cialluíonn an abairt “an tAire” an tAire Cosanta;
cialluíonn an abairt “an Chúlmhutaireacht” cúlmhutaireacht bhall áirithe den Chéad Chath de sna Connaught Rangers do thárla i mí an Mheithimh agus i mí an Iúil, 1920, i Solon agus i Jullundur san India;
cialluíonn an abairt “an Arm-Chúirt Ghenerálta” an Arm-Chúirt Ghenerálta Bhriotánach do tháinig le chéile i mí Lúnasa, 1920, i nDagshai san India chun baill áirithe den Chéad Chath de sna Connaught Rangers do thriail i gcúiseanna d'eirigh as an gCúlmhutaireacht;

“Daoine cáilithe.”
2.—San Acht so cialluíonn an abairt “duine cáilithe” duine go ndeimhneoidh an tAire ina thaobh—
(a) gur bhall den Chéad Chath de sna Connaught Rangers é, agus
(b) gur ghaibh sé páirt sa Chúlmhutaireacht, agus
(c) go ndearna an Arm-Chúirt Ghenerálta, de bhíthin é do ghabháil páirte amhlaidh, é do dhaoradh chun báis, no chun pian-tseirbhíse, no chun príosúntachta ar feadh téarma ar bith nach giorra na dhá mhí dhéag.
Pinsin seirbhíse.
3.—(1) Fé réir forálacha an Achta so féadfar pinsean (dá ngairmtear pinsean seirbhíse fada san Acht so) a bheidh iníoctha le n-a shaol do dheonadh do dhuine cháilithe gur seirbhís fhada a sheirbhís airm.
(2) Is mar leanas a bheidh pinsean seirbhíse fada bheidh iníoctha le duine ar bith, sé sin le rá:—
(a) i gcás gan céim shubstainteach cheannairc no céim shubstainteach nea-choimisiúnta is aoirde ná san do bheith ag an duine sin ar dháta na Cúlmhutaireachta, isé bheidh sa phinsean san ná liúntas do réir dhá scilling agus seacht bpingne go leith sa ló;
(b) i gcás céim shubstainteach cheannaire do bheith ag an duine sin ar dháta na Cúlmhutaireachta, isé bheidh sa phinsean san ná—
(i) liúntas do réir dhá scilling agus seacht bpingne go leith sa ló, agus
(ii) liúntas breise do réir leath-phingne sa ló in aghaidh gach bliana iomláine dá sheirbhís inphinsin go raibh céim shubstainteach cheannaire aige;
(c) i gcás céim shubstainteach sháirsint no céim shubstainteach nea-choimisiúnta is aoirde ná san do bheith ag an duine sin ar dháta na Cúlmhutaireachta, isé bheidh sa phinsean san ná—
(i) liúntas do réir dhá scilling agus seacht bpingne go leith sa ló, agus
(ii) liúntas breise do réir pingne sa ló in aghaidh gach bliana iomláine dá sheirbhís inphinsin go raibh céim shubstainteach sháirsint no céim shubstainteach nea-choimisiúnta is aoirde ná san aige, agus
(iii) liúntas breise do réir leath-phingne sa ló in aghaidh gach bliana iomláine (más ann di) dá sheirbhís Airm Bhriotánaigh roimh an gCúlmhutaireacht go raibh céim shubstainteach cheannaire aige.
(3) Chun crícheanna fo-ailt (2) den alt so—
(a) isé tuigfear is seirbhís inphinsin dhuine ná a sheirbhís airm agus a thréimhse de sheirbhís tuigthe le chéile;
(b) duine ag á raibh aon chéim shubstainteach nea-choimisiúnta ar dháta na Cúlmhutaireachta tuigfear é do leanúint den chéim sin do bheith aige i rith na tréimhse dar thosach dáta na Cúlmhutaireachta agus dár chríoch deireadh a thréimhse de sheirbhís tuigthe;
(c) i gcás duine ag á raibh céim shubstainteach cheannaire ar dháta na Cúlmhutaireachta tuigfear gurb í uimhir na mblian iomlán go raibh céim shubstainteach cheannaire aige ná an toradh do gheobhfar tré uimhir is có-ionann leis an uimhir de laetheanta go raibh an chéim shubstainteach san aige no céim shubstainteach neachoimisiúnta is aoirde ná san do roinnt ar thrí chéad agus cúig seascad, gan áird do thabhairt ar aon chodán;
(d) i gcás duine ag á raibh, ar dháta na Cúlmhutaireachta, céim shubstainteach sháirsint no céim shubstainteach nea-choimisiúnta is aoirde ná san—
(i) tuigfear gurbh í uimhir na mblian iomlán go raibh céim shubstainteach sháirsint no céim shubstainteach nea-choimisiúnta is aoirde ná san aige ná an toradh do gheobhfar tré uimhir is có-ionann leis an uimhir de laetheanta go raibh céim shubstainteach sháirsint no céim shubstainteach nea-choimisiúnta is aoirde ná san aige do roinnt ar thrí chéad agus cúig seascad, gan áird do thabhairt ar aon chodán, agus
(ii) tuigfear gurbh í uimhir na mblian iomlán (más ann dóibh) go raibh céim shubstainteach cheannaire aige ná an toradh do gheobhfar tré uimhir is có-ionann leis an uimhir de laetheanta go raibh céim shubstainteach cheannaire aige do roinnt ar thrí chéad agus cúig seascad, gan áird do thabhairt ar aon chodán.
(4) Fé réir forálacha an Achta so féadfar pinsean (dá ngairmtear pinsean seirbhíse gearr san alt so) a bheidh iníoctha le n-a shaol do réir deich scillinge agus sé pingne sa tseachtain do dheonadh do dhuine cháilithe gur seirbhís ghearr roimh 1918 a sheirbhís airm.
(5) Pé áit ina bhfuil an abairt “pinsean seirbhíse” sna forálacha ina dhiaidh seo den Acht so léireofar í mar abairt is có-ionann leis na focail “pinsean seirbhíse fada no pinsean seirbhíse gearr”.
Aiscí seirbhíse.
4.—Fé réir forálacha an Achta so féadfar aisce (dá ngairmtear aisce sheirbhíse san Acht so) de pé méid (nach mó ná céad agus caoga púnt) a chinnfidh an tAire, le toiliú an Aire Airgid, do dheonadh do dhuine cháilithe gur seirbhís gearr tar éis 1918 a sheirbhís airm.
Pinsin agus aiscí créachta.
5.—(1) I gcás duine cáilithe do bheith fé dhíth gurb é fé ndeár í ná créacht a dheimhneoidh an tAire do bheith ionchurtha i leith na Cúlmhutaireachta no i leith nithe d'eirigh go díreach as an gCúlmhutaireacht, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) maran lugha ná fiche per cent. grád na díthe sin ar dháta scrúduithe an duine sin ag Bord na nArm-Phinsean féadfar, i dteanta pinsin seirbhíse no aisce seirbhíse, pinsean (dá ngairmtear pinsean créachta san Acht so) a bheidh iníoctha le n-a shaol do dheonadh don duine sin do réir an ráta luaidhtear sa tríú colún den Chéad Sceideal a ghabhann leis an Acht so os coinne an ghráid oiriúnaigh díthe luaidhtear sa dara colún den Sceideal san más seirbhís fhada a sheirbhís airm no, más seirbhís ghearr roimh 1918 a sheirbhís airm, do réir an ráta luaidhtear sa cheathrú colún den Sceideal san os coinne an ghráid oiriúnaigh díthe luaidhtear sa dara colún san no, más seirbhís ghearr tar éis 1918 a sheirbhís airm, do réir an ráta luaidhtear sa chúigiú colún den Sceideal san os coinne an ghráid oiriúnaigh díthe luaidhtear sa dara colún san;
(b) más lugha ná fiche per cent. grád na díthe sin ar dháta scrúduithe an duine sin ag Bord na nArm-Phinsean féadfar, i dteanta pinsin seirbhíse no aisce seirbhíse, aisce (dá ngairmtear aisce chréachta san Acht so) de pé méid (nach mó ná triocha púnt) a dhéanfaidh an tAire, ag féachaint do chúrsaí uile an cháis, a chinneadh, le toiliú an Aire Airgid, do dheonadh don duine sin.
(2) I gcás duine do bheith fé aon cheann de sna díthe luaidhtear sa chéad cholún den Chéad Sceideal a ghabhann leis an Acht so isé is grád do dhíth an duine sin, chun crícheanna an ailt so, ná an grád atá leagtha amach sa dara colún den Sceideal san os coinne na díthe fé n-a bhfuil an duine sin.
(3) I gcás duine atá fé dhíth, gur créacht fé ndeár í, ná luaidhtear sa chéad cholún den Chéad Sceideal a ghabhann leis an Acht so, isé is grád do dhíth an duine sin, chun crícheanna an ailt seo, ná an grád a mheasfaidh Bord na nArm-Phinsean chuige sin.
Pinsin mhí-ábaltachta.
6.—I gcás duine cáilithe do bheith fé dhíth gur galar, a dheimhneoidh an tAire is ionchurtha i leith na Cúlmhutaireachta no i leith nithe d'eirigh go díreach as an gCúlmhutaireacht, fé ndeár í agus nach lugha ná ochtó per cent. grád na díthe sin ar dháta scrúduithe an duine sin ag Bord na nArm-Phinsean féadfar, i dteanta pinsin seirbhíse no aisce seirbhíse, pinsean (dá ngairmtear pinsean mí-ábaltachta san Acht so) a bheidh iníoctha le n-a shaol do dheonadh don duine sin do réir an ráta luaidhtear sa dara colún den Dara Sceideal a ghabhann leis an Acht so os coinne an ghráid oiriúnaigh díthe luaidhtear sa chéad cholún den Sceideal san más seirbhís fhada a sheirbhís airm no, más seirbhís ghearr roimh 1918 a sheirbhís airm, do réir an ráta luaidhtear sa tríú colún den Sceideal san os coinne an ghráid oiriúnagh díthe luaidhtear sa chéad cholún san no, más seirbhís ghearr tar éis 1918 a sheirbhís airm, do réir an ráta luaidhtear sa cheathrú colún den Sceideal san os coinne an ghráid oiriúnaigh díthe luaidhtear sa chéad cholún san.
Díth dhúbalta.
7.—I gcás—
(a) duine do bheith fé dhíth (dá ngairmtear an ghalar-dhíth san alt so) gur galar fé ndeár í agus gur lugha a grád ná ochtó per cent. agus go bhféadfaí do réir chúrsaí an cháis pinsean mí-ábaltachta do dheonadh don duine sin mar gheall ar an ngalar-dhíth dá mbeadh grád na díthe có-ionann le hochtó per cent. no níos mó ná san, agus
(b) an duine sin do bheith, freisin, fé dhíth (dá ngairmtear an chréacht-díth san alt so), gur créacht fé ndeár í, 'na bhféadfaí pinsean créachta do dheonadh dho mar gheall uirthi, no 'na bhféadfaí, dá mbeadh grád na díthe có-ionann le fiche per cent. no níos mó ná san, pinsean créachta do dheonadh dho mar gheall uirthi,
ansan, chun crícheanna an dá alt deiridh sin roimhe seo beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(i) isé is grád dá dhíth ná suim iomlán grád na galardhíthe agus grád na créacht-díthe,
(ii) más mó ná céad per cent. an tsuim iomlán san áirmheofar grád na díthe mar chéad per cent.,
(iii) tuigfear gurb í an chréacht fé ndeár iomlán a dhíthe.
Liúntaisí cleithiúnaithe.
8.—(1) Fé réir forálacha an ailt seo féadfar, de bhíthin duine ar bith le n-a mbaineann an t-alt so d'fháil bháis, na liúntaisí seo leanas do dheonadh, sé sin le rá:—
(a) do bhaintrigh an duine sin, liúntas (dá ngairmtear liúntas cleithiúnaí san Acht so) a bheidh iníoctha le linn a baintreachais do réir deich scillinge sa tseachtain;
(b) má bhíonn agus faid a bheidh beirt leanbh no níos mó leis an duine sin fé bhun sé bliana déag d'aois—
(i) don duine is sine de sna leanbhaí sin, liúntas (dá ngairmtear freisin liúntas cleithiúnaí san Acht so) do réir chúig scillinge sa tseachtain,
(ii) i gcás triúr leanbh no níos mó den tsórt san do bheith ann, do gach leanbh acu san (seachas an té is sine) no, i gcás gan ach beirt leanbh den tsórt san do bheith ann, don té is óige de sna leanbhaí sin, liúntas (dá ngairmtear freisin liúntas cleithiúnaí san Acht so) do réir trí scillinge sa tseachtain;
(c) mara mbeidh ach leanbh amháin leis an duine sin fé bhun sé bliana déag d'aois agus faid a bheidh sé fé bhun na haoise sin, liúntas (dá ngairmtear freisin liúntas cleithiúnaí san Acht so) don leanbh san do réir chúig scillinge sa tseachtain.
(2) Féadfar, mar gheall ar bhás dhuine ar bith le n-a mbaineann an t-alt so de bhuadh fo-ailt (4) den alt so, liúntas (dá ngairmtear liúntas cleithiúnaí san Acht so) do dheonadh d'athair an duine sin a bheidh iníoctha le n-a shaol do réir deich scillinge sa tseachtain.
(3) Baineann an t-alt so le gach duine go ndeimhneoidh an tAire—
(a) gur bhall den Chéad Chath de sna Connaught Rangers é, agus
(b) gur ghaibh sé páirt sa Chúlmhutaireacht, agus
(c) gur marbhadh é sa Chúlmhutaireacht.
(4) Baineann an t-alt so freisin le gach duine go ndeimhneoidh an tAire—
(a) gur bhall den Chéad Chath de sna Connaught Rangers é, agus
(b) gur ghaibh sé páirt sa Chúlmhutaireacht, agus
(c) gur cuireadh chun báis é do réir daortha ón Arm-Chúirt Ghenerálta.
(5) Baineann an t-alt so freisin le gach duine—
(a) go ndeimhneoidh an tAire—
(i) gur bhall den Chéad Chath de sna Connaught Rangers é, agus
(ii) gur gaibh sé páirt sa Chúlmhutaireacht, agus
(iii) go ndearna an Arm-Chúirt Ghenerálta, de bhíthin é do ghabháil páirte amhlaidh, é do dhaoradh chun báis no chun pian-tseirbhíse no chun príosúntachta ar feadh téarma ar bith nach giorra ná dhá mhí dhéag, agus
(b) a fuair bás roimh dháta an Achta so do rith, agus
(c) go ndeimhneoidh an tAire a bhás do bheith ionchurtha i leith créachta no galair d'eirigh as an gCúlmhutaireacht.
(6) Ní deonfar aon liúntas cleithiúnaí fén alt so do bhaintrigh dhuine le n-a mbaineann an t-alt so, de bhuadh fo-ailt (5) den alt so, más tar éis an 30adh lá de Mheitheamh, 1920, do rinneadh an pósadh.
(7) Ní deonfar aon liúntas cleithiúnaí fén alt so do leanbh dhuine le n-a mbaineann an t-alt so, de bhuadh fo-ailt (5) den alt so, más tar éis an 30adh lá de Mheitheamh, 1920, do phós an duine sin máthair an leinbh sin.
Iarrataisí ar phinsean, etc.
9.—(1) Is ar dháta nach déanaí ná an 31adh lá de Mhí na Nodlag, 1937, a déanfar gach iarratas ar phinsean, ar aisce no ar liúntas cleithiúnaí fén Acht so.
(2) Gach iarratas ar phinsean, ar aisce no ar liúntas cleithiúnaí fén Acht so déanfar é chun an Aire sa bhfuirm sin ordóidh an tAire agus beidh na mion-innste sin ann éileoidh an tAire.
(3) Gach duine iarrfaidh pinsean, aisce, no liúntas cleithiúnaí fén Acht so déanfaidh, ar an Aire dá cheangal san air, an t-eolas san uile do chur chun an Aire éileoidh an tAire chun an iarratais do bhreithniú.
(4) Féadfaidh an tAire a chur mar cheangal, maidir le haon ráiteas réada déanfar in iarratas ar phinsean no ar aisce no ar liúntas cleithiúnaí fén Acht so no déanfar mar fhreagra ar an Aire ar eisean d'iarraidh eolais fén bhfo-alt deiridh sin roimhe seo, go bhfíorófaí an ráiteas san le dearbhú reachtúil o dhuine éigin go n-eolas pearsanta ar na réada bheidh ann.
Iarrataisí ar phinsin chréachta, ar aiscí créachta, ar phinsin mhí-ábaltachta agus ar liúntaisí cleithiúnaithe do chur fé bhráid Bhord na nArm-Phinsean.
10.—(1) Gach iarratas ar phinsean chréachta, ar aisce chréachta, ar phinsean mhí-ábaltachta no ar liúntas chleithiúnaí cuirfidh an tAire fé bhráid Bhord na nArm-Phinsean é.
(2) Pé uair a cuirfear iarratas fé bhráid Bhord na nArm-Phinsean fén alt so, cuirfid tuarasgabháil chun an Aire i dtaobh na nithe sin eireoidh ar an iarratas san go n-iarrfaidh an tAire ortha tuairisciú ina dtaobh agus, chun crícheanna na tuarasgabhála san, cuirfid fé ndeár an t-iarratas san d'fhiosrú sa tslí sin ordóidh an tAire.
(3) Chun na ndualgas a cuirtear ortha leis an Acht so d'fheidhmiú féadfaidh Bord na nArm-Phinsean na fiosruithe sin uile do dhéanamh, na fínnéithe sin uile do ghairm agus an fhianaise sin do ghlacadh fé mhionn (agus údaruítear leis seo do bhall ar bith daoine do chur fé mhionn) no ar shlí eile is dóich leo is gá.
Grád na mí-ábaltachta do mheas.
11.—(1) Pé uair a thuairisceoidh Bord na nArm-Phinsean go bhfuil duine, is iarratasóir ar phinsean mhí-ábaltachta, fé dhíth gur galar fé ndeár é déanfaid grád na díthe fé n-a bhfuil an duine sin do mheas agus do chur síos sa tuarasgabháil sin.
(2) Is do réir phercentáiste a déanfar gach meas fén alt so ar ghrád díthe agus is céad per cent. a measfar do dhíth iomláin, agus is mar phercentáiste de dhíth iomláin a measfar gach díth is lugha ná díth iomlán.
Deonadh agus tosnú pinsean, etc.
12.—(1) Gach pinsean, aisce, no liúntas cleithiúnaí a deonfar fén Acht so isé an tAire, le toiliú an Aire Airgid, a dheonfaidh é.
(2) Is ón 1adh lá de Dheire Fómhair, 1934, a thosnóidh gach pinsean agus liúntas cleithiúnaí fén Acht so agus beid iníoctha in aghaidh an mhí i riaráiste.
Pinsin, etc., do chur chun críche i gcásanna áirithe.
13.—(1) Más deimhin leis an Aire duine ar bith a bheidh ag fáil pinsin seirbhíse, pinsin chréachta no pinsin mhí-ábaltachta do bheith fé oblagáid dleathach a bhean agus a chlann no éinne acu do chothú agus é do bheith ag tabhairt faillí i gcólíonadh na hoblagáide sin, ansan, má orduíonn agus pé uair agus faid ordóidh an tAire amhlaidh, féadfar, in ionad an phinsin sin d'íoc leis an duine sin, é d'íoc le n-a mhnaoi no do chur chun sochair dá leanbh no dá leanbhaí i pé slí is oiriúnach leis an Aire.
(2) Beidh liúntas cleithiúnaí is iníoctha le leanbh fé bhun sé bliana déag d'aois nach dílleachtaí iníoctha le máthair an leinbh sin ach féadfaidh an tAire, o am go ham, a ordú go ndéanfar, in ionad an liúntais sin d'íoc le máthair an leinbh sin, é d'íoc le duine éigin eile chun sochair an leinbh.
(3) Déanfar liúntas cleithiúnaí is iníoctha le leanbh dílleachtach fé bhun sé bliana déag d'aois d'íoc, chun sochair an leinbh, leis an duine sin ordóidh an tAire o am go ham.
Ciontaí.
14.—(1) Má dheineann no má shighníonn no má úsáideann duine ar bith, d'fhonn deonadh no íoc aon phinsin no aisce no liúntais chleithiúnaí d'fháil do féin no d'éinne eile fén Acht so, aon dearbhú, iarratas no ráiteas scríobhtha eile. agus a fhios aige an céanna bheith bréagach, beidh an duine sin ciontach i gcionta fén Acht so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint fhichead do chur air no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nach sia ná sé mhí no an fhíneáil sin agus an phríosúntacht san le chéile.
(2) Má bhíonn duine ar bith a ciontófar i gcionta fén alt so ag fáil aon phinsin no liúntais chleithiúnaí de bharr aon dearbhuithe no iarratais no ráitis scríobhtha bhréagaigh eile den tsórt san geallbhruidfe sé an pinsean no an liúntas san ar dháta agus o dháta an chiontuithe sin.
(3) Chun crícheanna imeachta mar gheall ar chionta fén alt so, tuigfear an cionta do dhéanamh san áit ina ndearnadh é no in aon áit ina dtárlóidh don chiontathóir a bheith.
(4) In ainneoin éinní atá in alt 10 den Petty Sessions (Ireland) Act, 1851, féadfar cúiseamh alos cionta fén alt so do bhunú laistigh de shé mhí tar éis an dáta ar a bhfuighidh an tAire fianaise chun an chúisimh do shuidheamh agus, chun crícheanna an fho-ailt seo, ní bheidh dul thar deimhniú fé láimh an Aire i dtaobh an dáta ar a bhfuair sé fianaise chun an chúisimh sin do shuidheamh.
Pinsin agus liúntaisí do cheiliúradh.
15.—(1) Fé réir forálacha an ailt seo, féadfaidh an Ard-Chomhairle tráth ar bith, le hordú, aon phinsean no liúntas cleithiúnaí a deonfar fén Acht so do cheiliúradh toisc réasún a luadhfar san ordú san.
(2) Ní déanfar aon phinsean ná liúntas cleithiúnaí fén Acht so do cheiliúradh amhlaidh mara ndeintear ná go dtí go ndéanfar réasúin an cheiliúrtha san do chur in úil i scríbhinn don té bheidh ag fáil an phinsin no an liúntais sin agus caoi réasúnta do thabhairt don duine sin chun pé míniú no freagra no eile is dóich leis is ceart i dtaobh an cheiliúrtha bheartuithe sin no i dtaobh réasún an cheiliúrtha san do chur chun na hArd-Chomhairle.
(3) Gach ordú dhéanfaidh an Ard-Chomhairle fén alt so foillseofar é san Iris Oifigiúil chó luath agus is féidir é tar éis a dhéanta.
Pinsin agus liúntaisí cleithiúnaithe do gheallbhruideadh.
16.—Má dheineann cúirt dlighinse inniúla i Saorstát Éireann duine ar bith dá ndeonfar pinsean no liúntas cleithiúnaí fén Acht so do chiontú in aon choir no cionta le linn an phinsin no an liúntais sin do bheith aige agus go ndaorfaidh an chúirt sin é, mar gheall ar an gcoir no ar an gcionta san, chun príosúntachta i dteanta no d'éamuis daor-oibre ar feadh aon téarma is sia ná trí mhí, no chun pian-tseirbhíse ar feadh téarma ar bith, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) geallbhruidfear an pinsean no an liúntas cleithiúnaí sin ar dháta an chiontuithe sin agus ón dáta san amach;
(b) má cuirtear an cionta agus an daoradh san ar neamh-ní no ar nea-mbrí tuigfear an geallbhruideadh de dheascaibh an chiontuithe agus an daortha san do bheith curtha ar neamh-ní no ar nea-mbrí freisin, agus leis sin beidh an pinsean san no an liúntas cleithiúnaí sin ar marthain arís agus iníoctha maraon le gach riaráiste air d'fhás o dháta an chiontuithe sin.

17.—(1) Gach sannadh déanfar agus gach muirear a cuirfear ar aon phinsean, aisce no liúntas cleithiúnaí fén Acht so, agus gach có-aontú chun san do shannadh no do chur fé mhuirear, beid gan bhrí gan éifeacht ach amháin sa mhéid go mbeid údaruithe le hAcht a bheidh i bhfeidhm de thurus na huaire.
(2) Ní bheidh aon phinsean ná aisce ná liúntas cleithiúnaí fén Acht so ion-tógtha i bhfeidhmiúchán ná ion-aistrithe ar shlí eile le hoibriú dlí chun íoctha aon fhiacha no fiachaisí de chuid an duine dar deonadh an pinsean no an aisce no an liúntas cleithiúnaí sin.
(3) Ní chuirfidh éinní san alt so cosc le haon airgead a bheidh dlite agus ag dul d'aon Aire, is ceann ar Roinn Stáit, no d'aon Roinn phuiblí de Rialtas Shaorstáit Éireann ón duine le n-a mbeidh pinsean no aisce no liúntas cleithiúnaí iníoctha fén Acht so do bhaint as an bpinsean no as an aisce no as an liúntas cleithiúnaí sin.
Pinsin dúbalta do chur ar fiunraoi agus do chosc.
18.—(1) I gcás duine ar bith le n-a mbeidh pinsean seirbhíse iníoctha fén Acht so do bheith, aon uair le linn an phinsin sin do bheith aige, ag fáil aon luach saothair no pinsin (seachas pinsean créachta no pinsean mí-ábaltachta is iníoctha fén Acht so) no liúntais is iníoctha amach as airgead puiblí, pe'ca ar n-a sholáthar ag an Oireachtas do no amach as an bPrímh-Chiste no tríd an ráta dealbhais no tré aon ráta eile ar n-a ghearradh ag údarás áitiúil, déanfar, faid a bheidh an duine sin ag fáil an luach saothair no an phinsin no an liúntais sin, an pinsean seirbhíse sin do chur ar fiunraoi i méid a háirmheofar do réir na rialacha atá sa Tríú Sceideal a ghabhann leis an Acht so.
(2) I gcás—
(a) duine do bheith i dteideal pinsin seirbhíse fada, agus
(b) gur giorra ná bliain agus fiche seirbhís airm an duine sin, agus
(c) an duine sin d'fhónamh i Stát-Sheirbhís Rialtais Shaorstáit Éireann ar feadh aon tréimhse (dá ngairmtear an tréimhse de stát-sheirbhís sa bhfo-alt so) a tháinig laistigh dá thréimhse de sheirbhís tuigthe,
ní bheidh an duine sin i dteideal an tréimhse de stát-sheirbhís d'áireamh chun crícheanna aois-liúntais fé sna hAchtanna Aoisliúntas, 1834 go 1923, mar a leasuítear san le haon achtachán ina dhiaidh sin, mara dtuga sé suas cuid den phinsean seirbhíse fada san go mbeidh idir í agus iomlán an phinsin seirbhíse fada san an cothrom céanna bheidh idir an tréimhse de stát-sheirbhís agus bliain agus fiche.
Nithe áirithe do chinneadh.
19.—Gach ceist eireoidh fén Acht so maidir le héinní acu so leanas sé sin le rá:—
(a) tréimhse sheirbhíse airm dhuine cháilithe agus dáta tosnuithe na seirbhíse sin,
(b) an chéim shubstainteach nea-choimisiúnta (más ann di) do bhí ag duine cáilithe ar dháta na Cúlmhutaireachta,
(c) i gcás duine cháilithe ag á raibh céim shubstainteach neachoimisiúnta áirithe ar dháta na Cúlmhutaireachta, an tréimhse no na tréimhsí gur le n-a linn a bhí an chéim nea-choimisiúnta san, no aon chéim shubstainteach neachoimisiúnta is ísle no is aoirde ná san, aige roimh dháta na Cúlmhutaireachta,
(d) tréimhse sheirbhíse tuigthe dhuine cháilithe gur seirbhís fhada a sheirbhís airm, isé an tAire do bhéarfaidh breith uirthi, agus beidh breith an Aire ina breith dheiridh gan aon dul tháirsi agus ina ceangal ar gach duine agus bínse ar bith.

20.—(1) Féadfaidh an tAire, do réir rialachán ar n-a ndéanamh fé fho-alt (2) den alt so, íocaíochtaí in aghaidh costaisí taistil agus liúntais chothuithe d'íoc, amach as airgead a sholáthróidh an tOireachtas, le lucht iarrtha pinsean créachta, aiscí créachta agus pinsean mí-ábaltachta nuair a thiocfaid i láthair i gcathair no i gcontae Bhaile Atha Cliath chun dul fé scrúdú dhoctúra le hordú Bhord na nArm-Phinsean agus le daoine thiocfaidh i láthair i gcathair no i gcontae Bhaile Atha Cliath mar fhínnéithe os cóir Bhord na nArm-Phinsean do réir gairme o Bhord na nArm-Phinsean.

CONNAUGHT RANGERS (PENSIONS) ACT, 1936.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Defence;
the expression “the Mutiny” means the mutiny of certain members of the 1st Battalion, the Connaught Rangers, which took place in June and July, 1920, at Solon and Jullundur in India;
the expression “the General Court-martial” means the British General Court-martial which assembled in August, 1920, at Dagshai in India for the purposes of trying certain members of the 1st Battalion, the Connaught Rangers, on charges arising out of the Mutiny;
the expression “army service” means British army service preceding the Mutiny together with any period spent in prison or internment awaiting trial by the General Court-martial and any period spent in prison following on a sentence by the General Court-martial;
the expression “long service” means army service amounting to more than twelve years;
the expression “pre-1918 short service” means army service which does not exceed twelve years and which commenced before the 18th day of April, 1918;
the expression “post-1918 short service” means army service which does not exceed twelve years and which commenced on or after the 18th day of April, 1918;
the expression “period of notional service” means, in relation to any person whose army service is long service, the period which commenced at the expiration of his army service and ended at the expiration of a number of days equal to the number of days by which his army service fell short of twenty-one years;
the word “wound” means an interruption of the normal continuity of body tissue caused by direct or indirect violence but does not include any injury due to the serious negligence or misconduct of the person suffering therefrom;
the word “disablement” means an injury of a permanent nature resulting in impairment of function caused by wound or disease and not due to the serious negligence or misconduct of the person suffering therefrom;
the expression “degree of disablement” when used in relation to a disablement means the degree of disablement assessed in respect of such disablement by the Army Pensions Board.
“Qualified persons.”
2.—In this Act the expression “a qualified person” means a person in respect of whom the Minister certifies that—
(a) he was a member of the 1st Battalion, the Connaught Rangers, and
(b) he joined in the Mutiny, and
(c) he was, in consequence of so joining, sentenced by the General Court-martial to death, penal servitude, or imprisonment for any term of not less than twelve months.
Service pensions.
3.—(1) There may, subject to the provisions of this Act, be granted to a qualified person whose army service is long service, a pension (in this Act referred to as a long service pension) payable during his life.
(2) A long service pension payable to any person shall be as follows, that is to say:—
(a) in case such person did not at the date of the Mutiny hold the substantive rank of corporal or substantive higher non-commissioned rank, such pension shall consist of an allowance at the rate of two shillings and sevenpence halfpenny per day;
(b) in case such person held at the date of the Mutiny the substantive rank of corporal, such pension shall consist of—
(i) an allowance at the rate of two shillings and sevenpence halfpenny per day, and
(ii) an additional allowance at the rate of one halfpenny per day for each complete year of his pensionable service during which he held the substantive rank of corporal;
(c) in case such person held at the date of the Mutiny the substantive rank of sergeant or substantive higher non-commissioned rank, such pension shall consist of—
(i) an allowance at the rate of two shillings and sevenpence halfpenny per day, and
(ii) an additional allowance at the rate of one penny per day for each complete year of his pensionable service during which he held the substantive rank of sergeant or substantive higher non-commissioned rank, and
(iii) an additional allowance at the rate of one halfpenny per day for each complete year (if any) of his British Army service preceding the Mutiny during which he held the substantive rank of corporal.
(3) For the purposes of sub-section (2) of this section—
(a) the pensionable service of a person shall be taken to be the sum of his army service and his period of notional service;
(b) a person who at the date of the Mutiny held any substantive non-commissioned rank shall be deemed to have continued to have held that rank during the period commencing on the date of the Mutiny and ending at the expiration of his period of notional service;
(c) in the case of a person who held at the date of the Mutiny the substantive rank of corporal, the number of complete years during which he held the substantive rank of corporal shall be taken to be the result obtained by dividing by three hundred and sixty-five a number equal to the number of days during which he held that substantive rank or a substantive higher non-commissioned rank, any fraction being disregarded;
(d) in the case of a person who held at the date of the Mutiny the substantive rank of sergeant or a substantive higher non-commissioned rank—
(i) the number of complete years during which he held the substantive rank of sergeant or substantive higher non-commissioned rank shall be taken to be the result obtained by dividing by three hundred and sixty-five a number equal to the number of days during which he held the substantive rank of sergeant or substantive higher non-commissioned rank, any fraction being disregarded, and
(ii) the number of complete years (if any) during which he held the substantive rank of corporal shall be taken to be the result obtained by dividing by three hundred and sixty-five a number equal to the number of days during which he held the substantive rank of corporal, any fraction being disregarded.
(4) There may, subject to the provisions of this Act, be granted to a qualified person whose army service is pre-1918 short service a pension (in this section referred to as a short service pension) payable during his life at the rate of ten shillings and sixpence per week.
(5) The expression “a service pension” where it occurs in the subsequent provisions of this Act shall be construed as equivalent to the words “a long service pension or a short service pension”.
Service gratuities.
4.—There may, subject to the provisions of this Act, be granted to a qualified person whose army service is post-1918 short service a gratuity (in this Act referred to as a service gratuity) of such amount (not exceeding one hundred and fifty pounds) as the Minister shall, with the consent of the Minister for Finance, determine.
Wound pensions and gratuities.
5.—(1) Where a qualified person is suffering from a disablement caused by a wound certified by the Minister to be attributable to the Mutiny or to circumstances directly arising out of the Mutiny, the following provisions shall have effect, that is to say:—
(a) if the degree of such disablement at the date of his examination by the Army Pensions Board is not less than twenty per cent. there may, in addition to a service pension or a service gratuity, be granted to such person a pension (in this Act referred to as a wound pension) payable during his life at, in case his army service is long service, the rate mentioned in the third column of the First Schedule to this Act opposite to the appropriate degree of disablement mentioned in the second column of that Schedule or, in case his army service is pre-1918 short service, the rate mentioned in the fourth column of that Schedule opposite to the appropriate degree of disablement mentioned in the said second column or, in case his army service is post-1918 short service, the rate mentioned in the fifth column of that Schedule, opposite to the appropriate degree of disablement mentioned in the said second column;
(b) if the degree of such disablement at the date of his examination by the Army Pensions Board is less than twenty per cent. there may, in addition to a service pension or a service gratuity, be granted to such person a gratuity (in this Act referred to as a wound gratuity) of such amount (not exceeding thirty pounds) as the Minister, having regard to all the circumstances of the case, shall, with the consent of the Minister for Finance, determine.
(2) Where a person is suffering from any of the disablements mentioned in the first column of the First Schedule to this Act, the degree of such person's disablement shall, for the purposes of this section, be the degree set out in the second column of that Schedule opposite to the disablement from which such person is suffering.
(3) In the case of a person who is suffering from a disablement, caused by a wound, not mentioned in the first column of the First Schedule to this Act, the degree of such person's disablement for the purposes of this section shall be the degree assessed in that behalf by the Army Pensions Board.
Disability pensions.
6.—Where a qualified person is suffering from a disablement caused by disease certified by the Minister to be attributable to the Mutiny or to circumstances directly arising out of the Mutiny and the degree of such disablement is at the date of his examination by the Army Pensions Board not less than eighty per cent. there may, in addition to a service pension or a service gratuity, be granted to such person a pension (in this Act referred to as a disability pension) payable during his life at, in case his army service is long service, the rate mentioned in the second column of the Second Schedule to this Act opposite the appropriate degree of disablement mentioned in the first column of that Schedule or, in case his army service is pre-1918 short service, the rate mentioned in the third column of that Schedule opposite to the appropriate degree of disablement mentioned in the said first column or, in case his Army service is post-1918 short service, the rate mentioned in the fourth column of that Schedule, opposite to the appropriate degree of disablement mentioned in the said first column.
Double disablement.
7.—Where—
(a) a person is suffering from a disablement (in this section referred to as the disease disablement) caused by a disease the degree of which is less than eighty per cent. and the circumstances are such that such person could be granted a disability pension in respect of the disease disablement if the degree of disablement had equalled or exceeded eighty per cent., and
(b) such person is also suffering from a disablement (in this section referred to as the wound disablement) caused by a wound in respect of which he could be granted a wound pension, or could, if the degree of disablement had equalled or exceeded twenty per cent., be granted a wound pension,
then, for the purposes of the two immediately preceding sections the following provisions shall have effect, that is to say:—
(i) the degree of his disablement shall be the sum total of the degree of the disease disablement and the degree of the wound disablement,
(ii) if the said sum total exceeds one hundred per cent., the degree of disablement shall be reckoned as one hundred per cent.,
(iii) the whole of his disablement shall be deemed to have been caused by the wound.
Dependants allowances.
8.—(1) Subject to the provisions of this section, there may, on account of the death of any person to whom this section applies, be granted the following allowances, that is to say:—
(a) to the widow of such person, an allowance (in this Act referred to as a dependant's allowance) payable during widowhood at the rate of ten shillings per week;
(b) if and so long as there are two or more children of such person under the age of sixteen years—
(i) to the eldest or elder of such children, an allowance (in this Act also referred to as a dependant's allowance) at the rate of five shillings per week,
(ii) in case there are three or more such children, to each of such children (other than the eldest) or, in case there are two such children only, to the younger of such children an allowance (in this Act also referred to as a dependant's allowance) at the rate of three shillings per week;
(c) if and so long as there is one child only of such person under the age of sixteen years, to such child an allowance (in this Act also referred to as a dependant's allowance) at the rate of five shillings per week.
(2) There may, on account of the death of any person to whom, by virtue of sub-section (4) of this section, this section applies, be granted to the father of such person an allowance (in this Act referred to as a dependant's allowance) payable during his life at the rate of ten shillings per week.
(3) This section applies to every person who is certified by the Minister—
(a) to have been a member of the 1st Battalion, the Connaught Rangers, and
(b) to have joined in the Mutiny, and
(c) to have been killed in the Mutiny.
(4) This section also applies to every person who is certified by the Minister—
(a) to have been a member of the 1st Battalion, the Connaught Rangers, and
(b) to have joined in the Mutiny, and
(c) to have been executed in accordance with a sentence passed by the General Court-martial.
(5) This section also applies to every person—
(a) who is certified by the Minister—
(i) to have been a member of the 1st Battalion, the Connaught Rangers, and
(ii) to have joined in the Mutiny, and
(iii) to have been sentenced, in consequence of his so joining, by the General Court-martial to death, penal servitude or imprisonment for any term not less than twelve months, and
(b) who died before the date of the passing of this Act, and
(c) whose death is certified by the Minister to have been attributable to wound or disease arising out of the Mutiny.
(6) No dependant's allowance shall be granted under this section to the widow of a person to whom, by virtue of sub-section (5) of this section, this section applies, if the marriage took place after the 30th day of June, 1920.
(7) No dependant's allowance shall be granted under this section to the child of a person to whom, by virtue of sub-section (5) of this section, this section applies, if the marriage of such person to the mother of such child took place after the 30th day of June, 1920.
Applications for pension etc.
9.—(1) Every application for a pension, gratuity, or dependant's allowance under this Act shall be made not later than the 31st day of December, 1937.
(2) Every application for a pension, gratuity, or dependant's allowance under this Act shall be made to the Minister in such form as the Minister may direct and shall contain such particulars as the Minister may require.
(3) Every person applying for a pension, gratuity, or dependant's allowance under this Act shall, when required by the Minister so to do, furnish to the Minister all such information as the Minister may require for the consideration of the application.
(4) The Minister may require any statement of fact made in an application for a pension, gratuity, or dependant's allowance under this Act or made to the Minister in response to a request for information under the immediately preceding sub-section to be verified by the statutory declaration of some person having personal knowledge of the facts so stated.
Reference of applications for wound pensions, wound gratuities, disability pensions and dependants' allowances to the Army Pensions Board.
10.—(1) Every application for the grant of a wound pension, a wound gratuity, a disability pension, or a dependant's allowance shall be referred by the Minister to the Army Pensions Board.
(2) Whenever an application is referred to the Army Pensions Board under this section, they shall report to the Minister on such matters arising on such application as they may be requested by the Minister to report upon, and for the purposes of such report shall cause such application to be investigated in such manner as the Minister may direct.
(3) The Army Pensions Board may for the purposes of carrying out the duties imposed on them by this Act make all such inquiries, summon all such witnesses and take such evidence on oath (which any member is hereby authorised to administer) or otherwise, as they may deem necessary.
Assessment of degree of disability.
11.—(1) Whenever the Army Pensions Board report that a person, who is an applicant for a disability pension, is suffering from a disablement caused by disease they shall assess and state in such report the degree of disablement from which such person is suffering.
(2) Every assessment under this section of a degree of disablement shall be made on a percentage basis, and total disablement shall be assessed at one hundred per cent., and every disablement less than total disablement shall be assessed as a percentage of total disablement.
Grant and commencement of pensions, etc.
12.—(1) Every award of a pension, gratuity, or dependant's allowance under this Act shall be made by the Minister with the consent of the Minister for Finance.
(2) Every pension and dependant's allowance under this Act shall commence from the 1st day of October, 1934, and shall be payable monthly in arrear.
Application of pensions, etc., in certain cases.
13.—(1) Where the Minister is satisfied that any person, who is in receipt of a service pension, a wound pension, or a disability pension, is under a legal obligation to maintain his wife and children or any of them and is neglecting to fulfil such obligation, such pension may, if and whenever and for so long as the Minister so directs, in lieu of being paid to such person, be paid to his wife or applied, in such manner as the Minister thinks fit, for the benefit of his child or children.
(2) A dependant's allowance payable to a child under the age of sixteen who is not an orphan shall be payable to the mother of such child, but the Minister may from time to time direct that such allowance shall, in lieu of being paid to the mother of such child, be paid to some other person for the benefit of the child.
(3) A dependant's allowance payable to an orphan child under the age of sixteen years shall be paid to such person as the Minister may from time to time direct for the benefit of the child.
Offences.
14.—(1) If any person, with a view to obtaining for himself or any other person a grant or payment of any pension, gratuity or dependant's allowance under this Act, makes, signs, or uses any declaration, application, or other written statement knowing the same to be false, such person shall be guilty of an offence under this Act, and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds, or, at the discretion of the Court, either to imprisonment for any term not exceeding six months or to both such fine and imprisonment.
(2) If any person convicted of an offence under this section is in receipt of any pension or dependant's allowance obtained by reason of any such false declaration, application or other written statement, he shall forfeit such pension or allowance as on and from the date of such conviction.
(3) For the purposes of proceedings in respect of an offence under this section, the offence shall be deemed to have been committed either at the place where it was actually committed or any place where the offender may happen to be.
(4) Notwithstanding anything contained in section 10 of the Petty Sessions (Ireland) Act, 1851, a prosecution for an offence under this section may be brought within six months after the date when evidence to sustain the prosecution came to the notice of the Minister, and a certificate under the hand of the Minister as to the date on which evidence to sustain such prosecution came to his notice shall for the purposes of this sub-section be conclusive.
Revocation of pensions and allowances.
15.—(1) Subject to the provisions of this section, the Executive Council may at any time by order revoke for reasons stated in such order any pension or dependant's allowance granted under this Act.
(2) No pension or dependant's allowance under this Act shall be so revoked unless or until the reasons for such revocation have been communicated in writing to the person in receipt thereof and such person has been given a reasonable opportunity of making to the Executive Council such explanation, answer or other case as he may think proper in relation to such proposed revocation or the reasons thereof.
(3) Every order made by the Executive Council under this section shall be published in the Iris Oifigiúil as soon as may be after it is made.
Forfeiture of pensions and dependants' allowances.
16.—If any person to whom a pension or dependant's allowance has been granted under this Act is, during the continuance of such pension or allowance, convicted of any crime or offence by a court of competent jurisdiction in Saorstát Eireann and sentenced by that court for that crime or offence to imprisonment, with or without hard labour, for any term exceeding three months or to penal servitude for any term, the following provisions shall have effect, that is to say:—
(a) such pension or dependant's allowance shall be forfeited as on and from the date of such conviction;
(b) if such conviction and sentence is quashed or annulled, the forfeiture consequent on such conviction and sentence shall be deemed to have been quashed or annulled also, and such pension or dependant's allowance shall be thereupon revived and payable together with all arrears thereof accruing since the date of such conviction.
Prohibition of assignment, etc., of pensions and gratuities and dependants' allowances.
17.—(1) Every assignment of and every charge on and every agreement to assign or charge any pension, gratuity, or dependant's allowance under this Act shall, except so far as the same is authorised by an Act for the time being in force, be null and void.
(2) No pension, gratuity, or dependant's allowance under this Act shall be capable of being taken in execution or otherwise alienated by process of law for the payment of any debts or liabilities of the person to whom such pension, gratuity, or dependant's allowance is granted.
(3) Nothing in this section shall prevent the deduction from any pension, gratuity, or dependant's allowance payable under this Act of any moneys which may be due and owing to any Minister, head of a Department of State, or any public department of the Government of Saorstát Eireann by the person to whom such pension, gratuity, or dependant's allowance is payable.
Suspension and prohibition of double pensions.
18.—(1) If any person to whom a service pension is payable under this Act shall at any time during the continuance of such pension be in receipt of any remuneration, pension (other than a wound pension or a disability pension payable under this Act) or allowance payable out of public moneys, whether provided by the Oireachtas or out of the Central Fund or by means of the poor rate or any other rate imposed by a local authority, the said service pension shall, while he is in receipt of such remuneration, pension or allowance, be suspended to an extent calculated according to the rules contained in the Third Schedule to this Act.
(2) Where—
(a) a person is entitled to a long service pension, and
(b) such person's army service is less than twenty-one years, and
(c) such person served in the Civil Service of the Government of Saorstát Eireann for any period (in this sub-section referred to as the period of civil service) which fell within his period of notional service,
such person shall not be entitled to reckon the period of civil service for the purposes of a superannuation allowance under the Superannuation Acts, 1834 to 1923, as amended by any subsequent enactment, unless he surrenders a part of the said long service pension which bears to the whole of the said long service pension the same proportion as the period of civil service bears to twenty-one years.
Determination of certain matters.
19.—Every question arising under this Act in relation to any of the following matters, that is to say:—
(a) the period of army service of a qualified person and the date of commencement of such service,
(b) the substantive non-commissioned rank (if any) held, at the date of the Mutiny, by a qualified person,
(c) in the case of a qualified person who held a particular substantive non-commissioned rank at the date of the Mutiny, the period or periods during which he held such non-commissioned rank or any substantive lower or higher non-commissioned rank before the date of the Mutiny,
(d) the period of notional service of a qualified person whose army service was long service, shall be determined by the Minister and the determination of the Minister shall be final and conclusive, and binding on all persons and tribunals whatsoever.
Travelling expenses and subsistence.
20.—(1) Payments for travelling expenses and for subsistence allowance may, in accordance with regulations made under sub-section (2) of this section, be made by the Minister, out of moneys provided by the Oireachtas, to applicants for wound pensions, wound gratuities and disability pensions when attending in the city or county of Dublin for medical examination by direction of the Army Pensions Board and to persons attending in the city or county of Dublin as witnesses before the Army Pensions Board pursuant to a summons by the Army Pensions Board.
(2) The Minister may, with the consent of the Minister for Finance, by order make regulations prescribing the amounts of the payments which may be made for travelling expenses and subsistence allowance under the immediately preceding sub-section and the circumstances in which and conditions under which such payments may be made.
Expenses.
21.—(1) All pensions, gratuities, and dependants' allowances payable under this Act shall be paid out of moneys provided by the Oireachtas.
(2) All other expenses incurred in carrying this Act into execution shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Short title.
22.—This Act may be cited as the Connaught Rangers (Pensions) Act, 1936.

1. Subject to the provisions of Rule 2 of this Schedule, the extent to which the payment of a service pension shall be suspended under Section 18 of this Act, where the person in receipt of such pension is in receipt of any remuneration, pension (other than a wound pension or disability pension) or allowance payable out of public moneys, shall be as follows:—

2. Where the total of the amount payable to any person out of public moneys and the amount payable to such person in respect of a service pension within the limits specified at B. C, D, E, F, G, H, I, J, or K of Rule 1 of this Schedule would under the terms of the said Rule be less than the amount which such person would receive if the amount payable to him out of public moneys were at the maximum of the limit immediately preceding, then and in every such case the extent of the suspension of his service pension shall be reduced so that the total of the amount payable to him out of public moneys and of his service pension shall not be less than that which he would receive if the amount payable out of public moneys were at the maximum of the limit immediately preceding.
