Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Tionnscail agus Tráchtála;
cialluíonn an abairt “an Bord” Bord na Móna, Teoranta;
cialluíonn an focal “orduithe” orduithe le rialacháin a dhéanfaidh an tAire fén Acht so;
cialluíonn an focal “cigire” oifigeach don Aire ar n-a cheapadh (go generálta no chun críche áirithe) i scríbhinn ag an Aire chun bheith ina chigire chun críche an Achta so no chun aon chríche áirithe den Acht so;
foluíonn an focal “móin” brícíní bheidh déanta ar fad no nach mór ar fad de mhóin, ach ní fholuíonn sé easair chaonaigh mhóna;

cialluíonn an abairt “dóghadh chun crícheanna tighis” dóghadh chun gach críche no aon chríche acu so leanas, sé sin le rá:—
(a) an t-iomlán no aon chuid d'aon fhoirgint no d'aon áit eile do théigheadh a húsáidtear mar thigh chomhnuithe do dhaoine, no mar stábla d'aon tsaghas ainmhí, no mar áit ina ndeineann daoine aon tsaghas oibre, no thaithíonn daoine chun críche ar bith, no
(b) biadh do bhruith, pe'ca do dhaoine no d'ainmhithe é, no
(c) uisce do théigheadh chun aon chríche seachas gal do gheiniúint in inneall gaile.
Soláthraithe ceaduithe chun crícheanna an Achta so.
2.—(1) Chun crícheanna an Achta so beidh gach duine acu so leanas ina sholáthraí cheaduithe maidir le mion-díoltóirí guail d'fháil mhóna, sé sin le rá:—
(a) an Bord;
(b) comhar-chumann a bheidh údaruithe de thurus na huaire ag an mBord chun móin do sholáthar do mhiondíoltóirí guail chun crícheanna na bhforálacha den Acht so bhaineann le móin do cheannach go héigeanta ach ní bheidh ina sholáthraí amhlaidh ach chó fada le méid agus laistigh de theoranta an údaráis sin;
(c) maidir le brícíní móna agus leo san amháin, cuideachta theoranta bheidh ceaduithe chuige seo de thurus na huaire ag an Aire.
(2) San Acht so cialluíonn an abairt “soláthraí ceaduithe” duine is soláthraí ceaduithe de bhuadh an ailt seo, de thurus na huaire, chun crícheanna an Achta so.
Ait ghnótha mhion-díoltóra ghuail.
3.—(1) Chun críche an Achta so tuigfear mion-díoltóir guail do bheith ag déanamh a ghnótha mar mhion-díoltóir guail in aon áit áirithe inar gnáth leis orduithe d'fháil no connartha do dhéanamh chun gual do dhíol agus do sheachadadh (láithreach no tráth éigin ar ball) ina mhion-choda, ach ní tuigfear, chun críche an Achta so, mion-díoltóir guail do bheith ag déanamh an ghnótha san aige in aon áit eile bheidh á úsáid aige chun crícheanna an ghnótha san aige.
(2) Mion-díoltóir guail ná díolann gual ach tré mhangaireacht i mbealaigh phuiblí agus ná fuil aon áit áirithe aige ina ndíolann sé gual de ghnáth tuigfear, chun crícheanna an Achta so, a ghnó mar mhion-díoltóir guail do bheith á dhéanamh aige san áit ina bhfuil comhnaí air.
Líomatáistí ceaptha.
4.—(1) Pé uair agus chó minic agus is dóich leis san do bheith ceart féadfaidh an tAire, le hordú (dá ngairmtear ordú um líomatáiste cheaptha san Acht so), á dhearbhú go mbeidh líomatáiste áirithe a luadhfar no go luadhfar a theoranta san ordú san ina líomatáiste cheaptha chun crícheanna an Achta so ar dháta agus o dháta (nach luatha ná mí tar éis dáta an orduithe sin) a luadhfar san ordú san.
(2) Féadfaidh an tAire tráth ar bith mar is rogha leis, le hordú, ordú um líomatáiste cheaptha do cheiliúradh no do leasú agus, go sonnrách, féadfaidh, le haon ordú leasúcháin den tsórt san, atharú do dhéanamh (tré chur leis no tré bhaint uaidh no tré chur leis agus baint uaidh) go n-éifeacht ar lá agus o lá áirithe, nách luatha ná mí tar éis dáta an orduithe leasúcháin sin, ar an líomatáiste is líomatáiste ceaptha de bhuadh orduithe um líomatáiste cheaptha.
(3) San Acht so cialluíonn an abairt “líomatáiste ceaptha” líomatáiste is líomatáiste ceaptha de thurus na huaire de bhuadh orduithe um líomatáiste cheaptha.
Ordú um líomatáiste cheaptha do chur ar fiunraoi.
5.—(1) Pé uair agus chó minic agus is dóich leis san do bheith ceart féadfaidh an tAire, le hordú (dá ngairmtear ordú fiunraíochta san Acht so), aon ordú um líomatáiste cheaptha do chur ar fiunraoi ar dháta agus o dháta (nach luatha ná dáta an orduithe sin) a luadhfar san ordú san.
(2) Pé uair a bheidh an tAire tar éis ordú fiunraíochta do dhéanamh féadfaidh mar is rogha leis, le hordú (dá ngairmtear ordú cealúcháin san alt so), an cur ar fiunraoi deintear leis an ordú fiunraíochta san ar an ordú um líomatáiste cheaptha le n-a mbaineann an t-ordú fiunraíochta san do chealú ar dháta agus o dháta (nach luatha ná dáta an orduithe chealúcháin sin) a luadhfar san ordú chealúcháin sin.
(3) Pé uair a bheidh an tAire tar éis ordú fiunraíochta do dhéanamh beidh an tordú um líomatáiste cheaptha le n-a mbaineann an t-ordú fiunraíochta san ar fiunraoi ar an dáta agus ón dáta luadhfar chuige sin san ordú fiunraíochta san agus leanfaidh de bheith ar fiunraoi amhlaidh go dtí an dáta gur air agus uaidh a cealófar an fhiunraíocht san le hordú cealúcháin.
(4) Pé uair a cuirfear ordú um líomatáiste cheaptha ar fiunraoi fén alt so, scuirfidh an líomatáiste ceaptha le na mbainfidh an t-ordú san de bheith ina líomatáiste cheaptha chun crícheanna an Achta so díreach i dtosach feidhme na fiunraíochta san, ach tiocfaidh chun bheith agus beidh arís ina líomatáiste cheaptha chun na gcrícheanna san ar an dáta gur air agus uaidh a cealófar an t-ordú fiunraíochta san.
(5) Pé uair a cuirfear ordú um líomatáiste cheaptha ar fiunraoi fén alt so déanfaidh an tAire, le linn na fiunraíochta san, an clár de mhion-díoltóirí guail a bunófar do réir an Achta so alos an líomatáiste cheaptha le n-a mbaineann an t-ordú san do choinneáil ar bun agus do choimeád do réir an Achta so ach ní chuirfidh éinní sa bhfo-alt so d'oblagáid ar dhuine ar bith é bheith cláruithe sa chlár san le linn na fiunraíochta san.
Forálacha de bhíthin líomatáiste ceaptha do scur de bheith ina líomatáiste cheaptha.
6.—Pé uair a scuirfidh líomatáiste ceaptha no cuid de líomatáiste cheaptha, de bhuadh orduithe fén Acht so ag ceiliúradh no ag leasú orduithe um líomatáiste cheaptha no de bhuadh orduithe fhiunraíochta, de bheith ina líomatáiste cheaptha no ina cuid de líomatáiste cheaptha (do réir mar bheidh) beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) ní dhéanfaidh an scur san deifir—
(i) d'oibriú an Achta so roimhe sin sa líomatáiste cheaptha sin no sa chuid sin de líomatáiste cheaptha (do réir mar bheidh) ná d'éinní do rinneadh no do fulaingeadh fén Acht so sa líomatáiste sin no sa chuid sin; ná
(ii) d'aon cheart, príbhléid, oblagáid no freagarthacht do fuarthas no d'fhás no fé n-a ndeachthas fén Acht so sa líomatáiste cheaptha sin no sa chuid sin de líomatáiste cheaptha (do réir mar bheidh); ná
(iii) d'aon phionós, geallbhruid, no peannaid fé n-a ndeachthas fén Acht so; ná
(iv) d'aon fhiosrúchán, imeacht dlí no leigheas alos aon chirt, príbhléide, oblagáide, pionóis, geallbhruide no peannaide den tsórt san roimhráite; agus
(b) aon chionta fé aon alt den Acht so do rinneadh roimh an scur san féadfar é d'fhiosrú, do chúiseamh, do thriail agus do phionósú tar éis an scurtha san agus dá ainneoin fé is dá mba ná tárlódh an scur san.
Cláir de mhiondíoltóiri guail.
7.—(1) Pé uair a dhéanfaidh an tAire ordú um líomatáiste cheaptha bunóidh sé láithreach agus coinneoidh ar bun agus coimeádfaidh ina dhiaidh sin clár de dhaoine a bheidh ag déanamh gnótha mar mhion-díoltóirí guail sa líomatáiste a dearbhófar leis an ordú san do bheith ina líomatáiste cheaptha.
(2) I ngach clár a bheidh á choinneáil ar bun do réir an ailt seo iontrálfar, alos gach duine clárófar sa chlár san, na mion-innste seo leanas, sé sin le rá:—
(a) ainm agus sloinneadh agus tuairisc iomlán an duine sin; agus
(b) tuairisc (is leor chun an áitreibh agus chun suidheamh agus teoranta an chéanna d'aithint) ar an áitreabh no ar gach áitreabh de sna háitreabhacha ar leithligh (do réir mar bheidh) ina mbíonn díol guail ina mhion-choda ar siúl ag an duine sin sa líomatáiste cheaptha le n-a mbaineann an clár san.
Iarrataisí ar chlárú agus ceart chun cláruithe i gclár.
8.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so beidh gach duine go mbíonn díol guail ina mhion-choda ar siúl aige no go mbeidh beartuithe aige san do bheith ar siúl aige i líomatáiste cheaptha beidh sé i dteideal, ar iarratas do dhéanamh sa bhfuirm agus sa tslí orduithe agus ar an táille orduithe d'íoc, é do chlárú sa chlár alos an áitreibh sa líomatáiste cheaptha sin ina ndeineann sé an gnó san no ina mbeidh beartuithe aige an gnó san a dhéanamh.
(2) Má dheineann duine go mbeidh beartuithe aige gnó do dhéanamh mar mhion-díoltóir guail sa líomatáiste cheaptha le n-a mbaineann clár áirithe iarratas ar chlárú sa chlár san ní thiocfaidh clárú an duine sin, do réir an iarratais sin, in éifeacht go dtí go dtosnóidh an duine sin ar an ngnó san do dhéanamh.
(3) Féadfar iarratas ar chlárú i gclár do dhéanamh tráth ar bith tar éis dáta an orduithe um líomatáiste cheaptha bhaineann leis an gcás, pe'ca roimh an lá ar a raghaidh an dearbhú déanfar leis an ordú san ag dearbhú líomatáiste cheaptha in éifeacht no dá éis sin é, agus dá réir sin foluíonn an abairt “líomatáiste ceaptha” sna fo-ailt sin roimhe seo den alt so líomatáiste bheidh dearbhuithe le hordú um líomatáiste cheaptha do bheith ina líomatáiste cheaptha ar dháta ina dhiaidh sin agus ón dáta san amach.
(4) In ainneoin éinní atá sna fo-ailt sin roimhe seo den alt so féadfaidh an tAire, mar is rogha leis féin, diúltú d'iarratas o dhuine ar bith ar chlárú i gclár más rud é go raibh an duine sin, roimh an iarratas san, cláruithe so chlár san no in aon chlár eile agus go ndearnadh an clárú san roimhe sin do chealú.
Cláir do leasú.
9.—(1) Féadfaidh an tAire tráth ar bith, uaidh féin, clár do leasú tré aon earráid shoiléir a bheidh ann do cheartú.
(2) Déanfaidh an tAire, ar n-a iarraidh sin air do dhuine ar bith bheidh cláruithe i gclár, an clár san do leasú tré cheartú do dhéanamh ar aon earráid sa tuairisc sa chlár san ar an duine sin no ar an áitreabh no aon cheann de sna háitreabhacha gur ina thaobh no ina dtaobh a bheidh sé cláruithe amhlaidh, no tré iontráil do dhéanamh sa chlár san ar atharú in únaeracht an ghnótha gur ina thaobh a bheidh an duine sin cláruithe amhlaidh no ar atharú (pe'ca tré chur leis, laigheadú, no aistriú iomlán é) san áitreabh no in aon cheann de sna háitreabhacha ina mbeidh an gnó san á dhéanamh.
(3) I gcás duine bheidh cláruithe i gclár d'éag déanfaidh an tAire, ar n-a iarraidh sin air d'ionadaí phearsanta an duine sin, an clár san do leasú tríd an éag san d'iontráil ann agus an t-ionadaí pearsanta san d'iontráil ann mar dhuine chláruithe in ionad an duine d'éag amhlaidh.
Clárú do chealú.
10.—(1) Féadfaidh an tAire tráth ar bith, clárú dhuine ar bith i gclár do chealú, ar n-a iarraidh sin i scríbhinn don duine sin no, i gcás pearsan, dá ionadaí phearsanta no, i gcás cóluchta chorpruithe, do shocruitheoir an chóluchta chorpruithe sin.
(2) Féadfaidh an tAire tráth ar bith, gan aon iarratas den tsórt san roimhráite, clárú dhuine ar bith i gclár do chealú más deimhin leis—
(a) gur tré chalaois no tré cham-thuairisc (pe'ca neamhurchóideach no calaoiseach di) do fuarthas an clárú san; no
(b) gur scuir an gnó gur ina thaobh a cláruíodh an duine sin amhlaidh de bheith á dhéanamh; no
(c) gur thárla don duine sin, más pearsa é, é d'éag no, más cólucht corpruithe é, é do scur, agus ná dearnadh i gceachtar cás, laistigh de thrí mhí tar éis an éaga no an scurtha san, duine ar bith eile do chlárú in ionad an duine d'éag no do scuir amhlaidh; no
(d) gur tugadh de bhreith ar an duine sin gur duine gnóbhriste é; no
(e) gur ciontuíodh an duine sin i sárú (pe'ca tré ghníomh no tré fhaillí é) ar an Acht so no ar rialachán ar n-a dhéanamh fé.
(3) Sara ndeinidh an tAire cealú fén alt so (ar shlí seachas do réir iarratais chuige sin fén alt so) ar chlárú dhuine ar bith i gclár bhéarfaidh fógra mí ar a laighead i scríbhinn don duine sin no dá ionadaí pearsanta (más ann do) no dá shocruitheoir (do réir mar bheidh) á rá go bhfuil sé ar intinn an clárú san do chealú amhlaidh agus cadiad na fáthanna atá aige leis sin, agus breithneoidh aon chúiseanna dhéanfaidh an duine cláruithe no an t-ionadaí pearsanta no an socruitheoir sin (do réir mar bheidh) a phlé leis laistigh de sheacht lá tar éis an fhógra san do sheirbheáil.
(4) Féadfar fógra i dtaobh an Aire do bheith ar intinn clárú do chealú do sheirbheáil tré n-a sheachadadh don té dá mbeidh sé dírithe no tré n-a chur tríd an bpost chun an duine sin ag an áit chomhnuithe is déanaí is eol do bheith aige no ag an áit is déanaí is eol an gnó gur ina thaobh a bheidh beartuithe an clárú do chealú do bheith á dhéanamh aige.
Deimhnithe clárathachta do thabhairt amach agus do thaisbeáint.
11.—(1) Pé uair a chláróidh an tAire duine i gclár bhéarfaidh an tAire amach láithreach don duine sin deimhniú sa bhfuirm orduithe i dtaobh an chláruithe sin agus, i gcás an duine sin do bheith cláruithe amhlaidh alos dhá áitreabh no níos mó ar leithligh, bhéarfaidh amach amhlaidh don duine sin deimhniú ar leithligh den tsórt san alos gach áitreibh ar leithligh acu san.
(2) Gach duine dá dtabharfaidh an tAire deimhniú clárathachta amach fén alt so cuirfe sé fé ndeár an deimhniú san do bheith ar taisbeáint go feiceálach le linn uaireanna gnótha san áitreabh le n-a mbaineann an deimhniú san.
(3) Gach mion-díoltóir guail go dteipfidh air déanamh do réir forálacha an fho-ailt deiridh sin roimhe seo den alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Toirmeasc ar dhaoine neachláruithe gual do dhíol ina mhion-choda.
12.—(1) Ní bheidh sé dleathach do dhuine ar bith gual do dhíol ina mhion-choda i líomatáiste cheaptha mara mbeidh sé cláruithe sa chlár a bheidh á choimeád do réir an Achta so alos an líomatáiste cheaptha sin.
(2) Ní bheidh sé dleathach do dhuine ar bith gnó do bheith ar siúl aige, i líomatáiste cheaptha, ag díol guail ina mhion-choda in aon áitreabh no áit sa líomatáiste cheaptha sin seachas áitreabh gur ina thaobh a bheidh sé cláruithe sa chlár a bheidh á choimeád do réir an Achta so alos an líomatáiste cheaptha sin.
(3) Gach duine dhíolfaidh gual ina mhion-choda contrárdha don alt so beidh sé ciontach i gcionta fén alt so, agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga púnt do chur air no, más rogha leis an gCúirt é, príosúntacht ar feadh aon téarma nách sia ná trí mhí, no an fhíneáil sin agus an phríosúntacht san le chéile.
Toirmeasc ar ghual do cheannach o mhion-díoltóir guail neachláruithe.
13.—(1) Ní bheidh sé dleathach do dhuine ar bith aon ghual do cheannach, i líomatáiste cheaptha, o mhion-díoltóir guail a bheidh ag díol guail ina mhion-choda sa líomatáiste cheaptha sin mara mbeidh an mion-díoltóir guail sin cláruithe sa chlár a bheidh á choimeád do réir an Achta so alos an líomatáiste cheaptha sin.
(2) Gach duine cheannóidh aon ghual contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar púnt do chur air in aghaidh gach tonna no coda de thonna guail a cheannóidh sé amhlaidh.
E bheith éigeanta móin do cheannach.
14.—(1) Pé uair a dhéanfaidh mion-díoltóir guail níos mó ná dhá chéadmeáchaint ghuail do dhíol le ceannuitheoir agus do sheachadadh do cheannuitheoir (pe'ca i líomatáiste cheaptha é no nach cadh) chun a dhóighte chun crícheanna tighis i líomatáiste cheaptha agus ná beidh an ceannuitheoir sin i dteideal tairbhe saoirse fén Acht so alos an díola agus an tseachadtha san déanfaidh an miondíoltóir guail sin freisin, le linn an díola agus an tseachadtha san, an chaindíocht orduithe de mhóin (ar n-a fáil o sholáthraí cheaduithe) is oiriúnach do chaindíocht an ghuail a díolfar agus a seachadfar amhlaidh agus don-líomatáiste cheaptha gur chun é dhóghadh ann a díolfar agus a seachadfar an gual san amhlaidh, déanfa sé san do dhíol leis an gceannuitheoir sin agus do sheachadadh dho agus déanfaidh an ceannuitheoir sin, le linn an ama san, an céanna do cheannach agus do thógaint ón mion-díoltóir guail sin.
(2) Pé uair, ar mhion-díoltóir guail do dhíol guail le ceannuitheoir agus dá sheachadadh dhó, a theipfidh ar an mion-díoltóir guail sin an chaindíocht de mhóin (ar n-a fáil o sholáthraí cheaduithe) a luaidhtear sa bhfo-alt san roimhe seo den alt so do dhíol leis an gceannuitheoir sin agus do sheachadadh dhó le linn an ghuail sin do dhíol agus do sheachadadh agus is sárú ar an bhfo-alt san roimhe seo an teip sin, beidh an mion-díoltóir guail sin ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar púnt do chur air in aghaidh gach tonna no coda de thonna guail a díolfar agus a seachadfar amhlaidh.
(3) Pé uair, ar mhion-díoltóir guail do dhíol guail le ceannuitheoir agus dá sheachadadh dhó, a theipfidh ar an gceannuitheoir sin an chaindíocht de mhóin a luaidhtear sa chéad fho-alt den alt so do cheannach agus do thógaint ón mion-díoltóir guail sin le linn an ghuail sin do dhíol agus do sheachadadh agus is sárú ar an gcéad fho-alt san an teip sin, beidh an ceannuitheoir sin ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar púnt do chur air in aghaidh gach tonna no coda de thonna guail a díolfar agus a seachadfar amhlaidh.
(4) San Act so gairmtear den alt so na forálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, agus féadfar tagairt don alt so sa tslí chéanna in aon ordú, rialachán, saoirse no ionstruim eile déanfar fén Acht so.
Rialacháin ag ordú na caindíochta orduithe de mhóin.
15.—Pé uair a dhéanfaidh an tAire, le rialacháin ar n-a ndéanamh fén Acht so, a ordú cadé an chaindíocht de mhóin a dhíolfaidh mion-díoltóir guail le ceannuitheoir agus a sheachadfaidh dó agus a cheannóidh agus a thógfaidh an ceannuitheoir sin ón mion-díoltóir guail sin do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, féadfaidh an tAire rialacháin deifriúla ar leith den tsórt san do dhéanamh alos líomatáistí deifriúla ceaptha agus féadfaidh, le haon rialacháin den tsórt san, caindíochtaí deifriúla de mhóin d'ordú alos líomatáistí ceaptha deifriúla no alos codanna deifriúla den líomatáiste cheaptha chéanna agus féadfaidh, le haon rialacháin den tsórt san, aon chaindíocht den tsórt san de mhóin do cheapadh do réir gach ní no éinní acu so leanas, sé sin le rá, an tráth den bhliain a díolfar an gual san amhlaidh, an chaindíocht de ghual a bheidh in aon díol ar leithligh, an praghas ar a ndíolfar an gual san amhlaidh, agus an áit ina seachadfar an gual san.
E bheith d'oblagáid móin do chur ar fáil do gheobhfar o sholáthraí cheaduithe.
16.—(1) An mhóin uile dhíolfaidh agus a sheachadfaidh miondíoltóir guail do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, sé bheidh inti ná móin do gheobhaidh an mion-díoltóir guail sin o sholáthraí cheaduithe, agus má dheineann mion-díoltóir guail móin do gheobhfar o dhuine nách soláthraí ceaduithe de thurus na huaire do dhíol agus do sheachadadh ní bheidh san ina dhíol ná ina sheachadadh, ná ní háirmheofar é mar dhíol ná mar sheachadadh, do réir na bhforálacha san den Acht so.
(2) Gach mion-díoltóir guail a dhéanfaidh, ag dúmas déanamh do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, aon mhóin do dhíol le ceannuitheoir agus do sheachadadh dhó, nach móin do fuair an mion-díoltóir guail sin o sholáthraí cheaduithe, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar suim púint do chur air in aghaidh gach tonna no coda de thonna móna díolfar agus a seachadfar amhlaidh.
(3) Gach duine dhéanfaidh, ag dúmas déanamh do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, aon mhóin do cheannach agus do thógaint o mhiondíoltóir guail agus a fhios ag an duine sin nach móin í do fuair an mion-díoltóir guail sin o sholáthraí cheaduithe, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar púnt do chur air in aghaidh gach tonna no coda de thonna móna ceannófar agus a tógfar amhlaidh.
(4) Ní oibreoidh éinní san alt so chun aon oblagáid a chur ar dhuine cheannóidh móin o mhion-díoltóir guail do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach fiosrú do dhéanamh maidir leis an soláthraí o n-a bhfuair an mion-díoltóir guail sin an mhóin sin ná ní oibreoidh sé chun fógra iontuigthe no eile i dtaobh an tsoláthraí sin do chur i leith an cheannuitheora san.
Comhacht chun a chur fhiachaint ar mhiondíoltóir guail móin d'fháil.
17.—(1) Pé uair a bheidh an chaindíocht de mhóin do gheobhaidh mion-díoltóir guail o sholáthraithe ceaduithe i rith aon tréimhse áirithe nách giorra ná dhá mhí, maraon leis an gcaindíocht (más ann di) de mhóin do fuarthas o sholáthraithe ceaduithe agus a bhí i seilbh an mhion-díoltóra ghuail sin i dtosach na tréimhse sin, níos lugha ná an chaindíocht de mhóin do dhíol agus do sheachaid an mion-díoltóir guail sin no ba cheart dó a dhíol agus a sheachadadh, do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, i rith na tréimhse sin, féadfaidh an tAire fógra i scríbhinn do sheirbheáil ar an mion-díoltóir guail sin—
(a) ina luadhfar—
(i) an tréimhse áirithe roimhráite le n-a mbaineann an fógra san, agus
(ii) an chaindíocht de mhóin do fuair an mion-díoltóir guail sin mar adubhradh, agus
(iii) an chaindíocht (más ann di) de mhóin do bhí i seilbh an mhion-díoltóra ghuail sin, mar adubhradh, agus
(iv) an chaindíocht de mhóin do dhíol agus do sheachaid an mion-díoltoir guail sin, no ba cheart dó a dhíol agus a sheachadadh, mar adubhradh, agus
(b) á cheangal ar an mion-díoltóir guail sin caindíocht áirithe de mhóin d'fháil laistigh d'am áirithe (nách giorra ná ceithre lá déag o dháta an fhógra san do sheirbheáil) o sholáthraí no o sholáthraithe éigin ceaduithe, caindíocht ná raghaidh thar an méid a bheidh an chaindíocht de mhóin do fuair an miondíoltóir guail sin, mar adubhradh, maraon leis an gcaindíocht (más aon chaindíocht é) de mhóin a bhí i seilbh an mhion-díoltóra ghuail sin mar adubhradh, fé bhun na caindíochta de mhóin do dhíol agus do sheachaid an mion-díoltóir guail sin no ba cheart do a dhíol agus a sheachadadh, mar adubhradh, agus
(c) á cheangal ar an mion-díoltóir guail sin, laistigh de dhá lá tar éis déanamh do réir na n-éilithe sin roimhe seo den fhógra san, ráiteas do chur chun an Aire, sa tslí luadhfar sa bhfógra san, á rá cadé an chaindíocht no cadiad na caindíochtaí uile agus fé seach de mhóin do fuair an mion-díoltóir guail sin do réir an fhógra san agus cé hé an soláthraí o n-a bhfuarthas agus cadé an dáta ar a bhfuarthas an chaindíocht san no gach caindíocht fé leith den tsórt san de mhóin.
(2) Gach mion-díoltóir guail ar a seirbheálfar fógra fén alt so déanfaidh, laistigh den am a bheidh luaidhte chuige sin sa bhfógra san, an chaindíocht de mhóin a bheidh luaidhte chuige sin sa bhfógra san d'fháil o sholáthraí no o sholáthraithe éigin ceaduithe, agus má theipeann ar an mion-díoltóir guail sin an chaindíocht san do mhóin d'fhail amhlaidh beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar púnt do chur air in aghaidh gach tonna no coda de thonna móna do ceangladh air leis an bhfógra san d'fháil amhlaidh no, má bhíonn sé tar éis cuid den chaindíocht de mhóin d'fháil go cuibhe do ceangladh air amhlaidh d'fháil, fíneáil ná raghaidh thar púnt in aghaidh gach tonna no coda de thonna a bheidh an chuid sin den chaindíocht san de mhóin fé bhun méid iomlán na caindíochta san de mhóin.
(3) Gach mion-díoltóir guail ar a seirbheálfar fógra fén alt so cuirfidh chun an Aire do réir an fhógra san ar gach slí, laistigh den am a bheidh luaidhte chuige sin sa bhfógra san, an ráiteas san a ceanglófar air leis an bhfógra san a chur chun an Aire amhlaidh agus má theipeann air an ráiteas san do chur chun an Aire amhlaidh beidh sé ciontach i gcionta fén bhfo-alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint do chur air.
(4) Beidh éifeacht ag na forálacha so leanas maidir le miondíoltóir guail do chúiseamh i gcionta fé fho-alt ar bith den alt so, sé sin le rá:—
(a) an fógra fén alt so gur ina thaobh adeirtear do rinneadh an cionta san beidh sé ina fhianaise, go dtí go gcruthófar a mhalairt, i dtaobh na réad uile agus fé seach a bheidh luaidhte sa bhfógra san alos na gcaindíochtaí de mhóin do fuair an mion-díoltóir guail sin, no do bhí ar seilbh aige, no do dhíol agus do sheachaid sé no ba cheart do a dhíol agus a sheachadadh;
(b) ní dhéanfaidh earráid sa ráiteas i dtaobh gach ceann no aon cheann de sna réada san sa bhfógra san an fógra san nea-dhleathach maran mó an chaindíocht de mhóin a ceanglófar ar an mion-díoltóir guail sin leis an bhfógra san d'fháil ná an chaindíocht de mhóin a féadfaí go dleathach a cheangal air amhlaidh d'fháil dá mbeadh gach réad acu san luaidhte i gceart sa bhfógra san;
(c) féadfaidh an Chúirt, más dóich léi san do bheith ceart, ar n-a iarraidh sin don chúisitheoir no don mhiondíoltóir guail sin, leasú do dhéanamh ar an ráiteas sa bhfógra san i dtaobh aon cheann de sna réada san no i dtaobh na caindíochta de mhóin a ceangaltar ar an mion-díoltóir guail sin leis an bhfógra san d'fháil agus, má leasuíonn an Chúirt an fógra san amhlaidh, beidh éifeacht ag an bhfógra san agus tuigfear éifeacht do bheith riamh aige, chun gach críche, mar a leasófar é amhlaidh;
(d) gach breacachán a bheidh á choimeád ag an miondíoltóir guail sin do réir an Achta so beidh sé ionghlactha ina fhianaise ar iarratas an chúisitheora no an mhion-díoltóra ghuail sin, agus féadfaidh an Chuirt, más ceart san dar léi ar n-a iarraidh sin don chúisitheoir, a chur fhiachaint ar an mion-díoltóir guail sin aon bhreacachán den tsort san do thabhairt i láthair agus fós gach billín, nóta consighneachta, admháil agus scríbhinn eile (ar a n-áirmhítear cóipeanna dhíobh i gcás ná beid féin ar fáil) a bheidh i seilbh an mhiondíoltóra ghuail sin agus is gá, dar leis an gCúirt, chun féachaint an fíor aon iontráil áirithe sa bhreacachán san no chun a chruthú no a mhíniú cad fé ndeár éinní áirithe d'fhágaint amach as;
(e) gach tuairisceán a bhéarfaidh an mion-díoltóir guail sin don Aire do réir an Achta so beidh sé ionghlactha ina fhianaise ar iarratas an chúisitheora no an mhiondíoltóra ghuail sin agus féadfaidh an Chúirt, más ceart san dar léi ar n-a iarraidh sin don mhion-díoltóir ghuail sin, a chur fhiachaint ar an Aire aon tuairisceán den tsórt san do thabhairt i láthair.
Saoirse o n-a bheith éigeanta móin do cheannach.
18.—(1) Féadfaidh an tAire, más dóich leis agus pé uair is dóich leis é bheith ceart san do dhéanamh, saoirse o sna forálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach do dheonadh do dhuine ar bith.
(2) Gach saoirse deonfar fén alt so—
(a) beidh sí sa bhfuirm orduithe, agus
(b) féadfar í dheonadh in aghaidh tréimhse teoranta no gan aon teora ama, agus
(c) féadfar í dheonadh fé réir pé teoranta (más aon cheann é) (a luadhfar sa tsaoirse sin) is dóich leis an Aire is ceart maidir leis an ngual le n-a mbaineann an tsaoirse, pe'ca alos caindíochta no cáilíochta an ghuail sin é no alos áite a cheannuithe no áite no críche a úsáidthe no alos éinní eile bhaineann leis an ngual san, agus
(d) déarfaidh agus déanfaidh an duine dá ndeonfar í d'fhuascailt o n-a bheith air déanamh do réir na bhforálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach i rith na tréimhse luadhfar chuige sin sa tsaoirse no, i gcás gan aon tréimhse den tsórt san do luadh amhlaidh, gan teora ama, ach san fé réir pé teoranta (más aon cheann é) a húdaruítear leis an bhfo-alt so agus a luadhfar sa tsaoirse.
(3) Féadfaidh an tAire, mar is rogha leis féin, saoirse deonfar fén alt so do cheiliúradh tráth ar bith.
Saoirse alos móna ceannófar on mBord.
19.—(1) Pé uair a cheannóidh duine caindíocht áirithe de mhóin o sholáthraí cheaduithe agus is deimhin leis an mBord no leis an gcumann no leis an gcuideachtain, gurb é an soláthraí ceaduithe sin é, go bhfuil an mhóin sin á ceannach chun an duine sin á dóghadh chun crícheanna tighis i líomatáiste cheaptha áirithe, déanfaidh an Bord no an cumann no an chuideachta san (do réir mar bheidh), má cheanglann an duine sin ortha é, deimhniú bheidh contra-shighnithe ag oifigeach don Aire do thabhairt don duine sin á dheimhniú gur cheannuigh an duine sin an chaindíocht san de mhóin ón soláthraí cheaduithe sin chun an duine sin á dóghadh chun crícheanna tighis sa líomatáiste cheaptha sin.
(2) Pé uair a dhéanfaidh duine, ag á mbeidh deimhniú neachaithte do thug an Bord no cumann no cuideachta is soláthraí ceaduithe amach dó fén alt so, gual do cheannach o mhion-díoltóir guail chun a dóighte chun crícheanna tighis sa líomatáiste cheaptha bheidh luaidhte sa deimhniú san agus a bheidh ag na forálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach feidhm maidir leis an gceannach guail sin tuigfear an ceannach móna o sholáthraí cheaduithe is abhar don deimhniú san do bheith ina chólíonadh ar na forálacha san den Acht so, sa mhéid go mbaineann an céanna leis an gceannach guail sin, ach ní hi méid is mó ná an chaindíocht de mhóin gur ina taobh a bheidh éifeacht ag an deimhniú san tráth an cheannaigh ghuail sin.
(3) Pé uair a cheannóidh duine ar bith gual o mhion-díoltóir guail agus a dhéanfaidh an duine sin deimhniú do tugadh amach fén alt so d'úsáid mar chólíonadh, alos an cheannaigh ghuail sin, ar na forálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, cúlscríobhfaidh an mion-díoltóir guail sin ar an deimhniú san na mion-innste orduithe i dtaobh an cheannaigh ghuail sin, ar a n-áirmhítear an chaindíocht de mhóin ba ghá, do réir na bhforálacha san den Acht so, don duine sin do cheannach alos an cheannaigh ghuail sin mara mbeadh an deimhniú san.
(4) Ní dhéanfaidh deimhniú do bhéarfar amach fén alt so an duine dá dtabharfar amach é d'fhuascailt o n-a bheith air déanamh do réir na bhorálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach mara ndeintear go cuibhe an chúlscríbhinn a luaidhtear sa bhfo-alt deiridh sin roimhe seo den alt so do chur ar an deimhniú san ar gach ócáid a húsáidfear é mar chólíonadh ar na forálacha san den Acht so.
(5) Chun crícheanna an ailt seo—
(a) tuigfear deimhniú do bhéarfar amach fén alt so do bheith nea-chaithte faid ná raghaidh an chaindíocht iomlán de mhóin, a bheidh luaidhte sna cúlscríbhinní déanfar ar an deimhniú san do réir an ailt seo, thar an gcaindíocht de mhóin a deimhneofar leis an deimhniú san a bheith ceannuithe o sholáthraí cheaduithe, agus
(b) tuigfear deimhniú do bhéarfar amach fén alt so do bheith éifeachtach aon tráth áirithe alos na caindíochta de mhóin a bheidh de bhreis ag an gcaindíocht de mhóin a bheidh deimhnithe leis an deimhniú san a bheith ceannuithe o sholáthraí cheaduithe ar an gcaindíocht iomláin de mhóin a bheidh luaidhte sna cúlscríbhinní bheidh déanta ar an deimhniú san do réir an ailt seo.
Baint an Achta so le caindíochtaí guail de dhá chéadmeáchaint no níos lugha do dhíol.
20.—I gcás duine (dá ngairmtear fo-mhion-díoltóir san alt so) do cheannach guail o dhuine eile (dá ngairmtear ceannaí san alt so) agus do mhion-díol an ghuail sin ina chaindíochtaí nach mó ná dhá chéadmeáchaint (pe'ca íocfaidh an fo-mhion-díoltóir sin leis an gceannaí sin an praghas mion-díola iomlán ar an ngual san no ná híocfaidh agus pe'ca dhéanfaidh an fo-mhion-díoltóir sin freisin an gual san do dhíol ina chaindíochtaí is mó ná dhá chéadmeáchaint no ná déanfaidh), beidh éifeacht ag na forálacha so leanas maidir leis an ngual uile cheannóidh an fo-mhion-díoltóir sin ón gceannaí sin agus a mhion-díolfaidh an fo-mhion-díoltóir sin ina chaindíochta nach mó ná dhá chéadmeáchaint chun a dhóighte chun crícheanna tighis i líomatáiste cheaptha, sé sin le rá:—
(a) tuigfear, chun crícheanna an Achta so, an fo-mhiondíoltóir sin do cheannach an ghuail sin ón gceannaí sin chun a dhóighte chun crícheanna tighis i líomatáiste cheaptha, agus
(b) tuigfear, chun crícheanna an Achta so, an ceannaí sin do mhion-díol an ghuail sin leis an bhfo-mhion-díoltóir sin chun a dhóighte chun crícheanna tighis i líomatáiste cheaptha, agus
(c) bainfidh an tAcht so agus, go sonnrách, na forálacha den Acht so i dtaobh é bheith éigeanta móin do cheannach, leis an bhfo-mhion-díoltóir sin agus leis an gceannaí sin dá réir sin.
Comhacht don Aire chun talamh do cheannach don Bhord o Choimisiún Talmhan na hÉireann.
21.—(1) Féadfaidh an tAire, más dóich leis agus pé uair is dóich leis san do bheith ceart ar mholadh an Bhúird, aon talamh do cheannach o Choimisiún Talmhan na hÉireann don Bhord agus thar a gceann a bheidh dílsithe i gCoimisiún Talmhan na hÉireann agus a bheidh ag teastáil on mBord chun gach chríche no aon chríche acu so leanas, sé sin le rá, móin do bhaint no d'ullamhú chun a díolta no do stóráil no aon chríoch a ghabhas leis an mbaint no leis an ullamhú no leis an stóráil sin.
(2) Beidh éifeacht ag na forálacha so leanas maidir leis an Aire do cheannach tailimh o Choimisiún Talmhan na hÉireann fén alt so, sé sin le rá:—
(a) déanfar an talamh san do cheannach amhlaidh ar pé praghas agus ar pé téarmaí agus coinníollacha eile ar a gcó-aontóidh an tAire agus Coimisiún Talmhan na hÉireann, fé réir an tsrianta ná déanfar, agus an praghas san á mheas, aon áird do thabhairt ar aon fheabhsúcháin ná aon mhéadú praghais do lomháil mar gheall ar aon fheabhsúcháin do rinneadh ar an talamh san le hairgead do híocadh no do roimh-íocadh amach as an bPrímh-Chiste no amach as airgead do sholáthruigh an tOireachtas;
(b) déanfaidh Coimisiún Talmhan na hÉireann an talamh san do leithliú chun an Bhúird;
(c) isé an Bord a sholáthróidh agus a íocfaidh an praghas a bheidh le n'íoc ag an Aire le Coimisiún Talmhan na hÉireann ar an talamh san;
(d) íocfaidh an Bord costaisí agus caiteachaisí uile an Aire agus Choimisiúin Talmhan na hÉireann maidir leis an gceannach san no ina thaobh.
(3) San alt so (ach amháin an fo-alt so) foluíonn an focal “talamh” aon éasáid, profit á prendre, no ceart eile ar aon talamh no maidir leis agus an chomhacht cheannaigh a bronntar leis an alt so bainfidh le haon ceart den tsórt san do cheannach pe'ca i dteanta talamh do cheannach no gan talamh do cheannach a ceannófar é.
Comhacht generálta don Aire chun talamh do cheannach don Bhord.
22.—(1) Féadfaidh an tAire, más dóich leis agus pé uair is dóich leis san do bheith ceart ar mholadh an Bhúird, aon talamh do cheannach o dhuine ar bith, tré chó-aontú no go héigeanta, don Bhord agus thar a gceann a bheidh ag teastáil ón mBord chun gach críche no aon chríche acu so leanas, sé sin le rá, móin do bhaint no d'ullamhú chun a díolta no do stóráil, no aon chríoch a ghabhas leis an mbaint no leis an ullamhú no leis an stóráil sin.
(2) Gach oifigeach don Bhord go n-údarás chuige sin i scríbhinn ón Aire údaruítear agus tugtar comhacht dó leis seo dul isteach ar aon talamh a bheidh ag teastáil ón mBord fén alt so chun aon fhiosrú, lorgaireacht no scrúdú do dhéanamh ann roimh an Aire do cheannach an tailimh sin no ina thaobh san.
(3) Beidh éifeacht ag na forálacha so leanas maidir leis an Aire do cheannach tailimh (pe'ca tré chó-aontú no go héigeanta é) fén alt so, sé sin le rá:—
(a) déanfar, cheal có-aontuithe, an praghas a bheidh le n'íoc ag an Aire ar an talamh san do mheas fén Acquisition of Land (Assessment of Compensation) Act, 1919, agus dá réir;
(b) nuair a beifear ag meas an praghais sin (pe'ca tré chó-aontú no fén mír dheiridh sin roimhe seo den fho-alt so é) ní déanfar aon áird do thabhairt ar aon fheabhsúcháin ná aon mhéadú praghais do lomháil mar gheall ar aon fheabhsúcháin do rinneadh ar an talamh san le hairgead do híocadh no do roimh-íocadh amach as an bPrímh-Chiste no amach as airgead do sholáthruigh an tOireachtas;
(c) déanfar an talamh san do leithliú chun an Bhúird;
(d) beidh feidhm ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845, maidir leis an bpraghas san agus le leithliú an tailimh sin chun an Bhúird agus, chun críche na feidhme sin, tuigfear gurb é an tAire bunuitheoir an ghnótha;
(e) isé an Bord a sholáthróidh agus a íocfaidh an praghas san;
(f) aon tráth roimh an bpraghas san do mheas no roimh an talamh san do leithliú chun an Bhúird, ach fé réir fógra nách giorra ná mí no, i gcás tighe chomhnuithe ghabhtha, nách giorra ná trí mhí do thabhairt roimh ré i scríbhinn do shealbhaire an tailimh sin, féadfaidh an Bord, le toiliú an Aire, dul isteach ar an talamh san agus seilbh do thógaint air, ach i ngach cás den tsórt san íocfaidh an Bord leis an sealbhaire sin ús ar mhéid an phraghais sin, nuair a measfar é, do réir ceathair per cent. per annum ón dáta raghfar isteach amhlaidh go dtí an dáta a híocfar an praghas san;
(g) íocfaidh an Bord costaisí agus caiteachaisí uile an Aire maidir leis an gceannach san no ina thaobh, ar a n-áirmhítear costaisí agus caiteachaisí uile dhíoltóra an tailimh sin is iníoctha go dleathach ag an Aire.
(4) San alt so (ach amháin an fo-alt so) foluíonn an focal “talamh” aon éasáid, profit á prendre, no ceart eile ar aon talamh no maidir leis, agus na comhachta, chun talamh do cheannach agus chun dul isteach ann agus chun seilbh do thógaint air, a bronntar leis an alt so bainfid le haon cheart den tsórt san do cheannach (pe'ca i dteanta talamh do cheannach no gan talamh do cheannach a ceannófar é) agus leis an gceart san d'fheidhmiú agus, chun na críche sin, folóidh tagairtí do shealbhaire an tailimh sin únaer an chirt sin.
Breacacháin a choimeádfaidh mion-díoltóirí guail cláruithe.
23.—(1) Coimeádfaidh gach mion-díoltóir guail cláruithe, no cuirfidh fé ndeár go gcoimeádfar, na breachacháin orduithe sa bhfuirm orduithe i dtaobh an ghuail go léir agus na móna go léir a cheannóidh, a gheobhaidh, a dhíolfaidh no a sheachadfaidh agus, tráth nach déanaí ná an chéad lá, nach Domhnach ná lá saoire baine, i ndiaidh an cheannaigh, na fála, an díola no an tseachadtha san, déanfaidh no cuirfidh fé ndeár go ndéanfar na hiontrála orduithe ina thaobh san do chur i ngach breacachán den tsórt san.
(2) Féadfar a cheangal le rialacháin a déanfar fén Acht so, ag ordú na mbreacachán a coimeádfar do réir an ailt seo, go ndéanfaidh mion-díoltóir guail cláruithe bheidh cláruithe alos dhá áitreabh no níos mó ar leithligh breacacháin ar leithligh den tsórt san do choimeád alos gach áitreibh ar leithligh den tsórt san.
(3) Gach breacachán a bheidh á choimeád do réir an ailt seo féadfaidh cigire no oifigeach don Bhord, go n-údarás chuige sin i scríbhinn ón Aire, no ball den Ghárda Síochána é d'iniúchadh aon am le linn tráthanna oifige, agus an té dhlighfidh fén alt so an breacachán san do choimeád beidh sé de dhualgas air an breacachán san do thaisbeáint, ar n-a iarraidh sin air, chun go n-iniúchfaidh an cigire, an t-oifigeach no an ball san é agus fós gach billín, nóta consighneachta, admháil agus scríbhinn eile (ar a n-áirmhítear cóipeanna dhíobh i gcás ná beid féin ar fáil) a iarrfaidh an cigire, an t-oifigeach no an ball san go réasúnta chun féachaint an fíor aon iontráil áirithe sa bhreacachán san no cad fé ndeár éinní áirithe d'fhágaint amach as.
(4) Má thárlann d'éinne—
(a) maidir leis an mbreacachán san is gá dhó do réir an ailt seo do choimeád no a chur fé ndeár é choimeád, go dteipfidh air é choimeád no a chur fé ndeár é choimeád; no
(b) go dteipfidh air aon iontráil áirithe do chur no a chur fé ndeár í chur sa bhreacachán san laistigh den am a ceaptar leis an alt so is iontráil is gá dhó do réir an ailt seo a chur sa bhreacachán san; no
(c) go dteipfidh air aon bhreacachán, scríbhinn no cóip de scríbhinn do thaisbeáint no a chur fé ndeár é thaisbeáint, ar n-a iarraidh sin air, chun go n-iniúchfaidh cigire no oifigeach don Bhord, go n-údarás chuige sin i scríbhinn ón Aire, no ball den Ghárda Síochána é, is gá dhó do réir an ailt seo do thaisbeáint chun an iniúchta san, no go gcuirfe sé cosc le haon chigire no le haon oifigeach no ball den tsórt san agus é ag déanamh an iniúchta san; no
(d) go ndéanfa sé no go gcuirfe sé fé ndeár, go toiliúil no tré fhaillí, aon iontráil a bheidh bréagach no mí-threorach in aon phonc táchtach do chur sa breacachán san,
beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
(5) Chun crícheanna an ailt seo—
(a) folóidh breacachán no scríbhinn d'iniúchadh cóipeanna do dhéanamh de no sleachta do thógaint as; agus
(b) tuigfear gur iarr cigire, oifigeach don Bhord no ball den Ghárda Síochána go cuibhe fén alt so breacachán no scríbhinn do thaisbeáint, chun a iniúchta, ar an duine dhlighfidh fén alt so an breacachán san no an breacachán le n-a mbaineann an scríbhinn sin (pe'ca aca é) do choimeád má hiarradh san de bhréithre béil san áitreabh san ar phearsain ar bith ar fostú ag an duine sin; agus
(c) má thárlann diúltú no teip maidir le breacachán no scríbhinn do thaisbeáint chun a iniúchta fén alt so agus más san áitreabh ina mbeidh an breacachán no an scríbhinn sin á choimeád a thárlóidh san agus más do phearsain ar fostú ag an duine dhlighfidh fén alt so an breacachán no an scríbhinn sin do thaisbeáint a thárlóidh sé, tuigfear gurb é an duine sin do dhiúltuigh no gurb air do theip; agus
(d) cialluíonn an abairt “tráthanna oifige”—
(i) maidir le haon lá (nach Domhnach ná lá saoire bainc ná fós lá saoire ná leath-lá saoire coimeádtar sa cheanntar), aon am idir a deich a chlog ar maidin agus a cúig a chlog um thráthnóna bhíonn gnó ar siúl no obair á déanamh san áitreabh le n-a mbaineann; agus
(ii) maidir le haon leath-lá saoire coimeádtar sa cheanntar, aon am idir a deich a chlog ar maidin agus a haon a chlog um thráthnóna bhíonn gnó ar siúl no obair á déanamh san áitreabh le n-a mbaineann.
Tuairisceáin a chuirfidh mion-díoltóirí guail cláruithe chun an Aire.
24.—(1) Féadfaidh an tAire, le hordú, rialacháin do dhéanamh á cheangal ar mhion-díoltóirí guail cláruithe tuairisceáin tréimhsiúla do chur chun an Aire ina dtaisbeánfar na caindíochtaí de ghual agus de mhóin do cheannuíodar, na caindíochtaí de ghual agus de mhóin do dhíoladar agus pé nithe eile maidir le ceannach no le díol an ghuail sin no na móna san is dóich leis an Aire is ceart do luadh sna rialacháin sin, agus féadfaidh an tAire, leis na rialacháin sin, a ordú cé hiad na daoine bhéarfaidh na tuairisceán sin uatha, agus cadiad na tráthanna do bhéarfar agus cadé an fhuirm agus an tslí ina dtabharfar na tuairisceáin sin.
(2) Gach duine ar a gceanglófar le rialacháin a déanfar fén alt so aon tuairisceán áirithe do thabhairt uaidh agus go dteipfidh air no dhiúltóidh an tuairisceán san do thabhairt uaidh do réir na ríalachán san ar gach slí no chuirfidh in aon tuairisceán den tsórt san aon ráiteas a bheidh bréagach no mí-threorach in aon phonc táchtach, beidh sé ciontach i gcionta fén alt so agus, ar a chiontú ann ar an slí achmair, dlighfear fíneáil ná raghaidh thar deich bpúint do chur air másé an chéad chionta den tsórt san aige é agus, másé an dara cionta no aon chionta ina dhiaidh sin den tsórt san aige é, fíneáil ná raghaidh thar cúig púint fhichead.
Comhacht chun a cheangal ar mhion-díoltóirí guail neachláruithe tuairisceáin do thabhairt uatha.
25.—(1) Féadfaidh an tAire, pé uair is dóich leis san do bheith ceart, fógra i scríbhinn do sheirbheáil ar aon mhion-díoltóir guail (pe'ca i líomatáiste cheaptha no lasmuich dhe bheidh gnó á dhéanamh aige) nach mion-díoltóir guail cláruithe, fógra á cheangal ar an mion-díoltóir guail sin, laistigh d'am áirithe nach luatha ná seacht lá o lá seirbheálta an fhógra san, tuairisceán do chur chun an Aire ina dtaisbeánfar an chaindíocht de ghual agus de mhóin do cheannuigh an mion-díoltóir guail sin i rith tréimhse áirithe, an chaindíocht de ghual agus de mhóin do dhíol an miondíoltóir guail sin i rith na tréimhse sin, agus pé nithe eile maidir le ceannach no le díol an ghuail sin agus na móna san is dóich leis an Aire is ceart agus a luadhfaidh sa bhfógra san.
(2) Gach mion-díoltóir guail ar a seirbheálfar fógra fén alt so déanfaidh, laistigh den am a luadhfar chuige sin sa bhfógra san, an tuairisceán san do chur chun an Aire is gá dhó do réir an fhógra san do chur chuige agus má theipeann ar an mion-díoltóir guail sin an tuairisceán san do chur chun an Aire no má chuireann chuige aon tuairisceán den tsórt san a bheidh bréagach no míthreorach in aon phone táchtach beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar fiche púnt do chur air.
Cláir, tuairisceáin agus staitistíocht d'fhoillsiú.
26.—(1) Féadfaidh an tAire gach ní no éinní bheidh iontrálta i gclár d'fhoillsiú i pé slí is oiriúnach leis agus féadfaidh fós fógra á rá go ndearna sé cealú no atharú ar chlarú éinne bhí cláruithe i gclár d'fhoillsiú amhlaidh.
(2) Ní déanfar aon tuairisceán áirithe ná aon chuid áirithe de thuairisceán do bhéarfar do réir an Achta so d'fhoillsiú ná do nochtadh ach amháin don Bhord no chun críche cúisimh fén Acht so.
(3) Féadfaidh an tAire, o am ga ham, pé colas staitistíochta (le n-a n-áirmhítear staitistíocht as tuairisceáin do cuireadh chuige do réir an Achta so) is oiriúnach leis do bhailiú agus d'fhoillsiú maidir le héinní le n-a mbaineann an tAcht so ach, chó fada agus is féidir é do réir réasúin, ní bheidh in aon eolas staitistíochta foillseofar amhlaidh mion-innste ar bith do chuirfeadh ar chumas éinne a aithint gur mion-innste bhaineann le haon duine no gnó no cúram áirithe na mion-innste sin.
Coimeád na gclár agus fianaise ar a mbeidh ionta.
27.—(1) Maidir le gach clár—
(a) tuigfear é bheith sa choimeád cheart nuair a bheidh sé i gcoimeád an Aire no oifigigh don Aire go n-údarás chuige sin ón Aire, agus
(b) beidh sé ionghlactha ina fhianaise, gan a thuilleadh cruthúnais, ar é thabhairt i láthair as an gcoimeád gceart.
(2) Féadfar fianaise prima facie i dtaobh aon iontrála i gclár do thabhairt in aon chúirt no in aon imeachta dlí tré chóip den iontráil sin do thabhairt i láthair do bheireann le tuisgint í bheith deimhnithe mar chóip dhílis ag oifigeach don Aire go n-údarás chuige sin ón Aire agus ní bheidh sé riachtanach sighniú an oifigigh sin do chruthú ná a chruthú gurbh é an t-oifigeach san é ná go raibh an t-údarás san aige.
(3) Beidh deimhniú do bheireann le tuisgint é bheith fé láimh oifigigh don Aire go n-údarás chuige sin ón Aire, á rá go bhfuil duine ar bith luaidhtear sa deimhniú san gan bheith cláruithe in aon chlár áirithe, beidh san, in aon chúirt no imeachta dlí, ina fhianaise prima facie ar na nithe bheidh deimhnithe amhlaidh, agus ní bheidh sé riachtanach sighniú an oifigigh sin do chruthú ná a chruthú gurb é an t-oifigeach san é ná go raibh an t-údarás san aige.
(4) Féadfaidh duine ar bith—
(a) cóip, agus í deimhnithe mar chóip dhílis sa tslí luaidhtear anso roimhe seo, d'aon iontráil i gclár a bheidh á choimeád do réir an Achta so d'fháil ar tháille reulach ar gach folió de dhá fhocal sheachtód den chóip d'íoc leis an Aire;
(b) deimhniú den tsórt san a luaidhtear anso roimhe seo, á rá go bhfuil éinne áirithe gan bheith cláruithe i gclár no i gcláir áirithe bheidh á gcoimeád do réir an Achta so, d'fháil ar tháille scillinge ar gach deimhniú den tsórt san d'íoc leis an Aire.
Comhachta chun iniúchadh agus scrúdú do dhéanamh.
28.—(1) Udaruítear agus bheirtear comhacht leis seo do gach cigire agus do gach oifigeach don Bhord, go n-údarás chuige sin i scríbhinn ón Aire, agus do gach ball den Ghárda Síochána gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) dul isteach agus saorchead do bheith aige istigh gach tráth réasúnta in aon áitreabh chláruithe no in aon áitreabh nea-chláruithe ina mbíonn gual no móin, no ina gcreidfear gual no móin do bheith, á dhíol no ar coimeád no ar taisbeáint no ar stóráil chun a dhíolta, no in áitreabh éinne dheineann earraí d'iompar ar luach saothair, no in aon bhád, bhaigín traenach, laraí mótair, trucail, no feithicil eile a húsáidtear chun earraí d'iompar;
(b) scrúdú do dhéanamh ar an ngual go léir agus ar an móin go léir a gheobhfar in aon áitreabh, bád no feithicil go mbeidh cead aige bheith istigh ann de bhuadh an ailt seo agus, chuige sin, aon mhála, sac no pacáid eile d'oscailt a gheobhfar san áit sin agus ina mbeidh gual no móin no ina gcreidfear gual no móin do bheith;
(c) pé ceisteanna is dóich leis an gcigire, leis an oifigeach no leis an mball san is ceart, i dtaobh aon ghuail no móna gheobhfar le linn feidhmithe aon chomhachta dá mbronntar leis an alt so do chur, aon tráth no in aon áit, chun duine ar bith ag á mbeidh, no ag á raibh tráth ar bith, coimeád no seilbh an ghuail no na móna san agus ainm agus seoladh an duine sin d'éileamh agus do thógaint agus fós ainm agus seoladh únaera no chonsighné an ghuail no na móna san d'éileamh ar an duine sin agus do thógaint uaidh;
(d) a éileamh, aon tráth no in aon áit, ar dhuine ar bith ag á mbeidh, no ag á raibh tráth ar bith, coimeád no seilbh aon ghuail no móna gheobhfar le linn feidhmithe aon chomhachta dá mbronntar leis an alt so gach breacachán, billín, nóta consighneachta, admháil agus scríbhinn eile (ar a n-áirmhítear cóipeanna dhíobh i gcás ná beid féin ar fáil) a bhaineann leis an ngual no leis an móin sin do thaisbeáint agus cóipeanna do dhéanamh d'aon scríbhinní den tsórt san (ar a n-áirmhítear cóipeanna den chéanna mar adubhradh) agus sleachta do thógaint asta.
(2) Nuair a bheidh na comhachta bronntar air leis an alt so á bhfeidhmiú aige in áitreabh aon chuideachtan loingis no bóthair iarainn déanfaidh gach cigire agus gach oifigeach don Bhord agus gach ball den Ghárda Síochána do réir pé éilithe réasúnta ón gcuideachtain sin is gá chun ná déanfaí cosc ná cur isteach ar oibriú an tráchta san áitreabh san.
(3) Gach éinne—
(a) a bhacfaidh no a choiscfidh aon chigire no aon oifigeach don Bhord no aon bhall den Ghárda Síochána agus an cigire, an t-oifigeach, no an ball san ag feidhmiú aon chomhachta dá mbronntar air leis an alt so, no
(b) go dteipfidh air no dhiúltóidh freagra do thabhairt, chó fada le n-a eolas agus le n-a chumas, ar aon cheist a chuirfidh an cigire, an t-oifigeach no an ball san chuige i bhfeidhmiú comhachta bronntar chuige sin leis an alt so, no
(c) do bhéarfaidh ar aon cheist den tsórt san freagra is eol dó a bheith bréagach no mí-threorach, no

Deimhnithe ceapacháin chigirí.
29.—Beidh ag gach cigire deimhniú sa bhfuirm orduithe á rá go bhfuil sé ceaptha mar chigire den tsórt san agus, nuair a bheidh sé ag feidhmiú aon chomhachta dá mbronntar ar chigire leis an Acht so no fé, déanfaidh, má héilítear san air, an deimhniú san do thaisbeáint do dhuine ar bith le n-a mbaineann.
Fógraí do theistiú agus do sheirbheáil.
30.—(1) Gach fógra seirbheálfar fén Acht so ar mhion-díoltóir guail beidh sé, má dearbhuítear leis an Acht so gur cionta teip i ndéanamh do réir an fhógra san, séaluithe le séala oifigiúil an Aire.
(2) Gach fógra a ceangaltar no a húdaruítear leis an Acht so a sheirbheáil ar mhion-díoltóir guail féadfar é sheirbheáil amhlaidh—
(a) tríd an bhfógra san do sheachadadh don mhion-díoltóir guail sin, no
(b) tríd an bhfógra san do sheachadadh, in aon áit ina mbíonn gnó mar mhion-díoltóir guail á dhéanamh ag an miondíoltóir guail sin, do dhuine bheidh sé bliana déag d'aois no os a chionn san agus a bheidh ar fostú ag an mion-díoltóir guail sin maidir leis an ngnó san, no
(c) tríd an bhfógra san do chur tríd an bpost cláruithe roimhíoctha agus é dírithe chun an mhion-díoltóra ghuail sin, más mion-díoltóir guail cláruithe é, ag aon áitreabh go mbeidh sé cláruithe ina thaobh i gclár a bheidh á choimeád fén Acht so no, maran mion-díoltóir guail cláruithe é, ag aon áit ina mbeidh a ghnó mar mhiondíoltóir guail á dhéanamh aige.
(3) Gach fógra seirbheálfar fén Acht so ar mhion-díoltóir guail féadfar, in aon chúiseamh i gcoinnibh an mhion-díoltóra ghuail sin i dtaobh é do theip air déanamh do réir an fhógra san, é do chruthú tré chóip den fhógra san do thaisbeáint a bheidh séaluithe le séala oifigiúil an Aire agus deimhniú, fé láimh oifigigh don Aire go n-údarás chuige sin ón Aire, cúlscríobhtha uirthi á dheimhniú gur cóip dhílis den fhógra do seirbheáladh amhlaidh ar an miondíoltóir guail sin an chóip sin, agus ní bheidh sé riachtanach sighniú an oifigigh sin do chruthú ná a chruthú gurbh oifigeach den tsórt san adubradh é ná go raibh an t-údarás san aige adubhradh.
Rialacháin.
31.—Féadfaidh an tAire, le hordú, rialacháin do dhéanamh chun éinní no aon ruda d'ordú dá dtagartar san Acht so mar ní no mar rud atá orduithe no le hordú, ach ní déanfar aon rialachán den tsórt san i dtaobh méid táillí ná i dtaobh a mbailithe gan toiliú an Aire Airgid.
Costaisí.
32.—Ach amháin mar a foráltar a mhalairt leis an Acht so, is amach as airgead a sholáthróidh an tOireachtas a híocfar, sa mhéid go gceadóidh an tAire Airgid é, gach costas fé n-a raghaidh an tAire chun an Achta so do chur i bhfeidhm.
Táillí do bhailiú agus do chur de láimh.
33.—(1) Déanfar na táillí uile glacfar fén Acht so do bhailiú in airgead agus do ghlacadh i pé slí ordóidh an tAire Airgid o am go ham, agus déanfar iad d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste do réir orduithe an Aire sin.

TURF (USE AND DEVELOPMENT) ACT, 1936.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the expression “the Board” means the Turf Development Board, Limited;
the word “prescribed” means prescribed by regulations made by the Minister under this Act;
the word “inspector” means an officer of the Minister appointed (either generally or for a particular purpose) in writing by the Minister to be an inspector for the purpose or any particular purpose of this Act;
the word “turf” includes peat, and also includes briquettes made wholly or mainly of peat, but does not include peat moss litter;
the word “coal” means coal mined outside Saorstát Eireann and includes briquettes made wholly or mainly of such coal or the dust of such coal, but does not include coke;
the expression “coal retailer” means a person who carries on the business of selling coal by retail;
the word “register” when used as a noun and without qualification means a register of coal retailers kept by the Minister in pursuance of this Act;
the expression “registered coal retailer” means a coal retailer who is registered in a register of coal retailers kept by the Minister in pursuance of this Act, and the said expression when used in relation to an appointed area means a coal retailer registered in the register of coal retailers so kept in respect of such appointed area;
the word “delivery” wherever it occurs in the expression “sale and delivery” includes delivery at the premises of the coal retailer in relation to whom that expression is used;
the expression “consumption for domestic or household purposes” means consumption by burning for all or any of the following purposes, that is to say:—
(a) heating the whole or any part of any building or other place which is used as a dwelling-house for human beings, or as a stable for any kind of animal, or as a place in which human beings do any kind of work or to which human beings resort for any purpose, or
(b) the cooking of food, whether for human beings or animals, or
(c) the heating of water for any purpose other than the generation of steam in a steam engine.
Approved sources for the purposes of this Act.
2.—(1) Every of the following persons shall, for the purposes of this Act, be an approved source for the obtaining of turf by coal retailers, that is to say:—
(a) the Board;
(b) a co-operative society which is for the time being authorised by the Board to supply turf to coal retailers for the purposes of the provisions of this Act relating to the compulsory purchase of turf, but only to the extent and within the limits of such authority;
(c) in relation only to turf briquettes, a limited company for the time being approved of in this behalf by the Minister.
(2) In this Act, the expression “approved source” means a person who is, by virtue of this section, for the time being an approved source for the purposes of this Act.
Place of business of a coal retailer.
3.—(1) A coal retailer shall be deemed for the purpose of this Act to carry on his business as a coal retailer at any fixed place at which he habitually receives orders or makes contracts for the sale and delivery (whether immediately or at some future time) of coal by retail, but a coal retailer shall not be deemed for the purpose of this Act to carry on his said business at any other place which he uses for the purposes of his said business.
(2) A coal retailer who sells coal only by hawking in public thoroughfares and has no fixed place at which he habitually sells coal shall be deemed for the purposes of this Act to carry on his business as a coal retailer at the place at which he resides.
Appointed areas.
4.—(1) The Minister may whenever and so often as he so thinks proper, by order (in this Act referred to as an appointed area order) declare that a particular area specified or delimited in such order shall, as on and from a date (not less than one month after the date of such order) specified in such order, be an appointed area for the purposes of this Act.
(2) The Minister may at any time at his discretion by order revoke or amend an appointed area order and, in particular, may by any such amending order alter (whether by addition or subtraction or both addition and subtraction) as on and from a specified day, not less than one month after the date of such amending order, the area which is an appointed area by virtue of an appointed area order.
(3) In this Act the expression “appointed area” means an area which is for the time being an appointed area by virtue of an appointed area order.
Suspension of appointed area order.
5.—(1) The Minister may, whenever and so often as he thinks proper, by order (in this Act referred to as a suspension order) suspend, as on and from a date (not earlier than the date of such order) specified in such order, any appointed area order.
(2) Whenever the Minister has made a suspension order, he may at his discretion by order (in this section referred to as a termination order) terminate, as on and from a date (not earlier than the date of such termination order), specified in such termination order, the suspension effected by such suspension order of the appointed area order to which such suspension order relates.
(3) Whenever the Minister has made a suspension order, the appointed area order to which such suspension order relates shall be suspended as on and from the date specified in that behalf in such suspension order and shall continue to be so suspended until the date as on and from which such suspension is terminated by a termination order.
(4) Whenever an appointed area order is suspended under this section, the appointed area to which such order relates shall, immediately upon the commencement of such suspension, cease to be an appointed area for the purposes of this Act, but shall, on the date as on and from which such suspension order is terminated, become and again be an appointed area for the said purposes.
(5) Whenever an appointed area order is suspended under this section, the Minister shall, during such suspension, maintain and keep in accordance with this Act the register of coal retailers established in pursuance of this Act in respect of the appointed area to which such order relates, but nothing in this sub-section shall render it obligatory upon any person to be registered in such register during such suspension.
Provisions consequential on cesser to be an appointed area.
6.—Whenever an appointed area or a part of an appointed area ceases, by virtue of an order under this Act revoking or amending an appointed area order or by virtue of a suspension order, to be an appointed area or to be included in an appointed area (as the case may be), the following provisions shall have effect, that is to say:—
(a) such cesser shall not affect—
(i) the previous operation of this Act in such appointed area or part of an appointed area (as the case may be) or anything done or suffered under this Act in such area or part; or
(ii) any right, privilege, obligation, or liability acquired, accrued, or incurred under this Act in such appointed area or part of an appointed area (as the case may be); or
(iii) any penalty, forfeiture, or punishment incurred under this Act; or
(iv) any investigation, legal proceeding, or remedy in respect of any such right, privilege, obligation, penalty, forfeiture, or punishment as aforesaid; and
(b) any offence under any section of this Act committed before such cesser may be investigated, prosecuted, tried, and punished after and not withstanding such cesser as if such cesser had not occurred.
Registers of coal retailers.
7.—(1) Whenever the Minister makes an appointed area order, he shall forthwith establish and thereafter maintain and keep a register of persons who carry on business as coal retailers in the area which is declared by such order to be an appointed area.
(2) In every register maintained in pursuance of this section there shall be entered, in respect of every person registered in such register, the following particulars, that is to say:—
(a) the full name and description of such person; and
(b) a description (sufficient to identify the premises and the situation and limits thereof) of the premises or every of the separate and distinct premises (as the case may be) in which such person carries on, in the appointed area to which such register relates, the business of selling coal by retail.
Applications for and right to registration in a register.
8.—(1) Save as is otherwise provided by this section, every person who carries on or proposes to carry on in an appointed area the business of selling coal by retail shall be entitled, on applying in the prescribed form and manner and paying the prescribed fee, to be registered in the register in respect of the premises in such appointed area in which he carries on or proposes to carry on such business.
(2) Where an application for registration in a register is made by a person who proposes to carry on business as a coal retailer in the appointed area to which such register relates, the registration of such person in pursuance of such application shall not become effective until such person commences to carry on such business.
(3) An application for registration in a register may be made at any time after the date of the relevant appointed area order, whether before or after the day on which the declaration of an appointed area made by such order takes effect, and accordingly the expression “appointed area” in the foregoing sub-sections of this section includes an area which has been declared by an appointed area order to be an appointed area as on and from a future date.
(4) Notwithstanding anything contained in the foregoing sub-sections of this section, the Minister may, in his absolute discretion, refuse an application by any person for registration in a register if such person has, previous to such application, been registered in that or any other register and such previous registration has been cancelled.
Amendment of registers.
9.—(1) The Minister may, at any time, on his own motion amend a register by correcting any manifest error therein.
(2) The Minister shall, on the application of any person registered in a register, amend such register by correcting any error in the description in such register of such person or of the premises or any of the premises in respect of which he is so registered or by entering in such register a change in the ownership of the business in respect of which such person is so registered or a change (whether by addition, reduction, or complete transfer) in the premises or any of the premises in which such business is carried on.
(3) Where a person registered in a register has died, the Minister shall, on the application of the personal representative of such person, amend such register by entering therein the fact of such death and entering therein such personal representative as the registered person in lieu of the person so deceased.
Cancellation of registration.
10.—(1) The Minister may at any time cancel the registration of any person in a register upon the application in writing of such person, or, in the case of an individual, of his personal representative or, in the case of a body corporate, the liquidator of such body corporate.
(2) The Minister may at any time, without any such application as aforesaid, cancel the registration of any person in a register if he is satisfied that—
(a) such registration was procured through fraud or by misrepresentation (whether innocent or fraudulent); or
(b) the business on account of which such person was so registered has ceased to be carried on; or
(c) such person, if an individual, has died, or if a body corporate, has been dissolved, and, in either case, no other person has, within three months after such death or dissolution, been registered in the place of the person so dead or dissolved; or
(d) that such person has been adjudicated a bankrupt; or
(e) that such person has been convicted of a contravention (whether by way of commission or omission) of this Act or a regulation made thereunder.
(3) Before cancelling under this section (otherwise than in accordance with an application in that behalf made under this section) the registration of any person in a register, the Minister shall give at least one month's notice in writing to such person or his personal representative (if any) or its liquidator (as the case may be) of his intention so to cancel such registration and the reasons therefor, and shall consider any representations made by such registered person or personal representative or liquidator (as the case may be) within seven days after the service of such notice.
(4) A notice of the Minister's intention to cancel a registration may be served by delivering it to the person to whom it is addressed or by sending it by post to such person at his last known place of abode or at the last known place at which he carried on the business in respect of which it is proposed to cancel the registration.
Issue and display of registration certificates.
11.—(1) Whenever the Minister has registered a person in a register, the Minister shall forthwith issue to such person a certificate in the prescribed form of such registration, and, if such person is so registered in respect of two or more distinct premises, shall so issue to such person a separate such certificate in respect of each such distinct premises.
(2) Every person to whom a certificate of registration is issued by the Minister under this section shall cause such certificate to be displayed prominently during business hours in the premises to which such certificate relates.
(3) Every coal retailer who fails to comply with the provisions of the next preceding subsection of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Prohibition of coal retailing by unregistered persons.
12.—(1) It shall not be lawful for any person to carry on in an appointed area, the business of selling coal by retail unless he is registered in the register kept in pursuance of this Act in respect of that appointed area.
(2) It shall not be lawful for any person to carry on, in an appointed area, the business of selling coal by retail at any premises or place in such appointed area other than premises in respect of which he is registered in the register kept in pursuance of this Act in respect of that appointed area.
(3) Every person who carries on the business of selling coal by retail in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for any term not exceeding three months, or to both such fine and such imprisonment.
Prohibition of purchase of coal from unregistered coal retailer.
13.—(1) It shall not be lawful for any person to purchase in an appointed area any coal from a coal retailer who carries on, in that appointed area, the business of selling coal by retail unless such coal retailer is registered in the register kept in pursuance of this Act in respect of that appointed area.
(2) Every person who purchases any coal in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one pound for every ton or part of a ton of coal so purchased.
Compulsory purchase of turf.
14.—(1) Whenever a coal retailer sells and delivers (whether in or not in an appointed area) to a purchaser who is not entitled to the benefit of an exemption under this Act in respect of such sale and delivery more than two hundredweights of coal for consumption for domestic or household purposes in an appointed area, such coal retailer shall, at the time of such sale and delivery, also sell and deliver to such purchaser and such purchaser shall at the said time purchase and take from such coal retailer the prescribed quantity of turf (obtained from an approved source) appropriate both to the quantity of coal so sold and delivered and to the appointed area for consumption in which such coal is so sold and delivered.
(2) Whenever, on a sale and delivery of coal by a coal retailer to a purchaser, such coal retailer fails to sell and deliver to such purchaser at the time of such sale and delivery of coal the quantity of turf (obtained from an approved source) mentioned in the foregoing sub-section of this section and such failure is a contravention of the said foregoing sub-section, such coal retailer shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding one pound for every ton or part of a ton of coal so sold and delivered.
(3) Whenever, on a sale and delivery of coal by a coal retailer to a purchaser, such purchaser fails to purchase and take from such coal retailer at the time of such sale and delivery of coal the quantity of turf mentioned in the first sub-section of this section and such failure is a contravention of the said first sub-section, such purchaser shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding one pound for every ton or part of a ton of coal so sold and delivered.
(4) This section is in this Act referred to as the provisions of this Act relating to the compulsory purchase of turf, and this section may be referred to in a similar manner in any order, regulation, exemption, or other instrument made under this Act.
Regulations prescribing the prescribed quantity of turf.
15.—Whenever the Minister by regulations made under this Act prescribes the quantity of turf to be sold and delivered by a coal retailer to a purchaser and purchased and taken by such purchaser from such coal retailer in pursuance of the provisions of this Act relating to the compulsory purchase of turf, the Minister may make separate and different such regulations in respect of different appointed areas, and may by any such regulations prescribe different quantities of turf in respect of different appointed areas or different parts of the same appointed area, and may by any such regulations fix any such quantity of turf by reference to all or any of the following matters, that is to say, the period of the year at which such coal is so sold, the quantity of coal included in any one sale, the price at which such coal is so sold, and the place of delivery of such coal.
Obligation to supply turf obtained from an approved source.
16.—(1) All turf sold and delivered by a coal retailer in pursuance of the provisions of this Act relating to the compulsory purchase of turf shall be turf obtained by such coal retailer from an approved source, and the sale and delivery by a coal retailer of turf obtained from a person who is not for the time being an approved source shall not be or be reckoned as a sale and delivery in pursuance of the said provisions of this Act.
(2) Every coal retailer who, in pretended compliance with the provisions of this Act relating to the compulsory purchase of turf, sells and delivers to a purchaser any turf which was not obtained by such coal retailer from an approved source shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding the sum of one pound for every ton or part of a ton of turf so sold and delivered.
(3) Every person who, in pretended compliance with the provisions of this Act relating to the compulsory purchase of turf, purchases and takes from a coal retailer any turf which was, to the actual knowledge of such person, not obtained by such coal retailer from an approved source shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one pound for every ton or part of a ton of turf so purchased and taken.
(4) Nothing in this section shall operate to impose on a purchaser of turf from a coal retailer in pursuance of the provisions of this Act relating to the compulsory purchase of turf any obligation to make inquiry as to the source from which such coal retailer obtained such turf or operate to impute to such purchaser constructive or other notice of such source.
Power to compel coal retailer to obtain turf.
17.—(1) Whenever the quantity of turf obtained by a coal retailer from approved sources during any particular period of not less than two months, together with the quantity (if any) of turf obtained from approved sources which is in the possession of such coal retailer at the beginning of such period, is less than the quantity of turf sold and delivered or which ought to have been sold and delivered by such coal retailer in pursuance of the provisions of this Act relating to the compulsory purchase of turf during the said period, the Minister may serve on such coal retailer a notice in writing—
(a) stating—
(i) the particular period aforesaid to which such notice relates, and
(ii) the quantity of turf obtained as aforesaid by such coal retailer, and
(iii) the quantity (if any) of turf in the possession as aforesaid of such coal retailer, and
(iv) the quantity of turf sold and delivered or which ought to have been sold and delivered as aforesaid, by such coal retailer, and
(b) requiring such coal retailer to obtain within a specified time (not less than fourteen days from the service of such notice) from some approved source or sources a specified quantity of turf not exceeding the amount by which the quantity of turf obtained as aforesaid by such coal retailer together with the quantity (if any) of turf in the possession as aforesaid of such coal retailer falls short of the quantity of turf sold and delivered or which ought to have been sold and delivered as aforesaid by such coal retailer, and
(c) requiring such coal retailer, within two days after complying with the foregoing requirements of such notice, to send to the Minister in the manner stated in such notice a statement of the quantity or several quantities of turf obtained by such coal retailer in compliance with such notice and the source from which and the date on which such quantity, or every such quantity, of turf was so obtained.
(2) Every coal retailer on whom a notice is served under this section shall, within the time specified in that behalf in such notice, obtain from some approved source or sources the quantity of turf specified in that behalf in such notice, and if such coal retailer fails so to obtain the said quantity of turf he shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding one pound for every ton or part of a ton of turf which he was required by such notice so to obtain or, if he has duly obtained part of the quantity of turf which he was so required to obtain, not exceeding one pound for every ton or part of a ton by which the said part of the said quantity of turf falls short of the full amount of the said quantity of turf.
(3) Every coal retailer, on whom a notice is served under this section shall, within the time specified in that behalf in such notice, send to the Minister in accordance in all respects with such notice such statement as he is required by such notice so to send and if he fails so to send such statement he shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.
(4) The following provisions shall have effect in relation to the prosecution of a coal retailer for an offence under any sub-section of this section, that is to say:—
(a) the notice under this section in relation to which such offence is alleged to have been committed shall be evidence, until the contrary is proved, of the several matters of fact stated in such notice in respect of the quantities of turf obtained by, in the possession of, or sold and delivered or which ought to have been sold and delivered by such coal retailer;
(b) an error in the statement of all or any of the said matters of fact in such notice shall not invalidate such notice if the quantity of turf which such coal retailer is required by such notice to obtain does not exceed the quantity of turf which he could lawfully have been so required to obtain if all such matters of fact had been correctly stated in such notice;
(c) the Court may, if it so thinks proper on the application of the prosecutor or of such coal retailer, amend the statement in such notice of any of the said matters of fact or of the quantity of turf which such coal retailer is required by such notice to obtain, and where the Court so amends such notice, such notice shall for all purposes have and be deemed always to have had effect as so amended;
(d) every record kept by such coal retailer in pursuance of this Act shall be admissible in evidence at the instance of either the prosecutor or such coal retailer, and the Court may, if it so thinks proper on the application of the prosecutor, compel such coal retailer to produce any such record and all invoices, consignment notes, receipts and other documents (including copies thereof where the originals are not available) in the possession of such coal retailer and necessary in the opinion of the Court for the purpose of verifying any entry in or proving or explaining any omission from such record;
(e) every return made by such coal retailer to the Minister in pursuance of this Act shall be admissible in evidence at the instance of either the prosecutor or such coal retailer, and the Court may, if it so thinks proper on the application of such coal retailer, compel the production by the Minister of any such return.
Exemptions from compulsory purchase of turf.
18.—(1) The Minister may, if and whenever he thinks proper so to do, grant to any person an exemption from the provisions of this Act relating to the compulsory purchase of turf.
(2) Every exemption granted under this section—
(a) shall be in the prescribed form, and
(b) may be granted for a limited period or without any limitation of time, and
(c) may be granted subject to such (if any) limitations (specified in such exemption) as the Minister shall think proper in relation to the coal to which the exemption applies, whether in respect of the quantity, quality, place of purchase, place or purpose of user of or any other matter connected with such coal, and
(d) shall be expressed and shall operate to relieve the person to whom it is granted from the obligation to comply with the provisions of this Act relating to the compulsory purchase of turf during the period specified in that behalf in the exemption or, where no such period is so expressed, without limitation of time, but subject to such (if any) limitations authorised by this sub-section as shall be specified in the exemption.
(3) An exemption granted under this section may be revoked at any time by the Minister at his absolute discretion.
Exemption in respect of turf purchased from the Board.
19.—(1) Whenever a person purchases a particular quantity of turf from an approved source and the Board, society, or company which is such approved source is satisfied that such turf is purchased for consumption for domestic or household purposes by such person in a particular appointed area, such Board, society, or company (as the case may be) shall, if so required by such person, give to such person a certificate, counter-signed by an officer of the Minister, certifying that such person has purchased from such approved source the said quantity of turf for consumption for domestic or household purposes by such person in the said appointed area.
(2) Whenever a person who holds an unexhausted certificate issued to him under this section by the Board or a society or company which is an approved source purchases coal from a coal retailer for consumption for domestic or household purposes in the appointed area mentioned in such certificate and the provisions of this Act relating to the compulsory purchase of turf apply to such purchase of coal, the purchase of turf from an approved source which is the subject of such certificate shall be deemed to be a compliance with the said provisions of this Act so far as the same apply to the said purchase of coal, but not to a greater extent than the quantity of turf in respect of which such certificate is effective at the time of such purchase of coal.
(3) Whenever coal is purchased by any person from a coal retailer and a certificate issued under this section is used by such person as a compliance in respect of such purchase of coal with the provisions of this Act relating to the compulsory purchase of turf, such coal retailer shall endorse on such certificate the prescribed particulars of such purchase of coal, including the quantity of turf which, but for such certificate, would have been required by the said provisions of this Act to have been purchased by such person in respect of such purchase of coal.
(4) A certificate issued under this section shall not relieve the person to whom it is issued from compliance with the provisions of this Act relating to the compulsory purchase of turf unless the endorsement mentioned in the next preceding sub-section of this section is duly made on such certificate on every occasion on which it is used as a compliance with the said provisions of this Act.
(5) For the purposes of this section—
(a) a certificate issued under this section shall be deemed to be unexhausted so long as the total quantity of turf mentioned in the endorsements made on such certificate in pursuance of this section does not exceed the quantity of turf certified by such certificate to have been purchased from an approved source, and
(b) a certificate issued under this section shall be deemed at any particular time to be effective in respect of the quantity of turf by which the quantity of turf certified by such certificate to have been purchased from an approved source exceeds the total quantity of turf mentioned in the endorsements made on such certificate in pursuance of this section.
Application of this Act to sales of two hundred-weights or less of coal.
20.—Where a person (in this section referred to as a sub-retailer) carries on the business of buying coal from another person (in this section referred to as a merchant) and selling such coal by retail in quantities not exceeding two hundredweights (whether such sub-retailer does or does not pay such merchant the full retail price for such coal and whether such sub-retailer does or does not also sell such coal in quantities exceeding two hundredweights), the following provisions shall have effect in respect of all coal purchased by such sub-retailer from such merchant and sold by such sub-retailer by retail in quantities not exceeding two hundredweights for consumption for domestic or household purposes in an appointed area, that is to say:—
(a) such sub-retailer shall be deemed for the purposes of this Act to have purchased such coal from such merchant for consumption for domestic or household purposes in an appointed area, and
(b) such merchant shall be deemed for the purposes of this Act to have sold such coal to such sub-retailer by retail for consumption for domestic or household purposes in an appointed area, and
(c) this Act and, in particular, the provisions of this Act relating to the compulsory purchase of turf shall apply to such sub-retailer and to such merchant accordingly.
Power of the Minister to purchase land from the Irish Land Commission for the Board.
21.—(1) The Minister may, if and whenever he so thinks proper on the recommendation of the Board, purchase from the Irish Land Commission for and on behalf of the Board any land vested in the Irish Land Commission which is required by the Board for all or any of the following purposes, that is to say, the production, the preparation for sale, or the storage of turf, or any purpose ancillary to such production, preparation, or storage.
(2) The following provisions shall have effect in respect of every purchase of land by the Minister from the Irish Land Commission under this section, that is to say:—
(a) such land shall be so purchased at such price and upon such other terms and conditions as shall be agreed upon by the Minister and the Irish Land Commission, subject to the restriction that in assessing such price no regard shall be had to, nor any enhancement of price allowed for, any improvements executed on such land with moneys paid or advanced out of the Central Fund or out of moneys provided by the Oireachtas;
(b) such land shall be conveyed by the Irish Land Commission to the Board;
(c) the price to be paid by the Minister to the Irish Land Commission for such land shall be provided and paid by the Board;
(d) the Board shall defray all the costs and expenses of the Minister and of the Irish Land Commission of or incidental to such purchase.
(3) In this section (except this sub-section) the word “land” includes any easement, profit á prendre, or other right over or in relation to any land, and the power of purchase conferred by this section shall extend to the purchase of any such right, whether in conjunction with or apart from the purchase of land.
General power of the Minister to purchase land for the Board.
22.—(1) The Minister may, if and whenever he so thinks proper on the recommendation of the Board, purchase by agreement or compulsorily from any person for and on behalf of the Board any land which is required by the Board for all or any of the following purposes, that is to say, the production, the preparation for sale, or the storage of turf, or any purpose ancillary to such production, preparation, or storage.
(2) Every officer of the Board authorised in that behalf in writing by the Minister is hereby authorised and empowered to enter on any land which is required by the Board under this section for the purpose of making thereon any inquiry, investigation, or examination preliminary or incidental to the purchase of such land by the Minister.
(3) The following provisions shall have effect in relation to every purchase (whether by agreement or compulsorily) of land by the Minister under this section, that is to say:—
(a) the price to be paid by the Minister for such land shall, in default of agreement, be assessed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919;
(b) in assessing (whether by agreement or under the next preceding paragraph of this sub-section) the said price, no regard shall be had to, nor any enhancement of price allowed for, any improvements executed on such land with moneys paid or advanced out of the Central Fund or out of moneys provided by the Oireachtas;
(c) such land shall be conveyed to the Board;
(d) sections 69 to 83 of the Lands Clauses Consolidation Act, 1845, shall apply to the said price and to the conveyance of such land to the Board, and for the purpose of such application the Minister shall be deemed to be the promoter of the undertaking;
(e) the said price shall be provided and paid by the Board;
(f) at any time before assessment of such price or conveyance of such land to the Board, but subject to giving not less than one month's or, in the case of an occupied dwelling-house, three months' previous notice in writing to the occupier of such land, the Board may, with the consent of the Minister, enter on and take possession of such land, but in every such case the Board shall pay to such occupier interest on the amount of such price when assessed at the rate of four per cent. per annum from the date of such entry to the date of payment of such price;
(g) the Board shall defray all the costs and expenses of the Minister of or incidental to such purchase, including all costs and expenses of the vendor of such land lawfully payable by the Minister.
(4) In this section (except this sub-section) the word “land” includes any easement, profit a prendre, or other right over or in relation to any land, and the powers of purchase and of entry and taking possession conferred by this section shall extend to the purchase of any such right (whether in conjunction with or apart from the purchase of land) and to the exercise of such right, and for that purpose references to the occupier of such land shall include the owner of such right.
Records to be kept by registered coal retailers.
23.—(1) Every registered coal retailer shall keep or cause to be kept the prescribed records in the prescribed form of all coal and all turf bought, received, sold, or delivered by him and, shall, not later than the next day which is not a Sunday or a bank holiday after such buying, receipt, sale or delivery, make or cause to be made in every such record the prescribed entries in respect thereof.
(2) Regulations made under this Act prescribing the records to be kept in pursuance of this section may require that a registered coal retailer who is registered in respect of two or more distinct premises shall keep separate such records in respect of each such distinct premises.
(3) Every record kept in pursuance of this section may be inspected at any time during office hours by an inspector or by an officer of the Board authorised for the purpose by the Minister in writing or by a member of the Gárda Síochana, and it shall be the duty of the person liable under this section to keep such record to produce for the inspection of such inspector, officer, or member on demand such record and also all invoices, consignment notes, receipts, and other documents (including copies thereof where the originals are not available) reasonably demanded by such inspector, officer or member for the purpose of verifying any entry in or explaining any omission from such record.
(4) If any person—
(a) fails to keep or cause to be kept such record as is required by this section to be kept or caused to be kept by him; or
(b) fails to make or cause to be made in such record, within the time limited by this section, any entry required by this section to be made by him in such record; or
(c) fails to produce or cause to be produced on demand for inspection by an inspector or by an officer of the Board authorised for the purpose by the Minister in writing or by a member of the Gárda Síochána any record, document, or copy of a document which he is required by this section to produce for such inspection, or obstructs any inspector or any such officer or member in the making of such inspection; or
(d) wilfully or negligently makes or causes to be made in such record any entry which is false or misleading in any material particular,
he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
(5) For the purposes of this section—
(a) inspection of a record or document shall include taking copies thereof or making extracts therefrom; and
(b) a demand under this section by an inspector, an officer of the Board or a member of the Gárda Síochána for the production of a record or document for inspection shall be deemed to have been duly made to the person liable under this section to keep such record or the record to which such document relates (as the case may be) if such demand is made verbally at such premises to any individual in the employment of such person; and
(c) a refusal or failure to produce for inspection under this section a record or document, if made or committed at the premises at which such record or document is kept by an individual in the employment of the person liable under this section to produce such record or document, shall be deemed to have been made or committed by such person; and
(d) the expression “office hours” means—
(i) in relation to any day (not being a Sunday, a bank holiday, or a locally observed holiday or half-holiday), any time between the hours of ten o'clock in the morning and five o'clock in the afternoon during which business is being carried on or work is being done at the relevant premises; and
(ii) in relation to any locally observed half-holiday, any time between the hours of ten o'clock in the morning and one o'clock in the afternoon during which business is being carried on or work is being done at the relevant premises.
Returns to be made by registered coal retailers.
24.—(1) The Minister may by order make regulations requiring registered coal retailers to make periodical returns to the Minister showing the quantities of coal and of turf bought by them, the quantities of coal and of turf sold by them, and such other matters relating to the purchase or the sale of such coal or of such turf as the Minister shall think proper to specify in such regulations, and the Minister may by such regulations prescribe the persons by whom, the times at which, and the form and manner in which such returns are to be made.
(2) Every person, required by regulations made under this section to make any return, who fails or refuses to make such return in accordance in all respects with such regulations or who makes in any such return any statement which is false or misleading in any material respect shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first such offence, to a fine not exceeding ten pounds, and in the case of a second or any subsequent such offence to a fine not exceeding twenty-five pounds.
Power to require returns from unregistered coal retailers.
25.—(1) The Minister may, whenever he so thinks proper, serve on any coal retailer (whether carrying on business in or outside an appointed area) who is not a registered coal retailer a notice in writing requiring such coal retailer within a specified time not less than seven days from the service of such notice to make to the Minister a return showing the quantity of coal and of turf bought by such coal retailer during a specified period, the quantity of coal and of turf sold by such coal retailer during such period, and such other matters relating to the purchase or the sale of such coal and such turf as the Minister shall think proper and shall specify in such notice.
(2) Every coal retailer on whom a notice is served under this section shall, within the time specified in that behalf in such notice, make to the Minister such return as is required of him by such notice, and if such coal retailer fails so to make such return or makes any such return which is false or misleading in any material respect he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Publication of registers, returns, and statistics.
26.—(1) The Minister may publish, in such manner as he may think fit, all or any of the matters entered in a register and may also so publish notice of the cancellation or alteration by him of the registration of any person registered in a register.
(2) No individual return or part of a return furnished in pursuance of this Act shall be published or disclosed except to the Board or for the purpose of a prosecution under this Act.
(3) The Minister may, from time to time, collect and publish such statistical information (including statistics derived from returns made pursuant to this Act) as he shall think fit with respect to any matter to which this Act relates, but so far as is reasonably practicable, no statistical information so published shall contain any particulars which would enable any person to identify such particulars as being particulars relating to any individual person, business, or concern.
Custody of and evidence of con tents of registers.
27.—(1) Every register shall be—
(a) deemed to be in the proper custody when in the custody of the Minister or of an officer of the Minister authorised in that behalf by the Minister, and
(b) admissible in evidence without further proof on production from the proper custody.
(2) Prima facie evidence of any entry in a register may be given in any court or any legal proceedings by the production of a copy of such entry purporting to be certified to be a true copy by an officer of the Minister authorised in that behalf by the Minister, and it shall not be necessary to prove the signature of such officer or that he was in fact such officer or was so authorised.
(3) A certificate, purporting to be under the hand of an officer of the Minister authorised in that behalf by the Minister, that any person specified in such certificate is not registered in any specified register shall in any court or legal proceedings be prima facie evidence of the matters so certified, and it shall not be necessary to prove the signature of such officer, or that he was in fact such officer, or was in fact so authorised.
(4) Any person may—
(a) obtain a copy, certified in manner hereinbefore mentioned to be a true copy, of any entry in a register kept in pursuance of this Act on payment to the Minister of a fee of sixpence for each folio of seventy-two words of the copy;
(b) obtain such certificate as is hereinbefore mentioned that any specified person is not registered in a specified register or registers kept in pursuance of this Act on payment to the Minister of a fee of one shilling for each such certificate.
Powers of inspection and examination.
28.—(1) Every inspector and every officer of the Board authorised in that behalf in writing by the Minister and every member of the Gárda Síochána is hereby authorised and empowered to do all or any of the following things, that is to say:—
(a) at all reasonable times to enter upon and have free access to the interior of any registered premises or of any unregistered premises in which coal or turf is or is believed to be sold, or kept, exposed or stored for sale, or the premises of any person engaged in the business of carrying goods for reward, or any boat, railway waggon, motor lorry, cart, or other vehicle used for the conveyance of goods;
(b) to examine all coal and all turf found in any premises, boat, or vehicle to the interior of which he has access by virtue of this section, and for that purpose to open any bag, sack, or other package found in such place and containing or believed to contain coal or turf;
(c) at any time or place to ask of any person who has or at any time had the custody or possession of any coal or turf found in the exercise of any of the powers conferred by this section such questions in relation to such coal or turf as such inspector, officer, or member shall think proper, and to demand and take the name and address of such person and also to demand and take from such person the name and address of the owner or consignee of such coal or turf;
(d) at any time or place to demand of any person who has or at any time had the custody or possession of any coal or turf found in the course of the exercise of any of the powers conferred by this section, the production of all records, invoices, consignment notes, receipts and other documents (including copies thereof where the originals are not available) relating to such coal or turf, and to take copies of and make extracts from any such documents (including copies thereof as aforesaid).
(2) In the exercise in or upon the premises of any shipping or railway company of the powers conferred on him by this section, every inspector and every officer of the Board and member of the Gárda Síochána shall conform to such reasonable requirements of such company as are necessary to prevent the working of the traffic on such premises being obstructed or interfered with.
(3) Every person who shall do any of the following things, that is to say:—
(a) obstruct or impede any inspector or any officer of the Board or member of the Gárda Síochána in the exercise of any of the powers conferred on such inspector, officer or member by this section, or
(b) fail or refuse to answer to the best of his knowledge and ability any question asked of him by such inspector, officer or member in exercise of a power in that behalf conferred by this section, or
(c) give an answer to any such question which is to his knowledge false or misleading, or
(d) when his own or any other name or address is demanded of him by any such inspector, officer or member in exercise of a power in that behalf conferred by this section, fail or refuse to give such address, or give a name or an address which is false or misleading, or
(e) fail or refuse to produce any document the production of which is lawfully demanded of him by any such inspector, officer or member in exercise of any of the powers in that behalf conferred by this section, or fail or refuse to permit any such inspector, officer or member to take copies of or to make extracts from any such document,
shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty pounds.
Inspectors' certificates of appointment.
29.—Every inspector shall be provided with a certificate in the prescribed form of his appointment as such inspector and, when exercising any of the powers conferred on an inspector by or under this Act, shall, if so required, produce such certificate to any person affected.
Attestation and service of notices.
30.—(1) Every notice served under this Act on a coal retailer shall, if failure to comply with such notice is declared by this Act to be an offence, be sealed with the official seal of the Minister.
(2) Every notice which is required or authorised by this Act to be served on a coal retailer may be so served—
(a) by delivering such notice to such coal retailer, or
(b) by delivering such notice at any place at which such coal retailer carries on business as a coal retailer to a person of or over the age of sixteen years in the employment of such coal retailer in relation to such business, or
(c) by sending such notice by prepaid registered post addressed to such coal retailer, if he is a registered coal retailer, at any premises in respect of which he is registered in a register kept under this Act, or if he is not a registered coal retailer, at any place at which he carries on his business as a coal retailer.
(3) Every notice served under this Act on a coal retailer may, in any prosecution of such coal retailer for failure to comply with such notice, be proved by the production of a copy of such notice sealed with the official seal of the Minister and having endorsed thereon a certificate, signed by an officer of the Minister authorised in that behalf by the Minister, certifying that such copy is a true copy of the notice so served on such coal retailer, and it shall not be necessary to prove the signature of such officer or that he was such officer as aforesaid or was so authorised as aforesaid.
Regulations.
31.—The Minister may by order make regulations for the purposes of prescribing any matter or thing which is referred to in this Act as prescribed or to be prescribed, but no such regulation shall be made in relation to the amount or collection of fees without the consent of the Minister for Finance.
Expenses.
32.—Save as is otherwise provided by this Act, all expenses incurred by the Minister in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Collection and disposal of fees.
33.—(1) All fees taken under this Act shall be collected in money and taken in such manner as the Minister for Finance may from time to time direct, and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the said Minister.
(2) The Public Offices Fees Act, 1879, shall not apply in respect of any fees payable under this Act.
Short title.
34.—This Act may be cited as the Turf (Use and Development) Act, 1936
