AN tACHT UM GHNÍOMHAIREACHT FOSTAÍOCHTA, 1971

Léiriú.
1.—(1) San Acht seo—
tá le “oifigeach údaraithe” an bhrí a shanntar dó le halt 9 den Acht seo;
ciallaíonn “an tAire” an tAire Saothair;
ciallaíonn “forordaithe” forordaithe le rialacháin a rinne an tAire faoin Acht seo.
(2) Chun críocha an Achta seo, ciallaíonn gnó gníomhaireachta fostaíochta gnó ag lorg, ar luach saothair nó eile, thar ceann daoine eile, daoine a thabharfaidh nó a ghlacfaidh fostaíocht, agus folaíonn sé daoine a ghlacfaidh fostaíocht ó dhaoine eile nó a dhéanfaidh seirbhísí do dhaoine eile a fháil nó a sholáthar ar luach saothair.
Toirmeasc ginearálta le gníomhaireachtaí fostaíochta neamhcheadúnaithe.
2.—Ní sheolfaidh aon duine gnó gníomhaireachta fostaíochta ach amháin faoi réim agus de réir ceadúnais faoin Acht seo.
Forálacha maidir le ceadúnas.
3.—(1) Aon duine a bheidh chun gnó gníomhaireachta fostaíochta a sheoladh iarrfaidh sé ceadúnas faoin Acht seo ar an Aire, agus cuir fidh sé faoi deara fógra san fhoirm fhorordaithe go bhfuil sé chun sin a iarraidh amhlaidh a fhoilsiú i nuachtán laethúil amháin ar a laghad a léitear sa Stát.
(2) Aon iarratas ar cheadúnas faoin Acht seo—
(a) is san fhoirm fhorordaithe a dhéanfar é,
(b) beidh ann na sonraí forordaithe, agus
(c) beidh an táille fhorordaithe ag gabháil leis.
(3) I gcás ina n-iarrfar ceadúnas faoin Acht seo, deonóidh an tAire an ceadúnas—
(a) más deimhin leis go bhfreagraíonn an t-áitreabh do na caighdeáin chóiríochta fhorordaithe,
(b) más deimhin leis go bhfreagraíonn an t-iarratasóir do na caighdeáin fhorordaithe oiriúnachta agus feidhmiúlachta, agus
(c) más rud é nár ciontaíodh an t-iarratasóir i gcion faoin Acht seo sa tréimhse 5 bliana dar críoch dáta an iarratais.
(4) Féadfaidh an tAire na caighdeáin chóiríochta i leith áitreabh a úsáidfear le haghaidh gnó gníomhaireachta fostaíochta agus na caighdeáin oiriúnachta agus feidhmiúlachta a mheasfaidh sé a bheith riachtanach i leith iarratasóra ar cheadúnas faoin Acht seo a fhorordú.
(5) Is san fhoirm fhorordaithe a bheidh ceadúnas faoin Acht seo agus beidh ceadúnas den sórt sin faoi réir cibé coinníollacha a shonróidh an tAire sa cheadúnas.
Ceadúnas a chúlghairm.
4.—I gcás sealbhóir ceadúnais faoin Acht seo a bheith ciontaithe i gcion faoin Acht seo nó eolas bréagach a bheith tugtha aige in iarratas faoi alt 3 den Acht seo nó i gcás inarb é tuairim an Aire—
(a) nach duine oiriúnach feasta chun gnó gníomhaireachta fostaíochta a sheoladh an sealbhóir, nó
(b) maidir leis an áitreabh ina seolann an sealbhoir gnó gníomhaireachta fostaíochta nach bhfeagraíonn sé feasta do na caighdeáin fhorordaithe,
féadfaidh an tAire an ceadúnas a chúlghairm.
Achomhairc i gcoinne ceadúnas a chúlghairm agus diúltú ceadúnas a dheonú.
5.—(1) I gcás in a mbeartóidh an tAire ceadúnas faoin Acht seo a chúlghairm cuirfidh sé in iúl go cuí do shealbhóir an cheadúnais go bhfuil sin beartaithe aige, agus féadfaidh an sealbhóir achomharc a dhéanamh chun na hArd-Chúirte i gcoinne beartú an Aire.
(2) I gcás ina ndiúltóidh an tAire ceadúnas faoin Acht seo a dheonú d'iarratasóir ceadúnais den sórt sin, cuirfidh sé a chinneadh in iúl don iarratasóir laistigh de 21 lá agus féadfaidh an t-iarratasóir achomharc a dhéanamh chun na hArd-Chúirte i gcoinne cinneadh an Aire.
(3) Ar éisteacht a thabhairt d'achomharc faoin alt seo maidir lena bheith beartaithe ceadúnas a chúlghairm nó maidir lena bheith diúltaithe ceadúnas a dheonú, féadfaidh an Ard-Chúirt an beartú nó an diúltú a dhaingniú nó géilleadh don achomharc agus, i gcás ina ngéillfear d'achomharc, ní chúlghairfidh an tAire an ceadúnas nó deonóidh sé an ceadúnas, de réir mar is iomchuí.
(4) Is breith chríochnaitheach breith na hArd-Chúirte ar achomharc faoin alt seo ach amháin go bhféadfar, le cead na Cúirte sin, achomharc i gcoinne na breithe sin a dhéanamh chun na Cúirte Uachtaraí ar phonc shonraithe dlí.
Gan feidhm a bheith ag an Acht seo.
6.—(1) Ní bhainfidh an tAcht seo—
(a) le haon scéim ná seirbhís a bhaineann le fostú nó earcú foireann agus a riarann nó a oibríonn Aire Stáit nó a riartar nó a oibrítear faoi threorú Aire Stáit,
(b) le Coimisiún na Státseirbhise,
(c) leis an gCoimisiún um Cheapacháin Áitiúla.
(2) Féadfaidh an tAire, más oiriúnach leis, le hordú díolúine ón Acht seo nó ó fhoráil shonraithe den Acht seo a dheonú maidir le gnó aicme sonraithe gníomhaireachta fostaíochta a sheoladh.
(3) Féadfaidh an tAire le hordú ordú faoin alt seo a chúlghairm nó a leasú.
Táillí, etc., gníomhaireachtaí.
7.—(1) Ní dhéanfaidh duine a sheolann gnó gníomhaireachta fostaíochta aon táille ná caiteachais a ghearradh, i leith seirbhísí a rinneadh i gcúrsa an ghnó, de bhreis ar scála a bheidh ceadaithe ag an Aire, agus ullmhóidh agus cuirfidh faoi bhráid an Aire de réir mar a bheidh ceangailte chun críocha an ailt seo scála táillí agus caiteachas den sórt sin.
(2) Ní dhéanfaidh aon duine a sheolann gnó gníomhaireachta fostaíochta aon táille a ghearradh d'aontoisc de bharr a chomhaontú fostaíocht a lorg do dhuine eile ná d'aontoisc de bharr a chomhaontú daoine a lorg a thabharfaidh nó a ghlacfaidh fostaíocht.
Cumhacht ghinearálta rialacháin a dhéanamh.
8.—(1) Féadfaidh an tAire rialacháin a dhéanamh chun éifeacht a thabhairt don Acht seo agus i gcoitinne chun seoladh gníomhaireachtaí fostaíochta a rialáil agus a mhaoirseacht.
(2) Féadfaidh rialacháin faoin alt seo, gan dochar do ghinearáltacht fho-alt (1) den alt seo, socrú a dhéanamh do gach ábhar nó d'aon ábhar acu seo a leanas—
(a) a cheangal ar dhuine a sheolann gníomhaireacht fostaíochta taifid a choimeád faoin ngnó a sheolann an ghníomhaireacht agus faoi cibé ábhair eile a fhorordófar;
(b) foirm na dtaifead sin agus an t-eolas a bheidh le cur iontu a fhorordú;
(c) a cheangal ar dhuine a sheolann gníomhaireacht fostaíochta tuairisceáin bhliantúla a thabhairt don Aire agus, cibé tráthanna agus cibé slí a shonrófar, cibé eolas eile a iarrfaidh sé ó am go ham;
(d) cosc a chur le calaois ag seoladh gnó gníomhaireachta fostaíochta;
(e) airgead a chaomhnú a bheidh faighte ag gníomhaireachtaí fostaíochta le haghaidh agus thar ceann daoine a d'fhostaigh na gníomhaireachtaí sin;
(f) a cheangal go mbeidh ar taispeáint in áitribh gníomhaireachtaí fostaíochta ceadúnais faoin Acht seo a deonaíodh i leith na n-áitreabh, scálaí táillí agus caiteachas a bheidh ceadaithe faoin Acht seo agus cibé fógraí eile a bheidh forordaithe;
(g) a cheangal ar shealbhóirí ceadúnas faoin Acht seo go bhfaighidh siad, go gcoimeádfaidh siad agus (má iarrtar sin orthu) go dtabharfaidh siad ar aird don Aire, sula lorgfaidh siad daoine le haghaidh fostaíochta lasmuigh den Stát, fianaise ar údarás na sealbhóirí sin gníomhú thar ceann daoine a bheidh ag tairiscint fostaíochta den sórt sin agus eolas i dtaobh téarmaí fostaíochta den sórt sin;
(h) a cheangal, i gcás fógra i bhfoilseachán arna fhoilsiú sa Stát ar lorg duine le haghaidh fostaíochta lasmuigh den Stát nó ag tairiscint fostaíocht a fháil lasmuigh den Stát do shaoránach den Stát a chónaíonn sa Stát, go gcuirfear san fhógra ainm agus seoladh an duine lasmuigh den Stát a bheidh ar lorg duine le haghaidh, nó a bheidh ag tairiscint, fostaíochta nó ainm agus seoladh sealbhóra cheadúnais faoin Acht seo;
(i) a cheangal, i gcás gníomhaireacht fostaíochta a bheidh ar lorg daoine faoi bhun 18 mbliana d'aois le haghaidh fostaíochta lasmuigh den Stát nó a bheidh ag tairiscint fostaíocht a fháil lasmuigh den Stát do shaoránaigh den Stát faoi bhun 18 mbliana d'aois agus a chónaíonn sa Stát, cibé eolas a shonrófar sna rialacháin a bhainfidh leis an bhfostaíocht lasmuigh den Stát.
Cumhacht dul isteach, cumhacht scrúdaithe, etc.
9.—(1) Féadfaidh an tAire cibé daoine agus cibé méid daoine is oiriúnach leis a cheapadh chun bheith ina n-oifigigh údaraithe chun críocha an Achta seo.
(2) Tabharfar do gach oifigeach údaraithe barántas ar é a cheapadh ina oifigeach údaraithe agus, nuair a bheidh sé ag feidhmiú aon chumhachta a thugtar d'oifigeach údaraithe leis an alt seo, tabharfaidh sé, má iarann aon duine lena mbaineann air é, an barántas ar aird don duine sin.
(3) Féadfaidh oifigeach údaraithe gach tráth réasúnach—
(a) dul isteach agus scrúdú a dhéanamh ar aon áitreabh ina seoltar gnó gníomhaireachta fostaíochta nó a mbeidh iarratas faoi alt 3 den Acht seo déanta ina leith,
(b) scrúdú a dhéanamh ar cibé leabhair agus taifid i dtaobh gnó gníomhaireachta fostaíochta a cheanglaítear a choimeád faoin Acht seo, agus, i gcás a mbeidh cúis réasúnach aige a chreidiúint go bhfuil an tAcht seo á shárú nó gur sáraíodh an tAcht seo, cóipeanna a dhéanamh d'aon sonraí sna leabhair nó sna taifid sin.
(c) a cheangal ar aon duine a sheolann gnó gníomhaireachta fostaíochta nó a bheartaíonn sin a dhéanamh cibé eolas a thabhairt dó a iarrfaidh sé le réasún lena dhéanamh amach cé acu atá nó nach bhfuil an ghníomhaireacht nó gur dóigh nó nach dóigh di a bheith á seoladh de réir an Achta seo.
(4) I gcás aon duine—
(a) ní bhacfaidh sé ná ní choiscfidh sé oifigeach údaraithe agus an t-oifigeach údaraithe sin ag feidhmiú aon chumhachta dá dtugtar leis an Acht seo,
(b) ní mhainneoidh sé ná ní dhiúltóidh sé aon eolas a thabhairt d'oifigeach údaraithe a bheidh teideal ag aon oifigeach a éileamh faoin alt seo, ná
(c) ní thabharfaidh sé d'oifigeach údaraithe eolas is eol dó a bheith bréagach nó míthreorach i bponc ábhartha.
Cionta.
10.—(1) Má sháraíonn duine an tAcht seo nó aon rialacháin faoi beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £50 agus, i gcás ciona leanúnaigh, fíneáil bhreise nach mó ná £10 in aghaidh gach lae a leanfar den chion a chur air.
(2) I gcás cion faoin Acht seo a dhéanamh ag comhlacht corpraithe agus go gcruthófar go ndearnadh amhlaidh é le toiliú nó le ceadú, nó gur urasaíodh a dhéanamh le haon fhaillí thoiliúil ar thaobh, aon stiúrthóra, bainisteora, rúnaí, nó oifigigh eile de chuid an chomhlachta chorpraithe, measfar an stiúrthóir, an bainisteoir, an rúnaí nó an t-oifigeach eile a bheith ciontach sa chion freisin.
Rialacháin a leagan faoi bhráid Thithe an Oireachtais.
11.—Gach rialachán a dhéanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin laistigh den lá is fiche a shuífidh an Teach sin tar éis an rialachán a leagan faoina bhráid rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.

12.—Aisghairtear leis seo alt 85 den Public Health Acts (Amendment) Act, 1907.
Caiteachais, etc.
13.—(1) Déanfar na caiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais, as airgead a sholáthróidh an tOireachtas.
(2) Aon airgead a gheobhaidh an tAire faoin Acht seo íocfar isteach sa Státchiste é nó cuirfear chun tairbhe don Státchiste é i cibé slí a ordóidh an tAire Airgeadais.
Tosach feidhme.
14.—Tiocfaidh an tAcht seo i ngníomh cibé lá a cheapfaidh an tAire le hordú.

EMPLOYMENT AGENCY ACT, 1971
Interpretation.
1.—(1) In this Act—
“authorised officer” has the meaning assigned to it by section 9 of this Act;
“the Minister” means the Minister for Labour;
“prescribed” means prescribed by regulations made by the Minister under this Act.
(2) For the purposes of this Act, the business of an employment agency means the business of seeking, whether for reward or otherwise, on behalf of others, persons who will give or accept employment, and includes the obtaining or supplying for reward of persons who will accept employment from or render services to others.
General prohibition on unlicensed employment agencies.
2.—A person shall not carry on the business of an employment agency except under and in accordance with a licence under this Act.
Provisions regarding licence.
3.—(1) A person proposing to carry on the business of an employment agency shall apply to the Minister for a licence under this Act, and shall cause to be published in not less than one daily newspaper circulating in the State a notice in the prescribed form of his intention so to apply.
(2) An application for a licence under this Act shall—
(a) be made in the prescribed form,
(b) contain the prescribed particulars, and
(c) be accompanied by the prescribed fee.
(3) Where an application is made for a licence under this Act, the Minister shall grant the licence if—
(a) he is satisfied that the premises conform to the prescribed standards of accommodation,
(b) he is satisfied that the applicant conforms to the prescribed standards of suitability and fitness, and
(c) the applicant has not been convicted of an offence under this Act in the period of 5 years ending on the date of the application.
(4) The Minister may prescribe the standards of accommodation in respect of premises for use for the business of an employment agency and the standards of suitability and fitness which he considers requisite in respect of an applicant for a licence under this Act.
(5) A licence under this Act shall be in the prescribed form and shall be subject to such conditions as the Minister specifies in the licence.
Revocation of licence.
4.—Where the holder of a licence under this Act has been convicted of an offence under this Act or has given false information in an application under section 3 of this Act or where in the opinion of the Minister—
(a) the holder is no longer a suitable person to carry on the business of an employment agency, or
(b) the premises where the holder is carrying on the business of an employment agency no longer conform to the prescribed standards,
the Minister may revoke the licence.
Appeals against revocation of licence and refusal to grant licence.
5.—(1) Where the Minister proposes to revoke a licence under this Act, he shall duly notify the holder of the licence of his proposal, and the holder may appeal to the High Court against the Minister's proposal.
(2) Where the Minister refuses to grant a licence under this Act to an applicant for such a licence, he shall notify the applicant within 21 days of his decision, and the applicant may appeal to the High Court against the Minister's decision.
(3) On the hearing of an appeal under this section in relation to a proposal to revoke, or a refusal to grant, a licence the High Court may either confirm the proposal or refusal or allow the appeal and, where an appeal is allowed, the Minister, as may be appropriate, shall not revoke the licence or shall grant the licence.
(4) A decision of the High Court on an appeal under this section shall be final save that, by leave of that Court, an appeal from that decision shall lie to the Supreme Court on a specified question of law.
Non-application of Act.
6.—(1) This Act shall not apply to—
(a) any scheme or service relating to employment or the recruitment of staff and administered or operated by or under the direction of a Minister of State,
(b) the Civil Service Commission,
(c) the Local Appointments Commission.
(2) The Minister may, if he so thinks fit, by order grant exemption from this Act or a specified provision thereof in respect of the carrying on of the business of a particular class of employment agency.
(3) The Minister may by order revoke or amend an order under this section.
Fees, etc., of agencies.
7.—(1) A person carrying on the business of an employment agency shall not charge any fees or expenses, in respect of services rendered in the course of the business, in excess of a scale approved by the Minister, and shall prepare and submit to the Minister as may be required for the purposes of this section a scale of such fees and expenses.
(2) A person carrying on the business of an employment agency shall not charge any fee solely for agreeing to seek employment for another person or solely for agreeing to seek persons who will give or accept employment.
General power to make regulations.
8.—(1) The Minister may make regulations for giving effect to this Act and generally for controlling and supervising the carrying on of employment agencies.
(2) Regulations under this section may, without prejudice to the generality of subsection (1) of this section, provide for all or any of the following matters—
(a) requiring a person carrying on an employment agency to keep records of the business conducted by the agency and of such other matters as may be prescribed;
(b) prescribing the form of such records and the entries to be made in them;
(c) requiring a person carrying on an employment agency to furnish to the Minister annual returns and, at such times and in such manner as may be specified, such other information as he may from time to time require;
(d) the prevention of fraud in the carrying on of the business of employment agency;
(e) the safeguarding of moneys received by employment agencies for and on behalf of persons employing such agencies;
(f) requiring the display in premises of employment agencies of licences under this Act granted in respect of the premises, of scales of fees and expenses approved thereunder and of such other notices as may be prescribed;
(g) requiring holders of licences under this Act to obtain, keep and (if so required) produce to the Minister in advance of seeking persons for employment outside the State evidence of the authority of such holders to act on behalf of persons offering such employment and information relating to the terms of such employment;
(h) requiring, in the case of a notice in a publication published in the State seeking a person for employment outside the State or offering to obtain employment outside the State for a citizen of the State residing in the State, the inclusion in the notice of the name and address of the person outside the State seeking a person for or offering employment or the name and address of the holder of a licence under this Act;
(i) requiring, in the case of an employment agency seeking persons under the age of 18 for employment outside the State or offering to obtain employment outside the State for citizens of the State under the age of 18 years and residing in the State, such information as may be specified in the regulations relating to the employment outside the State.
Power of entry inspection, etc.
9.—(1) The Minister may appoint such and so many persons as he thinks fit to be authorised officers for the purposes of this Act.
(2) Every authorised officer shall be furnished with a warrant of his appointment as an authorised officer and, when exercising any power conferred on an authorised officer by this section shall, if requested by any person affected, produce the warrant to that person.
(3) An authorised officer may at all reasonable times—
(a) enter and inspect any premises in which the business of an employment agency is being carried on or in respect of which an application under section 3 of this Act has been made,
(b) inspect such books and records relating to the business of an employment agency as are required to be kept under this Act, and, where he has reasonable grounds for believing that this Act is being or has been contravened, take copies of any entries in such books or records,
(c) require any person carrying on the business of an employment agency or proposing to do so to furnish him with such information as he may reasonably require in order to ascertain whether or not the agency is being or is likely to be conducted in accordance with this Act.
(4) A person shall not—
(a) obstruct or impede an authorised officer in the exercise of any of the powers conferred by this section;
(b) fail or refuse to give to an authorised officer on demand any information which the officer is entitled to demand under this section, or
(c) give to an authorised officer information which the person knows to be false or misleading in a material particular.
Offences.
10.—(1) Where a person contravenes this Act or any regulation thereunder he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £50 and, in the case of a continuing offence, to a further fine not exceeding £10 in respect of each day on which the offence is continued.
(2) Where an offence under this Act is committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any wilful neglect on the part of, any director, manager, secretary, or other officer of the body corporate, the director, manager, secretary or other officer shall also be deemed to be guilty of the offence.
Laying of regulations before Houses of Oireachtas.
11.—Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Repeal.
12.—Section 85 of the Public Health Acts (Amendment) Act, 1907, is hereby repealed.
Expenses, etc.
13.—(1) The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
(2) Any moneys received by the Minister under this Act shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Commencement.
14.—This Act shall come into operation on such day as the Minister appoints by order.
Short title.
15.—This Act may be cited as the Employment Agency Act, 1971.
