2.—Féadfaidh an Ard-Chomhairle, más oiriúnach agus pé uair is oiriúnach leo é, ní no ceist ar bith, a bhaineann le diuité custum d'fhorchur no d'atharú no deire do chur leis no é d'athnuachaint, do chur fé bhráid an Choimisiuin fé alt 2 den Phríomh-Acht, agus déanfaidh an Coimisiún gach ní no ceist a cuirfear fé n-a mbráid amhlaidh do bhreithniú agus tuarasgabháil do thabhairt air fé is dá mba iarratas é do chuirfeadh an tAire Airgid fé n-a mbráid fén bPríomh-Acht.

Tuarasgabhála an Choimisiuin.

3.—D'ainneoin éinní atá sa Phríomh-Acht is don Ard-Chomhairle do bhéarfar na tuarasgabhála uile do bhéarfaidh an Coimisiún uatha, pe'ca ar iarratas do chuir an tAire Airgid fé n-a mbráid fén bPríomh-Acht no ar ní no ar cheist do chuir an Ard-Chomhairle fé n-a mbráid fén Acht so do bhéarfar san.

Nithe áirithe atá ar feitheamh do chríochnú.

4.—(1) Na baill den Choimisiún d'eirigh le déanaí as bheith ina mbaill amhlaidh déanfaid, d'ainneoin an eirithe-as san, a dtuarasgabháil do thabhairt uatha do réir an Phríomh-Achta ar na hiarrataisí uile agus fé seach gur éisteadar fianaise ina dtaobh ach nár thugadar aon tuarasgabháil ortha roimh an eirghe-as san.

(2) D'ainneoin éinní atá san Acht so is don Aire Airgid a bhéarfar tuarasgabháil do bhéarfaidh na baill sin den Choimisiún uatha fén alt so agus, chun gach críche, áireofar an tuarasgabháil sin mar thuarasgabháil do thug an Coimisiún uatha fén bPríomh-Acht.

(3) Tuigfear an t-alt so do theacht i ngníomh an cúigiú lá déag de Mhí na Samhna, 1930, sé sin, an lá d'eirigh na baill sin den Choimisiún as bheith ina mbaill amhlaidh, agus beidh sé mar bheadh éifeacht aige an lá san agus ón lá san amach.

TARIFF COMMISSION (AMENDMENT) ACT, 1930.


AN ACT TO AMEND THE TARIFF COMMISSION ACT, 1926, BY CONFERRING ON THE EXECUTIVE COUNCIL POWER TO REFER TO THE TARIFF COMMISSION MATTERS AND QUESTIONS RELATING TO CUSTOMS DUTIES AND BY REQUIRING ALL REPORTS OF THAT COMMISSION TO BE MADE TO THE EXECUTIVE COUNCIL, AND ALSO TO MAKE PROVISION FOR THE COMPLETION OF THE MATTERS WHICH WERE PENDING BEFORE THE MEMBERS OF THE TARIFF COMMISSION WHO HAVE LATELY RESIGNED THEIR MEMBERSHIP THEREOF. [23rd December, 1930.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act,

the expression “the Principal Act” means the Tariff Commission Act, 1926 (No. 40 of 1926);

[GA]

the expression “the Commission” means the Tariff Commission.

[GA]

Reference of questions to the Commission by the Executive Council.

2.—The Executive Council may, if and whenever they think fit so to do, refer to the Commission under section 2 of the Principal Act any matter or question relating to the imposition, modification, abolition, or renewal of a customs duty and the Commission shall consider and report on every matter or question so referred to them as if it were an application referred to them by the Minister for Finance under the Principal Act.

Reports of the Commission.

3.—Notwithstanding anything contained in the Principal Act, all reports made by the Commission whether on an application referred to them by the Minister for Finance under the Principal Act or on a matter or question referred to them by the Executive Council under this Act shall be made to the Executive Council.

Completion of certain pending matters.

4.—(1) The members of the Commission who have lately resigned their membership thereof shall, notwithstanding such resignation, make their report in accordance with the Principal Act on the several applications in reference to which they heard evidence but made no report before their said resignation.

(2) A report made under this section by the said members of the Commission shall, notwithstanding anything contained in this Act, be made to the Minister for Finance and shall for all purposes be a report of the Commission made under the Principal Act.

(3) This section shall be deemed to have come into operation on and shall have effect as on and from the fifteenth day of November, 1930, being the day on which the said members of the Commission resigned their membership.

Short title, construction and citation.

5.—This Act may be cited as the Tariff Commission (Amendment) Act, 1930, and shall be construed as one with the Principal Act, and the Principal Act and this Act may be cited together as the Tariff Commission Acts, 1926 and 1930.
