PART I.
PRELIMINARY.
Short title.
1.—This Act may be cited as the Censorship of Publications Act, 1929.
Definitions.
2.—In this Act—
the word “Minister” means the Minister for Justice;
the expression “periodical publication” includes any newspaper, magazine, journal, or other printed publication which is published periodically or in parts or numbers;
the word “book” includes every printed publication which is not a periodical publication and, save where the context otherwise requires, includes every edition of such book;
neither the expression “periodical publication” nor the word “book” shall include a journal, book, or other publication which is certified by the Board to be published bona fide for the information or instruction of members of the medical or legal profession;
the word “indecent” shall be construed as including suggestive of, or inciting to sexual immorality or unnatural vice or likely in any other similar way to corrupt or deprave.
PART II.
CENSORSHIP OF PUBLICATIONS.
Establishment of Censorship of Publications Board.
3.—(1) There shall be established a board to be called and known as the Censorship of Publications Board (in this Act referred to as the Board) consisting of five members appointed under this section.
(2) The Minister shall, as soon as may be after the passing of this Act and from time to time thereafter as occasion requires, appoint five fit and proper persons to be the members of the Board.
(3) Such member of the Board as the Minister shall from time to time nominate for the purpose shall be the Chairman of the Board.
(4) Subject to the provisions of this section in relation to persons appointed to fill casual vacancies, every member of the Board shall, unless he sooner dies, resigns or is removed, hold his office as such member for the term of three years reckoned, in the case of the first members, from the date of his appointment, and in the case of every subsequent member, from the expiration of the term of office of his predecessor.
(5) A member of the Board appointed to fill a casual vacancy in the Board shall, unless he sooner dies, resigns or is removed, hold office for the residue of the term for which the member whose death, resignation, or removal occasioned the vacancy would have held office if he had not died, resigned or been removed.
(6) A member of the Board may at any time resign his office as such member by letter addressed to the Minister.
(7) The Minister may remove from membership of the Board any member of the Board who is absent (otherwise than on account of illness) from four consecutive meetings of the Board or who becomes unfit in the opinion of the Minister to be a member of the Board.
(8) Every member of the Board shall on the cesser of his membership by effluxion of time be eligible for re-appointment.
Officers and servants.
4.—The Minister may appoint such and so many fit and proper persons to be officers and servants of the Board as, subject to the consent of the Minister for Finance, he may consider necessary for the purposes of this Act, and the officers and servants so appointed shall hold office upon such terms and shall be remunerated at such rates and in such manner as the Minister for Finance shall sanction.
Meetings and procedure of the Board.
5.—(1) The first meeting of the Board shall be held at such time as the Minister shall appoint, and subsequent meetings of the Board shall be held at such times as the Board shall appoint either generally or in respect of any particular meeting.
(2) At every meeting of the Board the Chairman of the Board, if present, shall be the chairman of the meeting, or, if the Chairman of the Board is absent, such member of the Board as the members of the Board then present shall choose shall be the chairman of the meeting.
(3) The Board may act notwithstanding a vacancy in their membership.
Prohibition orders in respect of books.
6.—(1) Whenever a complaint is duly made under this Act to the Minister to the effect that a book or a particular edition of a book is indecent or obscene or advocates the unnatural prevention of conception or the procurement of abortion or miscarriage or the use of any method, treatment or appliance for the purpose of such prevention or such procurement, the Minister may refer such complaint to the Board.
(2) The Board shall consider every complaint referred to them by the Minister under this section and for the purpose of such consideration shall examine the book or the particular edition of a book which is the subject of such complaint and on the completion of such consideration the Board shall make to the Minister their report on such complaint.
(3) When considering a complaint referred to them under this section the Board shall have regard to all or any of the following matters, that is to say:—
(a) the literary, artistic, scientific or historic merit or importance and the general tenor of the book or the particular edition of a book which is the subject of such complaint,
(b) the language in which such book or edition is printed or produced,
(c) the nature and extent of the circulation which, in the opinion of the Board, such book or edition is intended to have,
(d) the class of reader in Saorstát Eireann which, in the opinion of the Board, may reasonably be expected to read such book or edition, and
(e) any other matter relating to such book or edition which appears to the Board to be relevant.
(4) When considering a complaint referred to them under this section the Board may communicate with the author, editor, or publisher of the book or the particular edition of a book which is the subject of such complaint and may take into account any representation made in relation to such book or edition by the author, editor, or publisher thereof.
(5) The Board may at any time make to the Minister a report in respect of any book or any particular edition of a book although no complaint in regard to such book or edition has been referred to them by the Minister, and in considering the making of a report under this sub-section in respect of a book or particular edition of a book the Board may have regard to the like matters and communicate with the like persons in relation to such book or edition as they are by this section authorised to have regard to or to communicate with when considering a complaint referred to them under this section.
(6) Whenever the Board under this section makes a report, not dissented from by more than one and assented to by at least three members of the Board, stating that in the opinion of the Board the book or the particular edition of a book which is the subject of such report is in its general tendency indecent or obscene and should for that reason be prohibited or that in the opinion of the Board such book or edition advocates the unnatural prevention of conception or the procurement of abortion or miscarriage or the use of any method, treatment or appliance for the purpose of such prevention or such miscarriage and should for that reason be prohibited, the Minister may by order (in this Act referred to as a prohibition order) prohibit the sale and distribution in Saorstát Eireann of such book or of such edition of a book.
(7) Where a report is proposed to be made by the Board under this section and either one member or two members of the Board has or have not signified any opinion (whether assenting or dissenting) in regard to such proposed report and the circumstances are such that the signification by such member or members of his opinion or their respective opinions (as the case may be) in regard to such proposed report might affect the operation of such proposed report in respect of the power of the Minister to make under this section a prohibition order in consequence thereof, a copy of such proposed report shall be sent by registered post to such member or to each of such two members (as the case may be) and a report shall not be finally made by the Board until after the expiration of seven days from such posting.
(8) A prohibition order made under this section in relation to a book shall, unless it is limited to one or more particular editions of such book, apply to every edition of such book whether published before or after the date of such order save such (if any) editions thereof as may be excluded by an amending order from the application of such prohibition order.
Prohibition orders in respect of periodical publications.
7.—(1) Whenever a complaint is duly made under this Act to the Minister to the effect that the several issues of a periodical publication recently theretofore published have usually or frequently been indecent or obscene or have advocated the unnatural prevention of conception or the procurment of abortion or miscarriage or the use of any method, treatment or appliance for the purpose of such prevention or such procurement or have devoted an unduly large proportion of space to the publication of matter relating to crime, the Minister may refer such complaint to the Board.
(2) The Board shall consider every complaint referred to them by the Minister under this section and for the purpose of such consideration shall examine the issues theretofore recently published of the periodical publication which is the subject of such complaint and on completion of such consideration the Board shall make to the Minister their report on such complaint.
(3) Whenever the Board under this section makes in reference to a complaint a report not dissented from by more than one and assented to by at least three members of the Board stating that in the opinion of the Board the issues recently theretofore published of the periodical publication which is the subject of such complaint have usually or frequently been indecent or obscene and should for that reason be prohibited or that in the opinion of the Board such issues have advocated the unnatural prevention of conception or the procurement of abortion or miscarriage or the use of any method, treatment or appliance for the purpose of such prevention or such procurement and should for that reason be prohibited or have devoted an unduly large proportion of space to the publication of matter relating to crime, and should for that reason be prohibited, the Minister may by order (in this Act referred to as a prohibition order) prohibit the sale and the distribution in Saorstát Eireann of any issue of such periodical publication published after the day on which such order comes into operation.
(4) Where a report is proposed to be made by the Board under this section and either one member or two members of the Board has or have not signified any opinion (whether assenting or dissenting) in regard to such proposed report and the circumstances are such that the signification by such member or members of his opinion or their respective opinions (as the case may be) in regard to such proposed report might affect the operation of such proposed report in respect of the power of the Minister to make under this section a prohibition order in consequence thereof, a copy of such proposed report shall be sent by registered post to such member or to each of such two members (as the case may be) and a report shall not be finally made by the Board until after the expiration of seven days from such posting.
(5) A prohibition order made under this section in respect of a periodical publication in respect of which no such prohibition order has previously been made shall, unless previously revoked under this Act, continue in force for three months from the day on which it comes into operation and shall then expire.
Revocation and amendment of prohibition orders.
8.—(1) The Minister may at any time after consultation with the Board by order revoke any prohibition order theretofore made by him under this Act.
(2) Where a prohibition order has been made by the Minister under this Act in relation to a book, the Minister may at any time, after consultation with the Board, by order amend such prohibition order by excluding from the application thereof any particular edition of such book whether published before or after the date of such prohibition order.
Publication of prohibition orders.
9.—Every prohibition order and every order made by the Minister under this Act revoking or amending any such prohibition order shall be published in the Iris Oifigiúil as soon as may be after it is made and shall come into operation and have effect as on and from the day on which it is so published.
Offences in relation to prohibited publications.
10.—(1) It shall not be lawful for any person, otherwise than under and in accordance with a permit in writing granted to him under this section—
(a) to import into Saorstát Eireann for sale or distribution, or
(b) to sell, or expose, offer, advertise or keep for sale, or
(c) to distribute or offer or keep for distribution,
any book or any particular edition of a book or any issue of a periodical publication the sale and distribution of which in Saorstát Eireann is for the time being prohibited by a prohibition order.
(2) Every person who acts in contravention of the foregoing sub-section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment with or without hard labour, for any term not exceeding six months or to both such fine and such imprisonment and, in any case, to forfeiture of the book, edition, or issue in respect of which such offence was committed.
(3) The Minister may if he thinks fit for reasons which appear to him sufficient grant to any person a permit in writing to sell and keep for sale or to distribute and keep for distribution and (where appropriate) to import into Saorstát Eireann any specified book or any specified edition of a book or all or any particular issues of a specified periodical publication the sale and distribution of which in Saorstát Eireann is for the time being prohibited by a prohibition order, and the Minister may grant any such permit subject to such (if any) conditions and limitations as he may think fit to impose and shall specify in such permit.
Register of prohibited publications.
11.—(1) The Minister shall prepare and keep a register to be called and known as “The Register of Prohibited Publications” (in this section referred to as the register) in such form as shall be prescribed by the Minister by regulations made under this Act.
(2) Whenever a prohibition order is made there shall forthwith be entered in the register—
(a) if such order relates to a book, the name of such book, the edition or editions of such book to which such order applies, the names of the author and the publisher of such book if and as stated in such book, the date of such order and the date of the publication thereof in the Iris Oifigiúil, and
(b) if such order relates to a periodical publication, the name of such publication, the names of the proprietor and the publisher of such publication if and as stated in such publication, the date of such order and the date of the publication thereof in the Iris Oifigiúil.
(3) Whenever a prohibition order is revoked by the Minister under this Act the entry in the register of the book or periodical publication to which such order relates shall be erased and whenever a prohibition order is amended by the Minister under this Act the particulars of such amending order and of the amendment effected thereby shall be entered in the register opposite the entry of such book or periodical publication.
(4) The Minister shall cause the register to be printed, published and made available to the public in such manner and at such times as he shall think proper.
(5) It shall be the duty of every Customs official examining the baggage of incoming travellers to exhibit on demand a list of all books which are at the time being the subject of a prohibition order.
(6) The register shall be open to inspection free of charge by any person at such place in the City of Dublin and at such hours as shall be prescribed by the Minister by regulations made under this Act and a copy of any entry in the register certified by an officer of the Minister to be a true copy shall be furnished by the Minister to any person on payment of such charge as shall be fixed from time to time by the Minister with the consent of the Minister for Finance.
(7) A document purporting to be a copy of an entry in the register and to be certified by an officer of the Minister to be a true copy shall, without proof of the signature of such officer or of the fact that he is such officer, be accepted in all courts of justice as evidence until the contrary is proved of the terms of such entry and that the same was contained in the register at the date on which such certificate purports to have been given.
(8) The fact that a book or a periodical publication is at any particular time entered in the register shall be conclusive evidence that a prohibition order has been made in regard thereto and that such order is then still in force and the terms of such entry in the register shall be conclusive evidence of the editions of such book or issues of such periodical publication to which such order applies.
Search warrant in respect of prohibited books, etc.
12.—(1) Where a Justice of the District Court is satisfied on the information on oath of an officer of the Gárda Síochána not below the rank of chief superintendent that there is reasonable ground for suspecting that in any specified building, land, premises or other place there are kept for sale or distribution any books, or periodical publications the sale and distribution of which in Saorstát Eireann are then prohibited by a prohibition order, such Justice may issue to such officer such search warrant as is mentioned in this section.
(2) A search warrant issued by a Justice of the District Court under this section shall be expressed and shall operate to authorise a named officer of the Gárda Síochána not below the rank of superintendent, accompanied by such other members of the Gárda Síochána as such officer shall think proper, at any time within forty-eight hours after the issue of the search warrant, and if needs be by force, to enter and search the specified building, land, premises, or other place aforesaid (which place shall be also specified in the warrant) for books, or periodical publications the sale and distribution of which in Saorstát Eireann is then prohibited by a prohibition order and to seize and remove all such books and periodical publications found on such search.
Customs and postal restrictions.
13.—(1) Where a prohibition order has been made in relation to a book or a particular edition of a book or a periodical publication, then so long as such order is in operation the importation (otherwise than under and in accordance with a permit in writing granted under this Act) of any edition of such book or issue of such periodical publication (as the case may be) to which such order for the time being applies shall be added to and included in the table of prohibitions and restrictions inwards contained in section 42 of the Customs Consolidation Act, 1876, and that section shall have effect accordingly.
(2) The Minister for Posts and Telegraphs may by order under this section make regulations for the purpose of preventing the sending or delivery by post (otherwise than under and in accordance with a permit in writing granted under this Act) of any edition of a book or any issue of a periodical publication to which a prohibition order for the time being applies and for the delivery to the Minister for Justice of any such edition or issue intercepted in course of transmission by post.
PART III.
REPORTS OF JUDICIAL PROCEEDINGS.
Restrictions on publication of reports of judicial proceedings.
14.—(1) It shall not be lawful to print or publish or cause or procure to be printed or published in relation to any judicial proceedings—
(a) any indecent matter the publication of which would be calculated to injure public morals, or
(b) any indecent medical, surgical or physiological details the publication of which would be calculated to injure public morals.
(2) It shall not be lawful to print or publish or cause or procure to be printed or published any report, statement, commentary or other matter of or in relation to any judicial proceedings for divorce, nullity of marriage, judicial separation, or restitution of conjugal rights save and except all or any of the following particulars of such proceedings, so far as the same can be printed and published without contravening any other sub-section of this section, that is to say:—
(a) the names, addresses, and occupations of the parties and witnesses,
(b) the court in which and the Judge before whom the proceedings were tried and the names of the solicitors and counsel professionally engaged in the proceedings,
(c) a concise statement of the charges, defences, and counter-charges in support of which evidence was given,
(d) particulars of any point of law raised and discussed in the proceedings and the decision of the court thereon,
(e) the summing-up of the Judge and the findings of the jury or the decision of the court and the observations of the Judge when pronouncing his decision.
(3) Nothing in this section shall apply—
(a) to the printing of any pleading, transcript of evidence, or other document for use in connection with any judicial proceedings or the communication thereof to persons concerned in the proceedings, or
(b) to the printing and publishing of any order, notice, or report in pursuance of the directions of the court, or
(c) to the printing or publishing of any matter in any separate volume or part of any bona fide series of law reports which does not form part of any other publication and consists solely of reports of proceedings in courts of law, or in any publication of a technical character bona fide intended for circulation among members of the legal profession or medical profession.
Offences in relation to the publication of reports of judicial proceedings.
15.—(1) If any person being the proprietor, editor or publisher of any book or periodical publication or being a master printer engaged in the printing of such book or publication prints or publishes or causes, procures or permits to be printed or published therein in contravention of any of the provisions of this Part of this Act any matter, details, or particulars in relation to any judicial proceedings such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five hundred pounds or at the discretion of the court to imprisonment with or without hard labour for any term not exceeding six months or to both such fine and such imprisonment.
(2) Every prosecution for an offence under this section shall be brought at the suit and in the name of the Attorney-General.
PART IV.
MISCELLANEOUS AND GENERAL.
Prohibition of publications advocating contraceptives.
16.—(1) It shall not be lawful for any person, otherwise than under and in accordance with a permit in writing granted to him under this section—
(a) to print or publish or cause or procure to be printed or published, or
(b) to sell or expose, offer, or keep for sale, or
(c) to distribute, offer or keep for distribution,
any book or periodical publication (whether appearing on the register of prohibited publications or not) which advocates or which might reasonably be supposed to advocate the unnatural prevention of conception or the procurement of abortion or miscarriage or any method, treatment, or appliance to be used for the purpose of such prevention or such procurement.
(2) Every person who acts in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds, or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.
(3) A book or periodical publication containing an advertisement relating to a book or periodical publication which advocates or might reasonably be supposed to advocate within the meaning of sub-section (1) of this section one or more of the matters mentioned in that sub-section shall not, by reason only of its containing such advertisement, be deemed itself to advocate any of such matters, provided such advertisement is inserted for reward and is not and could not reasonably be supposed to be itself an advocacy of any such matter.
(4) Where a person who carries on the business of selling or distributing books or periodicals or other publications is charged with an offence under this section it shall be a good defence to such charge to prove that he committed the act alleged to constitute such offence in the ordinary course of his said business, and that he could not by the exercise of reasonable care have known or ascertained the contents of the book or other publication in respect of which such act was committed.
(5) The Minister may if he thinks fit for reasons which appear to him sufficient grant to any person a permit in writing to do all or any of the following things, that is to say, to print, publish, import, sell, keep for sale, distribute, or keep for distribution any book or periodical publication the printing, publishing, importing, selling, or distributing of which without such permit would be a contravention of this section and the Minister may grant any such permit subject to such (if any) conditions and limitations as he may think fit to impose and shall specify in such permit.
(6) The Minister for Posts and Telegraphs may by order under this section make regulations for the purpose of preventing the sending or delivery by post (otherwise than under and in accordance with a permit in writing granted under this Act) of any book or periodical publication the distribution of which is prohibited by this section.
Amendment of the Indecent Advertisements Act, 1889.
17.—(1) The reference contained in section 3 of the Indecent Advertisements Act, 1889, to printed matter which is of an indecent or obscene character shall be deemed to include advertisements which relate or refer or may be reasonably supposed to relate or refer to any disease affecting the generative organs of either sex, or to any complaint or infirmity arising from or relating to sexual intercourse, or to the prevention or removal of irregularities in menstruation, or to drugs, medicines, appliances, treatment, or methods for procuring abortion or miscarriage or preventing conception.
(2) Any person summarily convicted of an offence under section 3 of the Indecent Advertisements Act, 1889 shall, in lieu of the punishments mentioned in that section, be liable to a fine not exceeding ten pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months.
(3) Any person summarily convicted of an offence under section 4 of the Indecent Advertisements Act, 1889 shall, in lieu of the punishments mentioned in that section, be liable to a fine not exceeding twenty-five pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months.
Prohibition of sale of indecent pictures.
18.—(1) It shall not be lawful for any person to sell or offer, expose, or keep for sale, or import for sale any indecent picture and every person who sells or offers, exposes, or keeps for sale or imports for sale any indecent picture in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding fifty pounds and, in the case of a second or any subsequent offence, to a fine not exceeding one hundred pounds or, at the discretion of the court, to imprisonment with or without hard labour for any term not exceeding six months and, in any case, to forfeiture of every indecent picture so sold or offered, exposed, or kept for sale by him.
(2) The word “indecent” where the same occurs in section 42 of the Customs Consolidation Act, 1876 shall have the same meaning and construction as it has in this Act and the said section 42 shall be construed and have effect accordingly.
Search warrant in respect of indecent pictures.
19.—(1) Where a Justice of the District Court is satisfied on the information on oath of an officer of the Gárda Síochána not below the rank of chief superintendent that there is reasonable ground for suspecting that in any specified building, land, premises or other place there are kept for sale any indecent pictures, such Justice may issue to such officer such search warrant as is mentioned in this section.
(2) A search warrant issued by a Justice of the District Court under this section shall be expressed and shall operate to authorise a named officer of the Gárda Síochána not below the rank of superintendent, accompanied by such other members of the Gárda Síochána as such officer shall think proper, at any time within forty-eight hours after the issue of the search warrant, and if needs be by force, to enter and search the specified building, land, premises, or other place aforesaid (which place shall be also specified in the warrant) for indecent pictures and to seize and remove all such pictures found on such search.
(3) The Obscene Publications Act, 1857 is hereby repealed.
Regulations.
20.—(1) The Minister may by order make regulations prescribing all or any of the following matters and things, that is to say:—
(a) the manner and form in which complaints are to be made to the Minister under this Act,
(b) the procedure of the Censorship of Publications Board and the forms to be used by them for the purposes of this Act,
(c) any matter or thing referred to in this Act as prescribed or to be prescribed by the Minister by regulations made under this Act.
(2) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which such House has sat after such regulation is laid before it annulling such regulation, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Expenses.
21.—All expenses incurred in carrying this Act into execution shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

SCRUDOIREACHT FHOILLSEACHAN.

3.—(1) Bunófar bord ar a dtabharfar mar ainm agus mar theideal an Bord um Scrúdóireacht Fhoillseachán (dá ngairmtear an Bord san Acht so) agus a bheidh có-dhéanta de chúigear ball a ceapfar fén alt so.
(2) Déanfidh an tAire, chó luath agus is féidir é tar éis rithte an Achta so agus o am go ham ina dhiaidh sin fé mar is gá é, cúigear daoine cearta oiriúnacha do cheapa chun bheith ina mbaill den Bhord.
(3) Isé bheidh ina Chathaoirleach ar an mBord ná pé ball den Bhord a ainmneoidh an tAire chuige sin o am go ham.
(4) Fé réir na bhforálacha den alt so i dtaobh daoine a ceapfar chun foth-fholúntaisí, marab éag, eirghe as no cur as oifig roimhe sin do, bheidh gach ball den Bhord i seilbh a oifige mar bhall den tsórt san ar feadh téarma trí mblian a háireofar, i gcás na gcéad bhall, o dháta a cheaptha agus, i gcás gach baill ina dhiaidh sin, ón am a bheidh téarma oifige an té bhí roimhe caithte.
(5) Ball den Bhord a ceapfar chun foth-fholúntais sa Bhord, beidh sé, marab éag, eirghe as no cur as oifig roimhe sin do, i seilbh oifige ar feadh an iarsma den téarma go mbeadh ag an mball, 'na dtáinig an folúntas tré éag, eirghe as no cur as oifig do, seilbh oifige mara mbeadh a éag, a eirghe as no a chur as oifig.
(6) Féadfidh ball den Bhord aon uair eirghe as a oifig mar bhall den tsórt san tré leitir do dhíriú chun an Aire.
(7) Aon bhall den Bhord a bheidh as láthair (ar aon chúis seachas de dheascaibh breoiteachta) o cheithre cruinnithe as a chéile den Bhord no a thiocfidh chun bheith neamh-oiriúnach dar leis an Aire chun bheith ina bhall den Bhord, féadfidh an tAire é chur as ballraíocht an Bhúird.
(8) Nuair a bheidh deire le n-a bhallraíocht tré imeacht aimsire beidh gach ball den Bhord ion-athcheaptha.
Oifigigh agus seirbhísigh.
4.—Féadfidh an tAire daoine cearta oiriúnacha do cheapa chun bheith ina n-oifigigh agus ina seirbhísigh don Bhord, pé daoine agus pé méid acu a mheasfa sé, fé réir toiliú an Aire Airgid, a bheith riachtanach chun crícheanna an Achta so, agus na hoifigigh agus na seirbhísigh a ceapfar amhlaidh beid i seilbh oifige ar pé téarmaí agus tabharfar luach saothair dóibh do réir pé rátaí agus i pé slí a cheadóidh an tAire Airgid.
Cruinnithe agus nós-imeachta an Bhúird.
5.—(1) Comórfar an chéad chruinniú den Bhord pé uair a cheapfidh an tAire, agus comórfar cruinnithe den Bhord ina dhiaidh sin pé uaire a cheapfidh an Bord go generálta no maidir le haon chruinniú áirithe.
(2) Ag gach cruinniú den Bhord isé Cathaoirleach an Bhúird a bheidh mar chathaoirleach ar an gcruinniú má bhíonn sé i láthair no, má bhíonn Cathaoirleach an Bhúird as láthair, isé bheidh ina chathaoirleach ar an gcruinniú ná pé ball den Bhord a thoghfidh na baill den Bhord a bheidh i láthair an uair sin.
(3) Féadfidh an Bord gníomhú d'ainneoin folúntas do bheith ina mballraíocht.
Orduithe toirmisc i dtaobh leabhar.
6.—(1) Pé uair a déanfar gearán go cuibhe leis an Aire fén Acht so sa chéill go bhfuil leabhar no eagrán áirithe de leabhar nea-náireach no draosta no go molann sé geiniúint do chosc go mínádúrtha, no a chur fé ndeár breith mhí-ionbhaidh no mí-bhreith do thárlachtaint, no aon mhodh, cóir, no fearas d'úsáid chun críche an choisc sin no na tárlachtainte sin féadfidh an tAire an gearán san do chur chun an Bhúird.
(2) Breithneoidh an Bord gach gearán a chuirfidh an tAire chucha fén alt so agus chun críche an bhreithnithe sin scrúdóid an leabhar no an t-eagrán áirithe de leabhar is abhar don ghearán san agus ar chríochnú an bhreithnithe sin déanfidh an Bord a dtuarasgabháil ar an ngearán san do thabhairt don Aire.
(3) Nuair a bheidh an Bord ag breithniú gearáin do cuireadh chucha fén alt so féachfid do gach ní no d'éinní acu so a leanas, sé sin le rá:—
(a) maitheas no tácht litríochta, ealadhantachta, eolaíochta no staire agus brí ghenerálta an leabhair no an eagráin áirithe de leabhar is abhar don ghearán san,
(b) an teanga ina bhfuil an leabhar no an t-eagrán san clóbhuailte no tugtha amach,
(c) cineál agus méid na cúrsaíochta atá ceaptha le bheith ag an leabhar no ag an eagrán san do réir tuairim an Bhúird,
(d) an saghas léitheora i Saorstát Éireann nách miste do réir réasúin a mheas, do réir tuairim an Bhúird, go léighfe sé an leabhar no an t-eagrán san, agus
(e) éinní eile i dtaobh an leabhair no an eagráin sin 'na bhfeicfar don Bhord baint do bheith aige leis an scéal.
(4) Nuair a bheidh an Bord ag breithniú gearáin do cuireadh chucha fén alt so féadfidh an Bord scéala do thabhairt d'údar, d'eagarthóir, no d'fhoillsitheoir an leabhair no an eagráin áirithe de leabhar is abhar don ghearán san agus féadfid aon aithris chúise a dhéanfidh údar, eagarthóir, no foillsitheoir an leabhair no an eagráin sin i dtaobh an chéanna do chur i bhfáth.
(5) Féadfidh an Bord aon uair tuarasgabháil do thabhairt don Aire i dtaobh aon leabhair no aon eagráin áirithe de leabhar cé ná beidh aon ghearán i dtaobh an leabhair no an eagráin sin curtha chucha ag an Aire agus, ag breithniú dhóibh i dtaobh tuarasgabháil do thabhairt i dtaobh leabhair no eagráin áirithe de leabhar fén bhfo-alt so, féadfidh an Bord féachaint do nithe den tsaghas chéanna agus scéala do thabhairt do dhaoine den tsaghas chéanna, maidir leis an leabhar no leis an eagrán san, go n-údaruítear don Bhord leis an alt so féachaint dóibh no scéala do thabhairt dóibh le linn bheith ag breithniú gearáin do cuireadh chucha fén alt so.
(6) Pé uair a thabharfidh an Bord tuarasgabháil uatha fén alt so, nár chuir níos mó ná aon bhall amháin den Bhord ina coinnibh agus le n-ar aontuigh triúr ball ar a laighead den Bhord, á rá go bhfuil an leabhar no an t-eagrán áirithe de leabhar is abhar don tuarasgabháil sin nea-náireach no draosta ina chlaona ghenerálta do réir tuairim an Bhúird agus dá bhrí sin gur cheart a thoirmeasc no go molann an leabhar no an t-eagrán san, do réir tuairim an Bhúird, geiniúint do chosc go mí-nádúrtha, no a chur fé ndeár breith mhí-ionbhaidh no mí-bhreith do thárlachtaint, no aon mhodh, cóir, no fearas d'úsáid chun críche an choisc sin no na tárlachtainte sin agus dá bhrí sin gur cheart a thoirmeasc, féadfidh an tAire díol agus scaipe an leabhair sin no an eagráin sin de leabhar i Saorstát Éireann do thoirmeasc le hordú (dá ngairmtear ordú toirmisc san Acht so).
(7) I gcás ina mbeidh beartuithe ag an mBord tuarasgabháil do thabhairt uatha fén alt so agus go mbeidh ball amháin no beirt bhall den Bhord gan aon tuairim (ag aontú léi no ina coinnibh) do chur in úil i dtaobh na tuarasgabhála beartuithe sin agus gurb amhlaidh a bheidh an scéal ná go mb'fhéidir go ndéanfadh sé deifir d'oibriú na tuarasgabhála beartuithe sin, maidir le comhacht an Aire chun ordú toirmisc do dhéanamh fén alt so dá druim, dá gcuireadh an ball no na baill sin a thuairim no a dtuairimí fé seach (pe'ca aca é) in úil i dtaobh na tuarasgabhála beartuithe sin, cuirfar cóip den tuarasgabháil bheartuithe sin tríd an bpost cláruithe go dtí an ball san no go dtí gach duine den bheirt bhall san (pe'ca aca é) agus ní thabharfidh an Bord tuarasgabháil deiridh uatha go ceann seacht lá o dháta na postála san.
(8) Mara gcuirtar de theorainn le hordú toirmisc a déanfar fén alt so i dtaobh leabhair gan é bhaint ach le heagrán no le heagráin áirithe den leabhar san, bainfe sé le gach eagrán den leabhar san, pe'ca roimh dháta an orduithe sin do foillsíodh é no dá éis sin, ach amháin pé eagráin de (más ann dóibh) a heiscfear, le hordú leasúcháin, ó bhaint do bheith ag an ordú toirmisc sin leo.
Orduithe toirmisc i dtaobh foillseachán dtréimhsiúil.
7.—(1) Pé uair a déanfar gearán go cuibhe leis an Aire fén Acht so sa chéill gur ghnáth no gur mhinic nea-náireach no draosta na huimhreacha uile agus fé seach do foillsíodh le déanaí go dtí san d'fhoillseachán tréimhsiúil no gur mholadar geiniúint do chosc go mí-nádúrtha, no a chur fé ndeár breith mhí-ionbhaidh no mí-bhreith do thárlachtaint, no aon mhodh, cóir, no fearas d'úsáid chun críche an choisc sin no na tárlachtainte sin no gur tugadh cion ró-mhór de shlí ionta d'fhoillsiú abhair i dtaobh coirthe, féadfidh an tAire an gearán san do chur chun an Bhúird.
(2) Breithneoidh an Bord gach gearán a chuirfidh an tAire chucha fén alt so agus chun críche an bhreithnithe sin scrúdóid na huimhreacha do foillsíodh le déanaí go dtí san den fhoillseachán tréimhsiúil is abhar don ghearán san agus ar chríochnú an bhreithnithe sin déanfidh an Bord a dtuarasgabháil ar an ngearán san do thabhairt don Aire.
(3) Pé uair a thabharfidh an Bord uatha fén alt so i dtaobh gearáin tuarasgabháil, nár chuir níos mó ná aon bhall amháin den Bhord ina coinnibh agus le n-ar aontuigh triúr ball ar a laighead den Bhord, á rá gurb é tuairim an Bhúird gur ghnáth no gur mhinic nea-náireach no draosta na huimhreacha do foillsíodh le déanaí go dtí san den fhoillseachán tréimhsiúil is abhar don ghearán san agus dá bhrí sin gur cheart a dtoirmeasc, no gurb é tuairim an Bhúird gur mhol na huimhreacha san geiniúint do chosc go mí-nádúrtha, no a chur fé ndeár breith mhí-ionbhaidh no mí-bhreith do thárlachtaint, no aon mhodh, cóir, no fearas d'úsáid chun críche an choisc sin no na tárlachtainte sin agus dá bhrí sin gur cheart a dtoirmeasc, no gur tugadh cion ró-mhór de shlí ionta d'fhoillsiú abhair i dtaobh coirthe agus dá bhrí sin gur cheart a dtoirmeasc, féadfidh an tAire, le hordú (dá ngairmtear ordú toirmisc san Acht so), toirmeasc do chur ar aon uimhir a foillseofar den fhoillseachán tréimhsiúil sin tar éis an lá a thiocfidh an t-ordú san i ngníomh do dhíol ná do scaipe i Saorstát Éireann.
(4) I gcás ina mbeidh beartuithe ag an mBord tuarasgabháil do thabhairt uatha fén alt so agus go mbeidh ball amháin no beirt bhall den Bhord gan aon tuairim (ag aontú léi no ina coinnibh) do chur in úil i dtaobh na tuarasgabhála beartuithe sin agus gurb amhlaidh a bheidh an scéal ná go mb'fhéidir go ndéanfadh sé deifir d'oibriú na tuarasgabhála beartuithe sin, maidir le comhacht an Aire chun ordú toirmisc do dhéanamh fén alt so dá druim, dá gcuireadh an ball no na baill sin a thuairim no a dtuairimí fé seach (pe'ca aca é) in úil i dtaobh na tuarasgabhála beartuithe sin, cuirfar cóip den tuarasgabháil bheartuithe sin tríd an bpost cláruithe go dtí an ball san no go dtí gach duine den bheirt bhall san (pe'ca aca é) agus ní thabharfidh an Bord tuarasgabháil deiridh uatha go ceann seacht lá o dháta na postála san.
(5) Aon ordú toirmisc a déanfar fén alt so i dtaobh foillseacháin tréimhsiúla nár dineadh aon ordú toirmisc den tsórt san ina thaobh roimhe sin, leanfa sé i bhfeidhm ar feadh ráithe ón lá a thiocfa sé i ngníomh, mara gceiliúrtar roimhe sin fén Acht so é, agus raghaidh sé in éag ansan.

8.—(1) Féadfidh an tAire, aon uair tar éis do dul i gcomhairle leis an mBord, aon ordú toirmisc do dhin sé go dtí san fén Acht so do cheiliúra le hordú.
(2) Má dhineann an tAire ordú toirmisc fén Acht so i dtaobh leabhair féadfidh an tAire aon uair, tar éis do dul i gcomhairle leis an mBord, an t-ordú toirmisc sin do leasú le hordú tré aon eagrán áirithe den leabhar san, pe'ca foillsíodh roimh dháta an orduithe thoirmisc sin é no a foillseofar dá éis sin é, d'eisceacht o bhaint do bheith ag an ordú toirmisc sin leis.
Orduithe toirmisc d'fhoillsiú.
9.—Gach ordú toirmisc agus gach ordú a dhéanfidh an tAire fén Acht so agus a cheiliúrfidh no a leasóidh aon ordú toirmisc den tsórt san, foillseofar é san Iris Oifigiúil chó luath agus is féidir é tar éis a dhéanta agus tiocfa sé i ngníomh agus beidh éifeacht aige lá a fhoillsithe amhlaidh agus ón lá san amach.
Ciontaí i dtaobh foillseachán toirmeasctha.
10.—(1) Ní bheidh sé dleathach d'éinne, ach fé chead agus do réir cheada i scríbhinn a bheidh deonta dho fén alt so, aon leabhar ná aon eagrán áirithe de leabhar ná aon uimhir d'fhoillseachán tréimhsiúil go mbeidh a dhíol agus a scaipe i Saorstát Éireann toirmeasctha de thurus na huaire le hordú toirmisc—
(a) d'iomportáil isteach i Saorstát Éireann chun a dhíolta no a scaipthe, ná
(b) do dhíol, ná do chur ar taisbeáint, do thairisgint, d'fhógairt ná do chimeád chun a dhíolta, ná
(c) do scaipe ná do thairisgint ná do chimeád chun a scaipthe.
(2) Gach éinne a ghníomhóidh contrárdha don fho-alt san roimhe seo beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar fíneáil ná raghaidh thar caoga punt do chur air no, más rogha leis an gCúirt é, príosúntacht, i dteanta no d'éamais daor-oibre, ar feadh aon téarma nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile agus, in aon chás, dlighfar an leabhar, an t-eagrán, no an uimhir gur ina thaobh a dineadh an cionta san do gheallbhruide.
(3) Féadfidh an tAire más oiriúnach leis é, ar réasúin is dó leis is leor, cead i scríbhinn do dheona d'éinne chun aon leabhar áirithe no aon eagrán áirithe de leabhar no gach uimhir no aon uimhreacha áirithe d'fhoillseachán tréimhsiúil áirithe go mbeidh a dhíol agus a scaipe i Saorstát Éireann toirmeasctha de thurus na huaire le hordú toirmisc do dhíol agus do chimeád chun a dhíolta no do scaipe agus do chimeád chun a scaipthe agus (i gcás oiriúnach) d'iomportáil isteach i Saorstát Éireann, agus féadfidh an tAire aon chead den tsórt san do dheona fé réir pé coiníollacha agus teoranta (más ann dóibh) is oiriúnach leis d'fhorchur agus a luadhfa sé sa chead san.
Clár d'fhoillseacháin toirmeasctha.
11.—(1) Ullamhóidh agus cimeádfidh an tAire, i pé fuirm a ordóidh an tAire le rialacháin a déanfar fén Acht so, clár ar a dtabharfar mar ainm agus mar theideal “An Clár d'Fhoillseacháin Toirmeasctha” (dá ngairmtear an clár san alt so).
(2) Pé uair a déanfar ordú toirmisc iontrálfar sa chlár láithreach—
(a) más le leabhar a bhaineann an t-ordú san, ainm an leabhair sin, an t-eagrán no na heagráin den leabhar san le n-a mbaineann an t-ordú san, ainmneacha údair agus foillsitheora an leabhair sin má bhíd agus fé mar a bheid curtha síos sa leabhar san, dáta an orduithe sin agus dáta a fhoillsithe san Iris Oifigiúil, agus
(b) más le foillseachán tréimhsiúil a bhaineann an t-ordú san, ainm an fhoillseacháin sin, ainmneacha dílseánaigh agus foillsitheora an fhoillseacháin sin má bhíd agus fé mar a bheid curtha síos sa bhfoillseachán san, dáta an orduithe sin agus dáta a fhoillsithe san Iris Oifigiúil.
(3) Pé uair a dhéanfidh an tAire fén Acht so ordú toirmisc do cheiliúra scriosfar amach an iontráil sa chlár i dtaobh an leabhair no an fhoillseacháin tréimhsiúla le n-a mbaineann an t-ordú san agus pé uair a dhéanfidh an tAire fén Acht so ordú toirmisc do leasú iontrálfar sa chlár os coinne iontrála an leabhair no an fhoillseacháin tréimhsiúla san mion-innste an orduithe leasúcháin sin agus an leasuithe a dintar leis.
(4) Cuirfidh an tAire fé ndeár an clár do chlóbhuala, d'fhoillsiú, agus do chur ar fáil don phuiblíocht i pé slí agus ar pé amannta is dó leis is ceart.
(5) Beidh sé de dhualgas ar gach oifigeach Custum a bheidh ag scrúdú bagáiste le lucht taistil a bheidh ag teacht isteach liost de sna leabhair uile is abhar d'ordú toirmisc de thurus na huaire do thaisbeáint ar a iarraidh sin air.
(6) Beidh an clár le feiscint in aisce chun a iniúchta ag éinne i pé áit i gCathair Bhaile Atha Cliath agus ar pé uaire a ordóidh an tAire le rialacháin a déanfar fén Acht so agus tabharfidh an tAire d'éinne, ar íoc pé éilimh a shocróidh an tAire o am go ham le haontú an Aire Airgid, cóip d'aon iontráil sa chlár agus í deimhnithe ag oifigeach don Aire mar chóip dhílis.
(7) Aon scríbhinn a thabharfidh le tuisgint gur cóip d'iontráil sa chlár í agus go bhfuil sí deimhnithe ag oifigeach don Aire mar chóip dhílis, glacfar léi i ngach cúirt bhreithiúnais, gan cruthú ar shighniú an oifigigh sin ná ar eisean do bheith ina oifigeach amhlaidh, mar fhianaise, go dtí go gcruthófar a mhalairt, ar théarmaí na hiontrála san agus ar an iontráil sin do bheith sa chlár ar an dáta go dtuigtar ón deimhniú san gur tugadh an deimhniú san.
(8) Má bhíonn leabhar no foillseachán tréimhsiúil iontrálta sa chlár aon uair áirithe beidh san ina fhianaise dho-chlaoite gur dineadh ordú toirmisc ina thaobh agus go bhfuil an t-ordú san i bhfeidhm fós an uair sin agus beidh téarmaí na hiontrála san sa chlár ina bhfianaise dho-chlaoite ar na heagráin den leabhar san no ar na huimhreacha den fhoillseachán tréimhsiúil sin le n-a mbaineann an t-ordú san.
Barántas cuardaigh i dtaobh leabhar toirmeasctha, etc.
12.—(1) Más deimhin le Breitheamh den Chúirt Dúithche o scéala fé mhionn o oifigeach den Ghárda Síochána nách ísle céim ná árd-cheannphort go bhfuil cúis réasúnta le hamhrus go gcimeádtar in aon fhoirgint, talamh, áitreabh no áit eile áirithe, chun a ndíolta no a scaipthe, aon leabhair no foillseacháin tréimhsiúla 'na mbeidh a ndíol agus a scaipe i Saorstát Éireann toirmeasctha le hordú toirmisc an uair sin, féadfidh an Breitheamh san barántas cuardaigh den tsórt a luaidhtear san alt so do thabhairt amach don oifigeach san.
(2) Déarfidh agus déanfidh barántas cuardaigh a thabharfidh Breitheamh den Chúirt Dúithche amach fén alt so a údarú d'oifigeach ainmnithe den Ghárda Síochána nách ísle céim ná ceannphort, agus pé baill eile den Ghárda Síochána is dó leis an oifigeach san is ceart ina theanta, dul isteach agus cuardach do dhéanamh, le héigean más gá é, sa bhfoirgint, sa talamh, san áitreabh no san áit eile áirithe roimhráite (áit a luadhfar freisin sa bharántas), aon uair laistigh d'ocht n-uaire is dachad a' chluig tar éis tabhartha amach an bharántais chuardaigh, do leabhair no d'fhoillseacháin tréimhsiúla 'na mbeidh a ndíol agus a scaipe i Saorstát Éireann toirmeasctha le hordú toirmisc an uair sin agus gach leabhar agus foillseachán tréimhsiúil den tsórt san a gheobhfar sa chuardach san do ghabháil agus do bhreith leis.
Sriantachtaí custum agus puist.
13.—(1) Má dintar ordú toirmisc i dtaobh leabhair no eagráin áirithe de leabhar no foillseacháin tréimhsiúla, ansan, faid a bheidh an t-ordú san i ngníomh, déanfar iomportáil (ar aon tslí seachas fé chead agus do réir cheada i scríbhinn do deonadh fén Acht so) aon eagráin den leabhar san no aon uimhreach den fhoillseachán tréimhsiúil sin (pe'ca aca é) le n-a mbaineann an t-ordú san de thurus na huaire do chur leis an táible agus áireofar san mar chuid den táible de thoirmisc agus de shriantachtaí isteach atá in alt 42 den Customs Consolidation Act, 1876, agus beidh éifeacht ag an alt san dá réir sin.
(2) Féadfidh an tAire Puist agus Telegrafa, le hordú fén alt so, rialacháin do dhéanamh chun cosc do chur le haon eagrán de leabhar no aon uimhir d'fhoillseachán tréimhsiúil le n-a mbaineann ordú toirmisc de thurus na huaire do chur ná do sheachada tríd an bpost (ar aon tslí seachas fé chead agus do réir cheada i scríbhinn do deonadh fén Acht so) agus chun aon eagrán no uimhir den tsórt san a stopfar agus é ag gabháil tríd an bpost do sheachada don Aire Dlí agus Cirt.
CUID III.
TUARASGABHALA AR IMEACHTA CUIRTE.
Sriantachtaí le tuarasgabhála ar imeachta cúirte d'fhoillsiú.
14.—(1) Ní bheidh sé dleathach—
(a) aon abhar nea-náireach gur dócha go ndéanfadh a fhoillsiú díobháil don mhorálas phuiblí, ná
(b) aon mhion-innste nea-náireacha leighis, máinliaghachta, no fisiológachta gur dócha go ndéanfadh a bhfoillsiú díobháil don mhorálas phuiblí,
do chlóbhuala ná d'fhoillsiú ná a chur fé ndeár ná a thabhairt chun críche go gclóbhuailfar no go bhfoillseofar iad maidir le haon imeachta cúirte.
(2) Ní bheidh sé dleathach aon tuarasgabháil, ráiteas, tuairim ná abhar eile, ar ná maidir le haon imeachta cúirte in ar hiarradh eadarscara pósta, pósa do chur ar nea-mbrí, deighilt chúirte, no aiseag cearta an phósta do chlóbhuala ná d'fhoillsiú ná a chur fé ndeár ná a thabhairt chun críche go gclóbhuailfar no go bhfoillseofar a leithéid, ach amháin gach ceann no aon cheann de sna mion-innste seo a leanas ar na himeachta san, sa mhéid gur féidir iad do chlóbhuala agus d'fhoillsiú gan aon fho-alt eile den alt so do shárú, sé sin le rá:—
(a) ainmneacha, seolta, agus slite beatha na bpáirtithe agus na bhfínnithe,

(3) Ní bhainfidh éinní san alt so—
(a) le haon phléideáil, aithscríbhinn fhianaise, no scríbhinn eile do chlóbhuala chun a húsáidthe i dtaobh aon imeachta cúirte ná le hí do chur in úil do dhaoine go mbeidh baint acu leis na himeachta, ná

(c) le haon abhar do chlóbhuala no d'fhoillsiú in aon imleabhar no cuid ar leithligh d'aon tsreath bona fide de thuarasgabhála dlí nách cuid d'aon fhoillseachán eile agus ná beidh ann ach amháin tuarasgabhála ar imeachta i gcúirteanna dlí, no in aon fhoillseachán de shaghas teicniciúil a bheidh ceaptha bona fide chun a chúrsuithe imeasc dligheadóirí no dochtúirí leighis.

15.—(1) Má dhineann aon duine is dílseánach, eagarthóir no foillsitheoir d'aon leabhar no foillseachán tréimhsiúil no is árdchlódóir ag clóbhuala an leabhair no an fhoillseacháin sin no má chuireann sé fé ndeár no má thugann sé chun críche no má cheaduíonn sé aon abhar, mion-aithriste, no mion-innste, i dtaobh aon imeachta cúirte, do chlóbhuala no d'fhoillsiú sa leabhar no sa bhfoillseachán san contrárdha d'aon cheann d'fhorálacha na Coda so den Acht so, beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar fíneáil ná raghaidh thar cúig céad punt do chur air no, más rogha leis an gcúirt é, príosúntacht i dteanta no d'éamais daor-oibre ar feadh aon téarma nách sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.
(2) Is ar agra agus in ainm an Phríomh-Atúrnae a bunófar gach cúiseamh i gcionta fén alt so.
CUID IV.
ILGHNEITHEACH AGUS GENERALTA.
Toirmeasc ar fhoillseacháin ina moltar nithe frithgheiniúnacha.
16.—(1) Ní bheidh sé dleathach d'éinne, ach fé chead agus do réir cheada i scríbhinn a bheidh deonta dho fén alt so, aon leabhar ná foillseachán tréimhsiúil (pe'ca sa chlár d'fhoillseacháin toirmeasctha dho no nách ea) a mholann no go bhféadfí do réir réasúin a cheapa go molann sé geiniúint do chosc go mí-nádúrtha, no a chur fé ndeár breith mhí-ionbhaidh no mí-bhreith do thárlachtaint no aon mhodh, cóir no fearas d'úsáid chun críche an choisc no na tárlachtainte sin—
(a) do chlóbhuala ná d'fhoillsiú ná a chur fé ndeár ná a thabhairt chun críche go gclóbhuailfar no go bhfoillseofar a leithéid, ná
(b) é do dhíol ná é do chur ar taisbeáint, do thairisgint, ná do chimeád chun a dhíolta, ná
(c) é do scaipe ná é do thairisgint ná do chimeád chun a scaipthe.

Leasú ar an Indecent Advertisements Act, 1889.

Toirmeasc ar phictiúirí nea-náireacha do dhíol.
18.—(1) Ní bheidh sé dleathach d'éinne aon phictiúir neanáireach do dhíol, ná do thairisgint, do chur ar taisbeáint, ná do chimeád chun a dhíolta, ná d'iomportáil chun a dhíolta, agus gach éinne a dhíolfidh aon phictiúir nea-náireach no a thairgfidh, a chuirfidh ar taisbeáint no a chimeádfidh chun a dhíolta é no a iomportálfidh chun a dhíolta é, contrárdha don alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar fíneáil ná raghaidh thar caoga punt do chur air má sé an chéad chionta aige é agus, má sé an dara cionta aige é no aon chionta ina dhiaidh sin, fíneáil ná raghaidh thar céad punt no, más rogha leis an gcúirt é, príosúntacht i dteanta no d'éamais daor-oibre ar feadh aon téarma nách sia ná sé mhí agus, in aon chás acu, dlighfar gach pictiúir nea-náireach do dhíol sé amhlaidh no do thairg sé, do chuir sé ar taisbeáint, no do chimeád sé amhlaidh chun a dhíolta do gheallbhruide.

19.—(1) Más deimhin le Breitheamh den Chúirt Dúithche o scéala fé mhionn o oifigeach den Ghárda Síochána nách ísle céim ná árd-cheannphort go bhfuil cúis réasúnta le hamhrus go gcimeádtar aon phictiúirí nea-náireacha in aon fhoirgint, talamh, áitreabh no áit eile áirithe chun a ndíolta, féadfidh an Breitheamh san barántas cuardaigh den tsórt a luaidhtear san alt so do thabhairt amach don oifigeach san.
(2) Déarfidh agus déanfidh barántas cuardaigh a thabharfidh Breitheamh den Chúirt Dúithche amach fén alt so a údarú d'oifigeach ainmnithe den Ghárda Síochána nách ísle céim ná ceannphort, agus pé baill eile den Ghárda Síochána is dó leis an oifigeach san is ceart ina theanta, dul isteach agus cuardach do phictiúirí nea-náireacha do dhéanamh, le héigean más gá é, sa bhfoirgint, sa talamh, san áitreabh no san áit eile áirithe roimhráite (áit a luadhfar freisin sa bharántas) aon uair laistigh d'ocht n-uaire is dachad a' chluig tar éis tabhartha amach an bharántais chuardaigh agus gach pictiúir den tsórt san a gheobhfar sa chuardach san do ghabháil agus do bhreith leis.

Rialacháin.
20.—(1) Féadfidh an tAire, le hordú, rialacháin do dhéanamh ag ordú gach ceann no aon cheann de sna nithe agus de sna rudaí seo a leanas, sé sin le rá:—
(a) an modh agus an fhuirm ina ndéanfar gearáin leis an Aire fén Acht so,
(b) nós-imeachta an Bhúird um Scrúdóireacht Fhoillseachán agus na fuirmeacha a úsáidfid chun crícheanna an Achta so,
(c) éinní no aon rud dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú ag an Aire tré rialacháin do dhéanamh fén Acht so.
(2) Gach rialachán a déanfar fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta, agus má dhineann ceachtar Tigh acu san, laistigh den lá is fiche a shuidhfidh an Tigh sin tar éis an rialachán san do bheith leagtha fé n-a bhráid, rún do rith ag cur an rialacháin sin ar nea-mbrí, beidh an rialachán san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do dineadh roimhe sin fén rialachán san.
