Iomportáil torthaí talmhaíochta agus torthaí iascaigh do rialáil.

2.—(1) Féadfaidh an tAire, pé uair chó agus minic agus is oiriúnach leis é, ordú do dhéanamh chun iomportáil aon tortha talmhaíochta no tortha iascaigh no iomportáil aon chiníl áirithe (a míneofar sa tslí sin agus do réir na nithe sin is oiriúnach leis an Aire) d'aon toradh talmhaíochta no d'aon toradh iascaigh do rialáil sa tslí sin agus tré sna meáin sin is dóich leis is ceart agus féadfaidh, gan dochar do gheneráltacht na forála san roimhe seo, socrú do dhéanamh leis an ordú san i gcóir éinní no nithe acu so leanas, se sin le rá:—

(a) chun iomportáil an tortha san no an chiníl sin den toradh san do thoirmeasc ar fad no fé réir na gcoinníollacha san (ar a n-áirmhítear coinníollacha maidir le tuairisc) is dóich leis an Aire is ceart agus a luadhfaidh san ordú san,

(b) chun a ordú go mbeidh sáruithe áirithe ar an ordú san ina gciontaí is ionphionósuithe ar dhaoine do chiontú ionta ar an slí achmair, agus chun na bpionós a gheobhaidh leis na ciontaí sin do cheapadh,

(c) i gcóir na nithe eile sin a chífear don Aire do bheith riachtanach chun a chur in áirithe go ndéanfar an scéim rialacháin a bheidh san ordú d'oibriú agus d'fhoirfheidhmiú go cuibhe.

(2) Féadfaidh an tAire, le hordú, ceiliúradh no leasú do dhéanamh ar aon ordú bheidh déanta fén alt so le n-a n-áirmhítear an fo-alt so.

(3) Sara ndeinidh an tAire aon ordú fén alt so raghaidh i gcomhairle leis an Aire Airgeadais agus leis an Aire Tionnscail Tráchtála.

(4) Beidh feidhm dlí ag gach ordú dhéanfaidh an tAire fén alt so.

[EN]

(5) Gach ordú dhéanfaidh an tAire fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dheineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid, rún do rith ag cur an orduithe sin ar neambrí beidh an t-ordú san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.

Forálacha custum.

3.—(1) Tuigfear earraí go dtoirmiscfear, le hordú ar n-a dhéanamh fén Acht so, iad d'iomportáil do bheith ar na hearraí a háirmhítear agus a tuairiscítear sa Chlár de Thoirmisc agus de Shrianta maidir le hEarraí do Theacht Isteach, atá in alt 42 den Customs Consolidation Act, 1876, agus na forálacha den Acht san, mar atá san leasuithe no leathnuithe le haon Acht ina dhiaidh sin, a bhaineann le hearraí d'iomportáil a toirmisctear no sriantar beidh feidhm acu dá réir sin.

(2) Má hiomportáltar aon earraí contrárdha d'ordú ar n-a dhéanamh fén Acht so, féadfaidh oifigeach Custum agus Máil a cheangal ar dhuine ar bith (eadhon, an t-iomportálaí no an t-iompróir le n-a mbainfidh an scéal) na hearraí sin d'easportáil laistigh de thréimhse áirithe agus má theipeann ar an duine sin déanamh do réir an cheangail sin beidh sé ciontach i gcionta fán bhfo-alt so agus ar a chiontú ar an slí achmair dlighfear fíneáil chaoga punt do chur air.

(3) Féadfaidh na Coimisinéirí Ioncuim cionta fé fho-alt (2) den alt so do chúiseamh.

Ciontaí.

4.—(1) Má dheineann cólucht corpruithe cionta fé aon ordú ar n-a dhéanamh fén Acht so no fé fho-alt (2) den alt deiridh sin roimhe seo agus go gcruthófar go ndearnadh amhlaidh é le toiliú no le ceadú éinne, no gur cuireadh a dhéanamh in usacht le haon fhaillí i bpáirt éinne, is stiúrthóir no bainisteoir ar an gcólucht chorpruithe sin no is rúnaí no oifigeach eile dhó, tuigfear an stiúrthóir, an bainisteoir, an rúnaí no an t-oifigeach eile sin freisin do bheith ciontach sa chionta san agus féadfar imeachta do bhunú ina choinnibh agus é phionósú dá réir sin.

(2) Féadfaidh an tAire aon chionta fé ordú ar bith ar n-a dhéanamh fén Acht so do chúiseamh.

5.—Sa mhéid go gceadóidh an tAire Airgeadais é, is amach as airgead a sholáthróidh an tOireachtas a híocfar na costaisí uile fé n-a raghaidh an tAire fén Acht so.

AGRICULTURAL PRODUCTS (REGULATION OF IMPORT) ACT, 1938.


AN ACT TO REGULATE THE IMPORTATION OF AGRICULTURAL AND FISHERY PRODUCTS, AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. [16th May, 1938.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

the expression “the Minister” means the Minister for Agriculture; the expression “agricultural product” means—

(a) any product of agriculture, horticulture or arboriculture,

[GA]

(b) any animal,

[GA]

(c) milk, cream, and eggs,

[GA]

(d) any article of food or drink wholly or partly manufactured or derived from any product of agriculture, horticulture or arboriculture, or from any animal, or from milk, cream or eggs,

[GA]

(e) feathers, wool, hides and skins of animals,

[GA]

but does not include intoxicating liquor;

[GA]

the expression “fishery product” means—

[GA]

(a) any fish,

[GA]

(b) any product of fish,

[GA]

(c) any article of food or drink wholly or partly manufactured or derived from fish or from any product of fish;

[GA]

the word “importation” shall be construed as not including importation for the purposes only of transit and consequent exportation, and cognate words shall be construed accordingly.

Regulation of importation of agricultural products and fishery products.

2.—(1) The Minister may, whenever and so often as he thinks fit, make an order regulating, in such manner and by such means as he thinks proper, the importation of any agricultural product or fishery product or any specified kind (defined in such manner and by reference to such things as the Minister thinks fit) of any agricultural product or any fishery product, and may without prejudice to the generality of the foregoing provision, by such order, provide for any one or more of the following matters, that is to say:—

(a) for prohibiting the importation of such product or such kind of such product, either absolutely or subject to such conditions (including conditions as respects description) as the Minister thinks proper and specifies in such order,

(b) for making specified infringements of such order offences punishable on summary conviction and fixing the penalties for such offences,

[GA]

(c) for such other matters as appears to the Minister necessary for securing the due operation and enforcement of the scheme of regulation contained in the order.

[GA]

(2) The Minister may by order revoke or amend any order made under this section including this sub-section.

[GA]

(3) The Minister shall before making any order under this section consult with the Minister for Finance and the Minister for Industry and Commerce.

[GA]

(4) Every order made by the Minister under this section shall have the force of law.

[GA]

(5) Every order made by the Minister under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such order is passed by either such House within the next subsequent twenty-one days on which such House has sat after such order is laid before it, such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.

Customs provisions.

3.—(1) Articles prohibited to be imported by an order made under this Act shall be deemed to be included amongst the goods enumerated and described in the Table of Prohibitions and Restrictions Inwards contained in section 42 of the Customs Consolidation Act, 1876, and the provisions of that Act, as amended or extended by any subsequent Act, applying to the importation of prohibited or restricted goods, shall apply accordingly.

(2) Where any articles are imported in contravention of an order made under this Act, an officer of Customs and Excise may require any person (being the importer or the carrier concerned) to export such articles within a specified time and if such person fails to comply with such requisition he shall be guilty of an offence under this sub-section and shall be liable on summary conviction to a fine of fifty pounds.

(3) An offence under sub-section (2) of this section may be prosecuted by the Revenue Commissioners.

Offences.

4.—(1) Where an offence under any order made under this Act or under sub-section (2) of the immediately preceding section was committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of such body corporate, such director, manager, secretary or other officer shall also be deemed to be guilty of such offence and shall be liable to be proceeded against and punished accordingly.

(2) Any offence under any order made under this Act may be prosecuted by the Minister.

Expenses.

5.—All expenses incurred by the Minister under this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title.

6.—This Act may be cited as the Agricultural Products (Regulation of Import) Act, 1938.
