ACHT TOGHCHÁIN (CÁRTAÍ VÓTAÍOCHTA), 1943.

Mínithe.
1.—San Acht so—
cialluíonn an abairt “clár de thoghthóirí Dála” clár de dhaoine atá i dteideal vótáil i dtoghchán chomhaltaí no chomhalta do Dháil Éireann;
cialluíonn an abairt “an staid phráinne náisiúnta atá ann fé láthair” an staid phráinne náisiúnta dhéanann deifir do bhonn beatha an Stáit agus do dearbhuíodh le rúin do rith gach Tigh den Oireachtas an 2adh lá de Mheán Fhómhair, 1939, do bheith ann;
cialluíonn rud do bheith “orduithe” é bheith orduithe ag an Aire Riaghaltais Aiteamhail agus Sláinte Poiblidhe.

2.—(1) Aon uair a thárlóidh, in olltoghchán chomhaltaí do Dháil Éireann a tionólfar i rith na staide práinne náisiúnta atá ann fé láthair, go gcuirfear an toghchán in aon dáilcheanntar áirithe ar athló chun vótaíocht do thógaint, déanfaidh an ceann cóimhrimh don dáilcheanntar san cárta (dá ngairmtear cárta vótaíochta san Acht so) sa bhfuirm orduithe do chur leis an bpost do réir an Achta so chun gach toghthóra a mbeidh a ainm ar an gclár de thoghthóirí Dála don dáilcheanntar san agus gan í ar an liost de phost-vótálaithe don dáilcheanntar san á chur in iúl don toghthóir sin cadé a uimhir (maille le leitir a cheanntair vótaíochta) ar an gclár san agus cá bhfuil an t-ionad vótaíochta ina mbeidh an toghthóir sin i dteideal vótáil sa toghchán san.
(2) Déanfar gach cárta vótaíochta cuirfear fén Acht so chun toghthóra in aon dáilcheanntar áirithe do dhíriú chun an toghthóra san fén ainm féna mbeidh sé cláruithe sa chlár de thoghthóirí Dála don dáilcheanntar san agus ag an seoladh ar ina thaobh a bheidh sé cláruithe amhlaidh, agus cuirfear amach é i dtráth chun go seachadfaí é i ngnáth-chúrsa an phuist ag an seoladh san am nach déanaighe ná an tríú lá roimh an lá vótaíochta sa toghchán lena mbainfidh.
(3) Déanfaidh an ceann cóimhrimh gach cárta vótaíochta do sheachadadh don Cheann-Oifig Phuist is comhgaraighe dhó no do pé post-oifig eile socrófar leis an gCeann-Mháistir Puist, agus déanfaidh an Ceann-Mháistir Puist no máistir puist na post-oifige eile sin (do réir mar a bheidh) é chur ar aghaidh saor o chostas chun é sheachadadh don duine chun a mbeidh sé dírithe.
Costais cinn chóimhrimh.
3.—Na costais féna raghaidh ceann cóimhrimh chun an tAcht so do chólíonadh i dtoghchán áirmheofar iad mar chostais féna raghaidh chun crícheanna an toghcháin sin do réir bhrí ailt 25 den Acht Timpeal Toghcháin, 1923 (Uimh. 12 de 1923), agus beidh feidhm agus éifeacht dá réir sin ag an alt san.
Toghchán do bheith bailidhe d'ainneoin gan an tAcht so do chólíonadh.
4.—(1) Ní bheidh aon toghchán nea-mbailidhe toisc an ceann cóimhrimh do mhainneachtain i gcárta vótaíochta do chur do réir an Achta so chun aon toghthóra áirithe no toisc gan cárta vótaíochta do sheachadadh d'aon toghthóir áirithe no toisc aon earráide no mí-ráitis in aon chárta vótaíochta cuirfear amach de bhun an Achta so, ná ní déanfar aon toghchán do chonspóid ar scór aon mhainneachtana no nea-sheachadta no earráide no mí-ráitis den tsórt san.
(2) Ní luighfidh ná ní bunófar aon aicsean ná imeacht eile i gcoinnibh cinn chóimhrimh mar gheall ar aon mhainneachtain uaidh sin i gcárta vótaíochta do chur do réir an Achta so chun aon toghthóra áirithe ná mar gheall ar aon earráid no mí-ráiteas in aon chárta chuirfe sé amach amhlaidh.

5.—(1) Féadfar an tAcht Toghcháin (Cártaí Vótaíochta), 1943, do ghairm den Acht so.
(2) Folóidh an có-luadh “na hAchtanna Toghcháin, 1923 ge 1943,” an tAcht so chun gach críche.

ELECTORAL (POLLING CARDS) ACT, 1943.
Definitions.
1.—In this Act—
the expression “register of Dáil electors” means a register of persons entitled to vote at an election of members or a member of Dáil Eireann;
the expression “the present national emergency” means the national emergency affecting the vital interests of the State which was declared by resolutions passed by each House of the Oireachtas on the 2nd day of September, 1939, to exist;
the word “prescribed” means prescribed by the Minister for Local Government and Public Health.
Sending of polling cards by returning officers.
2.—(1) Whenever, at a general election of members of Dáil Eireann held during the present national emergency, the election in any constituency is adjourned for the purpose of taking a poll, the returning officer for such constituency shall send by post in accordance with this Act to every elector whose name is on the register of Dáil electors for such constituency and is not on the postal voters' list for such constituency a card (in this Act referred to as a polling card) in the prescribed form informing such elector of his number (including polling district letter) on such register and of the situation of the polling place in which such elector will be entitled to vote at such election.
(2) Every polling card sent under this Act to an elector in any constituency shall be addressed to such elector by the name and at the address by and in respect of which he is registered in the register of Dáil electors for that constituency and shall be sent at such time that it would be delivered in the ordinary course of post at that address not later than the third day before the polling day at the election to which it relates.
(3) Every polling card shall be delivered by the returning officer to the nearest Head Post Office or such other post office as may be arranged with the Head Postmaster and shall immediately be forwarded free of charge by the Head Postmaster or the postmaster of such other post office (as the case may be) for delivery to the person to whom it is addressed.
Returning officer's expenses.
3.—The expenses incurred by a returning officer in complying with this Act at an election shall be expenses incurred by him for the purposes of such election within the meaning of section 25 of the Electoral Act, 1923 (No. 12 of 1923), and that section shall apply and have effect accordingly.
Validity of election notwithstanding failure to comply with this Act.
4.—(1) No election shall be invalidated by reason of the failure of the returning officer to send a polling card in accordance with this Act to any elector or by reason of the non-delivery of a polling card to any elector or of any error or mis-statement in any polling card sent in pursuance of this Act, nor shall any election be questioned on the ground of any such failure, non-delivery, error, or mis-statement.
(2) No action or other proceeding shall lie or be brought against a returning officer in respect of any failure by him to send a polling card in accordance with this Act to any elector or in respect of any error or mis-statement in any polling card so sent by him.
Short title and collective citation.
5.—(1) This Act may be cited as the Electoral (Polling Cards) Act, 1943.
(2) The collective citation “the Electoral Acts, 1923 to 1943,” shall for all purposes include this Act.
