ACHT I dTAOBH DEARBHUITHE REACHTÚLA, 1938.
Dearbhuithe reachtúla.
1.—(1) Is dleathach d'aon duine acu so leanas, sé sin le rá:—
(a) nótaire puiblí,
(b) coimisinéir mionn,
(c) feadhmannach síochána,
(d) duine dá n-údaruítear le dlí dearbhuithe reachtúla do thógaint agus do ghlacadh,
dearbhú scríobhtha dhuine ar bith, is dearbhú ar n-a dhéanamh ag an duine sin ina fhianaise sa bhfuirm atá leagtha amach sa Sceideal a ghabhann leis an Acht so, do thógaint agus do ghlacadh.
(2) Is dearbhú reachtúil a gairmfear chun gach críche de dhearbhú ar n-a dhéanamh fén alt so agus isé sin do bheirtear air san Acht so, agus, d'ainneoin éinní atá in aon reacht eile, déanfar an abairt “dearbhú reachtúil” do léiriú agus beidh éifeacht aici (ach amháin más dearbhú no sa mhéid gur dearbhú do rinneadh roimh an Acht so do rith a bheidh i gceist), i ngach reacht no ionstruim reachtúil atá i bhfeidhm anois no a hachtófar no déanfar ina dhiaidh seo, mar abairt a chialluíonn dearbhú ar n-a dhéanamh fén alt so.
(3) Sá chéad fho-alt den alt so cialluíonn an abairt “duine dá n-údaruítear le dlí dearbhuithe reachtúla do thógaint agus do ghlacadh” duine dá n-údaruítear le haon reacht no fé aon reacht (ar n-a achtú roimh an Acht so do rith no dá éis sin) dearbhuithe reachtúla do thógaint agus do ghlacadh, agus foluíonn sí duine dá n-údaruítear amhlaidh dearbhuithe reachtúla do thógaint agus do ghlacadh o dhaoine áirithe no o aicme áirithe daoine no chun críche áirithe no i gcásanna áirithe.
Dearbhuithe reachtúla do shighniú agus do theistiú.
2.—(1) Gach dearbhú reachtúil a déanfar sighneoidh neach a dhéanta é i láthair an duine gur ina fhianaise a déanfar é agus teisteofar ansan é tríd an duine sin gur ina fhianaise a déanfar é do shighniú teistithe ag á bhun a bheidh sa bhfuirm agus ina mbeidh na mion-innste atá leagtha amach i bhfuirm an dearbhuithe reachtúil atá sa Sceideal a ghabhann leis an Acht so.
(2) Lasmuich de chás dá bhforáltar a mhalairt leis an alt so, ní dhéanfaidh aon duine (dá ngairmtear an duine céad-luaidhte sa bhfo-alt so) dearbhú reachtúil do thógaint ná do ghlacadh o dhuine eile (dá ngairmtear an dearbhuitheoir sa bhfo-alt so) mara mbeidh aithne phearsanta ag an duine céad-luaidhte ar an dearbhuitheoir no mara ndeinidh duine go mbeidh aithne phearsanta ag an duine céad-luaidhte air an dearbhuitheoir do chur in aithne dhó.
(3) Ní bhainfidh an fo-alt deiridh sin roimhe seo den alt so le duine dá n-údaruítear le reacht (ar n-a rith roimh an Acht so do rith no dá éis sin) dearbhuithe reachtúla do ghlacadh agus do thógaint o dhaoine áirithe no o aicme áirithe daoine chun crícheanna an reachta san, agus dá réir sin, nuair a dhéanfaidh duine go n-údarás amhlaidh aon dearbhú reachtúil den tsórt san do ghlacadh agus do thógaint, féadfar na focail “duine go bhfuil aithne phearsanta agam air (no duine do chuir C.D., duine go bhfuil aithne phearsanta agam air, in aithne dhom)” d'fhágaint ar lár sa dearbhú reachtúil sin.

4.—Má bhíonn i bhfuirm dhearbhuithe, do horduíodh roimh an Acht so do rith le haon reacht no fé aon reacht (seachas an Statutory Declarations Act, 1835) agus atá i bhfeidhm le linn an rithte sin, ráiteas á rá gur de bhuadh an Statutory Declarations Act, 1835, atá an dearbhú san á dhéanamh, agus go mbeidh sé ráite sa dearbhú san no gó dtuigfear uaidh é bheith le déanamh fé alt 18 den Acht san, beidh éifeacht ag na forálacha so leanas, maidir le haon dearbhú den tsórt san a déanfar tar éis an Achta so do rith, sé sin le rá:—
(a) déanfar an fhuirm do horduíodh amhlaidh den dearbhú san d'atharú i slí go mbeidh sí ar aon dul (do réir mar a bheidh oiriúnach) leis an bhfuirm atá leagtha amach sa Sceideal a ghabhann leis an Acht so no leis an bhfuirm sin agus na focail “duine go bhfuil aithne phearsanta agam air (no duine do chuir C.D., duine go bhfuil aithne phearsanta agam air, in aithne dhom)” fágtha ar lár inti, agus
(b) tuigfear chun gach críche gur fé alt 1 den Acht so do rinneadh an dearbhú san ar n-a dhéanamh sa bhfuirm atharuithe sin.

5.—Gach nótaire puiblí agus gach coimisinéir mionn a thógfaidh agus a ghlacfaidh dearbhú reachtúil beidh sé i dteideal na dtáillí céanna d'éileamh agus d'fháil as a ucht san a bheadh sé i dteideal d'éileamh agus d'fháil dá mba dhearbhóid ar n-a déanamh ina fhianaise an dearbhú reachtúil sin.

6.—Gach duine dhéanfaidh dearbhú reachtúil a bheidh go bhfios dó bréagach no mí-threorach in aon phonc táchtach beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar caoga punt do chur air no, más rogha leis an gCúirt é, príosúntacht ar feadh téarma nach sia ná trí mhí no an fhíneáil sin agus an phríosúntacht san le chéile.

7.—(1) Athghairmtear leis seo alt 18 den Statutory Declarations Act, 1835.
(2) Ní bhainfidh éinní atá san Acht so le dearbhú do dhéanamh ná ní dhéanfaidh deifir do dhearbhú do dhéanamh fé réim no do bhun aon fhorála den Statutory Declarations Act, 1835, seachas an t-alt san 18 de.

STATUTORY DECLARATIONS ACT, 1938.
Statutory declarations.
1.—(1) It shall be lawful for any of the following persons, that is to say:—
(a) a notary public,
(b) a commissioner for oaths,
(c) a peace commissioner,
(d) a person authorised by law to take and receive statutory declarations,
to take and receive the declaration in writing of any person making the same before him in the form set out in the Schedule to this Act.
(2) A declaration made under this section shall be known for all purposes as and is in this Act called a statutory declaration, and, notwithstanding anything contained in any other statute, the expression “statutory declaration” (save if or in so far as it refers to a declaration made before the passing of this Act) shall, in every statute or statutory instrument now in force or hereafter enacted or made, be construed and have effect as meaning a declaration made under this section.
(3) In the first sub-section of this section the expression “a person authorised by law to take and receive statutory declarations” means a person authorised by or under any statute (whether enacted before or after the passing of this Act) to take and receive statutory declarations, and includes a person so authorised to take and receive statutory declarations from particular persons or a particular class of persons or for a particular purpose or in particular circumstances.
Signing and attestation of statutory declarations.
2.—(1) Every statutory declaration shall be signed by the person making the same in the presence of the person before whom it is made and shall then be attested by the said person before whom it is made signing an attestation at the foot thereof in the form and containing the particulars set out in the form of statutory declaration in the Schedule to this Act.
(2) Save as is otherwise provided by this section, no person (in this sub-section referred to as the first-mentioned person) shall take or receive a statutory declaration from another person (in this sub-section referred to as the declarant) unless the declarant is personally known to the first-mentioned person or is identified to him by a person who is personally known to him.
(3) The next preceding sub-section of this section shall not apply to a person who is authorised by statute (whether passed before or after this Act) to receive and take statutory declarations from particular persons or a particular class of persons for the purposes of that statute, and accordingly, where any such statutory declaration is received and taken by a person so authorised, the words “who is personally known to me (or who is identified to me by C.D. who is personally known to me)” may be omitted from such statutory declaration.
Restriction on persons specially authorised.
3.—Where a person is or shall be authorised by law to receive and take statutory declarations from particular persons or a particular class of persons or for a particular purpose or in particular circumstances, nothing in this Act shall operate to authorise such person to receive and take statutory declarations otherwise than (as the case may be) from the said particular persons or particular class of persons or for the said particular purpose or in the said particular circumstances.
Adaptation of existing statutory forms.
4.—Wherever a form of declaration, prescribed before the passing of this Act by or under any statute (other than the Statutory Declarations Act, 1835) and in force at such passing, contains a statement that such declaration is made by virtue of the Statutory Declarations Act, 1835, and such declaration is, expressly or by implication, to be made under section 18 of that Act, the following provisions shall, as regards any such declaration made after the passing of this Act, have effect, that is to say:—
(a) the form so prescribed of such declaration shall be altered so as to conform either (as may be appropriate) to the form set out in the Schedule to this Act or to that form with the omission therefrom of the words “who is personally known to me (or who is identified to me by C.D. who is personally known to me)”, and
(b) such declaration made in such altered form shall be deemed for all purposes to be made under section 1 of this Act.
Fees chargeable by notaries public and commissioners for oaths.
5.—Every notary public and every commissioner for oaths who shall take and receive a statutory declaration shall be entitled to charge and be paid therefor the like fees as he would be entitled to charge and be paid if such statutory declaration were an affidavit made before him.
Penalty for false declaration.
6.—Every person who makes a statutory declaration which to his knowledge is false or misleading in any material respect shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds or, at the discretion of the Court, to imprisonment for a term not exceeding three months or to both such fine and such imprisonment.
Repeal and saving.
7.—(1) Section 18 of the Statutory Declarations Act, 1835, is hereby repealed.
(2) Nothing in this Act shall apply to or affect the making of a declaration under or in pursuance of any provision of the Statutory Declarations Act, 1835, other than the said section 18 thereof.
Short title.
8.—This Act may be cited as the Statutory Declarations Act, 1938.
