ACHT RIALTAIS ÁITIÚLA (BAILE ÁTHA CLIATH) (LEASÚ), 1931.
Mínithe.
1.—(1) San Acht so—
cialluíonn an abairt “an Príomh-Acht” an tAcht Rialtais Áitiúla (Baile Atha Cliath), 1930 (Uimh. 27 de 1930);
cialluíonn an abairt “an lá ceaptha” an lá ceapfar fén Acht so chun bheith mar lá cheaptha chun crícheanna an Achta so;
léireofar an abairt “bord conganta” mar abairt a thagrann do Bhord Chonganta Bhaile Atha Cliath, do Bhord Chonganta Ráth Dúin, agus do Bhord Chonganta Bhaile an Ridire agus ní d'aon bhord ná cólucht eile agus a fholuíonn na buird sin agus ní haon bhord ná cólucht eile.
(2) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, cialluíonn gach focal agus abairt a húsáidtear san Acht so agus a húsáidtear sa Phríomh-Acht, leis, agus go sonnrách na habairtí “Comhairle na Cathrach” agus “an Chomhairle Chontae”, cialluíd san Acht so na nithe céanna chialluíd fé seach sa Phríomh-Acht.
Feidhmeanna d'aistriú go dtí Bord Conganta Bhaile Atha Cliath.
2.—(1) Ar an lá ceaptha, scuirfidh an tOrdú dar dáta an 21adh lá de Mhí na Samhna, 1923, agus do rinneadh fé alt 12 den Acht um Rialtas Áitiúil (Forálacha Sealadacha), 1923 (Uimh. 9 de 1923), agus le n-ar scuireadh Bord Caomhnóirí Aontais Bhaile Atha Cliath, scuirfidh d'éifeacht do bheith aige d'ainneoin éinní atá in alt 91 den Phríomh-Acht agus tiocfaidh an bord san chun bheith agus beidh sé scurtha ar fad de bhuadh an ailt seo.
(2) Ar an lá ceaptha tiocfaidh feidhmeanna, comhachta, agus dualgaisí Bhuird Chaomhnóirí Aontais Bhaile Atha Cliath (ar a n-áirmhítear na feidhmeanna, na comhachta, agus na dualgaisí atá ag Coiste Aontais Bhaile Atha Cliath fé chó-oibriú an Orduithe sin dar dáta an 21adh lá de Mhí na Samhna, 1923, agus ailt 91 den Phríomh-Acht) chun bheith agus beid aistrithe go dtí Bord Conganta Bhaile Atha Cliath agus as san amach beid dílsithe sa bhord san agus infheidhmithe acu agus cólíonfaid iad.
Feidhmeanna d'aistriú go dtí Bord Conganta Ráth Dúin.
3.—(1) Ar an lá ceaptha scuirfidh fo-alt (3) d'alt 92 den Phríomh-Acht d'éifeacht do bheith aige agus tiocfaidh Bord Caomhnóirí Aontaís Ráth Dúin chun bheith agus beidh sé scurtha ar fad de bhuadh an ailt seo.
(2) Ar an lá ceaptha tiocfaidh feidhmeanna, comhachta, agus dualgaisí Bhuird Chaomhnóirí Aontais Ráth Dúin (ar a n-áirmhítear na feidhmeanna, na comhachta, agus na dualgaisí atá ag Coiste Aontais Ráth Dúin fé alt 92 den Phríomh-Acht) chun bheith agus beid aistrithe go dtí Bord Conganta Ráth Dúin agus as san amach beid dílsithe sa bhord san agus infheidhmithe acu agus cólíonfaid iad.

4.—(1) Ar an lá ceaptha scuirfidh fo-alt (3) d'alt 93 den Phríomh-Acht d'éifeacht do bheith aige agus tiocfaidh Bord Caomhnóirí Aontais Bhaile an Ridire chun bheith agus beidh sé scurtha ar fad de bhuadh an ailt seo.
(2) Ar an lá ceaptha tiocfaidh feidhmeanna, comhachta, agus dualgaisí Bhuird Chaomhnóirí Aontais Bhaile an Ridire (ar a n-áirmhítear na feidhmeanna, na comhachta, agus na dualgaisí atá ag Coiste Aontais Bhaile an Ridire fé alt 93 den Phríomh-Acht) chun bheith agus beid aistrithe go dtí Bord Conganta Bhaile an Ridire agus as san amach beid dílsithe sa bhord san agus infheidhmithe acu agus cólíonfaid iad.

5.—(1) Na hailt agus na fo-ailt uile agus fé seach den Phríomh-Acht a luaidhtear sa Sceideal a ghabhann leis an Acht so, beidh feidhm agus éifeacht acu, fé réir forálacha an ailt seo, maidir le gach ceann fé leith de sna buird chonganta uile agus fé seach fé is dá ndeintí na hailt sin do chur síos agus d'ath-achtú anso.
(2) Chun go mbeidh feidhm ag na hailt agus na fo-ailt sin den Phríomh-Acht do réir an ailt seo, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) déanfar an abairt “an lá ceaptha”, i ngach áit ina bhfuil sí sna hailt agus sna fo-ailt sin, do léiriú mar abairt a thagrann don lá cheaptha fén Acht so;
(b) beidh Bord Caomhnóirí Aontais Bhaile Atha Cliath, Coiste Aontais Bhaile Atha Cliath, agus gach duine no cólucht eile chun ar haistríodh maoin, comhachta, agus dualgaisí an Bhuird sin leis an Ordú dar dáta an 23adh lá de Mhí na Samhna, 1923, agus a luaidhtear in alt 91 den Phríomh-Acht, beidh gach ceann fé leith acu ina chólucht díochurtha agus beidh Bord Conganta Bhaile Atha Cliath mar chomharba do gach cólucht díochurtha acu san;
(c) beidh Bord Caomhnóirí Aontais Ráth Dúin agus Coiste Aontais Ráth Dúin ina dhá gcólucht díochurtha agus beidh Bord Conganta Ráth Dúin mar chomharba do gach cólucht díochurtha fé leith acu san;
(d) beidh Bord Caomhnóirí Aontais Bhaile an Ridire agus Coiste Aontais Bhaile an Ridire ina dhá gcólucht díochurtha agus beidh Bord Conganta Bhaile an Ridire mar chomharba do gach cólucht díochurtha fé leith acu san.
Bord Conganta Bhaile Atha Cliath do bhunú.
6.—(1) Ar an lá ceaptha bunófar Bord Conganta Bhaile Atha Cliath do réir an Achta so chun na bhfeidhmeanna a haistrítear chuige leis an Acht so agus pé feidhmeanna eile ceapfar do o am go ham do réir dlí do chólíonadh.
(2) Beidh Bord Conganta Bhaile Atha Cliath ina chólucht chorparáideach fén ainm sin agus comhacht aige séala corporáideach do sholáthar do féin agus bheith i seilbh tailimh do réir aon tsaghas sealbhaíochta chun críche na bhfeidhmeanna bheidh dílsithe ann de thurus na huaire do réir dlí.
(3) Beidh Bord Conganta Bhaile Atha Cliath có-dhéanta de sheisear daoine cheapfaidh Comhairle na Cathrach, de thriúr daoine cheapfaidh an Chomhairle Chontae, agus de pé daoine (más éinne é) ceapfar o am go ham fén Acht so chun bheith ina mbaill chó-thoghtha den Bhord san.

7.—(1) Chó luath agus is féidir é tar éis an Achta so do rith—
(a) ceapfaidh Comhairle na Cathrach beirt daoine chun teacht chun bheith agus chun bheith ina mbaill de Bhord Chonganta Bhaile Atha Cliath ar an lá ceaptha; agus
(b) ceapfaidh an Chomhairle Chontae beirt daoine chun teacht chun bheith agus chun bheith ina mbaill de Bhord Chonganta Bhaile Atha Cliath ar an lá ceaptha; agus
(c) más rud é, le linn an Achta so do rith, go mbeidh aon ionaid folamh de sna hionaid sin imeasc ballra Choiste Aontais Bhaile Atha Cliath gur gá do réir ailt 91 den Phríomh-Acht gur daoine do cheapfadh Chomhairle na Cathrach do líonfadh iad, ceapfaidh Comhairle na Cathrach daoine chun gach ionaid den tsórt san do líonadh láithreach; agus
(d) más rud é, le linn an Achta so do rith, go mbeidh an t-ionad san folamh imeasc ballra Choiste Aontais Bhaile Atha Cliath gur gá do réir ailt 91 den Phríomh-Acht gur duine do cheapfadh an Chomhairle Chontae do líonfadh é, ceapfaidh an Chomhairle Chontae duine chun an ionaid sin do líonadh láithreach.
(2) Na daoine bheidh ina mbaill de Choiste Aontais Bhaile Atha Cliath díreach roimh an lá ceaptha, tiocfaid chun bheith agus beid, ar an lá ceaptha, ina mbaill de Bhord Chonganta Bhaile Atha Cliath.
(3) Gach ball de Choiste Aontais Bhaile Atha Cliath éagfaidh, eireoidh as, no thiocfaidh fé dhí-cháilíocht tar éis an Achta so do rith agus roimh an lá ceaptha agus fós gach duine ceapfar fén alt so chun teacht chun bheith ina bhall de Bhord Chonganta Bhaile Atha Cliath ar an lá ceaptha agus éagfaidh roimh an lá ceaptha, tuigfear, chun crícheanna an Achta so, gur tháinig sé chun bheith ina bhall de Bhord Chonganta Bhaile Atha Cliath ar an lá ceaptha agus gur éag, gur eirigh as, no gur tháinig fé dhícháilíocht (pe'ca aca é) an lá tar éis an lae cheaptha.
Baill chóthoghtha de Bhord Chonganta Bhaile Atha Cliath.
8.—(1) Fé réir na teorann a forchuirtear leis an alt so, féadfaidh Bord Conganta Bhaile Atha Cliath, pé uair is oiriúnach leo é, duine ar bith is dóich leo is ceart do chó-thogha chun bheith ina bhall den Bhord san.
(2) Gach duine có-thoghfar fén alt so chun bheith ina bhall de Bhord Chonganta Bhaile Atha Cliath, beidh sé, marab éag, eirghe as, no teacht fé dhí-cháilíocht roimhe sin do, i seilbh oifige mar bhall den tsórt san go dtí tosach an chéad chruinnithe den bhord san tar éis pé ní acu so leanas is túisce thárlóidh tar éis a cheaptha, sé sin le rá, toghachán cinn trí mblian do bhaill Chomhairle na Cathrach no toghachán cinn trí mblian do bhaill na Comhairle Contae.
(3) Ní bheidh aon uair níos mó ná beirt bhall de Bhord Chonganta Bhaile Atha Cliath ar n-a gcó-thogha fén alt so.
(4) Baill chó-thoghtha gairmtear san Acht so de bhaill de Bhord Chonganta Bhaile Atha Cliath a có-thoghfar fén alt so.
Bord Conganta Ráth Dúin do bhunú.
9.—(1) Ar an lá ceaptha bunófar Bord Conganta Ráth Dúin do réir an Achta so chun na bhfeidhmeanna a haistrítear chuige leis an Acht so agus pé feidhmeanna eile ceapfar do o am go ham do réir dlí do chólíonadh.
(2) Beidh Bord Congantá Ráth Dúin ina chólucht chorparáideach fén ainm sin agus comhacht aige séala corporáideach do sholáthar do féin agus bheith i seilbh tailimh do réir aon tsaghas sealbhaíochta chun críche na bhfeidhmeanna bheidh dílsithe ann de thurus na huaire do réir dlí.
(3) Beidh Bord Conganta Ráth Dúin có-dhéanta de pé méid ball is dóich leis an gComhairle Chontae o am go ham do bheith ceart agus, mara bhforálaidh agus go dtí go bhforálfaidh an Chomhairle Chontae a mhalairt, beidh an Bord san có-dhéanta den méid ball is ionann agus lán-líon ballra Choiste Aontais Ráth Dúin le linn an Achta so do rith.
(4) Tar éis an lae cheaptha isí an Chomhairle Chontae cheapfaidh gach ball de Bhord Chonganta Ráth Dúin.
(5) Roimh an lá ceaptha ceapfaidh an Chomhairle Chontae daoine chun gach folúntais (más aon cheann é) atá imeasc ballra Choiste Aontais Ráth Dúin le linn an Achta so do rith.
(6) Na daoine bheidh ina mbaill de Choiste Aontais Ráth Dúin díreach roimh an lá ceaptha, tiocfaid chun bheith agus beid, ar an lá ceaptha, ina mbaill de Bhord Chonganta Ráth Dúin.
(7) Gach ball de Choiste Aontais Ráth Dúin éagfaidh, eireoidh as, no thiocfaidh fé dhí-cháilíocht tar éis an Achta so do rith agus roimh an lá ceaptha, tuigfear, chun crícheanna an Achta so, gur tháinig sé chun bheith ina bhall de Bhord Chonganta Ráth Dúin ar an lá ceaptha agus gur éag, gur eirigh as, no gur tháinig fé dhí-cháilíocht (pe'ca aca é) an lá tar éis an lae cheaptha.

10.—(1) Ar an lá ceaptha bunófar Bord Conganta Bhaile an Ridire do réir an Achta so chun na bhfeidhmeanna a haistrítear chuige leis an Acht so agus pé feidhmeanna eile ceapfar do o am go ham do réir dlí do chólíonadh.
(2) Beidh Bord Conganta Bhaile an Ridire ina chólucht chorparáideach fén ainm sin agus comhacht aige séala corporáideach do sholáthar do féin agus bheith i seilbh tailimh do réir aon tsaghas sealbhaíochta chun críche na bhfeidhmeanna bheidh dílsithe ann de thurus na huaire do réir dlí.
(3) Beidh Bord Conganta Bhaile an Ridire có-dhéanta de pé méid ball is dóich leis an gComhairle Chontae o am go ham do bheith ceart agus, mara bhforálaidh agus do dtí go bhforálfaidh an Chomhairle Chontae a mhalairt, beidh an Bord san có-dhéanta den méid ball is ionann agus lán-líon ballra Choiste Aontais Bhaile an Ridire le linn an Achta so do rith.

(7) Gach ball de Choiste Aontais Bhaile an Ridire éagfaidh, eireoidh as, no thiocfaidh fé dhí-cháilíocht tar éis an Achta so do rith agus roimh an lá ceaptha, tuigfear, chun crícheanna an Achta so, gur tháinig sé chun bheith ina bhall de Bhord Chonganta Bhaile an Ridire ar an lá ceaptha agus gur éag, gur eirigh as, no gur tháinig fé dhí cháilíocht (pe'ca aca é) an lá tar éis an lae cheaptha.
Ceapadh agus téarma oifige ball de bhuird chonganta.
11.—(1) Tar éis an lae cheaptha is i gcionn gach tríú bliana, ag an gcéad chruinniú cinn ráithe de Chomhairle na Cathrach tar éis toghacháin cinn trí mblian, a cheapfaidh an Chomhairle sin na baill de Bhord Chonganta Bhaile Atha Cliath gur gá do réir an Achta so gurb í an Chomhairle sin do cheapfadh iad (seachas baill a ceapfar chun foth-fholúntas).
(2) Tar éis an lae cheaptha is i gcionn gach tríú bliana, ag an gcéad chruinniú, bliantúil den Chomhairle Chontae tar éis toghacháin cinn trí mblian, a cheapfaidh an Chomhairle sin na baill de Bhord Chonganta Bhaile Atha Cliath gur gá do réir an Achta so gurb í an Chomhairle sin do cheapfadh iad agus fós baill uile Bhuird Chonganta Ráth Dúin agus Bhuird Chonganta Bhaile an Ridire fé seach (seachas baill d'aon bhord acu san a ceapfar chun foth-fholúntas).
(3) Isé am go dtosnóidh téarma oifige baill de bhord chonganta ceapfar fén Acht so tar éis an lae cheaptha (seachas baill a ceapfar chun foth-fholúntas agus baill chó-thoghtha de Bhord Chonganta Bhaile Atha Cliath) ná i dtosach an chéad chruinnithe den bhord san tar éis an bhaill sin do cheapadh.
(4) Isé am go gcríochnóidh téarma oifige baill de bhord chonganta (seachas baill chó-thoghtha de Bhord Chonganta Bhaile Atha Cliath) ná díreach roimh thosach téarma oifige a chomharba.

12.—(1) Pé uair a thárlóidh folúntas (dá ngairmtear fothfholúntas san Acht so) imeasc ballra buird chonganta tré bhall den bhord san (seachas baill chó-thoghtha de Bhord Chonganta Bhaile Atha Cliath) d'éag, d'eirghe as, no do theacht fé dhícháilíocht—
(a) ceapfaidh Comhairle na Cathrach duine chun an fholúntais sin i gcás folúntais imeasc ballra Bhuird Chonganta Bhaile Atha Cliath do thárla tré éag, eirghe as, no teacht fé dhí-cháilíocht do bhall de do cheap Comhairle na Cathrach; agus
(b) ceapfaidh an Chomhairle Chontae duine chun an fholúntais sin i ngach cás eile.
(2) Duine ceapfar fén alt so chun foth-fholúntais imeasc ballra buird chonganta beidh sé i seilbh oifige ar feadh an iarsma den téarma go mbeadh ag an mball, 'nar thárla an folúntas san tré éag, eirghe as, no teacht fé dhí-cháilíocht do, seilbh oifige mara mbeadh a éag, a eirghe as, no a theacht fé dhí-cháilíocht.

13.—(1) An dlí bhaineann le quorum, cruinnithe, imeachta, agus dí-cháiliú ball bord caomhnóirí, bainfe sí le quorum, cruinnithe, imeachta, agus dí-cháiliú ball bord conganta díreach fé mar a bhaineann sí le quorum, cruinnithe, imeachta, agus dí-cháiliú ball bord caomhnóirí.
(2) Comórfar an chéad chruinniú de bhord chonganta pé uair agus pé lá agus pé áit a socrófar chuige sin roimh an lá ceaptha ag an gcoiste aontais go n-aistrítear a bhfeidhmeanna go dtí an bord san leis an Acht so.
(3) Féadfaidh bord conganta gníomhú d'ainneoin folúntais no folúntaisí imeasc a bhallraíochta.
(4) Féadfaidh an tAire Rialtais Áitiúla agus Sláinte Puiblí, le hordú, oiriúnú agus atharú do dhéanamh ar aon Acht a bhaineann le quorum, cruinnithe, imeachta, agus dí-cháiliú ball bord caomhnóirí fé mar is dóich leis is gá chun go mbeadh lánfheidhm agus lán-éifeacht ag an Acht san maidir le buird chonganta.
(5) Gach ordú dhéanfaidh an tAire fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta agus má dheineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid, rún do rith ag cur an orduithe sin ar nea mbrí, beidh an t-ordú san curtha ar nea-mbrí dá réir sin gan dochar do dhleathacht éinní do rinneadh fén ordú san roimhe sin.

14.—Féadfaidh an tAire Rialtais Áitiúla agus Sláinte Puiblí, le hordú, lá nach déanaí ná an 31adh lá de Mhí na Nodlag, 1931, do cheapadh chun bheith mar lá cheaptha chun crícheanna an Achta so.

LOCAL GOVERNMENT (DUBLIN) (AMENDMENT) ACT, 1931.
Definitions.
1.—(1) In this Act—
the expression “the Principal Act” means the Local Government (Dublin) Act, 1930 (No. 27 of 1930);
the expression “the appointed day” means the day appointed under this Act to be the appointed day for the purposes of this Act;
the expression “board of assistance” shall be construed as referring to and including the Dublin Board of Assistance, the Rathdown Board of Assistance, and the Balrothery Board of Assistance and no other board or body.
(2) Save as is otherwise provided by this section, all words and expressions used in this Act which are also used in the Principal Act and in particular the expressions “the City Council” and “the County Council” have the same meanings in this Act as they respectively have in the Principal Act.
Transfer of functions to the Dublin Board of Assistance.
2.—(1) On the appointed day the Order dated the 21st day of November, 1923, and made under section 12 of the Local Government (Temporary Provisions) Act, 1923 (No. 9 of 1923), whereby the Board of Guardians of the Dublin Union was dissolved shall, notwithstanding anything contained in section 91 of the Principal Act, cease to have effect and the said board shall become and be finally dissolved by virtue of this section.
(2) On the appointed day the functions, powers, and duties of the Board of Guardians of the Dublin Union (including the functions, powers, and duties of the Dublin Union Committee under the joint operation of the said Order dated the 21st day of November, 1923, and section 91 of the Principal Act) shall become and be transferred to the Dublin Board of Assistance and shall thenceforward be vested in and exercisable and performed by that board.
Transfer of functions to the Rathdown Board of Assistance.
3.—(1) On the appointed day sub-section (3) of section 92 of the Principal Act shall cease to have effect and the Board of Guardians of the Rathdown Union shall become and be finally dissolved by virtue of this section.
(2) On the appointed day the functions, powers, and duties of the Board of Guardians of the Rathdown Union (including the functions, powers, and duties of the Rathdown Union Committee under section 92 of the Principal Act) shall become and be transferred to the Rathdown Board of Assistance and shall thenceforward be vested in and exercisable and performed by that board.
Transfer of functions to the Balrothery Board of Assistance.
4.—(1) On the appointed day sub-section (3) of section 93 of the Principal Act shall cease to have effect and the Board of Guardians of the Balrothery Union shall become and be finally dissolved by virtue of this section.
(2) On the appointed day the functions, powers, and duties of the Board of Guardians of the Balrothery Union (including the functions, powers, and duties of the Balrothery Union Committee under section 93 of the Principal Act) shall become and be transferred to the Balrothery Board of Assistance and shall thenceforward be vested in and exercisable and performed by that board.
Application of certain provisions of the Principal Act.
5.—(1) Subject to the provisions of this section, the several sections and sub-sections of the Principal Act which are mentioned in the Schedule to this Act shall apply and have effect in relation to each of the several boards of assistance as if those sections were here set out and re-enacted.
(2) For the purpose of the application of the said sections and sub-sections of the Principal Act in accordance with this section, the following provisions shall have effect, that is to say:—
(a) the expression “the appointed day” wherever it occurs in the said sections and sub-sections shall be construed as referring to the appointed day under this Act;
(b) the Board of Guardians of the Dublin Union, the Dublin Union Committee, and every other person or body to whom the property, powers, and duties of the said Board were transferred by the Order dated the 23rd day of November, 1923, mentioned in section 91 of the Principal Act shall each be an abolished body and the Dublin Board of Assistance shall be the successor of every such abolished body;
(c) the Board of Guardians of the Rathdown Union and the Rathdown Union Committee shall each be an abolished body and the Rathdown Board of Assistance shall be the successor of each such abolished body;
(d) the Board of Guardians of the Balrothery Union and the Balrothery Union Committee shall each be an abolished body and the Balrothery Board of Assistance shall be the successor of each such abolished body.
Establishment of the Dublin Board of Assistance.
6.—(1) On the appointed day the Dublin Board of Assistance shall be established in accordance with this Act to fulfil the functions transferred to it by this Act and such other functions as shall from time to time be assigned to it by law.
(2) The Dublin Board of Assistance shall be a corporate body under that name, with power to provide itself with a common seal and to hold land of any tenure for the purpose of the functions for the time being vested in it by law.
(3) The Dublin Board of Assistance shall consist of six persons appointed by the City Council, three persons appointed by the County Council, and such persons (if any) as may from time to time be appointed under this Act to be co-opted members of the said board.
The first members of the Dublin Board of Assistance.
7.—(1) As soon as may be after the passing of this Act—
(a) the City Council shall appoint two persons to become and be members of the Dublin Board of Assistance on the appointed day; and
(b) the County Council shall appoint two persons to become and be members of the Dublin Board of Assistance on the appointed day; and
(c) if any of the places in the membership of the Dublin Union Committee which are required by section 91 of the Principal Act to be filled by persons appointed by the City Council are vacant at the passing of this Act, the City Council shall appoint persons to fill forthwith every such place; and
(d) if the place in the membership of the Dublin Union Committee which is required by section 91 of the Principal Act to be filled by a person appointed by the County Council is vacant at the passing of this Act, the County Council shall appoint a person to fill forthwith such place.
(2) The persons who are, immediately before the appointed day, members of the Dublin Union Committee shall, on the appointed day, become and be members of the Dublin Board of Assistance.
(3) Every member of the Dublin Union Committee who dies resigns, or becomes disqualified after the passing of this Act and before the appointed day and also every person who is appointed under this section to become a member of the Dublin Board of Assistance on the appointed day and dies before the appointed day shall, for the purposes of this Act, be deemed to have become a member of the Dublin Board of Assistance on the appointed day and to have died, resigned, or become disqualified (as the case may be) on the day after the appointed day.
Co-opted members of the Dublin Board of Assistance.
8.—(1) Subject to the limitation imposed by this section, the Dublin Board of Assistance may, whenever they so think fit, co-opt any person they think proper to be a member of that board.
(2) Every person co-opted under this section to be a member of the Dublin Board of Assistance shall, unless he sooner dies, resigns, or becomes disqualified, hold office as such member until the commencement of the meeting of the said board next after whichever of the following events first happens after his appointment that is to say, a triennial election of the members of the City Council or a triennial election of the members of the County Council.
(3) There shall not at any time be more than two members of the Dublin Board of Assistance co-opted under this section.
(4) Members of the Dublin Board of Assistance co-opted under this section are referred to in this Act as co-opted members.
Establishment of the Rathdown Board of Assistance.
9.—(1) On the appointed day the Rathdown Board of Assistance shall be established in accordance with this Act to fulfil the functions transferred to it by this Act and such other functions as shall from time to time be assigned to it by law.
(2) The Rathdown Board of Assistance shall be a corporate body under that name, with power to provide itself with a common seal and to hold land of any tenure for the purpose of the functions for the time being vested in it by law.
(3) The Rathdown Board of Assistance shall consist of such number of members as the County Council shall from time to time think proper and, unless and until the County Council otherwise provides, the said Board shall consist of the number of members which at the passing of this Act constitutes the full membership of the Rathdown Union Committee.
(4) After the appointed day all the members of the Rathdown Board of Assistance shall be appointed by the County Council.
(5) The County Council shall, before the appointed day, appoint persons to fill all vacancies (if any) in the membership of the Rathdown Union Committee existing at the passing of this Act.
(6) The persons who are, immediately before the appointed day, members of the Rathdown Union Committee shall, on the appointed day, become and be members of the Rathdown Board of Assistance.
(7) Every member of the Rathdown Union Committee who dies, resigns, or becomes disqualified after the passing of this Act and before the appointed day shall, for the purposes of this Act, be deemed to have become a member of the Rathdown Board of Assistance on the appointed day and to have died, resigned, or become disqualified (as the case may be) on the day after the appointed day.
Establishment of the Balrothery Board of Assistance.
10.—(1) On the appointed day the Balrothery Board of Assistance shall be established in accordance with this Act to fulfil the functions transferred to it by this Act and such other functions as shall from time to time be assigned to it by law.
(2) The Balrothery Board of Assistance shall be a corporate body under that name, with power to provide itself with a common seal and to hold land of any tenure for the purpose of the functions for the time being vested in it by law.
(3) The Balrothery Board of Assistance shall consist of such number of members as the County Council shall from time to time think proper and, unless and until the County Council otherwise provides, the said Board shall consist of the number of members which at the passing of this Act constitutes the full membership of the Balrothery Union Committee.
(4) After the appointed day all the members of the Balrothery Board of Assistance shall be appointed by the County Council.
(5) The County Council shall, before the appointed day, appoint persons to fill all vacancies (if any) in the membership of the Balrothery Union Committee existing at the passing of this Act.
(6) The persons who are, immediately before the appointed day, members of the Balrothery Union Committee shall, on the appointed day, become and be members of the Balrothery Board of Assistance.
(7) Every member of the Balrothery Union Committee who dies, resigns or becomes disqualified after the passing of this Act and before the appointed day shall, for the purposes of this Act, be deemed to have become a member of the Balrothery Board of Assistance on the appointed day and to have died, resigned, or become disqualified (as the case may be) on the day after the appointed day.
Appointment and term of office of members of boards of assistance.
11.—(1) After the appointed day, the members of the Dublin Board of Assistance required by this Act to be appointed by the City Council (other than members appointed to fill casual vacancies) shall be appointed triennially by the City Council at the quarterly meeting of that Council held next after a triennial election.
(2) After the appointed day, the members of the Dublin Board of Assistance required by this Act to be appointed by the County Council and all the members of the Rathdown Board of Assistance and the Balrothery Board of Assistance respectively (other than members of any of the said boards appointed to fill casual vacancies) shall be appointed triennially by the County Council at the annual meeting of that Council held next after a triennial election.
(3) The term of office of a member of a board of assistance appointed under this Act after the appointed day (other than members appointed to fill casual vacancies and co-opted members of the Dublin Board of Assistance) shall begin at the commencement of the meeting of such board held next after the appointment of such member.
(4) The term of office of a member of a board of assistance (other than co-opted members of the Dublin Board of Assistance) shall terminate immediately before the commencement of the term of office of his successor.
Casual vacancies in boards of assistance.
12.—(1) Whenever a vacancy (in this Act referred to as a casual vacancy) occurs in the membership of a board of assistance by reason of the death, resignation, or disqualification of a member of such board (other than co-opted members of the Dublin Board of Assistance), a person shall be appointed to fill such vacancy—
(a) by the City Council in the case of a vacancy in the membership of the Dublin Board of Assistance occasioned by the death, resignation, or disqualification of a member thereof appointed by the City Council; and
(b) by the County Council in every other case.
(2) A person appointed under this section to fill a casual vacancy in the membership of a board of assistance shall hold office for the residue of the term for which the member whose death, resignation, or disqualification occasioned such vacancy would have held office if he had not died, resigned, or become disqualified.
Procedure, etc., of boards of assistance.
13.—(1) The law relating to the quorum, meetings, proceedings, and disqualification of members of boards of guardians shall apply to the quorum, meetings, proceedings, and disqualification of members of boards of assistance in like manner as it applies to the quorum, meetings, proceedings and disqualification of members of boards of guardians.
(2) The first meeting of a board of assistance shall be held at such hour, on such day, and at such place as shall be fixed in that behalf before the appointed day by the union committee whose functions are transferred by this Act to such board.
(3) A board of assistance may act notwithstanding one or more vacancies in its membership.
(4) The Minister for Local Government and Public Health may by order make such adaptations of and modifications in any Act relating to the quorum, meetings, proceedings, and disqualification of members of boards of guardians as may, in his opinion, be necessary to enable such Act to have full force and effect in relation to boards of assistance.
(5) Every order made by the Minister under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if either such House shall, within the next twenty-one days on which such House has sat after such order is laid before it, pass a resolution annulling such order, such order shall be annulled accordingly without prejudice to the validity of anything previously done under such order.
The Appointed day.
14.—The Minister for Local Government and Public Health may by order appoint a day, not later than the 31st day of December, 1931, to be the appointed day for the purposes of this Act.
Short title and citation.
15.—(1) This Act may be cited as the Local Government (Dublin) (Amendment) Act, 1931.
(2) The Principal Act and this Act may be cited together as the Local Government (Dublin) Acts, 1930 and 1931.
