CUID I.
Reamhráiteach agus Ginearálta.
Gearrtheideal agus tosach feidhme.
1.—(1) Féadfear an tAcht um Chearrbhachas agus Crannchuir, 1956, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh pé lá a cheapfas an tAire le hordú.
Mínithe.
2. San Acht seo—
ciallaíonn “baincéir” maidir le cluiche an baincéir nó an duine eile a dhéanas bainistí ar an gcluiche, nó ar ina choinne a chuireas na himreoirí eile geall nó a dhéanaid imirt;
ciallaíonn “cearrbhachas” imirt chluiche (pé acu cluiche stuaime nó cluiche cinniúna é nó cluiche atá go páirteach ina chluiche stuaime agus go páirteach ina chluiche cinniúna) le haghaidh geallta a chuireas na himreoirí i bhfiontar;
ciallaíonn “gléas cearrbhachais” aon bhord nó gléas cearrbhachais agus aon phíosa airgid, cárta, comhartha nó earra eile a húsáidtear mar ghléas nó meán cearrbhachais;
ciallaíonn “ceadúnas cearrbhachais” ceadúnas faoi alt 19;
ciallaíonn “údarás áitiúil” comhlucht arb é atá ann comhairle chontae, bardas contae-bhuirge nó buirge eile, comhairle cheantair uirbigh nó coimisinéirí baile;
folaíonn “crannchur” gach comórtas le haghaidh airgid nó luach airgid ina dtugtar cranna tomhais nó meastacháin ar theaghmhais atá le teacht nó ar theagmhais atá imithe agus nach bhfuil a dtorthaí fionnta fós ná ar eolas go coitianta fós;
ciallaíonn “ceadúnas crannchuir” ceadúnas faoi alt 28;
ciallaíonn “an tAire” an tAire Dlí agus Cirt;
ciallaíonn “áit phoiblí” aon áit a bhfuil sé de cheart nó de chead ag an bpobal dul ann ar íocaíocht a dhéanamh nó gan íocaíocht a dhéanamh;
folaíonn “cumann” club, foras, eagras nó comhlachas eile daoine pé ainm a tugtar air;
folaíonn “geall” aon íocaíocht as an gceart chun bheith páirteach i gcluiche agus aon chineál eile íocaíochta is gá a dhéanamh mar choinníoll chun bheith páirteach sa chluiche ach ní fholaíonn sé íocaíocht nach ndéantar ach le haghaidh saoráidí a cuirtear ar fáil chun an cluiche d'imirt;
folaíonn “Ceannfort” Cigire a bheas ag gníomhú mar Cheannfort.

CUID II.
Cearrbhachas.
Cearrbhachas neamhdhleathach.
4.—(1) Ní thionscnóidh duine ar bith aon chineál cearrbhachais ná ní chabhróidh lena thionscnamh ná ní sholáthróidh saoráidí le haghaidh aon chineál cearrbhachais—
(a) nach dugtar ann, mar gheall ar an sórt cluiche a himrítear, an t-amhantar céanna do na himreoirí uile, lena n-áirítear an baincéir, nó
(b) ina gcoinníonn an tionscantóir aon chuid de na geallta nó ina gcoinníonn an baincéir aon chuid díobh ar chuma seachas mar ghnóthachan de thoradh na himeartha, nó
(c) trí aon scán-inneall nach dtoirmisctear le halt 10.
(2) Tugtar cearrbhachas neamhdhleathach san Acht seo ar an gcearrbhachas sin.
(3) Ní bheidh cearrbhachas ina chearrbhachas neamhdhleathach mura gcuirfidh na himreoirí aon gheall i bhfiontar leis an tionscantóir nó leis an mbaincéir ach amháin táille as an gceart chun bheith páirteach sa chluiche, ar choinníoll—
(a) nach ngearrfar ach táille amháin den tsórt sin i leith an lae a himreofar an cluiche, agus
(b) gurb í an táille chéanna a gearrfar ar gach duine de na himreoirí, agus
(c) nach bhfaighidh an tionscantóir aon bhrabús pearsanta as an gcluiche a thionscnamh.
Usaid ionad le haghaidh cearrbhachais neamhdhleathaigh.
5.—Ní dhéanfaidh ná ní cheadóidh duine ar bith aon foirgneamh ná seomra ná ionad, iata ná neamhiata, d'oscailt ná a choimeád ná d'úsáid le haghaidh cearrbhachais neamhdhleathaigh, ná ní ghlacfaidh sé páirt i gcúram agus i mbainistí, ná ní chabhróidh ar aon tslí i stíurú gnótha, aon fhorgnimh nó seomra nó ionaid a hosclófar nó a coimeádfar nó a húsáidfear amhlaidh.
Cearrbhachas ag surcas nó ag seó taistil.
6.—(1) Ní cearrbhachas neamhdhleathach cearrbhachas a bheas ar siúl in ionad ar bith mar chuid de shurcas nó de sheó taistil eile, más rud é—
(a) nach é an cearrbhachas an phríomh-ghníomhaíocht ag an seó, agus
(b) nach mairfidh an cearrbhachas tréimhse is sia ná deich lá agus nach raibh sé ar siúl i rith na dtrí mhí roimhe sin mar chuid den seó le linn é a bheith ar siúl san ionad sin nó in aon bhall laistigh de thrí mhíle ón ionad sin, agus
(c) nach mó ná sé pingne do gach imreoir faoi leith an geall i ngach cluiche faoi leith, agus
(d) nach gceadófar d'aon duine faoi bhun sé bliana déag d'aois imirt, agus
(e) nach bhféadfaidh aon imreoir níos mó ná luach deich scillinge a ghnóthú i ngach cluiche faoi leith, agus
(f) nach dtabharfaidh páirtíocht i gcluiche, ná toradh cluiche, teideal don imreoir bheith páirteach in aon chluiche ná crannchur eile ná teideal ar chuma ar bith eile chun aon airgead ná luach airgid d'fháil ná chun bheith páirteach in iomaíocht lena aghaidh, agus
(g) gur thug an tionscantóir roimh ré don tSáirsint i bhfeighil stáisiúin áitiúil an Gharda Shíochána fógra i scríbhinn i dtaobh na ndátaí a bheas cearrbhachas ar siúl ag an seó.
(2) Chun críche míre (b) d'fho-alt (1) measfar gur ionann crannchur a thionscnamh agus cearrbhachas a chur ar siúl.
Cearrbhachas ag carnabhail.
7.—(1) Ní cearrbhachas neamhdhleathach cearrbhachas a bheas ar siúl mar chuid de charnabhal, basár, spórt-chruinniú, féile áitiúil, taispeántas nó ócáid eile den tsórt sin, más rud é—
(a) nach bhfaighidh na daoine a rinne socrú le haghaidh na hócáide aon bhrabús pearsanta as an ócáid ná as an gcluiche, agus
(b) nach é an cearrbhachas an phríomh-ghníomhaíocht ag an ócáid, agus
(c) nach mairfidh an cearrbhachas ag an ócáid tréimhse is sia ná mí, agus
(d) nach mó ná sé pinge do gach imreoir faoi leith an geall i ngach cluiche faoi leith, agus
(e) nach gceadófar d'aon duine faoi bhun sé bliana déag d'aois imirt, agus
(f) nach bhféadfaidh aon imreoir níos mó ná luach deich scillinge a ghnóthú i ngach cluiche faoi leith, agus
(g) nach dtabharfaidh páirtíocht i gcluiche, ná toradh cluiche, teideal don imreoir bheith páirteach in aon chluiche ná crannchur eile ná teideal ar chuma ar bith eile chun aon airgead ná luach airgid d'fháil ná chun bheith páirteach in iomaíocht lena aghaidh, agus

(2) Chun críche míre (c) d'fho-alt (1) measfar gurb ionann crannchur a thionscnamh agus cearrbhachas a chur ar siúl.
Cáilíochtaí maidir le háit chónaithe i gcás tionscantóirí cearrbhachais.
8.—(1) San alt seo—
ciallaíonn “pearsa cháilithe” pearsa ar sa Stát a bhí a ghnátháit nó a phríomh-áit chónaithe aige i gcaitheamh na tréimhse dhá mhí dhéag roimh dháta áirithe;
ciallaíonn “cuideachta cháilithe” comhlucht corpraithe ar pearsana cáilithe tromlach a chomhaltaí agus tromlach na ndaoine atá á rialú agus á bhainistí.
(2) Ní thabharfaidh aon ní in alt 6 ná in alt 7 gur dleathach do dhuine cearrbhachas lena mbaineann alt 4 a thionscnamh nó cabhrú lena thionscnamh nó saoráidí a sholáthar lena aghaidh, mura rud é—
(a) gur pearsa cháilithe nó cuideachta cháilithe an duine sin, agus
(b) má tá an duine sin ag gníomhú thar ceann duine eile, gur pearsa cháilithe nó cuideachta cháilithe nó comhlucht neamhchorpraithe daoine, ar pearsa cháilithe gach comhalta dhe, an duine eile sin freisin.
(3) Ní bhaineann an t-alt seo le pearsa nach bhfuil ach ag cabhrú le cearrbhachas a thionscnamh do réir conartha sheirbhíse.
Cearrbhachas in áitreabh ceadúnaithe.
9.—(1) Ní cheadóidh ceadúnaí aitribh atá ceadúnaithe chun deocha meisciúla a dhíol cearrbhachas san áitreabh.
(2) Ní thoirmiscfidh an t-alt seo ar an gceadúnaí ná ar a chairde príobháideacha cártaí d'imirt ar gheallta i gcuid den áitreabh seachas an chuid inar gnáth deocha meisciúla a dhíol más ar a chostas féin a bheas sé ag tabhairt aíochta do na cairde sin.
(3) Ní bhaineann an t-alt seo le cluiche d'imirt nach gcuireann na himireoirí aon gheall i bhfiontar ann ach amháin táille as an gceart chun bheith páirteach sa chluiche, ar choinníoll—
(a) nach ngearrfar ach táille amháin den tsórt sin i leith an lae a himreofar an cluiche, agus
(b) gurb í an táille chéanna a gearrfar ar gach duine de na himreoirí, agus
(c) nach bhfaighidh an tionscantóir (más ann) aon bhrabús pearsanta as an gcluiche a thioscnamh.
(4) Déanfaidh an Chúirt, más cuí léi dá rogha féin é, ciontú i leith ciona faoin alt seo a thaifeadadh ar an gceadúnas.
Scán-innill a thoirmeasc.
10.—(1) Ní oibreoidh duine ar bith, ná ní chuirfidh faoi deara ná ní cheadóidh go n-oibreofar, ná ní sholáthróidh saorá dí chun go n-oibreofar, aon scán-inneall a bheas ceaptha chun go dtabharfaidh sé, nuair a hoibreofar go rathúil é, duais airgid nó comhartha nó earra eile a ngeallann nó a dtoilíonn an tionscantóir nó aon duine ag gníomhú thar a cheann é a mhalairtiú ar airgead nó ar luach airgid nó is féidir d'úsáid chun an t-inneall d'oibriú arís.
(2) Aon duine a bheas tar éis airgead nó luach airgid a thabhairt mar mhalairt ar chomhartha nó ar earra eile a scaoileadh amach as scán-inneall, measfar, murab é féin tionscantóir an innill, é a bheith ag gníomhú thar ceann an tionscantóra mura gcruthaítear a mhalairt.
(3) Ní bhaineann an t-alt seo le hinneall a bheas ceaptha chun áineasa amháin agus nach scaoilfear as, ar é d'oibriú go rathúil, méid is mó ná méid an ghill agus a mbeidh fógra air á mhíniú gurb shin é an cineál innill atá ann.
Falcaireacht.
11.—Gach duine a ghnóthós ó aon duine eile, trí aon chalaois nó falcaireacht ag tionscnamh nó ag oibriú aon chluiche nó ag cabhrú ina thionscnamh nó ina oibriú, nó ag soláthar saoráidí lena aghaidh, nó ag gníomhú mar bhaincéir do na daoine atá ag imirt, nó ag gabháil d'imirt, nó ag gealltóireacht ar thoradh, aon chluiche, spóirt, caithimh aimsire nó freachnaimh, nó a chuirfeas faoi deara nó a thabharfas amhlaidh go ngnóthóidh aon duine ó dhuine eile, rud ar bith is féidir a ghoid, measfar é a bheith ciontach sa rud sin d'fháil ón duine eile sin trí dhúmas bréige, le hintinn calaois a dhéanamh, do réir bhrí ailt 10 den Acht um Cheartas Coiriúil, 1951 (Uimh. 2 de 1951), agus ar é a chiontú pionósfar é dá réir.
CUID III.
Siamsalanna agus Aontaí Súgraidh a Cheadúnú.
Feidhm na Coda seo.
12.—Ní bheidh éifeacht ag an gCuid seo in aon límistéir mura bhfuil i bhfeidhm de thuras na huaire rún faoi alt 13 ag glacadh léi don límistéir sin.
Údarás áitiúil do ghlacadh leis an gCuid seo.
13.—(1) Féadfaidh údarás áitiúil, trí rún, glacadh leis an gCuid seo i leith iomláin a límistéire riaracháin nó i leith coda sonraithe di agus féadfaidh, trí rún, an glacadh sin a chealú.
(2) Chun críche an ailt seo ní háireofar i límistéir riaracháin chomhairle contae aon bhuirg, ceantar uirbeach ná baile.
(3) Ní bheidh éifeacht ag rún murar tugadh fógra míosa ar a laghad i scríbhinn do gach comhalta den údarás áitiúil go rabhthas ar intinn é a thairiscint agus murar foilsíodh sin trí fhógrán i dhá nuachtán ar a laghad a léitear sa límistéir lena mbaineann an tairiscint.
(4) Nuair a bheas rún rite ag údarás áitiúil cuirfidh sé faoi deara go bhfoilseofar fógra á chur sin in iúl i dhá nuachtán ar a laghad a léitear sa límistéir lena mbaineann an rún agus, a luaithe is féidir, cuirfidh sé cóip den rún chun an Aire.
(5) Féadfar fianaise gur ritheadh rún a thabhairt trí chóip den nuachtán ina raibh an fógra a thabhairt ar aird nó trí dheimhniú ina leith sin a thabhairt ar aird a airbheartós a bheith faoi shéala an údaráis áitiúil.
Siamsalann cheadúnaithe agus aonach súgraidh ceadúnaithe.
14.—Ní cearrbhachas neamhdhleathach cearrbhachas a bheas ar siúl i siamsalann nó ag aonach súgraidh, más rud é—
(a) gur do réir ceadúnais a bheas sé ar siúl, agus
(b) nach mó ná sé pingne do gach imreoir faoi leith an geall i ngach cluiche faoi leith, agus
(c) nach gceadófar d'aon duine faoi bhun sé bliana déag d'aois imirt, agus
(d) nach bhféadfaidh aon imreoir níos mó ná luach deich scillinge a ghnóthú i ngach cluiche faoi leith, agus
(e) nach dtabharfaidh páirtíocht i gcluiche, ná toradh cluiche, teideal don imreoir bheith páirteach in aon chluiche ná crannchur eile ná teideal ar chuma ar bith eile chun aon airgead ná luach airgid d'fháil ná chun bheith páirteach in iomaíocht lena aghaidh.
Deimhniú le haghaidh ceadúnais chearrbhachais.
15.—(1) Féadfaidh an Chúirt Dúiche deimhniú a thabhairt á údarú ceadúnas d'eisiúint a cheadós cearrbhachas i siamsalann nó ag aonach súgraidh.
(2) Ní tabharfar deimhniú mura soláthraítear siamsaí eile i dteannta an chearrbhachais.
(3) Ní tabharfar deimhniú mura suífidh an t-iarratasóir nach bhfuil sé dícháilithe le halt 8 chun cearrbhachas a thionscnamh faoi alt 6 nó faoi alt 7.
(4) Féadfaidh an Chúirt coinníollacha a chur leis an deimhniú a thórainneos na huaireanta le haghaidh cearrbhachais, a chuirfeas srian leis na cineálacha cearrbhachais agus lena mhéid is cead cineálacha áirithe cearrbhachais a bheith ar siúl, a thórainneos méid na ngeall agus na nduaiseanna agus a thoirmiscfeas nó a shrianfas cearrbhachas ag daoine faoi bhun aoiseanna sonraithe.
(5) Sonróidh an deimhniú an tréimhse sa bhliain áirithe lena mbaineann sé a bhfuil an ceadúnas le heisiúint ina haghaidh.
(6) Ní bheidh deimhniú faoin alt seo neamhbhailí toisc rún faoi alt 13 a chealú ina dhiaidh sin.
Fógra i dtaobh iarratais ar dheimhniú.
16.—(1) (a) Bhéarfaidh an duine a bheas ar intinn deimhniú d'iarraidh fógra ocht lá fichead i scríbhinn go bhfuil sin ar intinn aige do gach údarás áitiúil a bhfuil an t-áitreabh lena mbaineann an t-iarratas laistigh dá límistéir riaracháin agus do Cheannfort Gharda Shíochána na háite.
(b) Luafar sa bhfógra an méid agus na cineálacha cluichí atá le bheith ar siúl agus na saghsanna eile áineasa atá le soláthar.
(2) Cuirfidh an t-iarratasóir faoi deara freisin fógra i dtaobh a intinne d'fhoilsiú, ceithre lá déag ar a laghad roimh éisteacht a iarratais, i nuachtán a léitear san áit.
Eisteacht iarratais.
17.—(1) Nuair a bheas iarratas ar dheimhniú á bhreithniú ag an gCúirt bhéarfaidh sí aird—
(a) ar charachtar an iarratasóra nó, i gcás comhluchta chorpraithe, na ndaoine atá á rialú agus á bhainistí,
(b) ar an méid ceadúnas cearrbhachais atá i bhfeidhm cheana féin san áit,
(c) ar oiriúnacht an áitribh nó an ionaid a beartaítear d'úsáid,
(d) ar an gcineál daoine is dócha a bheas á thaithí agus, má bhí ceadúnas cearrbhachais ag an iarratasóir don áitreabh sin nó d'aon áitreabh nó ionad eile an bhliain roimhe sin, ar an gcuma inar stiúraigh sé é, agus
(e) ar na cineálacha cearrbhachais atá le bheith ar siúl.
(2) Féadfaidh an t-údarás áitiúil, Ceannfort an Gharda Shíochána agus aon duine eile ar dóigh leis an gCúirt leas a bheith aige ann, láithriú ag an éisteacht agus fianaise a thabhairt ar aird maidir leis an iarratas.
Achomharc i leith iarratais ar dheimhniú.
18.—(1) Gan dochar d'aon cheart achomhairc a bheirtear le haon Acht eile, beidh ceart achomhairc chun na Cúirte Cuarda—
(a) ag an iarratasóir ar dheimhniú—i gcoinne orduithe ón gCúirt Dúiche ag diúltú don iarratas,
(b) ag an iarratasóir—i gcoinne aon choda áirithe d'ordú ón gCúirt Dúiche ag tabhairt deimhnithe, agus
(c) ag aon duine a chuir i gcoinne an iarratais tráth a éisteachta—i gcoinne orduithe nó aon choda áirithe d'ordú ón gCúirt Dúiche ag tabhairt an deimhnithe.
(2) Fanfaidh deimhniú a thug an Chúirt Dúiche i lán-fheidhm go dtí go n-athrófar nó go gcúlghairmfear é de thoradh achomhairc.
(3) Más rud é, i gcás ina ndiúltóidh an Chúirt Dúiche deimhniú a thabhairt, gur sealbhóir ar cheadúnas atá fós i bhfeidhm an t-iarratasóir, leanfaidh an ceadúnas i bhfeidhm go dtí go gcinnfear achomharc i gcoinne an diúltuithe sin.
Ceadúnas d'oisiúint.
19.—Déanfaidh na Coimisinéirí Ioncaim, ar dhuine dar tugadh deimhniú i leith ceadúnais chearrbhachais dá iarraidh sin agus ar é d'íoc aon dleachta máil a foráltar le dlí, ceadúnas i pé foirm a ordóid d'eisiúint chun an iarratasóra agus beidh an ceadúnas sin, agus déarfar ann go mbeidh sé, faoi réir na gcoinníollacha a bheas ag gabháil leis an deimhniú.
Fógra a bheith ar taispeáint ag an gceadúnaí.
20.—Cuirfidh ceadúnaí siamsalainne ceadúnaithe nó aonaigh shúgraidh ceadúnaithe faoi deara go dtaispeánfar i gcónaí, i suíomh feiceálach in aice leis an mbealach isteach, fógra ar a mbeidh ainm agus seoladh an cheadúnaí agus coinníollacha an cheadúnais.
CUID IV.
Crannchuir.
Crannchuir a thoirmeasc.
21.—(1) Ní thionscnóidh duine ar bith crannchur ná ní chabhróidh lena thionscnamh.
(2) Ní dhéanfaidh duine ar bith aon ticéad, comhdhuille ná cúpón le haghaidh úsáide i gcrannchur, ná aon doiciméad ina mbeidh aon eolas maidir le crannchur, d'allmhuiriú, a chlóbhualadh, d'fhoilsiú, d'imdháil, a dhíol ná a thairiscint ná a thaispeáint chun a dhíolta, ná ní iarrfaidh tairiscint chun sin a cheannach ná ní bheidh sin ina sheilbh aige le díol ná le himdháil.
(3) Má gheibhtear in aon ionad nó áitreabh a cuardófar de bhun barántais chuardaigh faoin Acht seo aon ticéad, comhdhuille nó cúpón le haghaidh úsáide i gcrannchur, beidh sin ina fhianaise go dtí go gcruthófar a mhalairt, in inchúiseamh faoi gur sáraíodh an t-alt seo go raibh sé ina sheilbh le díol nó le himdháil ag an duine ag a raibh urlamhás ar an ionad nó ar an áitreabh.
(4) Ní bhaineann an t-alt seo le crannchur a ndearbhaítear le haon fhoráil den Chuid seo nach crannchur neamhdhleathach é.
(5) Ní bhaineann an t-alt seo le clóbhualadh ticéad, comhdhuillí, cúpón nó doiciméad eile do thionscantóirí crannchuir a tionscnaítear agus a stiúraítear go hiomlán lasmuigh den Stát.
Fógraíocht do chrannchuir.
22.—Ní dhéanfaidh duine ar bith aon fhógra ná scéala i dtaobh crannchuir (seachas scéala ag insint torthaí crannchuir a ndearbhaítear le haon fhoráil den Chuid seo nach crannchur neamhdhleathach é) a chlóbhualadh, d'fhoilsiú in aon nuachtán ná in aon fhoilseachán tréimhsiúil, a thaispeáint ar aon scáileán cineama ná a chraoladh ar an radio, ná ní chuirfidh faoi deara ná ní thabharfaidh chun críche go gclóbhuailfear, go bhfoilseofar, go dtaispeánfar nó go gcraolfar amhlaidh aon fhógra ná scéala den tsórt sin, ná ní leathfaidh, ná ní chuirfidh faoi deara ná ní thabharfaidh chun críche go leathfar, go feasach, aon nuachtán ná aon fhoilseachán tréimhsiúil ina mbeidh aon fhógra nó scéala den tsórt sin.
Crannchuir phríobháideacha.
23.—Ní bheidh crannchur neamhdhleathach más rud é—
(a) nach ndíolfar na hamhantair ach—
(i) le comhaltaí an aon-chumainn a bunaíodh agus a stiúraítear chun críocha nach mbaineann le cearrbhachas, geallchur ná crannchuir, nó
(ii) le daoine a n-oibríonn nó a gcónaíonn gach duine acu san áitreabh céanna, agus
(b) nach dtabharfar aon fhógra ná scéala i scríbhinn maidir leis an gcrannchur ach amháin fógra in áitreabh an chumainn nó na ndaoine eile lena mbaineann nó fógra do chomhaltaí an chumainn.
Crannchuir ag rincí agus ceolchoirmeacha.
24.—Ní bheidh crannchur neamhdhleathach más rud é—
(a) gur mar chuid de rince, ceolchoirm nó ócáid eile dá samhail a tionscnaítear é agus nach bhfaigheann na daoine a rinne socrú le haghaidh na hócáide aon bhrabús pearsanta as an ócáid ná as an gcrannchur, agus

25.—Ní bheidh crannchur neamhdhleathach más rud é—
(a) (i) gur mar chuid de shurcas nó de sheó taistil eile, lá a bheas cearrbhachas ceadaithe faoi alt 6, a tionscnófar é, nó
(ii) gur mar chuid de charnabhal, basár, spórtchruinniú, féile áitiúil, taispeántas nó ócáid eile dá samhail, lá a bheas cearrbhachas ceadaithe faoi alt 7, a tionscnófar é, agus nach bhfaighidh na daoine a rinne socrú le haghaidh na hócáide aon bhrabús pearsanta as an ócáid ná as an gcrannchur, nó
(iii) gur ceadúnaí siamsalainne ceadúnaithe nó aonaigh shúgraidh cheadúnaithe a thionscnós é, mar chuid den tsiamsa ann, agus

Crannchuir faoi chead nó faoi cheadúnas.
26.—(1) Ní bheidh crannchur neamhdhleathach más laistigh den Stát agus do réir ceada nó ceadúnais a tionscnófar agus a stiúrófar é go hiomlán.
(2) Ní bheidh feidhm ag alt 32 den Acht um Gheallchur, 1931 (Uimh. 27 de 1931) (a bhaineas le geallta a chur ar chluichí peile), maidir le crannchur lena mbaineann an t-alt seo.
Ceada.
27.—(1) Féadfaidh Ceannfort den Gharda Síochána, ar iarratas aon duine a chónaíos ina cheantar, cead d'eisiúint chun crannchur a thionscnamh do réir an ailt seo.
(2) Beidh na coinníollacha seo a leanas le comhlíonadh maidir leis an gcrannchur:—
(a) ní bhfaighidh sealbhóir an cheada aon bhrabús pearsanta as an gcrannchur;
(b) ní mó ná trí chéad punt luach iomlán na nduaiseanna;
(c) luafar ar gach ticéad nó cúpón luach gach duaise faoi leith.
(3) Ní tabharfar cead chun sochair d'aon tairbhí áirithe níos mó ná uair amháin sa sé mhí.
(4) Más rud é, áfach, gur carnabhal, basár, spórt-chruinniú, féile áitiúil, taispeántas nó ócáid eile dá samhail a bheas á eagrú féadfaidh an cead a údarú go dtionscnófar níos mó ná aon chrannchur amháin i ndáil leis. Má bhíonn níos mó ná crannchur amháin ann in aon tseachtain, ní mó ná trí chéad punt luach iomlán na nduaiseanna don tseachtain sin.
(5) Má dhiúltaíonn Ceannfort cead a thabhairt féadfar achomharc a dhéanamh chun na Cúirte Dúiche i gcoinne an diúltuithe. Is breith chríochnaitheach breith na Cúirte Dúiche.
Ceadúnas crannchuir.
28.—(1) Féadfaidh an Chúirt Dúiche ceadúnas a thabhairt chun crannchuir thréimhsiúla a thionscnamh do réir an ailt seo i rith pé tréimhse, nach sia ná bliain, a sonrófar sa cheadúnas.
(2) Beidh na coinníollacha seo a leanas le comhlíonadh maidir le gach sreath chrannchur:—
(a) is chun críche nó críocha éigin carthanais nó daoncharadais a tionscnófar í;
(b) ní bhfaighidh an ceadúnaí aon bhrabús pearsanta aisti;
(c) ní mó ná cúig chéad punt luach iomlán na nduaiseanna aon tráth, agus, má bhíonn níos mó ná crannchur amháin ann in aon tseachtain, ní mó ná cúig chéad punt luach iomlán na nduaiseanna don tseachtain sin;
(d) luafar ar gach ticéad nó cúpón luach gach duaise faoi leith;
(e) ní húsáidfear níos mó ná ceathracha faoin gcéad den fháltas iomlán le haghaidh caiteachas a tionscanta, lena n-áirítear coimisiún, agus measfar gurb íocaíocht choimisiúin is ionann agus an méid is fiú í aon iontráil a bhéarfar in aisce le haghaidh an chrannchuir.

29.—(1) Bhéarfaidh an duine a bheas ar intinn ceadúnas d'iarraidh fógra ocht lá fichead i scríbhinn go bhfuil sin ar intinn aige do Cheannfort an Gharda Shíochána sa cheantar ina bhfuil an crannchur le heagrú.
(2) Luafar sa bhfógra an cineál crannchuir atá le cur ar siúl, cuspóir an chrannchuir, an méid nó an chionúireacht den fháltas a beartaítear a thabhairt mar luach saothair do ghníomhairí, díoltóirí ticéad agus daoine eile a fostófar i ndáil leis, agus luach na nduaiseanna.

30.—Duine ar bith a dhéanfas, mar thaca le hiarratas ar cheadúnas nó ar chead, aon ráiteas nó uiríoll (i scríbhinn nó ó bhéal) is eol dó a bheith bréagach nó míthreorach in aon phonc ábhartha, beidh sé ciontach i gcion agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná céad punt a chur air nó príosúntacht ar feadh téarma nach sia ná trí mhí nó an fhíneáil sin agus an phríosúntacht sin le chéile.
Eisteacht iarratais.
31.—(1) Nuair a bheas iarratas ar cheadúnas á bhreithniú ag an gcúirt bhéarfaidh sí aird—
(a) ar charachtar an iarratasóra, agus
(b) ar an méid crannchur tréimhsiúla atá ar siúl cheana san áit.
(2) Nuair a bheas an t-iarratas á éisteacht féadfaidh Ceannfort an Gharda Shíochána, agus aon duine eile ar dóigh leis an gCúirt leas a bheith aige ann, láithriú agus fianaise a thabhairt ar aird maidir leis an iarratas.
Achomharc i leith iarratais ar cheadúnas.
32.—Gan dochar d'aon cheart achomhairc a bheirtear le haon Acht eile, beidh ceart achomhairc chun na Cúirte Cuarda—
(a) ag an iarratasóir ar cheadúnas—i gcoinne an orduithe ón gCúirt Dúiche ag diúltú don iarratas,
(b) ag an iarratasóir—i gcoinne na coda den ordú ón gCúirt Dúiche a shonraíos tréimhse an cheadúnais, agus
(c) ag aon duine a chuir i gcoinne an iarratais tráth a éisteachta—i gcoinne an orduithe ón gCúirt Dúiche ag tabhairt an cheadúnais nó i gcoinne na coda den ordú a shonraíos tréimhse an cheadúnais.
Ticéid chrannchuir.
33.—Beidh ar gach ticéad, cúpón, comhdhuille agus fógra maidir le crannchur (seachas crannchur lena mbaineann alt 23, 24 nó 25) ainm agus seoladh sealbhóra an cheadúnais nó an cheada nó, má bhíonn an ceadúnas nó an cead in ainm níos mó ná duine amháin, ainm agus seoladh aon duine amháin acu, agus ainm agus seoladh an chlódóra agus an tairbhí nó an chuspóra, agus luafar ann cé acu faoi cheadúnas nó faoi chead atá sé ar siúl agus luafar an Chúirt nó an Ceannfort a thug an ceadúnas nó an cead.
Toirmeasc ar airgead nó doiciméid a thabhairt amach nó a chur amach as an Stát.
34.—(1) Ní dhéanfaidh ná ní thriailfidh duine ar bith aon ticéad, comhdhuille ná cúpón le haghaidh úsáide i gcrannchur ná aon airgead chun ticéad nó amhantar a cheannach, ná aon airgead is ionann agus praghas ceannaigh ticéid nó amhantair, i gcrannchur ná duais a gnóthaíodh i gcrannchur, ná aon doiciméad a bhaineas le ceannach nó díol, nó a chuireas in iúl cé hé sealbhóir, aon ticéid nó amhantair den tsórt sin, a thabhairt amach ná a chur amach as an Stát.
(2) Ní bhaineann an t-alt seo le honnmhuiriú ticéad, cúpón, comhdhuillí agus doiciméad eile a clóbhuailtear sa Stát do thionscantóirí crannchuir a tionscnaítear agus a stiúraítear go hiomlán lasmuigh den Stát.
(3) I gcás crannchur a thionscnamh, do réir ceadúnais, do thairbhí lasmuigh den Stát, ní chuirfidh an t-alt seo toirmeasc ar dhoiciméid a bhaineas leis an gcrannchur a thabhairt amach nó a chur amach as an Stát chun duine atá ag gníomhú thar ceann an tairbhí nuair a beifear tar éis na duaiseoirí a chinneadh.
Díolmhadh ó na hAchta um Gheallchur.
35.—Ní bheidh ar shealbhóir ceadúnais nó ceada crannchuir ceadúnas geallghlacadóra a bheith aige faoin Acht um Gheallchur, 1931 (Uimh. 27 de 1931), agus ní bheidh feidhm ag an Betting Act, 1853, maidir le húsáid áitribh i ndáil leis an gcrannchur.
CUID V.
Cur i bhFeidhm, Fianaise agus Pionóis.
Conartha cearrbhachais agus geallchuir ar neamhní.
36.—(1) Is conradh ar neamhní gach conradh i modh cearrbhachais nó geallchuir.
(2) Ní bheidh aon ábhar caingin ann chun aon airgead nó rud a ghnóthú a líomhantar a bheith buaite nó íoctha as geall nó a taisceadh ag feitheamh ar an teagmhas ar ar cuireadh geall.
(3) Aon gheallúint, sainráite nó intuigthe, go n-íocfar le duine ar bith aon airgead d'íoc sé faoi chonradh nó i leith conartha lena mbaineann an t-alt seo nó go n-íocfar aon airgead i bhfoirm choimisiúin, táille, luaíochta nó eile i leith an chonartha nó i leith aon tseirbhísí i ndáil leis an gconradh, is geallúint ar neamhní í agus ní bheidh aon ábhar caingin ann chun aon airgead den tsórt sin a ghnóthú.
(4) Ní bhaineann an t-alt seo le haon chomhaontú chun síntiús nó ranníoc a thabhairt i gcomhair aon phláta, duaise nó suime airgid a bheas le dámhadh do bhuaiteoir nó buaiteoirí aon chluiche, spóirt nó caithimh aimsire nach dtoirmisctear leis an Acht seo, ar choinníoll nach geall an síntiús nó an ranníoc.
Gléasa cearrbhachais d'urghabháil.
37.—(1) Féadfaidh comhalta den Gharda Síochána aon ghléas cearrbhachais d'urghabháil, más scán-inneall é a toirmeasctar le halt 10 nó gléas cearrbhachais ar a bhfuil aon fheiste trínar féidir é d'oibriú go calaoiseach nó má tá cúis aige a chreidiúint go bhfuiltear á oibriú go calaoiseach nó á úsáid le haghaidh cearrbhachais neamhdhleathaigh.
(2) Ní oibreoidh duine ar bith, ná ní cheadóidh sé go n-oibreofar, aon ghléas cearrbhachais, ná ní bheidh seilbh ná urlámhas aige ar aon ghléas cearrbhachais, ar a bhfuil aon fheiste den tsórt sin.

38.—Féadfaidh comhalta den Gharda Síochána dul isteach agus saor-chead isteach a bheith aige, gach tráth réasúnach, chuig aon tsiamsalann, aonach súgraidh, surcas, seó taistil, carnabhal, basár, spórt-chruinniú, féile áitiúil, taispeántas nó ócáid eile dá samhail a bhfuil, nó a gcreidtear go bhfuil, cearrbhachas nó crannchur ar siúl ann.
Barántas cuardaigh
39.—(1) Más deimhin le Breitheamh den Chuirt Dúiche, ar chomhalta den Gharda Síochána nach ísle céim ná Cigire do thabhairt faisnéise faoi mhionn, go bhfuil cúis réasúnach ann chun a cheapadh go bhfuil cion in aghaidh an Achta seo déanta, á dhéanamh, nó ar tí a dhéanta, in aon ionad nó áitreabh, féadfaidh an Breitheamh barántas cuardaigh d'eisiúint faoin alt seo.
(2) Udaróidh an barántas cuardaigh do chomhalta a hainmneofar den Gharda Síochána agus nach ísle céim ná Cigire, maraon le pé comhaltaí eile den Gharda Síochána is cuí leis an gcomhalta sin, dul isteach san ionad nó san áitreabh aon tráth laistigh d'ocht n-uaire ceathrachad a chloig tar éis an barántas d'eisiúint, go forneartach más gá sin, chun an t-ionad nó an t-áitreabh agus aon leabhair agus doiciméid a gheofar ann d'iniúchadh agus ainm agus seoladh aon duine a gheofar ann a thógaint, agus aon ghléas cearrbhachais agus aon leabhair agus doiciméid d'urghabháil a gheofar ann agus a dhealraíos a bheith ag baint le cearrbhachas nó crannchuir.

40.—(1) Féadfaidh comhalta den Gharda Síochána duine ar bith a ghabháil gan barántas a gheobhas sé ag stiúrú, nó ag cabhrú le stiúrú, aon tsóirt chearrbhachais in áit poiblí a bhfuil cúis aige a chreidiúint gur cearrbhachas é atá contrártha don Acht seo.
(2) Féadfaidh comhalta den Gharda Síochána duine ar bith a ghabháil gan barántas más rud é, ar a ainm agus a sheoladh d'éileamh air faoin Acht seo, nach dtabharfaidh sé iad nó go dtabharfaidh sé ainm nó seoladh a bhfuil cúis ag an gcomhalta sin a chreidiúint go bhfuil sé bréagach nó míthreorach.

41.—Duine ar bith a choiscfeas nó a bhacfas comhalta den Gharda Síochána agus é ag feidhmiú a chumhacht faoin Acht seo nó, nuair a iarrfas an comhalta sin a ainm agus a sheoladh air, nach dtabharfaidh iad nó a bhéarfas ainm nó seoladh atá bréagach nó míthreorach, beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná cúig puint fhichead a chur air.
Fianaise i dtaobh ionad cearrbhachais neamhdhleathaigh a choimeád.
42.—Má coisctear nó má bactar comhalta den Gharda Síochána ar dhul isteach in aon ionad nó áitreabh, nó in aon chuid de, i bhfeidhmiú a chumhacht faoin Acht seo nó má gheibhtear ansin aon ghléas cearrbhachais, ar scán-inneall é a toirmisctear le halt 10 nó gléas cearrbhachais is féidir d'úsáid le haghaidh cearrbhachais neamhdhleathaigh, glacfar leis go dtí go gcruthófar a mhalairt go raibh nó go bhfuil an t-ionad nó an t-áitreabh sin á choimeád le haghaidh cearrbhachais neamhdhleathaigh.

43.—Ní gá mar thaca le hinchúiseamh maidir le cearrbhachas neamhdhleathach a chruthú gur ar airgead nó geall ar bith a bhí aon duine ag imirt a fuarthas ag imirt aon chluiche.

44.—Duine ar bith a shárós aon fhoráil den Acht seo nach bhforáltar pionós ina leith go sonrach, beidh sé ciontach i gcion agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná céad punt a chur air nó príosúntacht ar feadh téarma nach sia ná trí mhí nó an fhíneáil sin agus an phríosúntacht sin le chéile.

45.—(1) Má dhéanann comhlucht corpraithe nó duine a airbheartaíos a bheith ag gníomhú thar ceann comhluchta chorpraithe nó comhlucht neamhchorpraithe daoine cion i gcoinne an Achta seo agus go gcruthófar go ndearnadh amhlaidh é le toiliú nó aontú, nó gur hurasaíodh a dhéanamh trí aon mhainneachtaint ar thaobh aon duine atá, i gcás comhluchta chorpraithe, ina stiúrthóir ar an gcomhlucht sin nó, i gcás comhluchta neamhchorpraithe, ina chomhalta de choiste bainistí nó d'údarás rialuithe eile an chomhluchta sin, beidh an duine sin freisin ciontach sa chion.
(2) Aon toghairm nó doiciméad eile is gá a sheirbheáil, chun críche nó i gcúrsa imeacht faoin alt seo, ar chomhlucht corpraithe, féadfar é a sheirbheáil trína fhágaint ag oifig chláraithe an chomhluchta sin nó trína chur leis an bpost cláraithe go dtí an oifig sin nó, mura bhfuil aon oifig den tsórt sin sa Stát, trína fhágaint ag an gcomhlucht, nó trína chur leis an bpost cláraithe chuig an gcomhlucht, ag aon áit sa Stát ina mbíonn a ghnó á sheoladh aige.

46.—Má ciontaítear i gcion i gcoinne an Achta seo duine is sealbhóir ar cheadúnas cearrbhachais nó ar cheadúnas nó cead crannchuir, féadfaidh an Chúirt an ceadúnas nó an cead a chúlghairm.
Gléasa cearrbhachais d'fhorghéilleadh.
47.—(1) Nuair a ciontófar duine i gcion i gcoinne an Achta seo féadfaidh an Chúirt a ordú go bhforghéillfear don Aire aon ghléas cearrbhachais a húsáideadh ag déanamh an chiona nó, i gcás ciontuithe faoi alt 5, aon ghléas cearrbhachais a fuarthas san áitreabh nó san ionad a bheas i gceist.
(2) Féadfaidh an tAire déanamh nó déileáil mar is cuí leis le haon ní a forghéillfear amhlaidh.
(3) Déanfar an fáltas glan as aon ní a dhíolfas an tAire de bhun an ailt seo d'íoc isteach sa Stát-Chiste nó a chur chun tairbhe don Stát-Chiste i pé slí a ordós an tAire Airgeadais.
Doiciméid a dhíthiú.
48.—Nuair a ciontófar duine i gcion maidir le crannchur, féadfaidh an Chúirt a ordú go ndítheofar aon doiciméid a bhaineas leis an gcrannchur.
Pacáidí poist ina bhfuil doiciméid neamhdhleathacha a cuireadh sa phost sa Stát.
49.—(1) Féadfaidh an tAire Poist agus Telegrafa aon phacáid phoist a choinneáil a cuireadh sa phost sa Stát agus a mbeifear in amhras go bhfuil aon doiciméad inti a bhaineas le crannchur neamhdhleathach agus cuirfidh sé ar aghaidh chuig comhalta den Gharda Síochána nach ísle céim ná Ceannfort gach pacáid phoist a coinneofar amhlaidh.
(2) Féadfaidh an comhalta an phacáid d'oscailt agus a scrúdú ach, i gcás seoladh laistigh den Stát, ní dhéanfaidh sé sin ach amháin i láthair an duine chun ar seoladh an phacáid, mura rud é nach dtiocfaidh an duine sin i láthair tar éis fógra i scríbhinn d'fhágaint ag an seoladh ar an bpacáid, nó a chur leis an bpost chuig an seoladh sin, á iarraidh air teacht i láthair.
(3) Má gheibheann an comhalta aon doiciméad den tsórt sin, féadfaidh sé an phacáid agus a bhfuil inti a choinneáil le haghaidh inchúisimh, agus mura bhfaighidh sé aon doiciméad den tsórt sin seachadfaidh sé an phacáid don duine chun ar seoladh í nó, má tá sé as láthair, cuirfidh sé chuige leis an bpost í.
(4) Forléireofar mar aon ní amháin an t-alt seo agus na hAchta um Oifig an Phoist, 1908 go 1951.

50.—(1) Féadfaidh Coimisinéir an Gharda Shíochána, le toiliú an Aire, rialacháin a dhéanamh á fhoráil go gcoimeádfar cuntais agus taifid eile maidir le crannchuir agus go dtabharfar tuairisceáin agus eolas ina dtaobh.
(2) Gach duine ar a gcuirfear dualgas le haon rialachán den tsórt sin, comhlíonfaidh sé forála an rialacháin.

PART I.
Preliminary and General.
Short title and commencement.
1.—(1) This Act may be cited as the Gaming and Lotteries Act, 1956.
(2) This Act shall come into operation on such day as the Minister shall by order appoint.
Definitions.
2.—In this Act—
“banker” in relation to a game means the banker or other person by whom the game is managed, or against whom the other players stake, play or bet;
“gaming” means playing a game (whether of skill or chance or partly of skill and partly of chance) for stakes hazarded by the players;
“gaming instrument” means any table or instrument of gaming and any coin, card, token or other article used as an instrument or means of gaming;
“gaming licence” means a licence under section 19;
“local authority” means a body being the council of a county, the corporation of a county or other borough, the council of an urban district or the commissioners of a town;
“lottery” includes all competitions for money or money's worth involving guesses or estimates of future events or of past events the results of which are not yet ascertained or not yet generally known;
“lottery licence” means a licence under section 28;
“the Minister” means the Minister for Justice;
“public place” means any place to which the public have access whether as of right or by permission and whether subject to or free of charge;
“society” includes a club, institution, organisation or other association of persons by whatever name called;
“stake” includes any payment for the right to take part in a game and any other form of payment required to be made as a condition of taking part in the game but does not include a payment made solely for facilities provided for the playing of the game;
“Superintendent” includes an Inspector acting as Superintendent.
Repeals.
3.—The enactments mentioned in the Schedule are hereby repealed.
PART II.
Gaming.
Unlawful gaming.
4.—(1) No person shall promote or assist in promoting or provide facilities for any kind of gaming—
(a) in which by reason of the nature of the game, the chances of all the players, including the banker, are not equal, or
(b) in which any portion of the stakes is retained by the promoter or is retained by the banker otherwise than as winnings on the result of the play, or
(c) by means of any slot-machine not prohibited by section 10.
(2) Such gaming is in this Act referred to as unlawful gaming.
(3) Gaming shall not be unlawful if no stake is hazarded by the players with the promoter or banker other than a charge for the right to take part in the game, provided that—
(a) only one such charge is made in respect of the day on which the game is played, and
(b) the charge is of the same amount for all the players, and
(c) the promoter derives no personal profit from the promotion of the game.
Use of places for unlawful gaming.
5.—No person shall open, keep or use any building, room or place, enclosed or unenclosed, or permit it to be opened, kept or used for unlawful gaming or take part in the care and management of or in any way assist in conducting the business of any building, room or place so opened, kept or used.
Gaming at circus or travelling show.
6.—(1) Gaming carried on at any place as part of a circus or other travelling show shall not be unlawful gaming if—
(a) gaming is not the main activity at the show, and
(b) the gaming does not extend over a period exceeding ten days and has not been carried on during the preceding three months as part of the show when being held at that place or anywhere within three miles of that place, and
(c) the stake in each game is not more than sixpence for each player, and
(d) no person under sixteen years of age is permitted to play, and
(e) no player may win more than the value of ten shillings in each game, and
(f) neither taking part in nor the result of a game entitles the player to take part in any other game or lottery or otherwise to receive or be eligible to compete for any money or money's worth, and
(g) notice in writing of the dates of gaming at the show has been previously given by the promoter to the Sergeant in charge of the local Garda Síochána station.
(2) For the purpose of paragraph (b) of subsection (1), the promotion of a lottery shall be deemed to be the carrying on of gaming.
Gaming at carnivals.
7.—(1) Gaming carried on as part of a carnival, bazaar, sports meeting, local festival, exhibition or other like event shall not be unlawful gaming if—
(a) the persons arranging for the holding of the event derive no personal profit from the event or from the game, and
(b) gaming is not the main activity of the event, and
(c) gaming at the event does not extend over a period exceeding one month, and
(d) the stake in each game is not more than sixpence for each player, and
(e) no person under sixteen years of age is permitted to play, and
(f) no player may win more than the value of ten shillings in each game, and
(g) neither taking part in nor the result of a game entitles the player to take part in any other game or lottery or otherwise to receive or be eligible to compete for any money or money's worth, and
(h) notice in writing of the dates of gaming at the event has been previously given by the promoter to the Sergeant in charge of the local Garda Síochána station.
(2) For the purpose of paragraph (c) of subsection (1), the promotion of a lottery shall be deemed to be the carrying on of gaming.
Residence qualifications for promoters of gaming.
8.—(1) In this section—
“qualified individual” means an individual who, during the period of twelve months preceding a given date, has had his usual or principal place of residence in the State;
“qualified company” means a body corporate in the case of which both a majority of the members and a majority of the persons exercising control and management are qualified individuals.
(2) Nothing in section 6 or section 7 shall render it lawful for a person to promote, assist in promoting or provide facilities for gaming to which section 4 applies unless—
(a) that person is a qualified individual or a qualified company, and
(b) if that person is acting on behalf of another person, that other person is also a qualified individual or a qualified company or an unincorporated body of persons, each member of which is a qualified individual.
(3) This section does not apply to an individual who is merely assisting in the promotion of gaming in accordance with a contract of service.
Gaming on licensed premises.
9.—(1) The licensee of premises licensed for the sale of intoxicating liquor shall not permit gaming on the premises.
(2) This section shall not prohibit the licensee or his private friends from playing cards for stakes in a part of the premises other than that in which the sale of intoxicating liquor generally takes place if the friends are being entertained by him at his own expense.
(3) This section does not apply to the playing of a game where no stake is hazarded by the players other than a charge for the right to take part in the game, provided that—
(a) only one such charge is made in respect of the day on which the game is played, and
(b) the charge is of the same amount for all the players, and
(c) the promoter (if any) derives no personal profit from the promotion of the game.
(4) A conviction for an offence under this section shall, if the Court in its discretion so thinks proper, be recorded on the licence.
Prohibition of slot-machines.
10.—(1) No person shall operate or cause or permit to be operated or provide facilities for the operation of any slot-machine designed to deliver, when successfully operated, a money prize or a token or other article which the promoter or any person acting on his behalf undertakes or is willing to exchange for money or money's worth or which may be used to enable the machine to be operated again.
(2) A person who has given money or money's worth in exchange for a token or other article delivered from a slot-machine shall be deemed, if not himself the promoter of the machine, to be acting on behalf of the promoter unless the contrary is shown.
(3) This section does not apply to a machine which is designed for amusement only and, when successfully operated, delivers no more than the amount of the stake and bears a notice explaining that it is of that kind.
Cheating.
11.—Every person who by any fraud or cheat in promoting or operating or assisting in promoting or operating or in providing facilities for any game or in acting as banker for those who play or in playing at, or in wagering on the event of, any game, sport, pastime or exercise wins from any other person or causes or procures any person to win from another anything capable of being stolen shall be deemed guilty of obtaining such thing from such other person by a false pretence, with intent to defraud, within the meaning of section 10 of the Criminal Justice Act, 1951 (No. 2 of 1951), and on conviction shall be punished accordingly.
PART III.
Licensing of Amusement Halls and Funfairs.
Application of this Part.
12.—This Part shall not have effect in any area unless there is for the time being in force a resolution under section 13 adopting it for that area.
Adoption of this Part by local authority.
13.—(1) A local authority may by resolution adopt this Part in respect of the whole or a specified part of its administrative area and may by resolution rescind such adoption.
(2) For the purpose of this section the administrative area of the council of a county shall not include any borough, urban district or town.
(3) A resolution shall not have effect unless not less than one month's notice of the intention to propose it has been given in writing to every member of the local authority and has been published by advertisement in at least two newspapers circulating in the area to which the proposal relates.
(4) A local authority on passing a resolution shall cause notice of the fact to be published in at least two newspapers circulating in the area to which the resolution relates and shall as soon as may be send a copy of the resolution to the Minister.
(5) Evidence of the passing of a resolution may be given by the production of a copy of a newspaper containing the notice or by the production of a certificate to that effect purporting to be under the seal of the local authority.
Licensed amusement hall and funfair.
14.—Gaming carried on at an amusement hall or funfair shall not be unlawful gaming if—
(a) it is carried on in accordance with a licence, and
(b) the stake in each game is not more than sixpence for each player, and
(c) no person under sixteen years of age is permitted to play, and
(d) no player may win more than the value of ten shillings in each game, and
(e) neither taking part in nor the result of a game entitles the player to take part in any other game or lottery or otherwise to receive or be eligible to compete for any money or money's worth.
Certificate for gaming licence.
15.—(1) The District Court may grant a certificate authorising the issue of a licence permitting gaming at an amusement hall or funfair.
(2) A certificate shall not be granted unless forms of entertainment other than gaming are also provided.
(3) A certificate shall not be granted unless the applicant shows that he is not disqualified by section 8 from the promotion of gaming under section 6 or section 7.
(4) The Court may attach to the certificate conditions limiting the hours during which gaming may be carried on, restricting the kinds of gaming and the extent to which particular kinds of gaming may be carried on, limiting the amount of the stakes and of prizes and prohibiting or restricting gaming by persons under specified ages.
(5) The certificate shall specify the period in the particular year to which it relates for which the licence is to be issued.
(6) A certificate granted under this section shall not be invalidated by the subsequent rescission of a resolution under section 13.
Notice of application for certificate.
16.—(1) (a) The intending applicant for a certificate shall give twenty-eight days' notice in writing of his intention to each local authority within whose administrative area the premises to which the application relates are situate and to the Superintendent of the Garda Síochána for the locality.
(b) The notice shall state the number and kinds of games proposed to be carried on and the other forms of amusement to be provided.
(2) The applicant shall also cause a notice of his intention to be published at least fourteen days before the hearing in a newspaper circulating in the locality.
Hearing of application.
17.—(1) In considering an application for a certificate the Court shall have regard to—
(a) the character of the applicant or, in the case of a body corporate, of the persons exercising control and management thereof,
(b) the number of gaming licences already in force in the locality,
(c) the suitability of the premises or place proposed to be used,
(d) the class of persons likely to resort to it, and, if the applicant held a gaming licence for that or any other premises or place in the previous year, the manner in which he conducted it, and
(e) the kinds of gaming proposed to be carried on.
(2) At the hearing, the local authority, the Superintendent of the Garda Síochána and any other person who appears to the Court to be interested may appear and may adduce evidence in relation to the application.
Appeal in respect of application for certificate.
18.—(1) Without prejudice to any right of appeal given by any other Act, an appeal shall lie to the Circuit Court—
(a) by the applicant for a certificate—from an order of the District Court refusing the application,
(b) by the applicant—from any particular part of an order of the District Court granting a certificate, and
(c) by any person who at the hearing opposed the application—from an order or any particular part of an order of the District Court granting the certificate.
(2) A certificate granted by the District Court shall remain in full force until altered or revoked on appeal.
(3) Where, in the case of the refusal of a certificate by the District Court, the applicant is the holder of a subsisting licence the licence shall continue in force pending the determination of an appeal against such refusal.
Issue of licence.
19.—The Revenue Commissioners shall, on the application of a person to whom a certificate for a gaming licence has been granted and on payment by him of any excise duty provided for by law, issue to the applicant a licence in such form as they may direct which shall be and be expressed to be subject to the conditions attached to the certificate.
Display of notice by licensee.
20.—The licensee of a licensed amusement hall or funfair shall cause to be displayed at all times, in a conspicuous position near the entrance, a notice giving the name and address of the licensee and the conditions of the licence.
PART IV.
Lotteries.
Prohibition of lotteries.
21.—(1) No person shall promote or assist in promoting a lottery.
(2) No person shall import, print, publish or distribute or sell, offer or expose for sale, invite an offer to buy or have in his possession for sale or distribution any ticket, counterfoil or coupon for use in a lottery or any document containing any information relating to a lottery.
(3) If any ticket, counterfoil or coupon for use in a lottery is found at any place or premises searched in pursuance of a search warrant under this Act, it shall be evidence until the contrary is proved, in a prosecution for a contravention of this section, that the person having control over the place or premises had it in his possession for sale or distribution.
(4) This section does not apply to a lottery declared by any provision of this Part not to be unlawful.
(5) This section does not apply to the printing of tickets, counterfoils, coupons or other documents for the promoters of a lottery promoted and conducted wholly outside the State.
Advertisement of lotteries.
22.—No person shall print, publish in any newspaper or periodical publication, exhibit on any cinema screen or broadcast by radio any notice or announcement concerning a lottery (other than an announcement of the results of a lottery declared by any provision of this Part not to be unlawful) or cause or procure any such notice or announcement to be so printed, published, exhibited or broadcast or knowingly circulate or cause or procure to be circulated any newspaper or periodical publication containing any such notice or announcement.
Private lotteries.
23.—A lottery shall not be unlawful if—
(a) the sale of chances is confined to—
(i) the members of one society established and conducted for purposes not connected with gaming, wagering or lotteries, or
(ii) persons all of whom work or reside on the same premises, and
(b) there is no written notice or announcement relating to the lottery except a notice on the premises of the society or other persons concerned or to members of the society.
Lotteries at dances and concerts.
24.—A lottery shall not be unlawful if—
(a) it is promoted as part of a dance, concert or other like event and the persons arranging for the holding of the event derive no personal profit from the event or from the lottery, and
(b) the total value of the prizes in the lottery is not more than twenty-five pounds and, if more than one lottery is held, the total value of the prizes for the event is not more than twenty-five pounds.
Lotteries at carnivals and other events.
25.—A lottery shall not be unlawful if—
(a) either—
(i) it is promoted as part of a circus or other travelling show on a day on which under section 6 gaming is permitted, or
(ii) it is promoted as part of a carnival, bazaar, sports meeting, local festival, exhibition or other like event on a day on which under section 7 gaming is permitted and the persons arranging for the holding of the event derive no personal profit from the event or from the lottery, or
(iii) it is promoted by the licensee of a licensed amusement hall or funfair as part of the entertainment therein, and
(b) the tickets are not sold outside the place or premises where the event is in progress, and
(c) they are sold only on the same day or night as the draw and announcement of results, and
(d) the price of each ticket is not more than sixpence, and
(e) no person may win more than the value of ten shillings in the lottery, and
(f) neither taking part in nor the result of the lottery entitles the participant to take part in any other lottery or game or otherwise to receive or be eligible to compete for any money or money's worth.
Lotteries under permit or licence.
26.—(1) A lottery shall not be unlawful if it is promoted and conducted wholly within the State in accordance with a permit or a licence.
(2) Section 32 of the Betting Act, 1931 (No. 27 of 1931) (which relates to betting on football games), shall not apply to a lottery to which this section applies.
Permits.
27.—(1) A Superintendent of the Garda Síochána, on the application of any person residing in his district, may issue a permit for the promotion of a lottery in accordance with this section.
(2) The lottery shall comply with the following conditions:—
(a) the permit-holder shall derive no personal profit from the lottery;
(b) the total value of the prizes shall be not more than three hundred pounds;
(c) the value of each prize shall be stated on every ticket or coupon.
(3) A permit shall not be granted more than once in six months for the benefit of any one beneficiary.
(4) Where, however, a carnival, bazaar, sports meeting, local festival, exhibition or other like event is being organised, the permit may authorise the promotion of more than one lottery in conjunction with it. If more than one lottery is held in any week, the total value of the prizes for the week shall be not more than three hundred pounds.
(5) An appeal shall lie to the District Court from the refusal of a Superintendent to grant a permit. The decision of the District Court shall be final.
Lottery licence.
28.—(1) The District Court may grant a licence for the promotion, during such period, not exceeding one year, as shall be specified in the licence, of periodical lotteries in accordance with this section.
(2) Each series of lotteries shall comply with the following conditions:—
(a) it shall be for some charitable or philanthropic purpose or purposes;
(b) the licensee shall derive no personal profit from it;
(c) the total value of the prizes on any occasion shall be not more than five hundred pounds, and, if more than one lottery is held in any week, the total value of the prizes for the week shall be not more than five hundred pounds;
(d) the value of each prize shall be stated on every ticket or coupon;
(e) not more than forty per cent. of the gross proceeds shall be utilised for the expenses of promotion, including commission, and any free entry for the lottery shall be deemed to be a payment of commission to the extent of its value.
Notice of application for licence.
29.—(1) The intending applicant for a licence shall give twenty-eight days' notice in writing of his intention to the Superintendent of the Garda Síochána for the district in which the lottery is to be organised.
(2) The notice shall state the kind of lottery proposed to be carried on, the purpose of the lottery, the amount, or proportion of the proceeds, intended to be devoted to the remuneration of agents, ticket-sellers and other persons employed in connection with it, and the value of the prizes.
False statements on application for licence or permit.
30.—Any person who, in support of an application for a licence or permit, makes any statement or representation (whether written or oral) which is to his knowledge false or misleading in any material respect shall be guilty of an offence and shall on summary conviction thereof be liable to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeding three months or to both such fine and imprisonment.
Hearing of application.
31.—(1) In considering an application for a licence the court shall have regard to—
(a) the character of the applicant, and
(b) the number of periodical lotteries already in operation in the locality.
(2) At the hearing, the Superintendent of the Garda Síochána and any other person who appears to the Court to be interested may appear and may adduce evidence in relation to the application.
Appeal in respect of application for licence.
32.—Without prejudice to any right of appeal given by any other Act, an appeal shall lie to the Circuit Court—
(a) by the applicant for a licence—from the order of the District Court refusing the application,
(b) by the applicant—from the part of the order of the District Court specifying the period of the licence, and
(c) by any person who at the hearing opposed the application—from the order of the District Court granting the licence or the part of the order specifying the period of the licence.
Lottery tickets.
33.—Every ticket, coupon, counterfoil and notice relating to a lottery (other than a lottery to which section 23, 24 or 25 applies) shall bear the name and address of the holder of the licence or permit, or, if the licence or permit is in the name of more than one person, of one of them, and of the printer, and of the beneficiary or object, and shall state whether it is being carried on under a licence or under a permit and the Court or Superintendent by whom the licence or permit was granted.
Prohibition on taking or sending money or documents out of State.
34.—(1) No person shall take or send or attempt to take or send out of the State any ticket, counterfoil or coupon for use in a lottery or any money for the purchase of, or any money representing the purchase-price of, a ticket or chance in a lottery or a prize won in a lottery, or any document relating to the purchase or sale of, or indicating the identity of the holder of, any such ticket or chance.
(2) This section does not apply to the export of tickets, coupons, counterfoils and other documents printed in the State for the promoters of a lottery promoted and conducted wholly outside the State.
(3) Where a lottery is promoted in accordance with a licence for a beneficiary outside the State, this section shall not prohibit the taking or sending out of the State, to a person acting on behalf of the beneficiary, of documents relating to the lottery when the prize-winners have been determined.
Exemption from Betting Acts.
35.—The holder of a licence or permit for a lottery shall not be required to hold a bookmaker's licence under the Betting Act, 1931 (No. 27 of 1931), and the Betting Act, 1853, shall not apply in relation to the use of premises in connection with the lottery.
PART V.
Enforcement, Evidence and Penalties.
Gaming and wagering contracts void.
36.—(1) Every contract by way of gaming or wagering is void.
(2) No action shall lie for the recovery of any money or thing which is alleged to be won or to have been paid upon a wager or which has been deposited to abide the event on which a wager is made.
(3) A promise, express or implied, to pay any person any money paid by him under or in respect of a contract to which this section applies or to pay any money by way of commission, fee, reward or otherwise in respect of the contract or of any services connected with the contract is void and no action shall lie for the recovery of any such money.
(4) This section does not apply to any agreement to subscribe or contribute to any plate, prize or sum of money to be awarded to the winner or winners of any game, sport or pastime not prohibited by this Act provided that the subscription or contribution is not a stake.
Seizure of gaming instruments.
37.—(1) A member of the Garda Síochána may seize any gaming instrument, being a slot-machine prohibited by section 10 or a gaming instrument having any device by means of which it can be fraudulently operated or which he has reason to believe is being fraudulently operated or used for unlawful gaming.
(2) No person shall operate or permit to be operated or be in possession or control of any gaming instrument having any such device.
Power of entry of Garda Síochána.
38.—A member of the Garda Síochána may at all reasonable times enter and have free access to any amusement hall, funfair, circus, travelling show, carnival, bazaar, sports meeting, local festival, exhibition or other like event in which gaming or a lottery is or is believed to be carried on.
Search warrant.
39.—(1) Where a Justice of the District Court is satisfied on the information on oath of a member of the Garda Síochána not below the rank of Inspector that there is reasonable ground for supposing that, at any place or premises, an offence against this Act has been, is being, or is about to be committed the Justice may issue a search warrant under this section.
(2) The search warrant shall authorise a named member of the Garda Síochána not below the rank of Inspector, accompanied by such other members of the Garda Síochána as that member thinks proper, to enter the place or premises at any time within forty-eight hours after the issue of the warrant, if need be by force, to inspect the place or premises and any books and documents found there and to take the name and address of any person, and seize any gaming instrument and any books and documents appearing to relate to gaming or lotteries found there.
Arrest of offenders.
40.—(1) A member of the Garda Síochána may arrest without warrant any person whom he finds conducting or assisting in conducting in a public place any kind of gaming which he has reason to believe to be contrary to this Act.
(2) A member of the Garda Síochána may arrest without warrant any person who, when his name and address are demanded of him under this Act, fails to give them or gives a name or address which such member has reason to believe to be false or misleading.
Obstruction of Garda Síochána.
41.—Any person who obstructs or impedes a member of the Garda Síochána in the exercise of his powers under this Act or who, on being asked his name and address by such member, fails to give them or gives a name or address which is false or misleading shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding twenty-five pounds.
Evidence of keeping place for unlawful gaming.
42.—If a member of the Garda Síochána is obstructed or impeded in entering any place or premises or any part thereof in the exercise of his powers under this Act or if any gaming instrument, being a slot machine prohibited by section 10 or a gaming instrument capable of being used for unlawful gaming, is found therein it shall be assumed until the contrary is proved that that place or premises was or were being kept for unlawful gaming.
Evidence of unlawful gaming.
43.—It shall not be necessary in support of a prosecution in relation to unlawful gaming to prove that any person found playing at any game was playing for any money, wager or stake.
Offences.
44.—A person who contravenes any provision of this Act for which a penalty is not specifically provided shall be guilty of an offence and shall on summary conviction thereof be liable to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeding three months or to both such fine and imprisonment.
Offences in relation to bodies corporate and unincorporated bodies.
45.—(1) Where an offence against this Act is committed by a body corporate or by a person purporting to act on behalf of a body corporate or an unincorporated body of persons and is proved to have been so committed with the consent or approval of, or to have been facilitated by any default on the part of, any person being, in the case of a body corporate, a director thereof, or, in the case of an unincorporated body, a member of the committee of management or other controlling authority thereof, that person shall also be guilty of the offence.
(2) Any summons or other document required to be served for the purpose or in the course of proceedings under this section on a body corporate may be served by leaving it at or sending it by registered post to the registered office of that body or, if there be no such office in the State, by leaving it at, or sending it by registered post to, the body at any place in the State at which it conducts its business.
Revocation of licences and permits.
46.—Where a person who is the holder of a gaming licence or a lottery licence or permit is convicted of an offence against this Act the Court may revoke the licence or permit.
Forfeiture of gaming instruments.
47.—(1) On a conviction for an offence against this Act the Court may order the forfeiture to the Minister of any gaming instrument used in the commission of the offence or, in case of a conviction under section 5, any gaming instrument found on the premises or at the place concerned.
(2) The Minister may deal with or dispose of as he thinks fit any thing so forfeited.
(3) The net proceeds of any thing sold by the Minister in pursuance of this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Destruction of documents.
48.—On a conviction for an offence in relation to a lottery the Court may order the destruction of any documents relating to the lottery.
Postal packets containing unlawful documents posted in the State.
49.—(1) The Minister for Posts and Telegraphs may detain any postal packet posted in the State and suspected of containing any document relating to an unlawful lottery and shall forward every postal packet so detained to a member of the Garda Síochána not below the rank of Superintendent.
(2) The member may open and examine the packet, but, in the case of an address within the State, only in the presence of the person to whom it is addressed unless, after notice in writing requiring his attendance left at or forwarded by post to the address on the packet, he fails to attend.
(3) If the member finds any such document he may detain the packet and its contents for the purpose of prosecution, and if he finds no such document he shall either deliver the packet to the person to whom it is addressed or, if he is absent, forward the packet to him by post.
(4) This section shall be construed as one with the Post Office Acts, 1908 to 1951.
Records, accounts and returns.
50.—(1) The Commissioner of the Garda Síochána, with the consent of the Minister, may make regulations providing for the keeping of accounts and other records in relation to lotteries and the furnishing of returns and information relating thereto.
(2) Every person on whom a duty is imposed by any such regulation shall comply with its provisions.
Exemption of Hospitals' Sweepstakes.
51.—This Act does not apply to a sweepstake under the Public Hospitals Acts, 1933 to 1940.
SCHEDULE.
PART I.
Enactments Repealed in Whole.
