ACHTUIGHEADH OIREACHTAS SHAORSTáIT ÉIREANN MAR LEANAS:— [EN]

Daoine do cheapa chun gníomhú go sealadach mar Bhreithiúin bhreise den Chúirt Chuarda.

1.—(1) Pé uair a chífear don tSeanascal, ar chomhairle na hArd-Chomhairle, go bhfuil Breitheamh den Chúirt Chuarda gan bheith ábalta de thurus na huaire ar dhualgaisí a oifige no ar chuid de sna dualgaisí sin do chólíona, toisc dualgaisí no seirbhísí puiblí eile do cuireadh air go sealadach no de dheascaibh breoiteachta no mar gheall ar aon leor-réasún eile, féadfaidh an Seanascal, ag gníomhú dho ar chomhairle na hArd-Chomhairle, abhcóide bheidh ag cleachta a ghairme agus 'na mbeidh seasamh deich mblian ar a laighead aige ar dháta a cheaptha do cheapa chun gníomhú mar Bhreitheamh den Chúirt Chuarda ar feadh pé tréimhse (nách sia ná an fhaid a bheidh an Breitheamh san a céad-luaidhtear gan bheith ábalta ar dhualgaisí uile a oifige no ar chuid de sna dualgaisí sin do chólíona) a mheasfa sé, ar an gcomhairle roimhráite, do bheith ceart.

(2) Gach duine ceapfar fén alt so chun gníomhú mar Bhreitheamh den Chúirt Chuarda beidh sé, ar feadh na tréimhse dá mbeidh sé ceaptha amhlaidh, i seilbh a oifige do réir na sealbhaíochta gur dá réir a bhíonn Breitheamh den Chúirt Chuarda i seilbh a oifige.

(3) Féadfaidh an tAire Dlí agus Cirt, o am go ham fé mar is gá é, gach duine ceapfar fén alt so chun gníomhú mar Bhreitheamh den Chúirt Chuarda do cheapa do chuaird ar bith ar feadh na tréimhse dá mbeidh sé ceaptha chun gníomhú amhlaidh agus faid a bheidh sé ceaptha amhlaidh do chuaird beidh ag gach duine den tsórt san, maidir leis an gcuaird sin agus i gcó-réim leis an mBreitheamh a bheidh buan-cheaptha don chuaird sin agus le Breitheamh ar bith a bheidh ceaptha go sealadach fé alt 9 den Acht Cúirteanna Breithiúnais, 1928 (Uimh. 15 de 1928) don chuaird sin, gach príbhléid, comhacht agus dualgas a bheidh de thurus na huaire bronnta no curtha do réir dlí ar an mBreitheamh a bheidh buan-cheaptha don chuaird sin.

(4) Gach duine ceapfar fén alt so chun gníomhú mar Bhreitheamh den Chúirt Chuarda íocfar leis, ar feadh na tréimhse dá mbeidh sé ceaptha amhlaidh, as airgead a sholáthróidh an tOireachtas pé luach saothair agus liúntaisí shocróidh an tAire Dlí agus Cirt le cead an Aire Airgid.

(5) In alt 45 den Acht Cúirteanna Breithiúnais, 1924 (Uimh. 10 de 1924) athghairmtear leis seo na focail “I gcás aon Bhreitheamh Cuarda bheith breoite, féadfar fear ionaid a cheapa chun gníomhú ina áit, ar mhola ón bPríomh-Atúrnae, ar pé luach saothair a cheadóidh an tAire Airgid: Ach mar sin féin éinne nách abhcóide atá ag cleachta a ghairme agus seasamh deich mblian ar a luíod aige ní bheidh sé cáilithe chun a cheaptha mar fhear ionaid do Bhreitheamh Chuarda.”

2.—(1) Féadfar an tAcht Cúirteanna Breithiúnais, 1929, do ghairm den Acht so, agus léireofar é mar éinní amháin leis na hAchtanna Cúirteanna Breithiúnais, 1924 go 1928, agus féadfar na hAchtanna Cúirteanna Breithiúnais, 1924 go 1929, do ghairm de sna hAchtanna san agus den Acht so le chéile.

(2) Leanfaidh an tAcht so i bhfeidhm go ceann dhá bhliain o am a rithte agus raghaidh in éag ansan.

AN ACT TO PROVIDE FOR THE OCCASIONAL APPOINTMENT OF PERSONS TO ACT TEMPORARILY AS JUDGES OF THE CIRCUIT COURT DURING SUCH TIMES AS A JUDGE OF THE CIRCUIT COURT IS, OWING TO OTHER PUBLIC DUTIES OR SERVICES TEMPORARILY IMPOSED ON HIM OR ON ACCOUNT OF ILLNESS OR FOR ANY OTHER SUFFICIENT REASON, WHOLLY OR PARTLY UNABLE TO PERFORM THE DUTIES OF HIS OFFICE. [20th December, 1929.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Appointment of persons to act temporarily as additional Judges of the Circuit Court.

1.—(1) Whenever it appears to the Governor-General on the advice of the Executive Council that owing to other public duties or services temporarily imposed on him or on account of illness or for any other sufficient reason a Judge of the Circuit Court is for the time being wholly or partly unable to discharge the duties of his office, the Governor-General acting on the advice of the Executive Council may appoint a practising barrister of ten years standing at least at the date of his appointment to act as a Judge of the Circuit Court for such period (not exceeding the duration of such complete or partial inability of such first-mentioned Judge to discharge the duties of his office) as he shall on the advice aforesaid think proper.

(2) Every person appointed under this section to act as a Judge of the Circuit Court shall, during the period for which he is so appointed, hold office by the tenure by which a Judge of the Circuit Court holds his office.

(3) Every person appointed under this section to act as a Judge of the Circuit Court may, during the period for which he is so appointed, be assigned by the Minister for Justice from time to time as occasion requires to any circuit, and every such person shall while so assigned to a circuit have in relation to such circuit and concurrently with the Judge permanently assigned to such circuit and any Judge temporarily assigned under section 9 of the Courts of Justice Act, 1928 (No. 15 of 1928) to such circuit all the privileges, powers and duties for the time being conferred or imposed by law on the Judge permanently assigned to such circuit.

(4) Every person appointed under this section to act as a Judge of the Circuit Court shall during the period for which he is so appointed be paid out of moneys provided by the Oireachtas such remuneration and allowances as the Minister for Justice, shall, with the sanction of the Minister for Finance, determine.

(5) In section 45 of the Courts of Justice Act, 1924 (No. 10 of 1924) the words “in case of the illness of any Circuit Judge, a deputy may be appointed to act in his place, on the recommendation of the Attorney General, at such remuneration as may be sanctioned by the Minister for Finance: Provided however that no one other than a practising barrister of ten years' standing at least shall be qualified for appointment as deputy of a Circuit Judge,” are hereby repealed.

Short title, citation, construction and duration.

2.—(1) This Act may be cited as the Courts of Justice Act, 1929, and shall be construed as one with the Courts of Justice Acts, 1924 to 1928, and those Acts and this Act may be cited together as the Courts of Justice Acts, 1924 to 1929.

(2) This Act shall continue in force for two years from the passing thereof and shall then expire.
