ACHT CROISE DEIRGE, 1938.
Cumann Croise Deirge do bhunú.
1.—(1) Féadfaidh an Riaghaltas, le hordú (dá ngairmtear an t-ordú bunúcháin san alt so), a dhearbhú—
(a) cumann (dá ngairmtear an Cumann san Acht so) ar a dtabharfar an ainm a luadhfar san ordú bunúcháin do bheith bunuithe amhail ar dháta áirithe agus o dháta áirithe;
(b) go mbeidh an Cumann, fén ainm sin, ina gcólucht chorpruithe go síor-chomharbas agus có-shéala (ar a dtabharfar áird i gcúrsaí breithiúntais) agus go bhféadfaid dul chun dlí, agus go bhféadfar dul chun dlí leo, fén ainm sin;
(c) gurb iad príomh-chuspóirí an Chumainn ná—
(i) cabhair dheontach do thabhairt do dhaoine breoite agus do dhaoine gonta in airm le linn cogaidh,
(ii) faoiseamh do thabhairt do phríosúnaigh chogaidh,
(iii) bheith ag gabháil d'obair agus ag cabhrú le hobair, le linn síochána no cogaidh, chun sláinte daoine d'fheabhsú, galar do chosc agus fulaing do laigheadú ar fuaid an domhain;
(d) gurb iad a bheidh sa Chumann ná na daoine luadhfar chuige sin san ordú bunúcháin agus na daoine eile go léir a thiocfaidh, do réir rialacha an Chumainn, chun bheith ina mbaill de faid a leanfaidh na daoine sin a céad-luaidhtear no na daoine eile sin (do réir mar a bheidh) de bheith ina mbaill.
(2) Féadfaidh an Riaghaltas, leis an ordú bunúcháin, socrú do dhéanamh maidir le gach ní no éinní acu so leanas, sé sin le rá:—
(a) comhachta an Chumainn;
(b) có-ghléasadh an Chumainn;
(c) cólucht rialúcháin do bhainistí agus do riaradh cúrsaí an Chumainn;
(d) an chomhacht chun rialacha do dhéanamh don Chumann do leigint chun an chóluchta rialúcháin sin;
(e) cruinnithe bliantúla agus cruinnithe eile den Chumann do chomóradh;
(f) airgead agus cuntaisí an Chumainn;
(g) aon nithe eile bhaineann leis an gCumann agus go bhfeicfear don Riaghaltas é do bheith inmhianuithe agus ceart socrú do dhéanamh ina dtaobh.
(3) Pé uair agus chó minic agus is oiriúnach leo é, féadfaidh an Riaghaltas, le hordú fén bhfo-alt so, leasú do dhéanamh (pe'ca tré chur leis, fágaint ar lár, no atharú é) ar an ordú bunúcháin no ar aon ordú fén bhfo-alt so.
(4) Beidh feidhm dlí, do réir a bhrí, ag gach ordú déanfar fén alt so.
(5) Gach ordú déanfar fén alt so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta agus má dheineann ceachtar Tigh den Oireachtas, laistigh den lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid amhlaidh, rún do rith ag cur an orduithe sin ar nea-mbrí beidh an t-ordú san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.
Deontaisí agus iasachtaí don Chumann.
2.—Féadfaidh an tAire Airgeadais, amach as airgead a sholáthróidh an tOireachtas, congnamh do thabhairt don Chumann i bhfuirm deontais no iasachta ar na téarmaí agus ar na coinníollacha san is dóich leis is ceart.
Comhacht chun a údarú do chumainn um chabhair dheontach congnamh do thabhairt do Sheirbhís Liaghachta an Airm.
3.—Chun crícheanna Airteagail 10 den Chonvensiún Eadarnáisiúnta, i dtaobh staid na ndaoine gonta agus na ndaoine breoite in airm ar an machaire d'fheabhsú, do sighníodh sa Gheinéibh an 27adh lá d'Iúl, 1929, féadfaidh an Riaghaltas o am go ham, le hordú, a údarú d'aon chumann um chabhair dheontach (le n-a n-áirmhítear an Cumann) a bheidh ag obair sa Stát congnamh do thabhairt do Sheirbhís Liaghachta an Airm agus féadfaid o am go ham, le hordú, aon údarás den tsórt san do tharrac siar.

4.—(1) Ar dháta an Chumainn do bhunú agus dá éis sin, ní dleathach do dhuine ar bith, gan toiliú an Aire Cosanta, úsáid do dhéanamh, chun críche trádála no gnótha no chun aon chríche eile ar bith, de shuaitheantas armaidhe na croise deirge ar urlár bhán a deintear tré dhathanna Chó-Chomhairle na hEilbhéise do chur in ionad a chéile, ná d'aon tsuaitheantas a bheidh ana-chosúil leis an suaitheantas armaidhe sin, ná de sna focail “Cros Dearg”, “Cros na Geinéibhe”, “Red Cross”, no “Geneva Cross” ná d'aon fhocail a bheidh ana-cosúil leis na focail ‘Cros Dearg”, “Cros na Geinéibhe”, “Red Cross” no “Geneva Cross”.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh an duine sin ciontach i gcionta fén alt so.

5.—(1) Ní dleathach do dhuine ar bith—
(a) aon dearadh gurb é bheidh ann ná cros bhán no cros airgid ar urlár dhearg gan aon ghéag di do shroichint go himeall an urláir, eadhon, an chros atá in Armas Chó-Chomhairle na hEilbhéise, ná
(b) aon dearadh bheidh ina aithris dheallrathach ar an dearadh san a céad-luaidhtear,
d'úsáid ná do thaisbeáint chun crícheanna a thrádála no a ghnótha ná chun aon chríche eile ar bith gan údarás ón Aire Tionnscail agus Tráchtála.
(2) Má dheineann duine ar bith éinní contrárdha don alt so beidh an duine sin ciontach i gcionta fén alt so.
(3) Ní dhéanfaidh éinní atá i bhfo-alt (1) den alt so dochar do cheart (más ann dó) dhílseánaigh mhairc thrádála, do cláruíodh roimh an 19adh lá de Mheitheamh, 1931, agus ar a bhfuil armas Chó-Chomhairle na hEilbhéise no aithris air sin, chun leanúint den mharc trádála san d'úsáid.

6.—(1) Gach duine bheidh ciontach i gcionta fé alt ar bith den Acht so, dlighfear ar a chiontú ann ar an slí achmair fíneáil ná raghaidh thar deich bpúint do chur air agus féadfaidh an Chúirt freisin a ordú aon earraí gur mar gheall ortha do rinneadh an cionta do gheallbhruideadh.
(2) Má deintear aon earraí do gheallbhruideadh fén alt so cuirfear na hearraí sin de láimh do réir orduithe an Aire Cosanta agus déanfar aon airgead do gheobhfar as aon chur-de-láimh den tsórt san d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste sa tslí sin ordóidh an tAire Airgeadais.

7.—Má dheineann cólucht corpruithe cionta fé alt ar bith den Acht so agus go gcruthófar go ndearnadh amhlaidh é le toiliú no le ceadú éinne, no gur cuireadh a dhéanamh in usacht le haon fhaillí i bpáirt éinne, is stiúrthóir no bainisteoir ar an gcólucht chorpruithe sin no is rúnaí no oifigeach eile dhó, tuigfear an stiúrthóir, an bainisteoir, an rúnaí no an t-oifigeach eile sin freisin do bheith ciontach sa chionta san agus féadfar imeachta do bhunú ina choinnibh agus é phionósú dá réir sin.

RED CROSS ACT, 1938.
Establishment of Red Cross Society.
1.—(1) The Government may by order (in this section referred to as the establishment order) declare—
(a) that there shall be established as on and from a specified date a society (in this Act referred to as the Society) to be called by the name specified in the establishment order;
(b) that the Society shall by such name be a body corporate and have perpetual succession and a common seal (which shall be judicially noticed) and may by such name sue and be sued;
(c) that the primary objects of the Society shall be—
(i) to furnish volunteer aid to the sick and wounded of armies in time of war,
(ii) to furnish relief to prisoners of war,
(iii) in time of peace or war to carry on and assist in work for the improvement of health, the prevention of disease and the mitigation of suffering throughout the world;
(d) that the Society shall consist of the persons named in that behalf in the establishment order and all other persons who shall, in accordance with the rules of the Society, become members thereof so long as such first mentioned persons or such other persons (as the case may be) continue to be members.
(2) The Government may by the establishment order make provision in relation to all or any of the following matters, that is to say:—
(a) the powers of the Society;
(b) the organisation of the Society;
(c) the management and administration of the affairs of the Society by a governing body;
(d) the delegation to such governing body of the power to make rules for the Society;
(e) the holding of annual and other meetings of the Society;
(f) the finances and accounts of the Society;
(g) any other matters in relation to the Society in respect of which it appears to the Government desirable and proper that provision should be made.
(3) The Government may, whenever and so often as they think fit, by order under this sub-section amend (whether by addition, omission, or variation) the establishment order or any order under this sub-section.
(4) Every order made under this section shall have, according to the tenor thereof, the force of law.
(5) Every order under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and, if a resolution annulling such order is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat after such order is so laid before it, such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.
Grants and loans to the Society.
2.—The Minister for Finance may, out of moneys provided by the Oireachtas, afford assistance to the Society by way of grant or loan on such terms and conditions as he shall think proper.
Power to authorise voluntary aid societies to render assistance to the Army Medical Service.
3.—The Government may, for the purposes of Article 10 of the International Convention for the amelioration of the condition of the wounded and sick in armies in the field signed at Geneva on the 27th day of July, 1929, from time to time by order authorise any voluntary aid society (including the Society) operating in the State to render assistance to the Army Medical Service, and may from time to time by order withdraw any such authorisation.
Restriction on use of Red Cross, etc.
4.—(1) On and after the date of the establishment of the Society it shall not be lawful for any person to use for the purpose of trade or business or any other purpose whatsoever, without the consent of the Minister for Defence, the heraldic emblem of the red cross on a white ground formed by reversing the Federal colours of Switzerland or any emblem closely resembling such heraldic emblem, or the words “Cros Dearg” “Cros na Geinéibhe”, “Red Cross” or “Geneva Cross” or any words closely resembling the words “Cros Dearg”, “Cros na Geinéibhe”, “Red Cross” or “Geneva Cross”.
(2) If any person acts in contravention of this section such person shall be guilty of an offence under this section.
Restriction on use of arms of the Swiss Confederation.
5.—(1) It shall not be lawful for any person without the authority of the Minister for Industry and Commerce to use or display, for the purposes of his trade or business or for any other purpose whatsoever—
(a) any design consisting of a white or silver cross on a red ground, none of the limbs of which extends to the margin of the ground, being the cross comprised in the Arms of the Swiss Confederation, or
(b) any design which is a colourable imitation of such first-mentioned design.
(2) If any person acts in contravention of this section such person shall be guilty of an offence under this section.
(3) Nothing in sub-section (1) of this section shall affect the right (if any) of the proprietor of a trade mark registered before the 19th day of June, 1931, and containing the arms of the Swiss Confederation or an imitation thereof to continue to use such trade mark.
Penalties for offences and disposition of forfeited goods.
6.—(1) Every person guilty of an offence under any section of this Act shall be liable on summary conviction thereof to a fine not exceeding ten pounds, and the Court may also order any goods in relation to which the offence was committed to be forfeited.
(2) Where any goods are forfeited under this section such goods shall be disposed of in accordance with the directions of the Minister for Defence and any moneys arising from any such disposition shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance may direct.
Offences by bodies corporate.
7.—Where an offence under any section of this Act is committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of such body corporate, such director, manager, secretary or other officer shall also be deemed to be guilty of such offence and shall be liable to be proceeded against and punished accordingly.
Repeal of Geneva Convention Act, 1911.
8.—The Geneva Convention Act, 1911, is hereby repealed as on and from the date of the establishment of the Society.
Short title.
9.—This Act may be cited as the Red Cross Act, 1938.
