ACHT TITHE CÚIRTE (SOLÁTHAR AGUS COTHABHÁIL), 1935.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Dlí agus Cirt;
foluíonn an abairt “cóiríocht tighe chúirte” foirgintí, áitreabhacha agus oifigí maraon leis na daingneáin ionta agus an troscán (agus daingean-chófraí d'áireamh) is gá dhóibh do réir réasúin agus foluíonn freisin téigheamh agus soillsiú na bhfoirgintí, na n-áitreabh agus na n-oifigí sin agus iad-san agus na daingneáin agus an troscán san do ghlanadh, do dheisiú, agus do chothabháil, ach ní fholuíonn leabhair ná foillseacháin eile ná cló-scríbhneóirí, páipéarachas ná abhair eile scríbhneoireachta do chur ar fáil;
cialluíonn an focal “comhairle” comhairle chontae agus foluíonn comhairle chontae-bhuirge;
cialluíonn an focal “orduithe” orduithe le rialacháin a dhéanfaidh an tAire fén Acht so;
cialluíonn an abairt “na Coimisinéirí” Coimisinéirí na nOibreacha Puiblí in Éirinn.
Cosaint d'fhoirgint a húsáidtear chun crícheanna iomdha.
2.—I gcás gan ach páirt d'fhoirgint do sholáthar agus do chothabháil agus d'úsáid mar chóríocht tighe chúirte do réir bhrí an Achta so agus i gcás an chuid eile den fhoirgint do sholáthar, do chothabháil agus d'úsáid chun crícheanna eile ní bhainfidh éinní san Acht so leis an gcuid eile sin den fhoirgint sin.
E de dhualgas ar chomhairlí cóiríocht tighe chúirte do sholáthar.
3.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an Acht so déanfaidh gach comhairle pé cóiríocht tighe chúirte ordóidh an tAire go generálta no in aon chás áirithe do sholáthar agus í chothabháil i líomatáiste feidhmiúcháin na comhairle sin chun na gcrícheanna so leanas, sé sin le rá:—
(a) i gcóir suidheanna aon Chúirte Breithiúnais ag á mbíonn suidheanna sa líomatáiste feidhmiúcháin sin, le n-a n-áirmhítear seomraí cúluithe don Bhreitheamh a bheidh i gceannas na Cúirte sin agus seomraí cúluithe do lucht dlí, do líthigh agus d'fhínnithe bheidh ag freastal suidheanna aon Chúirte den tsórt san, agus
(b) chun an ghnótha bheidh ceaptha le dlí d'aon oifig no oifigeach d'aon Chúirt den tsórt san no deintear de ghnáth in aon oifig no ag aon oifigeach den tsórt san, do dhéanamh le linn na Cúirte sin do bheith ina suidhe agus gach tráth eile, pe'ca gnó Cúirte an gnó san no nách eadh, agus
(c) chun gnótha oifige an fho-shirriaim do dhéanamh má bhíonn agus faid a bheidh an oifig sin ann.
(2) Cóiríocht tighe chúirte do bhí, díreach roimh an Acht so do rith, á cothabháil ag comhairle chun gach críche no aon chríche dá luaidhtear sa bhfo-alt deiridh sin roimhe seo den alt so tuigfear, chun crícheanna an Achta so, gur cóiríocht í do sholáthruigh an chomhairle sin do réir an Achta so agus bainfidh an tAcht so léi dá réir sin.
Coimeád agus rialú cóiríochta tighe chúirte.
4.—Fé réir orduithe generálta no áirithe an Aire beidh coimeád agus rialú cóiríochta tighe chúirte soláthrófar agus a bheidh á cothabháil fén Acht so dílsithe sa chléireach chúirte dúithche don cheanntar ina mbeidh an chóiríocht san más chun crícheanna Cúirte Dúithche agus nách chun crícheanna aon Chúirte eile bheidh an chóiríocht tighe chúirte sin á húsáid agus beidh an chóiríocht san dílsithe sa chlárathóir chontae don chontae ina mbeidh an chóiríocht san más chun crícheanna aon Chúirte seachas Cúirt Dúithche bheidh an chóiríocht san á húsáid (pe'ca bheidh sí á húsáid freisin chun crícheanna Cúirte Dúithche no ná beidh).
Airighigh do cheapadh.
5.—(1) Pé uair a bheidh coimeád aon chóiríochta tighe chúirte dílsithe fén Acht so i gclárathóir contae déanfaidh an chomhairle gur ina líomatáiste feidhmiúcháin a bheidh an chóiríocht tighe chúirte sin, chó minic agus is gá é, duine ceart oiriúnach do cheapadh agus é íoc chun bheith ina airigheach ar an gcóiríocht tighe chúirte sin agus ceapfaid amhlaidh freisin agus íocfaid pé méid daoine cearta oiriúnacha (más aon mhéid é) ordóidh an tAire (go generálta no in aon chás áirithe) chun bheith ina gcongantóirí don airigheach san.
(2) Pé uair a theipfidh ar Chomhairle ar feadh trí mhí aon cheapadh do dhéanamh is gá don chomhairle sin do réir an fho-ailt sin roimhe seo den alt so do dhéanamh féadfaidh an tAire an ceapadh san do dhéanamh agus i ngach cás den tsórt san íocfaidh an chomhairle sin go cuibhe leis an duine ceapfar amhlaidh pé luach saothair ordóidh an tAire.
(3) Pé uair a thárlóidh folúntas i bpost airighigh ar chóiríocht tighe chúirte ceapfar fé sna forálacha san roimhe seo den alt so no i bpost congantóra d'aon airigheach den tsórt san féadfaidh an clárathóir contae ag á mbeidh coimeád na cóiríochta tighe chúirte sin duine do cheapadh chun an phuist sin do líonadh go sealadach go dtí go líonfar an post san go cuibhe fé sna forálacha san roimhe seo agus i ngach cás den tsórt san déanfaidh an chomhairle gur ina líomatáiste feidhmiúcháin a bheidh an chóiríocht tighe chúirte sin pé luach saothair ordóidh an tAire d'íoc go cuibhe leis an duine ceapfar amhlaidh.
(4) Gach airigheach agus gach congantóir d'airigheach ar chóiríocht tighe chúirte ceapfar fén alt so, féadfaidh an chomhairle ag á mbeidh a luach saothair iníoctha no aon Bhreitheamh den Chúirt Uachtaraigh, den Ard-Chúirt, no den Chúirt Chuarda bheidh i gceannas suidhe bheidh ag aon chúirt den tsórt san sa chóiríocht tighe Chúirte sin no an tAire, é bhriseadh aon uair as a phost mar airigheach no congantóir den tsórt san.
(5) Ní bhainfidh an tAcht Oifigigh Cúirte, 1926 (Uimh. 27 de 1926), ná Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926 (Uimh. 39 de 1926), le héinne ceapfar ná le haon cheapadh déanfar fén alt so.
(6) I gcás duine do bheith, le linn an Achta so do rith, i seilbh phuist mar airigheach no mar chongantóir don airigheach ar aon chóiríocht tighe chúirte go mbeidh a coimeád dílsithe fén Acht so i gclárathóir contae agus é choinneáil sa phost san tar éis an Achta so do rith tuigfear gur fén alt so do ceapadh an duine sin chun an phuist sin.
Tigh cúirte do dheisiú mara ndeinidh an chomhairle amhlaidh.
6.—(1) Pé uair a theipfidh ar chomhairle no fhailleoid treo ceart agus staid cheart do choimeád ar aon chóiríocht tighe chúirte is gá don Chomhairle sin do réir an Achta so do chothabháil beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) lasmuich de chás dá bhforáltar a mhalairt leis an alt so déanfaidh an tAire, tar éis do dul i gcomhairle leis an Aire Airgid, a ordú do sna Coimisinéirí pé deisiúchán agus pé obair eile do dhéanamh is gá no is ceart chun treo ceart agus staid cheart do chur ar an gcóiríocht tighe chúirte sin agus leis sin déanfaidh na Coimisinéirí pé deisiúchán agus obair eile ordóidh an tAire;
(b) maran mó ná deich bpúint an méid a measfar a chosnóidh an deisiúchán no an obair eile sin féadfaidh an tAire a údarú don chlárathóir chontae no don chléireach chúirte dúithche ag á mbeidh coimeád na cóiríochta tighe chúirte sin a chur fé ndeár an deisiúchán no an obair eile sin do dhéanamh sa chomharsanacht.
(2) Pé uair a theipfidh ar chomhairle no fhailleoid leorsholáthar do chur ar fáil de ghual, de gheas, de leictreachas, no de shubstaint no rud eile theastóidh chun aon chóiríochta tighe chúirte bheidh soláthruithe agus á cothabháil ag an gcomhairle sin fén Acht so do shoillsiú agus do théigheamh go cuibhe agus go ceart féadfaidh an clárathóir contae no an cléireach cúirte dúithche ag á mbeidh coimeád na cóiríochta tighe chúirte sin, le toiliú an Aire, a chur fé ndeár go gcuirfear ar fáil pé méid (nách mó a chostas ná deich bpúint) den tsubstaint no den rud san a mheasfa sé, leis an toiliú roimhráite, do bheith ceart.
(3) Pé uair a dhéanfaidh na Coimisinéirí deisiúchán no obair eile fén alt so no a dhéanfaidh clárathóir no cléireach cúirte dúithche fén alt so a chur fé ndeár deisiúchán no obair eile do dhéanamh no a chur fé ndeár aon tsubstaint no rud do chur ar fáil beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) na costaisí agus na caiteachaisí fé n-a ndeachaidh na Coimisinéirí no an clárathóir contae no an cléireach cúirte dúithche sin (do réir mar a bheidh) ag déanamh an deisiúcháin no na hoibre eile sin no á chur fé ndeár é dhéanamh no á chur fé ndeár an tsubstaint no an rud san do chur ar fáil (pe'ca aea é) beidh na Coimisinéirí no an clárathóir contae no an cléireach cúirte dúithche sin (do réir mar a bheidh) i dteideal iad do bhaint mar fhiacha síbhialta, in aon Chúirt dlighinse inniúla, den chomhairle ar a mbeidh sé de dhualgas fén Acht so an chóiríocht tighe chúirte sin do chothabháil ar a ndearnadh an deisiúchán no an obair eile sin no gur ina cóir do cuireadh an tsubstaint no an rud san ar fáil;
(b) féadfaidh an tAire Airgid méid aon chostaisí no caiteachaisí fé n-a ndeachaidh na Coimisinéirí ag déanamh an deisiúcháin no na hoibre eile sin do bhaint as aon deontas no airgead eile fé n-a urláimh is iníoctha leis an gcomhairle sin mara mbeidh agus sa mhéid ná beidh an méid sin bainte amach ag na Coimisinéirí ar shlí eile agus pe'ca bheidh imeachta chun é bhaint amach bunuithe ag na Coimisinéirí no ná beidh;
(c) deimhniú i scríbhinn ar n-a shéalú le séala oifigiúil an Aire agus ag deimhniú méid aon chostaisí no caiteachaisí den tsórt a luaidhtear sa chéad mhír den fho-alt so beidh sé ina fhianaise dho-chlaoite ar mhéid na gcostaisí agus na gcaiteachaisí sin chun críche aon imeachta chun na gcostaisí agus na gcaiteachaisí sin do bhaint amach fén mír sin.
(4) Na suimeanna uile as-bhainfidh an tAire Airgid fén alt so agus an t-airgead uile bhainfidh na Coimisinéirí no clárathóir contae no cléireach cúirte dúithche amach fén alt so déanfaidh an tAire Airgid no déanfar ar pé slí ordóidh an tAire sin (pe'ca aca é) iad d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste.
(5) Ní dhéanfaidh ná ní údaróidh éinní san alt so aon oblagáid no dualgas do chur ar na Coimisinéirí leanúint no maidir le leanúint de bheith ag cothabháil aon chóiríochta tighe chúirte no de bheith ag soláthar aon tsolais no teasa inti.
Cathair agus Contae Bhaile Atha Cliath.
7.—(1) Na hoblagáidí bheidh ar Ard-Mhéara Ró-Onórach, ar Sheanóirí agus ar Bhuirgéisigh Bhaile Atha Cliath cóiríocht tighe chúirte do sholáthar agus do chothabháil fén Acht so ní raghaid thar pé cóiríocht tighe chúirte do sholáthar agus do chothabháil do réir an Achta so i Sráid na Faithche i gCathair Bhaile Atha Cliath a ordóidh an tAire le haghaidh no i dtaobh suidheanna na Príomh-Chúirte Coiriúla agus na Cúirte Cuarda i mBaile Atha Cliath.
(2) Airmheofar mar chuid den chóiríocht tighe chúirte bheidh le soláthar agus le cothabháil ag Comhairle Chontae Bhaile Atha Cliath pé cóiríocht tighe chúirte ordóidh an tAire do sholáthar agus do chothabháil i gCill Maighneann i gCathair Bhaile Atha Cliath le haghaidh no i dtaobh suidheanna den Chúirt Chuarda agus den Chúirt Dúithche, agus chun crícheanna an Achta so tuigfear an chóiríocht tighe chúirte sin do bheith i gContae Bhaile Atha Cliath.
(3) Chun crícheanna an Achta so ní háirmheofar buirg Dhún Laoghaire mar chuid do Chontae Bhaile Atha Cliath agus bainfidh an tAcht so leis an mbuirg sin agus beidh éifeacht aige inti fé is gur chontae an bhuirg sin agus gurbh iad Bárdas Dhún Laoghaire comhairle na contae sin, ach san gus an atharú so agus fé réir an atharuithe seo, eadhon, faid a leanfaidh an tigh cúirte atá in úsáid sa bhuirg sin le linn an Achta so do rith de bheith á úsáid, le toiliú an Aire, mar thigh cúirte is amach as airgead a sholáthróidh an tOireachtas a híocfar an cíos uile is iníoctha alos an tighe chúirte sin.
(4) Ní dhéanfaidh éinní san alt so dochar ná deifir do fhreagarthacht Chomhairle Chontae Bhaile Atha Cliath no Bhárdais Dhún Laoghaire maidir le cion d'íoc, fé aon alt eile den Acht so, de chostaisí aon chomhairle eile maidir le cóiríocth tighe chúirte do sholáthar agus do chothabháil.
Comhachta breitheamh maidir le hairighigh agus le n-a gcongantóirí.
8.—(1) Féadfaidh aon Bhreitheamh den Chúirt Uachtaraigh, den Ard-Chúirt, no den Chúirt Chuarda aon uair a chur de cheangal agus d'fhiachaibh ar airigheach no ar aon chongantóir d'airigheach aon chóiríochta tighe chúirte bheidh soláthruithe agus á cothabháil fén Acht so, agus ina mbeidh an Breitheamh san de thurus na huaire ag coinneáil suidhe den Chúirt Bhreithiúnais, teacht ina láthair agus féadfaidh an t-airigheach no an congantóir sin do scrúdú i dtaobh a dhualgaisí mar airigheach no mar chongantóir den tsórt san (pe'ca aca é) agus i dtaobh cólíonadh na ndualgaisí sin aige agus féadfaidh, más deimhin leis gur theip ar an airigheach no ar an gcongantóir sin na dualgaisí sin aige do chólíonadh go héifeachtúil no iad do chólíonadh in aon chor, fíneáil ná raghaidh thar deich bpúint agus a bheidh iníoctha leis an gclárathóir contae ag á mbeidh coimeád agus rialú na cóiríochta tighe chúirte sin do ghearradh ar an airigheach no ar an gcongantóir sin.
(2) Pé uair a ghearrfaidh Breitheamh fíneáil ar éinne fén alt so féadfaidh an Breitheamh san a ordú go ndéanfar, gan dochar d'aon mhodh eile chun a bainte amach, an fhíneáil sin do bhaint ina tráth-chuid no ina tráth-choda as an luach saothair is iníoctha leis an duine sin alos a oifige mar airigheach na mar chongantóir d'airigheach cóiríochta tighe chúirte agus pé uair do bhéarfaidh Breitheamh aon ordú den tsórt san uaidh beidh sé de dhualgas ar an gcomhairle ag á mbeidh an luach saothair sin iníoctha an fhíneáil sin do bhaint as dá réir sin agus méid na has-bhainte sin d'íoc leis an gclárathóir contae le n-a mbeidh an fhíneáil sin iníoctha.
(3) Gach fíneáil a gearrfar ar éinne fén alt so féadfaidh an clárathóir contae le n-a mbeidh an fhíneáil sin iníoctha í bhaint amach mar fhiacha síbhialta in aon chúirt dlighinse inniúla.
Cóiríocht tighe chúirte do chur ar cíos.
9.—(1) Beidh sé dleathach don chlárathóir chontae no don chléireach chúirte dúithche, ag á mbeidh coimeád agus rialú aon chóiríochta tighe chúirte do soláthruíodh fén Acht so, úsáid na cóiríochta tighe chúirte sin uile no úsáid aon choda dhi do chur ar cíos, pé uair is dóich leis is ceart, chun duine ar bith agus chun críche ar bith ar feadh aon tréimhse no tréimhsí ar pé táille agus ar pé coinníollacha is dóich leis an gclárathóir contae no leis an gcléireach cúirte dúithche sin is ceart ach—
(a) an cur-ar-cíos san do dhéanamh tré cheadúnas chun úsáid agus sealbhuithe agus ní mar thionóntacht ná fós i slí do dhéanfadh tiarna agus tionónta de sna páirtithe, agus
(b) gan an cur-ar-cíos san do dhéanamh i gcóir aon tréimhse do dhéanfadh ná in aon chás ina ndéanfadh an curar-cíos san cur isteach ar úsáid no dochar d'úsáid do dhéanamh den chóiríocht tighe chúirte sin chun na prímh-chríche chun a mbeidh sí á cothabháil fén Acht so.
(2) An t-airgead uile do gheobhaidh clárathóir contae no cléireach cúirte dúithche as aon chóiríocht tighe chúirte no aon chuid di do chur ar cíos aon uair fén alt so íocfaidh an clárathóir contae no an cléireach cúirte dúithche sin é leis an gcomhairle ag á mbeidh an chóiríocht tighe chúirte sin á cothabháil.

10.—(1) Pé uair a theipfidh ar chomhairle no fhailleoid dualgas do chólíonadh a cuirtear ar an gcomhairle sin leis an Acht so luighfidh imeachta um fhaoiseamh tré ordú mandamus, san Ard-Chúirt, ar agra an Aire chun a chur fhiachaint ar an gcomhairle sin an dualgas san do chólíonadh.
(2) Luighfidh imeachta fén bhfo-alt san roimhe seo d'ainneoin leigheas do bheith ann agus beidh na himeachta san gan dochar don leigheas eile sin agus ní scór chun an fhaoisimh a hiarrfar sna himeachta san do dhiúltadh an leigheas eile sin do bheith ann.
Comhachta comhairlí chun lasacht d'fháil.
11.—Chun cóiríochta tighe chúirte do sholáthar féadfaidh comhairle, le toiliú an Aire Rialtais Áitiúla agus Sláinte Puiblí, airgead d'fháil ar iasacht fé Airtiogal 22 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, fé is dá mbeadh crícheanna an ailt seo luaidhte san Airtiogal san agus ní déanfar airgead do gheobhfar ar iasacht amhlaidh d'áireamh mar chuid d'fhiacha na comhairle sin chun crícheanna an Airtiogail sin.

12.—Beidh mar chuid de chomhachta agus de dhualgaisí comhairle do réir bhrí fo-ailt (1) d'alt 10 den Local Government (Ireland) Act, 1898, comhacht agus dualgas chun cóiríochta tighe chúirte do sholáthar do réir an Achta so, agus beidh feidhm agus éifeacht dá réir sin ag an alt san mar a leasuítear é le halt 68 den Acht Rialtais Áitiúla, 1925 (Uimh. 5 de 1925).
Comhairlí, etc., do chruinniú costaisí.
13.—(1) Isé slí ina gcruinneofar na costaisí fé n-a raghaidh comhairle chun cóiríochta tighe chúirte do sholáthar agus do chothabháil do réir an Achta so ná—
(a) i gcás contae-bhuirge Bhaile Atha Cliath agus buirge Dhún Laoghaire, tríd an ráta bárdais, agus
(b) i gcás aon chontae-bhuirge eile, tríd an ráta tré n-a gcruinnítear costaisí (seachas costaisí caomhnóirí no costaisí bhaineann leis an ráta dealbhais) fé fho-alt (3) d'alt 46 den Local Government (Ireland) Act, 1898, agus
(c) i ngach cás eile, tríd an ráta dealbhais mar mhuirear ar an gcontae uile ach, i gcás Chontae Bhaile Atha Cliath, gan buirg Dhún Laoghaire d'áireamh.
(2) Pé uair a bheidh aon chóiríocht tighe chúirte, a bheidh soláthruithe agus á cothabháil do réir an Achta so ag aon chomhairle amháin (dá ngairmtear an phríomh-chomhairle sa bhfo-alt so), ag fónamh no á húsáid mar chóiríocht tighe chúirte do líomatáiste fheidhmiúcháin comhairle no comhairlí eile (dá ngairmtear na comhairlí rann-íocacha sa bhfo-alt so) íocfaidh gach ceann fé leith de sna comhairlí rann-íocacha leis an bpríomhchomhairle, ar éileamh na príomh-chomhairle, pé cion de chostaisí soláthruithe agus cothabhála na cóiríochta tighe chúirte sin ar a gcó-aontóidh na comhairlí sin no cheapfaidh an tAire Rialtais Áitiúla agus Sláinte Puiblí cheal an chó-aontuithe sin agus bainfidh an chéad fho-alt den alt so le gach suim is iníoctha ag comhairle rann-íocach fén bhfo-alt so fé is dá mba chostaisí do réir bhrí an chéad fho-ailt sin an tsuim sin.
(3) Chó luath agus is féidir é tar éis an Achta so do rith íocfaidh Comhairle Chontae Bhaile Atha Cliath agus Bárdas Dhún Laoghaire fé seach le hArd-Mhéara Ró-Onórach, Seanóirí agus Buirgéisigh Bhaile Atha Cliath (dá ngairmtear Bárdas na Cathrach sa bhfo-alt so) pé suimeanna fé seach a cheapfaidh an tAire Rialtais Áitiúla agus Sláinte Puiblí, cheal có-aontuithe, ina rann-íoc mar chabhair chun íoctha na gcostaisí fé n-a ndeachaidh Bárdas na Cathrach ag déanamh deisiúcháin speisialta, tar éis an 31adh lá de Lúnasa, 1933, agus roimh an Acht so do rith, ar an Tigh Cúirte i Sráid na Faithche i gCathair Bhaile Atha Cliath agus bainfidh an chéad fho-alt den alt so leis na suimeanna san is iníoctha amhlaidh le Bárdas na Cathrach fé is dá mba chostaisí iad do réir bhrí an fho-alt sin.
(4) Tuigfear chun crícheanna an ailt seo luach saothair airighigh agus chongantóirí airighigh aon chóiríochta tighe chúirte soláthrófar agus a bheidh á cothabháil fén Acht so do bheith ina chuid de chostaisí cothabhála na cóiríochta tighe chúirte sin.

14.—Féadfaidh an tAire, le hordú, rialacháin do dhéanamh i dtaobh éinní no aon ruda dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú.
Costaisí.
15.—Sa mhéid go gceadóidh an tAire Airgid é is amach as airgead a sholáthróidh an tOireachtas a híocfar na costaisí uile fé n-a raghaidh an tAire no na Coimisinéirí ag cur an Achta so in éifeacht.
Athghairm.
16.—Athghairmtear leis seo na hachtacháin a luaidhtear sa Sceideal a ghabhann leis an Acht so sa mhéid a luaidhtear sa tríú colún den Sceideal san.

COURTHOUSES (PROVISION AND MAINTENANCE) ACT, 1935.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Justice;
the expression “courthouse accommodation” includes buildings, premises, and offices with the fixtures therein and the furniture (including safes) reasonably necessary therefor, and also includes the heating and lighting of such buildings, premises, and offices and the cleaning, repair, and maintenance thereof and of the said fixtures and furniture, but does not include the provision of books or other publications or typewriters, stationery or other scrivenery materials;
the word “council” means the council of a county and includes the council of a county borough;
the word “prescribed” means prescribed by regulations made by the Minister under this Act;
the expression “the Commissioners” means the Commissioners of Public Works in Ireland.
Saving for building used for several purposes.
2.—Where a part only of a building is provided and maintained and is used as courthouse accommodation within the meaning of this Act and the residue of such building is provided and maintained and is used for other purposes, nothing in this Act shall apply to such residue of such building.
Duty of councils to provide courthouse accommodation.
3.—(1) Save as is otherwise provided by this Act, every council shall provide and shall maintain in the functional area of such council such courthouse accommodation for the following purposes as the Minister shall direct either generally or in any particular case, that is to say:—
(a) for the sittings of any Court of Justice sittings of which are held in such functional area, including retiring rooms for the Judge or Justice presiding in such Court and retiring rooms for members of the legal profession, litigants and witnesses attending the sittings of any such Court, and
(b) for the transaction of the business by law assigned to or usually transacted in or by any office or officer of any such Court, both during the sitting of such Court and at all other times, whether such business is Court business or not, and
(c) for the transaction of the business of the office of the under-sheriff where and so long as such office exists.
(2) Courthouse accommodation which is, immediately before the passing of this Act, maintained by a council, for all or any of the purposes mentioned in the foregoing sub-section of this section shall, for the purposes of this Act, be deemed to have been provided by such council in pursuance of this Act and this Act shall apply thereto accordingly.
Custody and control of courthouse accommodation.
4.—Subject to the general or particular directions of the Minister, the custody and control of courthouse accommodation which is provided and maintained under this Act shall, where such courthouse accommodation is used for the purposes of a District Court and no other Court, be vested in the district court clerk for the district in which such accommodation is situate, and shall, where such accommodation is used for the purposes of any Court other than a District Court (whether it is or is not also; used for the purposes of a District Court), be vested in the county registrar for the county in which such accommodation is situate.
Appointment of caretakers.
5.—(1) Whenever the custody of any courthouse accommodation is vested under this Act in a county registrar, the council in whose functional area such courthouse accommodation is situate shall as often as occasion requires appoint and shall pay a fit and proper person to be the caretaker of such courthouse accommodation, and shall also so appoint and shall pay so many (if any) fit and proper persons as the Minister shall direct (either generally or in any particular case) to be assistants to such caretaker.
(2) Whenever a Council fails for three months to make any appointment which such council is required by the foregoing sub-section of this section to make, the Minister may make such appointment, and in every such case such council shall duly pay to the person so appointed such remuneration as the Minister shall direct.
(3) Whenever a vacancy occurs in the post of a caretaker of courthouse accommodation who is appointed under the foregoing provisions of this section or in the post of assistant to any such caretaker, the county registrar having the custody of such courthouse accommodation may appoint a person to fill such post temporarily until such post is duly filled under the said foregoing provisions, and in every such case the council in whose functional area such courthouse accommodation is situate shall duly pay to the person so appointed such remuneration as the Minister shall direct.
(4) Every caretaker and every assistant to a caretaker of courthouse accommodation appointed under this section may at any time be dismissed from his post as such caretaker or assistant by the council by whom his remuneration is payable or by any Judge of the Supreme Court, the High Court, or the Circuit Court presiding at a sitting of any such Court in such courthouse accommodation, or by the Minister.
(5) Neither the Court Officers Act, 1926 (No. 27 of 1926), nor the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926), shall apply to any person appointed or to any appointment made under this section.
(6) Where the person who holds at the passing of this Act the post of caretaker or of assistant to the caretaker of any courthouse accommodation the custody of which is vested under this Act in a county registrar is continued in such post after the passing of this Act, such person shall be deemed to have been appointed to such post under this section.
Repair of courthouse in case of failure of council to repair same.
6.—(1) Whenever a council fails or neglects to maintain in proper repair and condition any courthouse accommodation which such council is required by this Act to maintain, the following provisions shall have effect, that is to say:—
(a) save as is otherwise provided by this section, the Minister shall, after consultation with the Minister for Finance, direct the Commissioners to execute such repairs and do such other work as may be necessary or proper to put such courthouse accommodation into proper repair and condition, and thereupon the Commissioners shall execute such repairs and do such other work as the Minister shall direct;
(b) where the estimated cost of the said repairs or other work does not exceed ten pounds, the Minister may authorise the county registrar or district court clerk having custody of such courthouse accommodation to procure the said repairs or other work to be done locally.
(2) Whenever a council fails or neglects to provide a sufficient supply of coal, gas, electricity, or other substance or thing required for the due and proper lighting or heating of any courthouse accommodation provided and maintained by such council under this Act, the county registrar or district court clerk having custody of such courthouse accommodation may, with the consent of the Minister, procure the supply of such amount (not exceeding ten pounds in cost) as he shall, with the consent aforesaid, think proper of such substance or thing.
(3) Whenever the Commissioners have executed repairs or done other work under this section or a county registrar or a district court clerk has under this section procured repairs or other work to be done or procured the supply of any substance or thing, the following provisions shall have effect, that is to say:—
(a) the Commissioners or such county registrar or district court clerk (as the case may be) shall be entitled to recover the costs and expenses incurred by them or him in the execution or procuring the doing of such repairs or other work or procuring the supply of such substance or thing (as the case may be) as a civil debt in any Court of competent jurisdiction from the council charged under this Act with the duty of maintaining the courthouse accommodation to or for which such repairs or other work were done or such substance or thing was supplied;
(b) the amount of any costs or expenses which have been incurred by the Commissioners in the execution of such repairs or other work may, if and so far as such amount is not otherwise recovered by the Commissioners and whether proceedings for the recovery thereof have or have not been instituted by the Commissioners, be deducted by the Minister for Finance from any grant or other moneys under his control payable to such council;
(c) a certificate in writing sealed with the official seal of the Minister certifying the amount of any such costs or expenses as are mentioned in the first paragraph of this sub-section shall be conclusive evidence of the amount of such costs and expenses for the purpose of any proceedings for the recovery of such costs and expenses under the said paragraph.
(4) All amounts deducted by the Minister for Finance under this section and all moneys recovered by the Commissioners or by a county registrar or district court clerk under this section shall be paid into or disposed of for the benefit of the Exchequer either (as the case may be) by the Minister for Finance or in such manner as that Minister shall direct.
(5) Nothing in this section shall impose or authorise the imposing on the Commissioners of any obligation or duty for or in respect of the continuing maintenance of any courthouse accommodation or the continuing provision of any light or heat therein.
The City and County of Dublin.
7.—(1) The obligations of the Right Honorable the Lord Mayor, Aldermen, and Burgesses of Dublin to provide and maintain courthouse accommodation under this Act shall be limited to providing and maintaining in accordance with this Act at Green Street in the City of Dublin such courthouse accommodation as the Minister shall direct for or in relation to the sittings in Dublin of the Central Criminal Court and the Circuit Court.
(2) The courthouse accommodation to be provided and maintained by the Council of the County of Dublin shall include the provision and maintenance at Kilmainham in the City of Dublin of such courthouse accommodation as the Minister shall direct for or in relation to sittings of the Circuit Court and of the District Court, and for the purposes of this Act such courthouse accommodation shall be deemed to be situate in the County of Dublin.
(3) For the purposes of this Act the borough of Dun Laoghaire shall not be reckoned as part of the County of Dublin, and this Act shall apply to and have effect in the said borough as if that borough were a county and the Corporation of Dun Laoghaire were the council of such county, but with and subject to the modification that, so long as the courthouse in use in the said borough at the passing of this Act continues to be used with the consent of the Minister as a courthouse, all rent payable in respect of such courthouse shall be defrayed out of moneys provided by the Oireachtas.
(4) Nothing in this section shall prejudice or affect the liability of the Council of the County of Dublin or of the Corporation of Dun Laoghaire to pay, under any other section of this Act, a proportion of the expenses of the provision and maintenance of courthouse accommodation by any other council.
Powers of judges in respect of caretakers and their assistants.
8.—(1) Any Judge of the Supreme Court, the High Court, or the Circuit Court may at any time require and enforce the attendance before him of the caretaker or any assistant to the caretaker of any courthouse accommodation provided and maintained under this Act in which such Judge is for the time being holding a sitting of the Court of Justice and may examine such caretaker or assistant in regard to his duties as such caretaker or assistant (as the case may be) and his performance of such duties, and may, if he is satisfied that such caretaker or assistant has failed to perform his said duties efficiently or at all, impose on such caretaker or assistant a fine not exceeding ten pounds payable to the county registrar having the custody and control of the said courthouse accommodation.
(2) Whenever a Judge imposes under this section a fine on any person, such Judge may direct that, without prejudice to any other method of recovery, such fine shall be deducted in one or more instalments from the remuneration payable to such person in respect of his office as the caretaker or assistant to the caretaker of courthouse accommodation, and whenever a Judge gives any such direction it shall be the duty of the council by whom such remuneration is payable to make such deduction therefrom accordingly and to pay the amount of such deduction to the county registrar to whom the said fine is payable.
(3) Every fine imposed under this section on any person may be recovered as a civil debt in any court of competent jurisdiction by the county registrar to whom such fine is payable.
Letting of courthouse accommodation.
9.—(1) It shall be lawful for the county registrar or district court clerk having the custody and control of any courthouse accommodation provided under this Act to let out on hire whenever he thinks proper to any person for any purpose the use of all or any part of such courthouse accommodation for any period or periods at such charge and on such conditions as such county registrar or district court clerk shall think proper but subject to the limitations—
(a) that such letting out on hire shall be made by way of licence to use and occupy and not by way of tenancy nor so as to create the relation of landlord and tenant, and
(b) such letting out on hire shall not be made for any period or in any circumstances which would cause such letting out on hire to interfere with or prejudice the use of such courthouse accommodation for the primary purpose for which it is maintained under this Act.
(2) All moneys received by a county registrar or district court clerk for any letting out on hire under this section of all or any part of any courthouse accommodation shall be paid by such county registrar or district court clerk to the council by whom such courthouse accommodation is maintained.
Remedy by mandamus against defaulting council.
10.—(1) Whenever a council fails or neglects to perform a duty imposed on such council by this Act, proceedings for relief by way of an order of mandamus to enforce the performance of such duty by such council shall lie in the High Court at the suit of the Minister.
(2) Proceedings under the foregoing sub-section shall lie notwithstanding the existence of an alternative remedy and shall be without prejudice to such alternative remedy, and the existence of such alternative remedy shall not be a ground for the refusal of the relief sought in such proceedings.
Borrowing powers of councils.
11.—For the purpose of providing courthouse accommodation a council may, with the consent of the Minister for Local Government and Public Health, borrow money under Article 22 of the Schedule to the Local Government (Application of Enactments) Order, 1898, in like manner as if the purposes of this section were mentioned in that Article, and money so borrowed shall not be reckoned as part of the debt of such council for the purposes of the said Article.
Acquisition of land by councils.
12.—The provision of courthouse accommodation in pursuance of this Act shall be part of the powers and duties of a council within the meaning of sub-section (1) of section 10 of the Local Government (Ireland) Act, 1898, and that section as amended by section 68 of the Local Government Act, 1925 (No. 5 of 1925), shall apply and have effect accordingly.
Raising of expenses by councils, etc.
13.—(1) The expenses incurred by a council in the provision and maintenance of courthouse accommodation in pursuance of this Act shall be raised—
(a) in the case of the county borough of Dublin and of the borough of Dun Laoghaire by means of the municipal rate, and
(b) in the case of any other county borough by means of the rate by which expenses (other than expenses of guardians or in connection with the poor rate) are raised under sub-section (3) of section 46 of the Local Government (Ireland) Act, 1898, and
(c) in every other case, by means of the poor rate as a county-at-large charge, but, in the case of the County of Dublin, exclusive of the borough of Dun Laoghaire.
(2) Whenever any courthouse accommodation which is provided and maintained in pursuance of this Act by one council (in this sub-section called the principal council) serves or is used as courthouse accommodation in respect of the functional area of one or more other councils (in this sub-section called the contributing councils), every of the contributing councils shall pay to the principal council on demand by the principal council such proportion of the expenses of the provision and the maintenance of such courthouse accommodation as shall be agreed upon by such councils or, in default of such agreement, shall be fixed by the Minister for Local Government and Public Health, and the first sub-section of this section shall apply to every sum payable by a contributing council under this sub-section as if such sum were expenses within the meaning of the said first sub-section.
(3) As soon as may be after the passing of this Act, the Council of the County of Dublin and the Corporation of Dun Laoghaire shall respectively pay to the Right Honorable the Lord Mayor, Aldermen and Burgesses of Dublin (in this sub-section called the City Corporation) such respective sums as, in default of agreement, shall be fixed by the Minister for Local Government and Public Health, by way of contribution towards the expenses incurred by the City Corporation in the execution, after the 31st day of August, 1933, and before the passing of this Act, of special repairs to the Courthouse at Green Street in the City of Dublin, and the first sub-section of this section shall apply to the said sums so payable to the City Corporation as if they were expenses within the meaning of that sub-section.
(4) The remuneration of the caretaker and the assistants of the caretaker of any courthouse accommodation provided and maintained under this Act shall be deemed, for the purposes of this section, to be part of the expenses of the maintenance of such courthouse accommodation.
Regulations.
14.—The Minister may by order make regulations prescribing any matter or thing which is in this Act referred to as prescribed or to be prescribed.
Expenses.
15.—All expenses incurred by the Minister or the Commissioners in carrying this Act into effect shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
16.—The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of the said Schedule.
Short title.
17.—This Act may be cited as the Courthouses (Provision and Maintenance) Act, 1935.
