ACHT LEICTREACHAIS NA SIONAINNE, 1925.

Mínithe.
1.—San Acht so—
cialluíonn an focal “an tAire” an tAire Tionnscail agus Tráchtála;
cialluíonn an focal “connarthóir” duine a dhineann obair don Aire fé chonnra no fé chó-aontú a dhin sé fén Acht so leis an Aire;
cialluíonn agus foluíonn an focal “údarás áitiúil” comhairle chontae, comhairle chontae-bhuirge no bhuirge eile, comhairle bhailecheanntair, agus coimisinéiri baile.
Féadfidh an tAire a thógaint air féin leictreachas do dhéanamh.
2.—Féadfidh an tAire a thógaint air féin mar ghnó leictreachas do dhéanamh agus do gheiniúint le huisce-chomhacht a gheobhfar o uiscí Abha na Sionainne agus an leictreachas a geinfar amhlaidh do roinnt agus do sholáthar, agus san Acht so gairmtear “an gnó” den ghnó san.
Comhachta generálta an Aire.
3.—(1) Chun críche an ghnótha féadfidh an tAire gach ní no éinní acu so a leanas do dhéanamh, sé sin le rá:—
(a) tithe no cóiríocht chomhnaithe eile agus ceantíní, clubanna, agus áiteanna eile úrúcháin no caitheamh aimsire d'fháil, do dhéanamh, no do sholáthar ar shlí eile agus do choinneáil i dtreo do dhaoine a bheidh ar fostú (pe'ca ag an Aire é no ag connarthóir) i ndéanamh oibreacha, i mbainistí, in oibriú, no i stiúra an ghnótha, no i ndéanamh aon ghnímh no ní eile a húdaruítear don Aire leis an Acht so a dhéanamh;
(b) uiscí Abha na Sionainne agus uiscí aon abhann no srotha a théigheann isteach inti agus uiscí aon locha, linne, no canála atá uirthi no i gceangal léi do chruinniú, do stop, do chasa, do thógaint, agus d'úsáid;
(c) Abha na Sionainne no aon abha no sruth a théigheann isteach intí do phortú, do chosc, do dhreidireacht, do dhoimhniú, do leathnú, do dhíriú, do chasa agus d'atharú ar aon tslí eile;
(d) aon loch, linn, no uisce eile ar Abha na Sionainne, no i gceangal léi díreach no nea-dhíreach, do phortú, do chosc, do dhreidireacht, a leibhéal d'atharú, agus baint leis ar aon tslí eile;
(e) comhlaí uisce, coraí, iadhtáin, bancánachtaí, agus oibreacha eile d'aistriú, no d'atharú, do dheisiú, do dhéanamh, agus do choinneáil i dtreo, pé cinn is gá chun éinní dá luaidhtear sna míreanna san roimhe seo do dhéanamh no a bhaineann le n-a dhéanamh;
(f) stáisiúin gheiniúna, tithe comhachta, stáisiúin atharúcháin, agus stáisiúin agus áiteanna eile chun leictreachas do gheiniúint, d'atharú, no do stóráil, no chun deighleáil leis ar aon tslí eile—iad do dhéanamh agus do choinneáil i dtreo;
(g) meaisíní, gléasra, agus fearaistí do cheannach, do thógaint ar cíos, no do sholáthar ar shlí eile, agus do choinneáil i dtreo do gach stáisiún geiniúna, tigh comhachta, stáisiún atharúcháin, agus stáisiún agus áit eile a déanfar fén mír sin roimhe seo, ach san i dtreo, an cumas a bheidh ag na meaisíní, ag an ngléasra, agus ag na fearaistí a soláthrófar amhlaidh chun leictreachas do gheiniúint, ná ragha sé thar céad míle each-neart go dtí go socróidh an tOireachtas a mhalairt;
(h) bóithre iarainn agus trambhealaighe (pe'ca le gail, le dógha inmheánach, no le comhacht leictriciúil a hoibrítear iad), duganna agus piaranna do dhéanamh, do chonneáil i dtreo agus d'oibriú;
(i) línte do dhéanamh agus do choinneáil i dtreo chun leictreachas d'aon voltáiste áirithe d'iompar os cionn aon tailimh no uisce, puiblí no príobháideach, no aon bhóthair, sráide, slí, bóthair iarainn, trambhealaighe no duga, no aon bhealaigh uisce no cuain, nádúrtha no déanta, no air no fé;
(j) aon áit go n-údaruítear don Aire leis an Acht so línte do dhéanamh os a chionn no air no fé chun leictreachas d'iompar—a uachtar do bhrise agus mór-phíopaí do chur sios agus do choinneáil i dtreo ann agus polaí agus tacaí eile (i dteanta no d'éamais atharathóirí leictreachais) do chur suas agus do choinneáil i dtreo ann;
(k) aon tsráid, bóthar, slí no droichead, puiblí no príobháideach, do dhúna, do chasa no d'aistriú;
(l) dul isteach ar aon tailte no áitreabh chun go ndéanfadh sé ortha-san no ar aon tailte no áitreabh eile gach ní no éinní dá n-údaruítear do leis an bhfo-alt so a dhéanamh ortha, no chun go ndéanfadh sé ortha-san no ar aon tailte no áitreabh eile aon fhiosrú, scrúdú no iniúcha a théigheann roimh éinní den tsórt san do dhéanamh no a bhaineann leis sin;
(m) aon ghníomh no ní do dhéanamh is gá chun aon rud do dhéanamh no a bhaineann le haon rud do dhéanamh a húdaruítear do leis an bhfo-alt so a dhéanamh.
(2) Féadfidh an tAire connra do dhéanamh le héinne chun gach ni no éinní do dhéanamh dá n-údaruítear don Aire le fo-alt (1) den alt so do dhéanamh, agus chuige sin féadfidh an tAire, le cead an Aire Airgid, connracha agus có-aontuithe do dhéanamh.
(3) Má dhineann an tAire fén alt so aon chonnra no có-aontú chun éinní do dhéanamh a húdaruítear don Aire le fo-alt (1) den alt so do dhéanamh féadfidh an tAire, le hordú, ceart do bhronna ar an gconnarthóir chun nithe do dhéanamh a húdaruítear don Aire leis an bhfo-alt san (1) do dhéanamh, pé cinn acu is ceart dar leis an Aire agus a luadhfa sé san ordú, agus leis sin beidh ceart ag an gconnarthóir sin (i gcó-réim leis an Aire) chun gach ní no éinní a luaidhtear amhlaidh san ordú do dhéanamh agus san chó hiomlán is dá mba leis an Acht so a bronnfí an ceart san air agus sa mhéid gur gá é chun an connra no an có-aontú d'fheidhmiú go cuibhe agus ní níos mó ná san.
Féadfidh an tAire talamh, etc., do thógaint go héigeanta.
4.—(1) Chun críche an ghnótha no chun éinní do dhéanamh a húdaruítear don Aire leis an Acht so do dhéanamh (pe'ca uaidh féin a dhéanfidh an tAire an ní sin no tré chonnarthóir) féadfidh an tAire gach ní no éinní acu so a leanas do dhéanamh, sé sin le rá:—
(a) aon tailte no áitreabh do thógaint go héigeanta (pe'ca go buan no go sealadach é);
(b) aon éasáid, cead slí, ceart uisce, ceart iascaigh, no ceart eile ar aon tailte, áitreabh, no uisce, no maidir leis an gcéanna, do thógaint go héigeanta (pe'ca go buan no go sealadach é);
(c) aon éasáid, cead slí, ceart uisce, ceart iascaigh, no ceart eile atá ar aon tailte, áitreabh, no uisce, no maidir leis an gcéanna, do chríochnú no do shriana, no cur isteach do dhéanamh air in aon tslí eile, go héigeanta (pe'ca go buan no go sealadach é);
(d) aon bhóthar, slí, no droichead, puiblí no príobháideach, no aon chanáil no bealach uisce déanta eile no aon chúrsa uisce déanta do chasa, do dhúna no d'aistriú, no cur isteach do dhéanamh air in aon tslí eile, go héigeanta (pe'ca go buan no go sealadach é).
(2) Aon uair tar éis rithte an Achta so agus roimh leithliú no fáil amach an phraghais no an chúitimh, ach fé réir fógra mí ar a luíod roimh ré no, i gcás tighe chomhnaithe ina gcomhnuítear, fógra trí mí ar a luíod roimh ré, do thabhairt i scríbhinn do shealbhaire na dtailte no an áitribh no d'únaer an chirt slí no maoine eile le n-a mbaineann an scéal, féadfidh an tAire dul isteach agus seilbh do thógaint ar aon tailte no áitreabh no aon cheart d'fheidhmiú a húdaruitear don Aire, leis an alt so, a thógaint go héigeanta, no, aon cheart go n-údaruítear don Aire leis an alt so é chríochnú no é shriana no cur isteach do dhéanamh air go héigeanta, féadfa sé é chríochnú no é shriana no cur isteach do dhéanamh air in aon tslí eile, no, aon bhóthar, slí, droichead, bealach uisce, no cúrsa uisce go n-údarúitear don Aire leis an alt so é chasa, é dhúna, é aistriú, no cur isteach do dhéanamh air go héigeanta féadfa sé é chasa, é dhúna, é aistriú, no cur isteach do dhéanamh air in aon tslí eile.
(3) Féadfidh an tAire, le hordú, ceart do bhronna ar chonnarthóir chun nithe do dhéanamh a húdaruítear don Aire, le fo-alt (2) den alt so, do dhéanamh, pé nithe acu is dó leis an Aire is ceart agus a luadhfa sé san ordú, agus leis sin, fé réir an fógra do thabhairt a héilítear leis an bhfo-alt san (2) beidh ceart ag an gconnarthóir sin (i gcó-réim leis an Aire) chun gach ní no éinní dá luadhfar amhlaidh san ordú do dhéanamh agus san chó hiomlán is dá mba leis an Acht so a bronnfí an ceart san air, agus sa mhéid gur gá é chun a chonnra no a chó-aontú d'fheidhmiú go cuibhe agus ní níos mó ná san.
Socrú praghais no cúitimh.
5.—(1) Mara gcó-aontuítear ina thaobh, is fén Acquisition of Land (Assessment of Compensation) Act, 1919, agus dá réir a socrófar méid an phraghais no an chúitimh a bheidh le n'íoc ag an Aire, as tailte agus as áitreabh a thógfa sé go héigeanta (pe'ca go buan no go sealadach é) fén Acht so, leis na daoine uile agus fé seach go bhfuil teideal acu chúcha no go bhfuil estáit no leasanna acu ionta, no, as éasáidí, ceadanna slí, ceartanna uisce, ceartanna iascaigh agus ceartanna eile a thógfa sé go héigeanta (pe'ca go buan no go sealadach é), no ar scór na nithe sin, le húnaer na nithe sin, no leis na daoine uile agus fé seach go bhfuil teideal acu chun na dtailte agus an áitreibh, no go bhfuil estáit no leasanna acu sna tailte agus an áitreabh, gur ortha no maidir leo a tógfar na ceartanna san amhlaidh.
(2) Mara gcó-aontuítear ina thaobh, is fén Acquisition of Land (Assessment of Compensation) Act, 1919, agus dá réir, agus fé is dá mba phraghas é ar thalamh a tógfí go héigeanta, a socrófar méid an chúitimh a bheidh le n'íoc ag an Aire mar gheall ar aon éasáid, ceart uisce, ceart iascaigh, no ceart eile atá ann, ar no maidir le haon tailte, áitreabh, no uisce, do chríochnú no do shriana, no mar gheall ar chur isteach do dhéanamh air i slí eile, go héigeanta (pe'ca go buan no go sealadach é) fén Acht so, no mar gheall ar aon bhóthar, slí no droichead príobháideach, no aon chanáil no bealach uisce déanta eile, no aon chúrsa uisce déanta eile, do chasa, do dhúna, no d'aistriú, no cur isteach do dhéanamh air i slí eile go héigeanta (pe'ca go buan no go sealadach é) fén Acht so.
(3) Nuair a bheidh aon phraghas no cúiteamh á mheas do réir an ailt seo maidir le haon mhaoin, corpardha no nea-chorpardha, go bhfuiltar á sealbhú no ag baint úsáide no tairbhe aisti in éineacht le haon mhaoin eile, no atá ina cuid d'aon mhaoin eile, tabharfar aire d'aon tsochar i bhfuirm dréineála no feabhsú ar sholáthar uisce nách miste do réir reasúin súil a bheith le n-a theacht don mhaoin sin de bharr aon oibreacha a dhin an tAire no atá sé a dhéanamh no ar tí a dhéanamh fén Acht so.
(4) Gach éileamh ar phraghas no ar chúiteamh maidir le haon talamh, áitreabh, no ceart a tógadh go héigeanta, no le haon cheart, slí no maoin eile gur cuireadh isteach air go héigeanta fén Acht so, déanfar é laistigh de bhliain tar éis don Aire no do chonnarthóir dul isteach no feidhmiú no cur isteach do dhéanamh, ar an talamh, ar an áitreabh, ar an gceart, ar an slí, no ar an maoin sin mar an gcéad uair fén Acht so, ach amháin, i gcás cúitimh i gcur-isteach buan ar cheart iascaigh, go bhféadfar an t-éileamh do dhéanamh aon uair laistigh de dheich mbliana tar éis críochnú na n-oibreacha le n-a gcuirtar isteach ar an gceart iascaigh amhlaidh.
(5) Bainfidh ailt 69 go 83 den Lands Clauses Consolidation Act, 1845, le haon phraghas no cúiteamh is iníoctha ag an Aire fén alt so agus leis an leithliú chun an Aire a déanfar ar mhaoin, corpardha no nea-chorpardha, a thóg sé go héigeanta fén Acht so, agus chun na críche sin tuigfar gurb é an tAire bunathóir an ghnótha.
(6) Ní luighfidh aon aicsean, do réir dlí ná cothruim, i gcoinnibh an Aire ná aon chonnarthóra ná i gcoinnibh aon oifigigh ná seirbhísigh don Aire ná d'aon chonnarthóir a los ná ar son aon ghnímh, ní, ná ruda go bhfuil cúiteamh iníoctha mar gheall air de bhua an ailt seo.
Bínse chun praghas no cúiteamh do shocrú.
6.—(1) Má bhíonn méid aon phraghais no cúitimh le socrú, de bhua an Achta so, fén Acquisition of Land (Assessment of Compensation) Act, 1919, agus dá réir, déanfidh moltóir no moltóirí a ceapadh fén alt so an praghas no an cúiteamh san do shocrú amhlaidh in ionad moltóra oifigiúla a ceapadh fén Acht san, agus gach tagairt atá san Acht san do mholtóir oifigiúil léireofar í mar thagairt do mholtóir no do mholtóirí a ceapadh fén alt so.
(2) Déanfidh coiste (dá ngairmtear an Coiste Réitigh san Acht so), gurb iad a bheidh air ná Prímh-Bhreitheamh Shaorstáit Éireann, Uachtarán na hArd-Chúirte, agus Cathaoirleach Fhundúireacht na Suirbhéirí (Brainse na hÉireann), fé mar a iarrfidh agus nuair a iarrfidh an tAire ortha é, pé méid daoine cearta oiriúnacha a ordóidh an tAire, le cead an Aire Airgid, do cheapa chun bheith ina moltóirí chun crícheanna an Achta so.
(3) Gach éinne a ceapfar amhlaidh chun bheith ina mholtóir chun crícheanna an Achta so beidh an ceapachán san aige ar pé téarmaí agus fé réir pé coiníollacha, agus iocfidh an tAire leis mar chuid de chostaisí an ghnótha pé luach saothair, a ordóidh an tAire Airgid.
(4) Gach tagairt atá san Acquisition of Land (Assessment of Compensation) Act, 1919, don Choiste Réitigh, chun crícheanna an Achta so léireofar í agus beidh éifeacht aici mar thagairt don Choiste Réitigh a hainmnítear san alt so.
(5) An chomhacht a bronntar, le fo-alt (7) d'alt 3 den Acquisition of Land (Assessment of Compensation) Act, 1919, ar an gCoiste Réitigh chun rialacha do dhéanamh, folóidh sí comhacht chun rialacha do dhéanamh, le cead an Aire Airgid, á ordú cá mhéid moltóir, ceaptha fén alt so, a éistfidh iarrataisí no saghsanna difiriúla iarrataisí le n-a n-iarrfar aon phraghas no cúiteamh do shocrú fén Acht so.
Féadfidh an tAire socrú le daoine eile chun bóthar iarainn no trambhealach do dhéanamh, etc.
7.—(1) Féadfidh an tAire a shocrú le haon údarás áitiúil no cólucht puiblí eile no le haon chuideachtain—
(a) go ndéanfidh an t-údarás, an cólucht, no an chuideachta san, agus go gcoinneoid i dtreo agus go n-oibreoid, no go ndéanfid no go gcoinneoid i dtreo no go n-oibreoid, ar a gcostas féin, aon bhóthar iarainn no trambhealach a húdaruítear don Aire, leis an Acht so, do dhéanamh, do choinneáil i dtreo, agus d'oibriú, no
(b) go ndéanfidh an tAire agus go gcoinneoidh sé i dtreo agus go n-oibreoidh sé, no go ndéanfa sé no go gcoinneoidh se i dtreo no go n-oibreoidh sé aon bhóthar iarainn no trambhealach den tsórt san don údarás, don chólucht no don chuideachtain sin agus ar a gcostas.
(2) Má dhineann an tAire aon tsocrú den tsórt san roimhráite, féadfidh an tAire, le hordú, na comhachta a bronntar don Aire leis an Acht so do thabhairt agus do bhronna don údarás, don chólucht no don chuideachtain le n-a ndintar an socrú, pé comhachta acu is dó leis an Aire is gá go réasúnta chun go ndéanfidh an t-údarás, an cólucht, no an chuideachta san an socrú san do thabhairt chun críche go cuibhe.
(3) Féadfidh aon údarás áitiúil no cólucht puiblí eile no aon chuideachta, in ainneoin aon teorann reachtúla no eile le n-a gcomhachta, aon tsocrú den tsórt san roimhráite do dhéanamh leis an Aire agus gan dochar d'aon tseana-chomhachta chun iasachtaí d'fháil agus in ainneoin aon tseana-shrianta le hiasachtaí d'fháil féadfid, chun an socrú do thabhairt chun críche, airgead d'fháil ar iasacht ar pé slí agus ar pé téarmaí, coiníollacha, agus urrús a ordóidh an tAire Rialtais Áitiúla agus Sláinte Puiblí i gcás údaráis áitiúla go ndineann iniúchóir don Aire sin a gcuntaisí d'iniúcha, no a cheadóidh an tAire Tionnscail agus Tráchtála in aon chás eile.
(4) Ar bheith críochnuithe d'aon bhóthar iarainn a dineadh fé shocrú a dineadh fén alt so agus ar bheith có-líonta do sna héilithe reachtúla a bheidh i bhfeidhm de thurus na huaire maidir le bóthar iarainn d'oscailt i gcóir tráchta phuiblí, féadfidh an tAire a éileamh go ndéanfidh aon chuideachta bhóthair iarainn a bheidh ann an uair sin agus a ainmneoidh seisean an bóthar iarainn d'oibriú ar pé téarmaí agus coiníollacha de gach saghas (ar a n-áirítear na héilithe a éileoidh an chuideachta san ar an mbóthar iarainn sin) a socrófar le có-aontú a déanfar idir an chuideachta bhóthair iarainn sin agus an t-údarás, an cólucht, no an chuideachta a dhin no dar dineadh an bóthar iarainn, agus a cheadóidh an tAire.
(5) Nuair a hosclófar i gcóir tráchta phuiblí bóthar iarainn a dhin an tAire fén Acht so no a dineadh fé shocrú a dineadh fén alt so agus nuair a bheidh sé á oibriú ag an Aire, no ag an údarás áitiúil, ag an gcólucht puiblí, no ag an gcuideachtain a dhin no dar dineadh é, isé an Bínse Bóthair Iarainn a shocróidh na héilithe a héileofar ar an mbóthar iarainn agus féadfidh an Bínse Bóthair Iarainn na héilithe sin no aon cheann acu d'athscrúdú aon uair ar a iarraidh sin don té a bheidh ag oibriú an bhóthair iarainn no d'aon chólucht ionadathach de lucht an bhóthair iarainn d'úsáid, no d'aon trádálaí a úsáideann an bóthar iarainn.
Féadfidh an tAire slí loingseoireachta abhann, etc., d'fheabhsú.
8.—(1) Féadfidh an tAire gach bancánacht, piara, caladh, biordhoras, comhla uisce, agus obair eile do dhéanamh, agus gach dreidireacht, díriú, doimhniú, leathnú, agus nithe eile do dhéanamh chun feabhas do chur ar shlí loingseoireachta Abha na Sionainne no aon abhann no srotha a théigheann isteach inti, no aon locha atá uirthi no i gceangal léi, gach obair agus ní acu a bhaineann no a ghabhann leis an ngnó no is féidir a dhéanamh go saoráideach, dar leis an Aire, le linn éinní eile do bheith á dhéanamh a húdaruítear don Aire, leis an Acht so, a dhéanamh.
(2) Má dhineann an tAire aon oibreacha fén alt so coinneoidh sé i dtreo iad mara ndinidh agus go dtí go ndéanfidh an tOireachtas socrú eile chun iad do choinneáil i dtreo.
Féadfidh an tAire tailte do dhréineáil.
9.—(1) Féadfidh an tAire oibreacha do dhéanamh agus gach ní do dhéanamh chun aon tailte atá i gcomhgar no i gcomhsursanacht Abha na Sionainne no aon abhann no srotha a théigheann isteach inti, no aon locha, linne, no uisce eile uirthi no i gceangal léi, do dhréineáil no d'fheabhsú le dréineáil, gach obair agus ní acu a bhaineann no a ghabhann leis an ngnó no is féidir a dhéanamh go saoráideach, dar leis an Aire, le linn éinní eile do bheith á dhéanamh a húdaruítear don Aire, leis an Acht so, a dhéanamh.
(2) Má dhineann an tAire aon oibreacha fén alt so coinneoidh sé i dtreo iad mara ndinidh agus go dtí go ndéanfidh an tOireachtas socrú eile chun iad do choinneáil i dtreo.
Lóisteáil phleananna, etc.
10.—(1) Chó luath agus is féidir é tar éis rithte an Achta so agus ar dháta nách déanaí ná mí sara dtosnuítear ar aon oibreacha déanmhachta síbhialta áirithe fén Acht so, no roimh dhul isteach ar aon tailte no áitreabh no roimh fheidhmiú aon chirt no roimh chur isteach ar aon mhaoin, corpardha no nea-chorpordha, fén Acht so chun na críche sin, cuirfidh an tAire fé ndeár mapaí, pleananna, agus leabhra eolais a bhaineann leis na hoibreacha san do lóisteáil mar a luaidhtear ina dhiaidh seo anso.
(2) Na mapaí agus na pleananna atá le lóisteáil fén alt so, ní foláir dóibh bheith líonmhar a ndóthin agus de shaghas is leor chun méid na n-oibreacha déanmhachta síbhialta le n-a mbainid do thaisbeáint ar scálaí is leor, maraon le gach claona agus atharú atá beartuithe, agus fós gach maoin, corpardha agus (san áit ina bhfuil sé oiriúnach) nea-chorpardha, atá beartuithe a thógaint go héigeanta chun críche na n-oibreacha san agus fós gach cur-isteach (sa mhéid gur féidir é thaisbeáint ar tharraic eoireacht) atá beartuithe a dhéanamh go héigeanta chun na críche sin ar aon mhaoin, corpardha no nea-chorpardha, no ar aon bhóthar no droichead.
(3) Beidh sna leabhra eolais atá le lóisteáil fén alt ainmneacha na ndaoine atá ina n-únaerí no in ainm bheith ina n-únaerí, na ndaoine atá ina léasaithe no in ainm bheith ina léasaithe, agus na ndaoine atá ina sealbhairí ar gach talamh agus áitreabh go bhfuil beartuithe iad do thógaint no baint leo ar shlí eile go héigeanta fén Acht so chun críche na n-oibreacha déanmhachta síbhialta go lóisteáltar na leabhra eolais sin ina dtaobh agus ar gach maoin, corpardha no nea-chorpardha (maraon le bóithre agus droichid), go bhfuil beartuithe cur isteach ortha in aon tslí go héigeanta fén Acht so chun críche na n-oibreacha san.
(4) Na mapaí, na pleananna agus na leabhra eolais atá le lóisteáil fén alt so is in oifig éigin leis an Aire i gCathair Bhaile Atha Cliath a lóisteálfar iad agus fós, i gcás mapaí, pleananna, agus leabhra eolais a bhaineann le hoibreacha no le maoin laisteas den droichead atá ar Abha na Sionainne ag an gceann thuaidh de Loch Deirg-dheirc agus dá ngairmtear Droichead Phort Omna, is in áit chaothúil i gCathair Luimnigh a lóisteálfar iad, agus i gcás mapaí, pleananna, agus leabhra eolais a bhaineann le hoibreacha no le maoin lastuaidh den droichead san, is in áit chaothúil i mbaile Phort Omna a lóisteálfar iad, agus fanfidh na mapaí, na pleananna agus na leabhra eolais sin uile ar lóisteáil amhlaidh go dtí go gcríochnófar na hoibreacha le n-a mbainid, agus faid a bheid ar lóisteáil amhlaidh beid ar nochta chun a n-iniúchta ag éinne in aisce in áit na lóisteála idir a deich a chlog ar maidin agus a ceathair a chlog um thráthnóna gach lae ach Domhntaí agus laetheanta saoire bainc.
(5) Chó luath agus is féidir é tar éis aon mhapaí, pleananna, no leabhra eolais do bheith lóisteálta in aon chathair no baile do réir an ailt seo, tabharfidh an tAire fógra puiblí i dtaobh na lóisteála san le fógrán a foillseofar fé dhó i ngach ceann de dhá pháipéar no níos mó a léightear sa chathair no sa bhaile sin, agus déarfa sé i ngach fógra den tsórt san go bhfuil na mapaí, na pleananna, agus na leabhra eolais sin ar nochta chun a n-iniúchta ag an bpuiblíocht do réir an ailt seo.
Airgead i gcóir an ghnótha do sholáthar.
11.—(1) Féadfidh an tAire Airgid, fé réir na dteorann atá leagtha amach ina dhiaidh seo anso, roimh-íoc do dhéanamh amach as an bPrímh-Chiste no as a thora fáis i pé suimeanna a theastóidh ón Aire Tionnscail agus Tráchtála chun críche an ghnótha no chun éinní do dhéanamh a húdaruítear do leis an Acht so a dhéanamh no chun aon phraghas, cúiteamh, no airgead eile d'íoc a thiocfidh chun bheith iníoctha aige de bhua an Achta so.
(2) Roimh-íocanna a híocfar amach as an bPrímh-Chiste no a thora fáis fén alt so is isteach i gciste fé leith a bunófar chuige sin a híocfar iad agus gach íocaíocht a bheidh le n'íoc amach as na suimeanna a roimh-íocfar fén alt so is amach as an gciste sin fé leith, agus fé réir ceada an Aire Airgid, a híocfar iad.
(3) An 1adh lá de Dheire Fomhair no roimhe sin i ngach bliain airgeadais déanfidh an tAire Tionnscail agus Tráchtála cuntas ar an gciste fé leith a bunófar mar adubhradh do thabhairt uaidh i gcóir na bliana airgeadais roimhe sin i pé fuirm a ordóidh an tAire Airgid agus beidh gach cuntas den tsórt san fé réir iniúcha an Ard-Scrúdóra agus leagfar é fé bhráid gach Tighe den Oireachtas.
(4) Íocfar ús amach as an gciste sin fé leith, do réir pé rátaí agus pé tráthanna agus i pé slí a ordóidh an tAire Airgid, ar gach roimh-íoc a híocfar fén alt so amach as an bPrímh-Chiste no as a thora fáis.
(5) Ní raghaidh méid iomlán na roimh-íoc a bheidh le n-íoc amach as an bPrímh-Chiste no as a thora fáis fén alt so, thar suim chúig milleon, dhá chéad agus deich míle púnt.
(6) Chun soláthar do dhéanamh chun suimeanna do roimh-íoc amach as an bPrímh-Chiste fén alt so, no chun gach suim no aon tsuim a roimh-íocfar amhlaidh d'aisíoc isteach sa Chiste sin, no chun urrúsanna a tabharfar amach fén alt so d'íoc sa mhéid ná fuil aon tsoláthar eile déanta chun a n-íoctha, féadfidh an tAire Airgid iasachtaí d'fháil tré pé urrúsanna is do leis is ceart do thabhairt amach.
(7) Íocfar isteach sa Stát-Chiste gach airgead a gheobhfar ar iasacht fén alt so.
(8) Is ar an bPrímh-Chiste no ar a thora fáis a bheidh muirear agus íoc cholann agus ús gach urrúis a tabharfar amach fén alt so.

12.—Maidir le haon tailte, áitreabh no maoin eile, réalta no pearsanta, a thóg no a cheannuigh an tAire fén Acht so, no aon oibreacha a dineadh ag an Aire no dho no fé aon tsocrú a dineadh leis an Aire fén Acht so—
(a) más chun oibreacha do dhéanamh a húdaruítear leis an Acht so a tógadh, a ceannuíodh, no a dineadh iad amhlaidh agus, dar leis an Aire, nách gá chun na críche sin feasta iad agus ná beidh gá leo chun crícheanna an ghnótha nuair a bheidh an gnó críochnuithe, no
(b) má ráinig dóibh, ar aon chúis eile, dar leis an Aire, bhei iomarcach agus nea-riachtanach don ghnó,
féadfidh an tAire na tailte, an t-áitreabh, an mhaoin no na hoibreacha san do dhíol no do léasú, no deighleáil leo ar chuma eile, chun sochair don Stát-Chiste, ar pé slí agus ar pé téarmaí is dó leis an Aire is ceart agus a cheadóidh an tAire Airgid.

13.—(1) Fé réir ceada ón Aire Airgid, pe'ca cead generálta é no cead i gcóir cáis áirithe, féadfidh an tAire, le linn oibreacha do bheidh á dhéanamh fén Acht so chun críche an ghnótha, aon mhéid leictreachais dá ndintar sa ghnó le linn déanamh na n-oibreacha san amhlaidh do sholáthar, ar pé téarmaí agus coiníollacha is dó leis is ceart, d'éinne chun úsáide dho féin no chun a ath-dhíolta.
(2) Sara ndintar línte iompair, stáisiúin atharúcháin, ná oibreacha eile chun soláthar leictreachais do sheachada d'aon duine no dream daoine áirithe, no mar choiníoll ar a ndéanfar iad, féadfidh an tAire a éileamh ar an duine no ar na daoine sin có-aontú no có-aontuithe do dhéanamh leis an Aire chun soláthar leictreachais do ghlaca, chun úsáide dho féin no dhóibh féin no chun a ath-dhíolta, nuair a bheidh sé ar fáil, pé méid minimum de atá réasúnta dar leis an Aire, ag cuimhneamh do ar chostas na n-oibreacha is gá chun an soláthar san do sheachada, agus a luadhfa sé agus san ar pé praghas no praghasanna a húdaruíodh don Aire, le reacht no fé reacht, a éileamh air.
(3) D'ainneoin aon teorann reachtúla no eile le n-a gcomhachta, féadfidh aon údarás áitiúil no cólucht puiblí eile no aon chuideachta aon chonnra no có-aontú do dhéanamh leis an Aire fén alt so agus é thabhairt chun críche.

14.—(1) Más dó leis an Aire agus nuair is dó leis gur dineadh d'aon tailte no áitreabh tairbhe i bhfuirm dréineála, cosaint ar thuile, no feabhsú ar sholáthar uisce de bharr aon oibreacha a dhin an tAire fén Acht so, ansan, le fógra i scríbhinn a seirbheálfar ar shealbhaire rátuithe na dtailte no an áitreibh sin agus (más féidir teacht suas leis) ar an té atá in ainm bheith in únaer ar an gcéanna, no a cuirfar chúcha tríd an bpost roimh-íoctha, féadfidh an tAire a éileamh go gcuirfar mar mhuirear ar na tailte no ar an áitreabh san suim chaipitiúil d'íoc leis an Aire, suim chó mór le méid an mhéaduithe a dineadh ar luach caipitiúil na dtailte no an áitreibh sin de bharr na tairbhe sin.
(2) Mara gcó-aontuítear ina thaobh, déanfidh moltóir, a cheapfidh an Coiste Réitigh fé alt 6 den Acht so tar éis dul i gcomhairle leis an Aire Tailte agus Talmhaíochta, a shocrú an fíor gur dineadh an tairbhe sin agus cadé méid an mhéaduithe (más ann do) a dineadh ar luach caipitiúil na dtailte no an áitreibh sin de bharr na tairbhe sin.
(3) Má shocruíonn an moltóir sin gur dineadh tairbhe d'aon tailte no áitreabh agus gur méaduíodh a luach caipitiúil mar adubhradh, déanfa sé ordú á fhaisnéis gur fíor gur dineadh an tairbhe sin agus ag faisnéis méid an mhéaduithe sin, agus oibreoidh an t-ordú san chun a chur, agus déarfar ann go gcuireann sé, mar mhuirear ar na tailte no ar an áitreabh san (roimh gach muirear agus ualach nách muirear ná ualach a bheidh ann an uair sin agus a bunuíodh le hAcht, no fé Acht, a ritheadh roimh an Acht so), méid an mhéaduithe sin ar luacha, mar a faisnéistear leis an ordú san, maraon le hús ar an gcéanna mar a luaidhtear ina dhiaidh seo anso, d'íoc leis an Aire Airgid tré chíos-mhuirear inchríochnuithe a háireofar ar pé slí agus a leanfidh ar feadh pé tréimhse a luaidhtear ina dhiaidh seo anso.
(4) Mara ndinidh agus go dtí go ndéanfidh an tOireachtas a mhalairt de shocrú ina dtaobh, áireofar an t-ús roimhráite do réir pé ráta agus o pé dáta, agus áireofar an cíos-mhuirear inchríochnuithe roimhráite i pé slí agus beidh sé iníoctha ar feadh pé tréimhse agus i pé slí a hordófar le rialacháin a dhéanfidh an tAire Airgid.
(5) Chun crícheanna an ailt seo ní tuigfar gur tairbhe d'aon tailte ná áitreabh leictreachas do bheith le fáil, ná é bheith le fáil ar aon phraghas áirithe ná in aon chaindíocht ná slí áirithe, ón ngnó.

17.—(1) Ní dhéanfidh an tAire ná aon chonnarthóir a bheidh ag déanamh oibreacha dho fén Acht so aon tailte, áitreabh, foirgintí, oibreacha, gléasra, abhair, ná maoin eile leis an Aire Puist agus Telegrafa do thógaint ná d'aistriú, ná dul isteach ortha ná cur isteach ortha ar aon tslí eile de bhua an Achta so, ná, de bhua an Achta so, aon oibreacha do chur suas, ná éinní ná aon rud eile do dhéanamh is dó leis an Aire Puist agus Telegrafa a bhacfadh, a mhoilleodh, a choiscfadh no a dhíobhálfadh ar aon tslí eile cólíona cuibhe seirbhísí puiblí na Roinne Puist agus Telegrafa maran rud é tar éis dul i gcomhairle leis an Aire Puist agus Telegrafa—
(a) gur dó leis an Aire Tionnscail agus Tráchtála go ndéanfadh sé dochar mór don ghnó, no go gcuirfadh sé cosc mór ar an hoibreacha do dhéanamh is gá don ghnó, na forálacha san roimhe seo den bhfo-alt so do chó-líona; agus

(2) Má thugann an tAire Tionnscail agus Tráchtála fógra don Aire Puist agus Telegrafa fén bhfo-alt san roimhe seo go bhfuil sé chun gan forálacha an fho-ailt sin do chó-líona, féadfidh an tAire Puist agus Telegrafa pé saoráidí agus cóiríocht eile agus pé abhair, gléasra, apparatus agus rudaí d'fháil, agus na hoibreacha san uile do dhéanamh is dó leis is gá chun a mhaoin agus seirbhísí puiblí a Roinne do chosaint ar dhíobháil no ar bhac a thiocfadh de dheascaibh an nea-chó-líonta san, agus íocfidh an tAire Tionnscail agus Tráchtála leis an Aire Puist agus Telegrafa gach costas (in aon tsuim amháin no i bhfuirm éilimh fhilltigh) go ndeimhneoidh an tAire deiridh sin a luadhadh go ndeachaidh sé fé ag fáil na saoráidí, na cóiríochta, agus na rudaí sin do agus ag déanamh na n-oibreacha san.
(3) Má bhíonn an tAire Tionnscail agus Tráchtála no aon chonnarthóir ar aigne aon oibreacha no aon ghníomh, ní no rud do dhéanamh fén Acht so a chuirfadh isteach, no d'fhéadfadh cur isteach, in aon tslí, ar mhaoin an Aire Puist agus Telegrafa no ar sheirbhísí puiblí a Roinne, ansan, sé mhí ar a luíod (no pé aimsir, níos giorra ná san, le n-a n-aontóidh an tAire Puist agus Telegrafa) roimh thosnú ar na hoibreacha san no ar an ngníomh, ar an ní, no ar an rud san do dhéanamh, tabharfidh an tAire Tionnscail agus Tráchtála no an connarthóir (pe'ca aca is gá sa chás) don Aire Puist agus Telegrafa fógra i scríbhinn go bhfuil sé chun na hoibreacha san no an gníomh, an ní no an rud san, do dhéanamh.

18.—Más rud é agus nuair is rud é go dtiocfadh as aon oibreacha do dhéanamh fén Acht so go gcasfí no go n-aistreofí aon bhóthar no droichead puiblí no go gcuirfí isteach air ar shlí eile beidh éifeacht ag na forálacha so a leanas, sé sin le rá:—
(a) má sé dúna an bhóthair no an droichid do thrácht a thiocfadh as na hoibreacha do dhéanamh, déanfidh an tAire agus coinneoidh sé i dtreo, faid a bheidh an bóthar no an droichead san dúnta amhlaidh do thrácht, bóthar no droichead sealadach sa tsuidheamh chéanna no i suidheamh éigin eile caothúil, bóthar no droichead is leor chun an méid agus an saghas céanna tráchta d'iompar a théigheann ar an mbóthar no ar an droichead san do ghnáth;
(b) le linn críochnú na n-oibreacha no roimhe sin cuirfidh an tAire an bóthar no an droichead sa riocht ina raibh sé no, tar éis dul i gcomhairle leis an Aire Rialtais Áitiúla agus Sláinte Puiblí, déanfa sé bóthar no droichead nua buan sa tsuidheamh chéanna no i suidheamh éigin eile caothúil, bóthar no droichead is leor chun an trácht céanna (an méid agus an saghas céanna) d'iompar a bhíodh an seana-bhóthar no an seana-dhroichead in án a iompar, agus ná beidh puinn níos neamh-oiriúnaí fánaidh agus lúb ná an seana-bhóthar no an seanadhroichead san;
(c) má dhineann an tAire droichead nua buan agus gur mó go mór na buntáistí a thugann an droichead san do phuiblíocht aon chontae no bailecheanntair ná an seanadhroichead, tré shlí chonbharsáide fheabhsuithe do thabhairt dóibh no ar aon tslí eile, deimhneoidh an tAire costas an droichid nua san agus deimhneoidh an tAire Rialtais Áitiúla agus Sláinte Puiblí cadé an chuid den chostas san is dó leis ba chóir, do réir réasúin, a bheith ar chomhairle na contae no an bhailecheanntair sin, agus leis sin déanfidh an chomhairle sin suim chó mór leis an gcuid a deimhníodh amhlaidh den chomhairle san do chruinniú mar chuid de chostaisí na mbóithre contae no bailecheanntair sin (pe'ca aca é) do choinneáil i dtreo, agus íocfidh an chomhairle sin leis an Aire í;

SHANNON ELECTRICITY ACT, 1925.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the word “contractor” means a person doing work for the Minister under a contract or agreement made under this Act by him with the Minister;
the expression “local authority” means and includes a county council, a county or other borough council, an urban district council, and the commissioners of a town.
Minister may undertake production of electricity.
2.—The Minister may undertake the production and generation of electricity by means of hydraulic power derived from the waters of the River Shannon and the distribution and supply of the electricity so produced, and such undertaking is in this Act referred to as “the undertaking.”
General powers of Minister.
3.—(1) The Minister may for the purpose of the undertaking do all or any of the following things, that is to say:—
(a) acquire, construct, or otherwise provide and maintain houses or other dwelling accommodation and canteens, clubs, and other places of refreshment or recreation for persons employed (whether by the Minister or a contractor) in the construction of works, the management, working, or conduct of the undertaking, or the doing of any other act or thing which the Minister is authorised by this Act to do;
(b) impound, hold up, divert, take, and use the waters of the River Shannon and any river or stream tributary thereto and any lake, pond, or canal thereon or connected thereto;
(c) embank, dam, dredge, deepen, widen, straighten, divert, and otherwise alter the River Shannon or any river or stream tributary thereto;
(d) embank, dam, dredge, alter the level of, and otherwise affect any lake, pond, or other water on or connected directly or indirectly with the River Shannon;
(e) remove, or alter, repair, construct, and maintain such sluices, weirs, dams, embankments, and other works as may be necessary for or incidental to the doing of any of the things mentioned in the foregoing paragraphs;
(f) construct and maintain generating stations, powerhouses, transformer stations, and other stations and places for generating, transforming, storing, or otherwise dealing with electricity;
(g) purchase, hire, or otherwise provide, and maintain machinery, plant, and equipment for all generating stations, power-houses, transformer stations, and other stations and places constructed under the foregoing paragraph, but so that, until the Oireachtas otherwise determines, the capacity of the machinery, plant, and equipment so provided for generating electricity shall not exceed one hundred thousand horse-power;
(h) construct, maintain and work railways and tramways (whether worked by steam, internal combustion, or electric power), docks, and piers;
(i) construct and maintain lines for the transmission of electricity at any voltage above, on, or under any public or private land or water, or any road, street, way, railway, tramway, or dock, or any natural or artificial waterway or harbour;
(j) break-up the surface of and lay and maintain mains in, and erect and maintain poles and other supports (with or without electricity transformers) on any place above, on, or under which the Minister is by this Act authorised to construct lines for the transmission of electricity;
(k) close, divert, or remove any public or private street, road, way, or bridge;
(l) enter on any lands or premises for the purposes of doing thereon or on any other lands or premises all or any of the things which he is by this sub-section authorised to do or making thereon or on any other lands or premises any inquiry, investigation, or examination preliminary or incidental to the doing of any such thing;
(m) do any act or thing which may be necessary for or incidental to the doing of anything which he is by this sub-section authorised to do.
(2) The Minister may contract with any person to do all or any of the things which the Minister is authorised by sub-section (1) of this section to do, and for that purpose the Minister may with the sanction of the Minister for Finance enter into contracts and agreements.
(3) Whenever the Minister enters under this section into any contract or agreement for the doing of anything which the Minister is authorised by sub-section (1) of this section to do, the Minister may by order, confer on the contractor the right to do such of the things which the Minister is authorised by the said sub-section (1) to do as the Minister shall think proper and shall specify in the order, and thereupon such contractor shall have the right (concurrently with the Minister) to do all or any of the things so specified in the order as fully as if such right were conferred on him by this Act, but so far as and no further than is necessary for the due execution of the contract or agreement.
Minister may acquire land, etc., compulsorily.
4.—(1) For the purpose of the undertaking or the doing of anything which the Minister is by this Act authorised to do (whether the Minister does such thing himself or by a contractor) the Minister may do all or any of the following things, that is to say:—
(a) compulsorily acquire (either permanently or temporarily) any lands or premises;
(b) compulsorily acquire (either permanently or temporarily) any easement, way-leave, water-right, fishing right, or other right over or in respect of any lands, premises, or water;
(c) compulsorily terminate, restrict, or otherwise interfere with (either permanently or temporarily) any easement, way-leave, water-right, fishing right, or other right existing over or in respect of any lands, premises, or water;
(d) compulsorily divert, close, remove, or otherwise interfere with (either permanently or temporarily) any public or private road, way, or bridge, or any canal or other artificial water-way or any artificial water-course.
(2) At any time after the passing of this Act and before conveyance or ascertainment of price or compensation, but subject to giving not less than one month's or, in the case of an occupied dwelling house, three months' previous notice in writing to the occupier of the lands or premises or the owner of the right of way or other property affected, the Minister may enter on and take possession of any lands or premises or exercise any right which the Minister is authorised by this section to acquire compulsorily, or may terminate, restrict, or otherwise interfere with any right which the Minister is authorised by this section compulsorily to terminate, restrict, or interfere with or may divert, close, remove, or otherwise interfere with any road, way, bridge, water-way, or water-course which the Minister is authorised by this section compulsorily to divert, close, remove, or interfere with.
(3) The Minister may by order confer on a contractor the right to do such of the things which the Minister is authorised by sub-section (2) of this section to do as the Minister shall think proper and shall specify in the order and thereupon such contractor shall have the right (concurrently with the Minister) subject to giving the notice required by the said sub-section (2) to do all or any of the things so specified in the order as fully as if such right were conferred on him by this Act, but so far as and no further than is necessary for the due execution of his contract or agreement.
Ascertainment of price or compensation.
5.—(1) The amount of the price or compensation to be paid by the Minister for lands and premises compulsorily acquired (whether permanently or temporarily) by him under this Act to the several persons entitled thereto or having estates or interests therein, or for or in respect of easements, way-leaves, water-rights, fishing rights and other rights compulsorily acquired (whether permanently or temporarily) by him to the owner thereof or the several persons entitled to or having estates or interests in the lands and premises over or in respect of which such rights are so acquired shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919.
(2) The amount of the compensation to be paid by the Minister on account of the compulsory termination, restriction, or other interference (whether permanent or temporary) under this Act of or with any easement, water-right, fishing right, or other right existing over or in respect of any lands, premises, or water, or the compulsory diversion, closing, removal, or other interference (whether permanent or temporary) under this Act of or with any private road, way, or bridge or any canal or other artificial water-way or any artificial water-course shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, in like manner as if such compensation were the price of land compulsorily acquired.
(3) When any price or compensation is being assessed in pursuance of this section in respect of any property, corporeal or incorporeal, which is occupied, used or enjoyed with or forms part of any other property, regard shall be had to any benefit in the nature of drainage or improvement of water supply which may reasonably be expected to accrue to such property by reason of any works executed or in course of execution or about to be executed by the Minister under this Act.
(4) All claims for price or compensation in respect of any land, premises, or right compulsorily acquired or any right, way, or other property compulsorily interfered with under this Act shall be made within one year after such land, premises, right, way, or property is first entered on, exercised, or interfered with by the Minister or a contractor under this Act, save that in the case of compensation for the permanent interference with a fishery right the claim may be made at any time within ten years after the completion of the works by which the fishery right is so interfered with.
(5) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845, shall apply to any price or compensation payable by the Minister under this section and to the conveyance to the Minister of property, corporeal or incorporeal, compulsorily acquired by him under this Act, and for the purpose of such application the Minister shall be deemed to be the promoter of the undertaking.
(6) No action shall lie at law or in equity against the Minister or any contractor or any officer or servant of the Minister or any contractor for or on account of any act, matter, or thing in respect of which compensation is payable by virtue of this section.
Tribunal to fix price or compensation.
6.—(1) Whenever the amount of any price or compensation is by virtue of this Act to be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, such price or compensation shall be so fixed by one or more arbitrators appointed under this section in lieu of an official arbitrator appointed under that Act, and all references in that Act to an official arbitrator shall be construed as references to an arbitrator or arbitrators appointed under this section.
(2) A committee (in this Act called the Reference Committee) consisting of the Chief Justice of the Irish Free State, the President of the High Court, and the Chairman of the Surveyors' Institution (Irish Branch) shall as and when so requested by the Minister appoint such number as the Minister, with the sanction of the Minister for Finance, shall direct of fit and proper persons to be arbitrators for the purposes of this Act.
(3) Every person so appointed to be an arbitrator for the purposes of this Act shall hold such appointment on such terms and subject to such conditions and shall be paid by the Minister as part of the costs of the undertaking such remuneration as the Minister for Finance shall direct.
(4) For the purposes of this Act all references contained in the Acquisition of Land (Assessment of Compensation) Act, 1919, to the Reference Committee shall be construed and have effect as references to the Reference Committee nominated in this section.
(5) The power conferred by sub-section (7) of section 3 of the Acquisition of Land (Assessment of Compensation) Act, 1919, on the Reference Committee to make rules shall include a power to make rules, with the sanction of the Minister for Finance, prescribing the number of arbitrators appointed under this section by whom applications or different classes of applications for the fixing of any price or compensation under this Act shall be heard.
Minister may delegate construction, etc., of railway on tramway.
7.—(1) The Minister may arrange with any local authority or other public body or any company either—
(a) that such authority, body or company will at their own expense construct, maintain, and work or construct or maintain or work any railway or tramway which the Minister is by this Act authorised to construct, maintain, and work, or
(b) that the Minister will construct, maintain, and work or construct or maintain or work any such railway or tramway for and at the expense of such authority, body, or company.
(2) Whenever the Minister enters into any such arrangement as aforesaid, the Minister may by order delegate to and confer on the authority, body or company with which the arrangement is made such of the powers conferred on the Minister by this Act as shall in the opinion of the Minister be reasonably necessary for the due carrying out of such arrangement by such authority, body, or company.
(3) Any local authority or other public body or company may, notwithstanding any statutory or other limitation of their powers, enter into any such arrangement as aforesaid with the Minister, and, without prejudice to any existing powers of borrowing and notwithstanding any existing restrictions on borrowing, may for the purpose of carrying out the arrangement borrow money in such manner and upon such terms, conditions, and security as, in the case of a local authority whose accounts are audited by an auditor of the Minister for Local Government and Public Health, shall be prescribed by that Minister, or, in any other case, shall be approved by the Minister for Industry and Commerce.
(4) When any railway constructed under an arrangement made under this section has been completed and the statutory requirements for the time being in force in relation to the opening of a railway for public traffic have been complied with, the Minister may require the railway to be worked by any then existing railway company nominated by him, upon such terms and conditions in all respects (including the charges to be made on such railway by such company) as may be determined by agreement made between such railway company and the authority, body, or company by or for whom the railway was constructed and approved of by the Minister.
(5) When a railway constructed by the Minister under this Act or constructed under an arrangement made under this section is opened for public traffic and is worked by the Minister or by the local authority, public body, or company by or for whom it was constructed, the charges to be made on the railway shall be fixed by the Railway Tribunal and such charges or any of them may at any time be revised by the Railway Tribunal on the application of the person working the railway or any representative body of users of the railway or any trader using the railway.
Minister may improve navigation of rivers, etc.
8.—(1) The Minister may construct all such embankments, piers, wharves, locks, sluices, and other works and do such dredging, straightening, deepening, widening, and other things for the improvement of the navigation of the River Shannon or any river or stream tributary thereto, or any lake thereon or connected therewith as may be incidental or ancillary to the undertaking or can in the opinion of the Minister be conveniently constructed or done in the course of the doing of any other thing which the Minister is authorised by this Act to do.
(2) Where the Minister constructs any works under this section he shall maintain the same unless and until the Oireachtas makes other provision for the maintenance thereof.
Minister may drain lands.
9.—(1) The Minister may construct such works and do all such things for the purpose of draining or improving by drainage any lands adjacent to or in the neighbourhood of the River Shannon or any river or stream tributary thereto or any lake, pond, or other water thereon or connected thereto as may be incidental or ancillary to the undertaking or can in the opinion of the Minister be conveniently constructed or done in the course of the doing of any other thing which the Minister is authorised by this Act to do.
(2) Where the Minister constructs any works under this section he shall maintain the same unless and until the Oireachtas makes other provision for the maintenance thereof.
Deposits of plans, etc.
10.—(1) As soon as may be after the passing of this Act and not later than one month before commencing any particular civil constructional works under this Act or, for that purpose, entering on any lands or premises or exercising any right or interfering with any property, corporeal or incorporeal, under this Act, the Minister shall cause maps, plans, and books of reference in relation to those works to be deposited as hereinafter mentioned.
(2) The maps and plans to be deposited under this section shall be sufficient in quantity and character to show on adequate scales the extent of the civil constructional works to which they relate with all contemplated deviations and variations, and also all property, corporeal and (where appropriate) incorporeal, proposed to be acquired compulsorily for the purpose of such works and also every interference (so far as the same can be shown on a drawing) proposed to be made compulsorily for the said purpose with any property, corporeal or incorporeal, or any road or bridge.
(3) The books of reference to be deposited under this section shall contain the names of the owners or reputed owners, lessees or reputed lessees, and occupiers of all lands and premises proposed to be acquired or otherwise affected compulsorily under this Act for the purpose of the civil constructional works in relation to which they are deposited and of all property, corporeal or incorporeal (including roads and bridges), proposed to be in any way interfered with compulsorily under this Act for the purpose of such works.
(4) The maps, plans, and books of reference to be deposited under this section shall be deposited at some office of the Minister in the City of Dublin, and also, in the case of maps, plans, and books of reference relating to works or property south of the bridge crossing the River Shannon at the northern end of Lough Derg and known as Portumna Bridge, at a convenient place in the City of Limerick, and, in the case of maps, plans, and books of reference relating to works or property north of the said bridge, at a convenient place in the town of Portumna, and all such maps, plans, and books of reference shall remain so deposited until the completion of the works to which they relate, and while so deposited shall be open to inspection by any person free of charge at the place of deposit between the hours of ten o'clock in the morning and four o'clock in the afternoon of every day except Sundays and bank holidays.
(5) As soon as may be after the deposit of any maps, plans, or books of reference in any city or town in pursuance of this section, the Minister shall give public notice of such deposit by advertisement published twice in each of two or more newspapers circulating in such city or town, and shall in every such notice state that such maps, plans, and books of reference are open to public inspection in accordance with this section.
Provision of money for undertaking.
11.—(1) The Minister for Finance may, subject to the limitation hereinafter imposed, advance out of the Central Fund or the growing produce thereof such sums as may be required by the Minister for Industry and Commerce for the purpose of the undertaking or the doing of anything which he is by this Act authorised to do or for the payment of any price, compensation or other moneys which shall by virtue of this Act become payable by him.
(2) Advances under this section from the Central Fund or the growing produce thereof shall be made to a separate fund to be established for the purpose and all payments to be made out of the sums advanced under this section shall, subject to the sanction of the Minister for Finance, be met from such separate fund.
(3) On or before the 1st day of October in every financial year an account of the separate fund to be established as aforesaid shall be rendered in respect of the previous financial year by the Minister for Industry and Commerce in such form as the Minister for Finance shall direct, and every such account shall be subject to audit by the Comptroller and Auditor-General and shall be laid before each House of the Oireachtas.
(4) Interest shall be paid out of the said separate fund at such rates and times and in such manner as the Minister for Finance shall direct on all advances made under this section from the Central Fund or the growing produce thereof.
(5) The total amount of the advances to be made under this section out of the Central Fund or the growing produce thereof shall not exceed the sum of five millions, two hundred and ten thousand pounds.
(6) The Minister for Finance may, for the purpose of providing for the advance of sums out of the Central Fund under this section, or for the repayment to that Fund of all or any sums so advanced or for paying off securities issued under this section so far as such payment is not otherwise provided for, borrow by means of the issue of such securities as he thinks proper.
(7) All moneys borrowed under this section shall be paid into the Exchequer.
(8) The principal of and interest on all securities issued under this section shall be charged on and payable out of the Central Fund or the growing produce thereof.
Disposal of surplus lands, etc.
12.—Whenever any lands, premises, or other property real or personal, acquired or purchased by the Minister under this Act or any works constructed by or for the Minister or under any arrangement made with the Minister under this Act—
(a) were so acquired, purchased, or constructed for the purpose of the execution of works authorised by this Act and, in the opinion of the Minister, have ceased to be required for that purpose and will not be required for the purposes of the undertaking when completed, or
(b) have for any other reason become, in the opinion of the Minister, surplus to and unnecessary for the undertaking,
the Minister may sell, lease, or otherwise dispose of such lands, premises, property, or works for the benefit of the Exchequer in such manner and upon such terms as the Minister with the approval of the Minister for Finance shall think proper.
Supply of electricity.
13.—(1) Subject to the sanction of the Minister for Finance given either generally or for any particular case, the Minister may supply, during the construction under this Act of works for the purpose of the undertaking, on such terms and conditions as he thinks proper to any person, whether for his own use or for re-sale, any quantity of electricity produced by the undertaking during such construction of works.
(2) The Minister may before or as a condition for the construction of transmission lines, transformer stations, or other works for the delivery of a supply of electricity to any particular person or group of persons, require such person or persons to enter into an agreement or agreements with the Minister to take, for his or their own use or for re-sale, a supply of electricity when available in such minimum quantity as the Minister, having regard to the cost of the works required for the delivery of such supply shall consider reasonable and shall specify and at such price or prices as the Minister may be authorised by or under statute to charge therefor.
(3) Any local authority or other public body or any company may, notwithstanding any statutory or other limitation of their powers, enter into and carry out any contract or agreement with the Minister under this section.
Lands benefited by drainage, etc., to be charged with certain payments.
14.—(1) If and whenever the Minister is of opinion that any lands or premises have been benefited by way of drainage, protection from flooding, or improvement of water supply by reason of any works executed by the Minister under this Act, the Minister may, by notice in writing served on or sent by prepaid post to the rated occupier and (if he can be found) the reputed proprietor of such lands or premises, require that such lands or premises be charged with the payment to the Minister of a capital sum equal to the amount by which the capital value of such lands or premises has been increased by reason of such benefit.
(2) The fact of such benefit and the amount (if any) by which the capital value of the said lands or premises has been increased thereby shall, in default of agreement, be determined by an arbitrator appointed after consultation with the Minister for Lands and Agriculture by the Reference Committee under section 6 of this Act.
(3) Whenever such arbitrator determines that any lands or premises have been benefited and the capital value thereof increased as aforesaid he shall make an order declaring the fact of such benefit and the amount of such increase, and such order shall operate and be expressed to charge such lands or premises (in priority to all other charges and incumbrances except charges or incumbrances then existing and created by or under an Act passed before this Act) with the payment to the Minister for Finance of the amount of such increase of values as thereby declared with interest thereon as hereinafter mentioned by means of a terminable rentcharge calculated in such manner and extending over such period as is hereinafter mentioned.
(4) Unless and until the Oireachtas makes other provision in regard thereto, the interest aforesaid shall be calculated at such rate and from such date and the terminable rentcharge aforesaid shall be calculated in such manner and be payable for such period and in such manner as shall be prescribed by regulations made by the Minister for Finance.
(5) For the purposes of this section, the fact that electricity is obtainable or obtainable at any particular price or in any particular quantity or manner from the undertaking shall not be deemed to be a benefit to any lands or premises.
Protection of ancient monuments.
15.—If and whenever the execution of any works under this Act would or might involve the destruction or injury of or any interference with any ancient monument which in the opinion of the Minister is of public interest by reason of the historical, traditional, archæological, or artistic interest attaching thereto, the Minister may with the consent of the Commissioners of Public Works in Ireland by order constitute the said Commissioners guardians of such monument under the Ancient Monuments Protection Acts, 1882 and 1892, and thereupon such Acts shall apply to such monument and the said Commissioners shall take such steps whether by removal and re-erection, raising, embanking or otherwise as they shall consider necessary for the protection of such monument.
Protection of fisheries.
16.—When constructing works under this Act it shall not be obligatory on the Minister or any contractor to comply with the Fisheries (Ireland) Acts, 1842 to 1909, but the Minister shall take and make or, in the case of works executed for him by a contractor procure that the contractor shall take and make such precautions and provisions as the Minister, after consultation with the Minister for Fisheries, shall consider adequate for the protection of and avoidance of injury to fisheries during or in consequence of the construction of any works under this Act, unless the Minister after such consultation as aforesaid is satisfied that such protection cannot be afforded or such injury cannot be avoided without substantial detriment to the works or substantial hindrance to their construction.
Protection of postal and telegraphic services.
17.—(1) Neither the Minister nor any contractor executing works for him under this Act shall by virtue of this Act acquire, enter on, remove, or otherwise interfere with any lands, premises, buildings, works, plant, materials, or other property of the Minister for Posts and Telegraphs or erect any works or do any other matter or thing which in the opinion of the Minister for Posts and Telegraphs would obstruct, delay, hinder, or otherwise injuriously affect the due execution of the public services of the Department of Posts and Telegraphs unless the Minister for Industry and Commerce after consultation with the Minister for Posts and Telegraphs—
(a) is of opinion that compliance with the foregoing provisions of this sub-section would be substantially detrimental to the undertaking or would materially hinder the construction of the works necessary therefor; and
(b) gives to the Minister for Posts and Telegraphs six months notice (or such shorter notice as the said Minister shall accept) in writing, of the matters and things in respect of which it is intended not to comply with the said provisions of this sub-section.
(2) Whenever the Minister for Industry and Commerce gives to the Minister for Posts and Telegraphs a notice under the foregoing sub-section of his intention not to comply with the provisions of that sub-section the Minister for Posts and Telegraphs may obtain such alternative facilities and accommodation and such materials, plant, apparatus, and things and do and execute all such works as in his opinion shall be necessary for the safeguarding of his property and the public services of his Department from injury or obstruction by reason of such non-compliance, and the Minister for Industry and Commerce shall pay to the Minister for Posts and Telegraphs all expenses (whether a lump sum or a recurring charge) which the last-mentioned Minister shall certify to have been incurred by him in obtaining such facilities, accommodation, things and doing or executing such works.
(3) Whenever the Minister for Industry and Commerce or any contractor proposes to execute any works or do any act, matter, or thing under this Act which would or might interfere in any way with the property of the Minister for Posts and Telegraphs or the public services of his Department, the Minister for Industry and Commerce or the contractor (as the case may require) shall, not less than six months (or such shorter time as shall be consented to by the Minister for Posts and Telegraphs) before commencing to execute such works or do such act, matter, or thing, give to the Minister for Posts and Telegraphs notice in writing of his intention to execute such works, or do such act, matter, or thing.
Protection of public roads and bridges.
18.—If and whenever the execution of any works under this Act involves the diversion, removal, or other interference with any public road or bridge the following provisions shall have effect, that is to say:—
(a) where the execution of the works involves the closing of the road or bridge to traffic the Minister shall construct and shall maintain while such road or bridge is so closed to traffic a temporary road or bridge in the same or some other convenient situation sufficient to carry traffic of such quantity and character as normally uses such road or bridge;
(b) the Minister shall at or before the completion of the works either restore the road or bridge to its former condition or construct, after consultation with the Minister for Local Government and Public Health, a new permanent road or bridge in the same or some other convenient situation sufficient to carry the like amount (in quantity and character) of traffic as the original road or bridge was able to carry and not substantially less convenient in gradient and curve than such original road or bridge;
(c) where the Minister constructs a permanent new bridge and such bridge confers substantially greater advantages on the public of any county or urban district than the original bridge, by affording an improved means of communication or otherwise, the Minister shall certify the cost of such new bridge and the Minister for Local Government and Public Health shall certify what part of such cost in his opinion ought reasonably to be borne by the council of such county or urban district, and thereupon a sum equal to the part so certified of such cost shall be raised by such council as part of the expenses of the maintenance of such county or urban roads (as the case may be) and shall be paid by such council to the Minister;
(d) if any doubt, dispute or question shall arise as to whether the Minister in the construction, maintenance or restoration of any temporary or permanent road or bridge pursuant to this section has complied with the provisions of this section, or as to whether a permanent new bridge constructed by the Minister confers substantially greater advantages on the public of any county or urban district than the original bridge, such doubt, dispute, or question shall be decided by the Minister for Local Government and Public Health whose decision shall be conclusive and final.
Service of notices.
19.—Any notice required by this or any other Act to be served on or sent or given to any person for any purpose in relation to the undertaking shall be sufficiently served, sent, or given, if sent by registered post in an envelope addressed to such person at his last known place of abode and shall be deemed to have been so served, sent, or given at the time at which such envelope would be delivered in the ordinary course of post at the place to which it is addressed.
Short title.
20.—This Act may be cited as the Shannon Electricity Act, 1925.
