Toirmeasc ar mhion-aoisigh do thabhairt vóta.

1.—Ní bheidh duine ar bith ná beidh bliain agus fiche slán aige i dteideal vóta do thabhairt i dtoghachán (pé aca toghachán generálta no toghachán corr é) do chomhaltaí no do chomhalta de Dháil Éireann.

2.—Deintear leis seo alt 29 den Acht Timpeal Toghacháin, 1923 (Uimh. 12 de 1923), do leasú mar leanas, sé sin le rá:—

(a) féadfaidh ceann cóimhrimh no a ionadaidhe, agus déanfaidh má hiarrtar air é thar ceann iarrthóra ar bith, an cheist seo leanas (léi féin no maraon le ceann amháin no gach ceann den dá cheist a luaidhtear i bhfo-alt (1) den alt san 29) do chur chun aon vótálaidhe le linn dó a vóta do thairgsint, ach ní dá éis sin, sé sin le rá:—

“An bhfuil bliain agus fiche slán agat?”;

(b) má dheineann duine chun a gcuirfear an cheist a luaidhtear sa mhír sin roimhe seo den alt so freagra diúltach do thabhairt ar an gceist sin ní leigfear dó vóta do thabhairt;

(c) deintear leis seo na focail “agus go bhfuil bliain agus fiche slán agam” do chur i ndeireadh na móide no an dearbhuithe atá leagtha amach i bhfo-alt (2) den alt san 29 agus beid ina gcuid den chéanna;

(d) léireofar fo-alt (3) den alt san 29 agus beidh éifeacht aige fé réir forálacha an ailt seo;

(e) beidh ar na cúiseanna atá curtha síos i bhfo-alt (4) den alt san 29 an chúis go bhfeictear don cheann chóimhrimh no dá ionadaidhe, ar é do chur na ceiste a luaidhtear i mír (a) den alt so chun duine a bheidh ag tairgsint a vóta, gan bliain agus fiche do bheith slán ag an duine sin.

ELECTORAL ACT, 1941.


AN ACT TO PROHIBIT PERSONS WHO HAVE NOT ATTAINED THE AGE OF TWENTY-ONE YEARS FROM VOTING AT ELECTIONS OF MEMBERS OF DÁIL EIREANN AND TO PROVIDE FOR MATTERS CONSEQUENTIAL ON OR INCIDENTAL TO THAT PROHIBITION. [16th December, 1941.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Prohibition of voting by minors.

1.—No person who has not attained the age of twenty-one years shall be entitled to vote at an election (whether a general election or a bye-election) of members or a member of Dáil Eireann.

Amendment of section 29 of the Electoral Act, 1923.

2.Section 29 of the Electoral Act, 1923, (No. 12 of 1923), is hereby amended as follows, that is to say:—

(a) a returning officer or his deputy may and, if so required on behalf of any candidate, shall put to any voter at the time of his tendering his vote and not afterwards the following question (either alone or in addition to either or both of the two questions mentioned in sub-section (1) of the said section 29) that is to say:—

“Have you attained the age of twenty-one years?”;

[GA]

(b) if a person to whom the question set out in the foregoing paragraph of this section has been put answers that question in the negative, he shall not be permitted to vote;

[GA]

(c) the words “and that I have attained the age of twenty-one years” are hereby added at the end of and shall form part of the oath or affirmation set out in sub-section (2) of the said section 29;

(d) sub-section (3) of the said section 29 shall be construed and have effect subject to the provisions of this section;

[GA]

(e) the reasons given in sub-section (4) of the said section 29 shall include the reason that it appears to the returning officer or his deputy, upon putting the question set out in paragraph (a) of this section to a person tendering his vote, that such person has not attained the age of twenty-one years.

Repeal.

3.—Section 25 of the Parliamentary Elections (Ireland) Act, 1823, is hereby repealed.

Short title and citation.

4.—(1) This Act may be cited as the Electoral Act, 1941.

(2) The Electoral Acts, 1923 to 1936, and this Act may be cited together as the Electoral Acts, 1923 to 1941.
