of compensation payable under the said Article 10 to a transferred officer who is found by the Board to be entitled to such compensation shall be determined by the Board in accordance with the Rules set out in the Schedule to this Agreement.
7. Where the Minister for Finance of the Irish Free State has before the date of this Agreement granted or refused to grant compensation under the said Article 10 to a person claiming to be a transferred officer, every dispute which shall hereafter arise between the said Minister and such person in relation to such grant or refusal or (in the case of a grant) the compensation granted and in particular every dispute which shall so arise as to whether such grant or refusal is or is not by virtue of this Agreement a final and conclusive determination of the claim of such person for such compensation shall be referred to and decided by the Board and the decision of the Board thereon shall be final and conclusive.
8. Provision shall be made by legislation to be passed by the Oireachtas of the Irish Free State for enabling a transferred officer who is required to perform duties which are not analogous and are an unreasonable addition to his duties at the time of his transfer or whose position has been materially altered to his detriment owing to changes in the conditions of his employment to retire from the service of the Government of the Irish Free State with the same right to compensation as if he had been discharged by the said Government within the meaning of the said Article 10 and for the determination by the Board of any dispute as to the right of a transferred officer so to retire.
9. Notice by a transferred officer of his desire to retire from the service of the Irish Free State in consequence of the change of government within the meaning of the said Article 10 may be given at any time up to but not after the 5th day of December, 1929, or, in the case of a transferred officer who is transferred to such service after the 5th day of December, 1928, within one year after the date of such transfer.
10. Where a transferred officer has received or hereafter receives promotion (whether by way of increase of salary or by appointment to another grade or situation) in the employment of the Provisional Government of Ireland or in the employment of the Government of the Irish Free State, any compensation to which he has become or hereafter becomes entitled under the said Article 10 shall (save in the cases provided for in the next following paragraph of this Agreement) be computed by reference to the salary and emoluments of the grade or situation which he held immediately before he received such promotion or the first of two or more such promotions and as if he had continued in that office or situation.
11. Where a transferred officer in the service of the Provisional Government of Ireland or the service of the Government of the Irish Free State has received or hereafter receives promotion (whether by way of increase of salary or by appointment to another grade or situation but not including acting-promotion) in either of those services and such promotion was or is in the customary course of promotion in or from the grade or situation which he held at the time of his transfer to the said service and was or is otherwise promotion such as he would normally (at the time he was so promoted) have received in or from the last-mentioned grade or situation if the change of government mentioned in the said Article 10 had not taken place (whether such promotion was or is received in or to a department which was or in or to a department which was not in existence at the time of such change of government) any compensation to which he has become or hereafter becomes entitled under the said Article 10 shall be computed by reference to the salary and emoluments of the grade or situation held by him immediately after such promotion or the latest of two or more consecutive such promotions.
12. The Oireachtas of the Irish Free State may provide by legislation that when and so long as a transferred officer in receipt of compensation under the said Article 10 is employed in any situation in a public department in Great Britain, the Irish Free State or Northern Ireland such compensation may be suspended wholly where his remuneration in such situation equals or exceeds his remuneration in the office on account of retirement or discharge from which such compensation was granted and in any other case to such extent as will render the total of such compensation and his remuneration in such situation equal to his remuneration in the office on account of retirement or discharge from which such compensation was granted.
In this paragraph the expression “situation in a public department” includes
(a) any situation which is remunerated wholly or partly out of moneys (other than a single grant or occasional grants not renewed from year to year) provided by the Oireachtas of the Irish Free State or by the Parliament of the United Kingdom of Great Britain and Northern Ireland or by the Parliament of Northern Ireland, and
(b) any situation in Great Britain, the Irish Free State or Northern Ireland which is a public office within the meaning of the Superannuation Act, 1892, or any enactment amending the same, and
(c) any situation in or under or as a paid member of the Currency Commission, the Electricity Supply Board, or the Agricultural Credit Corporation, Limited, and
(d) any situation in or under or as a paid member of a board or body established by or under the authority of an Act of the Oireachtas passed after the date of this agreement which the Minister for Finance of the Irish Free State shall by order declare to be a public department for the purposes of this paragraph.
13. His Majesty's Government in the United Kingdom of Great Britain and Northern Ireland agree to pay to His Majesty's Government in the Irish Free State the amount by which the compensation payable in accordance with this Agreement to transferred officers who have given notice before the 1st day of March, 1929, of their desire to retire under the said Article 10 from the service of the Government of the Irish Free State or have been discharged before that date from the service of the said Government exceeds the sum to which such compensation would amount if the same were calculated in the manner prescribed by this Agreement in respect of compensation payable to transferred officers who give notice on or after the 1st day of March, 1929, of their desire so to retire from the said service or are discharged on or after that date from the said service.
14. His Majesty's Government in the United Kingdom of Great Britain and Northern Ireland and His Majesty's Government in the Irish Free State respectively shall as soon as possible introduce into their respective Parliaments such legislation as may be necessary to give statutory effect to this Agreement, and this Agreement shall not take effect until such legislation in such Parliaments shall have been passed into law.

SCHEDULE
to the foregoing agreement.
1. In the case of a transferred officer to whom the Eighth Schedule to the Government of Ireland Act, 1920, would apply if the compensation were being calculated under that Act, the compensation shall, subject to the provisions of this Schedule, be calculated in accordance with the Rules contained in the said Eighth Schedule and for the purposes of such calculation,
(a) the Rules contained under Head A of Part I of the said Rules shall apply to retirement in consequence of the change of Government within the meaning of the said Article 10,
(b) the Rules contained under Head B of Part I of the said Rules shall apply to discharge by the Government of the Irish Free State within the meaning of the said Article 10,
(c) the transitional period referred to in the said Rules shall be deemed to end on the 5th day of December, 1929, save that, in the case of officers who are transferred to the service of the Government of the Irish Free State after the 5th day of December, 1928, the transitional period shall be deemed to end at the expiration of one year after the date of such transfer, and
(d) where a transferred officer (not being an officer transferred to the service of the Government of the Irish Free State after the 5th day of December, 1928) who has duly given notice on or before the 5th day of December, 1929, of his desire to retire from the said service in consequence of the change of Government within the meaning of the said Article 10 continues in the service of the Government of the Irish Free State after the 5th day of December, 1929, the period between that date and the actual date of retirement of such officer shall be reckoned in calculating his years of service, but increments of salary accruing to him after the said 5th day of December, 1929, shall not be taken into account in calculating the compensation payable to him.
2. In the case of a transferred officer to whom section 54 of the Government of Ireland Act, 1920, or any sub-section thereof would apply if the compensation were being calculated under that Act, the compensation payable to such officer shall be of such character and amount as the Board shall think proper having regard to all the circumstances of the case and in particular having regard to any limitation which would apply to such compensation by virtue of the said section 54 if such compensation were being calculated under the said Act.
3. In the case of a transferred officer to whom none of the foregoing Rules apply, the compensation payable to such officer shall be of such character and amount as the Board shall think proper having regard to all the circumstances of the case.
4. The following provisions shall apply to that portion (if any) of the compensation payable to a transferred officer under the said Article 10 which consists of an annual allowance computed on cost of living bonus on the Civil Service sliding scale, that is to say:—
(a) The said annual allowance shall be computed by reference to a standard rate based upon the bonus appropriate on the Civil Service sliding scale to a cost of living figure of 105, this standard rate being increased or reduced, as the case may be, by one twenty-first for each complete 5 points by which the index figure appropriate to the quarter in which the officer retires (or if he retires on the last day of the quarter to the ensuing quarter) exceeds or falls short of the said index figure of 105;
(b) The annual allowance so computed shall (subject to the limitation hereinafter mentioned where the same applies) be re-assessed quarterly on the above basis by reference to the official cost of living index figure for the Irish Free State appropriate to each quarter.
(c) The said quarterly re-assessments of the said annual allowance shall be made on fixed quarterly dates which shall be the same for all such annual allowances, and the first such quarterly re-assessment of any particular such annual allowance shall take place on whichever of the said fixed quarterly days first occurs after the commencement of such annual allowance:
(d) in the case of a transferred officer who gave or shall give notice on or after the first day of March, 1929, of his desire to retire from the service of the Government of the Irish Free State or has been or shall be discharged on or after that date from the service of the said Government, the said annual allowance shall not at any time exceed the amount at which it would be calculated if it were computed by reference to the cost of living index figure on which the cost of living bonus paid to such officer immediately before his discharge or retirement was computed.
5. That portion (if any) of the compensation payable to a transferred officer under the said Article 10 which consists of a gratuity calculated according to the provisions of section 6 of the Superannuation Act, 1859 or of an additional allowance or lump sum calculated according to the provisions of the Superannuation Act, 1909 shall, in so far as the same is computed by reference to cost of living bonus, be computed,
(a) in the case of a transferred officer who gave notice before the 1st day of March, 1929, of his desire to retire from the service of the Government of the Irish Free State or was discharged before that date from the service of the said Government, on the full amount of the cost of living bonus, computed by reference to the official cost of living index figure for the Irish Free State for the time being in force, appropriate on the Civil Service sliding scale to the salary of such officer on which such gratuity, additional allowance or lump sum is calculated, and
(b) in the case of a transferred officer who gave or shall give notice on or after the 1st day of March, 1929, of his desire to retire from the service of the Government of the Irish Free State or has been or shall be discharged on or after that date from the service of the said Government, on seventy-five per cent. of the cost of living bonus which, if computed by reference to the official cost of living index figure for the Irish Free State appropriate to the quarter in which the officer retires would be appropriate on the Civil Service sliding scale to the salary of such officer on which such gratuity, additional allowance or lump sum is calculated.
