LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACTS, 1983
Definitions.
1.—In this Act—
“the Assembly” means the Assembly of the European Communities;
“the Act of 1977” means the European Assembly Elections Act, 1977;
“chairman” means, save where the context otherwise requires, the chairman of the Board and “chairmanship” shall be construed accordingly;
“deputy chairman”, except in section 8 (1) of this Act, means the deputy chairman of the Board and “deputy chairmanship” shall be construed accordingly;
“ordinary member” means a member of the Board other than the chairman.
Board to continue to be body corporate, etc.
2.—(1) The Board shall continue to be a body corporate with perpetual succession and a seal and power to sue and be sued in its corporate name and to acquire, hold and dispose of land.
(2) The seal of the Board shall be authenticated by the signature of the chairman or of some other member, or of an employee of the Board or of a person whose services are availed of by the Board by virtue of section 21 (3) of the Act of 1976, authorised by the Board to act in that behalf.
(3) Judicial notice shall continue to be taken of the seal of the Board and every document purporting to be an instrument made by the Board and to be sealed with the seal (purporting to be authenticated in accordance with subsection (2) of this section) of the Board shall be received in evidence and be deemed to be such instrument without proof unless the contrary is shown.
(4) A person who immediately before the passing of this Act held the office either of chairman or of an ordinary member shall, subject to section 3 (2) of the Act of 1976 and to section 10 of this Act, continue to hold that office.
Board to consist of chairman and five other members.
3.—On and from the commencement of this section the Board shall consist of a chairman and five other members.
General duty of Board.
4.— (1) (a) It shall be the duty of the Board to ensure that appeals, references and other matters with which it is concerned are disposed of as expeditiously as may be and, for that purpose to take all such steps as are open to it to ensure that, in so far as is practicable, there are no avoidable delays at any stage in the consideration of such appeals, references and other matters.
(b) The Board shall conduct, at such intervals as it thinks fit or the Minister directs, reviews of its organisation and of the systems and procedures used by it in relation to appeals, references and other matters with which it is concerned.
(c) Where the Minister gives a direction under this section, the Board shall report to the Minister the results of the review conducted pursuant to the direction and shall comply with any directive which the Minister may, after consultation with the Board as regards such results, give in relation to all or any of the matters which were the subject of the review.
(2) The Board may make submissions to the Minister as regards any matter pertaining to its functions.
(3) The Minister may consult with the Board as regards any matter pertaining to the performance of—
(a) the functions of the Board, or
(b) the functions assigned to the Minister by or under the Local Government (Planning and Development) Acts, 1963 to 1983, or by any other enactment or by any order, regulation or other instrument thereunder.
(4) (a) The provisions of subsection (1) of this section are without prejudice to the provisions specified in paragraph (b) of this subsection.
(b) The provisions referred to in paragraph (a) of this subsection are—
(i) the provisions of the Local Government (Planning and Development) Acts, 1963 to 1983, or of any regulations made thereunder which relate to the performance by the Board of its functions,
(ii) the provisions of any other enactment, order, regulation or other instrument thereunder which so relates.
Chairman.
5.—(1) The chairman shall be appointed by the Government.
(2) There shall be a committee (in this section subsequently referred to as “the committee”) consisting of—
(a) the President of the High Court,
(b) the Chairman of the County Councils General Council,
(c) the Chief Engineering Adviser of the Department of the Environment,
(d) the Chairman of the Council of An Taisce—the National Trust for Ireland,
(e) the President of the Construction Industry Federation, and
(f) the President of the Executive Council of the Irish Congress of Trade Unions.
(3) Where—
(a) any of the persons aforesaid signifies at any time his unwillingness or inability to act for any period as a member of the committee,
or
(b) any of the persons aforesaid is through ill-health or otherwise unable so to act for any period,
the Minister may, when making a request under subsection (7) of this section, appoint another person to be a member of the committee in his place and such person shall remain a member of the committee until such time as the selection by the committee pursuant to the request is made.
(4) Where the Minister makes a request under subsection (7) of this section and at the time of making the request any of the offices aforesaid is vacant, the Minister may appoint a person to be a member of the committee and such person shall remain a member of the committee until such time as the selection by the committee pursuant to the request is made.
(5) Where pursuant to subsection (3) or (4) of this section the Minister appoints a person to be a member of the committee, he shall, as soon as may be, cause a notice of the appointment to be published in the Iris Oifigiúil.
(6) (a) The Minister may by order amend subsection (2) of this section.
(b) The Minister may by order amend or revoke an order under this subsection (including an order under this paragraph).
(c) Where an order under this subsection is proposed to be made, the Minister shall cause a draft thereof to be laid before both Houses of the Oireachtas and the order shall not be made until a resolution approving of the draft has been passed by each such House.
(d) Where an order under this subsection is for the time being in force, subsection (2) of this section shall be construed and have effect subject to the terms of the order.
(7) (a) The committee shall, whenever so requested by the Minister, select three candidates, or if in the opinion of the committee there is not a sufficient number of suitable applicants, such lesser number of candidates as the committee shall determine, for appointment to be the chairman and shall inform the Minister of the names of the candidates, or, as may be appropriate, the name of the candidate, selected and of the reasons why, in the opinion of the committee, they are or he is suitable for such appointment.
(b) In selecting candidates the committee shall have regard to the special knowledge and experience and other qualifications or personal qualities which the committee consider appropriate to enable a person effectively to perform the functions of the chairman.
(8) Except in the case of a reappointment under subsection (12) of this section, the Government shall not appoint a person to be the chairman unless the person was amongst those, or, where appropriate, was the candidate, selected by the committee pursuant to a request under subsection (7) of this section in relation to that appointment but—
(a) if the committee is unable to select any suitable candidate pursuant to a particular request under the said subsection (7), or
(b) if the Government decide not to appoint to be the chairman any of the candidates, or, where appropriate, the candidate, selected by the committee pursuant to a particular such request,
then either—
(c) the Government shall appoint a person to be the chairman who was amongst those, or, where appropriate, was the candidate, selected by the committee pursuant to a previous such request (if any) in relation to that appointment, or
(d) the Minister shall make a further such request to the committee and the Government shall appoint to be the chairman a person who was amongst those, or, where appropriate, was the candidate, selected by the committee pursuant to that request or pursuant to another such request made in relation to that appointment.
(9) The Minister may make regulations as regards—
(a) the publication of notice that a request has been received by the committee under subsection (7) of this section,
(b) applications for selection by the committee,
(c) any other matter which the Minister considers expedient for the purposes of this section.
(10) A person who is, for the time being—
(a) entitled under the Standing Orders of either House of the Oireachtas to sit therein,
(b) a representative in the Assembly,
(c) a member of a local authority,
shall be disqualified for being appointed as the chairman.
(11) The chairman shall be appointed in a wholetime capacity and shall not at any time during his term of office hold any other office or employment in respect of which emoluments are payable.
(12) Subject to the provisions of this section, the chairman shall hold office for a term of seven years and may be re-appointed by the Government for a second or subsequent term of office: Provided that a person shall not be reappointed under this subsection unless, at the time of his reappointment, he is or was the outgoing chairman of the Board.
(13) (a) The chairman may resign his chairmanship by letter addressed to the Minister and the resignation shall take effect as on and from the date of the receipt of the letter by the Minister.
(b) The chairman shall vacate the office of chairman on attaining the age of sixty-five years.
(c) A person shall cease to be the chairman if he—
(i) is nominated either as a member of Seanad Éireann or for election to either House of the Oireachtas,
(ii) is either nominated for election to the Assembly or appointed under section 15 of the Act of 1977 to be a representative in the Assembly,
(iii) becomes a member of a local authority.
(14) (a) There shall be paid by the Board to the chairman the same salary as is paid to a judge of the High Court.
(b) Subject to the provisions of this section, the chairman shall hold office on such terms and conditions (including terms relating to allowances for expenses) as the Minister, with the consent of the Minister for the Public Service, determines.
(15) The chairman may be removed from office by the Government if he has become incapable through ill-health of effectively performing his duties, or if he has committed stated misbehaviour, or if his removal appears to the Government to be necessary for the effective performance by the Board of its functions, and in case the chairman is removed from office under this subsection, the Government shall cause to be laid before each House of the Oireachtas a statement in writing of the reasons for the removal.
Chairman to ensure efficient discharge of business of Board, etc.
6.—(1) It shall be the function of the chairman, or, where he is not available or where the office of chairman is vacant, of the deputy chairman—
(a) to ensure the efficient discharge of the business of the Board, and
(b) to arrange the distribution of the business of the Board among its members.
(2) Where the chairman is of opinion that the conduct of an ordinary member has been such as to bring the Board into disrepute or has been prejudicial to the effective performance by the Board of all or any one or more of its functions, he may in his absolute discretion—
(a) require the member of the Board to attend for interview and there interview the member privately and inform him of such opinion, or
(b) where he considers it appropriate to do so, otherwise investigate the matter and, if he considers it appropriate so to do, report to the Minister the result of the investigation.
Ordinary members.
7.—(1) The Minister may prescribe—
(a) for the purposes of paragraph (a) of subsection (2) of this section any two or more organisations which in his opinion are representative of persons whose professions or occupations relate to physical planning and development,
(b) for the purposes of paragraph (b) of the said subsection (2) any two or more organisations which in his opinion are representative of persons concerned with the protection and preservation of the environment and of amenities,
(c) for the purposes of paragraph (c) of the said subsection (2) any two or more organisations which in his opinion are concerned with the promotion of economic or other development or are representative of either or both of the following, namely, persons carrying on the business of developing land or persons employed or engaged in or otherwise connected with the construction industry,
(d) for the purposes of paragraph (d) of the said subsection (2) any two or more organisations which in his opinion are, in relation to the community, concerned with the promotion of social, economic or general interests.
(2) Subject to section 12 (4) of this Act, the ordinary members shall be appointed by the Minister as follows:
(a) one shall be so appointed from among persons selected by organisations which for the time being stand prescribed for the purposes of this paragraph by the Minister;
(b) one shall be so appointed from among persons selected by organisations which for the time being stand prescribed for the purposes of this paragraph by the Minister;
(c) one shall be so appointed from among persons selected by organisations which for the time being stand prescribed for the purposes of this paragraph by the Minister;
(d) one shall be so appointed from among persons selected by organisations which for the time being stand prescribed for the purposes of this paragraph by the Minister;
(e) one shall be so appointed from among the officers of the Minister who are established civil servants for the purposes of the Civil Service Regulation Act, 1956.
(3) An organisation prescribed for the purposes of paragraph (a), (b), (c) or (d) of subsection (2) of this section shall, whenever so requested by the Minister, select such number of candidates (not being less than two) as the Minister may specify for appointment as an ordinary member and shall inform the Minister of the names of the candidates selected and of the reasons why, in the opinion of the organisation, they are suitable for such appointment.
(4) Except in the case of an appointment pursuant to paragraph (e) of subsection (2) of this section or of a re-appointment under subsection (9) of this section and subject to section 12 (4) of this Act, the Minister shall not appoint a person to be an ordinary member unless the person was amongst those selected pursuant to a request under subsection (3) of this section in relation to that appointment, but—
(a) if all of the appropriate organisations refuse or fail to select any candidate pursuant to a particular request under the said subsection (3), or
(b) if the Minister decides not to appoint as an ordinary member any of the candidates selected by such organisations pursuant to a particular request under that subsection,
then either—
(c) the Minister shall appoint as an ordinary member a person who was amongst those selected by such an organisation pursuant to a previous request (if any) under that subsection in relation to that appointment, or
(d) the Minister shall make a further such request and shall appoint as an ordinary member a person who was amongst those selected pursuant to that request or pursuant to another such request made in relation to that appointment.
(5) Where a request is made pursuant to subsection (3) of this section, failure or refusal by the organisation of whom the request is made to select the number of candidates specified in the request shall not preclude the appointment as an ordinary member of a person who was selected in relation to that appointment either by the aforesaid organisation or by any other organisation.
(6) The Minister may make regulations as regards—
(a) the period within which the Minister is to be informed in accordance with subsection (3) of this section,
(b) any other matter which the Minister considers expedient for the purposes of this section.
(7) A person who is for the time being—
(a) entitled under the Standing Orders of either House of the Oireachtas to sit therein,
(b) a representative in the Assembly,
(c) a member of a local authority,
shall be disqualified for being appointed to be an ordinary member.
(8) Each of the ordinary members shall be appointed in a wholetime capacity and shall not at any time during his term of office hold any other office or employment in respect of which emoluments are payable.
(9) Subject to the provisions of section 12 (4) (b) of this Act, an ordinary member shall hold office for such term (not exceeding five years) as shall be specified by the Minister when appointing him to office and may be re-appointed by the Minister for a second or subsequent term of office: Provided that a person shall not be reappointed under this subsection unless, at the time of his re-appointment, he is or was an outgoing member of the Board.
(10) (a) An ordinary member may resign his membership by letter addressed to the Minister and the resignation shall take effect as on and from the date of the receipt of the letter by the Minister.
(b) A person shall vacate the office of ordinary member on attaining the age of sixty-five years.
(c) A person shall cease to be an ordinary member if he—
(i) is nominated either as a member of Seanad Éireann or for election to either House of the Oireachtas,
(ii) is either nominated for election to the Assembly or appointed under section 15 of the Act of 1977 to be a representative in the Assembly,
(iii) becomes a member of a local authority.
(11) (a) There shall be paid by the Board to each ordinary member such remuneration and allowances for expenses as the Minister, with the consent of the Minister for the Public Service, determines.
(b) Subject to the provisions of this section, an ordinary member shall hold office on such terms and conditions as the Minister, with the consent of the Minister for the Public Service, determines.
(12) An ordinary member may be removed from office by the Minister if he has become incapable through ill-health of effectively performing his duties, or if he has committed stated misbehaviour, or if his removal appears to the Minister to be necessary for the effective performance by the Board of its functions, and in case an ordinary member is removed from office under this subsection, the Minister shall cause to be laid before each House of the Oireachtas a statement in writing of the reasons for the removal.
Deputy chairman of Board.
8.—(1) The Minister shall appoint from amongst the ordinary members a person to be the deputy chairman of the Board and such appointment shall be for such period as shall be specified in the appointment.
(2) If at any time the deputy chairman ceases to be an ordinary member of the board, he shall thereupon cease to be deputy chairman.
(3) The deputy chairman shall, in addition to his remuneration as an ordinary member, be paid by the Board such additional remuneration (if any) as the Minister, with the consent of the Minister for the Public Service, determines.
(4) The deputy chairman may resign his deputy chairmanship by letter addressed to the Minister and the resignation shall take effect as on and from the date of the receipt of the letter by the Minister.
Superannuation of members of Board.
9.—(1) The Minister may with the concurrence of the Minister for the Public Service—
(a) make a scheme or schemes for the granting of pensions, gratuities or other allowances to or in respect of the chairman and ordinary members ceasing to hold office,
(b) make a scheme or schemes for the granting of gratuities to or in respect of persons ceasing to hold office by virtue of section 10 of this Act.
(2) A scheme under this section may provide that the termination of the appointment of the chairman or of an ordinary member during that person's term of office shall not preclude the award to him under the scheme of a pension, gratuity or other allowance.
(3) The Minister may, with the concurrence of the Minister for the Public Service, amend a scheme made by him under this section.
(4) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity, or allowance payable in pursuance of a scheme under this section, such dispute shall be submitted to the Minister who shall refer it to the Minister for the Public Service, whose decision shall be final.
(5) A scheme under this section shall be carried out by the Board in accordance with its terms.
(6) No pension, gratuity or other allowance shall be granted by the Board to or in respect of any person referred to in subsection (1) of this section ceasing to hold office otherwise than in accordance with a scheme under this section.
(7) Notwithstanding section 25 of this Act, the scheme made by the Minister under Article 28 of the Schedule to the Act of 1976, shall continue in force and may be amended as if made under this section.
(8) Every scheme made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and if either such House, within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Cesser of office.
10.—(1) The person who, immediately before the commencement of this subsection, held the office of chairman of the Board, shall, on such commencement, cease to be chairman.
(2) Every person who, immediately before the commencement of this subsection was an ordinary member of the Board, shall, on such commencement, cease to be such ordinary member.
Meetings and procedure of Board.
11.—(1) The Board shall hold such and so many meetings as may be necessary for the performance of its functions.
(2) The chairman and each ordinary member at a meeting of the Board shall have a vote.
(3) At a meeting of the Board—
(a) the chairman shall, if present, be chairman of the meeting,
(b) if and for so long as the chairman is not present, or if the office of chairman is vacant, the deputy chairman shall, if present, be chairman of the meeting,
(c) if and for so long as neither the chairman nor the deputy chairman is present, or if the chairman is not present or if the office of chairman is vacant, and in either case, the office of deputy chairman is vacant, the ordinary members who are present shall choose one of their number to be chairman of the meeting.
(4) Every question at a meeting of the Board shall be determined by a majority of votes of the members present and, in the event that voting is equally divided, the person who is chairman of the meeting shall have a casting vote.
(5) (a) Subject to the Local Government (Planning and Development) Acts, 1963 to 1983, and to any regulations made thereunder, and subject also to any other enactment or order, regulation or other instrument thereunder, which regulates or otherwise affects the procedure of the Board, the Board shall regulate its own procedure and business.
(b) The Minister may require the Board to keep him informed of the arrangements made under this subsection for the regulation of its procedure and business.
(6) (a) Subject to paragraphs (b) and (c) of this subsection, the Board may perform or exercise any of its functions through or by any member of the Board or other person who, in either case, has been duly authorised by the Board in that behalf.
(b) Paragraph (a) of this subsection shall be construed as enabling a member of the Board finally to determine a particular case if, and only if, the case to which an authorisation under that paragraph relates has been considered at a meeting of the Board prior to the giving of the authorisation.
(c) Paragraph (a) of this subsection shall not be construed as enabling the Board to authorise a person who is not a member of the Board finally to determine any particular case with which the Board is concerned.
Board's quorum, vacancies, etc.
12.—(1) The quorum for a meeting of the Board shall be three.
(2) Subject to subsection (1) of this section, the Board may act notwithstanding a vacancy in the chairmanship, the deputy chairmanship or among the ordinary members.
(3) Where a vacancy occurs in the chairmanship, deputy chairmanship or among the ordinary members, the Minister shall, as soon as may be, take steps to fill the vacancy.
(4) (a) Where, owing to the illness of the chairman or of an ordinary member, or for any other reason, a sufficient number of members of the Board is not available to enable the Board effectively to perform its functions, the Minister may, as an interim measure, appoint from among the officers referred to in section 7 (2) (e) of this Act, one or more persons to be an ordinary member.
(b) A person shall not be appointed to be an ordinary member under this subsection for a term in excess of twelve months.
Prohibition on disclosure of information.
13.—(1) No person shall, without the consent of the Board (which may be given to the person, subject to or without conditions, as regards any information, as regards particular information or as regards information of a particular class or description) disclose—
(a) any information obtained by him while serving as a member or employee of, or consultant or adviser to, the Board or as a person whose services are availed of by the Board by virtue of section 21 (3) of the Act of 1976,
(b) any information so obtained relative to the business of the Board or to the performance of its functions.
(2) A person who contravenes subsection (1) of this section shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £800.
(3) Nothing in subsection (1) of this section shall prevent—
(a) disclosure of information in a report made to the Board or in a report made by or on behalf of the Board to the Minister,
(b) disclosure of information by any person in the course of and in accordance with the duties of his office.
Prohibition of certain communications in relation to appeals, etc.
14.—(1) It shall not be lawful to communicate with the chairman or with an ordinary member for the purpose of influencing improperly his consideration of an appeal, reference, or other matter with which the Board is concerned or a decision of the Board as regards any such matter.
(2) If the chairman or an ordinary member becomes of opinion that a communication is in contravention of subsection (1) of this section, it shall be his duty not to entertain the communication further.
Oral hearings.
15.—(1) The Board shall have an absolute discretion to hold an oral hearing of any reference or appeal to the Board which is not a reference or appeal to which subsection (2) of this section applies.
(2) (a) This subsection applies to any reference or appeal to the Board which is of a class or description which may, for the time being, be prescribed for the purposes of this subsection.
(b) Regulations made for the purposes of this subsection may include provisions requiring the Board to hold, either generally or in such cases as may be specified in the regulations, oral hearings of references or appeals which are of a class or description so specified.
(3) Where the Board is requested to hold an oral hearing of a reference or appeal (other than a reference or appeal to which subsection (2) of this section applies) and decides to determine the reference or appeal without an oral hearing, the following provisions shall apply:
(a) the Board shall serve notice of its decision on the person who requested such hearing and the notice shall require that person to make, within a period specified in the notice (being a period of not less than fourteen days beginning on the date of service of the notice), to the Board in writing such submissions or further submissions (if any) as he thinks fit in relation to the reference or appeal, and
(b) the Board shall not proceed to determine the reference or appeal until after the expiration of the period so specified.
Board may dismiss appeals under section 26 of Principal Act if vexatious, etc.
16.—(1) Subject to subsection (2) of this section, the Board shall in the following circumstances have an absolute discretion to dismiss an appeal brought under section 26(5) of the Principal Act—
(a) where, having considered the grounds of appeal, the Board is of opinion that the appeal is vexatious, frivolous or without substance or foundation, or
(b) where, having regard to—
(i) the nature of the appeal (including any question which in the Board's opinion is raised by the appeal), and
(ii) any previous permission or approval which in its opinion is relevant,
the Board is satisfied that in the particular circumstances the appeal should not be further considered by it.
(2) The exercise by the Board of the power conferred on it by subsection (1) of this section shall be subject to the restriction imposed on the Board by section 26 (1) of the Principal Act as applied by section 14 of the Act of 1976.
Notice requiring statement of grounds of appeal.
17.—(1) Where an appeal is made to the Board and the grounds of appeal are not stated in writing, the Board may serve on the appellant a notice—
(a) requiring him, within a period specified in the notice (being a period of not less than fourteen days beginning on the date of service of the notice) to submit to the Board a written statement of his grounds of appeal, and
(b) stating that, in default of compliance with the requirements of the notice, the Board will, after the period so specified and without further notice to the person, pursuant to this section declare that the appeal shall be regarded as having been withdrawn.
(2) Where a notice has been served under subsection (1) of this section, the Board may, having considered the response (if any) to the notice, at any time after the expiration of the period specified in the notice and without further notice to the party on whom the notice has been so served, if they so think fit declare that the appeal to which the notice relates shall be regarded as having been withdrawn.
Power of Board regarding delays by parties etc., to appeals.
18.—(1) Where the Board is of opinion that any document, particulars or other information is necessary for the purpose of enabling it to determine an appeal brought under section 26 (5) of the Principal Act, the Board may serve on any person who is a party to the appeal, or on any other person who has made submissions or observations to the Board as regards the appeal, a notice under this section—
(a) requiring that person, within a period specified in the notice (being a period of not less than fourteen days beginning on the date of service of the notice) to submit to the Board such document, particulars or other information (which document, particulars or other information shall be specified in the notice), and
(b) stating that, in default of compliance with the requirements of the notice, the Board will, after the period so specified and without further notice to the person, pursuant to this section dismiss or otherwise determine the appeal.
(2) Where a notice has been served under subsection (1) of this section, the Board, at any time after the expiration of the period specified in the notice, may, having considered the response (if any) to the notice, without further notice to the person on whom the notice has been so served dismiss or otherwise determine the appeal.
Appeals against conditions.
19.—(1) Where—
(a) an appeal is brought under section 26 (5) of the Principal Act from a decision of a planning authority to grant a permission or approval, and
(b) the appeal relates only to a condition or conditions subject to which the decision was made, and
(c) the Board is satisfied, having regard to the nature of the condition or conditions, that the determination by the Board of the relevant application as if it had been made to it in the first instance would not be warranted,
subject to compliance by the Board with subsection (2) of this section when considering the appeal, the Board may, in its absolute discretion, give to the relevant planning authority such directions as it considers appropriate relating to the attachment, amendment or removal by that authority either of the condition or conditions to which the appeal relates or of other conditions.
(2) In exercising the power conferred on it by subsection (1) of this section, apart from considering the condition or conditions to which the relevant appeal relates, the Board shall be restricted to considering the proper planning and development of the area of the relevant planning authority (including the preservation and improvement of the amenities thereof), regard being had to the provisions of the development plan, the provisions of any special amenity area order relating to the said area, the terms of any previous permission considered by the Board to be relevant, the matters referred to in section 26 (2) of the Principal Act and the matters referred to in section 24 (2) of the Act of 1976.
Amendment of section 26 of Principal Act.
20.—Section 26 (9) (a) of the Principal Act is hereby amended by the substitution of the following subparagraph for subparagraph (ii):
“(ii) in case an appeal or appeals is or are taken against the decision, they shall not make the grant unless as regards the appeal or, as may be appropriate, each of the appeals—
(I) it is withdrawn, or
(II) it is dismissed by the Board pursuant to section 16 or 18 of the Local Government (Planning and Development) Act, 1983, or
(III) in relation to it a direction is given to the authority by the Board pursuant to section 19 of the said Act,
and, in the case of the withdrawal or dismissal of an appeal or of all such appeals, as may be appropriate, they shall make the grant as soon as may be after such withdrawal or dismissal and, in the case of such a direction, they shall make the grant, in accordance with the direction, as soon as may be after the giving by the Board of the direction.”.
Amendment of sections 10 and 19 of Act of 1976.
21.—(1) Subsection (1) of section 10 of the Act of 1976 is hereby amended by the insertion of “given with the consent of the Minister for the Public Service” after “the Minister”, and the said subsection (1), as so amended, is set out in paragraph 1 of the Table to this section.
(2) Subsection (2) of section 19 of the Act of 1976 is hereby amended by the substitution of “£200” for “£50”, and the said subsection (2), as so amended, is set out in paragraph 2 of the Table to this section.

1. 10.—(1) The Board shall appoint such and so many persons to be employees of the Board as the Board, subject to the approval of the Minister given with the consent of the Minister for the Public Service as to the number and kind of such employees, from time to time thinks proper.
2. (2) A direction to pay any sum exceeding £200 shall be given by the Board under subsection (1) of this section only after consultation with the Minister.
Construction.
22.—(1) Section 26 (5) (b) of the Principal Act, as amended by section 14 (9) of the Act of 1976, shall be construed and have effect subject to sections 16, 18 and 19 of this Act, and the other provisions relating to appeals to the Board of the Local Government (Planning and Development) Acts, 1963 to 1982, shall be construed and have effect subject to section 17 of this Act.
(2) Nothing in section 17 or 18 of this Act shall be construed as affecting any power conferred on the Board by or under any enactment other than those sections.
Restriction.
23.—(1) Nothing in this Act shall be construed as enabling the Minister to exercise any power or control in relation to any particular case with which the Board is or may be concerned.
(2) The reference to this Act in subsection (1) of this section shall not be construed as including a reference to section 7 of the Local Government (Planning and Development) Act, 1982.
Saver.
24.—Nothing in this Act shall be construed as interrupting or otherwise affecting the continued existence of the Board or the performance by it of any of its functions.
Repeals.
25.—The following provisions of the Act of 1976 are hereby repealed, namely, sections 3 (2), 4, 16, 18 (1), 18 (2), 31 and the Schedule.
Short title, collective citation, commencement and construction.
26.—(1) This Act may be cited as the Local Government (Planning and Development) Act, 1983.
(2) The Local Government (Planning and Development) Acts, 1963 to 1982, and this Act may be cited together as the Local Government (Planning and Development) Acts, 1963 to 1983.
(3) This Act shall come into operation on such day or days as the Minister may fix by order, either generally or with reference to any particular purpose or provision, and different days may be so fixed for different purposes and different provisions of this Act.
(4) This Act and the Local Government (Planning and Development) Acts, 1963 to 1982, shall be construed together as one Act.

(4) Duine a bhí, díreach roimh dháta an Achta seo a rith, i seilbh oifige mar chathaoirleach nó mar ghnáthchomhalta, leanfaidh sé, faoi réir alt 3 (2) d'Acht 1976 agus alt 10 den Acht seo, den oifig sin a shealbhú.

Dualgas ginearálta an Bhoird.
4.—(1) (a) Is é dualgas an Bhoird a áirithiú go ndéanfar achomhairc, tarchuir agus nithe eile is cúram dó a chur de láimh a luaithe is féidir agus, chun na críche sin, go ndéanfaidh sé gach beart is ceadaithe dó a dhéanamh chun a áirithiú nach ndéanfar, a mhéid is praiticiúil, aon mhoill is inseachanta ag aon chéim i mbreithniú na n-achomharc, na dtarchur agus na nithe eile sin.
(b) Déanfaidh an Bord, ag cibé agaí aimsire is cuí leis nó de réir mar a ordóidh an tAire, athbhreithnithe ar a eagraíocht agus ar na córais agus ar na nósanna imeachta a chleachtann sé i ndáil le hachomhairc, tarchuir agus nithe eile is cúram dó.
(c) Má thugann an tAire ordú faoin alt seo, tabharfaidh an Bord tuarascáil don Aire i dtaobh thorthaí an athbhreithnithe a rinneadh de bhun an ordaithe agus comhlíonfaidh sé aon ordachán a thabharfaidh an tAire, tar éis dó dul i gcomhairle leis an mBord maidir leis na torthaí sin, i ndáil leis na nithe go léir nó aon ní díobh a bhí faoi réim an athbhreithnithe.
(2) Féadfaidh an Bord aighneachtaí a dhéanamh chun an Aire maidir le haon ní a bhaineann lena fheidhmeanna.
(3) Féadfaidh an tAire dul i gcomhairle leis an mBord maidir le haon ní—
(a) a bhaineann le feidhmeanna an Bhoird a chur i gcrích, nó
(b) a bhaineann leis na feidhmeanna a shanntar don Aire leis na hAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 go 1983, nó fúthu, nó le haon achtachán eile nó le haon ordú, rialachán nó ionstraim eile fúthu, a chur i gcrích.
(4) (a) Ní dochar forálacha fho-alt (1) den alt seo do na fóralacha a shonraítear i mír (b) den fho-alt seo.

5.—(1) An Rialtas a cheapfaidh an cathaoirleach.
(2) Beidh coiste ann (dá ngairfear “an coiste” anseo feasta san alt seo) ar a mbeidh—
(a) Uachtarán na hArd-Chúirte,
(b) Cathaoirleach Ard-Chomhairle na gComhairlí Contae,
(c) Príomh-Chomhairleoir Innealtóireachta na Roinne Comhshaoil,
(d) Cathaoirleach Chomhairle an Taisce,
(e) Uachtarán na Cónaidhme Tionscail Foirgníochta, agus
(f) Uachtarán Chomhairle Feidhmiúcháin Chomhar Ceardchumann na hÉireann.
(3) I gcás—
(a) ina gcuirfidh aon duine de na daoine réamhráite sin in iúl aon uair nach mian leis nó nach féidir leis gníomhú ar feadh aon tréimhse mar chomhalta den choiste,
nó
(b) nach bhfuil aon duine de na daoine réamhráite, mar gheall ar easláinte nó ar chúis éigin eile, in ann gníomhú amhlaidh ar feadh aon tréimhse,

(5) Más rud é, de bhun fho-alt (3) nó (4) den alt seo, go gceapfaidh an tAire duine chun bheith ina chomhalta den choiste, cuirfidh sé faoi deara, a luaithe is féidir, fógra faoin gceapachán a fhoilsiú san Iris Oifigiúil.
(6) (a) Féadfaidh an tAire, le hordú, fo-alt (2) den alt seo a leasú.
(b) Féadfaidh an tAire, le hordú, ordú faoin bhfo-alt seo (lena n-áirítear ordú faoin mír seo) a leasú nó a chúlghairm.
(c) I gcás ina mbeartófar ordú faoin bhfo-alt seo a dhéanamh, cuirfidh an tAire faoi deara go leagfar dréacht de faoi bhráid gach Tí den Oireachtas agus ní dhéanfar an t-ordú go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach acu sin.

(10) Duine a bheidh, de thuras na huaire—
(a) i dteideal faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin,
(b) ina ionadaí sa Tionól,
(c) ina chomhalta d'údarás áitiúil,
beidh sé dícháilithe chun a cheaptha mar chathaoirleach.
(11) Ceapfar an cathaoirleach i gcáil lánaimsire agus ní shealbhóidh sé, am ar bith i gcaitheamh a théarma oifige, aon oifig ná fostaíocht eile a mbeidh díolaíochtaí iníoctha ina leith.
(12) Faoi réir fhorálacha an ailt seo, sealbhóidh an cathaoirleach oifig ar feadh téarma seacht mbliana agus féadfaidh an Rialtas é a athcheapadh i gcomhair an dara téarma oifige nó i gcomhair téarma oifige iardain: Ar choinníoll nach n-athcheapfar duine faoin bhfo-alt seo mura rud é, tráth a athcheaptha, gurb eisean nó gurbh eisean cathaoirleach ceann téarma an Bhoird.
(13) (a) Féadfaidh an cathaoirleach éirí as a chathaoirleacht trí litir a bheidh dírithe chun an Aire agus glacfaidh an t-éirí as éifeacht amhail ar an agus ón dáta ar a bhfaighidh an tAire an litir.
(b) Fágfaidh an cathaoirleach oifig an chathaoirligh ar chúig bliana is seasca d'aois a shlánú.
(c) Scoirfidh duine de bheith ina chathaoirleach—
(i) má ainmnítear é mar chomhalta de Sheanad Éireann nó lena thoghadh chun ceachtar Tí den Oireachtas,
(ii) má ainmnítear é lena thoghadh chun an Tionóil nó má cheaptar é faoi alt 15 d'Acht 1977 mar ionadaí sa Tionól,
(iii) má dhéantar comhalta d'údarás áitiúil de.
(14) (a) Íocfaidh an Bord leis an gcathaoirleach an tuarastal céanna a íoctar le breitheamh den Ard-Chúirt.
(b) Faoi réir fhorálacha an ailt seo, beidh an cathaoirleach i seibh oifige ar cibé téarmaí agus coinníollacha (lena n-áirítear téarmaí a bhaineann le liúntais i leith caiteachas) a chinnfidh an tAire, le toiliú Aire na Seirbhíse Poiblí.
(15) Féadfaidh an Rialtas an cathaoirleach a chur as oifig ar é a bheith éirithe éagumasach mar gheall ar easláinte lena dhualgais a chomhlíonadh go héifeachtach nó má rinne sé é féin a mhí-iompar mar a bheidh sonraithe, nó más dóigh leis an Rialtas gur gá é a chur as oifig le go gcomhlíonfadh an Bord feidhmeanna an Bhoird go héifeachtach, agus i gcás ina gcuirfear an cathaoirleach as oifig faoin bhfo-alt seo, cuirfidh an Rialtas faoi deara ráiteas i scríbhinn ag insint na gcúiseanna lena chur as oifig a leagan faoi bhráid gach Tí den Oireachtas.
An Cathaoirleach d'áirithiú go ndéanfar gnó an Bhoird a chur i gcrích go héifeachtúil, etc.
6.—(1) Beidh sé d'fheidhm ag an gcathaoirleach, nó, i gcás nach mbeidh sé ar fáil, nó ina mbeidh oifig an chathaoirligh folamh, ag an leas-chathaoirleach—
(a) a áirithiú go ndéanfar gnó an Bhoird a chur i gcrích go héifeachtúil, agus
(b) a shocrú go ndéanfar gnó an Bhoird a dháileadh ar a chomhaltaí.
(2) Más é tuairim an chathaoirligh go ndearna gnáthchomhalta é féin a iompar ar shlí a tharraingeodh míchlú ar an mBord nó gur dhochar é d'fheidhmeanna uile an Bhoird nó aon fheidhm nó feidhmeanna díobh a chomhlíonadh go héifeachtach, féadfaidh sé dá lánrogha féin—
(a) a cheangal ar an gcomhalta den Bhord freastal le haghaidh agallaimh agus an comhalta a chur faoi agallamh go príobháideach ann agus an tuairim sin a chur i bhfios dó, nó
(b) má mheasann sé gur cuí sin a dhéanamh, an t-ábhar a imscrúdú ar dhóigh eile, agus má mheasann sé gur cuí sin a dhéanamh, toradh an imscrúdaithe a thuairisciú don Aire.
Gnáthchomhaltaí.
7.—(1) Féadfaidh an tAire na heagraíochtaí seo a leanas a fhorordú—
(a) chun críocha mhír (a) d'fho-alt (2) den alt seo, aon dá eagraíocht nó níos mó atá, ina thuairim, ionadaitheach do dhaoine a mbaineann a ngairm nó a slí bheatha le pleanáil agus forbairt fhisiceach,
(b) chun críocha mhír (b) den fho-alt sin (2), aon dá eagraíocht nó níos mó atá, ina thuairim, ionadaitheach do dhaoine ar cúram dóibh an timpeallacht agus taitneamhachtaí a chosaint agus a chaomhnú,
(c) chun críocha mhír (c) den fho-alt sin (2), aon dá eagraíocht nó níos mó ar cúram dóibh, ina thuairim, forbairt eacnamaíochta nó forbairt eile a spreagadh nó atá ionadaitheach do cheachtar díobh seo a leanas nó dóibh araon, is é sin, daoine a bhíonn ag gabháil do ghnó forbartha talún nó daoine a bhíonn fostaithe sa tionscal foirgníochta nó ag gabháil don tionscal sin nó atá bainteach leis ar dhóigh eile,
(d) chun críocha mhír (d) den fho-alt sin (2), aon dá eagraíocht nó níos mó ar cúram dóibh, ina thuairim, leasanna sóisialta, eacnamaíochta nó ginearálta a spreagadh, i ndáil leis an bpobal.
(2) Faoi réir alt 12 (4) den Acht seo, déanfaidh an tAire na gnáthchomhaltaí a cheapadh mar a leanas:
(a) ceapfar duine amháin amhlaidh as líon na ndaoine a roghnóidh eagraíochtaí a bheidh forordaithe de thuras na huaire chun críocha na míre seo ag an Aire;
(b) ceapfar duine amháin amhlaidh as líon na ndaoine a roghnóidh eagraíochtaí a bheidh forordaithe de thuras na huaire chun críocha na míre seo ag an Aire;
(c) ceapfar duine amháin amhlaidh as líon na ndaoine a roghnóidh eagraíochtaí a bheidh forordaithe de thuras na huaire chun críocha na míre seo ag an Aire;
(d) ceapfar duine amháin amhlaidh as líon na ndaoine a roghnóidh eagraíochtaí a bheidh forordaithe de thuras na huaire chun críocha na míre seo ag an Aire;
(e) ceapfar duine amháin amhlaidh as líon na n-oifigeach don Aire ar státseirbhísigh bunaithe iad chun críocha Acht Rialuithe na Stát-Sheirbhíse, 1956.
(3) Déanfaidh eagraíocht a bheidh forordaithe chun críocha mhír (a), (b), (c) nó (d) d'fho-alt (2) den alt seo, aon uair a iarrfaidh an tAire é, cibé líon iarrthóirí (nach lú ná beirt) a shonróidh an tAire a roghnú lena gceapadh mar ghnáthchomhaltaí agus cuirfidh sí ainm na n-iarrthóirí a roghnaíodh agus na cúiseanna a bhfuil siad, i dtuairim na heagraíochta, oiriúnach don cheapachán sin, in iúl don Aire.
(4) Ach amháin i gcás ceapachán de bhun mhír (e) d'fho-alt (2) den alt seo nó i gcás athcheapachán faoi fho-alt (9) den alt seo agus faoi réir alt 12 (4) den Acht seo, ní cheapfaidh an tAire duine chun bheith ina ghnáthchomhalta mura raibh an duine ar líon na ndaoine a roghnaíodh de bhun iarrata faoi fho-alt (3) den alt seo i ndáil leis an gceapachán sin, ach—
(a) má dhiúltaíonn na heagraíochtaí iomchuí go léir, nó má theipeann orthu, aon iarrthóir a roghnú de bhun iarrata áirithe faoin bhfo-alt sin (3), nó
(b) má chinneann an tAire gan aon iarrthóir de na hiarrthóirí a roghnóidh na heagraíoctaí sin de bhun iarrata áirithe faoin bhfo-alt sin a cheapadh mar ghnáthchomhalta,
ansin—
(c) ceapfaidh an tAire mar ghnáthchomhalta duine a bhí ar líon na ndaoine a roghnaigh eagraíocht den sórt sin de bhun iarrata roimhe sin (más ann) faoin bhfo-alt sin i ndáil leis an gceapachán sin, nó

(6) Féadfaidh an tAire rialacháin a dhéanamh—
(a) maidir leis an tréimhse ina mbeidh an fhaisnéis atá le tabhairt de réir fho-alt (3) den alt seo le cur in iúl don Aire,
(b) maidir le haon ní eile is fóirsteanach leis an Aire chun críocha an ailt seo.
(7) Duine a bheidh de thuras na huaire—
(a) i dteideal faoi Bhuan-Orduithe cheachtar Tí den Oireachtas suí sa Teach sin,
(b) ina ionadaí sa Tionól,
(c) ina chomhalta d'údarás áitiúil,
beidh sé dícháilithe chun a cheaptha ina ghnáthchomhalta.
(8) Ceapfar gach gnáthchomhalta i gcáil lánaimsire agus ní shealbhóidh sé, am ar bith i gcaitheamh a théarma oifige, aon oifig ná fostaíocht eile a mbeidh díolaíochtaí iníoctha ina leith.
(9) Faoi réir fhorálacha alt 12 (4) (b) den Acht seo, sealbhóidh gnáthchomhalta oifig ar feadh cibé téarma (nach faide ná cúig bliana) a shonróidh an tAire tráth a cheaptha chun oifige agus féadfaidh an tAire é a athcheapadh i gcomhair an dara téarma oifige nó i gcomhair téarma oifige iardain: Ar choinníoll nach n-athcheapfar duine faoin bhfo-alt seo, mura rud é, tráth a athcheaptha, go bhfuil sé nó go raibh sé ina chomhalta ceann téarma den Bhord.
(10) (a) Féadfaidh gnáthchomhalta éirí as a chomhaltas trí litir a bheidh dírithe chun an Aire agus glacfaidh an t-éirí as éifeacht amhail ar an agus ón dáta ar a bhfaighidh an tAire an litir.
(b) Fágfaidh duine a oifig mar ghnáthchomhalta ar chúig bliana is seasca d'aois a shlánú.
(c) Scoirfidh duine de bheith ina ghnáthchomhalta—
(i) má ainmnítear é mar chomhalta de Sheanad Éireann nó lena thoghadh chun ceachtar Tí den Oireachtas,
(ii) má ainmnítear é lena thoghadh chun an Tionóil nó má cheaptar é faoi alt 15 d'Acht 1977 mar ionadaí sa Tionól,
(iii) má dhéantar comhalta d'údarás áitiúil de.
(11) (a) Íocfaidh an Bord le gach gnáthchomhalta cibé luach saothair agus liúntais i leith caiteachas a chinnfidh an tAire, le toiliú Aire na Seirbhíse Poiblí,
(b) Faoi réir fhorálacha an ailt seo, beidh gnáthchomhalta i seilbh oifige ar cibé téarmaí agus coinníollacha a chinnfidh an tAire, le toiliú Aire na Seirbhíse Poiblí.
(12) Féadfaidh an tAire gnáthchomhalta a chur as oifig ar é a bheith éirithe éagumasach mar gheall ar easláinte lena dhualgais a chomhlíonadh go héifeachtach nó má rinne sé é féin a mhí-iompar mar a bheidh sonraithe, nó más dóigh leis an Aire gur gá é chur as oifig le go gcomhlíonfadh an Bord feidhmeanna an Bhoird go héifeachtach, agus i gcás ina gcuirfear gnáthchomhalta as oifig faoin bhfo-alt seo, cuirfidh an tAire faoi deara ráiteas i scríbhinn ag insint na gcúiseanna lena chur as oifig a leagan faoi bhráid gach Tí den Oireachtas.
Leaschathaoirleach an Bhoird.
8.—(1) Ceapfaidh an tAire duine as líon na ngáthchomhaltaí chun bheith ina leas-chathaoirleach ar an mBord agus is go ceann cibé tréimhse a bheidh sonraithe sa cheapachán a dhéanfar an ceapachán sin.
(2) Má scoireann an leas-chathaoirleach aon am de bheith ina ghnáthchomhalta den Bhord, scoirfidh sé air sin de bheith ina leaschathaoirleach.
(3) Íocfaidh an Bord leis an leas-chathaoirleach, i dteannta a luach saothair mar ghnáthchomhalta, cibé luach saothair breise (más ann) a chinnfidh an tAire, le toiliú Aire na Seirbhíse Poiblí.
(4) Féadfaidh an leas-chathaoirleach éirí as leas-chathaoirleacht trí litir a bheidh dírithe chun an Aire agus glacfaidh an t-éirí as éifeacht amhail ar an agus ón dáta ar a bhfaighigh an tAire an litir.
Aoisliúntas chomhaltaí an Bhoird.
9.—(1) Féadfaidh an tAire, le comhthoiliú Aire na Seirbhíse Poiblí—
(a) scéim nó scéimeanna a dhéanamh chun pinsin, aiscí nó liúntais eile a thabhairt don chathaoirleach agus do ghnáthchomhaltaí, nó ina leith, ar scor dóibh de bheith i seilbh oifige,
(b) scéim nó scéimeanna a dhéanamh chun aiscí a thabhairt do dhaoine, nó i leith daoine, ar scor dóibh de bheith i seilbh oifige de bhua alt 10 den Acht seo.
(2) Féadfar a fhoráil le scéim faoin alt seo má fhoirceanntar ceapachán an chathaoirligh nó gnáthchomhalta le linn téarma oifige an duine sin nach mbeidh sin ina bhac ar phinsean, aisce nó liúntas eile a dhámhadh dó faoin scéim.
(3) Féadfaidh an tAire, le comhthoiliú Aire na Seirbhíse Poiblí, scéim arna déanamh aige faoin alt seo a leasú.
(4) Má bhíonn aon díospóid ann i dtaobh éileamh aon duine ar aon phinsean, aisce nó liúntas is iníoctha de bhun scéime faoin alt seo, nó i dtaobh méid an chéanna, cuirfear an díospóid sin faoi bhráid an Aire agus tarchuirfidh seisean chun Aire na Seirbhíse Poiblí í agus is cinneadh críochnaitheach cinneadh Aire na Seirbhíse Poiblí.
(5) Cuirfidh an Bord scéim faoin alt seo i gcrích de réir théarmaí na scéime sin.
(6) Ní thabharfaidh an Bord aon phinsean, aisce nó liúntas eile, ach amháin de réir scéime faoin alt seo, d'aon duine nó i leith aon duine dá dtagraítear i bhfo-alt (1) den alt seo ar an duine sin do scor de bheith i seilbh oifige.
(7) D'ainneoin alt 25 den Acht seo, leanfaidh an scéim a rinne an tAire faoi Airteagal 28 den Sceideal a ghabhann le Acht 1976 d'fheidhm a bheith aici agus féadfar í a leasú amhail is dá mba faoin alt seo a rinneadh í.
(8) Gach scéim a dhéanfar faoin alt seo leagfar í faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a déanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an scéim a leagan faoina bhráid, rún a rith ag neamhniú na scéime, beidh an scéim ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin scéim.
Scor d'oifig.
10.—(1) An duine a bhí, díreach roimh thosach feidhme an fho-ailt seo, i seilbh oifige mar chathaoirleach an Bhoird, scoirfidh sé, ar an tosach feidhme sin, de bheith ina chathaoirleach.
(2) Gach duine a bhí, díreach roimh thosach feidhme an fho-ailt seo, ina ghnáthchomhalta den Bhord, scoirfidh sé, ar an tosach feidhme sin, de bheith ina ghnáthchomhalta.
Cruinnithe agus nós imeachta an Bhoird.
11.—(1) Tionólfaidh an Bord cibé cruinnithe agus cibé méid cruinnithe is gá chun a fheidhmeanna a chomhlíonadh.
(2) Beidh vóta ag an gcathaoirleach agus ag gach gnáthchomhalta ag cruinniú den Bhord.
(3) Ag cruinniú den Bhord—
(a) is é an cathaoirleach, má bhíonn sé i láthair, a bheidh ina chathaoirleach ar an gcruinniú,
(b) mura mbeidh agus fad nach mbeidh an cathaoirleach i láthair, nó má bhíonn oifig an chathaoirligh folamh, is é an leaschathaoirleach, má bhíonn sé i láthair, a bheidh ina chathaoirleach ar an gcruinniú,
(c) mura mbeidh agus fad nach mbeidh an cathaoirleach ná an leas-chathaoirleach i láthair, nó mura mbeidh an cathaoirleach i láthair nó má bhíonn oifig an chathaoirligh folamh, agus má bhíonn, i gceachtar cás, oifig an leaschathaoirligh folamh, roghnóidh na gnáthchomhaltaí a bheidh i láthair duine dá líon féin chun bheith ina chathaoirleach ar an gcruinniú.
(4) Cinnfear gach ceist a éireoidh ag cruinniú den Bhord le tromlach vótaí na gcomhaltaí a bheidh i láthair agus, i gcás na vótaí a bheith roinnte go cothrom, beidh an vóta réitigh ag an duine a bheidh ina chathaoirleach ar an gcruinniú.
(5) (a) Faoi réir na nAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 go 1983, agus aon rialacháin a rinneadh fúthu agus, faoi réir aon achtachán nó ordú, rialachán nó ionstraim eile fúthu sin freisin, a rialaíonn nó a dhéanann difear ar shlí eile do nós imeachta an Bhoird, déanfaidh an Bord a nós imeachta agus a ghnó féin a rialáil.
(b) Féadfaidh an tAire a cheangal ar an mBord é a choimeád ar an eolas i dtaobh na socruithe a dhéanfar faoin bhfo-alt seo chun nós imeachta agus gnó an Bhoird a rialáil.
(6) (a) Faoi réir mhíreanna (b) agus (c) den fho-alt seo, féadfaidh an Bord aon cheann dá fheidhmeanna a chur á gcomhlíonadh nó á bhfeidhmiú trí aon chomhalta nó ag aon chomhalta den Bhord nó trí aon duine eile nó ag aon duine eile a bheidh údaraithe go cuí ag an mBord chun na críche sin.
(b) Forléireofar mír (a) den fho-alt seo mar mhír a chuireann ar chumas comhalta den Bhord cás áirithe a chinneadh go críochnaitheach má breithníodh, agus ar an gcoinníoll amháin gur breithníodh, an cás lena mbaineann an t-údarás faoin mír sin ag cruinniú den Bhord sular tugadh an t-údarás.
(c) Ní fhorléireofar mír (a) den fho-alt seo mar mhír a chuireann ar chumas an Bhoird údarás a thabhairt do dhuine nach comhalta den Bhord aon chás áirithe is cúram don Bhord a chinneadh go críochnaitheach.
Córam don Bhord, folúntais, etc.
12.—(1) Triúr is córam do chruinniú den Bhord.
(2) Faoi réir fho-alt (1) den alt seo, féadfaidh an Bord gníomhú d'ainneoin folúntas a bheith sa chathaoirleacht, sa leas-chathaoirleacht nó i líon na ngnáthchomhaltaí.
(3) I gcás folúntas a bheith sa chathaoirleacht, sa leas-chathaoirleacht nó i líon na ngnáthchomhaltaí, déanfaidh an tAire bearta a luaithe is féidir chun an folúntas a líonadh.
(4) (a) Más rud é, mar gheall ar an gcathaoirleach nó gnáthchomhalta a bheith breoite, nó mar gheall ar chúis ar bith eile, nach mbeidh go leor comhaltaí den Bhord ar fáil chun a chur ar chumas an Bhoird a fheidhmeanna a chomhlíonadh go héifeachtach, féadfaidh an tAire, mar bheart idirlinne, duine amháin nó níos mó a cheapadh mar ghnáthchomhalta as líon na n-oifigeach dá dtagraítear in alt 7 (2) (e) den Acht seo.
(b) Ní dhéanfar duine a cheapadh chun bheith ina ghnáthchomhalta faoin bhfo-alt seo go ceann téarma is faide ná dhá mhí dhéag.
Toirmeasc ar fhaisnéis a nochtadh.
13.—(1) Ní dhéanfaidh aon duine gan toiliú an Bhoird (a fhéadfar a thabhairt don duine faoi réir nó d'éagmais coinníollacha, maidir le haon fhaisnéis, maidir le faisnéis áirithe nó maidir le faisnéis d'aicme nó de thuairisc áirithe)—
(a) aon fhaisnéis a nochtadh a bheidh faighte aige le linn dó bheith ag fónamh mar chomhalta nó mar fhostaí den Bhord nó mar shainchomhairleoir nó mar chomhairleoir don Bhord nó mar dhuine a mbaineann an Bord leas as a sheirbhísí de bhua alt 21 (3) d'Acht 1976,
(b) aon fhaisnéis a nochtadh a bheidh faighte amhlaidh i ndáil le gnó an Bhoird nó le comhlíonadh a fheidhmeanna.
(2) Duine a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion agus dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £800 a chur air.
(3) Ní choiscfidh aon ní i bhfo-alt (1) den alt seo—
(a) nochtadh faisnéise i dtuarascáil chun an Bhoird nó i dtuarascáil ón mBord, nó thar ceann an Bhoird, chun an Aire,
(b) nochtadh faisnéise ag aon duine i gcúrsa agus de réir dhualgais a oifige
Toirmeasc ar chumarsáidí áirithe i ndáil le hachomhairc, etc.
14.—(1) Ní dleathach cumarsáid a dhéanamh leis an gcathaoirleach ná le gnáthchomhalta d'fhonn tionchar míchuí a imirt air tráth bheidh breithniú á dhéanamh aige ar achomharc, ar tharchur nó ar ní eile is cúram don Bhord nó ar chinneadh an Bhoird i dtaobh aon ní den sórt sin.
(2) Má bhíonn an cathaoirleach nó gnáthchomhalta ar an tuairim go sáraíonn cumarsáid fo-alt (1) den alt seo, beidh de dhualgas air gan bacadh a thuilleadh leis an gcumarsáid.
Éisteachtaí ó bhéal.
15.—(1) Beidh de lán-rogha ag an mBord tarchur nó achomharc chun an Bhoird nach tarchur nó achomharc lena mbaineann fo-alt (2) den alt seo a éisteacht ó bhéal.
(2) (a) Baineann an fo-alt seo le haon tarchur nó achomharc chun an Bhoird is d'aicme nó de thuairisc a fhéadfar de thuras na huaire a fhorordú chun críocha an fho-ailt seo.
(b) Féadfaidh forálacha a bheith i rialacháin a dhéanfar chun críocha an fho-alt seo á cheangal ar an mBord, tarchuir nó achomhairc is d'aicme nó de thuairisc a bheidh sonraithe sna rialacháin a éisteacht ó bhéal, go ginearálta nó i cibé cásanna a bheidh sonraithe amhlaidh.
(3) I gcás ina n-iarrfar ar an mBord tarchur nó achomharc a éisteacht ó bhéal (seachas tarchur nó achomharc lena mbaineann fo-alt (2) den alt seo) agus go socróidh sé an tarchur nó an t-achomharc a chinneadh gan éisteacht ó bhéal, beidh feidhm ag na forálacha seo a leanas:
(a) seirbheálfaidh an Bord fógra faoin socrú atá déanta aige ar an duine a d'iarr an éisteacht sin agus ceanglóidh an fógra sin ar an duine sin cibé aighneachtaí nó cibé aighneachtaí breise (más ann) is cuí leis i ndáil leis an tarchur nó leis an achomharc a dhéanamh chun an Bhoird i scríbhinn laistigh de thréimhse a bheidh sonraithe san fhógra (is tréimhse nach lú ná ceithre lá dhéag dar tosach dáta seirbheála an fhógra), agus
(b) ní thosóidh an Bord ag cinneadh an tarchuir nó an achomhairc go dtí go rachaidh an tréimhse a bheidh sonraithe amhlaidh in éag.
Féadfaidh an Bord achomhairc faoi alt 26 den Phríomh-Acht a dhíbhe más achomhairc chráiteacha, etc., iad.
16.—(1) Faoi réir fho-alt (2) den alt seo beidh, sna himthosca seo a leanas, lán-rogha ag an mBord achomharc a dhéanfar faoi alt 26 (5) den Phríomh-Acht a dhíbhe—
(a) más rud é, tar éis forais an achomhairc a bhreithniú, gurb é tuairim an Bhoird gur achomharc cráiteach, suaibhreosach nó achomharc gan substaint ná bunús an t-achomharc, nó
(b) más rud é—
(i) ag féachaint do chineál an achomhairc (lena n-áirítear aon cheist a eascraíonn, i dtuairim an Bhoird, as an achomharc), agus
(ii) ag féachaint d'aon chead nó ceadú roimhe sin a mheasann sé is cuí,
gur deimhin leis an mBord nár chóir sna himthosca áirithe an t-achomharc a bhreithniú tuilleadh.
(2) Beidh an chumhacht a thugtar don Bhord le fo-alt (1) den alt seo infheidhme aige faoi réir na sriantachta a fhorchuirtear ar an mBord le halt 26 (1) den Phríomh-Acht arna chur chun feidhme le halt 14 d'Acht 1976.
Fógra á cheangal ráiteas a thabhairt i dtaobh na bhforas achomhairc.
17.—(1) I gcás ina ndéanfar achomharc chun an Bhoird agus nach mbeidh forais an achomhairc luaite i scríbhinn, féadfaidh an Bord fógra a sheirbheáil ar an achomharcóir—
(a) á cheangal air ráiteas i scríbhinn i dtaobh fhorais a achomhairc a chur faoi bhráid an Bhoird laistigh de thréimhse a bheidh sonraithe san fhógra (is tréimhse nach lú na ceithre lá dhéag dar tosach dáta seirbheála an fhógra), agus
(b) á rá, mura gcomhlíonfar ceanglais an fhógra, go ndéanfaidh an Bord, tar éis dheireadh na tréimhse a bheidh sonraithe amhlaidh agus gan a thuilleadh fógra a thabhairt don duine, a dhearbhú, de bhun an ailt seo, go n-áireofar an t-achomharc a bheith tarraingthe siar.
(2) I gcás ina mbeidh fógra seirbheáilte, faoi fho-alt (1) den alt seo, féadfaidh an Bord, tar éis dó an freagra (más ann) ar an bhfógra a bhreithniú, a dhearbhú, más cuí leis é, aon tráth tar éis dheireadh na tréimhse a bheidh sonraithe san fhógra agus gan a thuilleadh fógra a thabhairt don pháirtí ar a mbeidh an fógra seirbheáilte amhlaidh, go n-áireofar an t-achomharc lena mbaineann an fógra a bheith tarraingthe siar.
Cumhacht an Bhoird maidir le moill ag páirtithe etc., in achomhairc.
18.—(1) Más é tuairim an Bhoird go bhfuil aon doiciméad, aon sonraí nó aon fhaisnéis eile riachtanach chun go mbeidh ar a chumas achomharc a bheidh déanta faoi alt 26 (5) den Phríomh-Acht a chinneadh, féadfaidh an Bord fógra faoin alt seo a sheirbheáil ar aon duine is páirtí san achomharc, nó ar aon duine eile a mbeidh aighneachtaí déanta aige chun an Bhoird nó barúlacha tugtha aige dó maidir leis an achomharc—
(a) á cheangal ar an duine sin an doiciméad, na sonraí nó an fhaisnéis eile sin (is doiciméad, sonraí nó faisnéis eile a bheidh sonraithe san fhógra) a chur faoi bhráid an Bhoird laistigh de thréimhse a bheidh sonraithe san fhógra (is tréimhse nach lú ná ceithre lá dhéag dar tosach dáta seirbheála an fhógra), agus
(b) á rá, mura gcomhlíonfar ceanglais an fhógra, go ndéanfaidh an Bord, tar éis dheireadh na tréimhse a bheidh sonraithe amhlaidh agus gan a thuilleadh fógra a thabhairt don duine, an t-achomharc a dhíbhe, nó d'eile, é a chinneadh, de bhun an ailt seo.
(2) I gcás ina mbeidh fógra seirbheáilte faoi fho-alt (1) den alt seo, féadfaidh an Bord, aon tráth tar éis dheireadh na tréimhse a bheidh sonraithe san fhógra, tár éis dó an freagra (más ann) ar an bhfógra a bhreithniú, agus gan a thuilleadh fógra a thabhairt don duine ar ar seirbheáladh an fógra amhlaidh, an t-achomharc a dhíbhe nó, d'eile, é a chinneadh.
Achomhairc i gcoinne coinníollacha.
19.—(1) I gcás—
(a) ina ndéanfar achomharc faoi alt 26 (5) den Phríomh-Acht i gcoinne cinneadh ó údarás pleanála cead nó ceadú a thabhairt, agus
(b) nach mbaineann an t-achomharc ach le coinníoll nó coinníollacha ar faoina réir a rinneadh an cinneadh, agus
(c) gur deimhin leis an mBord, ag féachaint do chineál an choinníll nó na gcoinníollacha, nach ndlífí den Bhord an t-iarratas iomchuí a chinneadh amhail is dá mba chuige féin a rinneadh é sa chéad ásc,
féadfaidh an Bord dá lán-rogha féin, faoi réir é do chomhlíonadh fo-alt (2) den alt seo tráth bheidh sé ag breithniú an achomhairc, cibé orduithe is cuí leis a thabhairt don údarás pleanála iomchuí maidir leis an údarás sin do chur isteach, do leasú nó do bhaint amach an choinníll nó na gcoinníollacha lena mbaineann an t-achomharc nó coinníollacha eile.
(2) I bhfeidhmiú na cumhachta a thugtar dó le fo-alt (1) den alt seo, ní dhéanfaidh an Bord, ar leith ó bhreithniú an choinníll nó na gcoinníollacha lena mbaineann an t-achomharc iomchuí, breithniú ach amháin ar phleanáil agus ar fhorbhairt cheart limistéar an údaráis phleanála iomchuí (lena n-áirítear a thaitneamhachtaí a shlánchoimeád agus a fheabhsú), agus beidh aird aige ar fhorálacha an phlean fhorbartha, ar fhorálacha aon ordaithe um limistéar taitneamhachta speisialta a bhaineann leis an limistéar sin, ar théarmaí aon cheada roimhe sin a mheas an Bord a bheith iomchuí, ar na hábhair dá dtagraítear in alt 26 (2) den Phríomh-Acht agus ar na hábhair dá dtagraítear in alt 24 (2) d'Acht 1976.
Leasú ar alt 26 den Phríomh-Acht.
20.—Leasaítear leis seo alt 26 (9) (a) den Phríomh-Acht tríd an bhfomhír seo a leanas a chur in ionad fhomhír (ii):
“(ii) i gcás ina ndéanfar achomharc nó achomhairc i gcoinne an chinnidh, ní thabharfaidh siad an cead nó an ceadú mura rud é, maidir leis an achomharc nó, de réir mar is cuí, maidir le gach ceann de na hachomhairc—
(I) go mbeidh sé tarraingthe siar, nó
(II) go mbeidh sé dífe ag an mBord de bhun alt 16 nó 18 den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1983, nó
(III) go mbeidh ordú tugtha i ndáil leis ag an mBord don údarás de bhun alt 19 den Acht sin,
agus i gcás ina ndéanfar achomharc nó gach achomharc den sórt sin, de réir mar is iomchuí a tharraingt siar nó a dhíbhe, tabharfaidh siad an cead nó an ceadú a luaithe is féidir tar éis an t-achomharc a tharraingt siar nó a dhíbhe, agus, i gcás ordú den sórt sin, tabharfaidh siad an cead nó an ceadú de réir an ordaithe, a luaithe is féidir tar éis don Bhord an t-ordú a thabhairt.”.
Leasú ar ailt 10 agus 19 d'Acht 1976.
21.—(1) Leasaítear leis seo fo-alt (1) d'alt 10 d'Acht 1976 trí “arna thabhairt le toiliú Aire na Seirbhíse Poiblí” a chur isteach i ndiaidh “an Aire”, agus tá an fo-alt sin (1), arna leasú amhlaidh, leagtha amach i mír 1 den Tábla a ghabhann leis an alt seo.
(2) Leasaítear leis seo fo-alt (2) d'alt 19 d'Acht 1976 trí “£200” a chur in ionad “£50”, agus tá an fo-alt sin (2), arna leasú amhlaidh, leagtha amach i mír 2 den Tábla a ghabhann leis an alt seo.
AN TÁBLA
1. 10—(1) Ceapfaidh an Bord cibé daoine agus cibé líon daoine chun bheith ina bhfostaithe don Bhord is dóigh leis an mBord, faoi réir ceadú an Aire arna thabhairt le toiliú Aire na Seirbhíse Poiblí maidir leis an líon agus leis an gcineál fostaithe den sórt sin, ó am go ham is cuí.
2. (2) Is tar éis dul i gcomhairle leis an Aire, agus ansin amháin, a thabharfaidh an Bord ordú faoi fho-alt (1) den alt seo aon suim is mó ná £200 a íoc.

22.—(1) Déanfar alt 26 (5) (b) den Phríomh-Acht, arna leasú le halt 14 (9) d'Acht 1976, a fhorléiriú agus beidh éifeacht leis faoi réir ailt 16, 18 agus 19 den Acht seo, agus déanfar na forálacha eile de chuid na nAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 go 1982, i dtaobh achomhairc chun an Bhoird a fhorléiriú agus beidh éifeacht leo faoi réir alt 17 den Acht seo.
(2) Ní fhorléireofar aon ní in alt 17 nó 18 den Acht seo mar ní a dhéanann difear d'aon chumhacht a thugtar don Bhord le haon achtachán nó faoi aon achtachán seachas na hailt sin.

23.—(1) Ní fhorléireofar aon ní san Acht seo mar ní a chuireann ar chumas an Aire aon chumhacht nó rialú a fheidhmiú i ndáil le haon chás áirithe atá nó a bheidh de chúram ar an mBord.
(2) Ní dhéanfar an tagairt don Acht seo i bhfo-alt (1) den alt seo a fhorléiriú mar thagairt a fholaíonn tagairt d'alt 7 den Acht Rialtais Áitiúil (Pleanáil agus Forbairt), 1982.

24.—Ní fhorléireofar aon ní san Acht seo mar ní a chuireann isteach ar bhuan-leanúnachas an Bhoird ná ar chomhlíonadh aon fheidhme dá chuid feidhmeanna ag an mBord ná mar ní a dhéanann difear don bhuan-leanúnachas nó don chomhlíonadh sin.

(3) Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a shocróidh an tAire le hordú, go ginearálta nó faoi threoir aon chríche nó forála áirithe, agus féadfar laethanta éagsúla a shocrú amhlaidh do chríocha éagsúla agus d'fhorálacha éagsúla den Acht seo.
(4) Déanfar an tAcht seo agus na hAchtanna Rialtais Áitiúil (Pleanáil agus Forbairt), 1963 go 1982, a fhorléiriú le chéile mar aon Acht amháin.
