4.—Déanfar gach ordú faoi Chuid II den Acht seo a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir é tar éis a dhéanta, agus má dhéanann ceachtar Teach acu sin laistigh den lá agus fiche a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid rún a rith ag neamhniú an ordaithe, beidh an t-ordú ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.

5.—Déanfar an caiteachas faoina rachaidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais é, as airgead a sholáthróidh an tOireachtas.

CUID II.

Fruilcheannach, Díol Creidmheasa agus Ligean Earraí a Rialú.

Fruilcheannach, díol creidmheasa agus ligean earraí a rialú.

6.—(1) Féadfaidh an tAire, le hordú, foráil a dhéanamh le rialáil agus rialú a dhéanamh ar ligean, cibé acu faoi chomhaontuithe fruilcheannaigh nó ar shlí eile é, agus ar dhíol, trí chomhaontuithe díola chreidmheasa, earraí nó aon chinéal nó saghas earraí.

(2) Gan dochar do ghinearáltacht na méide sin roimhe seo nó d'aon ní sa Phríomh-Acht, féadfaidh foráil a bheith in ordú faoin alt seo lena aghaidh seo a leanas—

(a) foirm na gcomhaontuithe dá dtagraítear i bhfo-alt (1) den alt seo,

(b) an éarlais íosta a íocfaidh ceannaitheoir nó fruilitheoir,

(3) Féadfaidh ordú faoin alt seo a fhoráil freisin nach mbeidh teideal ag duine a dhíolfaidh nó a ligfidh earraí lena mbainfidh an t-ordú aon chomhaontú i leith an díola nó an ligin sin, ná aon cheart chun na hearraí a aisghabháil, a chur i bhfeidhm mura gcomhlíonfar forálacha sonraithe den ordú.

(4) Féadfaidh an tAire, le hordú, ordú faoin alt seo a leasú nó a chúlghairm.

(5) Is amháin tar éis dul i gcomhairle leis an Aire Airgeadais a dhéanfar ordú faoi aon fhoráil den alt seo (ach amháin maidir le mír (d) nó (e) d'fho-alt (2) den alt seo).

7.—Aon duine a sheolann, nó atá ar fostú i ndáil le, gnó ligin earraí, cibé acu faoi chomhaontuithe fruilcheannaigh nó ar shlí eile é, nó gnó díola earraí trí chomhaontuithe díola chreidmheasa, tabharfaidh sé don Aire, aon uair a iarrfaidh an tAire air é, aon leabhair, doiciméid, taifid, sonraí nó eolas a bheidh i gcumhacht nó ar urláimh an duine sin agus a theastóidh ón Aire chun a chumasú dó a fheidhmeanna faoin gCuid seo den Acht seo a fheidhmiú.

Oifigigh údaraithe.

8.—(1) Féadfaidh an tAire cibé oifigigh, agus cibé líon oifigeach, dá chuid is oiriúnach leis a cheapadh chun bheith ina n-oifigigh údaraithe chun críocha na Coda seo den Acht seo.

(2) Tabharfar do gach oifigeach údaraithe barántas a cheaptha mar oifigeach údaraithe, agus, a luaithe a rachaidh sé isteach in aon áitreabh de bhun alt 9 den Acht seo, tabharfaidh sé an barántas ar aird don duine a bheidh i bhfeighil an áitribh.

Cumhachtaí oifigeach údaraithe.

9.—(1) Féadfaidh oifigeach údaraithe, d'fhonn aon eolas a fháil a theastóidh ón Aire chun a chumasú dó a fheidhmeanna faoin gCuid seo den Acht seo a fheidhmiú, dul isteach gach tráth réasúnach in áitreabh ina seoltar gnó ligin earraí, cibé faoi chomhaontuithe fruilcheannaigh nó ar shlí eile é, nó gnó díola earraí trí chomhaontuithe díola chreidmheasa agus aon ní amháin nó níos mó acu seo a leanas a dhéanamh—

(a) an t-áitreabh a scrúdú,

(b) a cheangal ar an duine a bheidh ag seoladh an ghnó sin, agus ar aon duine a bheidh ar fostú i ndáil leis sin, aon leabhair, doiciméid nó taifid a bhainfidh leis an ngnó sin agus a bheidh i gcumhacht nó ar urláimh an duine sin a thabhairt ar aird dó agus cibé eolas a thabhairt dó a theastóidh uaidh le réasún maidir le haon sonraí sna leabhair, sna doiciméid nó sna taifid sin,

(c) na leabhair, na doiciméid nó na taifid sin a scrúdú agus cóipeanna a dhéanamh díobh nó sleachta a thógáil astu,

(d) a cheangal ar an duine sin aon eolas a thabhairt dó a theastóidh uaidh le réasún maidir leis na daoine a sheolann an gnó sin (lena n-áirítear, go háirithe, i gcás comhlacht neamhchorpraithe daoine, eolas maidir le comhaltas an chomhlachta sin agus a choiste bhainistí nó a údaráis rialaithe eile) nó atá ar fostú i ndáil leis an ngnó sin,

(e) a cheangal ar an duine sin aon eolas eile a thabhairt dó a theastóidh uaidh le réasún maidir leis an ngnó sin.

(2) Ní cheanglófar ar aon duine de bhua alt 7 den Acht seo nó fo-alt (1) den alt seo aon cheist a fhreagairt ná aon fhianaise a thabhairt a ionchoireodh é féin.

(3) Faoi réir fhorálacha fho-alt (2) den alt seo, má choisceann nó má bhacann aon duine oifigeach údaraithe ag feidhmiú a chumhachtaí dó faoin alt seo nó mura ndéanfaidh sé de réir cheanglais faoi alt 7 den Acht seo nó faoin alt seo, beidh an duine sin ciontach i gcion.

10.—(1) Ní nochtfaidh aon duine eolas a bheidh ar fáil aige de bhua na gcumhachtaí chun eolas a fháil a thugtar dó leis an gCuid seo den Acht seo.

(2) Ní bhaineann fo-alt (1) den alt seo le—

(a) scéala ó oifigeach údaraithe ag comhlíonadh a dhualgas dó faoin gCuid seo den Acht seo,

(b) nochtadh eolais chun críocha imeachtaí dlíthiúla faoin gCuid seo den Acht seo.

(3) Má sháraíonn aon duine fo-alt (1) den alt seo beidh sé ciontach i gcion.

Ordú a shárú.

11.—(1) Aon duine a sháróidh (trí ghníomh nó neamhghníomh) aon fhoráil d'ordú faoin gCuid seo den Acht seo a bheidh i bhfeidhm de thuras na huaire, beidh sé ciontach i gcion.

(2) Gach duine a chabhróidh, a neartóidh, nó a chomhcheilgfidh le duine eile, aon ní a dhéanamh (trí ghníomh nó neamhghníomh) a ndearbhaítear le fo-alt (1) den alt seo gur cion é a dhéanamh, beidh sé féin ciontach i gcion.

12.—Má dhéanann comhlacht corpraithe, nó duine a airbheartóidh a bheith ag gníomhú thar ceann comhlachta chorpraithe nó comhlachta neamhchorpraithe daoine, cion faoin gCuid seo den Acht seo, agus go gcruthófar go ndearnadh an cion amhlaidh le toiliú nó aontú, nó gur urasaíodh a dhéanamh trí mhainneachtain, aon duine atá, i gcás comhlachta chorpraithe, ina stiúrthóir air nó, i gcás comhlachta neamhchorpraithe, ina chomhalta de choiste bainistí, nó d'údarás rialaithe eile, an chomhlachta sin, beidh an duine sin freisin ciontach sa chion.

13.—Gach duine a dhéanfaidh cion faoin gCuid seo den Acht seo, dlífear, ar a chiontú ann go hachomair, fíneáil nach mó ná céad punt a chur air nó, de rogha na Cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí nó an fhíneáil agus an phríosúnacht sin le chéile.

14.—(1) Féadfaidh an tAire imeachtaí i leith ciona faoin gCuid seo den Acht seo a thionscnamh agus a ionchúiseamh.

(2) D'ainneoin fo-alt (4) d'alt 10 den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achoimre i leith ciona faoin gCuid seo den Acht seo a thionscnamh laistigh de dhá mhí dhéag ó dháta an chiona.

CUID III.

Leasú ar an bPríomh-Acht.

[EN]

Forálacha breise maidir le horduithe iarchurtha i leith sainseachadadh earraí.

15.—(1) I gcás ordú iarchurtha á ordú earraí a shainseachadadh don úinéir a dhéanamh, roimh thosach feidhme an Achta seo nó dá éis, faoi mhír (b) d'fho-alt (4) d'alt 13 den Phríomh-Acht, féadfar cumhachtaí na cúirte faoi mhíreanna (a) agus (c) d'fho-alt (4) d'alt 14 den Acht sin (míreanna a thugann, faoi seach, cumas don chúirt coinníollacha an iarchuir a athrú nó ordú a dhéanamh á ordú cuid de na hearraí a sheachadadh don úinéir agus teideal an úinéara chun na coda eile a aistriú chun an fhruilitheora) a fheidhmiú, d'ainneoin aon choinníoll i ndáil leis an iarchur a bheith gan chomhlíonadh, aon tráth sula seachadfar na hearraí don úinéir de réir ordú fhorghníomhaithe de réir bhrí an Achta um Fheidhmiú Orduithe Cúirte, 1926, arna eisiúint de bhun an ordaithe; agus má bhíonn ordú forghníomhaithe den sórt sin arna eisiúint (roimh thosach feidhme an Achta seo nó dá éis sin), déanfaidh an chúirt—

(a) má athraíonn an chúirt coinníollacha an iarchuir faoin mír sin (a), an t-ordú forghníomhaithe a fhionraí ar choinníollacha den sórt céanna;

(b) má dhéanann an chúirt ordú faoin mír sin (c) á ordú cuid de na hearraí a shainseachadadh don úinéir agus teideal an úinéara chun na coda eile de na hearraí a aistriú chun an fhruilitheora, an t-ordú forghníomhaithe a chealú sa mhéid go bhforálann sé an chuid is déanaí a luaitear de na hearraí a sheachadadh.

(2) D'ainneoin aon ní i rialacha cúirte, féadfar, aon tráth sula seachadfar earraí don úinéir de réir ordú forghníomhaithe arna eisiúint mar adúradh, an t-ordú forghníomhaithe, sa mhéid go mbeidh foráil ann go seachadfar na hearraí, a urscaoileadh tríd an bhfruilitheoir nó aon ráthóir d'íoc iomlán iarmhéad neamhíoctha an phraghais fhruilcheannaigh leis an úinéir maraon le haon ús (is ús is iníoctha faoin gcomhaontú fruilcheannaigh ar thráthchodanna den phraghas fruilcheannaigh a bheidh dlite agus gan íoc) a raibh foráil i leith a íoca san ordú iarchurtha, agus in aon chás den sórt sin dílseoidh teideal an úinéara chun na n-earraí san fhruilitheoir.

(3) Má tharlaíonn, in aon chaingean lena mbainfidh an t-alt sin 13, go ndéanfaidh an fruilitheoir agus go nglacfaidh an t-úinéir, de réir rialacha cúirte, tairiscint maidir le coinníollacha i leith oibriú ordaithe faoi mhír (b) d'fho-alt (4) den alt sin a iarchur, féadfaidh an chúirt, air sin, ordú a dhéanamh faoin mír sin de réir na tairisceana sin gan fianaise a éisteacht maidir le hábhair a shonraítear sa mhír sin (b):

Ar choinníoll nach ndéanfar aon ordú den sórt sin roimh an lá a bheidh socair chun an caingean a éisteacht i gcás ina mbeidh ráthóir ina pháirtí sa chaingean.

Seilbh a aisghabháil ar mhótar-fheithiclí a ligeadh faoi chomhaontuithe fruilcheannaigh.

16.—(1) Ní bheidh feidhm ag alt 6 den Phríomh-Acht maidir le foráil i gcomhaontú a dhéanfar tar éis tosach feidhme an Achta seo faoina mbeidh úinéir mótar-fheithicle a ligeadh faoi chomhaontú fruilcheannaigh nó duine a bheidh ag gníomhú thar a cheann—

(a) údaraithe chun dul isteach in áitreabh (seachas teach a úsáidtear mar áit chónaithe nó aon fhoirgneamh laistigh dá chuirtealáiste) chun seilbh a ghlacadh ar an mótar-fheithicil, nó

[EN]

(b) saor ó dhliteanas mar gheall ar dhul isteach amhlaidh.

[EN]

(2) I gcás—

[EN]

(a) ina mbeidh úinéir mótar-fheithicle a ligeadh faoi chomhaontú fruilcheannaigh tar éis caingean a thionscnamh tar éis tosach feidhme an Achta seo chun seilbh a aisghabháil ar an bhfeithicil ón bhfruilitheoir, agus

(b) (i) go mbeidh trian an phraghais fhruilcheannaigh íoctha nó tairgthe, sula dtionscnófar an caingean, ag an bhfruilitheoir nó ag aon ráthóir nó thar ceann an fhruilitheora nó aon ráthóra, nó

 (ii) gur comhaontú fruilcheannaigh eile de réir bhrí alt 16 den Phríomh-Acht an comhaontú fruilcheannaigh, agus

[EN]

(c) go mbeidh an fheithicil tréigthe nó fágtha gan freastal i gcúinsí dá dtáinig, nó ar dócha go dtiocfadh díobh go ró-luath, an fheithicil a dhamáistiú nó níos mó ná mar is gnáth de laghdú ar a luach,

ní bheidh feidhm ag forálacha alt 12 den Phríomh-Acht agus beidh teideal ag an úinéir ceart chun seilbh a aisghabháil ar an bhfeithicil a chur i bhfeidhm agus seilbh a choimeád uirthi dá éis sin i gcaitheamh an eatraimh nó go ndéanfaidh an chúirt ordú maidir leis an bhfeithicil faoi fho-alt (3) d'alt 13 den Phríomh-Acht.

(3) I gcás ina gcuirfidh úinéir feithicle, de bhun fo-alt (2) den alt seo, ceart chun seilbh a aisghabháil ar an bhfeithicil i bhfeidhm—

(a) déanfaidh sé iarratas chun na cúirte faoi fho-alt (3) d'alt 13 den Phríomh-Acht lá nach déanaí ná an ceathrú lá déag tar éis an lae a aisghabhadh seilbh ar an bhfeithicil nó, mura mbeidh an chúirt ina suí an lá sin, an chéad lá a shuífidh an chúirt tar éis an lae sin, agus

(b) más rud é, ar an gcaingean dá dtagraítear i bhfo-alt (2) den alt seo a éisteacht, nach gcruthóidh an t-úinéir don chúirt go raibh sé, i gcúinsí uile an cháis, i dteideal, de bhun an fho-ailt sin, a cheart chun seilbh a aisghabháil ar an bhfeithicil a chur i bhfeidhm, féadfaidh an chúirt, gan dochar d'aon chumhacht eile de chuid na cúirte, damáistí mar is cuí léi a bheidh iníoctha ag an úinéir a dhámhadh don fhruilitheoir i leith aisghabháil na feithicle agus coimeád seilbhe uirthi dá éis sin.

(4) I gcás ina ndéanfaidh úinéir mótar-fheithicle, de bhun fho-alt (2) den alt seo, ceart chun seilbh a aisghabháil ar an bhfeithicil a chur i bhfeidhm ach nach gcomhlíonfaidh sé forálacha mír (a) d'fho-alt (3) den alt seo, measfar, d'ainneoin forálacha fo-alt (2) den alt seo, gur aisghabh sé an fheithicil contrártha d'fho-alt (1) d'alt 12 den Phríomh-Acht agus beidh éifeacht dá réir sin ag fo-alt (2) den alt sin.

(5) Ní bheidh feidhm ag fo-alt (2) d'alt 12 den Phríomh-Acht in aon chás ina ndámhfar damáistí faoi mhír (b) d'fho-alt (3) den alt seo.

(6) Leasaítear leis seo an Sceideal a ghabhann leis an bPríomh-Acht, maidir le comhaontuithe fruilcheannaigh a bhainfidh le mótar-fheithiclí agus a dhéanfar tar éis tosach feidhme an Achta seo, tríd an mír atá leagtha amach sa Sceideal a ghabhann leis an Acht seo a chur isteach ag a dheireadh.

(7) San alt seo ciallaíonn “mótar-fheithicil” aon fheithicil inneall-ghluaiste atá déanta le húsáid ar bóthar chun daoine nó earraí a iompar agus folaíonn sé tarracóir.

Dliteanas ráthóra nuair a thugtar earraí ar ais don úinéir.

17.—(1) I gcás—

[EN]

(a) earraí a bheidh arna ligean faoi chomhaontú fruilcheannaigh, arna dhéanamh roimh thosach feidhme an Achta seo nó dá éis, agus

[EN]

(b) go n-aisghabhfaidh an t-úinéir seilbh ar na hearraí sin, nó go ndéanfaidh an chúirt ordú faoi mhír (a) d'fho-alt (4) d'alt 13 den Phríomh-Acht ag ordú na hearraí sin a shainseachadadh don úinéir,

ansin, faoi réir fho-alt (3) den alt seo, ní bheidh dliteanas ráthóra faoi chonradh ráthaíochta maidir leis an gcomhaontú níos mó ná an méad más aon mhéad é, a dhlífeadh an fruilitheoir a íoc faoi alt 5 den Phríomh-Acht dá bhfoirceannadh sé an comhaontú faoin alt sin tráth na haisghabhála nó tráth déanta an ordaithe, de réir mar bheidh.

(2) Faoi réir fho-alt (3) den alt seo, beidh aon fhoráil ar neamhní a bheidh in aon chonradh ráthaíochta maidir le comhaontú fruilcheannaigh trína mbeidh an ráthóir, tar éis seilbh a bheith aisghafa ar na hearraí a ligeadh faoin gcomhaontú nó tar éis ordú a dhéanamh ag an gcúirt faoin mír sin (a) ag ordú na hearraí a shainseachadadh don úinéir, faoi dhliteanas is mó ná an dliteanas a shonraítear i bhfo-alt (1) den alt seo.

(3) Ní dochar fo-ailt (1) agus (2) den alt seo d'aon dliteanas de chuid an ráthóra a bheidh faibhrithe i leith tráthchodanna den phraghas fruilcheannaigh a bheidh dlite faoin gcomhaontú fruilcheannaigh agus a bheidh gan íoc tráth na haisghabhála nó tráth déanta an ordaithe, de réir mar bheidh.

(4) Ní bheidh éifeacht ag an alt seo maidir le héileamh nó ordú i dtaobh ráthóra a rinneadh roimh thosach feidhme an Achta seo.

18.—I gcás—

(a) ina mbeidh fruilitheoir i dteideal faoi alt 10 den Phríomh-Acht íocaíocht a dhéanfar tar éis tosach feidhme an Achta seo a leithreasú, agus

[EN]

(b) ina mainneoidh an fruilitheoir leithreasú a dhéanamh faoin alt sin, agus

[EN]

(c) ina mbeidh dhá dtrian an phraghais cheannaigh íoctha faoi gach ceann de na comhaontuithe fruilcheannaigh a mbeidh suimeanna dlite ina leith ar chun nó mar chabhair chun iad a íoc a bheidh an teideal ann,

féadfaidh an t-úinéir, d'ainneoin forálacha an ailt sin 10, an íocaíocht a leithreasú chun nó mar chabhair chun íoctha na suime a bheidh dlite faoi aon cheann de na comhaontuithe nó chun nó mar chabhair chun íoctha na suimeanna a bheidh dlite faoi aon dá cheann nó níos mó de na comhaontuithe go comhréireach mar is oiriúnach leis agus, má mhainníonn sé aon leithreasú mar adúradh a dhéanamh, beidh an íocaíocht arna leithreasú, de bhua an ailt sin, mar chabhair chun íoctha na suimeanna a bheidh dlite faoi na comhaontuithe fruilcheannaigh faoi seach de réir na comhréire a bheidh idir na suimeanna sin.

19.—(1) In aon chaingean a thosófar tar éis tosach feidhme an Achta seo ag úinéir earraí a ligeadh faoi chomhaontú fruilcheannaigh le ceart chun seilbh na n-earraí a aisghabháil ón bhfruilitheoir a chur i bhfeidhm—

(a) beidh dlínse ag an gCúirt Chuarda i gcás nach mó ná míle punt praghas fruilcheannaigh na n-earraí, agus

[EN]

(b) beidh dlínse ag an gCúirt Dúiche i gcás nach mó ná céad punt praghas fruilcheannaigh na n-earraí.

HIRE-PURCHASE (AMENDMENT) ACT, 1960.


AN ACT TO AMEND THE LAW WITH RESPECT TO THE HIRE-PURCHASE, SALE UPON CREDIT AND LETTING OF GOODS AND FOR THAT PURPOSE TO AMEND THE HIRE-PURCHASE ACT, 1946. [8th June, 1960.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA][GA]

PART I.

Preliminary and General

[GA]

Short title, collective citation and construction.

1.—(1) This Act may be cited as the Hire-Purchase (Amendment) Act, 1960.

(2) The Principal Act and this Act may be cited together as the Hire-Purchase Acts, 1946 and 1960.

[GA]

(3) The Principal Act and this Act shall be construed as one.

[GA]

Commencement.

2.—This Act shall come into operation on such day as the Minister by order appoints.

[GA]

Definitions.

3.—In this Act—

[GA]

the Principal Act” means the Hire-Purchase Act, 1946;

[GA]

authorised officer” means an officer appointed to be an authorised officer under section 8 of this Act;

[GA]

the Minister” means the Minister for Industry and Commerce.

[GA]

Laying of orders before Houses of the Oireachtas.

4.—Every order under Part II of this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order is passed by either such House within the next subsequent twenty-one days on which that House has sat after the order is laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.

Expenses.

5.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

PART II.

Control of Hire-Purchase, Credit-Sale and Letting of Goods.

[GA]

Control of hire-purchase, credit-sale and letting of goods.

6.—(1) The Minister may by order provide for the regulation and control of the letting, whether under hire-purchase agreements or otherwise, and the selling by credit-sale agreements of goods or of any class or description of goods.

[GA]

(2) Without prejudice to the generality of the foregoing or to anything in the Principal Act, an order under this section may provide for—

[GA]

(a) the form of the agreements referred to in subsection (1) of this section,

[GA]

(b) the minimum deposit to be paid by a buyer or hirer,

[GA]

(c) the maximum period of payment, and the amount and frequency of instalments or rentals,

[GA]

(d) the information to be given in any visual advertisement or visual announcement published or made in any form or manner whatsoever relating to goods for sale by way of hire-purchase or credit-sale agreement regarding the terms upon which the goods will be sold,

[GA]

(e) the inclusion in any such advertisement or announcement of a statement of the price at which the goods will be sold for cash.

[GA]

(3) An order under this section may also provide that a person who sells or lets goods to which the order applies shall not be entitled to enforce any agreement for such sale or letting or any right to recover the goods unless specified provisions of the order are complied with.

(4) The Minister may by order amend or revoke an order under this section.

[GA]

(5) An order under any provision of this section (except in relation to paragraph (d) or (e) of subsection (2) of this section) shall be made only after consultation with the Minister for Finance.

Furnishing of information.

7.—Any person who carries on, or is employed in connection with, the business of letting goods, whether under hire-purchase agreements or otherwise, or selling goods by credit-sale agreements shall, whenever so required by the Minister, furnish to the Minister any books, documents, records, particulars, or information in that person's power or control which the Minister may require for enabling him to exercise his functions under this Part of this Act.

Authorised officers.

8.—(1) The Minister may appoint such and so many of his officers as he thinks fit to be authorised officers for the purposes of this Part of this Act.

(2) Every authorised officer shall be furnished with a warrant of his appointment as an authorised officer, and, as soon as he has entered any premises pursuant to section 9 of this Act, shall produce the warrant to the person in charge of the premises.

Powers of authorised officers.

9.—(1) An authorised officer may, for the purpose of obtaining any information which the Minister may require for enabling him to exercise his functions under this Part of this Act, at all reasonable times enter premises at which the business of letting goods, whether under hire-purchase agreements or otherwise, or selling goods by credit-sale agreements is carried on and do any one or more of the following things—

(a) inspect the premises,

[GA]

(b) require the person who carries on such business and any person employed in connection therewith to produce to him any books, documents or records relating to such business which are in that person's power or control and to give him such information as he may reasonably require in regard to any entries in such books, documents or records,

[GA]

(c) inspect and copy or take extracts from such books, documents or records,

[GA]

(d) require such person to give to him any information he may reasonably require in regard to the persons carrying on such business (including, in particular, in the case of an unincorporated body of persons, information in regard to the membership thereof and of its committee of management or other controlling authority) or employed in connection therewith,

[GA]

(e) require such person to give to him any other information which he may reasonably require in regard to such business.

[GA]

(2) No one shall be required by virtue of section 7 of this Act or subsection (1) of this section to answer any question or to give any evidence tending to criminate himself.

[GA]

(3) Subject to the provisions of subsection (2) of this section, if any person obstructs or impedes an authorised officer in the exercise of his powers under this section or does not comply with a requirement under section 7 of this Act or under this section, that person shall be guilty of an offence.

Prohibition on disclosure of information.

10.—(1) No person shall disclose information available to him by virtue of the powers of obtaining information conferred on him by this Part of this Act.

(2) Subsection (1) of this section does not apply to—

[GA]

(a) a communication made by an authorised officer in the execution of his duties under this Part of this Act,

[GA]

(b) the disclosure of information for the purpose of legal proceedings under this Part of this Act.

[GA]

(3) If any person contravenes subsection (1) of this section he shall be guilty of an offence.

[GA]

Contravention of order.

11.—(1) A person who contravenes (whether by act or omission) any provision of an order under this Part of this Act for the time being in force shall be guilty of an offence.

(2) Every person who aids, abets, or assists another person, or conspires with another person, to do any thing (whether by way of act or of omission) the doing of which is declared by subsection (1) of this section to be an offence shall himself be guilty of an offence.

Offences in relation to bodies corporate and unincorporated bodies.

12.—Where an offence under this Part of this Act is committed by a body corporate or by a person purporting to act on behalf of a body corporate or an unincorporated body of persons, and is proved to have been so committed with the consent or approval of, or to have been facilitated by any default on the part of any person being, in the case of a body corporate, a director thereof, or, in the case of an unincorporated body, a member of the committee of management or other controlling authority thereof, that person shall also be guilty of the offence.

Penalties.

13.—Every person who commits an offence under this Part of this Act shall on summary conviction thereof be liable to a fine not exceeding one hundred pounds or, at the discretion of the court, to imprisonment for a term not exceeding six months or to both such fine and imprisonment.

Prosecution of offences.

14.—(1) Proceedings in relation to an offence under this Part of this Act may be brought and prosecuted by the Minister.

(2) Notwithstanding subsection (4) of section 10 of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under this Part of this Act may be instituted within twelve months from the date of the offence.

PART III.

Amendment of the Principal Act.

[GA]

Further provisions relating to postponed orders for specific delivery of goods.

15.—(1) Where a postponed order for the specific delivery of goods to the owner has been made, whether before or after the commencement of this Act, under paragraph (b) of subsection (4) of section 13 of the Principal Act, the powers of the court under paragraphs (a) and (c) of subsection (4) of section 14 of that Act (which respectively enable the court to vary the conditions of the postponement or to make an order for the delivery of part of the goods to the owner and for the transfer to the hirer of the owner's title to the remainder) may be exercised, notwithstanding that any condition of the postponement has not been complied with, at any time before the goods are delivered to the owner in accordance with an execution order within the meaning of the Enforcement of Court Orders Act, 1926, issued in pursuance of the order; and where such an execution order has been issued (whether before or after the commencement of this Act) the court shall—

(a) if the court varies the conditions of the postponement under the said paragraph (a), suspend the execution order on the like conditions;

[GA]

(b) if the court makes an order under the said paragraph (c) for the specific delivery of a part of the goods to the owner and for the transfer to the hirer of the owner's title to the remaining part thereof, cancel the execution order so far as it provides for the delivery of the last-mentioned part of the goods.

[GA]

(2) Notwithstanding anything contained in rules of court, at any time before the delivery of goods to the owner in accordance with an execution order issued as aforesaid, the execution order may, so far as it provides for the delivery of the goods, be discharged by the payment to the owner by the hirer or any guarantor of the whole of the unpaid balance of the hire-purchase price together with any interest (being interest payable under the hire-purchase agreement on instalments of the hire-purchase price which are due and unpaid) the payment of which had been provided for in the postponed order, and in any such case the owner's title to the goods shall vest in the hirer.

(3) If in an action to which the said section 13 applies an offer as to conditions for the postponement of the operation of an order under paragraph (b) of subsection (4) of that section is made by the hirer and accepted by the owner in accordance with rules of court, an order under that paragraph may thereupon be made by the court in accordance with the said offer without hearing evidence as to matters specified in the said paragraph (b):

Provided that where a guarantor is a party to the action, no such order shall be made before the date fixed for the hearing of the action.

Recovery of possession of motor vehicles let under hire-purchase agreements.

16.—(1) Section 6 of the Principal Act shall not apply in relation to a provision in an agreement made after the commencement of this Act whereby an owner of a motor vehicle which has been let under a hire-purchase agreement or a person acting on his behalf is—

(a) authorised to enter premises (other than a house used as a dwelling or any building within the curtilage thereof) for the purpose of taking possession of the motor vehicle, or

[GA]

(b) relieved from liability for any such entry.

[GA]

(2) Where—

[GA]

(a) the owner of a motor vehicle let under a hire-purchase agreement has commenced an action after the commencement of this Act to recover possession of the vehicle from the hirer, and

[GA]

(b) either—

[GA]

(i) one-third of the hire-purchase price has, before the commencement of the action, been paid or tendered by or on behalf of the hirer or any guarantor, or

[GA]

(ii) the hire-purchase agreement is a further hire-purchase agreement within the meaning of section 16 of the Principal Act, and

[GA]

(c) the vehicle has been abandoned or has been left unattended in circumstances which have resulted or are imminently likely to result in damage to, or more than normal depreciation in the value of, the vehicle,

[GA]

the provisions of section 12 of the Principal Act shall not apply and the owner shall be entitled to enforce a right to recover possession of the vehicle and to retain possession thereof during the ensuing period prior to the making of an order by the court in relation to the vehicle under subsection (3) of section 13 of the Principal Act.

[GA]

(3) Where, pursuant to subsection (2) of this section, an owner of a motor vehicle enforces a right to recover possession of the vehicle—

[GA]

(a) he shall make an application to the court under subsection (3) of section 13 of the Principal Act not later than the fourteenth day after the day on which possession of the vehicle was recovered or, if the court is not sitting on that day, the first day on which the court sits after that day, and

[GA]

(b) if, on the hearing of the action referred to in subsection (2) of this section, the owner does not satisfy the court that in all the circumstances of the case he was entitled, pursuant to that subsection, to enforce his right to recover possession of the vehicle, the court may, without prejudice to any other power of the court, award to the hirer such damages payable by the owner, in respect of the recovery and the ensuing retention of possession of the vehicle, as it thinks proper.

(4) Where, pursuant to subsection (2) of this section, an owner of a motor vehicle enforces a right to recover possession of the vehicle but does not comply with the provisions of paragraph (a) of subsection (3) of this section, he shall, notwithstanding the provisions of subsection (2) of this section, be deemed to have recovered the vehicle in contravention of subsection (1) of section 12 of the Principal Act and subsection (2) of that section shall have effect accordingly.

(5) Subsection (2) of section 12 of the Principal Act shall not apply in any case in which damages are awarded under paragraph (b) of subsection (3) of this section.

(6) The Schedule to the Principal Act is, as respects hire-purchase agreements relating to motor vehicles and made after the commencement of this Act, hereby amended by the insertion at the end thereof of the paragraph set out in the Schedule to this Act.

(7) In this section “motor vehicle” means any mechanically propelled vehicle constructed for use on roads for the carriage of persons or goods and includes a tractor.

Liability of guarantor where goods are returned to owner.

17.—(1) Where—

(a) goods are let under a hire-purchase agreement, whether made before or after the commencement of this Act, and

[GA]

(b) the owner recovers possession thereof or an order is made by the court under paragraph (a) of subsection (4) of section 13 of the Principal Act for the specific delivery thereof to the owner,

[GA]

then, subject to subsection (3) of this section, the liability of a guarantor under a contract of guarantee in relation to the agreement shall not exceed the amount, if any, which the hirer would have been liable to pay under section 5 of the Principal Act if he had determined the agreement under that section at the time of the recovery or the making of the order, as the case may be.

(2) Subject to subsection (3) of this section, any provision in a contract of guarantee in relation to a hire-purchase agreement whereby the guarantor, after the recovery of possession of the goods let under the agreement or the making of an order by the court under the said paragraph (a) for the specific delivery of the goods to the owner, is subject to a liability which exceeds the liability specified in subsection (1) of this section shall be void.

(3) Subsections (1) and (2) of this section are without prejudice to any liability of the guarantor which has accrued in respect of instalments of the hire-purchase price which are due under the hire-purchase agreement and are unpaid at the time of the recovery or the making of the order, as the case may be.

(4) This section shall not have effect in respect of a claim or order in relation to a guarantor made before the commencement of this Act.

[GA]

Appropriation of payments by owner in respect of hire-purchase agreements.

18.—Where—

[GA]

(a) a hirer is entitled under section 10 of the Principal Act to appropriate a payment made after the commencement of this Act, and

[GA]

(b) the hirer fails to make an appropriation under that section, and

[GA]

(c) one-third of the hire-purchase price has been paid under each of the hire-purchase agreements in respect of which are due sums in or towards the satisfaction of which the entitlement exists,

[GA]

the owner may, notwithstanding the provisions of the said section 10, appropriate the payment in or towards the satisfaction of the sum due under any one of the agreements or in or towards the satisfaction of the sums due under any two or more of the agreements in such proportions as he thinks fit and, if he fails to make any such appropriation as aforesaid, the payment shall, by virtue of that section, be appropriated towards the satisfaction of the sums due under the respective hire-purchase agreements in the proportions which those sums bear to one another.

Jurisdiction of the courts.

19.—(1) In an action commenced after the commencement of this Act by the owner of goods let under a hire-purchase agreement to enforce a right to recover possession of the goods from the hirer—

(a) the Circuit Court shall have jurisdiction where the hire-purchase price does not exceed one thousand pounds, and

[GA]

(b) the District Court shall have jurisdiction where the hire-purchase price does not exceed one hundred pounds.

[GA]

(2) In an action commenced after the commencement of this Act by the owner of goods let under a hire-purchase agreement to enforce payment of a sum due under the hire-purchase agreement or under any contract of guarantee relating thereto—

[GA]

(a) the Circuit Court shall have jurisdiction where the amount claimed does not exceed one thousand pounds, and

[GA]

(b) the District Court shall have jurisdiction where the amount claimed does not exceed one hundred pounds.

[GA]

(3) Neither paragraph (v) of section 52 of the Courts of Justice Act, 1924, nor paragraph (a) of section 53 of the Courts of Justice Act, 1936, shall apply to an action—

[GA]

(a) in which the defendant or one, at least, of the defendants ordinarily resides or carries on any profession, business or occupation in the State, and

[GA]

(b) to which subsection (1) or subsection (2) of this section relates.

[GA]

Amendment of definition of hire-purchase price.

20.—(1) For the purposes of the Principal Act, any sum payable by the hirer under a hire-purchase agreement by way of a deposit or other initial payment, or credited or to be credited to him under such an agreement on account of any such deposit or payment, whether that sum is to be or has been paid to the owner or to any other person or is to be or has been discharged by a payment of money or by the transfer or delivery of goods or by any other means, shall form part of the hire-purchase price.

(2) This section shall apply for the purposes of the Principal Act in its application to agreements made before the commencement of this Act, except in relation to any note or memorandum of such an agreement made for the purposes of section 3 of the Principal Act.

Amendment of section 3 of the Principal Act.

21.—Paragraph (d) of subsection (2) of section 3 of the Principal Act is, as respects hire-purchase agreements made after the commencement of this Act, hereby amended by the substitution of “fourteen” for “seven”.

Amendment of section 4 of the Principal Act.

22.—Paragraph (c) of subsection (2) of section 4 of the Principal Act is, as respects credit-sale agreements made after the commencement of this Act, hereby amended by the substitution of “fourteen” for “seven”.

Restriction of section 5 of the Principal Act.

23.—(1) Section 5 of the Principal Act shall not apply in relation to hire-purchase agreements made after the commencement of this Act in respect of plant or machinery (other than mechanically propelled vehicles) which is intended for use in an industrial process and the cash price (within the meaning of section 3 of the Principal Act) of which exceeds two hundred pounds.

(2) The Schedule to the Principal Act shall, as respects hire-purchase agreements to which subsection (1) of this section relates, have effect as if “Right of Hirer to terminate Agreement” and the first four paragraphs in the notice therein prescribed were deleted.

Amendment of section 7 of the Principal Act.

24.—Subsection (1) of section 7 of the Principal Act is, as respects requests of the kind referred to in that subsection received after the commencement of this Act, hereby amended by the substitution of “seven” for “four”.

Amendment of section 16 of the Principal Act.

25.—Section 16 of the Principal Act is, as respects the enforcement after the commencement of this Act of a right to recover possession of goods let under a hire-purchase agreement, hereby amended by—

[GA]

(a) the insertion after “those goods” of “or any of them”, and

[GA]

(b) the insertion after “the commencement thereof” of “as if one-third of the hire-purchase price had been paid or tendered”.

Miscellaneous.

[GA]

Remittal or transfer of actions.

26.—(1) The jurisdiction of the High Court to remit or transfer actions under section 25 of the Courts of Justice Act, 1924, may, in relation to an action pending in the High Court by the owner of goods let under a hire-purchase agreement—

(a) to enforce a right to recover possession of the goods from the hirer, or

[GA]

(b) to enforce payment of a sum due under the hire-purchase agreement or under any contract of guarantee relating thereto,

[GA]

at any time before judgment is given in the action, be exercised by the High Court of its own motion and without application in that behalf having been made to it by any party to the action.

[GA]

(2) Paragraph (b) of subsection (2) of section 11 of the Courts of Justice Act, 1936, shall not apply in relation to an action which the High Court proposes to remit or transfer by virtue of this section.

[GA]

Judgments in actions for the recovery of goods let under hire-purchase agreements to be given only by a Judge or the Master of the High Court.

27.—Notwithstanding anything contained in rules of court, in an action in the High Court or the Circuit Court commenced after the commencement of this Act by the owner of goods let under a hire-purchase agreement claiming, whether solely or together with any other claim, the enforcement of a right to recover possession of the goods from the hirer, judgment may be obtained only from a Judge or, where appropriate, from the Master of the High Court.

Sale by dealer of goods let to him under a hire-purchase agreement.

28.—Where the hirer of goods of any class or description is a dealer in goods of that class or description and sells the goods of which he is the hirer when ostensibly acting in the ordinary course of his business as such dealer, the sale shall be as valid as if he were expressly authorised by the owner to make the sale, provided that the buyer acts in good faith and has not at the time of the sale notice that the hirer has not authority to make the sale.

Repeals.

29.—Subsection (5) of section 13 and section 20 of the Principal Act are, as respects actions commenced after the commencement of this Act, hereby repealed.

SCHEDULE.

Additional Paragraph to be included in Note or Memorandum of Hire-Purchase Agreement relating to a Motor Vehicle.

Section 16.

4. Paragraphs 1 and 2 above relating to the owner taking back the goods are modified as follows in the case of any motor vehicle (this includes a tractor):

(a) the owner is entitled to enforce any right which he may have under this agreement to enter on any premises of the hirer (other than a house used as a dwelling or any building within the curtilage thereof) for the purpose of taking back the vehicle,

(b) where the owner has made an application to the Court for an order to recover possession of the vehicle, he may, if the vehicle has been abandoned or has been left unattended in circumstances likely to result in damage to, or more than normal depreciation in the value of, the vehicle, and if the agreement so provides, take back the vehicle and retain possession of it during the ensuing period prior to the making by the Court of an order for the purpose of protecting the vehicle from damage or depreciation.
