1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht Rialtais Áitiúil (Luacháil a Laghdú go Sealadach), 1954.

Leasú ar alt 3 den Phríomh-Acht.

2.—Leasaítear leis seo alt 3 den Phríomh-Acht trí “an 31ú lá de Mhárta, 1972” a chur in ionad “an 31ú lá de Mhárta, 1969” sa mhíniú ar “an tréimhse ordaithe” atá i bhfo-alt (1).

Leasú ar alt 4 den Phríomh-Acht.

3.—(1) Déantar leis seo an fo-alt seo a leanas a chur isteach i ndiaidh fho-alt (1) d'alt 4 den Phríomh-Acht:

“(1A) Ní bheidh feidhm ag fo-alt (1) den alt seo in aon chás—

(a) más aon lá tar éis an 31ú lá de Mhárta, 1969, lá tógáil, fairsingiú nó feabhsú foirgnimh a chríochnú, agus

(b) má cheanglaíonn Cuid IV den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 (Uimh. 28 de 1963), gur gá cead faoin gCuid sin a fháil maidir leis an tógáil, leis an bhfairsingiú nó leis an bhfeabhsú,

mura lá nach déanaí ná an 9ú lá de Nollaig, 1969, lá an cheada sin a iarraidh.”

(2) Déantar leis seo an fo-alt seo a leanas a chur isteach i ndiaidh fho-alt (2) d'alt 4 den Phríomh-Acht:

“(2A) Más aon lá tar éis an 31ú lá de Bhealtaine, 1969, lá tógáil, fairsingiú nó feabhsú foirgnimh a chríochnú, beidh éifeacht ag fo-alt (2) den alt seo ach go gcuirfear in ionad na tagartha do na sé bliana airgeadais áitiúla díreach i ndiaidh na bliana airgeadais áitiúla a críochnaíodh an tógáil, an fairsingiú nó an feabhsú—

(a) más aon lá roimh an lú lá d'Aibreán, 1970, an lá sin— tagairt don chéad chúig cinn de na blianta sin agus don chúig cinn sin amháin, agus

(b) más aon lá é tar éis an 31ú lá de Mhárta, 1970, agus roimh an lú lá d'Aibreán, 1971—tagairt don chéad cheithre cinn de na blianta sin agus don chéad cheithre cinn sin amháin, agus

(c) más aon lá é tar éis an 31ú lá de Mhárta, 1970—tagairt don chéad trí cinn de na blianta sin agus don chéad trí cinn sin amháin.”

4.—(1) Féadfar an tAcht Rialtais Áitiúil (Luacháil a Laghdú go Sealadach), 1970, a ghairm den Acht seo.

(2) Féadfar na hAchtanna Rialtais (Luacháil a Laghdú go Sealadach), 1954 go 1970, a ghairm de na hAchtanna Rialtais Áitiúil (Luacháil a Laghdú go Sealadach), 1954 go 1966, agus den Acht seo le chéile.

LOCAL GOVERNMENT (TEMPORARY REDUCTION OF VALUATION) ACT, 1970

Principal Act.

1.—In this Act “the Principal Act” means the Local Government (Temporary Reduction of Valuation) Act, 1954.

Amendment of section 3 of Principal Act.

2.—Section 3 of the Principal Act is hereby amended by the substitution of “the 31st day of March, 1972” for “the 31st day of March, 1969” in the definition of “the prescribed period” contained in subsection (1).

Amendment of section 4 of Principal Act.

3.—(1) The following subsection is hereby inserted after subsection (1) of section 4 of the Principal Act:

“(1A) Subsection (1) of this section shall not apply in a case in which—

(a) the day of completion of the erection, enlargement or improvement of a building is after the 31st day of March, 1969, and

(b) Part IV of the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963), requires the grant with respect to the erection, enlargement or improvement of permission under that Part,

unless the day of application for that permission is not later than the 9th day of December, 1969.”

(2) The following subsection is hereby inserted after subsection (2) of section 4 of the Principal Act:

“(2A) In a case in which the day of completion of the erection, enlargement or improvement of a building is after the 31st day of March, 1969, subsection (2) of this section shall have effect subject to the substitution for the reference to the six local financial years next following the local financial year next after that in which the erection, enlargement or improvement was completed—

(a) if that day is before the 1st day of April, 1970—of a reference to the first five only of those years,

(b) if it is after the 31st day of March, 1970, and before the 1st day of April, 1971—of a reference to the first four only of those years, and

(c) if it is after the 31st day of March, 1971—of a reference to the first three only of those years.”

Short title and collective citation.

4.—(1) This Act may be cited as the Local Government (Temporary Reduction of Valuation) Act, 1970.

(2) The Local Government (Temporary Reduction of Valuation) Acts, 1954 to 1966, and this Act may be cited together as the Local Government (Temporary Reduction of Valuation) Acts, 1954 to 1970.
