CUID II.
Comhachta Coinneala.
Tosach feidhme agus scur na Coda so den Acht so.
3.—(1) Ní thiocfaidh ná ní bheidh an Chuid seo den Acht so i bhfeidhm ach amháin fé mar agus an uair agus an fhaid a foráltar leis na fo-ailt ina dhiaidh seo den alt so.
(2) Má dheineann agus má fhoillsíonn agus pé uair agus chó minic agus a dhéanfaidh agus a fhoillseoidh an Riaghaltas furógra á dhearbhú na comhachta bronntar leis an gCuid seo den Acht so do bheith ag teastáil chun a chur in áirithe go gcoimeádfar an tsíocháin agus an t-ord puiblí agus é bheith oiriúnach an Chuid seo den Acht so do theacht i bhfeidhm láithreach, tiocfaidh an Chuid seo den Acht so i bhfeidhm láithreach.
(3) Má thárlann, tráth ar bith faid a bheidh an Chuid seo den Acht so i bhfeidhm, go ndéanfaidh agus go bhfoillseoidh an Riaghaltas furógra á dhearbhú go scuirfidh an Chuid seo den Acht so de bheith i bhfeidhm, scuirfidh an Chuid seo den Acht so de bheith i bhfeidhm láithreach.
(4) Pé uair a bheidh an Riaghaltas tar éis furógra fén dara fo-alt den alt so do dhéanamh agus d'fhoillsiú, is dleathach do Dháil Éireann, tráth ar bith faid a bheidh an Chuid seo den Acht so i bhfeidhm de bhuadh an fhurógra san, rún do rith ag cur an fhurógra san ar nea-mbrí, agus leis sin beidh an furógra san curtha ar nea-mbrí agus scuirfidh an Chuid seo den Acht so de bheith i bhfeidhm, ach beidh san gan dochar do bhailíocht éinní do rinneadh fén gCuid seo den Acht so tar éis an fhurógra san do dhéanamh agus roimh an rún san do rith.
(5) Foillseofar furógra dhéanfaidh an Riaghaltas fén alt so tré chóip de d'fhoillsiú san Iris Oifigiúil agus féadfar é fhoillsiú freisin in aon tslí eile is ceart dar leis an Riaghaltas.
Comhachta speisialta gabhála agus coinneála.
4.—(1) Pé uair is dóich le hAire Stáit aon duine áirithe do bheith ag gabháil do ghníomhachas is dóich leis a bheith dochrach don tsíocháin agus don ord phuiblí do choimeád no do shlándáil an Stáit, féadfaidh an tAire sin le barántas fé n-a láimh agus fé n-a shéala oifigiúil a ordú an duine sin do ghabháil agus do choinneáil fén alt so.
(2) Féadfaidh aon bhall den Ghárda Síochána duine ar bith go mbeidh barántas tugtha amach ina thaobh ag Aire Stáit fén bhfo-alt san roimhe seo den alt so do ghabháil gan barántas.
(3) Gach duine geobhfar fén bhfo-alt deiridh sin roimhe seo den alt so coinneofar é i bpríosún no in áit eile a bheidh orduithe chuige sin le rialacháin ar n-a ndéanamh fén gCuid seo den Acht so go dtí go scuirfidh an Chuid seo den Acht so de bheith i bhfeidhm no go dtí go scaoilfear é fé sna forálacha ina dhiaidh seo den Chuid seo den Acht so, pé ní acu san is túisce thárlóidh.
(4) Pé uair a coinneofar duine fén alt so bhéarfar don duine sin chó luath agus is féidir é tar éis é theacht go dtí príosún no áit eile choinneála bheidh orduithe chuige sin le rialacháin ar n-a ndéanamh fén gCuid seo den Acht so, cóip den bharántas a bheidh tugtha amach fén alt so i dtaobh an duine sin agus d'fhorálacha ailt 8 den Acht so.
(5) Gach barántas do bhéarfaidh Aire Stáit amach fén alt so beidh sé sa bhfuirm atá leagtha amach sa Sceideal a ghabhann leis an Acht so no i bhfuirm sa chéill chéanna.
Comhachta chun daoine coinnithe do chuardach, etc.
5.—(1) Is dleathach d'aon bhall den Ghárda Síochána gach ní no aon ní no nithe acu so leanas do dhéanamh alos duine ar bith a geobhfar agus a coinneofar fén gCuid seo den Acht so, sé sin le rá:—
(a) a ainm agus a sheoladh d'éileamh ar an duine sin;
(b) an duine sin do chuardach no do chur á chuardach;
(c) an duine sin do ghrianghrafadh no do chur á ghrianghrafadh;
(d) méir-rianta an duine sin do thógaint no do chur á dtógaint.
(2) Gach duine chuirfidh bac no cosc le ball den Ghárda Síochána do dhéanamh feidhmithe ina thaobh ar aon chomhacht dá mbronntar leis an bhfo-alt deiridh sin roimhe seo den alt so no ná déanfaidh no dhiúltóidh a ainm agus a sheoladh do thabhairt uaidh ar bhall den Ghárda Síochána dá éileamh san air fén bhfo-alt san no bhéarfaidh uaidh ainm no seoladh bheidh bréagach no mí-threorach beidh sé ciontach sna rialacháin do shárú a bheidh déanta fén gCuid seo den Acht so i dtaobh smacht do choimeád, agus deighleálfar leis dá réir sin.
Daoine coinnithe do scaoileadh.
6.—Féadfaidh Aire Stáit le scríbhinn fé n-a láimh, más dóich leis agus pé uair is dóich leis san do bheith ceart, a ordú aon duine áirithe do scaoileadh a bheidh, de thurus na huaire, á choinneáil fén gCuid seo den Acht so, agus leis sin scaoilfear an duine sin as an gcoinneáil sin láithreach.
Rialacháin i dtaobh áiteanna coinneála.
7.—(1) Féadfaidh Aire Stáit le hordú rialacháin do dhéanamh chun gach críche no chun aon chríche no crícheanna acu so leanas, sé sin le rá:—
(a) chun a ordú cadiad na príosúin, na campaí coinneála, agus na háiteanna eile ina bhféadfar daoine do choinneáil fén gCuid seo den Acht so;
(b) chun socruithe do dhéanamh chun na bpríosún, na gcampaí coinneála, agus na n-áiteanna eile sin do bhainistí, do choimeád sláintiúil, do rialú agus do ghárdáil go héifeachtúil;
(c) chun socruithe do dhéanamh chun smacht do chur i bhfeidhm agus do choimeád imeasc na ndaoine bheidh á gcoinneáil in aon phríosún, campa coinneála, no áit eile den tsórt san mar adubhradh;
(d) chun socruithe do dhéanamh chun daoine bheidh á gcoinneáil amhlaidh agus a sháróidh na rialacháin do phionósú;
(e) chun éinní no aon rud eile d'ordú bhainfidh no gheobhaidh le daoine bheidh á gcoinneáil fén gCuid seo den Acht so do choinneáil go héifeachtúil no chun socruithe do dhéanamh i dtaobh an chéanna.
(2) Gach rialachán a déanfar fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta agus má dheineann ceachtar Tigh den Oireachtas, fé cheann an lá is fiche shuidhfidh an Tigh sin tar éis an rialacháin sin do leagadh fé n-a bhráid, rún do rith ag cur an rialacháin sin ar nea-mbrí beidh an rialachán san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do bhailíocht éinní do rinneadh roimhe sin fén rialachán san.
Coimisiún chun fiosrú do dhéanamh i dtaobh coinneála.
8.—(1) Chó luath agus a bheidh caoi ann chuige sin tar éis na Coda so den Acht so do theacht i bhfeidhm, bunóidh an Riaghaltas Coimisiún (dá ngairmtear an Coimisiún san alt so) chun na bhfeidhmeanna forchuirtear ar an gCoimisiún leis an alt so do chólíonadh.
(2) Beidh feidhm agus éifeacht ag na forálacha so leanas maidir leis an gCoimisiún, sé sin le rá:—
(a) isiad an Riaghaltas a cheapfaidh baill an Choimisiúin agus féadfaidh an Riaghaltas iad do chur as oifig;
(b) triúr a bheidh ar an gCoimisiún, agus beidh duine acu san ina oifigeach choimisiúnta de sna Fórsaí Cosanta go seirbhís seacht mblian ar a laighead aige agus beidh gach duine fé leith den bheirt eile ina abhcóide no ina atúrnae go seasamh seacht mblian ar a laighead aige no ina bhreitheamh, no ina dhuine ba bhreitheamh tráth, den Chúirt Uachtaraigh, den Ard-Chúirt, den Chúirt Chuarda no den Chúirt Dúithche;
(c) féadfar na táillí no an luach saothair sin a chinnfidh an tAire Airgeadais (má chinneann) d'íoc le haon bhall den Choimisiún as airgead ar n-a sholáthar ag an Oireachtas.
(3) Duine ar bith a bheidh á choinneáil fén gCuid seo den Acht so féadfa sé a iarraidh i scríbhinn ar an Riaghaltas a choinneáil níos sia amhlaidh do chur á breithniú ag an gCoimisiún, agus ar an iarratas san do dhéanamh amhlaidh beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) déanfaidh an Riaghaltas, chó luath agus a bheidh caothúil, coinneáil an duine sin níos sia do chur fé bhráid an Choimisiúin;
(b) déanfaidh an Coimisiún fiosrú i dtaobh na bhforas ar a mbeidh an duine sin á choinneáil agus déanfaid, chó luath agus a bheidh caothúil, tuarasgabháil ina dtaobh do thabhairt don Riaghaltas;
(c) bhéarfaidh an tAire Dlighidh agus Cirt don Choimisiún an t-eolas agus na scríbhinní sin (a bhainfidh le habhar an fhiosruithe sin) a bheidh ar seilbh no ar fáil ag an Riaghaltas no ag aon Aire Stáit agus a iarrfaidh an Coimisiún;
(d) má thuairiscíonn an Coimisiún ná fuil aon fhorais réasúnta ann chun an duine sin do choinneáil níos sia, scaoilfear saor an duine sin chó luath agus a bheidh caothúil.

9.—Bhéarfaidh an Riaghaltas do gach Tigh den Oireachtas uair amháin ar a laighead i ngach sé mhí mion-innste (a) ar dhaoine bheidh á gcoinneáil fén gCuid seo den Acht so, (b) ar dhaoine go mbeidh an Coimisiún tar éis tuarasgabháil do thabhairt don Riaghaltas ina dtaobh, (c) ar dhaoine go mbeidh an Coimisiún tar éis a thuairisciú ina dtaobh ná fuil aon fhorais réasúnta ann chun iad do choinneáil níos sia, (d) ar dhaoine do bhí á gcoinneáil fén gCuid seo den Acht so ach do scaoileadh saor de bharr tuarasgabhála ón gCoimisiún, agus (e) ar dhaoine do bhí á gcoinneáil fén gCuid seo den Acht so ach do scaoileadh saor gan tuarasgabháil ón gCoimisiún.

OFFENCES AGAINST THE STATE (AMENDMENT) ACT, 1940.
PART I.
Preliminary and General.
Short title, construction, and collective citation.
1.—(1) This Act may be cited as the Offences Against the State (Amendment) Act, 1940.
(2) This Act shall be construed as one with the Offences Against the State Act, 1939 (No. 13 of 1939).
(3) The Offences Against the State Act, 1939, and this Act may be cited together as the Offences Against the State Acts, 1939 and 1940.
Repeal.
2.—Part VI of the Offences Against the State Act, 1939 (No. 13 of 1939), is hereby repealed.
PART II.
Powers of Detention.
Commencement and cesser of this Part of this Act.
3.—(1) This Part of this Act shall not come into or be in force save as and when and for so long as is provided by the subsequent sub-sections of this section.
(2) If and whenever and so often as the Government makes and publishes a proclamation declaring that the powers conferred by this Part of this Act are necessary to secure the preservation of public peace and order and that it is expedient that this Part of this Act should come into force immediately, this Part of this Act shall come into force forthwith.
(3) If at any time while this Part of this Act is in force the Government makes and publishes a proclamation declaring that this Part of this Act shall cease to be in force, this Part of this Act shall forthwith cease to be in force.
(4) Whenever the Government has made and published a proclamation under the second sub-section of this section, it shall be lawful for Dáil Eireann, at any time while this Part of this Act is in force by virtue of such proclamation, to pass a resolution annulling such proclamation, and thereupon such proclamation shall be annulled and this Part of this Act shall cease to be in force, but without prejudice to the validity of anything done under this Part of this Act after the making of such proclamation and before the passing of such resolution.
(5) A proclamation made by the Government under this section shall be published by publishing a copy thereof in the Iris Oifigiúil and may also be published in any other manner which the Government shall think proper.
Special powers of arrest and detention.
4.—(1) Whenever a Minister of State is of opinion that any particular person is engaged in activities which, in his opinion, are prejudicial to the preservation of public peace and order or to the security of the State, such Minister may by warrant under his hand and sealed with his official seal order the arrest and detention of such person under this section.
(2) Any member of the Gárda Síochána may arrest without warrant any person in respect of whom a warrant has been issued by a Minister of State under the foregoing sub-section of this section.
(3) Every person arrested under the next preceding sub-section of this section shall be detained in a prison or other place prescribed in that behalf by regulations made under this Part of this Act until this Part of this Act ceases to be in force or until he is released under the subsequent provisions of this Part of this Act, whichever first happens.
(4) Whenever a person is detained under this section, there shall be furnished to such person, as soon as may be after he arrives at a prison or other place of detention prescribed in that behalf by regulations made under this Part of this Act, a copy of the warrant issued under this section in relation to such person and of the provisions of section 8 of this Act.
(5) Every warrant issued by a Minister of State under this section shall be in the form set out in the Schedule to this Act or in a form to the like effect.
Powers of search, etc., of detained persons.
5.—(1) It shall be lawful for any member of the Gárda Síochána to do all or any of the following things in respect of any person who is arrested and detained under this Part of this Act, that is to say:—
(a) to demand of such person his name and address;
(b) to search such person or cause him to be searched;
(c) to photograph such person or cause him to be photographed;
(d) to take, or cause to be taken the fingerprints of such person.
(2) Every person who shall obstruct or impede the exercise in respect of him by a member of the Gárda Síochána of any of the powers conferred by the next preceding sub-section of this section or shall fail or refuse to give his name and address when demanded of him by a member of the Gárda Síochána under the said sub-section or shall give a name or an address which is false or misleading shall be guilty of a contravention of the regulations made under this Part of this Act in relation to the preservation of discipline and shall be dealt with accordingly.
Release of detained persons.
6.—A Minister of State may by writing under his hand, if and whenever he so thinks proper, order the release of any particular person who is for the time being detained under this Part of this Act, and thereupon such person shall forthwith be released from such detention.
Regulations in relation to places of detention.
7.—(1) A Minister of State may by order make regulations for all or any of the following purposes, that is to say:—
(a) prescribing the prisons, internment camps, and other places in which persons may be detained under this Part of this Act;
(b) providing for the efficient management, sanitation, control, and guarding of such prisons, internment camps, and other places;
(c) providing for the enforcement and preservation of discipline amongst the persons detained in any such prison, internment camp, or other place as aforesaid;
(d) providing for the punishment of persons so detained who contravene the regulations;
(e) prescribing or providing for any other matter or thing incidental or ancillary to the efficient detention of persons detained under this Part of this Act.
(2) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling such regulation is passed by either House of the Oireachtas within the next subsequent twenty-one days on which such House has sat after such regulation is laid before it, such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Commission for inquiring into detentions.
8.—(1) As soon as conveniently may be after this Part of this Act comes into force, the Government shall set up a Commission (in this section referred to as the Commission) to perform the functions imposed upon the Commission by this section.
(2) The following provisions shall apply and have effect in relation to the Commission, that is to say:—
(a) the members of the Commission shall be appointed and be removable by the Government;
(b) the Commission shall consist of three persons of whom one shall be a commissioned officer of the Defence Forces with not less than seven years' service and each of the others shall be a barrister or solicitor of not less than seven years' standing or be or have been a judge of the Supreme Court, the High Court, or the Circuit Court or a justice of the District Court;
(c) there may be paid out of moneys provided by the Oireachtas to any member of the Commission such (if any) fees or remuneration as the Minister for Finance shall determine.
(3) Any person who is detained under this Part of this Act may apply in writing to the Government to have the continuation of his said detention considered by the Commission, and upon such application being so made the following provisions shall have effect, that is to say:—
(a) the Government shall, with all convenient speed, refer the matter of the continuation of such person's detention to the Commission;
(b) the Commission shall inquire into the grounds of such person's detention and shall, with all convenient speed, report thereon to the Government;
(c) the Minister for Justice shall furnish to the Commission such information and documents (relevant to the subject-matter of such inquiry) in the possession or procurement of the Government or of any Minister of State as shall be called for by the Commission;
(d) if the Commission reports that no reasonable grounds exist for the continued detention of such person, such person shall, with all convenient speed, be released.
Returns to be laid before each House of the Oireachtas.
9.—The Government shall once at least in every six months furnish to each House of the Oireachtas particulars of (a) persons detained under this Part of this Act, (b) persons in respect of whom the Commission has made a report to the Government, (c) persons in respect of whom the Commission has reported that no reasonable grounds exist for their continued detention, (d) persons who had been detained under this Part of this Act but who had been released on the report of the Commission, and (e) persons who had been detained under this Part of this Act but who had been released without a report of the Commission.
